inally I am able to report that the RSPH Level 3 NVQ Diploma in Supervising Licensed Asbestos Removal (Construction) has been approved as a qualification meeting the requirements for the Gold Supervisors CSCS card. The qualification is now available from ARCA and we are already taking bookings.

Following the launch of this Level 3 NVQ ARCA has now added the red and gold Supervisor CSCS cards to the suite of CSCS cards offered under the ARMI Skills Card Scheme.

As you would expect from ARCA, we offer the widest variety of qualification options for the industry, to allow companies to select the most appropriate route for their staff (see pages 14/15). ARCA also offers the widest range of CSCS cards for the industry and is the only CSCS partnership scheme to offer the black CSCS card for Contracts Managers, along with the temporary red cards for this occupation.

Members will recall that at the ARCA AGM in October 2017, Archie Mitchell, Head of the Asbestos Licensing Unit, informed members that as a result of the Post Implementation Review of the Control of Asbestos Regulations 2012, which was conducted in 2017, HSE had been tasked with producing guidance on Plans of Work which had to be published by October 2018. A draft version of this guidance was provided to ARCA by HSE on the 23rd May 2018, and this was circulated to members. The draft is a discussion document representing HSE’s thinking at the moment. HSE is keen to hear ARCA member’s views on any glaring omissions, duplication, or where the document is not clear, and also whether ARCA members’ think it helps or could be improved. The draft document was discussed at the ARCA regional meetings during June and in the main members welcomed the document and were broadly satisfied with both the approach and the content. Members were advised by email and at the regional meetings as to how they could provide feedback, which was requested by HSE by the end of June. I am pleased to report that the CITB Approved Training Organisation (ATO) scheme is progressing and ARCA is registered as a CITB Approved Training Organisation. A list of asbestos

industry training courses and qualifications that will be included in the scheme has been produced. The scheme will set standards for each training course or qualification, and then providers will be audited against the standard by CITB to ensure they are compliant with the requirements. Which includes details such as; duration of training, syllabus, trainer qualifications, what needs to be delivered as practical training and what practical equipment needs to be available at the training event. The need for such an independent third party was acknowledged at the Asbestos Leadership Group (ALG) meeting on the 23rd May. It was suggested that what is missing from the asbestos industry as a whole is the independent thirdparty accreditation of qualifications and training, which is present in the education sector (Ofsted, Ofqual). As ARCA is committed to providing quality assured training and qualifications, all our qualification processes and procedures are already Ofqual regulated via the Awarding Organisations. The ALG was made aware that CITB is putting in place an ATO scheme and the ALG may be able to participate in this work as ALG would not necessarily want to repeat it. ARCA is fully supporting this ATO initiative by the CITB and look forward to improved standards of asbestos training provision for the industry as a whole as result. Work on producing the standards for the ATO scheme has already commenced and I look forward to reporting significant progress on this scheme in the next issue of ARCA News. I am pleased to be able to inform members that Daniel Barrowcliffe, an HSE Scientist from the HSE’s Fibres and Mineral Team, has agreed to give the keynote speech at the ARCA AGM at Lords Cricket Ground on October 5th. This year we are holding our third Charity Week, 10-14 September. Some fundraising activities/ events are already being planned (page 21) and I hope many members will take part in some way to help support our charities.

RCA, the UK’s leading association representing asbestos removal contactors, announces the availability of the first NVQ for asbestos removal supervisors. The Level 3 NVQ Diploma in Supervising Licensed Asbestos Removal (Construction) has been developed by ARCA specifically for asbestos removal supervisors, following consultation with industry, and certificated through the Royal Society for Public Health (RSPH) (awarding body). Now asbestos removal supervisors can gain one qualification, rather than two, to obtain a gold CSCS card, saving businesses time and cost. “As the leading association, supporting our members and the industry by developing one encompassing qualification for supervisors was our goal,” commented Satish Patel, Training Manager for ARCA. The Sector Skills Council (SSC/CITB) agreed ARCA could review the framework of the Occupational Workers Supervisory NVQ to see how it could be tailored for the asbestos removal industry. After this review and selection of the learning units to be included in the qualification, industry was consulted to

ensure the content verified the knowledge and understanding required to carry out a supervisor’s role and responsibilities “Feedback was very positive, with the qualification content confirmed, so we worked with RSPH to complete all documentation and I carried out a pilot of the on-site assessment process,” stated Satish Patel. “Having the support of the SSC/CITB, the industry and also RSPH, ARCA is now delivering a specifically designed qualification for asbestos removal supervisors.” Full details on this NVQ, together with an overview of the assessment process, is available on the ARCA website.

