ARCA continues to develop membership benefits – CSCS Card and Audit Schemes
I
am pleased to report that ARCA is now an official partner for the CSCS card scheme, so is now issuing CSCS cards for asbestos removal operatives under the Asbestos Removal Management Institute (ARMI) scheme. ARCA began issuing cards on the 30th August 2017, and a steady flow of applications is now being received.

A meeting was held on the 16th August with the Construction Industry Training Board (CITB) and the Construction Skills Certification Scheme (CSCS) to discuss the card requirements for Asbestos Supervisors, Asbestos Managers, Analysts and Surveyors. The requirements for Asbestos Supervisors were agreed and ARCA is now developing an NVQ qualification to meet these requirements. The Analyst and Surveyor cards were agreed in principle and these should be available from ATaC shortly. The requirements for Asbestos Managers’ cards were referred to Build UK, as no agreement could be reached at the meeting. We will communicate the requirements to members as soon as there is confirmation One of the Associations’ aims this year was to move to only using our own directly-employed auditors to carry out ARCA site audits. As reported in the last issue of ARCA News a full-time auditor for the south of the country was appointed by ARCA in June this year. As a result, all of the ARCA audits conducted in July and August this year were carried out by ARCA directly employed staff. It is the Association’s opinion that by exclusively using directly employed staff, we can better manage the process and the people involved, leading to better performance and more consistent audit decisions. To date approximately 200 ARCA site audits have been carried out using the electronic auditing app. Several bugs have been identified in the app which the software company is now working to correct. We want to be sure that the app is working correctly and has been fully tested before releasing it to members. The goal is to have the app (reference page 6) ready to launch to members in November. ARCA will
be showcasing the app and explaining how members can sign up to use it at the November round of regional meetings. I was delighted to accept the invitation from The European Asbestos Forum (EAF) to give the Keynote Speech at the third international Conference of the annual European Asbestos Forum Foundation. This will take place on 26th September 2017 in London. The European Asbestos Forum aims to improve international professional networks and the exchange of the best knowledge regarding all matters related to asbestos across sectors and borders. The conference will feature a multidisciplinary program with over twenty speakers and specialists of global repute from many different countries and several continents. Also on the 27th and 28th September, ARCA and ATaC will be exhibiting at the second Contamination Expo Series at the ExCel London, and speaking on safe asbestos management and removal (reference pages 5 and 8). I look forward to seeing as many members as possible at the ARCA Annual General Meeting on the 6th October, which this year is being held at Lords Cricket ground. Archie Mitchell, Head of the HSE’s Asbestos Licensing Unit will once again be delivering the keynote speech at the event. The meeting will be followed by a luncheon in the afternoon giving a chance for AGM attendees to socialise and catch up with old friends. Dennis Taylor, former snooker world champion, will be providing the after-dinner speech to entertain those present and bring the event to a close.

Operatives gain NVQ and CSCS cards via ARCA A

via the On-Site Assessment and Training (OSAT) option of assessment. “The OSAT assessment suited both Adam and Dale, they soon felt comfortable in the assessment environment and provided good, solid evidence across a number of procedures and processes,” commented Satish Patel, Training Manager for ARCA. “I must add that it was a pleasure to assess both these candidates.” On receiving NVQ Level 2 Diploma in Removal of Hazardous Waste (Construction) – Licensed Asbestos Removal certificates, LAR applied to ARCA for blue skilled worker CSCS cards (under the ARMI Skills Card Scheme) for the operatives. “It’s great that ARCA is now issuing CSCS cards, as it makes the whole process of gaining an NVQ and applying for a CSCS card virtually seamless,” stated Steve Hannah. Members benefit from ARCA additional audits Bookings increase by nearly 90%
A
RCA has seen a significant increase in bookings for additional site audits as members see benefits to business management. For the first seven months of this year the Association has seen an increase of nearly 90% in additional audit bookings compared to the same period last year. ARCA site audits are widely acknowledged within the licensed asbestos industry as covering all legal requirements, as well as promoting good practices, and members need to pass two ‘unannounced’ site audits each year to maintain membership. The audit criteria and assessment methods are well established and reflect a detailed consultation process with industry leaders, and form a solid base from which further evaluation is possible. Choosing ARCA to carry out additional audits provides the external audit portion of a member’s full audit programme. ARCA introduced unannounced audits to the industry ... 8 months on In January 2017 ARCA initiated ‘unannounced’ site audits to make the Association’s member site audit scheme an even stronger system of reassurance.
A
RCA has been operating a membership audit scheme for sixteen years, which requires two satisfactory site audits each year for a contractor to join and to maintain membership. This initiative means that, for both annual site audits, a member has no prior warning of when or where an auditor would be assessing their work. After 8 months ...
Members Members have embraced unannounced audits as being a more robust method of monitoring their performance, therefore a stronger management tool for them, and a very positive move for the industry. Before all ARCA site audits became unannounced, there were some members who treated them in a similar way, as managers would not inform site staff of a pending audit – so for these not a lot has changed.
End-Clients End-client response has been extremely positive, welcoming ARCA auditors onto site. In fact, a number of major end-clients have given ARCA auditors an open invitation to any of their sites when required, and have assisted with site access.
The Association initiated unannounced audits to support consistent high standards and to make the ARCA site audits an even stronger system of reassurance for all parties.
ARCA Site Audit App for Members A
RCA is currently finalising the adaption of its Site Audit App for use by ARCA members for their own internal audits. Common practice is for audit programmes to be an effective mix of both internal and external audits, but often these two elements can be far apart from each other in terms of what is audited, limiting the scope of analysing the audit results collectively. By using the App members will be able to use the same question set as the ARCA audit, enabling direct comparisons of external and internal audit results, and compilation of all of the audits for statistical analysis, so creating a stronger management tool. The App is a web and remote device based application that enables auditors to audit using one of the following handheld platforms: Apple

