Monitoring employees’ communications The European Court of Human Rights (ECtHR) has overturned its decision on the lawfulness of an employer monitoring an employee’s private messages in the workplace. In Barbulescu v Romania, the employee used his work Yahoo! Messenger service for personal communications, including for sending messages to his fiancée and brother. His employer had monitored these messages and proceeded to dismiss him. Read more
Employee comparators in an equal pay claim The Employment Appeal Tribunal (“EAT”) has upheld a decision that predominantly female retail employees could compare themselves to distribution depot employees in an equal pay claim. Read more
