ARCA Developments and Initiatives Continue

I

have just completed the ARCA member regional meetings for May and June 2019. It was really encouraging to see so many of our members, with great attendance at all meetings. At these meetings I was able to report on discussions which took place at the last Asbestos Leadership Council Licensing Sub Group (ALC LSG) meeting, which included the Asbestos Licence Renewal process.

Feedback obtained from members at the January/February ARCA regional meetings regarding the new asbestos licence renewal process was relayed to the HSE. HSE explained that one of the biggest problems encountered during the pilot, was applications being made late. This meant that licence decisions were not able to be made until very close to the existing licence expiring or in some cases after the existing licence had expired. HSE also explained that the subjects which were generating the most requests for further information by the HSE were non-asbestos risk assessments and personal monitoring. HSE informed us that, with very few exceptions, save for administrative reasons, all licence renewals where granted, would be three-year licences. Further details of these discussions are included in the article on page 12. In the Chief Executive Comment in the last issue of ARCA News I mentioned we were working with the Labour Supply ARCA members to develop, ALFA, the Asbestos Labour Feedback App.

ALFA is a performance recording system of short-term operatives from Labour Supply members, which all ARCA Full Contracting Members will be able to access. The competency of the operatives on the system, that is, their knowledge, skills and behaviour, will be continually rated by the site supervisors of the ARCA Full Contracting Members that have hired the operatives. The supervisor will rate the short-term labour against a set of criteria, and will be prompted to complete a rating by an automated email generated by the system. These ratings, or feedback, will be added to the labour agency operatives profile on the app to give an overall rating for the operative based on the feedback submitted for the previous 12 months. ARCA Full Contracting Members will be able to refer to these ratings prior to hiring

short-term operatives, so providing reassurance of competency. This system will also support short-term operatives by gaining recognition and identifying training needs. I was hoping to demonstrate the prototype of the system at the recent regional meetings, however the development of the app is not quite complete. As I write this Chief Executive Comment I have an appointment to meet the developers next week to look at the first iteration of the software. My aim is to have a soft launch of the system by the ARCA AGM on the 4th October, and the system available to all, soon after. I will be demonstrating the system at the next round of regional meetings in November (dates available on page 13). I am delighted to say, that following feedback from members with regards to the length of time it took for the ARCA site audits to be assessed and awarded both a score and grade, we have now developed our auditing app to automatically score and grade the audits. Along with the completed audit report being emailed to the member company immediately following the audit, the email now includes the score and the grade of the audit, along with a corrective action report which collates any identified nonconformities and highlights the importance. The feedback from members regarding the enhanced system has been overwhelmingly positive. The same automatic scoring, grading and corrective action report system is also now included in the version of the app that is available for members to use for internal audits. Please remember that the ARCA Charity Week will run 16th - 20th of September 2019. We would love to see as many member companies as possible get involved to raise funds for the Association’s charity – Mesothelioma UK. ARCA Colour Codes Site Audit Reports

Coding confirms type of audit

RCA site audit reports are now colour coded and clearly labelled to indicate the type of audit, such as, ‘ARCA Site Audit - Unannounced’. Therefore, all parties, including the HSE, will know exactly the type of ARCA audit a report refers to.

CITB updates Health, Safety & Environment Test T

he CITB made further improvements to the Health, Safety and Environment Test at the end of June 2019. The Health, Safety and Environment Test is a requirement when applying for CSCS Cards. The CITB reviewed all versions of the test and where applicable the questions were updated to keep up with current legislation. The Operatives test in particular has had a substantial update to better reflect the range of day to day tasks and responsibilities an Operative has on-site.

In the revised test, candidates have one section of questions, rather than two, as behavioural case studies and accompanying questions has been taken out. However, behavioural elements are incorporated into many of the 50 test questions. Candidates still have 45 minutes to answer the 50 questions. Also, new scoring means candidates will need the following to pass the test: Operatives Test: pass mark is 45 out of 50

Over 1,700 CSCS Cards issued The take up for CSCS cards from the Association has continued to increase, with over 1,700 ARMI Skills cards issued. The Association receives CSCS card applications, for both physical and virtual smartcards, on a daily basis and continues to process the applications in just four working days. CSCS to end exemption to CITB Test Currently if an applicant for a CSCS card has achieved an NVQ within the last 2 years, they do not have to sit the CITB Health, Safety and Environment Test. However, following the announcement by CSCS on 17 June this exemption will

ARCA supports the Contamination Expo Series 2019 A RCA, the UK’s leading association representing asbestos removal contractors, will be exhibiting and speaking at the Contamination Expo Series on 11-12 Sept 2019 at the NEC Birmingham. The event will provide ARCA with a platform to continue communicating how ARCA members can assist in safely managing and removing asbestos, and highlight property owners and managers legal responsibilities. “One of our aims is to continually raise professional standards across the industry. We introduced unannounced site audits to the industry, over two years ago, as previously we arranged audits of members. This means ARCA members have no prior notice of when an ARCA auditor will be on-site to assess their performance,” commented Steve Sadley, Chief Executive of the Asbestos Removal Contractors Association (ARCA). “Our members need to continually demonstrate

ARCA Member Internal Audit App updated...now scores automatically R

ecently, ARCA announced two new developments to the ARCA Site Audit App; automatic scoring and a corrective action report. These developments have now been incorporated into the Member Internal Audit App. This App, which is an adaptation of the ARCA Site Audit App, enables Full Contracting ARCA Members to follow the same question set as an ARCA audit.

“We soon signed up to use the App after its launch at the end of 2017. ARCA carries out very thorough audits, so having the same criteria available for our own internal audits, has definitely supported our performance. Now these new developments mean that key information of our performance on-site can be immediately available to our managers. A real benefit when managing health and safety on-site.” Chris Dobson, Health, Safety and Quality Manager for Thompsons of Prudhoe Ltd.

Now the App scores members internal audits automatically, using the same criteria as an ARCA audit. This improves the App as a management tool for members to analyse their performance across all internal and ARCA audits. Also, the App now identifies and collates any non-conformities within the internal audit report and presents the information within a separate corrective action report. The report is immediately available after the audit is completed, enabling any actions to be rectified without delay, and for many projects, this could be while the asbestos removal work is still being undertaken.

“We started using the ARCA Member App earlier this year and are very happy with the format. That is, the questions are the same as ARCA site audits, guidance is available as to what details to look for and photos can be uploaded. o support ARCA’s Mission and Vision my overarching aim, as Chairman of ARCA, is to continually improve standards across the industry. I believe this is an important role of a trade association. Through a market research project, completed by a market research company (in 2017), ARCA gained valuable information from end-clients. 80% stated

that membership of a trade association was essential, and that they expect a trade association to maintain standards, provide reassurance and provide industry leadership. With regard to the two trade associations representing the asbestos removal contractors in the UK, there was a ‘very high spontaneous awareness’ of ARCA as the asbestos industry’s trade

association and ARCA was ‘seen as the established principle accreditor’. However, the market research demonstrated that clients perceived no obvious differences between ARCA and ACAD. This I can see as being good for ACAD, but not for ARCA, as ARCA has done, and continues to do, so much more for the industry.

Membership Application & Rules As a membership organisation, how does an asbestos removal contractor become a member and what are the rules of membership? There a number of differences in the requirements for joining each asbestos removal contractors trade association. I think this is best shown in the adjacent table. All membership organisations should have a set of rules, as all members should know what they need to do and what the organisation needs to do. There should be transparency as to the expectations and boundaries of membership. The Rules of Membership of ARCA (available on the website) set out what is needed to join, and how a member needs to continue to demonstrate the required standards to maintain membership, and if these slip, what actions will be taken. For example, asbestos removal contractor members need to follow the ARCA Site Audit Accreditation Scheme, that is undertake two

chairman’s comment satisfactory unannounced site audits every year. If a member fails an unannounced site audit, a replacement unannounced site audit is arranged and if the member fails this audit then membership is suspended. ARCA will then arrange to meet the management team to conduct an office audit. Through this management arrangements are

reviewed, as to what is effective and where improvements are required. This support enables the contractor to amend arrangements and carry out internal audits, before another ARCA unannounced site audit is undertaken. If this audit is passed membership suspension is lifted. However, membership will be terminated if a member

company fails to meet the required standard. On talking to some ACAD members, past and present, they have never seen any rules of membership. I could not find any on their website when writing this piece. So, it begs the question, what expectation do they have of member performance and how can clients be reassured of this.