arlier this year ARCA was invited by the Health and Safety Executive for Northern Ireland (HSENI) to address their Asbestos Updates Seminar. During the day numerous topics were covered, with particular emphasis on Plans of Work for licensed asbestos removal contractors. Geoff Silver, Membership Compliance Manager, represented ARCA at the seminar on 15th March, which was attended by over 100 delegates; licensed asbestos removal contractors, analysts and clients based in Northern Ireland, together with officers from HSENI. One of the key objectives of HSENI is that the relevant parties ‘control risk together’, and ARCA was delighted to contribute with presentations on Plan of Work Perspectives, Ensuring Plans of Work are Suitable & Sufficient, and Measuring Performance. “It was a privilege to share some of our perspectives regarding Plans of Work,” commented Geoff. “It was interesting

and significant to hear many of the same points highlighted in presentations by HSENI, creating a strong message of unity in the perspectives of the enforcing authority and the UK’s leading trade association for asbestos management”. ARCA typically assess over 500 Plans of Work per year. The importance of Plans of Work cannot be over emphasised. They are prepared in order to address all of the site specific requirements of each individual asbestos removal contract undertaken, and form the instructions to site teams as to how the work is to be carried out. “ARCA site audits not only assess Plans of Work against industry requirements, but also the compliance of site teams in carrying out the work in accordance with the Plan,” stated Geoff. ARCA presents at AGSM Conference to support housing sector

n April the Asbestos Removal Contractors Association supported the AGSM National Conference by exhibiting and speaking. This followed a discussion with the Association of Gas Safety Managers as questions on asbestos had been raised at some of the association’s member forums. ARCA delivered a presentation on ‘managing the risks from asbestos’, covering asbestos management, from surveys to removal, and the legal requirements. Also, on the exhibition stand

ARCA had various handouts available relating to these topics. “It was a successful event for us as we continue to promote safe management of asbestos containing materials. We spoke to numerous attendees from the housing sector, who asked questions on various topics from health & safety responsibilities to removing large areas of artex,” commented Steve Sadley Chief Executive of ARCA.

Contractors fined for carrying out unsafe asbestos removal work without a licence. T

wo contractors were sentenced today after removing asbestos pipe lagging without taking the necessary precautions to reduce exposure to asbestos. Teesside Magistrates’ Court heard how the two contractors were carrying out refurbishment work at a residential property in Hamsterley, County Durham. Having removed the ceiling in the back room on the first floor of the property, the contractors discovered pipework running along the length of the roof space, wrapped in lagging. Samples taken of the lagging confirmed it contained asbestos. An investigation by the Health and Safety Executive (HSE) found that, between 10 June 2016 and 12 July 2016, the two contractors removed the lagging, despite knowing it contained asbestos. Neither contractor held a licence to undertake this type of work nor

did they have the necessary training. The investigation also found the asbestos removal was carried out without the required measures in place to reduce exposure to asbestos, thereby putting themselves and the house owner at risk of exposure to asbestos fibres. Brian Michael John Barry, of Ponteland, Newcastle upon Tyne pleaded guilty to breaching regulations 8(1) and 11(1) of the Control of Asbestos Regulations 2012 and was fined £576 and ordered to pay costs of £847 costs. David Jonathan Storey of Prudhoe, Northumberland, pleaded guilty to breaching regulations 8(1) and 11(1) of the Control of Asbestos Regulations 2012 and was fined £692 and ordered to pay costs of £844. After the hearing, HSE inspector Andrea Robbins said “Asbestos is responsible for the premature deaths of approximately

5,000 workers each year. In this case, it was foreseeable that, in the absence of measures to reduce asbestos fibres becoming airborne during removal of the pipe lagging, that people were at risk of being exposed to them. It was reasonably practicable for the asbestos to have been removed by a licensed asbestos removal contractor under fully controlled condition thus reducing the risk of exposure to asbestos.”

Cork company fined €50,000 for exposing workers to asbestos he Irish Examiner reported that a Cork company has been fined €50,000 for exposing workers to the risk of inhaling asbestos fibres during demolition works at an office building in Mallow. At Cork Circuit Criminal Court, Leeside Cut & Core Contractors, pleaded guilty to two charges. The first was that it failed to ensure the safety, health, and welfare at work of employees. This was because it failed to manage the demolition work at the premises in circumstances where there were asbestos-containing materials present. Demolition work was being carried out in an uncontrolled fashion causing damage to the asbestos-containing ceiling tiles and floor tiles on the premises, thereby exposing employees to the risk of inhaling asbestos fibres. The second plea of guilty was to the related charge of failing to carry out a risk assessment. Judge Seán Ó Donnabháin said: “This is quite an alarming case. There is nobody — be that judge or labourer — who is not aware of the dangers of being exposed to or working with asbestos. Yet this company in a cut and core job carried on nonchalantly in the presence of asbestos.”

