SPECIAL EVENT PLANNING & PERMIT GUIDE

Information to assist you in the completion of your special event permit application and individual event related activity and/or support facility permit and license applications.

Introduction

If you are planning a special event in unincorporated St. Louis County, a municipality in St. Louis County or in a St. Louis County Park, permits will be required to help protect the health and safety of you and your guests This planning & permitting guide will help you determine what permits are required for your particular event or activity

Special events are organized gatherings that are generally open to the public. They may be held on private or public property or on a combination of both (private property & public right-of-way) and sponsored by the public or private entities, whether profit or not-for-profit. They are generally outdoor type events, but may also be held indoor. They usually include amusement, entertainment, food/beverage concessions, or sales activities. The Special Event Permit authorizes the conducting of the event itself.

Some examples of events that require a Special Event Permit are:

 Church & Company Picnics

 Festivals/Celebrations

 Commercial or Charity Garage/Yard Sales

 Parades, Triathlons, Runs, Bike & Walk-a-thons

 Craft / Art Shows & Fairs

 BBQ & Similar Fund Raisers

 Grand Openings (involving outdoor activities)

 Car/Bike Shows

 Concerts/Performances

Although a Special Event Permit may be required for your event, it is not an all encompassing permit. Additional permits or licenses may be required depending on the activities and support facilities you will offer. Separate individual permits or licenses are required to authorize certain activities or support facilities for your event. Permits are also required for any temporary advertising signs.

If your event is:

 In an unincorporated area in St. Louis County, you should contact the St Louis County Department of Public Works Special Events Permit Processor. (314) 615-5184

 In a municipality in St. Louis County, you should contact the offices of the municipality where the event will be held. Even if your event is in a municipality, St. Louis County Health Department Temporary Food Establishment and Portable Sanitations System permits and St. Louis County Revenue licensing requirements apply throughout the entire St. Louis County (both unincorporated and incorporated areas). Some municipality’s contract with St. Louis County Department of Public Works to provide permit & inspection services for event related activities such as amusement rides, temporary structures, electrical installations, etc. Similarly a permit is required from the County Department of Public Works for a pyrotechnic display if the municipality does not issue a permit. The municipal official may direct you to contact the St. Louis County Department of Public Works for these kinds of activity permits. (314) 615-5184

 In a St. Louis County Park, you should contact the St. Louis County Parks Events Coordinator to file an application for permit and reserve a park location and/or park facility. If your particular event requires permits from other County Departments for event related activities, the Parks Department Events Coordinator will assist and direct you. (314) 615-8371

If you are hiring a vendor to provide materials or services that require a permit, request that the vendor provide the permit as part of your agreement. Vendors that provide these services in St. Louis County should be aware of what permits are required.

Applications for an Amusement Rides/Devices Permit will also require proof of financial responsibility, proof of liability insurance, proof of annual state inspection and non destructive test results. The amusement ride vendor should be able to provide this information If your event is within a County Park make sure your amusement ride vendor meets the Parks Department higher insurance standards and is on their approved vendor list.

Applications for Temporary Structure Permits of larger temporary structures will also require that a cash surety deposit or performance bond be provided to ensure the removal of the temporary structure once the event is over.

Applications for a Pyrotechnic (Fireworks) Display Permit will also require proof of insurance for liability and any property damage that may result from the display

General liability insurance for bodily injury and property damage may be required for events held within St. Louis County Parks.

PART 1. SPECIAL EVENT PERMIT

If you are planning a special event in unincorporated St. Louis County a Special Event Permit from St. Louis County Department of Public Works is required to authorize the conducting of the event itself. Special events are organized gatherings that are generally open to the public. They may be held on private or public property or on a combination of both (private property & public right-ofway) and sponsored by the public or private entities, whether profit or not-for-profit. They are typically outdoor type events, but may also be held indoor. They usually include amusement, entertainment, food/beverage concessions, or sales activities.

St. Louis County Revised Ordinances, Chapter 1003 Zoning Code requires a Special Event Permit issued by the Department of Public Works for the operation or conducting of an amusement activity or an outdoor sales event on a temporary basis within any zoning district in unincorporated County Zoning districts extend to the centerline of the road right-of-way, thus these regulations include events within the road right-of-way such as parades, walks/runs, etc. “Amusement activity” includes a circus, carnival, fair, turkey shoot, art display, trade or animal show, concert, dance, rally, parade, athletic competition and any similar activity. Similar amusement and/or sales activities that usually require a event permit include, but are not limited to, church or company picnics, community festivals & celebrations, commercial or charity garage/tailgate sales, runs & walk-a-thons, craft or art shows/fairs, BBQ & similar fund raisers, car/bike shows, grand openings (involving outdoor activities), etc.