How are membership site audits carried out? Market research identified that clients see membership of a trade association as providing a level of reassurance. So, there is a responsibility on a trade association to meet this expectation. ARCA takes this responsibility seriously. It was the first trade association representing asbestos removal contractors to introduce an audit scheme for all member contractors, in 2000. ARCA recognised the value of unannounced site audits (no prior notice) so approached the HSE and negotiated access to information from the licensed contractors’ notification forms (ASB5), on a weekly basis, indicating who would be removing asbestos where and when(ii). Then in January 2017 ARCA took the step to support consistent high standards, by making the policy, that both site audits required every year would be unannounced (excluding Ireland). Myself and the Association’s Governing Council, believe that having two membership site audits every year, with no prior notice, makes the level of reassurance for clients so much stronger. And of course, supports member’s performance and business management. Why do we believe this? It is all down to the difference between what ‘announced/planned’ and ‘unannounced’ means to a contractor’s team on-site. If a site audit is ‘announced/planned’ the contractor will know an auditor is coming, so has time (perhaps days) to prepare. Time to get all its ducks in a row! For example, an ACAD member received an email saying; “We would like to come and carry out an ACAD membership audit and I have noticed on the HSE file that you have a job going on in <city>. Please could you confirm if we could visit this site on <specific date>?” (iii) Following agreement of this audit, the member received another email informing them of the auditor’s arrival time on-site and

requesting information to be sent (e.g. Plan of Work), 3 days prior to the planned audit.(iv) This increases the likely hood of a good result; however, it may not be a representation of the contractors’ day to day performance. ‘Unannounced’ means there is ‘no prior notice’ of an auditor coming on-site to monitor performance. No call. No email. No warning of a visit. Therefore, the contractor is assessed on the standard on that day. They always have to be prepared to demonstrate how the job was planned and how the plan is being implemented. This gives a representative view of the contractors’ day to day performance. This huge change to the ARCA membership audit scheme has been very well supported by members. In fact, ARCA has had contractors join as they want truly unannounced site audits, they see the benefit to performance management and to future business. The ARCA membership audit scheme is described on the website(v), stating that members need two satisfactory site audits, both unannounced, every year to maintain membership. The other trade association representing asbestos removal contractors, ACAD, is a little vague about its membership audit scheme. As on its website it states, “We carry out audits of member sites, both planned, and unannounced.” (vi) What does that really mean? What level of reassurance does it provide? Although, ACAD receives the same information from the HSE as ARCA, I cannot see that it uses it in the same way. Also, we have been advised that ACAD only carry out one membership site audit every year. I cannot see that one audit, when the contractor may know an auditor is coming on-site, is sufficient to demonstrate

that high standards are continuously demonstrated. ARCA has a team managing the membership audit scheme (two audits per year for all member asbestos removal contractors), and in-house auditors, to make sure the scheme runs smoothly. Successful management of the audit scheme is crucial as ARCA membership depends on it. As ARCA audits are unannounced and the information from the HSE is limited, inevitably some sites are not at a stage for an audit to be conducted, for whatever reason. However, ARCA is willing to take that financial hit(vii) (time and resource), as the underlaying reason for the unannounced audit scheme is to maintain high standards across membership. How does ACAD manage its audit scheme? I raise this question, particularly after I saw a news piece on the ACAD website - 10 May 2019: “Have you had your ACAD audit yet? .... Please contact <name> to arrange yours.” Posting news on their website, notifying members of an audit(iv), checking with a member that an auditor can come on-site(iii), requesting information prior to an audit(iv), and only one-member site audit per year(viii), leads me to question the creditability of the ACAD audit scheme. Also, some of their members were not audited at all in 2018.(viii) This leads me to say that I cannot see how clients can gain any reassurance from ACAD membership. If this trade association really does want to support the standards in the asbestos removal industry, I believe it needs to start to put words into actions. ARCA will continue to run, what I believe is an unrivalled audit scheme, so maintaining high standards across membership and providing clients with a high level of reassurance.

chairman’s comment Membership Support Another role of a trade association is to support membership and as asbestos removal is a licensed industry I feel this role has even more importance. ARCA has developed a range of support services for its member contractors, from producing guidance notes on specific regulated topics to developing an app for members to use when undertaking their own internal site audits. Audits are for monitoring performance,

yet they are also a method of supporting member contractors by highlighting areas where improvement could be made. To further support this, ARCA recently enhanced its unique auditing App, used to record and report on membership audits. Now the App collates any non-conformities within a separate corrective action report. Meaning any improvements are highlighted clearly in importance and available to the member immediately(ix) after the site audit is

completed, so any action can be taken without delay. The team is also available to support when it comes to licence renewal applications. A number of members have asked for help and have seen positive results. ARCA’s certification to ISO 9001 for its membership, training and auditing services provides an additional level of reassurance for members and customers.

Another ARCA initiative to support the industry

How can ARCA support? ARCA already delivers training, and has developed and provides qualifications. In fact, ARCA provides all the asbestos training and qualifications a removal operative, supervisor and manager, are required to have. The short-term labour workforce still has a poor reputation within the industry. How can all parties; contractor, agencies and operatives, be supported to raise the overall quality? Following discussions with some member contractors and labour supply agencies ARCA

has taken the initiative to resource the development of a performance feedback app. This will enable ARCA member contractors to rate operatives (from a member agency) on a number of specific capabilities, as well as behaviour and attitude. An operative’s overall rating (which will usually be from a number of contractors over a number of jobs) will be available to be seen by all contractors using the app, before selecting the operatives proposed by an agency for a job. I believe this will be a great support tool for contractors in future selection of short-term operatives, and also for the operatives, as they can gain recognition for good work and identify training needs to improve their skill set. ARCA is also taking another step to support the agency operatives by making free training available.

A number of years ago asbestos removal labour agencies needed a licence. However, this requirement was taken away, making it easier for labour agencies to operate in the asbestos removal industry. Shortly after this in January 2015, ARCA created a ‘Labour Supply’ membership category, whereby agencies supplying operatives to the industry need to undertake an office audit every year. By this I mean an ARCA auditor, would check that all their management systems, including certificate management, were sufficient and reliable. To continue to promote standards and improvement, the rules of membership for these members are being revised, so that from January 2020 they will undertake two office audits every year.

Over the years ARCA has introduced a number of initiatives to support both members and end-clients. From developing qualifications to managing an unrivalled membership audit scheme(x).

In this hazardous and licensed industry, we all need to work to support continuous improvement of standards across the industry. ARCA is now undertaking further initiatives. To support these we will look at

forging better relationships with some organisations and also develop new relationships.

ARCA has a membership of around 190 asbestos removal contractors, almost half of all the contractors in the UK, and they have told us that their biggest issue is the quality of labour. By quality, they mean the capability, knowledge, skills and behaviour.

New Asbestos Licence Renewal Process FEEDBACK ON PILOT At the ARCA regional meetings in January and February of this year, ARCA members who were part of the new asbestos licence renewal pilot, provided feedback on their experiences. The main comments on the new process received were: l The submission process is cumbersome due to the need to produce and name a series of emails and associated attachments. In general, it has been acknowledged that completing the application form and preparing the supporting documentation has been very time consuming and shouldn’t be underestimated. l Some members, including a few who were not part of the pilot, felt that the lack of a face-to-face meeting with an inspector would be a disadvantage to the applicant. They felt it was easier to resolve, or explain, any misunderstandings face-to-face rather than by email. l Applicants were getting stressed as a result of their licence expiry date fast approaching and not knowing whether they would receive a new licence before their old one ran out. In at least one case the licence did expire before a (positive) renewal decision was made. These comments were fed back to the HSE Asbestos Licensing Unit (ALU) during the ALC Licensed Working Group meeting in May.

