58 Ifyourchildbehavesanti-sociallyorcausesdamageonacoach,theyrisk beingbannedandparentswillalsobeliabletopayforthecostof repairs/replacementofpropertydamagedasaresultoftheirchild’sactions
59 TheSchoolreservestherighttorefusetocarryaPrepSchoolCoachUser whoisnotcollectedfromwithin10minutesofthearrivaloftheircoachorwho isnotwaitingattheirembarkationstopwhenthecoacharrivesonmorethan 3occasionsinanacademicyear Parentsshouldputinplaceback-up arrangementssothatanotheradultcanmeetaCoachUseriftheyareunable todoso
510 Ifyourchildleavesthecoachunsureofwheretheyare,neitherthedriver northecoachoperatorisresponsibleforthem Pleasenoteadrivercannot holdapupilonboardiftheyinsistondisembarkingbutwillcontacttheSchool immediatelyiftheyhaveanyconcerns Intheeventthatnoparentorguardian iswaitingtocollectaPrepSchoolchildatadisembarkationpointthecoach companywillimmediatelycontacttheSchoolandtheSchoolwilltryand contacttheparenttoarrangeforthechildtobecollected IftheSchoolis unabletocontactaparentorguardianthechildwillreturntotheSchool wheretheywillbelookedafterbyanappropriatememberofstaffuntilthey arecollected

82 TheShuttleCoachismetattheSeniorSchoolintheafternoonsbya memberofstaffwhowillensurethatallpupilsarecollectedbytheirparent, carerorguardianorthattheyaretransferredontothecorrectonwardcoach

9.Incidents
91 Alldriverswillhavereceivedinstructionandguidanceonproceduresto befollowedinemergencysituationseg illness,roadtrafficaccidents, breakdownorfire
92 Wherethejourneycannotcontinueinaccordancewiththescheduled timetable,alternativetransportwillbearranged
93 Inthecaseofanyaccidentor‘nearmiss’,theSchooland/orthe Coach providerwillfollowalldueprocessesforinvestigatingandrecordingthe incidentandanyactiontaken
94 Intheeventofanemergencyeg coachbreakdown,theSchoolwill endeavortoestablishthecauseoftheproblemandpasstheinformationto parentsassoonaspracticable
10 1 Please note that the School is under no obligation to provide school coach services
10 2 In the unlikely event that the coach company used by the School to run coach services can no longer provide the required services, a refund will be issued from the last date of travel The School will endeavor to put in place a replacement service but until that can be done parents will need to arrange alternative travel
10 3 In the event that the government legislates school closure or partial closure or the School is closed following an outbreak of an infectious disease, payment for the bus service will need to continue to be paid in full unless otherwise stated Any refunds in these circumstances are at the discretion of the School
10 4 Should demand for the particular coach route fall to such a point that it is no longer economically viable the School reserves the right to discontinue that coach service The School will give a minimum of a half-Term’ s notice of this In that case a place on an alternative service will be offered, if feasible
10 5 In order to run a cost effective and punctual service we may need from time-to-time to alter the coach arrangements We must, therefore, reserve the right to alter routes, pick up points, times and the coach companies used We will endeavor to keep changes to a minimum and provide as much warning as the circumstances allow
11. Miscellaneous
11 1 Our liability under these Terms and Conditions shall be limited to the amount paid by you for Coach services over the last 12 months Nothing in these Terms and Conditions affect or limit your rights under English law, or will exclude or limit our liability for death or personal injury resulting from our negligence
11 2 The School reserves the right to change these Terms and Conditions at any time but will always endeavor to give as much notice as possible before any changes are implemented In the event that changes are made, revised terms and conditions will be uploaded to the Vectare System and will also be available on the School website and via the parent portal
11 3 Neither party shall be liable in damages for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its reasonable control including, but not limited to Acts of God, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, insurrections, strikes, including, without limitation, failure of suppliers, subcontractors, and carriers, bad weather, and/or any other cause beyond the reasonable control of the party whose performance is affected to substantially meet its performance obligations under this Agreement
These Terms and Conditions and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales
