Common sense says you should probably move opening time back an hour or two, but an open-minded, honest discussion will absolutely increase our chances to resolve this issue, and many others.

Nearly every symptom of the preceding issues has been blamed on where the carnival/fair relationship currently resides, except on the real issue; i.e. an inefficient business model based upon inexpensive labor and energy. Make no mistake about it, the current nature of the fair and carnival business relationship is one that is outdated and grossly inefficient, rendering our efforts to remedy many issues with conventional methods ineffective. “Because we have always done it that way” is something we can no longer afford, and precisely what led us to this point.

Overcoming this will take never forgetting the lessons learned from our past, but resisting the temptation to let them completely dominate our thoughts as we strive to resolve the issues of our future.

For the first time in my life, external forces mandate that not only are we partners, we must act like it in order to survive. This is something that I truly look forward to, and hope you do as well, because the survival of our uniquely American carnival/ fair partnership hangs in the balance. Future generations of Americans not only deserve to enjoy the fairs and carnivals we offer, but are counting on us to make sure they can. Don’t be afraid of change; it’s the only thing that will actually save us!

By now nearly all of you have wrapped up your seasons and are making preparations for Las Vegas, state level fair meetings, or some much-deserved time off. As you do so, I can only hope that this message and that of the many other articles published in ShowTime enter into your conversations with your fair partners. Together we led ourselves into this predicament, and only together can we lead ourselves us out of it.

I hope 2015 was a safe and prosperous one for you all, and that 2016 will shape up to be even better! H

T

he seasons seem to go by faster as I get older, although I hear similar comments from the younger generation. It wasn’t long ago when the Florida, California and Texas winter and spring fairs were winding down and I had to delve deeper to find something pertinent that was happening.

Before I sat down to write this, I believe there were nine or 10 major fairs ending, several of which had broken records or were close to setting them.

Seemingly, on top of each other were the North Carolina State Fair, which passed the million mark in attendance for the second time; the South Carolina State Fair, which did remarkably well, considering it almost didn’t even happen due to floods that took bridges and roads out; Tulsa, where just about every record came tumbling down; Perry, GA, where Reithoffer Shows set a record for the second year in a row; the Arkansas State Fair, where a record attendance was recorded; the Big Fresno Fair, which lived up to its billing; Pensacola, which was having another great run, and the Arizona State Fair was still in progress.

Amidst all this, and much more, I spoke to OABA First Vice Chair Tom Gaylin, who has been tireless in his efforts to help the organization since he became a director. He has worked diligently with Curator Doc Rivera on the carnival museum in Gibsonton, and takes his duties very seriously as the head of the committee that elects members to the Hall of Fame and Pioneer Awards.

A wrestling aficionado and official who has received numerous awards for his efforts with that sport, Gaylin is a fourth-generation owner, with his wife, Barbara, of Rosedale Attractions & Shows, a Baltimore-based carnival. Usually when I ask a carnival owner or concessionaire how his or her season went, the answer goes something like it was good or bad, depending on the weather. When I asked

Gaylin, he answered, “Weird, that’s the best way I can describe it. Our spring was way up and we were going strong in April, May and June until we hit a stretch where we had to be towed in and out of four lots in a row. Then we did real well again until we got a lot of bad weather in September. Overall, we can’t complain because we were breaking records everywhere we went in July and August.” Rosedale, which has been in business since 1928, plays in the states of Maryland, Virginia and Pennsylvania.

It was also an eventful year in that Gaylin purchased Billet Amusements, York, PA, from Mildred (Mickey Billet).

He bought the rides, joints and generators but not the route. He plans to keep about six of the rides and sell the others.

He also bought what he refers to as a dormitory, “not a bunkhouse,” from Gary Otterbacher’s Lifetime Products.