HSE commented: l Some licence applications were being made late. The earlier an application is made the better the chance that it would be renewed in good time and before the existing licence expired. The message is to apply to HSE for asbestos licence renewal as soon as possible. l It was the intention to develop an online portal for asbestos licence renewal applications, however there is no time scale at the moment as to when this would be made available. l The topics causing most of the correspondence are risk assessments and personal monitoring. The quality of non-asbestos risk assessments is often poor and generic, and do not reflect the hierarchy of control measures. Members are advised to ensure their risk assessments demonstrate that the hierarchy of control measures (see below) has been considered. l Some personal monitoring submissions are a spreadsheet of all personal monitoring carried out, and some are just one record. What HSE is looking for is the strategy, how a contractor is capturing everyone, and what is being done when there are high levels. l HSE stated that the onus is on the applicant to demonstrate to HSE they are compliant, and that applicants should take every opportunity to do this. w For example, if the same two internal site audits are submitted to provide evidence for five different questions, then this could lead HSE to believe that two audits are all the

The list below sets out the order to follow when planning to reduce risks identified in the workplace. Consider the headings in the order shown, do not simply jump to the easiest control measure to implement. 1. Elimination - Redesign the job or substitute a substance so that the hazard is removed or eliminated. 2. Substitution - Replace the material or process with a less hazardous one. 3. Engineering controls - for example use work equipment or other measures to prevent falls where you cannot avoid working at height, install or use additional machinery to control risks from dust or fume or separate the hazard from operators by methods such as enclosing or guarding dangerous items of machinery/equipment. Give priority to measures which protect collectively over individual measures.

4. Administrative Controls - These are all about identifying and implementing the procedures you need to work safely. For example: reducing the time workers are exposed to hazards (e.g. by job rotation); prohibiting use of mobile phones in hazardous areas; increasing safety signage, and performing risk assessments. 5. Personal protective clothes and equipment - Only after all the previous measures have been tried and found ineffective in controlling risks to a reasonably practicable level, must personal protective equipment (PPE) be used. For example, where you cannot eliminate the risk of a fall, use work equipment or other measures to minimise the distance and consequences of a fall (should one occur). If chosen, PPE should be selected and fitted by the person who uses it. Workers must be trained in the function and limitation of each item of PPE.

HSE want to see job files which involve reasonably complex jobs, and this can include jobs for which the complexity is as a result of nonasbestos risks. l HSE reported that to date applicants have submitted a range of documentation. Some companies tend to send high level documents, but unless it is accompanied by specifics HSE is likely to go back to the company and ask for specifics and documentary evidence to support it. w For example, if a company has a policy of carrying out Director Site Visits then provide evidence that these have actually been conducted. Another example is worker involvement, a narrative answer stating that a company involves workers, will never be sufficient, there needs to be evidence that it happens and it is effective. l Site files that have been submitted are encouraging, although companies often have more evidence available which would help support their case but don’t submit it. w For example, site check sheets are submitted but the supervisor’s site diary is not submitted. What if an operative can’t continue work or the weather changes so work has to stop, where is that recorded? Usually it is in the site diary, and this should be included in the site file submitted to the HSE.

l HSE stressed that evidence sent electronically should have file names which reflect what the file contains, as this would make it easier to identify what evidence the files relate to. HSE clarified that the pilot phase is the period during which around 50 companies whose expiry date falls from 1 April 2019 to 30 June 2019 will be assessed.

HSE Policy Changes HSE also reported on some policy changes as a result of the pilot: l Originally it had been envisaged that in case of an application being refused during the pilot period there would always be a face-to-face meeting. That will still often be the case but in some instances a refusal may happen without such a meeting. The assessment report which HSE provides to the applicant will contain a full explanation of such a decision. l Licence terms granted for successful renewal applications will be streamlined to 3 years, with 1-year licences generally reserved for new applicants (if a licence is granted at all). A rationale setting out the reasons for and implications of these changes will be made available shortly. There is still leeway for non-standard licence terms in certain circumstances.

Hoteliers fined after failing to assess the presence of asbestos during refurbishment A Devon based hotelier has been sentenced today after materials containing asbestos were disturbed during a major refurbishment at The Park Hotel in Barnstaple. Newton Abbot Magistrates’ Court heard that between October 2016 and May 2017 construction work was undertaken to refurbish the hotel on Taw Vale. Parts of the hotel were originally constructed during the 1960’s and 1970’s when asbestos was a popular building material. The project aimed to refit and refurbish bathrooms and bedrooms. An investigation by the Health and Safety Executive found that, at an early stage of the work, an employee raised concerns about the potential presence of asbestos containing materials (ACM) within the rooms under refurbishment. Enquiries were made but no

physical testing of the materials being disturbed was undertaken. Work continued for several more months and concerns about the materials within the bedrooms and bathrooms were raised again by external contractors. Testing of the material being disturbed was eventually conducted in February 2017 and the presence of ACMs was confirmed. Whilst the HSE investigation was in progress the defendant had a further incident in May 2017 where ACMs were disturbed during bathroom refurbishment works being undertaken. The planning undertaken for this work, which had included an assessment as to the presence of ACMs, was inadequate as it failed to identify the full scope of the work proposed and the materials that would be disturbed during pipework installation works. The investigation also found that

refurbishment work was undertaken at the hotel without the appropriate assessment as to the presence of asbestos containing materials. Once identified the hotel took remedial action which included sampling of common parts for asbestos fibres, which came back as negative. Percy R Brend and Sons (Hoteliers) Ltd of Taw Vale, Barnstaple pleaded guilty to breaching Section 2(1) and 3(1) of the Health and Safety at Work etc Act 1974. They have been fined £80,000 and ordered to pay costs of £14,999.60. Speaking after the hearing HSE inspector JoAnne Michael said: “The dangers associated with asbestos are well known and a wealth of advice and guidance is freely available from HSE and other organisations. “Identification of the hazard is key. Duty holders should not undertake any work which either exposes or is liable to expose their employees to asbestos unless they have carried out a suitable and sufficient assessment as to the presence, location and condition of asbestos in the premises. Those persons tasked with undertaking the assessment should have the necessary skills.”

A

construction company and its director have been fined after failing to ensure the safe removal of asbestos during demolition work. Greater Manchester Magistrates’ Court heard how Sherwood Homes Limited was the client responsible for the demolition of Crowton Mill in Northwich. Peter Kiely was a director of the company when the results of an asbestos survey conducted in January 2017 were received that identified the presence of asbestos containing materials on the site. The extra work required to remove the asbestos increased the estimated costs and timescale for the completion of the demolition.

An investigation carried out by the Health and Safety Executive (HSE) found that Sherwood Homes Limited failed to ensure suitable contractors were used to carry out the asbestos removal work and demolition of the mill in February 2017. No record of a notification to HSE to remove asbestos had been received for the site. No details of how the asbestos containing materials were removed or how they were disposed were provided to HSE. Sherwood Homes Limited have had previous enforcement by HSE, including a prosecution in 2018 in relation to their role as a construction client. Sherwood Homes Limited of Houldsworth Street, Stockport was found guilty to breaching regulation 4(1) of the Construction (Design and Management) Regulations 2015. The company was fined £170,000 and ordered to pay costs of £10,406.