Generally school events such as athletic competitions, school picnics (without amusement rides), and most school fundraisers, conducted on the school grounds/campus by an elementary school, middle school, high school or college (or by an organization affiliated with the school or college) do not require a Special Event Permit. However, a Special Event Permit is required when a for-profit business or a non-school related not-for-profit organization, conducts an event on a school campus. Even thought a Special Event Permit may not be required, separate individual permits or licenses are still required to authorize certain activities or support facilities as discussed in Part 4 of this guide.

Upon receiving your application the Department of Public Works forwards the request to the Departments of Health, Transportation, Police, and Revenue for their review and approval of the overall event. When the Special Event Permit is eventually issued it may be issued with conditions.

The Special Event Permit issued by the Department of Public Works is not an all encompassing permit. Separate individual permits or licenses are required to authorize certain activities or support facilities for your Special Event These are discussed in Part 4 of this guide Permits are also required for any temporary advertising signs.

APPLICATION INSTRUCTIONS FOR SPECIAL EVENT PERMITS

If you are planning a special event in unincorporated St. Louis County a Special Event Permit will be required to help protect the health and safety of you and your guests. The application for a Special Event Permit for a special event in unincorporated St. Louis County is filed with the Department of Public Works.

If your special event is in a St. Louis County Park, you should contact the St. Louis County Parks Events Coordinator at (314) 615-8371 to file an application for permit and reserve a park location and/or park facility Permits for special events within a County Park are processed and issued by the Department of Parks & Recreation.

The following instructions apply to applications processed by the Department of Public Works for special events within unincorporated St. Louis County:

1. Applications must be submitted at least twelve (12) working days in advance of the planned event to allow sufficient time for normal processing of the request. County ordinance requires that Public Works obtain approvals from various other County Departments before a Special Event Permit can be issued. Applications for large events such as fairs, concerts, celebrations, circuses, parades, triathlons, runs, bike and walk-a-thons that impact traffic and/or require roadway closures and/or events that have multiple food vendors or require portable restroom units should be submitted a month in advance to allow sufficient time for processing and obtaining the required approvals. Applications not filed in advance of these required timelines may be rejected and/or denied due to insufficient time to process and obtain the required approvals from other departments.

If your event will require that a County maintained roadway or street be closed for the duration of the event, you must contact the Department of Transportation at 314-615-1123 and request permission well in advance of the event. A separate permit from Transportation called a Special Use Permit is required to close a roadway or street

2. The Public Works special event permit application should be completed with as much information as possible, signed by the applicant and dated

The special event permit application must be accompanied by a site plan, which shows the location of all existing & proposed structures, all activity areas & support facilities, paths for emergency vehicles, parking areas, etc. A route map must be provided for events involving parades, runs, walks, etc.

4. If you will be erecting a tent, you are required to submit a copy of the flame retardant certificate. If any tents are over 900 square feet, or if erecting stages, etc. you are required to also obtain a Temporary Structure Building Permit from the Department of Public Works in addition to the Special Event Permit

5. If you will be having amusement rides, inflatable’s, or amusement devices such as rock climbing walls or bungee jumping your amusement ride vendor is also required to obtain an Amusement Ride Permit from the Department of Public Works Mechanical Inspection Section in addition to the Special Event Permit.

6. If you will be having a pyrotechnics (fireworks) display you are required to also obtain a Pyrotechnics Permit from the Department of Public Works in addition to the Special Event Permit.

7. There are special insurance requirements for events having unique activities. If the event includes any helicopter rides, fire engine rides, hot air balloon exhibitions, etc. St Louis County Department of Public Works must have a copy of their insurance, and in the case of any aerial events, we must have a copy of the letter of approval from the FAA.

8. The Special Event Permit fee of $79 00, payable to “Treasurer-St. Louis County” , must be submitted at the same time as the application.

9. The complete application, site plan (6 copies required if site plan is larger than 11x17), and any other informational attachments together with the permit fee should be filed with:

10. Upon receipt of your application Public Works will forward the application to various County Departments for their review and approval. If there are any questions by any Departments during the review, a representative of that Department will contact the applicant or organization prior to issuance of the permit

11. Unless requested otherwise, the Special Event Permit will be issued and mailed to the applicant once all of required information is received and approvals are obtained from all of the reviewing County Departments. When the Special Event Permit is issued there may be additional requirements attached as conditions of the permit’s issuance Please make certain that all these conditions are met.