“I always preach to others that they should be in the OABA’s Circle of Excellence, and a purchase like this confirms that I practice what I preach. Each holds 10 people. They have flat-screen televisions, microwaves, refrigerators, individual closets, futons that can be rolled from sofas into beds, desks, air conditioning, and all the other state of the art amenities. I ordered it at the trade show in Gibtown and took delivery the end of August.” Gaylin likes it so well he’s ordering two more.

The ride gross at this year’s recordbreaking State Fair of Texas featured one of the strongest independent lineups in the country, and finished up a whopping 27 percent over last year, according to Rusty Fitzgerald, who has been vice president of concessions since 2001.

I received a nice note from Father John Vakulskas, who seems to be busier than ever. “Now that I am retired from active duty there is much more time available for me to do carnival ministry,” he said.

This summer he was making the rounds

in Minnesota, seeing John Magel (MCM Shows) at the Kandiyohi County Fair in Willmar, where they were relieved about dodging thunderstorms the night before his arrival, perhaps a miracle. His next visit was to the Mille Lacs County Fair in Princeton, where he had a nice visit with Barry Stipe of the Stipe Shows. “It was raining when I visited with Randy Forcier (Gopher State Expositions) at the Benton County Fair in Sauk Rapids. We recounted how different that visit was from the summer of 2014 when my classmate, now the Bishop of St. Cloud, Bishop Donald Kettler, joined me for a wonderful day on the midway, celebrating Mass and blessing the rides and games. He happens to live just down the street from there.”

Father John also stopped to see OABA Trustee Mike Featherston and his wife, Connie, of GoldStar Amusements at the Freeborn County Fair in Albert Lea. “He also had a unit at the Carver County Fair in Waconia, and after Albert Lea, played the Mower County Fair in Austin, which is the boyhood home of my good friend, Butch Butler, of many happy memories.”

Father John was at Showmen’s Rest in St. Louis to attend the Memorial Service for Shirley (Mrs. Ed) Murphy of Modern Motors, and visited OABA Director Debbie Powers and her husband, Les (Corky), of Powers Great American Midways at the Montgomery County Fair, Gaithersburg, MD. “This was also an opportunity for members of the United States Conference of Catholic Bishops committee on ministry to carnivals to be present, and witness part of my ministry. Mark Janas and Debbie were great in facilitating the hosting of these folks who were very positively impressed with my ministry and the good people in it. They enjoyed it even though one nun got sick on a Tilt A Whirl.

Valeria Schoendienst (1920 - 2015) Valeria H. Schoendienst, nee Wegmann, 95, of Belleville, IL, born March 10, 1920 in Damiansville, IL, died October 25, 2015 at Aviston Countryside Manor in Aviston, IL. Valeria was a devoted homemaker who was very involved in the lives of all of her family. She and her husband were founding members of St. Augustine of Canterbury Catholic Church in Belleville, where she was active in the Queenship of Mary Sodality, and volunteered at both the church and the school.

She was preceded in death by her husband, Andrew J. “Ducks” Schoendienst, whom she married on November 9, 1943, and who died June 16, 2007; her parents, Fred and Sophie, nee Rensing, Wegmann; a brother, Herman Wegmann; and two sisters, Margaret Imming and Sophie Kreitner.

Surviving are a son, Andrew (Lorelei) Schoendienst of Juno Beach, FL; two daughters, Janet (David) Billhartz of Fairview Heights, IL, and Susan (Michael) Schomber of Maryville, IL; six grandchildren; nine great-grandchildren; a sister-in-law, Lavita Schoendienst of St. Louis, MO; two brothers-in-law, Albert “Red” Schoendienst and Joseph (Irene) Schoendienst, both of St. Louis, MO; and numerous nieces and nephews.

Ethel A. Vivona Passes Away at 96

OABA’s Brenda Ruiz is Married!

Congratulations to OABA Manager of Programs and Services, Brenda Ruiz, on her marriage to Luis Rodriguez on October 24, 2015. The couple had an intimate wedding ceremony attended by immediate family members.