iOS (iPhones/iPads), most Android (Phones/ Tablets), Kindle Fire and Windows tablets. The App is user friendly, incorporates guidance with each audit question and can be used on sites even with no internet connection. Whenever the ARCA Site Audit App is updated to reflect industry and legislative changes, the Member App will be updated automatically. Management is enhanced as results can be displayed graphically to assist analysis and action reports are easily generated. Also, it is recognised that an automated
process of collecting audit data is a more efficient way of using auditors’ time, allowing them to spend more time on conducting audits and less time on administrative tasks. ARCA will be presenting the Member App at the forthcoming ARCA member regional meetings (see schedule on page 9), giving an overview of the App’s capabilities, report generation, conditions of use and more! ARCA now issuing CSCS cards for Asbestos Removal Operatives Red and Blue cards now available through the Association

removal operative (blue skilled worker) cards. To apply for an ARCA ARMI Skills Card applicants will need to prove they have the training, qualifications and experience required for that particular card. “I’m delighted, that following a successful compliance audit, we now have all systems in place to accept applications and issue all types of asbestos removal operative CSCS cards, under the ARMI Skills Card Scheme,” commented Steve Sadley, Chief Executive of ARCA. “We will continue to work with ARMI, so ARCA can offer cards for other occupations, such as asbestos removal supervisors, when requirements are agreed with the Standard Setting Body (CITB).”
RCA is pleased to announce that asbestos removal operatives can now obtain both temporary red cards and blue skilled worker cards from the Association, as it is operating the ARMI Skills Card Scheme under licence from CSCS. The Construction Leadership Council (CLC) set the specification for industry card schemes carrying the CSCS logo, under which the ARMI Skills Card Scheme was approved as a nationally recognised scheme, enabling the use of the CSCS logo. Following this ARCA successfully completed an audit, confirming compliance with the CLC requirements. ARCA is now accepting applications, from employers and individual operatives, for temporary (red) cards and 5-year asbestos

All cards issued by ARCA use smart technology and contain an electronic chip. This can be used to check the identity of the card holder and, for example, when ARCA updates a card holders’ record with ‘successfully completed operative annual refresher’ this will automatically update the chip in the card. Analysts go through Full Decontamination with ATaC
T
his summer a number of analysts have undertaken full decontamination while on the RSPH qualification with ATaC. In May, the Asbestos Testing and Consultancy Association (ATaC) announced that they would deliver full decontamination on the RSPH Level 3 Award in Asbestos Air Monitoring and Clearance Procedures qualification. This was after the publication of the finding of the ‘Asbestos Analysts

At the seminar Stephen Platkiw, the ATaC Manager, will highlight the legal responsibilities of all duty holders on managing the risks from asbestos in buildings, and why good coordination and cooperation between all parties is a must for an asbestos project to be managed effectively and safely.
Inspection Programme 2014/15’ commissioned by the HSE (Health and Safety Executive), which highlighted that some analysts’ decontamination procedures were poor. “It was very encouraging to see how quickly ATaC supported the industry following the report findings” stated Jonathan Francis, Managing Director of Riverside Environmental. “Through ATaC, analytical companies can now be confident that their staff receive thorough

Director and company fined after unlicensed asbestos removal A
Wiltshire based asbestos removal company and one of its Directors have been sentenced after removing licensable asbestos materials in an unsafe manner. Winchester Crown Court heard that on 8 March 2013 the Health and Safety Executive (HSE) received a concern from an employee of a construction company hired to demolish the Forresters Respite Centre in Hythe. Sarum Asbestos Limited (SAL) had been contracted to conduct an asbestos survey and then arrange for the removal of any identified asbestos material before demolition work could begin on site. An investigation by the HSE found that Sarum Asbestos Ltd had undertaken similar work in other locations and failed to ensure that this work with asbestos was undertaken in a safe manner by competent personnel. They also failed to undertake further testing on these sites to ensure that the asbestos had been removed safely and as a result placed workers at risk of exposure to asbestos fibres, as well as putting members of the public at risk.
The investigation also found the company’s Director, Jeremy Uphill, ignored the legal requirements for the licensed removal of asbestos containing material. Sarum Asbestos Limited of Pound Lane, Charlton All Saints, Wiltshire pleaded guilty to the six charges: • Sections 2 and 3 of the Health and Safety at Work Act 1974 for the work conducted at Forresters Respite Centre. These charges concern risks to their own operatives and members of the public. • The company also pleaded guilty to the same charges for work conducted at Corsham Police Station. • Sarum Asbestos Ltd also pleaded guilty of breaching Regulation 11 of the Control of Asbestos Regulations 2012 for work conducted at Moonfleet Manor, Weymouth, regarding a failure to control personal exposures to asbestos. • It also admitted the same charge for work conducted at Camberwell Reform Church in London.
At Salisbury Crown Court the company has been fined a total of £100,000 and ordered to pay costs of £31,000. Jeremy Uphill of Boyds Road, Pimperne, Dorset also pleaded guilty to the same six charges, and was given a total of six months imprisonment suspended for two years. Speaking after the hearing HSE inspector Adam Wycherley said: “Both the company and Director have failed to protect their workers and members of the public on a number of occasions and as a result placed them at risk of exposure to asbestos fibres. “Work with the material the company identified should have been subcontracted to a qualified Licensed asbestos removal company. “Around 3000 people a year die from asbestos related disease and it is a well-known risk within the construction industry, there is no excuse for putting people at risk when the hazards can be controlled with careful management during work with asbestos containing materials.”