12. The applicant shall keep the Special Event Permit and the letter of conditions on the premises during the event; however, these documents need not be posted.

13. Although a Special Event Permit is issued for your event, it is not an all encompassing permit. Additional permits or licenses may be required depending on the activities and services you will offer The applicant is responsible for any permits or licenses which may be required by other St. Louis County Departments, the governing municipality, other agencies and/or the State of Missouri For example, in addition to the temporary structures, amusement ride, and pyrotechnic permits from Public Works noted above, additional permits/licenses are required by other County Departments for servicing of food or beverages, portable restrooms, serving alcohol, raffles, carnival activities, etc. Permits are also required from Public Works for any temporary advertising signs. The applicant should allow adequate lead time in order to be able to obtain these other required permits and/or licenses prior to the planned special event

14. Inspection of the area, depending upon the type of event, will be scheduled by this department either on the day of the event or the day prior

PART 2. SPECIAL EVENT IN A COUNTY PARK PERMIT

If you are planning a special event in a St. Louis County Park a Special Event Permit from the St. Louis County Department of Parks is required to authorize the conducting of the event itself. Special events are organized gatherings that are generally open to the public. They may be sponsored by the public or private entities, whether profit or not-for-profit.

St. Louis County Revised Ordinances, Chapter 803 Amusements requires a Special Event Permit issued by the Department of Parks for any exhibition, fair, exposition, show, theatrical performance, professional athletic exhibition or event, circus, carnival, concert, or similar activity within a County Park. This chapter, and thus the requirement for a Special Event Permit, does not apply to any public exhibition or performance that is sponsored solely by St. Louis County

Not all events in a County Park require a Special Event Permit. If in a St. Louis County Park, contact the St. Louis County Parks Event Coordinator. If your particular event requires a Special Event Permit from the St. Louis County Department Parks, the Parks Department Events Coordinator will assist and direct you.

If your event includes activities or support facilities that require other St. Louis County Departmental involvement the Department of Parks will coordinate your application request with the Departments of Health, Transportation, Police, and/or Revenue for their review and approval of the overall event. When the Parks Department Special Event Permit is eventually issued it may be issued with conditions.

The Special Event Permit issued by the St. Louis County Department of Parks is not an all encompassing permit. Separate individual permits or licenses are required to authorize certain activities or support facilities for your Special Event. These are discussed in Section 4 of this guide.

PART 3. SPECIAL EVENTS REQUIRING COUNTY ROADWAY CLOSURES

If you are planning a special event that requires the closure of a St. Louis County roadway a Special Use Permit must be obtained from the St. Louis County Department of Transportation authorizing the closure of the roadway. The Special Use Permit application process is used for roadway closures, detours, modification of right-of-way, and activities impacting traffic. The Block Party Permit application process noted below may be used for Neighborhood Block Party street closure requests.

Parades, walk-a-thons, runs, and similar events

As indicated above a Special Use Permit must be obtained from the St. Louis County Department of Transportation authorizing the closure of the St. Louis County roadway. A Traffic Control Plan will need to be submitted when requesting a road closure. Additional information and applications forms are provided in this guide or may be obtained by visiting the Transportation website at www.stlouisco.com/YourGovernment/CountyDepartment/Transportation or by calling (314) 615-8515.

Neighborhood Block Party

If you are planning a neighborhood block party that requires the closure of a St. Louis County street you must obtain a Block Party Permit from the St. Louis County Department of Transportation authorizing the closure of the street. The application is provided in this guide or the request may be submitted on-line at http://www.stlouisco.com/PropertyandRoads/NeighborhoodServices/BlockParty. Additional information regarding street closures for Block Parties may be obtained by calling (314) 615-1123.

Block Parties are generally organized by the residents of a neighborhood for the residents themselves and thus are quasi-private Block Parties that the public is invited to or that have any of the activities noted in Part 3 of this guide must obtain a Special Events Permit from the St. Louis Department of Public Works authorizing the overall event as indicated in Part 1 of this guide

Events in a municipality in St. Louis County

If your event is in a municipality in St. Louis County, and your event involves a St. Louis County arterial roadway closure you will need to obtain a Special Use Permit from the St. Louis County Department of Transportation authorizing the closure of the roadway as indicated above You should also contact the offices of the municipality where the event will be held to see if they require a Special Event Permit.

SPECIAL USE PERMIT GENERAL PROVISIONS

DEFINITIONS

For purposes of this Application, the terms are defined as follows:

1) Applicant. The person (individual or artificial entity) that controls the property or the project authorized by this SUP. If Applicant uses a Contractor, the term "Applicant" includes the term "Contractor".