Greater Manchester Magistrates’ Court heard how EAS Asbestos Limited were commissioned to conduct refurbishment and demolition surveys by Mercer Brother Limited, a construction company who were contracted to demolish garages for Hyndburn Homes. EAS Asbestos stated in their surveys that asbestos was only present in the cement roof sheets, there were no areas that could not be accessed, and that there was no asbestos insulation board present in the garages. On Wednesday 1 February 2017, the demolition of the garages went ahead but work was immediately stopped when suspect material was found. Another surveying company was brought in and confirmed the presence of large amounts of asbestos insulation board in the demolition rubble.

An investigation by the Health and Safety Executive (HSE) found that the survey carried out by EAS Asbestos Limited was incorrect and misleading. EAS Asbestos Limited of Lower Meadow Lane, Huthwaite, Sutton in Ashfield, pleaded guilty to breaching Section 3 (1) of the Health and Safety at Work Act 1974. The company was fined £6,700 and ordered to pay costs of £1,000 and a victim surcharge of £170. Speaking after the case, HSE inspector Jacqueline Western said “This incident could so easily have been avoided by simply carrying out correct control measures and safe working practices. “Companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards”.

construction company has been fined after it carried out unsafe and unlicensed asbestos removal during the refurbishment works in a junior school in Dursley. Cheltenham Magistrates Court heard how, in October 2016, R F Gardiner Limited removed asbestos in an unsafe manner and did not have the appropriate licence to carry out the work. Operatives working for the company were exposed to high levels of airborne asbestos fibres during the removal work as no water suppression was used and they had not been face-fit tested for the face mask they were wearing.

An enclosure under negative pressure was not set up to contain the asbestos fibres released during the removal and as such asbestos fibres were spread to the surrounding area. Workers also had no way of decontaminating onsite on completion of the work. An investigation by the Health and Safety Executive (HSE) found that poor planning of the work meant that unsafe and unlicensed asbestos removal work was undertaken. R F Gardiner Limited of Cirencester Road, Gloucestershire, pleaded guilty to breaching Sections 8(1), 11(1) and 16 of the Control of Asbestos Regulations 2012 and

was fined £28,000 and ordered to pay costs of £1,141.80. Speaking after the hearing, HSE inspector James Lucas said “The company in this case should have ensured appropriate measures were identified during the planning process to include the engagement of a licensed asbestos contractor to carry out correct control measures and safe working practices for the removal of the asbestos. Companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards”.

Asbestos removal company and managers sentenced after forging documents

n asbestos removal company, and two of its managers, have today been prosecuted after forging documents in order to obtain an asbestos licence from the Health and Safety Executive (HSE). Greater Manchester Magistrates’ Court heard how, between 16 March 2012 and 10 March 2016, Excavation and Contracting (UK) Ltd used both forged medical certificates and forged asbestos training certificates for their asbestos removal operatives. These forged documents had been made by their asbestos operations manager, David Lloyd, and included medicals in the name of the company operations manager, Lee Cooper, and forged training certificates for Lee Cooper and the managing director, Brendan O’Halloran. The doctor who had allegedly issued these medical certificates had retired sometime earlier to live outside the UK. The HSE investigation found the defendants

had used forged documents to obtain an asbestos licence from HSE in order to trade. The investigation also found the company could not show that they had properly trained or adequately monitored their workers who were exposed to asbestos. David Lloyd, of Hanwell Close, Leigh pleaded guilty to breaching Regulations 10(1)(a) and 22(1)(c) of the Control of Asbestos Regulations 2012. Excavation and Contracting (UK) Ltd of West Quay Road, Warrington, pleaded guilty to

breaching Regulations 10(1)(a) and 22(1)(c) of the Control of Asbestos Regulations 2012 and was fined £13,000 and ordered to pay costs of £10,000. HSE inspector Matt Greenly said after the case: “Putting people at risk from asbestos by not training them or monitoring their health, as required by law, not only puts their lives at risk from an incurable set of diseases, but is also wholly unnecessary. “There are ample affordable training providers and approved doctors who can carry out these functions at the convenience of the contractor. Taking deliberate shortcuts by creating forged documents will not be tolerated by HSE and we will not hesitate to take appropriate enforcement action against those that fall below the required standards.”