Company director Peter Kiely of Bolton, pleaded guilty to breaching section 37 of the Health and Safety at Work etc. Act 1974, in relation to the company’s failing of regulation 4(1) of the Construction (Design and Management) Regulations 2015. Peter Kiely was fined £6,500 and ordered to pay costs of £7000. HSE Inspector David Norton said after the hearing “Asbestos is responsible for thousands of deaths in the UK every year but it only becomes dangerous when it is broken up and fibres are released into the air. Asbestos should only be removed by specialist contractors. Sherwood Homes Ltd and Peter Kiely put workers at risk by not following the correct safety procedures. Companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.”

hrewsbury and Telford Hospital NHS Trust has been fined after refurbishment work undertaken in an accommodation block at Royal Shrewsbury Hospital exposed Trust employees and contractors to asbestos. Telford Magistrates’ Court heard how in June 2012 Trust employees were removing fixtures and fittings from the empty flat when they disturbed asbestos containing materials (ACMs). The Trust then failed to take adequate measures to deal with the initial release of asbestos, exposing other contractors who later worked in the flat. An investigation by the Health and Safety Executive (HSE) found that the Trust did not properly record ACM on their estate. The Trust had arrangements in place to manage asbestos, however, the overall management plan for dealing with asbestos was not recorded in a clear and concise manner or effectively communicated to its employees

and contractors working on site. The Trust had insufficient auditing procedures to ensure that the arrangements contained in the policy and management plan were fully implemented, working properly and effective. The procedures in place upon the discovery of asbestos were inadequate and the Trust failed to prevent re-entry into the contaminated area by other workers. Shrewsbury and Telford Hospitals NHS Trust of Mytton Oak Rd, Shrewsbury pleaded guilty to two breaches of the Control of Asbestos Regulations 2012 and were fined £16,000 and ordered to pay costs of £18,385.80. After the hearing HSE inspector David Kivlin said; “The Trust should have controlled this potentially lethal risk by identifying the type, location and condition of any asbestos-containing-materials within the accommodation block at the Royal

Shrewsbury Hospital, by implementing suitable precautions to prevent its disturbance. “Although there is no indication that members of the public at the hospital were exposed as a result of the failings, asbestos related diseases are currently untreatable and claim the lives of an estimated 5,000 people per year in the UK. “This prosecution should act as a reminder, not just to Hospitals but to anyone in control of the repair and maintenance of non-domestic premises, of the need to ensure that correct control measures are put in place to ensure that exposure to asbestos is prevented, so far as is reasonably practicable.”

n Oldham building contractor has been fined following the uncontrolled removal of asbestos during a garage conversion. Manchester and Salford Magistrates’ Court heard how in December 2017 the Health and Safety Executive (HSE) was notified by a member of the public of fibrous board outside the property in Chadderton, Oldham which looked like asbestos insulation board. Mr Mohammad Arshad, a contractor appointed by the home owner to carry out the work, had stripped the garage ceiling and removed the material, leaving debris on site. The material was

tested during a site visit was confirmed as being licensable asbestos containing material. The HSE investigation into the incident found Mr Arshad had carried out the removal of licensable asbestos containing materials without being licensed to do so and without suitable control measures for preventing exposure to and spread of asbestos fibres. A prohibition notice was issued and the area was sealed off before being cleaned by a licensed contractor under fully controlled conditions. Mohammad Arshad of Broadway, Chadderton, Oldham pleaded guilty

to breaches of Regulation 11 (1) (a), Regulation 8 (1) and Regulation 16 of the Control of Asbestos Regulations 2012 and was fined £1200 and ordered to pay costs of £1000. Speaking after the hearing HSE inspector Laura Royales said: “Asbestos is a class 1 carcinogen which is responsible for around 5000 deaths per year. Prior to starting work on the property Mr Arshad should have had an asbestos survey carried out by a competent person. He should have then appointed a licensed contractor to remove the asbestos containing ceiling under controlled conditions. Instead he carelessly removed it himself, potentially putting himself and others at risk of exposure. Individuals and companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards”.

HSE Guidance on RPE Fit Testing T

he HSE ‘Guidance on Respiratory Protective Equipment (RPE) Fit Testing’, published March 2019, gives advice on fit testing for the employer and those conducting fit tests. This guide provides information on fit test methods, what can be achieved from a fit test and the core information to be included in a fit test report. Where respiratory protective equipment (RPE) is used as a control measure under health and safety legislation, it is vital that the selected RPE is both adequate and suitable. A fit test should be carried out as part of the initial selection of the RPE. General advice on selection of RPE is covered in the HSE guidance document ‘Respiratory protective equipment at work: A practical guide’ (HSG53), available on the HSE website. Fit testing should be conducted by a competent person. Competence can be demonstrated by accreditation under the Fit2Fit RPE Fit Test Providers Accreditation Scheme. This scheme has been developed by the British Safety Industry Federation (BSIF), together with industry stakeholders, and is supported by HSE. The scheme is not compulsory and employers are free to take other action to comply with the law.

The performance of tight-fitting facepieces depends on achieving a good contact between the wearer’s skin and the face seal of the facepiece. People’s faces vary significantly in shape and size so it is unlikely that one particular model or size of RPE facepiece will fit everyone. Inadequate fit will significantly reduce the protection provided to the wearer. Any reduction in protection may lead to immediate or longterm ill health or can even put the RPE wearer’s life in danger. Fit testing is therefore a method for checking that a specific model and size of tight-fitting facepiece matches the wearer’s facial features and seals adequately to the wearer’s face. It will also help to identify unsuitable facepieces which should not be used. A pre-use wearer-seal check should be carried out each time a fit-tested facepiece is worn and before entering the hazardous environment. This check is to determine whether the wearer has correctly donned a facepiece before entering a contaminated work area. The RPE manufacturer will provide instructions on how to carry it out. Note, however, that a pre-use wearer-seal check is not a substitute for fit testing. Tight-fitting facepieces (often referred to as masks) rely on having a good seal with the

wearer’s face. These are available as both non-powered and powered respirators, and breathing apparatus (BA) with either a half mask or a full-face mask. Their performance, irrespective of whether they are non-powered (negative pressure), powered or constant-flow airline BA relies heavily on the quality of fit of the facepiece to the wearer’s face. An inadequate fit will significantly reduce the protection provided to the wearer. mind over matter Why employers in the asbestos industry need to look at more than just the physical health and wellbeing of their workers.

What about workplace mental health? Professionals involved in asbestos management understand and accept the importance of Health and Safety at work. This focus on worker health and safety is of course understandable given that asbestos is a class 1 carcinogen, which causes thousands of deaths every year. To combat the risks the asbestos removal industry is licensed, with contractors requiring a licence from the HSE, as well as regulations in place to ensure health and safety.

The Facts Poor mental health might seem like a relatively minor issue compared to asbestos, but the facts suggest that it is a huge issue across all businesses/ industries. In 2017 The Stevenson Farmer Review found that: w Around 15% of people at work have symptoms of an existing mental health condition w 300,000 people with long-term mental health problems lose their jobs each year And this costs businesses too in absence, engagement, and productivity. The same report put the employer cost at somewhere between ÂŁ33bn and ÂŁ42bn each year. So, poor mental health is a very real and present danger to an organisation and its workers.

What actions can employers take? So, what can be done to provide employees and line managers with appropriate support in this area? The Stevenson Farmer report suggested that all organisations are capable of implementing the following mental health core standards quickly: 1. Produce, implement and communicate a mental health at work plan 2. Develop mental health awareness among employees 3. Encourage open conversations about mental health and the support available when employees are struggling 4. Provide employees with good working conditions and ensure they have a healthy work life balance and opportunities for development 5. Promote effective people management through line managers and supervisors 6. Routinely monitor employee mental health and wellbeing

health & safety And went on to suggest that larger employers could and should meet the following enhanced standards: 7. Increase transparency and accountability through internal and external reporting

Asbestos Work and Electrical Isolations O

n most, if not all, asbestos removal sites there are electrical hazards, and these can be a significant issue, as poorly planned and managed work on or near electrical equipment can be fatal. Therefore, asbestos removal companies must undertake a thorough site-specific assessment of risk, in order to identify appropriate control measures. The most ‘straightforward’ AIB removal job will be complicated by the presence of light fixtures and fittings. Also, asbestos removal can involve the application of water and surfactant increasing electrical safety risks. In addition, asbestos removal contractors are often required to work in voids etc. where live conductors are likely to be found.

Risk management when planning work

Having identified a hazard, the contractor will then have to decide how likely it is that harm will occur; i.e. the level of risk and what to do about it. Can the hazard be removed altogether or how can the risk(s) be controlled so that harm is unlikely? The HSE refers to the hierarchy of control measures, whereby a control should be chosen in order to reduce the risk of accident or ill health to the lowest reasonably practicable level. The control measure should be chosen in order of priority, not because it is the easiest measure to implement. At the top of this hierarchy is, ‘elimination’, where by the hazard is removed or eliminated, such as isolating an electrical circuit.