2) Contractor The person (individual or artificial entity) that performs the work authorized by this SUP.

3) County. St. Louis County, Missouri.

4) Department. The St. Louis County Department of Transportation.

5) Director. The Director of the Department or his / her designee.

6) Project. The work performed by Applicant pursuant to this SUP.

7) SUP. This Special Use Permit.

TERMS AND CONDITIONS

By submitting this application, the Applicant agrees to comply with all obligations, requirements, terms and conditions contained in the General and Special Conditions contained in this application. Except in those instances and to the extent that Applicant makes a good faith determination that an emergency exists, Applicant shall perform no work on a Project prior to issuance of an SUP. If Applicant fails to comply with any General or Special Condition, County may suspend or revoke this SUP. If Applicant wishes to request an exemption from, or a modification of, any General or Special Condition, Applicant must follow the procedures specified below in General Condition No. 4, titled "Variance Procedure".

GENERAL CONDITIONS

1) Notification. Applicant shall notify County at least 48 hours in advance that work will start on the Project. In non-emergency situations, Applicant shall provide such notice by contacting the Permit Inspection Section of the Department at (314) 615-1166 or by email to the following address: HighwaysPermit-Inspection@stlouisco.com. In emergency situations, Applicant shall provide such notice by calling the applicable number listed in County’s Special Use Permit Booklet, Requirements and Conditions. Applicant shall not commence any work prior to such notification, except in emergency situations.

2) Utilities Locates. Applicant shall be responsible to request the location of all utilities, including traffic signal interconnect and facilities, prior to performing any work. Applicant shall call the Department at (314) 615-0215 for traffic signal facility locates, a minimum of 72 hours in advance of any work, except in the case of emergencies.

3) Performance. Applicant shall perform all work in a workmanlike manner, without unreasonable delay, and in full compliance with this SUP.

ST. LOUIS COUNTY

4) Variance Procedure. If Applicant has a good faith belief that a General or Special Condition, in whole or in part, should not apply to the Project or to the Applicant, Applicant shall file contemporaneously with this SUP application a "Variance Application" (see Exhibit "A", attached hereto) for an exemption or modification of such condition. The Variance Application shall contain a full explanation of the reasons in support of the request and all other relevant information requested on the Variance Application. The Director will respond to the Applicant by granting or denying the request in whole or in part, without undue delay.

5) Indemnification. Applicant shall defend, indemnify and hold harmless the County, its officers and employees, whether based on a claim for real or personal property, or to a person, for any and all damages arising from the negligence or intentional tort of said Applicant or its subcontractors in constructing, extending, restoring or maintaining its facilities within, upon or across a County owned easement or right-of-way. Additionally, for a period of six months from the completion of such work or use, Applicant will save the County harmless from any cost or expense occasioned or required in the refilling, repairing, or restoring of said easement or right-of-way, for such period, due to or occasioned by such use, excavation or encroachment.

6) Signs, Barricades, Flagmen While work is being performed in County right-of-way, Applicant shall comply with the most recent version of the Manual of Uniform Traffic Control Devices (MUTCD).

7) Vertical Clearance. Applicant shall maintain a vertical clearance for overhead installations of not less than 15 feet, 6 inches from the road surface.

8) Cover for Underground Facilities. At the time of installation, Applicant shall provide the following minimum cover for underground facilities, unless approved through the Variance Procedure: 42 inches for waterlines, 24 inches for parallel telephone cables, 18 inches for gas service lines, 24 inches for gas mains, and 30 inches for all other underground installations.

9) Covers or Guards. Applicant shall provide covers or guards as approved by Director for cable, wire, small diameter pipe and other objects that extend above the surface.

10) Mud, Debris. Applicant shall keep pavements clear of mud and debris, and keep ditches, culverts and other areas that convey surface water, open and free from mud and debris.

11) Pavement Crossings/Openings. The Project shall not include open cut of any paved portion of the right-of-way unless such open cuts are limited to time periods designated in paragraph 13, "Lane Interruption/Traffic Stream". The Director may prohibit open cuts or impose additional limits if, after considering all relevant factors, the Director makes a good faith determination that such open cuts will result in an unreasonable disruption of the traffic stream.

12) Disturbed Paved Right-of-Way. At the completion of the Project, Applicant shall restore the paved right-of-way and any improvements thereon, to as good condition as before the Project, and keep and maintain such paved right-of-way in such condition for a period of six months. Applicant shall replace the subgrade and surface with like kind materials. Applicant shall fill all voids and pavement openings with granular backfill, which shall be compacted to comply with Standard Specification for Road and Bridge Construction, Section 726.6.3. Applicant shall make final pavement repairs within thirty days of completed temporary pavement work. If within six months of the completion of the Project, the paved right-of-way fails to remain in as good condition as before the Project, applicant shall repair such rightof-way to effect such compliance.