Prior to ARCA reviewing NVQ routes for supervisors, the only route that existed necessitated supervisors completing two NVQs, the Level 2 Qualification for Operatives and the Level 3 Occupational Work Supervisors NVQ. ARCA approached the Sector Skills Council (SSC/CITB) with a view to creating a single NVQ for supervisors, and by reframing the existing qualification units created the Level 3 NVQ Diploma in Supervision of Licensed Asbestos Removal (Construction).

members to be able to continue to obtain CSCS cards, which are necessary to work on many construction sites in the UK. After looking at the available routes to NVQ options, we knew we could better serve our members by giving them more choice and more efficient means of achieving them. So, we have worked with our long-term partner the Royal Society for Public Health (RSPH) to develop a range of qualifications. The RSPH has supported us and provided expert guidance in relation to the development of qualifications.

CITB Approved Training Organisation scheme The CITB has begun a programme of reform, as part of this they are ceasing providing training themselves and establishing a network of training providers to deliver CITB approved training across the construction industry. This scheme is known as the CITB Approved Training Organisation (ATO) scheme and will include asbestos training. All CITB ATOs will have to meet CITB requirements for the training courses they offer. The training requirements will be defined in the training standard for the particular course. ARCA is currently involved in defining the training standards for the asbestos industry and is already registered as a CITB ATO. We are fully supportive of CITB in the establishment of the ATO scheme and welcome independent third party verification of asbestos training as we feel this is long overdue for our industry. Guidance for Other Trades and Live Enclosures There can be exceptional circumstances where licensed asbestos removal contractors need the services of other trades (plumbers, electricians, lift engineers, excavator drivers etc.) in order to allow work activities to continue in a safe and effective manner.

A “live enclosure” means an enclosure / work area where licensed asbestos work is being undertaken. Entry into live enclosures will usually be avoided by appropriate planning. When entry is unavoidable, asbestos work must be stopped and the area cleaned before other trades can enter. Other trades’ personnel shall be: w Suitably trained (especially in personal decontamination)

Legal Requirements Licence holders will be aware of the main legal duties placed on them with regard to preventing / controlling the exposure and spread of asbestos. The Control of Asbestos Regulations 2012 (CAR 2012) and the Management of Health and Safety at Work Regulations 1999 are particularly relevant to all licence holders. The Health and Safety at Work etc Act 1974 places very broad general duties on employers. Employers have a duty to take all reasonably practicable steps to ensure the health, safety and welfare of: w Employees and w Others who may be affected by the employers’ work. This includes other trades who are not directly employed by the licence holder but are likely to be affected by the ongoing work. Also, the Construction (Design and Management) Regulations 2015 (CDM 2015) place very clear duties on contractors to communicate and coordinate effectively with each other, sharing relevant information and ensuring that significant risks are managed effectively.

Avoiding the need to enter live enclosures

Information, instruction and training

The starting position is that entry into an enclosure by a non-licensed contractor can, and should, be avoided as far as possible.

Before other trades enter a live asbestos removal enclosure they must receive sufficient information, instruction and training.

The need for other trades to enter enclosures can normally be avoided through careful planning, coordination and cooperation with the client and other contractors.

As a minimum, this training should include practical instruction in:

For example, in most scenarios either: w Arrangements can be made to allow other trades to complete their work prior to notified asbestos work starting, with no disturbance to the asbestos and / or w The work can be programmed to coincide with ‘shut downs’. In these situations services can be isolated and the risk of any need for trades to carry out additional works, such as isolations etc., is removed. Where entry of other trades into a live enclosure is unavoidable, the licensed contractor has control of the working area and the expertise regarding associated risks. The licensed contractor has a responsibility to ensure employees of other trades are adequately informed, trained and that they use appropriate personal and respiratory protective equipment (RPE / PPE). In effect, the contractor must assume responsibility for the health and safety of the other trade as if they were one of their own employees.

w The correct use of RPE and PPE, as well as functionality of the RPE to ensure continued protection w Correct personal decontamination techniques – they must be able to follow the full decontamination process as they would not be escorted through the decontamination unit w Information about the activities being undertaken in the enclosure and any other significant risks, including non-asbestos risks w Any other particular emergency procedures relevant to the job / site This level of information, instruction and training can be provided by a competent member of the licensed contractor’s team, and a record of the training delivered should be kept within the site file.

Actions required before allowing entry Before allowing trades to enter the enclosure, asbestos removal work should stop and the area should be cleaned as far as reasonably

practicable. Asbestos removal work should be “on hold” until trades have completed their work and exited the asbestos removal area.