Electrical risks on-site

Electrical risks can arise in many forms: poorly maintained / inappropriate electrical equipment, buried cables, overhead lines etc. In all cases, a general assessment should have identified standard procedures for carrying out work safely, with site specific assessments and methods added to take account of significant risks present on a particular site. The Health and Safety at Work etc. Act 1974 and the Management of Health and Safety Regulations 1999 set out legal requirements for controlling significant risks arising from work activities. Asbestos removal contractors refer to the Control of Asbestos Regulations 2012 (CAR 2012) and associated Approved Code of Practice, whereby any significant risks whether asbestos related or not, should be addressed in the site-specific Plan of Work for asbestos removal.

guidance The Construction (Design and Management) Regulations 2015 (CDM 2015) place specific duties on contractors and clients, focusing on effective planning, coordination and competence. The Electricity at Work Regulations 1989 require safe systems of work to be in place and also that employees have appropriate technical knowledge, tools, test equipment and personal protective equipment. Making live conductors dead prior to asbestos removal jobs is the preferred control method. So, one of the purposes of the notification / planning requirements is to allow all necessary preparation to be carried out, as multiple parties (clients, principal contractors, removal contractors etc.) may have a part to play in ensuring that a work site is safe and healthy.

‘effective communication and co-operation between all parties is key’ The key is co-ordination, effective communication and co-operation between all those involved. Contractors often rely on others to ensure that electrical isolations are in place. Where this is the case, there should be very clear confirmation of how this has been achieved.

General procedures Asbestos removal teams should not work in the vicinity of live conductors, as accidental contact (or contact with surfactant) can be fatal and it is relatively simple to isolate circuits and check they are dead. Live working is generally only acceptable where, for example, trained electricians are fault-finding or testing and suitable precautions are in place to prevent injury. Adequate planning, standard procedures, basic awareness training and choice of equipment should ensure significant electrical risks are controlled for asbestos removal companies. Managers should be able to: liaise with clients regarding power requirements and limitations; carry out site specific assessments that include consideration of any live or suspect equipment and conductors; produce a Plan of Work that is clear on how isolation is expected to be demonstrated and successful isolation should be recorded at a hold point, or similar. Site teams should be able to look for (potential) conductors etc. as part of their routine on-site assessments before starting work and identify situations where work would be expected to stop until suitable isolations and assurances are provided.

Construction companies fined after employee received electrical burns (ref: HSE website 26 April 2019) The Court heard how a ‘worker’ had been told by the principal contractor that the electrical equipment had been isolated. To reassure his colleague that it was safe he threw a crowbar at the 400V ac equipment. This came into contact with live exposed wires, causing a flashover and temperatures of several thousand degrees, followed by a subsequent fire. As a result, the ‘worker’ suffered serious burn injuries and was immediately hospitalised. An investigation by the Health and Safety Executive (HSE) found that the task being undertaken had not been properly planned and suitable control measures were not implemented to ensure the isolation of the power supply. One company breached Regulation 3(1) of the Electricity at Work Regulations 1989, and the other the Health and Safety at Work etc Act 1974. Both were fined £80,000 and ordered to pay costs. After the hearing HSE inspector said “This incident has had a significant impact on the worker’s life and the injuries could so very easily have been fatal. Had the companies followed the control measures outlined in their respective risk assessments, then this incident would not have occurred. Never assume that an electrical supply is disconnected. Always check with the Distribution Network Operator or a qualified electrician to obtain written proof of isolation before commencing work.”

Isolation Isolation means making a circuit dead and preventing it from becoming charged during the work. In other words, circuits must be locked off and controlled. Those doing the work, need to be confident that the means of disconnection is secure and it is highly recommended that a caution notice or label is attached at the point of disconnection, in addition to any other measures taken. Verbal assurances that isolations have been made are not sufficient and reasonable enquiries should be made to check the competency of those carrying out the isolations. Isolation using a main switch or distribution board switch-disconnector is the preferred method. It should be locked off using a unique key, which is controlled by the person carrying out the work or another appointed person, with a warning notice attached.

‘isolation should always be the preferred control method’ It is vitally important to establish that the isolation point is correctly identified: where there can be doubt, competent electricians should carry out tests to ensure that the isolation point being used is the correct one. Following isolation and before starting work, it should be proved that all relevant equipment is dead. This is done using a test lamp or voltage detector etc. Unused or unidentified cables must be assumed to be live unless they are proved to be dead and isolated. Isolation will generally be considered to be “reasonably practicable” and should always be the preferred control method. A RISKY BUSINESS? While the term ‘Risk Assessment’ came to the fore with the introduction of the Management of Health and Safety at Work Regulations 1992, the concept of assessing risk was not new. In the intervening years, the concept of risk assessment has become fundamental in health and safety management, and very much so in planning safe work with asbestos.

A

hazard is traditionally defined as ‘something with the potential to cause harm’ with the risk being the ‘likelihood of the harm occurring’ coupled with the severity of that harm. Elimination of hazards, without introducing new ones, is often not possible, so the emphasis will always be on introducing control measures to reduce the risks associated with the hazards. In some cases these control measures can reduce the severity of harm, though in most cases they will reduce the likelihood of the harm occurring.

Asbestos and Non-Asbestos Risks Assessment of risk is a major consideration and legal requirement when managing and working with asbestos. Regulation 6 of the Control of Asbestos Regulations 2012 (CAR 2012) outlines the assessment of work which exposes employees to asbestos, and the corresponding ACoP (L143, Managing and Working with Asbestos) expands on the legal requirement and sets out steps which,

if followed, would demonstrate that the regulations have been complied with. Paragraph 154 of L143 states that “if work liable to expose employees, and others affected by the work, to asbestos is unavoidable then, before starting work, employers must make a suitable and sufficient assessment of the risks created by the likely exposure. Employers must then identify the steps required to comply with the Regulations.” The risk assessment should also include “any other information relevant to safe working practices, such as other significant nonasbestos hazards like working at height or in confined spaces” (L143, paragraph 160). The risks from the non-asbestos hazards may be as critical as the risks from the asbestos hazards, and so considerable effort may be needed to decide on and implement the required control measures. For licensed asbestos removal work, there is clearly a set sequence that should be followed in planning the work. First of all there is an information gathering exercise, which includes


risk management identifying significant hazards (asbestos and non-asbestos) inherent on the site and any hazards introduced to the work as a result the work methods selected. This information is converted to instruction to the site team(s) in the form of a Plan of Work (sometimes referred to as a Method Statement). Within the Plan of Work should be sufficient detail of all of the control measures to be applied. The 14-day notification (ASB5 form) will then be prepared, by extracting key details from the Plan of Work, and submitted to the enforcing authority. So, the sequence is (i) Risk assessment, (ii) Plan of Work and (iii) Notification to the Enforcing Authority. Any other sequence, where risk assessment is essentially an afterthought, is incorrect and likely to result in key risks being overlooked or not sufficiently controlled, ultimately leading to an increased likelihood of an accident or incident occurring. It is an employer’s duty to ensure that whoever conducts the risk assessments (asbestos or non-asbestos) is competent to do so, as the assessor should: w w w w w w

have adequate knowledge, training and expertise in understanding the risks from asbestos and be able to make informed and appropriate decisions about the risks and precautions needed; know how the work activity may disturb asbestos; be familiar with and understand the requirements of the Regulations; have the ability and authority to collate all the necessary and relevant information; be able to assess other non-asbestos risks on-site; be able to estimate the expected level of exposure to decide whether or not the control limit is likely to be exceeded.

The level of detail in a risk assessment should be proportionate to the risk and appropriate to the nature of the work. Insignificant risks can usually be ignored, as can risks arising from routine activities associated with life in general, unless the work activity compounds or significantly alters those risks. For the risk assessment for licensable work to be suitable and sufficient, it should also include the reasons for the chosen work method and arrangements required to ensure that the premises or parts of the premises where work has taken place are left clean for reoccupation. This control measure reduces the likelihood of asbestos exposure not only to those carrying out the work but also future occupants.