13) Lane Interruption / Traffic Stream. In non-emergency situations, the Project shall not interrupt the traffic stream between the hours of 6:00 am to 9:00 am and 3:30 pm to 6:30 pm.

14) Disturbed Unpaved Right-of-Way. All disturbed unpaved areas of the right-of-way shall be re-graded, and vegetation restored to as good a condition as before the Project.

15) Manholes. Applicant shall conform utility boxes, valve boxes, manhole frame covers or any utility appurtenances to the transverse and longitudinal pavement slope, and make the top comply with the finished grade.

16) Trees, Shrubs and Turf. Applicant shall make all reasonable efforts not to cut, spray or damage trees, shrubs or turf in County right-of-way. If any such trees, shrubs or turf are damaged, Applicant shall restore or replace such items as is reasonable.

17) Disturbed Driveways and Sidewalks. Applicant shall repair or replace all subgrade, sidewalks, driveway approaches and associated drainage facilities that Applicant damages or removes with like kind materials. When Applicant disturbs 50% or more of a slab of a concrete driveway or sidewalk, Applicant shall replace such slab with a full slab. Applicant shall replace all paved improvements at the same depth as before the Project.

18) Private Facilities. If Applicant damages or removes privately owned facilities lawfully located within County right-of-way, Applicant shall immediately notify the owner, and repair or replace such facilities as soon as practical. Applicant will address any dispute with owners of private facilities as a civil matter arising in the course of business.

19) Storage. Applicant shall not store construction material or equipment on County right-of-way, if Applicant owns or controls property used for such storage within 500 feet of the Project. In any case, Applicant shall not store construction material or equipment if such storage impedes traffic or property access, or creates a sight distance hazard. Within thirty days after completion of the Project, Applicant shall restore all storage areas to as good a condition as before the Project.

20) Costs. Applicant shall bear all non-reimbursable costs of construction, maintenance, removal, repair and related costs associated with this SUP.

21) Pedestrian Right-of-Way Obstruction. Applicant work that closes, or impedes pedestrian traffic shall comply with the Manual of Uniform Traffic Control Devices (MUTCD).

22) Trenches. Applicant shall keep all trenches in right-of-way covered and protected during non-working hours. At the completion of the Project, all trenches within three feet of or under existing or future (programmed) pavement shall be backfilled with granular material.

23) Landscaping and Monuments. Applicant shall not install landscaping or entrance monuments unless replacing existing landscaping or monuments as specified by this SUP.

24) Fill Material. Applicant shall use fill material that consists of uncontaminated inert materials (soil, rock, concrete, asphaltic concrete, sand and similar materials). Applicant shall not allow materials such as wood, metals, plastics, textiles and hydrocarbons as fill material. Applicant shall report to appropriate federal, state or local officials the existence of any material subject to applicable reporting requirements.

PART 4. EVENT RELATED ACTIVITY PERMIT & LICENSE INFORMATION

Although a Special Event Permit may be required for your event, it is not an all encompassing permit. There are a number of different event related permits that are required independent of the Special Event Permit, or are required in conjunction with the Special Event Permit. The proposed event venue, activities, components, attendance, support facilities required, or unique circumstances of the event are contributing factors to the final determination of the required permit types.

Following is a summary of the most common permits and/or licenses you may be required to obtain if you are planning a special event with associated activities, amusements, and support facilities.

 Portable Toilets require a Permit to Operate Portable Sanitation Units

Obtaining permits for the associated amusements, activities, and support facilities does not mean you have authorization for your overall event. If you event is in unincorporated County or in a County Park a Special Event Permit from the St. Louis County Department of Public Works or Department of Parks is required to authorize your overall event. Special Event Permit information can be found in Part 1 and Part 2 of this Guide.

Food Concessions require a Temporary Food Establishment Permit

If you intend to prepare, handle, and/or serve food or other consumable products at a public event, your food vendor must obtain a Temporary Food Establishment Permit from the St. Louis County Department of Health As part of the food handling requirements, you are required to include public safety features in your event plans such as hand-washing sinks/stations, rubbish containers, etc.

Portable Toilets require a Permit to Operate Portable Sanitation Units

If you intend to, or are required to, provide portable toilets/restrooms you must obtain a permit to Operate Portable Sanitation Units from the St. Louis County Department of Health

Sponsors of most special events, at which a minimum of 100 people are expected to be present at peak hour(s) where sewered toilets are not readily available to accommodate anticipated attendance are required to provide portable toilets and hand washing facilities.

