Welcome to the 38th edition of our Sunbelt Realty magazine! In edition 37 of our Sunbelt Realty magazine, we explained to you why we still compose this magazine. Despite that valid reason why we have a hard copy magazine, we realized that digital and on-line information sources are a powerful tool to get our listings "across the limelight". Therefor we are very pleased to inform you about our brand new Sunbelt Realty website. KPMG Meijburg EtCo Caribbean Tax Et Legal Uw fiscale woonplaats bepaalt uw belastingplicht Wanneer u niet uit Caribisch Nederland afkomstig bent maar hier voor langere tijd wenst te verblijven dient u te verzoeken om een verblijfsvergunning, of indien van toepassing, een 'toelating van rechtswege'. Indien deze wordt toegekend kunt u zich inschrijven in de basisadministratie en ontvangt u een identiteitskaart. Of u dan ook voor de belastingheffing als inwoner van Caribisch Nederland wordt aangemerkt, is een ander vraagstuk. Als fiscaal inwoner zou u binnenlands belastingplichtig voor de inkomstenbelasting zijn en in Caribisch Nederland over uw wereldwijde inkomen - inclusief opbrengsten van bijvoorbeeld buitenlandse aandelen, spaar- en beleggingsrekeningen - belasting betalen. Als fiscaal niet-inwoner zou u echter alleen inkomstenbelasting hoeven te betalen over uw inkomen uit Caribisch Nederland.

Het verkrijgen van een identiteitskaart betekent niet automatisch dat Caribisch Nederland ook als uw fiscale woonplaats moet worden aangemerkt. Ook andersom geldt dit: iemand die niet is ingeschreven kan toch als fiscaal inwoner kwalificeren en binnenlands belastingplichtig zijn. De basisadministratie kan normaal gesproken wel als startpunt worden gebruikt voor het bepalen van uw fiscale woonplaats, maar is meestal niet doorslaggevend. De fiscale woonplaats wordt namelijk 'naar de omstandigheden' beoordeeld. Welke 'omstandigheden' precies relevant zijn, is in de jurisprudentie uitgewerkt. Onder meer dient beoordeeld te worden of u met Caribisch Nederland duurzame betrekkingen heeft van persoonlijke aard. Factoren zoals een verblijfsvergunning en identiteitskaart zijn ondergeschikt aan andere factoren zoals de locatie van uw hoofdverblijf, voor welke doeleinden u in Caribisch Nederland verblijft, waar u uw familie en vriendenkring zich bevinden en in welk(e) land(en) u werkzaam bent en uw inkomen geniet.

Your tax residence determines your tax obligations If you do not originate from the Caribbean Netherlands but wish to stay here for a longer period you have to request a residence permit or, if applicable, an ’admission ex jure’. If your request is granted you can be registered in the civil register and obtain an identity card. Whether the Caribbean Netherlands is also your country of residence for tax purposes, is a different issue. As a tax resident of the Caribbean Netherlands your worldwide income would be subject to income tax in the Caribbean Netherlands, including income derived from, for example, shares in foreign companies, savings and investment accounts. As a non-resident for tax purposes, income tax would only be due on your income derived from the Caribbean Netherlands.

Obtaining an identity card does not automatically result in the Caribbean Netherlands becoming your tax residence too. This also applies vice versa: an unregistered person may nevertheless qualify as tax resident and domestic taxpayer. The civil register can in principle be used as the starting point in determining your tax residence, but is generally not the decisive factor. A person's tax residence is namely determined based on the ’circumstances’. It has been developed in case law which ’circumstances’ are exactly relevant. Amongst others, it needs to be assessed whether you have lasting personal ties with the Caribbean Netherlands. Factors such as a residence permit and identity card are secondary to other factors such as the location of your main residence, the purpose of your stay in the Caribbean Netherlands, where your family and friends are and in which country/ies you are employed and earn your income.