Risk Profiling and Risk-based Thinking In recent years the term ‘Risk Profiling’ has been increasingly used, and when applied takes the concept of risk assessment a step further. Risk profiling is explained in the HSE publication HSG65, (Managing for Health and Safety), stating that “the risk profile of an organisation informs all aspects of the approach to leading and managing its health and safety risks. Every organisation will have its own risk profile. This is the starting point for determining the greatest health and safety issues for the organisation.” In some situations the risks will relate to tangible and immediate safety hazards (e.g. from non-asbestos hazards), whereas other risks may be health-related and it may be a long time before the illness becomes apparent (e.g. from asbestos hazards). A risk profile examines: w w w w

the nature and level of the threats faced by an organisation; the likelihood of adverse effects occurring; the level of disruption and costs associated with each type of risk; the effectiveness of controls in place to manage those risks.

The outcome of risk profiling will be that the right risks have been identified and prioritised for action, and minor risks will not have been given too much priority. It also informs decisions about what risk control measures are needed. Effective leaders and line managers know the risks their organisations face, rank them in order of importance and take action to control them. The range of risks goes beyond health and safety risks to include quality, environmental and asset damage, and issues in one area could impact in another. Those organisations who are certified against management system standards such as ISO 9001 or 45001 will have become aware of recent changes to these standards in introducing risk-based thinking. In particular, ISO 45001:2018 promotes not only legal and regulatory compliance, but a more thorough approach to risk identification and risk control of all operational activities and processes that could introduce harm to employees, contractors and/or members of the public.

Risk Assessment Findings It is a legal requirement (under CAR 2012) for significant findings of the risk assessment to be recorded, and be available on-site at all times. However, there is no official published template or format as to how the risk assessments are to be recorded. Many approaches are widely used and available, but a crucial element of being suitable and sufficient is that the level of detail in the assessment needs to be proportional to the level of risk. What matters most is that the control measures identified are realistic, practical and reduce risks to an acceptable level. The HSE refers to the hierarchy of control measures, whereby a control should be chosen in order to reduce the risk to the lowest reasonably practicable level. The control measure should be chosen in order of priority, not because it is the easiest measure to implement. For licensed asbestos removal work, risk assessment is not only a legal requirement, but a crucial building block in developing the Plan of Work. This ‘Plan’ should be a practical and useful document describing a safe working method for site teams to follow. It should include details of the work, and the appropriate actions to control all significant risks and prevent harm. In all cases the control measures will be underpinned by the assessment of risks of exposure to asbestos required by CAR 2012, and other risks as required by the Management of Health and Safety at Work Regulations 1999. Only with an adequate risk assessment (for both asbestos and non-asbestos risks) can a suitable and sufficient Plan of Work be produced, enabling compliance with the standard licence condition that the licensed work will be carried out ‘in accordance with the suitable and sufficient plan of work’. Encapsulation

encapsulation of sprayed coatings, insulation, board etc. These encapsulants can provide impact resistance as well as elasticity, especially when incorporating a reinforcing membrane, e.g. calico cloth or scrim. Correctly applied to asbestos applications, these encapsulants may provide up to 20 years of life if undisturbed, however, the manufacturer’s instructions should be followed.

Encapsulation is the application of an impervious material, which is secured over or around asbestos containing materials (ACM), and is designed to prevent the release of fibres under foreseeable conditions, such as vibration, impact and age degradation, so maintaining it in a safe condition. This article provides guidance on the considerations for the use and methods of encapsulating ACM once a decision has been made to encapsulate as part of an overall management plan.

l Penetrating Encapsulants Penetrating encapsulants are suitable for encapsulation of sprayed coatings, insulation, boards etc. Spray applied encapsulants are available which will penetrate friable ACMs. Such encapsulants have many advantages over other forms, but their application must follow manufacturer’s instructions for effective results.

of Asbestos Containing Materials

Licensed Work Encapsulation of ACM is classed as work with asbestos, and is subject to the requirements of the Control of Asbestos Regulations 2012 (CAR 2012). Therefore, encapsulation should be planned to minimise the potential for fibre release. Dependent upon the type and condition of the ACM, and the duration of the works, it will usually be necessary to employ the services of a contractor, licensed by the Health and Safety Executive (HSE). A licensed contractor will have the specialist knowledge, experience and equipment to carry out the work safely and effectively, as well as the specialist insurance cover required when working with asbestos. However, the regulations may not strictly require a licensed contractor if: w The material is in good condition w The Control Limit (0.1 f/cm³ 4-hour Time Weighted Average) will not be exceeded during the work w The Short-Term Exposure Value (0.6 f/cm³ measured over any 10-minute period) will not be exceeded during the work. Details of how to carry out minor asbestos encapsulation work not requiring a licence can be found in the HSE’s Asbestos Essentials HSG210 Task Manual (www.hse.gov.uk). All contractors are legally required to be insured for the work they carry out. When carrying out encapsulation, contractors need to hold employers and public liability insurance specifically for work with asbestos.

When is Encapsulation Appropriate? When considering encapsulation, the condition of the existing ACM is of prime importance, particularly in the case of sprayed asbestos and thermal insulation. Encapsulation should only be

considered if the ACM is adhering firmly to the substrate and is in a viable state. Planned works should be technically possible, economically viable, and the attributes of the original application need to be maintained. Of equal importance, is the need to ensure that there is no likelihood of water penetration into the asbestos from the substrate after encapsulation, as the additional weight of absorbed and trapped water could cause the asbestos to fall away. Also to be considered is the possible future damage to the application, e.g. from structural movement, vibration, vandalism, or from tools and equipment, or vehicles such as fork lift trucks, and the need for future maintenance work. Encapsulation should maintain the attributes of the original asbestos application e.g. fire resistance, acoustic or thermal insulation and maintain it in a safe condition. Where the asbestos to be encapsulated is providing fire protection any encapsulant which is used should also be suitably fire resistant.

Methods of Encapsulation There are four methods of encapsulation that are commonly available: l Mechanical Encapsulation An example of mechanical encapsulation would be the addition of board or sheet materials and simply painting with domestic paint. Normally board or sheet materials should not be fixed through the asbestos material. However, if the assessment shows that the best method for mechanical protection requires screw fixing through the asbestos material, appropriate controls should be put in place to minimise fibre release and the spread of contamination. l High Build Elastomeric Coating This method consists of a liquid encapsulant being applied in several layers, suitable for

Method of Application for Liquid Encapsulants Depending on the surface condition of the ACM, a light coat of thinned encapsulant or bonding primer should initially be spray applied at a lower pressure than final applications (to increase penetration). This consolidates the surface prior to the application of one or more coats of the encapsulant to achieve the manufacturer’s dry film thickness. The encapsulant may be reinforced with non-asbestos fibres if additional protection is required to increase resistance to impact, this should be applied to the wet surface between coats. Encapsulating asbestos which has been sprayed onto a structure, e.g. beams and columns can produce poor results as the material is often not stable. Ensure that any method used will not lead to this occurring. However, if encapsulation is appropriate to surfaces where sprayed asbestos has been removed, and residue remains, which cannot be removed, the encapsulant should be applied over and beyond the asbestos residue. Where products have been treated by an encapsulation process, the risk should be reassessed and the material managed in accordance with Regulation 4 of the CAR 2012.

UKAS accrediation

What does UKAS accreditation entail? Asbestos air testing and 4-stage clearance testing.

D

espite the first case of asbestosis being identified in the 1920s, it took until the turn of the century for its use to be completely banned in the UK. With the Health & Safety Executive (HSE) estimating that around 5,000 people die from asbestos related diseases each year in the UK, managing the legacy of asbestos is very much a 21st century problem for government, businesses and property owners. The quality of testing is essential for the effective control of asbestos. UKAS is the UK’s National Accreditation Body. It is able to accredit Laboratories for a range of testing activities including analysis of asbestos in bulk materials, asbestos in soils, air monitoring and the four-stage clearance process. Laboratory accreditation is carried out by UKAS against the internationally recognised standard ISO/ IEC 17025 to assess factors relevant to a laboratory’s ability to produce precise, accurate tests and data. Such factors include the validity and appropriateness of test methods, the suitability and maintenance of test equipment, the

testing environment, sampling, handling and transportation of test items, and the quality assurance of test data. As part of this process UKAS also determines technical competence of staff through witnessing of staff performing activities the laboratories wish to be accredited for. With a revised edition of the HSE’s HSG248 (Asbestos: the analysts’ guide for sampling, analysis and clearance procedures) due to be published soon, laboratories and their clients have been busy preparing themselves for the inevitable changes that will follow. A number of improvements are expected, such as the requirement to include photographs within reports issued by labs to provide more information on the work undertaken during the four-stage clearance and hopefully better clarity for the reader.