Contractor sentenced after householder exposed to asbestos A Wigan building contractor has appeared in court after exposing a homeowner and her family to asbestos while carrying out a garage conversion. Manchester Magistrates’ Court heard that Anthony McGrath, trading as Winstanley Construction, carried out asbestos removal work during the conversion when he was not licensed to do so and failed to carry out this work in a safe manner resulting in asbestos contamination in the ground floor of the house. The Health and Safety Executive (HSE) investigation into the incident at Bassett Grove, Wigan found Mr McGrath had removed Asbestos Insulating Board ceiling panels from the garage, broken them up, and placed them in the garden for several days. When the home owner queried what the boards were, she was told it was asbestos, but they were safe and would be removed soon. After ringing the local council the home owner then contacted a licensed asbestos removal contractor who confirmed that the boards were Asbestos Insulating Board and should be

removed under controlled conditions. Asbestos contamination was found in several areas of the house and the householder was unable to re-enter the house for more than a week while a clean-up operation costing in excess of £12,000 was carried out. Anthony McGrath of Winstanley Road, Billinge, Wigan pleaded guilty to breaches of Regulation 10 of the Control of Asbestos Regulations 2012 and Regulation 8 (1) of the Control of Asbestos Regulations 2012.He was fined £475 for each breach and ordered to pay a compensation order of £7,500. Speaking after the hearing HSE Inspector David Norton said: “This incident could so easily have been avoided by simply carrying out correct control measures and safe working practices. Companies and individuals should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards”.

Post Implementation Review of the
Control of Asbestos Regulations 2012 T
he Health and Safety Executive (HSE) recently published the Post Implementation Review (PIR) of the Control of Asbestos Regulations 2012 (CAR 2012) implemented in Great Britain (GB). The CAR 2012 revoked and re-enacted the Control of Asbestos Regulations 2006 (CAR 2006) with some minor changes, fully transposing the main elements of Directive 2009/148/EC on the protection of workers from the risks related to exposure to asbestos at work. On 23 June, the EU referendum took place and the people of the United Kingdom voted to leave the European Union. Until exit negotiations are concluded, the UK remains a full member of the European Union and all the rights and obligations of EU membership remain in force. During this period the Government will continue to negotiate, implement and apply EU legislation. The outcome of these negotiations will determine what arrangements apply in relation to EU legislation in future once the UK has left the EU.

The report sets out the Government’s views on the effectiveness of the regulatory regime now the Directive has been transposed and operational for a period of time. The report covers: a) the extent to which the regulation is achieving its objectives b) whether those objectives remain valid c) whether the Regulations are still required and remain the best option for achieving those objectives d) if they can be improved to reduce burdens on business and their overall costs and whether there have been any unintended consequences The scope of the review covers the extent to which the Regulations have achieved their objectives, assesses the costs and benefits, and identifies any unintended consequences. The review has also considered any identified areas of under- or over-implementation of the Directive and the cost implications, justification and benefits.
The evidence sought was aimed at determining whether CAR 2012 had met its objectives and understanding how implementation could be improved. The research sought both qualitative and quantitative evidence from organisations required to comply with the legislation. Post Implementation Review guidance requires three overarching research questions to be addressed: w To what extent are the Regulations working? w Is government intervention still required? w Are the Regulations and the way they are implemented the most appropriate approach? The principal objectives of CAR 2012 were to (1) fully transpose the requirements of Directive 2009/148/EC; and (2) to continue to protect those working with or potentially exposed to asbestos from the associated risks.
CAR 2012 review Does CAR 2012 fully transpose the requirements of the Directive as intended? This is confirmed in the Explanatory Memorandum and Transposition Note to CAR 2012. Does CAR 2012 protect those working with or potentially exposed to asbestos from the associated risks? There was a clear consensus amongst all the dutyholders of the importance of the specific duties in the Regulations in keeping workers and others safe from the risks of exposure to asbestos, beyond what might be achieved through relying on more general underlying requirements for the reduction of risks “to as low as reasonably practicable” in the Health and Safety at Work Act. The specific benefits expressed by all groups included minimising the risks from exposure to asbestos to keep workers and others safe, setting clear requirements for the controls that need to be implemented, raising awareness of the risks, providing an assurance to those working with asbestos that risks are being controlled effectively and, providing a level playing field for licensed contractors bidding for work. Dutyholders also referred extensively to the supporting guidance to the Regulations and the Approved Code of Practice Managing and working with Asbestos (L143), which set out in more detail what dutyholders are expected to do in order to comply with the legal requirements. The prevalent view amongst the different groups was that the regulations were practical to implement and were effective in achieving their objective to protect workers and others from the risks of exposure to asbestos. The evidence also confirmed that CAR 2012, and associated guidance, specifically the ACOP, and the way they are implemented, are reasonable and fair, and that they contain sufficient information to enable dutyholders to comply with the requirements. Overall the Regulations were considered practical to implement, although some areas were identified where greater clarification is needed, not specifically with regards to the Regulations per se but the provision of clearer guidance. The specific areas included: w Greater clarity around the distinction between licensable, non-licensable and notifiable work
w Regulation 4 – Duty to manage greater clarity of dutyholders’ roles and responsibilities, with specific guidance on conducting a management plan w Regulation 7 – Plans of Work – further guidance and clarity regarding how much information should be included in the written plan of work prior to commencing work w Regulation 22 – Health records and medical surveillance – dutyholders were unclear as to why the frequency of medical examinations differed for licensed and notifiable work. It was expressed that exposure to asbestos carries the same risks irrespective of the type of work activity and that the frequency of medicals should be aligned. Overall, the collective evidence suggests that CAR 2012 are operating as intended, but that the issues outlined above could, in the main, be addressed administratively through updated guidance. The evidence from the research and analysis gathered for this PIR suggests that overall CAR 2012 has met its objectives and has helped to achieve a high level of compliance. CAR 2012 strengthens the protection given to those who might be exposed to asbestos fibres, setting clear health and safety requirements to ensure the appropriate control measures are in place to prevent exposure to asbestos from work activity or reduce exposure as far as reasonably practicable. The gravity of the potential consequences of exposure to workers requires a robust regulatory framework to ensure they are protected from exposure to asbestos fibres and dutyholder views and experiences confirm that CAR 2012 meet their intended objective to provide greater protection for those working with asbestos. CAR 2012 achieves this by requiring that exposure to asbestos from work activity is prevented or exposure reduced as far as is reasonably practicable. The process evaluation aimed to identify, as part of its research, if there were any unintended consequences of the Regulations. Whilst the research did not identify any examples through consultation with dutyholders, it is not possible to conclude that there are no unintended consequences. However, the research suggests that it is unlikely that there have been any significant or
major unintended consequences. Based on the collective stakeholder evidence, cost/benefit analysis, epidemiological and enforcement data, the Government does not consider that it is necessary to amend the provisions of CAR 2012. There are several areas where the recommendations from the PIR can be taken forward mainly by changes to administrative guidance and processes, with the exception of one recommendation which would require further exploration of the case for a minor amendment to the Regulations. These are detailed in the PIR report but, in summary, include: w greater clarity around the distinction between licensable, non-licensable and notifiable work with asbestos w information on dutyholders’ roles and responsibilities around duty to manage asbestos in non-domestic premises w guidance on practical examples of written plans of work; and w exploration to align the frequencies for medical examinations for licensable and notifiable work. The current requirement in CAR 2012 for licensable work goes beyond the Directive. Alignment would involve changing the frequency of medical examinations for those undertaking licensed asbestos work, from every two years, to every three years and would impact on licensed contractors only. HSE will explore the health and safety impacts of any changes to the regulations taking account of medical, epidemiological, and scientific evidence, in consultation with stakeholders.