What do other trades need to do? They should be accompanied by the asbestos contractor’s supervisor at all times to ensure they conduct themselves in a safe manner. Other trades entering the enclosure will have to wear RPE and will have to be fit tested to ensure suitable RPE is selected. This does not cause any difficulty where the work is planned. In the case of genuine emergency works other RPE, which does not require face fitting should be used, such as hoods / powered visors. Although other trades will be entering into a “live” enclosure, they will not be involved in any asbestos work and no asbestos removal work will be taking place. When properly planned and controlled, exposure to asbestos is not expected to be significant and there will be no requirement for health surveillance. ARCA Staff bring back the bike for Charity Week! 480 miles from Rayleigh up to Glasgow For the first Charity Week in 2016, ARCA staff cycled the distance between its furthest training facilities, covering 480 miles from Glasgow to Rayleigh on an exercise bike in the office. After a rest from the bike last year, the team decided it was about time to cycle back up that hill to Glasgow! On Monday 10th September the team will start to make their way back to Glasgow and continue throughout the working week, completing before the end of the day on Friday 14th September (hopefully!). It’s going to be a challenge … for some more than others … but the team are determined to finish. Alongside the bike challenge, the staff will be taking part in a games night, baking and wearing fancy dress to finish off the week. The findings of ARCA site audits are essential sources of information for Licensed Asbestos Removal Contractors (LARC’s) in measuring their own performance. The audit results are also regularly reviewed by the Health and Safety Executive during the asbestos licence renewal process, and an increasing number of end-clients are taking greater interest in the results as part of their own contractor assessment schemes. I caught up with the ARCA Membership Compliance Manager, Geoff Silver, to find out more about the assessment process and how the audits are graded.

How many site audits does an ARCA member company have per year, and how are they conducted? LARC’s in the UK who are ARCA members have two site audits during each year of their membership, and these are conducted on an unannounced basis. The audits are arranged by the membership team (using information from the HSE/ASB5), which means that neither the company management nor the site teams know about the visit until the auditor arrives. Very occasionally, for access or security reasons, the company may learn of the impending visit shortly beforehand. Each audit is conducted following a predetermined checklist of ‘audit standards’, with the auditor recording the level of compliance for each standard on the electronic audit form. The standards have been developed over many years through the ARCA Membership Committee, and are seen as key indicators of company performance. At the conclusion of the audit, the audit findings are reviewed with the site supervisor

ARCA Site Audits

Insight into the Assessment Process who has opportunity to make comment, further discuss, or bring any other matter to the attention of the auditor. The agreed and completed audit form is then converted on-site to a report which can be emailed directly to the contractor and to ARCA. The two unannounced site audits conducted annually under the Site Audit Accreditation Scheme (SAAS) are a mandatory part of membership. Once the completed audit report is returned to ARCA, how is it then assessed? We assess the completed audits against a standardised marking scheme, which has been developed by the ARCA Membership Committee to ensure consistency in the assessment process. Non-conformances are categorised as either minor, major or critical, depending on the seriousness and implications of the nonconformance. For example, having a viewing panel that is slightly smaller than the standard

size is clearly less critical than insufficient use of a dust suppressant, and so non-conformances can’t all be scored the same. Therefore, the scores are weighted in accordance with the levels of risk the non-conformance would or could create. Within the categories of minor, major and critical, there are further subdivisions where non-conformances are given a points score. For example, a minor non-conformance may attract a score of 1 or 2 points depending on the seriousness, major 3 to 6, and critical 7+. The points are added together, and the total corresponds to bandings that reflect the grade to be awarded (grades A to F). Who comprises the Membership Committee? Committee members are either members of the ARCA Governing Council, and thus elected by the membership to represent them on the governing body, or nominated by the Governing Council. With the exception of the ARCA staff who also sit on the committee, all are company