Steps to gaining asbestos testing accreditation Laboratories considering applying for accreditation should check to see if they meet the relevant requirements and familiarise themselves with the

clauses in ISO/IEC 17025. Undertaking a gap analysis to identify areas that need addressing is recommended. Relevant supporting UKAS publications and guidance documents, such as LAB30 Application of ISO/IEC 17025 for Asbestos Sampling and Testing, which are freely available to download from the UKAS website, should also be considered. The next stage is to apply for accreditation using the relevant form and provide the supporting information required to be submitted with the application, including the quality manual and proof of legal status. Costs and payment terms are set out in the Terms of Business. Once the application is received, a Section Head and Assessment Manager will be allocated, with the latter acting as case manager and main point of contact. The Assessment Manager will review the documentation and guide applicants through the process of gaining accreditation. They will also discuss the composition of the proposed team that is best placed to technically assess the organisation and also outline the


UKAS accrediation timescales involved. There is normally a lead-in time of approximately three months to arrange the first assessment visit.

Pre-assessment Although optional, UKAS strongly recommends a less formal pre-assessment visit as it is often a valuable step in the process to reduce delays in gaining accreditation. After addressing any issues raised during the pre-assessment visit, the Initial Assessment is the first formal assessment or in some cases, after discussion with their Assessment Managers, laboratories may decide to go straight to an Initial Assessment. A preassessment generally avoids issues found through formal assessment and can save time and expense in the long run.

The initial assessment visit This will be conducted by a Lead Assessor (normally the Assessment Manager) supported, as necessary, by technical assessors with the expertise to cover the scope of the application. The length of the visit will depend upon the scope of application requested and in all cases the Assessment Manager will provide a quotation for the work involved.

The practicalities of the assessment In advance of the visit, applicants receive a visit confirmation followed by a visit plan, which provides a proposed timetable for the work to be assessed. Following an open meeting to confirm the arrangements, a full vertical and horizontal audit takes place. This involves a detailed review of company records, interviews with staff and managers, and the witnessing of key activities. Once the assessment is complete, a debrief of the visit and any findings are discussed at a closing meeting. UKAS provides a full report during or immediately following the assessment visit. This details any findings or improvement actions identified against accreditation requirements and applicants will be asked to advise UKAS on how they will address them. The assessment team then makes a recommendation at the closing meeting.

Witnessing of key activities At the time of the Initial Assessment the UKAS team is looking for compliance against the requirements of ISO/ IEC 17025, which includes fulfilment against both the Management and Technical aspects of the standard. The laboratory must also demonstrate that individuals carrying out air monitoring and four-stage clearances are technically competent to do so. This is demonstrated through a combination of aspects including ensuring appropriate qualifications are held by staff and the internal training and authorisation procedures are appropriate. In addition, the Technical Assessor must also witness, in real-time, an analyst undertaking a four-stage clearance on-site following the removal of asbestos materials under fully controlled conditions. This forms a vital part of any assessment and will prevent a recommendation to offer accreditation until competency can be demonstrated. UKAS expects laboratories to have completed training and authorisation of staff as far as possible before completion of the Initial Assessment, so that the implementation of the laboratories systems can be assessed. Technical Assessors witness analysts undertaking all aspects of the fourstage clearance, including testing of the hygiene unit on-site. This allows for the competency of staff to be witnessed along with the implementation of the in-house methods. The Technical Assessor may also ask a series of technical questions during witnessing in order to assess the level of experience, knowledge and competency staff hold. Assessors will also undertake a review of the documented technical procedures the laboratory hold to see that these are in line with the guidance documents including HSE’s HSG248. In many areas UKAS accreditation is voluntary but under CAR 2012 it is mandatory for the four-stage clearance process. As the laboratory applying for accreditation will not yet hold accreditation at the time of the Initial Assessment, it needs to work with an already accredited laboratory to shadow

the process and complete all stages of the four-stage clearance once the applicant laboratory has been witnessed completing each stage of the process. It is advisable that all parties involved in the works are made aware of the Initial Assessment taking place and it is best to avoid time sensitive works where possible. UKAS appreciates that sourcing four-stage clearance work for UKAS to witness during the Initial Assessment visits can be a challenge for applicants, so it is advised that communication between the Laboratory and their Assessment Manager is vital so that potential issues can be addressed.

Post assessment Should any findings arise, applicants generally have approximately 12 weeks to provide suitable evidence to the Assessment Manager that these have been addressed and this evidence will be then be reviewed to check matters have been addressed satisfactorily. Once all findings have been satisfactorily cleared, the Assessment Manager will submit their recommendation to an independent Decision-maker within UKAS. Following ratification of the decision to grant accreditation, successful applicants will be notified in writing and receive a certificate of accreditation. A schedule defining the scope of each organisation’s accreditation is then made publicly available on the UKAS website.

ION Environmental awarded asbestos removal work at former ITV Studios

I

TV Studios is relocating from its renowned former headquarters on London’s South Bank to a new base in Holborn. The two structures that once housed the worldfamous broadcasting company – Prince’s Wharf and the SBK Building – are undergoing a complete refurbishment, in preparation for a redevelopment project. Carey Group companies, ION Environmental and Scudder Demolition, have been contributing to the refurbishment of the iconic studio structures by carrying out an eight-week package of works. Over the 40 years that ITV Studios operated in this spot on the banks of the Thames, several famous TV shows were created here, such as This Morning and Ant and Dec’s Saturday Night Takeaway. Now that the broadcaster has decided to relocate to its new leased studio space in Holborn, it plans to offer its former headquarters for sale.

ION Environmental has been awarded a package of remediation works on this site which enables them to support the refurbishment. Their responsibilities on this project involve: providing specialist asbestos strip-out services to render the site safe and removing asbestos from the roof of the bridge between Prince’s Wharf and the SBK Building, prior to demolition. On this important project fellow Carey Group company, Scudder Demolition, have also been tasked with conducting a wide range of works, including the deconstruction of the bridge that connected the two studio buildings. DKF Recruitment Director, Katy Fagan, completed the gruelling Manchester Marathon, raising a whopping £1,275.00 for Mesothelioma UK. Achieving a personal best time of 3 hours and 56 minutes, Katy enjoyed the support of close friends and family, as well as several members of the DKF team who were there to cheer her on. This year the marathon had a record number of over 20,000 runners. Rilmac Asbestos Services support mental wellbeing T he importance of talking about mental wellbeing and the value in opening up about emotions will be discussed with over 800 construction workers from Lincolnshire and nationwide. Rilmac Asbestos Services, has teamed up with a local construction group, to support a campaign by national charity Mates in Mind, which aims to address the stigma around poor mental health and improve positive mental wellbeing among those working in the building sector. Together the two businesses will deliver workshops designed to help change the culture in construction and encourage employees to see the worth in being open about how they are feeling. The sessions will be backed up by poster campaigns and will see all employees given information about support networks as well as contact details for a 24-hour mental health helpline. The campaign was rolled out to coincide with this year’s national Mental Health Awareness Week, which began on Monday, May 13th, and comes as statistics show 34 per

cent of construction workers have experienced a mental health condition in the last 12 months and suicide rates amongst construction workers is 3.7 times above the national average. NVQs require effective planning ARCA can provide an efficient assessment process Asbestos removal operatives and supervisors can gain an NVQ in the shortest possible time when the assessment process is planned well in advance, especially as a candidate can need up to three assessment sites and dates scheduled. By discussing appropriate sites and timings, ARCA will be able to provide members with the best possible assessment plan for a Level 2 and Level 3 NVQ. Also, members can plan by prioritising candidates based on their CSCS card requirements or card expiry. “It is important for members to plan well in advance, as we need a number of suitable asbestos removal sites to assess a candidate and construct a portfolio of evidence that covers all the necessary criteria,” commented Satish Patel, Training Manager for ARCA. “More members are now effectively planning all NVQs with us, so that candidates are able to complete their NVQ assessments in the most efficient and cost-effective way.”