AMUSEMENT RIDE or DEVICE PERMIT INFORMATION

The Amusement Ride or Device Permit is a permit to install, erect, set-up and/or operate the individual temporary ride(s) or device(s) normally associated with a special event or activity such as a circus, carnival, school picnic, fair, etc. This includes mechanical rides, go-karts, rock climbing walls, bungee jumping, inflatable devices, mechanical bulls, etc

The Amusement Ride or Device Permit does not authorize the overall event, function or activity. Within the Unincorporated Areas of the County and within any County Park, a Special Event Permit is required from the St. Louis County Department of Public Works authorizing the overall event, amusement, or assembly activity.

When the activity/event is located within a Municipality that contracts with St. Louis County for Code Enforcement of Amusement Rides and Devices, the Event Organizer must obtain approval of the overall activity/event from the Municipality The Amusement Ride Supplier obtains their permit for the amusement rides/devices from the St. Louis County Department of Public Works Mechanical Inspection Section To see if a permit & inspection is required you can use the County/Municipality Contact Matrix which can be found at:

If unsure if a permit is needed the best course of action is to call the St. Louis County Department of Public Works Mechanical Inspection Section at 314-615-7806 The maximum no-permit penalty fine is $500.

2. The amusement ride/device permit application must list all rides and devices to be set up, including food trailers and games.

a. The individual or company is required to have financial responsibility with St. Louis County. The County’s Financial Responsibility Form must be completed and submitted along with a Certificate of Insurance for $1,000,000 dollars per occurrence general liability for bodily injury and property damage.

b. A hand drawn plot plan to include locations of the rides and devices, any buildings, nearby roads and overhead power lines. Show separation distance between rides and devices and a clear entrance for emergency vehicles.

c. Non Destructive Test results required by the CPSC or the manufacturer of the device.

d Proof of the annual State of Missouri inspection

e Permit cost is $32 00 processing plus $45 00 per ride/device and $30 00 per inflatable/device (min. total fee for a single device is $79 00), payable to “Treasurer – St. Louis County”, Submit permit fee payment with the application There are additional inspection fees for evening and weekend inspections.

2) Fencing and barriers shall enclose all amusement devices

A) All fencing for mechanical devices shall be 42” tall (Minimum) with no opening/space over 4 inches, non climbable, and must be self-supporting and withstand the force of a full-grown man leaning against it. The exit gate shall swing away from the device.

B) Rock climbing walls and slides shall be completely enclosed by a barrier such as fencing mentioned above or orange construction barrier material. The barrier shall completely enclose the device to include the stakes, the rear and the front of the device to control the patrons.

3) Signage and minimum number of operators

A) All devices shall have proper ride signage indicating all manufacture requirements to include minimum rider height, weight and health warnings. Ride specific signage shall be posted, in good condition and readable. (M,B)

B) All devices shall have the proper number of ride operators based on manufacture requirements If the ride operator cannot see the rear of a fenced ride then provide a mirror or another ride operator (M,B)

4) Weather Hazards

A) An amusement ride or device shall not be operated above wind limits established by the manufacturer or when storm warnings have been posted by the weather service, except as may be necessary to release or discharge passengers. (M,B)

5) Electrical wiring, enclosures, connectors and disconnect means

A) All electrical wiring shall be installed and maintained to the requirements of the National Electrical Code. (M,B)

B) All electrical disconnects, connection boxes, connectors, raceways and wiring shall be UL listed European devices will be given special consideration. (M,B)

C) Each device shall be provided with a fused disconnect switch or circuit breaker located within sight and within 6 feet of the ride operator The disconnecting means shall be readily accessible to the operator, including when the ride is operating. (M)

D) All trailer mounted generators shall have two 10 foot ground rods with 8 feet driven into the ground, spaced at least six feet apart, not less than ¾ inch in diameter, of solid construction and the electrical connector shall be UL listed

E) All midway wiring shall be for hard service, not spliced, split or frayed (M)

F) All midway wiring shall not create a trip hazard, shall be covered or in a listed wire way manufactured for walking areas (M)

G) All midway electrical boxes shall be enclosed by a fence. If bare conductors are assessable the cover shall be locked with a padlock. (M)

H) All midway electrical boxes shall be of weatherproof construction and mounted so that the bottom of the enclosure is not less than 6 inches above the ground (M)

I) All wire connectors shall be listed for the intended use. (M,B)

J) All devices that utilize water, except for fire suppression, shall be ground fault interrupt protected I E., boat ride on water, pull out the duck and win a prize booth

K) All devices shall be maintained not less than 15 feet in any direction from overhead conductors except for conductors supplying the device. (M,B)

6) Inflatable Devices

A) Inflatable devices shall be staked per the manufactures requirements and below.