Understanding Asbestos Surveys
What clients need to know
If you are a property owner or property manager you should be aware of your legal duties regarding asbestos management and the need for assessing the risks from any asbestos containing materials in a building. Risk assessment usually takes the form of an asbestos survey, followed by the creation of a register and a management plan, as required by Regulation 4 of The Control of Asbestos Regulations 2012 (CAR 2012).

What type of Asbestos Survey is required? Before deciding on the type of survey, the client needs to be aware that the survey must provide sufficient information for: an asbestos register and plan to be prepared, a suitable risk assessment to be carried out and a written plan to manage the risks to be produced. Also, it is highly recommended that the client (the customer) agrees with the surveyor, before the survey is commissioned, what format the survey report should take, agree on any caveats and areas not to be surveyed. There are three types of asbestos surveys, each covering different aspects of asbestos management: w Management Survey w Refurbishment Survey w Demolition Survey
Management Survey The purpose of a management survey, known as the ‘standard’ survey, is to locate, as far as reasonably practicable, the presence and extent of any suspected asbestos containing materials (ACMs) in the building which could be damaged or disturbed during normal occupancy, including foreseeable maintenance and installation, and to assess their condition.
Refurbishment Survey If it is possible that the fabric of the building will be disturbed during refurbishment works then the building requires a refurbishment survey. The survey should locate, as far as reasonably practicable, the presence and extent of any suspected ACMs in the areas that are to be refurbished. Therefore, the refurbishment job specification should be provided so that all the areas likely to be disturbed are surveyed prior to the work starting.
asbestos surveys Demolition Survey If a building or part of a building is to be demolished, a demolition survey is required, so that all ACMs can be identified and then removed, prior to the demolition taking place. Demolition surveys are the most intrusive and licensed asbestos removal may have to take place to access all areas for surveying purposes.
Choosing a Surveyor Surveys can be carried out by in-house personnel or a third party. However, the surveyor must be competent to carry out the work required, and it is the duty holders’ responsibility (as stated in the ‘Asbestos: The survey guide’ HSG264) to ensure the surveyor is competent to carry out the type of survey required. To be competent the HSG264 states that the surveyor must: w have sufficient training, qualifications, knowledge, experience and ability to carry out their duties in relation to the survey and to recognise their limitations w have sufficient knowledge of the specific tasks to be undertaken and the risks which the work will entail
w be able to demonstrate independence, impartiality and integrity
A report, for any type of survey should contain the following sections:
w have an adequate quality management system
w executive summary
w carry out the survey in accordance with recommended guidance
w general site and survey information
When choosing a third party, clients should note that the Health and Safety Executive (HSE) do recommend United Kingdom Accreditation Service (UKAS) accreditation for surveying organisations, although this is not a legal requirement. Also, accreditation for individual surveyors is not available.
Survey Report – what should a client receive? A client should receive a comprehensible and usable report, that is, the information in the survey report should be easy for the client to extract and to use to prepare an asbestos register, e.g. by presenting the results in a manner or format that can be directly lifted or employed to form the asbestos register. It’s important to note that reports should contain the results of sample analysis.
w introduction covering the scope of work w survey results (including material assessment results) w conclusions and actions w bulk analysis results A report should be completed in a written format and supplied either as a hard copy or as an electronic document, or both. Also, once a survey is completed the surveyor should return and meet the client to discuss the findings and to explain how the survey report should be used. For the client. a survey report forms part of their overall management plan and should be able to fulfil the requirements of an asbestos register.

In a previous issue of ARCA News (Issue 96, p 24-25) we published an article highlighting some key steps to make your audit approach effective, whether you were designing it from scratch or revamping your existing programme.
What should I do with my audit results? W
hen properly planned and designed, your audits can become an essential part of the ‘Check’ stage of the ‘Plan, Do, Check, Act’ approach outlined in the HSE publication ‘Managing for Health and Safety’ (HSG65). In this issue of ARCA News, we look at some key factors to consider in collating and interpreting your audit results, so that you can maximise the impact of the audit findings. This forms an essential part of the ‘Act’ stage of the HSG65 approach.
Every finding is important Firstly, if the audit has been well designed, then every audit finding is important. Where there is full compliance with the standard required, then this acts as reassurance that management systems and procedures are evident at site level. Continued maintenance of required standards is a vital element of any management system, and essential in an industry such as asbestos abatement. Secondly, any non-conformances identified should be addressed without delay, so that the exemplary standards expected of a licensed contractor can be established/reestablished, then maintained.
In addressing non-conformances, there are two key factors that need to be considered. The first consideration is the extent of the non-conformance observed. One example could be that the auditor has observed that some inspection records are not kept up to date. While this is better than no inspection records being kept at all, it is nonetheless a non-conformance and needs to be addressed. Worse still is where inspection records are up to date and indicate all is in order, yet evidence from site observations contradicts this, for example the twice daily DCU inspection record shows all is compliant, yet the unit may be dirty, or the nailbrush is missing from the shower compartment, or the gas bottle for the shower is empty. Whether required inspections are not done and therefore not recorded, or they are done though not recorded or the findings addressed, or even not done but reported as done, the extent of such audit findings needs to be established and the findings addressed. What is observed should match what is planned and recorded. The second consideration is one of priorities. Any site practice where a potential imminent danger to health or safety has