site audits directors of asbestos removal or analytical companies with membership of the Association. They therefore have many years of experience of asbestos removal and abatement at a senior level. What grades constitute a satisfactory audit under the ARCA Site Audit Accreditation Scheme (SAAS)? Any audit graded from A to E is considered satisfactory under the SAAS. An audit deemed as an F grade is deemed to have not met the minimum standard required of the Scheme, and therefore a remedial action plan needs to be prepared by the LARC and a further site audit arranged. While no-one really wants to get a D or E grade, these are still within the range of grades considered as satisfactory, though there will be some clearly identified opportunities for improvement available to the contractor. What is assessed during a site audit? For an ARCA site audit to be considered valid, it needs to be conducted on a licensable and notified job (NB an equivalent job in the Republic of Ireland, as licensing is not applicable there). Ideally we would like to observe the actual removal process, but in some instances the actual time spent on removal is only a small proportion of the actual time on-site. It is important to remember that the whole of the time on-site forms the notified works, it should all be detailed in the Plan of Work, and it is all auditable. The site audit itself is divided into numerous sections, and starts with observed work practices and immediate site control for asbestos risks, then consideration of observed work practices and immediate site control for non-asbestos risks. There then follows sections that assess the Plan of Work and adherence to it, methods of measuring and monitoring site work, and the provision and availability of supporting documentation. Audit findings and recommendations are recorded by the auditor for the benefit of both the assessor and the company being audited, and can include photographs to aid explanation. Why don’t you report the audit results as a percentage rather than a grade? This was a really serious consideration when we were developing the grading system, but gave rise to some very specific concerns as to how the results could be interpreted. The current site audit form refers to more than 140 different

criteria. It would be quite feasible for a company to have 3 or 4 non-conformances, which could relate to a score in the region of 97%, and yet those non-conformances could be significant. We wanted to avoid the complacency that might creep in when a company’s audit results are consistently in the high 90’s yet some issues would be essentially hidden and therefore unlikely to be addressed. Asbestos removal in the UK is operated under a permissioning regime, alongside industries such as nuclear or offshore installations, and therefore exemplary standards are required and expected at all times. As much as an audit should highlight good practices as well as identify where improvement is required, we should not focus on our achievements and ignore our weaknesses. It’s the 3% that needs attention right now, not the 97%. Who marks the completed audits and determines the grades? All completed audits under the SAAS are returned to the ARCA office for assessment. The first stage of the assessment process is for each audit to be assessed in-house within the Membership Department. Audit reports generating results within a specified range of scores are forwarded to members of the Membership Committee for verification. This is part of ARCA’s own quality assurance process to ensure a fair and robust assessment process. Comments and recommendations from the Committee members are then collated in order to determine the audit grade awarded. You mentioned the audits completed ‘under the SAAS’. Are there other audits that are not under the SAAS and if so, how are they different? The ARCA audit covers a variety of different scenarios. We have already discussed the two unannounced audits required as part of membership. Also, companies come to ARCA to arrange for some additional audits, which are conducted using the same audit criteria as the two membership audits, enabling direct comparisons of results, which in turn can be a powerful management tool. These additional audits can be arranged on an unannounced basis (e.g. one per month at any active site) or can be arranged by management for a specific contract, type of material being removed, stage of work, or particular site team or supervisor. The additional site audits are not routinely assessed and graded, but can be on request, and are outside the scope of the SAAS.

In addition, all applicants for membership (as Full Contracting Members) are required to successfully complete a site audit as part of the application process. Does the ARCA site audit cover every element that a licensed asbestos removal contractor needs to demonstrate? Being in a permissioning regime, the asbestos removal industry is highly regulated, and there is a great deal of additional HSE guidance for particular scenarios. This means that there are lot of elements to each job, and therefore a lot of criteria that could be checked. In order to avoid overload, we try to focus on the things that matter most – the things that are safety critical, potentially pose a risk to health, and evidence of sound management of the asbestos removal process. Through our work in the Membership Committee, we have identified the elements that we consider matter the most, so they are not at the mercy of the things that matter least, thus striving to include all of the most important criteria in the site audit. Could you tell us a bit more about the Gold Site Audit Award, and what do companies need to do to achieve this? Although we acknowledge the efforts of all of our member companies in achieving satisfactory audit results, we also wanted to acknowledge those companies who achieve and maintain exemplary standards over a sustained time period. This is why the ARCA Gold Site Audit Award was introduced. The main qualification to receive this award is for a company to have had their last 6 SAAS audits (i.e. the past 3 years) graded in the A to C range, with an average of at least a B grade. There is also a slight weighting to be applied to account for the fact that some of the audit criteria are not applicable, depending on the stage of works being audited, the timing being a consequence of site audits being unannounced. It is reassuring for us to see companies demonstrating that the standards expected can be achieved and sustained over time. Welfare Facilities for Asbestos This article gives an overview of the basic legal requirements for welfare provision on asbestos removal sites. These requirements are well defined, having been in place for a long time, therefore any failure to provide adequate welfare could have serious implications for HSE’s confidence in a contractors’ general management arrangements.