B) Stakes shall be tent stakes a minimum of 36 inches in length, 1inch diameter and driven a minimum of 24 inches into the ground If sand bags are approved by the manufacture the sand bags shall have documentation to the weight or a scale shall be provided to verify the weight

C) The tethers shall be in good condition, no knots, proper length, proper size, not frayed and connected at each end per the manufacture

D) Tether connection points at the inflatable shall be in good condition and unmodified

E) The Inflatable shall be clean and in good condition. All repairs shall be approved by the manufacture. If unapproved repairs and modifications have been made without documentation from the manufacture that such repairs meet their requirements you will not be allowed to set up and operate the inflatable.

F) All air supply tubes shall be utilized unless documentation from the manufacturer is supplied

G) Blowers/fans shall be of the proper CFM required by the manufacture, be UL listed, in good condition and maintained in a clean condition. If the blower intake and blades are not kept clean you will not have adequate CFM

H) Extension cords shall be a minimum number 12 gauge wire size, listed for rough service, maintained in good condition and not over 100 feet in length

I) If the building power is utilized to power the blower only one extension cord may be plugged into a branch circuit, shall be secured to the receptacle and a testing device shall be provided to verify an earth grounded circuit Only one extension cord per blower may be utilized If you cannot comply with this please rent a generator, as it will not be approved

J) Generators shall be of adequate size to power the devices, shall contain enough fuel to last throughout the time that the device will be in operation and grounded per the electrical section of this letter A HOT GENERATOR CANNOT BE REFUELED

7) Fire Extinguishers

A) All amusement devices, generators and game booths shall have at least one fire extinguisher

B) The fire extinguisher shall be sized per NFPA 10 and be at least a 20 pound extinguisher.

C) Food trailers shall have at least one “K” type fire extinguisher

D) All fire extinguishers shall have a current service tag meeting the requirements of NFPA 10.

E) The fire extinguisher shall be located next to the operator and properly supported

8) Fire Suppression Systems

A) All dark rides and walk thru rides shall have a fire suppression system as required by the Life Safety Code 101 (M)

B) All fire suppression systems shall be maintained and be operational (M)

C) If water storage tanks are utilized they shall remain full of water and have the proper pressure. (M)

D) If water is supplied by other than a storage tank the supply shall be uninterruptible. (M)

E) Wet or dry chemical fire suppression shall have an inspection tag that complies with NFPA 17 and NFPA 17A. The systems need to be inspected every six months and properly tagged.

F) All food trailers that utilize fryers of any type shall be equipped with an automatic fire suppression system in addition to the “K” type fire extinguisher

TEMPORARY STRUCTURES SUBMITTAL INSTRUCTIONS

Please allow a minimum of four (4) weeks for processing the application after being received by the Department of Public Works.

The following information is required to be submitted in order to obtain a building permit to erect, place, or construct a temporary structure:

1. A completed application for Temporary Structure permit. Application forms are available at the Public Works Permit Counter or can be downloaded from the Public Works web site at www.stlouis.com/YourGovernment/CountyDepartments/PublicWorks

2. A cash surety deposit (see attached form) or a performance bond (see attached form) made payable to the “Treasurer of St. Louis County, Missouri” for the following amounts:

Permits for tents and tent canopies to be used for sales promotions or display shelters and those used on church property for worship or other religious purposes may be issued without posting a cash surety deposit/performance bond.

The cash surety deposit /bond shall guarantee the removal of the structure at the direction of the Director of Public Works or upon expiration of the permit. Please see the “Cash Surety Deposit/Temporary Structure Bonds Information” sheet for an acceptable cash surety deposit/bond format.

3. Six (6) site plans showing the location of the structure in relation to any other existing structures on the site and the distances to the property lines. Please contact County Zoning Review, 314-6152525, or the Zoning Official of the contracting municipality, if within a contracting municipality, for placement restrictions for a particular parcel.

4. Six (6) complete sets of plans identifying how the structure will be anchored and or braced to resist wind loads referenced by the County Ordinance 24,444, Chapter 1115 SLCRO and Chapter 16 of the ’09 IBC as amended. St. Louis County Public Works reserves the right to request plans and/or structural calculations prepared and sealed by the appropriate Missouri Registered Design Professional.

5. Four (4) sets of plans and details for anything that is to be field constructed (i.e. entrance stairs, landing, ramp, deck, canopy) and/or four (4) sets of plans for the temporary trailer.