audit results been identified should be addressed immediately, though still recorded as a non-conformance so that management are alerted and follow up actions can be implemented. Highest priorities and swiftest remedial actions should be applied to situations where risks from the spread of asbestos, or exposure to it, are not being kept as low as is reasonably practicable [Control of Asbestos Regulations 2012 (CAR 2012), regs.16 and 11], even within the enclosure. In contrast, some issues identified relating to insufficiencies in supporting documentation on site, though important and needing to be addressed, may not have the same urgency in terms of remedial actions.
Reviewing findings In reviewing audit findings, don’t be tempted to just add up the total number of non-conformances (or conformances) and compare the figure to other audits. An audit identifying a major or critical nonconformance will be of far more immediate concern than an audit identifying several minor non-conformances. Nevertheless, all non-conformances should still be addressed. Whatever scoring system you decide to

use, it is best that it is ‘weighted’ to help distinguish the most important criteria from the important criteria. The ARCA site audit is weighted in this way. In addition, your management and site teams should clearly understand what is minor, major and critical. Be careful in prioritising actions. Some audit findings in isolation may be considered minor, but if there develops a pattern of recurrence in subsequent audits, the issue becomes major; not that the nature of the non-conformance has changed, but that the continuation of the non-conformance becomes a management failing. Whether the issue was addressed, but not effectively, or not addressed at all, the management failure becomes more significant and could be indicative of other management weaknesses that could ultimately emerge during the licence assessment process. While it is important to ensure that audit findings are accurate, don’t expend energy on trying to defend or justify something that wasn’t up to standard. Sometimes we need to accept that an unacceptable practice has been identified, as one of the reasons for auditing is that this can happen. Better to use our energy to make and establish the changes that lead to improvement. What
is done about the audit findings is often considered as important as the findings themselves. Doing nothing with audit findings will profit no-one, and audit findings that are unaddressed will rarely go away, but will most likely resurface at a later time and potentially with more devastating effects. When evaluating and prioritising audit findings, develop the tenacity to look beyond the immediate situation, which may at first seem quite innocuous, and explore potential implications. To illustrate this point, an audit question may establish that baglock compartments meet the minimum dimensions of 1m x 1m x 2m (height), which initially may be considered as compliant. However, a further question may be asked to determine whether or not the baglock compartment dimensions are suitable for the waste size. Large AIB panels, for example, would need a bigger baglock in order for the standard cleaning and double wrapping process to be thoroughly undertaken while the waste is transferred out through the baglock. If the Plan of Work does not address the requirement for a bigger baglock, what are the implications? Firstly, the supervisor is bound by HSE licence condition 3 to follow the Plan of
audit results Work, but in doing so will not have a big enough baglock to ensure the procedure of suitably wrapping the waste is carried out – a procedure which also should be followed. Secondly, the large panels should be removed as whole as possible so that breakage (and hence the spread of asbestos) is reduced to the lowest levels reasonably practicable. So, does the supervisor decide to break the panels (breach of CAR 2012, reg. 16) so that the waste ‘parcels’ are small enough to be processed through each stage of the minimum sized baglock, or not fully implement the cleaning and double bagging procedure that should be followed (leading to breach of CAR 2012, reg. 16)? Either way, what seems like a minor issue can have far reaching implications. If the baglock could have been made bigger, why wasn’t it? Would this identify a training need for the author of the Plan of Work, whose job it is to plan the job and unsure that a suitable and sufficient Plan of Work has been written? If the baglock couldn’t have been made bigger, then this should have been identified and addressed at the planning stage, and a suitable alternative procedure documented in the site-specific Plan of Work. So, an audit requirement that at first may seem compliant,
and if not compliant then quite minor, actually may have implications that are extremely serious. In identifying root causes of audit findings, it is essential to look beyond the immediate cause – ask yourself ‘why?’, then ask again (even if it’s a phrase we wouldn’t normally use) ‘why else?’, and again ‘why else?’ until all avenues have been explored. It is normal for an investigative process to identify numerous contributory factors to an undesired event. Record your deliberations as evidence of a thorough review process, and to learn from the experience.
Managing performance Numerous software packages are available to produce graphs of results and identify trends for each individual audit requirement. Be aware though, that many identified audit findings may have similar roots, such as the planning of the job, suitability and sufficiency of the written Plan of Work, adherence to the Plan of Work and associated procedures, record keeping, and supporting documentation. It may be better to look for patterns and trends in common root causes rather than individual manifestations of those root causes.
Reviewing health and safety performance allows you to establish whether the essential health and safety principles – effective leadership and management, competence, worker consultation and involvement – have been embedded in your organisation. It tells you whether your system is effective in managing risk and protecting people. Learn from incidents, errors and relevant experience, including those from other organisations. Revisit plans, policy documents and risk assessments to see if they need updating. Take action on lessons learned, specifically including audit and inspection reports (see HSG65). Auditing will then not be seen as a hindrance but become a vital reassurance and measurement tool in your overall management approach.