What are welfare facilities? These are facilities that are necessary for the well-being of workers/employees, such as: w Toilets & washing facilities w Rest areas (incorporating a place for preparing hot drinks & eating food) w Access to drinking water w Changing rooms & lockers (where workers need to change into special clothing)

Who is responsible for welfare facilities? All contractors need to ensure that there are adequate facilities for workers under their control. In many cases, welfare provision will require cooperation and coordination between a number of different organisations. This coordination needs to be clearly addressed at the planning stage.

Welfare and health & safety management The Construction (Design and Management) Regulations 2015 (CDM 2015) place specific duties on contractors, clients and others involved in construction work. The definition of ‘construction work’ is very broad and will include asbestos removal tasks

(licensed and non-licensed). For example, it includes; alteration, conversion, fitting out, commissioning, renovation, repair, upkeep, redecoration or other maintenance (including cleaning which involves the use of water or an abrasive at high pressure, or the use of corrosive or toxic substances), de-commissioning, demolition or dismantling. The minimum welfare facilities required for all construction sites is described in Schedule 2 of CDM 2015. Welfare requirements on contractors will apply regardless of whether or not the project is CDM 2015 “notifiable”. A company’s approach to arranging welfare provision needs to consider: w The type of work being carried out w The number of workers and work location w Cleaning and maintenance responsibilities and regimes For licensed asbestos removal a ‘suitable and sufficient’ plan of work will identify where / how facilities are to be provided. General / generic statements (e.g. “Welfare to be provided by client”) are not sufficient as they do not explain what site teams should expect on-site. It follows that site assessors, planners, supervisors and auditors / visiting managers need to understand the minimum standards for

guidance of toilet provided. For example, HSE guidance recommends that no more than 7 persons should be expected to use a single portable toilet where it is being emptied on a weekly basis. Washing facilities will include showers for very dirty or hazardous work and these will be separate from general washing facilities. Sinks should be large enough to wash face, hands and forearms. They must be provided in the immediate vicinity of every toilet. They should also be provided next to rest areas, where these are far from toilets. All washing facilities must include: supply of hot and cold water; soap, or similar; towels, or other means of drying. Rooms containing washing facilities and toilets must be kept clean and orderly; they must be adequately ventilated and lit.

Work welfare provision and take welfare facilities into account when considering workplace transport and other ‘access’ or site management issues. In addition: w The company’s training and / or general procedures need to cover welfare requirements. w The company’s general arrangements for monitoring performance must also look at welfare provision; ‘audits, senior management tours’ etc. should expect to identify where welfare provision does not meet the minimum legal standard.

Welfare facilities – basic requirements Any reference to something ‘provided or made available’ means that the facility is in a readily accessible, suitable location. For example, a toilet that is ‘made available’ but is a 30-minute walk away, is unlikely to be considered readily accessible. Where possible there should be separate facilities for men and women - failing that, rooms with lockable doors. Toilets & washing facilities A ‘suitable and sufficient’ number of toilets must be provided or made available. This will depend on the number of workers and the type

Rest areas or rest rooms Rest rooms or rest areas must be provided or made available. These areas will: w Have tables and chairs (with backs) to accommodate the number of people likely to use them at any one time w Include facilities to prepare / eat meals, including a kettle (or similar) w Be heated / ventilated as necessary to maintain a comfortable environment Drinking Water An adequate supply of drinking water must be provided or made available. Cups (or similar) must also be provided, unless the water is provided from a drinking jet / fountain etc. Changing rooms and lockers Changing rooms must be provided in situations where workers need to change into special clothing and, for reasons of either health or propriety, they cannot be expected to change elsewhere. Changing rooms need to be equipped with seating and have places for workers to lock away clothing or personal effects.

Decontamination units as changing and washing facilities Where decontamination units (DCUs) are required for removal work, these should be capable of meeting the ‘welfare’ requirement for changing rooms and lockers. However, DCUs do not provide general washing facilities as defined above: use of the shower section of a DCU is subject to decontamination procedures and access is restricted to those working in asbestos areas. As mentioned above, washing facilities will be required with / near toilets (and rest areas, if these are a long way from toilets). For asbestos removal work not requiring a

DCU (i.e. non-licensed works) specific changing rooms are not required, as asbestos coveralls are generally worn over work clothing.

Small scale / short-duration asbestos work There is HSE guidance on welfare provision for work that is completed in less than a week, or for ‘transient’ activities (such as a sequence of short tasks carried out across various locations in a particular geographical area). In such cases it is accepted that contractors make use of a “client’s existing facilities, public facilities or local businesses”. However, contractors need to be able to demonstrate that clear agreements have been made as part of planning for the work. In all cases workers must have facilities that are readily accessible (open at all relevant times), provided at no cost to workers and of an acceptable standard. In practice, it is unlikely that local businesses will offer such agreements. A guidance note available on the ARCA website gives further information and example scenarios.