CITB Funding for Asbestos NVQs and Training If your asbestos removal company is registered with the CITB for levy purposes, there are grants and funding available to support your asbestos training needs. To support you ARCA has consolidated and simplified the CITB information, and made this available on the ARCA website. The content covers:

CITB Grants w Short Period Qualification Grant The CITB pays a £600 grant on the achievement of an approved short-period qualification. This includes the Level 4 Diploma for Managers, Level 3 NVQ for Supervisors and Level 2 NVQ for Operatives. w Short Course Grant This CITB grant (amount varies per training course) is paid on the achievement of short duration courses. This includes asbestos

training courses for asbestos licensed operatives, supervisors and managers, as well as refresher training courses.

Skills and Training Fund This fund provides an extra incentive for employers, available in addition to the grants above, which can be used towards NVQs and training for asbestos removal operatives, supervisors and managers. The amount of funding available is related

to the number of direct PAYE employees. For example, if an employer has between 50-74 directly employed staff, they could receive up to £7,500 a year to fund training/ qualifications. Further information on the Grants, and Skills and Training Fund, including the application processes, is available on the ARCA website within the ‘Support’ section.

Personal Air Monitoring Workshop - Now available!

A

RCA is now delivering a half-day workshop on personal air monitoring, to enable asbestos removal contractors to gain further knowledge on personal sampling requirements. This theory-based workshop will cover; air sampling methods, strategic planning, as well as recording and collating of ‘monitoring data’. “Contractors are required to establish effective personal sampling evidence when carrying out asbestos removal works on-site. So, we have now made available a personal air monitoring workshop,” commented Satish Patel, Training Manager for ARCA. “This workshop will be available on request, at either an ARCA centre or in-house, and will enable members to gain a better understanding of personal air monitoring, and how to obtain thorough results.” For more information, or if you are interested in booking on this workshop, please contact us on 01283 505777.

Our journey through the CITB Funding, NVQs, and CSCS Cards Recently, Satish Patel, ARCA’s Training Manager, spoke to Jamie Gatley, Contracts Manager at Midlands Asbestos Solutions Ltd, to discuss CITB funding, NVQs and CSCS cards.

S: What was the feedback from the operatives? J: Our operatives actually enjoyed the assessment process. It became clear that they thought it was going to be far more difficult than it actually was. They weren’t asked things they didn’t already know as part of their job. For one operative when it came to a one on one discussion with the ARCA assessor, he was very nervous. Therefore, the assessor carried out more assessment on-site, making the operative more comfortable. It’s good that there are these alternative assessment options for the operatives and supervisors. S: Will you be applying again, if you get the chance? J: Most definitely, the funding is there and it supports businesses, like ours, to get operatives, supervisors and contract managers (like myself) trained and qualified.

S: When did you realise that funding was available? J: We have only been CITB Levy Payers for a number of months. To be honest, I wasn’t sure what we’d get out of it and how the process worked. At a recent ARCA Members regional meeting we found out that we could apply for additional funding (on top of a grant) to support training and NVQs. Shortly afterwards we also received a letter from ARCA highlighting the process, so I called you [Satish]. You talked me through the application process and the information we would need to complete the application. S: Why do you need NVQs? J: NVQs are a requirement for gaining a CSCS card and although we don’t always need CSCS cards to gain access to a site, when clients ask for them, we need to provide it. We had a couple of cards nearing expiry so this was a good point to apply for funding and start the NVQ process. S: How did you get the funding? J: Not long after talking to ARCA I applied for the CITB funding. You gave me a good idea of how to approach

the application, along with quotes for the NVQs, which we had to provide with the application form. It can be a little confusing at first, one thing that’s important is to split the grants away from the funding. S: What was the application process like? J: Completing the applications form, probably took myself and Darren a couple of hours, and we made the March submission date. The turnaround from CITB was pretty quick, and I’m pleased to say we managed to get all the funding we needed, which was paid directly to us. The next step was to arrange NVQs with ARCA. S: How did the NVQ process work with ARCA? J: Firstly, we contacted ARCA and completed the paperwork. We had a suitable job coming up, so ARCA arranged to assess three operatives and a supervisor. After this we had a further follow up session in the office with the team and got a final assessment date for the operatives back on-site. Overall the process is flexible and if you work with ARCA in advance the process is efficient.

S: If you could give other members any advice, what would it be? J: If you’re a CITB levy payer and you’ve not applied for the funding, you’ve missed out on extra money (money you have already paid out) that can help you get your team qualified. It really is a nobrainer. You can also get funding for all manner of other health and safety related courses. Some of them become completely free with the funding and grants. We wouldn’t have known where to start without the help from the ARCA team. Satish and Isabelle have been invaluable throughout the process. If you’re not sure ask, it’s what I did. Thank you, ARCA.

…supporting the asbestos industry The Royal Society for Public Health (RSPH) is an independent health education charity and the world’s longest-established public health body. Our vision is that everyone should have the opportunity to optimise their health and wellbeing.

W

e take seriously any factor in our society and environment that could have an impact on people’s health and wellbeing. Included in this is the asbestos that remains in up to 1.5 million of our nation’s workplaces and in an estimated 75% of public sector housing, 80% of schools and 90% of hospitals. Around 2,500 people die a year from mesothelioma, a cancer developed after exposure to asbestos, and another 2,500 die from other asbestos-related lung cancers. This means that, on average, every two hours a person dies in this country due to asbestos exposure. Fortunately, exposure to asbestos is now rare and most asbestos-related deaths today are the result of incidents that occurred 30-40 years ago. This is due to efforts from both government and industry to control exposure to asbestos. Part of this work has been to ensure that anyone who deals with asbestos is well-trained and works at a high-standard. As a national awarding body for a range of Ofqual-regulated asbestos management qualifications, RSPH is an important part of this process.

Some of the qualifications we award include: w RSPH Level 3 Award in Asbestos Air Monitoring and Clearance Procedures w RSPH Level 3 Award in Asbestos Surveying w RSPH Level 3 Award in Asbestos Management for Dutyholders w RSPH Level 3 Award in Asbestos Bulk Analysis w RSPH Level 4 Certificate in Asbestos Laboratory and Project Management w RSPH Level 4 Diploma in Licensed Asbestos Removal for Contract Managers RSPH qualifications help to ensure that asbestos surveyors and analysts are competent in their role in managing the risks from asbestos for all workers, the public and themselves. The duty holder qualification also supports property owners and managers to understand their legal duties and responsibilities on managing asbestos in buildings. An important element to these qualifications is their Ofqual-regulated status. Ofqual is the statutory regulator for qualifications in England. The national body sets the standards for qualifications, including rules for their design, delivery and assessments. The fact that RSPH qualifications are Ofqual-regulated means that they are recognised by the regulator as meeting its high standards. This acts as a common mark of quality that employers, employees and contractors alike can recognise.

RSPH works hard to ensure our qualifications remain relevant for the changing needs of the industry and regulators. We work with ATaC (Asbestos Testing and Consultancy Association) to achieve this. ATaC is the trade association representing the testing and consulting services section of the asbestos industry, delivering the RSPH qualifications specifically developed for professionals working in UKAS accredited organisations involved in asbestos management. A great example of the value of ATaC was in 2017, following the publication of HSE’s ‘Asbestos Analysts Inspection Programme 2014/15’, which highlighted that analysts’ decontamination procedures were poor. In response, ATaC, who already used a live decontamination unit in training, was able to upgrade the delivery of the RSPH analysts’ qualification by adding in ‘full decontamination’ to the course. Now, candidates experience the actual decontamination procedures, including showering. This enhancement, increasing analysts’ competency and safety, was enabled by the foresight, knowledge and facilities that the ATaC team provide. With the help of both RSPH and ATaC, you and your employees can work safely and to the highest standard.