6. The flame resistance of the tent fabric shall be verified by an affidavit documenting the following information for all tent structures:

a. Names and addresses of the owners of the tent structure.

b. Date the fabric was last treated with flame resistant solution.

c. Trade name or kind of chemical used in treatment.

d. Name of person or firm treating the material.

e. Name of the approved testing agency and test standard by which the fabric was tested. The membrane material shall meet one of the following criteria:

Noncombustible (Section 704.4) or

Flame resistant when tested in accordance with small-scale and large scale tests in NFPA 701-96. or

Treated in an approved manner to render the material flame resistant.

7. All temporary structures shall either provide, or have nearby access to, an adequate water supply, plumbing facilities, and sewerage disposal in accordance with the Plumbing Code, Chapter 1103 SLCRO, as amended. If the temporary structure has toilet facilities within, the applicant must provide a letter to Plumbing Inspections specifying the method of sewage disposal (i.e. temporary hook-up to sewer line, holding tank, etc.). Include a copy of the contract with the waste hauler, if a holding tank is to be used, with the letter.

8. Zoning approval from St. Louis County Zoning Review (314-615-2525) or from the Zoning Official of the contracting municipality if the temporary structure is to be located within a contracting municipality.

9. Fire District or Fire Department approval. (see attached form)

10. Property Owners or Lessee’s Permission form sealed, signed and dated for St. Louis County or a municipality contracting with St. Louis County to enter the site. (refer to attached form)

In order to obtain a temporary structure permit, the owner and/or operator of the temporary structure may be required (see submittal instructions) to post a cash surety deposit for the stipulated amount with the Treasurer of St. Louis County, to guarantee removal of the structure upon expiration of the permit or at the direction of the Director of Public Works.

The cash surety deposit submitted shall consist of:

A) The temporary structure cash surety deposit form. (Must be signed and dated by the owner/operator of the temporary structure)

B) Cash, money order, or check for the stipulated sum to be deposited with the Treasurer of St. Louis County.

The temporary structure cash surety deposit shall be submitted in the same form as the attached sample without alterations.

TEMPORARY STRUCTURE BOND INFORMATION

In lieu of providing the cash surety deposit noted above, a performance bond must be posted to guarantee removal of the structure upon expiration of the permit or at the direction of the Director of Public Works.

The bond submitted shall consist of:

A) The temporary structure bond. (Must bear the seal of Surety Company and Principal if a corporation.)

B) The power of attorney.

C) The notary acknowledgment.

The temporary structure bond shall be submitted in the same form as the attached sample without alterations.

WHEREAS, the Principal and Surety agree that if the temporary structure is not removed upon the expiration of the building permit authorizing the temporary structure, St. Louis County may cause the temporary structure to be demolished and the site returned to its original condition; and

WHEREAS, Surety agrees to reimburse St. Louis County for all reasonable expenses incurred in the demolition of the temporary structure and in any work necessary to return the site to its original condition;

NOW, THEREFORE, if the Principal shall comply with all applicable ordinances of St. Louis County or any municipality within St. Louis County and upon expiration of the building permit authorizing said temporary structure, remove the temporary structure and return the site to its original condition, then this obligation to be void; otherwise, this obligation shall remain in full force and effect.

This bond shall be construed to cover the interests of any Municipality in St. Louis County and shall be available for the protection of such Municipalities and the residents of St. Louis County and any Municipality within St. Louis County. This bond shall remain in effect until the Director of Public Works, or his designee, has inspected the site and is satisfied that the temporary structure has been removed from the premises and the site returned to its original condition. Note: Applicants for Temporary Structure permits must submit this form verifying Fire Protection District or Fire Department approval of the temporary structure to St. Louis County, Department of Public Works before a permit can be issued for the structure.

All temporary structures must be removed by the expiration date of the permit. Permits for membrane structures including tents are limited to less than ninety (90) days. Permits for all other temporary structures are limited to time of service or length of season, not to exceed six (6) months, except for classroom structures which are permitted for ten (10) months, and unoccupied display structures and subdivision sales offices which are permitted for a period up to one (1) year.

Section 4E

Electrical and Power Supply requires an Electrical Permit

If your event activities include the need to supply electrical power, via connecting to temporary generators or by connecting to existing permanent electrical systems, an electrical permit is required the St. Louis County Department of Public Works A separate electrical permit is not required for powering temporary amusement rides having a mechanical amusement ride/device permit. Applications for an electrical permit must be submitted by and all electrical work must be performed by an Electrical Contractor licensed by St. Louis County