They must ensure adequate welfare arrangements are in place for their staff. For larger / more complex projects, contractors must coordinate their activities with others, particularly with the principal contractor and principal designer. On multi-contractor sites, asbestos contractors need to ensure that welfare arrangements are properly explored and clarified at the planning stage.

ION complete works at the iconic Selfridges I

ON Environmental reached a tremendous milestone successfully completing works within a live retail environment at the iconic Selfridges flagship store in Central London. Over the past year ION have delivered complex removal works alongside sister company Scudder Demolition, who carried out major refurbishment and renovation works at this intricate and historic store, bringing increased logistical efficiency and an enhanced overall Selfridges customer experience. ION completed detailed asbestos works in two phases. Initial works involved the removal of previously identified

Asbestos Containing Materials (ACMs), which often took place overnight to mitigate disruption to the live store. Following on from this, the team provided rapid evaluation, containment and protective measures for unplanned finds, ensuring the safety of site personnel and customers. This ‘watching brief’ service was provided day and night, with ION personnel also available for emergency call-outs.

Biffa announce plans to further extend Asbestos disposal offer across UK sites

hodar won the award for ‘Outstanding Projects (under £3million)’ at the 2018 UK Rail Industry Awards on 23rd March, at Battersea Evolution, London. The event, now in its fifth year, brought together leaders and decision-makers who run the rail industry, for the sector’s largest and most prestigious celebration. The winning project was a collaboration between, Rhodar, Rhodar’s client (Spencer Group) and Great Western Railways (GWR), who had a requirement for the safe removal of asbestos containing materials from one of its vast 192m HST (High Speed Train) maintenance facilities based in Penzance. Rhodar developed a solution that allowed the safe removal of asbestos, without impacting on the critical train maintenance schedule. The solution utilised a unique multi-level scaffold enclosure system which was erected inside the maintenance facility and was operated on a bespoke set of purpose-built tracks. Following a successful pilot phase, Rhodar worked systematically through the depot (from one end to the other in 11 planned sections) by locking the scaffold system down in each section, sealing the specialist asbestos enclosure walls and floor, and attaching the moveable airlock and bag-locks.

Rhodar faced a number of challenges during the project such as adverse weather conditions on the south west coast and an increase in planned train movements through the HST maintenance depot. Both had to be overcome in order to ensure the strict overall programme and timescales could be met. This then enabled the follow-on facility refurbishment works to be carried out on schedule. Rilmac respond to DIY SOS call R

ilmac Insulation Ltd are proud to have been able to provide free asbestos removal services for a deserving family from Hessle, East Riding Yorkshire, who are to be featured on the BBC One Series ‘DIY SOS: The Big Build’ presented by Nick Knowles and his team. When Rilmac Asbestos Services staff heard the unfortunate story of Darren and his family, they were inspired to contact them and offer any support they could. Darren, who was himself a volunteer on the DIY SOS Hull build in 2015, suffered a devastating injury to his spinal cord in 2017 leaving him unable to walk. After months of rehabilitation, wheelchair bound Darren returned home in December, only for tragedy to strike again. Darren’s wife Sarah died suddenly on Boxing Day. Eager to help, Rilmac teamed up with specialist asbestos surveyors Ensafe to undertake and provide a full refurbishment survey free of charge. Although much of Darren’s home was free of hazardous asbestos, some was discovered in the areas around the front door and window. As the door frame was due to be removed this needed to be addressed before the other volunteers could start work and the asbestos containing putty was removed from the window frame.

We appreciate that this cannot replace a lost family member or Darren’s mobility but we hope that we have contributed to making the quality of his day to day life better for him and his family. n May the National Specialists Accredited Centre (NSAC) held a standardisation meeting at ARCA’s office in Burton, using the facility as a hub for other associations to attend the standardisation meeting. All the ARCA team were involved, from internal quality assurers, assessors and admin team, as well as representatives from two other trade associations. Jon Ablewhite and John Parkes, both Internal Quality Assurers from NSAC delivered the meeting which covered all elements of the assessment process. A core activity of any organisation delivering qualifications is to maintain standards. This standardisation event reinforced key issues such as: accountability; measuring and progressing achievement; identifying assessment strategies; benchmarking performance; evaluation of assessment methods through self-reflection; progression of candidates and ensuring transparency.