Personal Air Monitoring ARCA is aware of concerns raised about the way personal air monitoring is routinely being carried out in the asbestos industry. Licence holders are advised to review • why they are collecting personal monitoring data • how data is being collected and • what is being done with the data Personal monitoring can be carried out for a variety of purposes. Many licensed contractors may be gathering data in a way that cannot be used to compare exposures with other jobs and cannot demonstrate meaningful personal exposure data. Licence holders also may be using sampling strategies that do not reflect a representative sample of their work and therefore cannot demonstrate effective performance. Where this is the case, licence holders may be wasting significant time and money on sampling that adds little benefit or reassurance. This could also be seen as a wider failure of health and safety management when licence assessments are carried out.

Legal requirements The Control of Asbestos Regulations 2012 (CAR 2012) contain numerous references to the requirement for personal and background monitoring. a) Regulation 19 requires employers to arrange regular monitoring of airborne fibres and keep records of the results. Assessments of any proposed work must consider the results of this monitoring (regulation 6). The significant findings of asbestos assessments should be reflected in the plan of work (required by regulation 7). b) An organisation’s arrangements for providing information, instruction and training must include detail of any air monitoring results (regulation 10). c) Employers must ensure that personal exposure to asbestos is prevented, so far as is reasonably practicable (regulation 11). Licensed work, by definition, is likely to produce airborne concentrations that exceed the control limit: where exposure cannot be prevented, it must be kept as low as reasonably practicable. Respiratory Protective Equipment (RPE) provided must ensure that concentration of asbestos fibres within the respirator is kept below the control limit. d) The spread of asbestos must be prevented or reduced (regulation 16). e) Exposure records form part of the health records that must be retained for any employees engaged in licensed asbestos work (regulation 22). Regulation 5 of the Management of Health and Safety at Work Regulations require employers to have effective arrangements in place for managing health and safety. Personal monitoring records should be an excellent indicator of performance and an aid to comparing and assessing removal situations. To achieve this, sampling must be planned and recorded in a meaningful way.
Purpose of personal air monitoring Personal air monitoring can provide invaluable performance information: it should provide an accurate record of actual concentrations of airborne fibre generated by particular types of work in particular circumstances, and give licence holders confidence (and clients, regulators etc) that control methods are working, in practice. In summary, CAR 2012, the Approved Code of Practice and existing guidance give the following reasons for carrying out personal air monitoring: a) To check the effectiveness of the controlled method of removal (i.e. by comparison to previous concentrations of airborne fibre in similar situations and to the control limit) b) To provide data for personal exposure records c) To guide assessment (and planning) for future, similar jobs d) To confirm that appropriate RPE has been chosen.
Sampling: planning and engaging with the analyst Decisions about the type(s) of monitoring to be done (and detail about how this will be carried out) should be considered at the planning stage. This will be reflected in the plan of work produced prior to notification and supported by standard procedures etc. Effective monitoring will require good liaison and engagement between the licence holder and the analyst. The service agreement between the two organisations should make expectations clear (and take into account the issues described in this document). For example, if an analyst is expected to observe work activities during the sampling period, this may limit capacity for carrying out other types of air monitoring at the same time.

Sampling methods Sampling duration and flow rates a) So that sampling results can be compared between jobs, a standardised approach for gathering and recording is required. This should be specified in standard procedures and / or contractual arrangements with an appointed analyst. b) The control limit refers to a ‘time weighted average’ (TWA) of 0.1 fibres/cm3 of air averaged over a continuous period of 4 hours. Monitoring may also be carried out to assess fibre concentrations associated with particular short duration activities (“sporadic and low intensity” (SALI)), with reference to a 10 minute sampling period. c) Where the purpose is comparison with the control limit or gathering personal exposure data, HSE will expect sampling periods to be as close to 4-hour periods as is reasonably practicable; the results should be recorded as a 4-hour TWA. Analysts might use a succession of sampling periods, or a single shorter period that is representative of the work, but where this is the case licence holders should expect a clear explanation of the assumptions being made to report results as a 4-hour TWA. d) When considering exposures in relation to the 4-hour control limit, sampling rates should be 1 litre/minute. When taking shorter samples, for example in relation to “sporadic and low intensity” assessments and exposures, sampling rates should be 4 litres/minute. Activity a) In the past, contractors have typically recorded the broad category of work being undertaken at the time of personal air sampling. For example, the sampling records may state “AIB removal”. This is not precise enough to allow for meaningful comparison between jobs. For example: the previous sampling might have involved a simple ‘clean’ activity of lifting boards from a grid; this can’t be compared against the removal of glued or nailed AIB. Relevant detail of the work activities should be addressed in a “suitable and sufficient” plan of work and might include: i) The scale of the work (1 small panel or 100m2 of panels?) ii) The type of fixings (screwed, nailed, glued, the presence of voids above AIB?) iii) Method of removal (Surfactant applied from above? Panels unscrewed whilst using shadow vacuum? Bagged or wrapped? etc.) iv) The condition of the tiles, surface treatments and ease of access etc. b) In addition, the analyst should also be able to give an opinion on the activity. Having observed the activity during the sampling
period, did the control measures appear to be working effectively? Were there any difficulties observed? c) This level of detail about the actual activities being undertaken during the sampling period will be crucial for gathering meaningful sampling data. It is therefore important that the removal contractor gives clear instructions to the analyst: to provide meaningful data, analysts will be expected to observe what activities are taking place during the sampling period. Records a) For useful comparisons, exposures should be recorded as TWA, unless the focus is on specific short-duration tasks. See the appendix, in the full ARCA Guidance Note available on the ARCA website, for a suggested ‘personal sampling’ template.
Strategies – planning sampling It is common practice for licence holders to commit to sampling a percentage of jobs, depending on the type of material being removed (for example: 100% limpet jobs, 25% of AIB jobs, etc). As indicated above, this is not likely to be sensitive enough to provide a representative sample of the actual range of work being done. Strategies for monitoring should be similar to strategies for targeting site visits/audits, i.e. they should ensure that a representative range of work is sampled. For example, the strategy should cover: a) A full range of work activities, as described above b) A full range of geographical locations: capturing ‘close to home’ and more remote work sites c) All supervisors / teams d) Over time, sampling should capture exposures to all operatives across a full range of activities. For licensed contractors, a strategy should focus on activities expected to be higher hazard / risk. Over time, the strategy will ensure that a full, representative range of asbestos work is covered, but the focus of resources should be on activities where exposure is liable to be higher. For example: a) for ‘routine’ jobs, personal sampling is carried out during the actual removal activities where asbestos is most likely to be disturbed, not during set up; b) resources should initially be directed at licensed activities, rather than for sampling the removal of bonded products such as floor tiles or asbestos cement sheeting.
Recording and collating monitoring data Licence holders may have collected monitoring data for many years. Unless that data can be clearly linked to particular asbestos activities, it may be difficult to use as a meaningful measure of performance or for meaningful comparison with current / future work. In practice, many licence holders will need to define a better strategy for sampling and build a database of results for comparison. A licence holder’s strategy (as described above) should be described in company policies / procedures etc. Routine performance reviews and organisational targets etc could refer to the number (and quality) of samples being taken as well as recorded exposure levels for particular removal situations. The appendix, in the full ARCA Guidance Note available on the ARCA website, provides a suggested template for gathering individual personal monitoring data. Analysts may provide additional, supporting records (stipulated by UKAS etc). Individual monitoring results must then be collated and stored in a way that makes them easy to use in the future. For example, a database / spreadsheet a) should enable easy access to an individual’s personal exposure records b) should enable easy comparison / reference to levels of exposure ‘achieved’ during similar activities. The Approved Code of Practice (paragraph 486) stresses that personal monitoring results should be “collated and submitted to HSE” as part of the licence renewal procedure. In practice, HSE’s ALPIs do not routinely ask for this information in advance. However, licence holders should expect monitoring results to feature in licence assessment meetings: they are likely to be seen as a critical indicator of how licence holders measure performance and assess risk.

