WHO WE ARE The Sylvia Rivera Law Project (SRLP) works to guarantee that all people are free to self-determine their gender identity and expression, regardless of income or race, and without facing harassment, discrimination or violence. SRLP is a collective organization founded on the understanding that gender self-determination is inextricably intertwined with racial, social, and economic justice. Therefore, we seek to increase the political voice and visibility of low-income people and people of color who are transgender, intersex, or gender nonconforming. SRLP works to improve access to respectful and affirming social, health, and legal services for our communities. We believe that in order to create meaningful political participation and leadership, we must have access to basic means of survival and safety from violence.

Dear Beloved Community, 2017 brought many peaks and valleys. The Sylvia Rivera Law Project celebrated 15 years of work towards trans justice. We experienced a watershed moment in our fight for self-determination when a federal judge brought down New York State Medicaid’s discriminatory ban on affirming healthcare for trans women and TGNCI youth. Across the country, though, the rise of state-sanctioned racism, transphobia, Islamophobia, misogyny, classism, and anti-immigrant sentiment continued, leaving many in our communities living in confusion and fear. In response, we witnessed an outpouring of support – the movement for racial, gender, and economic justice continued to bloom. More people became politically involved and joined the cause. They built community through marches, demonstrations, online – anywhere that allies were organizing for justice. They made sure their voices were heard and that the most powerful leaders in the state understood that we were unwilling to be beaten down and made to cower in fear – that we would call for accountability for police, for immigration enforcement, even for the highest office in the land. This momentum will continue. Now, more than ever, our demands are politically viable. Justice will not trickle down to the most vulnerable amongst us. We must work to ensure that our people are safe from violence in order to lead movements that will make them truly free.
We present this Annual Report not only as a reflection of the work that we’ve done but also as a roadmap for the work that remains ahead. Inspired by “Resistance in Bloom”, the theme of our 15th year, we wanted to share with you the ways that we are continuing to grow our work towards transformative change while keeping our grassroots strong. Inside, you will read about SRLP’s 13-year fight to increase access to healthcare and our continuing battle to ensure that the state properly implements its own regulation. You will learn more about the hundreds of cases we undertook this year to provide affirming and respectful services to our people. You will see the public education and Know Your Rights materials that we have created to assist our community, who, every day, navigate enormous barriers to care, safety, and even just being able to see each other, due to policing and profiling. TRANS HEALTHCARE NOW
2004 SRLP establishes the Medicaid Equality Initiative to challenge New York State Medicaid’s regulation denying coverage for transition-related healthcare. In collaboration with other trans and queer groups, including Queers for Economic Justice, the Audre Lorde Project, and the Gender Identity Project of the NYC LGBT Center, we begin organizing and strategizing to take down the regulation.
2007 Working with the New York Legal Assistance Group and Orrick, Herrington & Sutcliffe LLP, SRLP files the first lawsuit to challenge the ban, Casillas v. Daines.

SRLP, with the National Gay and Lesbian Task Force, develops a Medicaid activist toolkit, a comprehensive guide for state activists regarding transgender health coverage and Medicaid, that includes litigation and policy reform negotiation strategies, legal history, key medical evidence to prove medical necessity, sample documents for individual advocacy, and advice on working with medical experts.
2008 When the court is unwilling to overturn the regulation, SRLP partners with the Legal Aid Society to bring a challenge to New York Governor Patterson.
2010 SRLP holds healthcare focus groups for trans people of color and develops a Cost-Benefit Memo, gathering all available data on gender-affirming healthcare for trans people.
2011 Governor Patterson is unwilling to overturn the regulation so we partner with Housing Works and the Empire State Pride Agenda to bring it to Governor Cuomo’s Medicaid Redesign Team, with 500 signed petitions. Assembly Member Richard Gottfried and Senator Brad Hoylman declare their support.
2013 The Medicaid Redesign Team refuses to overturn the regulation; SRLP starts our healthcare media campaign with GLAAD and Callen-Lorde, which includes videos, infographics, and thousands of signed petitions.
Since our founding, the Sylvia Rivera Law Project’s work has been directly informed by the needs of trans, gender non-conforming, and intersex (TGNCI) community members. One priority that our community has consistently called for is access to gender-affirming healthcare and an end to New York State Medicaid’s ban on coverage for TGNCI-specific care. After a 13-year campaign, SRLP and our coalition partners were finally victorious – the state removed its blanket exclusions! This is only one step of the fight and we continue our work to ensure that the State is implementing the regulation correctly. Read on for a history of our “Trans Heathcare Now” campaign and the work that remains to be done.

SRLP and our allies take action at the New York Health Summit, calling for an end to healthcare discrimination for TGNC people.
U.S. Department of Health repeals the ban on healthcare for transgender people under federal Medicare program after Denee Mallon’s case and advocacy by organizations including GLAD, ACLU, and NCLR.
Healthcare victory! In Cruz v. Zucker, the court rules that NYS Medicaid must provide coverage for all TGNC New Yorkers, including trans youth, and deems procedures that were previously considered “cosmetic” to be medically necessary.
Working with Make the Road NY, GLOBE, and the Audre Lorde Project, we use direct action to keep transgender healthcare on the agenda for the Department of Health. We meet with the Health Care for All New York Coalition (HCFANY) to join forces.
2014 SRLP, with Willke Farr & Gallager and the Legal Aid Society, begins litigating Cruz v. Zucker, a federal class action suit against the New York State Department of Health to repeal the Medicaid regulation that denies TGNC people healthcare.
As a result of our lawsuit and advocacy by HCFANY, Governor Cuomo releases a bulletin clarifying that private insurance that covers mental healthcare must cover affirming healthcare for transgender people. Governor Cuomo and the New York Department of Health announce a proposed update to the regulation that will include coverage for hormones and surgery; the policy is introduced for 45 days of public comment. With the direction of our clients and members, SRLP continues our fight in federal court to end discrimination against TGNCI youth and trans women, whose care is considered “cosmetic” by the regulation and still banned.
2017 Even with the new regulations, our community members continue to face barriers to care due to untrained medical providers and Medicaid plan administrators. SRLP continues to grow our coalition to provide oversight and ensure that Medicaid policy is properly implemented, negotiating with government officials and training our members on their rights to increase their ability to advocate for themselves. SRLP launches What’s Up with Trans Healthcare Campaign to get crucial information to our community.
Each year, we receive hundreds of letters from people who are held in prisons, jails, and civil commitment facilities across the country. We respond to people to reduce their isolation and increase their ability to advocate for their rights.

SERVICES ACCESSED BY CLIENTS IN 2017 In 2017, we provided free, respectful, and affirming legal services to over 340 people in more than 400 cases (with many of our clients seeking legal assistance on multiple issues.) For most clients, the opportunity to access legal services in an environment where gender self-determination is valued and respected is a new and often transforming experience.
SRLP provides technical assistance to legal and social service providers to answer specific questions on best practices for serving TGNCI clients. We assist providers locally and those working nationwide.