Mesothelioma UK Nurses meet ARCA Members
D
uring July, Clinical Nurse Specialists from Mesothelioma UK attended the ARCA member regional meetings in the South West and Wales, Midlands, North West, North East, South East and Scotland. The nurses explained to ARCA Members, their work in supporting patients suffering with mesothelioma, an asbestos-related cancer, and how the charity funds a network of specialist mesothelioma nurses, regionally based in NHS hospitals, and the plan to grow this network over the coming years. This is an area where ARCA Members’ fundraising has and could continue to support the Charity. “I was delighted that Mesothelioma nurses were able to attend our member meetings and explain their excellent work,” commented Steve Sadley, Chief Executive of ARCA. “Last year funds were raised through a number of events, including a dedicated Charity Week when ARCA members took part in many different activities. This year we hope to raise further funds during our Charity Week in September.”

Hands on experience for Admin Staff
C
ourses are never created on a whim, new courses can come from word of mouth or by listening to a problem which is difficult for one individual or one company to solve. This was the case with this new training course for administration staff. After a number of conversations with members, it became apparent that there are a lot of administrators in the industry who want to gain a better understanding of what their colleagues would undertake on site and expand their knowledge. Administrators in asbestos removal companies are a key part of the team that produces plans of work, talks to suppliers and plan on-site resources. Training on business systems such as the purchasing system is one element companies can easily address, but training on what actually happens on a removal site, can be very limited due to on-site work being hazardous and restricted. ARCA has stepped into help, as the Association is ideally positioned to solve this problem. So ARCA has produced a one-day training course that will enable administrators to
experience what working on-site is really like and some of the issues their colleagues may face, all within a safe and controlled environment. The course, at ÂŁ125.00 (+ VAT), will cover a range of elements including; industry terminology, key legislative documents, asbestos licensing, plans of work and onsite documentation. It will also include some practical hands on tasks, such as; use of RPE, elements of enclosure construction and use of air/bag locks, as well as the decontamination process in enclosures and DCUs. e have all read headlines offering easy fixes to management issues
– communicate more efficiently, motivate people to be empowered, manage the risks within your business and develop individuals to perform at a higher level. Over the next four editions of ARCA News we will be bringing to you an insight into the four modules of the ARCA ILM Leadership & Management qualification. Each edition will contain an article relating to a specific module and how this knowledge can help improve your leadership and management skills. Hopefully, these articles will encourage you to look beyond the words and join a growing group of individuals who have applied the learning to their businesses, all through the ILM Leadership and Management qualification. It has enabled them to improve their skill set, but more importantly question – What does that mean for me and how can I make it work? In this edition of ARCA News, we are covering Management Communication and some of the factors that can help you become a better communicator. Good communication is the mainstay of any relationship. Teams are no exception. In his book “Business @ the Speed of Thought,” Bill Gates compared communication between the individuals and teams that compose a business with the nervous system of the human body. It’s a good analogy. The nervous system allows us to see, hear, feel, react to stimuli and take action. Without it, we would be a bunch of disconnected organs that just wouldn’t work. Communication allows teams within an organisation to become more than the sum of its parts and accomplish more than they could ever do alone. If you own a company or have a managerial position within your organisation, you need to invest in your teams’ communication. It’s not just a nice touchy-feely trick to make sure everyone gets along. Without communication, organisations fall apart. Here are some practical ways you can improve the communication of your organisation’s teams.
1. Clearly specify who the group members are This is obvious, which is probably why it is so often overlooked. If you want to create a strong team that communicates well, people need to be clear about who is in the team. The researchers behind the book “Senior Leadership Teams” studied over 120 top teams in businesses around the world. They found that although all senior team leaders thought they had set clear team boundaries, when the team members were asked to list who was on the team, less than 10 percent knew.
2. Assign specific roles and tasks for each team member Who is whom and who does what? Most of the problems that occur in teams happen when team roles are not clearly defined. Glenn H. Varney highlights the importance of having a clear understanding of the roles of each team member in his book “Building Productive Teams.” He explains: “During any discussion of roles and responsibilities, team members need to clearly know their specific tasks and the areas for which they will be held accountable. Everyone in the team should also know what everyone else is responsible for. This will build strength and mutual support.”
3. Challenge your team by providing purpose and common goals Humans are natural problem solvers. Nothing inspires us like overcoming an obstacle, meeting a challenge or doing something that has never been done before. When we’re bored and lacking purpose, we become sensitive and argumentative. If we are driven and confident that our work is important, we are more likely to overlook the idiosyncrasies of our teammates and focus on the ultimate goal. David Logan, professor of management at the University of Southern California, illustrated this point in his 2009 talk at TEDxUSC, Tribal Leadership, where he relates the story of Gallup’s world poll. Logan uses a five-stage framework to describe groups (which he calls tribes) based on what motivates them. According to this framework, Gallup is as a stage-four tribe, a group of people who know they are great and define their success by how much better they are than everybody else.

Gallup was the world’s most respected and influential polling company, and its employees knew it. They were bored. How do you motivate and improve communication in an already successful company? Easy. You set out to do something that has never been done before. In their case it was designing a world poll that could accurately reflect the views of 95 percent of the population. It seemed impossible, but it was challenging and exciting. And it got everybody — including several Nobel laureates in economics — working together as a team in the pursuit of statistical greatness.
4. Create an open-door policy for employee communication Organisations with an open-door policy allow team members to talk with managers and executives about anything without having to worry about negative repercussions. This fosters confidence and trust among team members, reduces rumours and gossip and increases communication levels among employees. No more “us versus them.”
5. Standardise communication procedures How’s this for scary? In the U.S., more people die from medical errors caused by miscommunication than from accidents, diabetes, Alzheimer’s disease, AIDS or breast cancer. Medical errors are actually ranked fifth in the list of top 10 causes of death in the United States. Don’t leave it to chance. Set up clear policies and guidelines that spell out how information must be shared. Train team members on how the new procedures work and set regular briefings to measure their efficiency.
6. Be specific in your objectives Ambiguity is the black death of team communication (and productivity, for that matter). Communicate in a simple and concise manner and train your team members to do the same. Don’t assume you understand what your team members mean. Rephrase what you think they said and check that you understood correctly. Ask them to do the same when you give them instructions. Get into the habit of sending along action items on a regular basis or collaborating.
7. Facilitate informal meetings Studies of team communication patterns indicate that team members who socialise and meet outside of formal meetings perform at a higher level than teams who only interact in formal settings. For instance, a study conducted by researchers at Sociometric Solutions on the performance of teams in a large call centre found that the best predictors of a team’s productivity were the energy and engagement that team members displayed in informal settings. The consultants advised the call centre manager to arrange the coffee break schedule so that teams took their coffee breaks together instead of separately on the staggered timetable they were using. This allowed team members to socialise away from their workstations. The researchers reported a 20 percent increase in productivity among the lower-performing teams and an overall increase of 8 percent throughout the call centre.
8. Choose appropriate forms of communication Email, collaboration tools, online meetings with Skype or GoToMeeting, instant messaging — you have a wide selection of mediums to communicate within your team, so choose wisely. What are some tools your team members already use? Do they need to have 24/7 access to their projects? Would a well-managed Google Calendar do just fine? Email is great for sharing large chunks of information, but its poor at conveying emotionally charged issues, which can easily be misconstrued in writing. It’s also important to note that an email inbox is so easily clogged up with short correspondences, CCs and forwards that it can ruin productivity. Phone calls and face-to-face meetings are inefficient methods for sharing information but the best formats for complex and nuanced issues. If you’re managing a large team with a lot of project crossover, it may be wise to adopt a single collaboration tool. On the other hand, if you’ve only got a small team with defined roles and objectives, you can keep it simple with email and Skype.
9. Treat team members as individuals and communicate with them accordingly (that includes you) Everyone learns (and works!) differently. Get to know your team members and adapt to how they prefer to absorb information. Readers love to receive (and write) long and detailed memos, while listeners may struggle with written memos but are great in conversation. And some people learn best by doing.

training news This also applies to managers. If you digest information better in conversation, organise regular meetings with your staff. If you are more of a reader, ask your team members to communicate with you primarily through reports.
10. Run your team like an airline crew In the 1970s and early 1980s, airlines had a very hierarchical and authoritarian crew structure. The system was completely overhauled when it was discovered that 70 percent of commercial flight accidents stemmed from communication failures. Aviation experts at NASA created a new system called Crew Resource Management (CRM), which completely changed how flight crews communicate and interact. CRM is now a requirement for flight crews worldwide. The new system focused on educating crews on the limitation of human performance and how fatigue, emergencies and work overload affect people. Team members are encouraged to ask questions and share information, and they are assured full immunity when analysing past errors. Instead of wasting time allocating blame, the system encourages managers to take a non-punitive approach and focus on developing more efficient procedures that will absorb communication errors through redundancy and standardisation.

11. Keep teams as small as possible View your company as a tribe and your teams as family units. In other words, keep your teams small and manageable. Although the ideal number of people is determined by the team’s task and the roles of its members, research shows that teams communicate better and are more productive when they have around 10 members or fewer. Anything larger than 10 produces a tendency toward social loafing, also known as the Ringelmann effect. The more people you have working in a single team, the more their level of work declines. This tendency stems from the feeling among team members that their individual effort doesn’t matter much within such a large group. Keeping your teams’ small will reduce bureaucracy and allow team members to know each other well enough to maximise their talents. It also streamlines communication and keeps your team members engaged.
12. Create an environment where trust can grow Trust is the glue that holds all social constructs together, from families to companies to national currencies. For effective communication to exist between team members, they have to trust, at
least on some level, their colleagues. Trust develops through time, which is why teams that have been working together the longest are more productive and make fewer mistakes.