Ethel A. Vivona, wife of Morris Vivona, of West Caldwell, NJ passed away on November 2, 2015. She and Morris were married over 70 years and was a devoted wife, mother and grandmother to six grandchildren and six great-grandchildren.

She was born in Newark, NJ and raised in West Caldwell and had 13 brothers and sisters. She was a member of the Miami Showmen’s Association, Women’s Auxiliary and the National Showmen’s Association. A graduate of Woman’s Business College of Newark, in her younger years she worked for Public Service Electric and Gas and was a volunteer at Columbus Hospital for several years.

Ethel was the behind the scenes matriarch of the Vivona family and Amusements of America, being married to the senior Vivona brother. She loved the carnival business and her many friends in the amusement industry. H

Carnival Americana Bill Hames Shows Has Lost a Smile

C

hristmas won’t be the same this year.

Of all the many smiling faces at their annual Christmas party, one of the biggest kids of all with the biggest smile will be missing this year.

After a long summer on the road with the traveling carnival, Levi would settle down at winter quarters and dream of tomorrow. His dream of retiring and going on long ocean cruises was one of his passions. His other passion was the annual Christmas party at winter quarters. He was a fixture on the show and most people treated him like family. Many worked with him during the season and understood his quirky personality, often putting their hand out in support. It was obvious that his age and life on the road had taken a toll on his body.

Each year as the Christmas holiday approached, Levi would pitch in and help plan for the annual event. It was all about the children having a good time and making memories.

Perhaps, in a way, he lived vicariously through the children’s joy at this special time of the year. He probably dreamed of being a kid again and finding that same joy. His generosity

was abundant for a man with so little.

It was a pattern he had obviously practiced his entire life.

Traveling with a carnival can be exciting for the young or young at heart.

However, the seduction of seeing new places and meeting new people can grow old as the body grows old. Long hours and hard work can take its toll.

Levi was like so many “carnies,” worked hard, played hard and treasured his friends. As he grew older, his home was the bunk house and you had the feeling he liked it that way. Perhaps it was the hand full of good friends that helped make it a home.

He always had a story to tell or an adventure to share that sounded hilarious and maybe even was true! I’m sure he embellished quite a bit. Most of his friends claimed that he could make them laugh their heads off. He apparently had a dark side as well and a quick temper when aggravated. I never saw this and only knew of his generosity.

Last year shortly after Christmas, while crossing the street not far from winter quarters, Levi was hit and killed by a moving vehicle. Those who were at winter quarters heard the sirens and went rushing out to the scene. When they learned that it was Levi they were shook to the core. After all, he was family.

Some say you’re a lucky person if you have five good friends. Well, Levi Meyer was a lucky man. He had more than five real friends, and all kept an eye on him and miss him terribly.

Not much was known about his younger years, but it didn’t matter. You accepted Levi for who he was at that moment.

He was known for helping out those in need, often supplying them with personal items such as disposable razors and warm socks. This is common on most shows, people helping each other, but he seemed to pay attention to others. He was known for saying that he “didn’t like people,” but he sure could make them laugh!

The Christmas party this year at winter quarters won’t be the same. Perhaps Santa won’t be quite as jolly, but somehow Levi’s laughter will be remembered. It might be in the colorful decorations or the festively-wrapped presents that will stir the memory. Maybe it will be the decorated tree and all the children’s happy faces waiting in anticipation. All I know is that Levi will be missed, but he won’t be far away. Just close your eyes and be real quiet. Do you hear his laughter?

any have heard of the romantic notion of running away to join the circus; I have been fortunate enough to be born into the industry. My grandparents were the successful inventors and owners of the world famous Giant Slide.

Due to my grandparents’ success, I have been blessed to have traveled all around the world to experience the profession first-hand. At five, I could be found poking my blonde-haired pigtailed head just barely above the counter top of the ticket booth. I was allowed to sit on the ground of the wooden booth and rip the tickets to hand to the customers. Before I knew it, I was being seated in the big girl chairs managing the chaos of the crowds. What many people do not know is the carnival life is not all fun and games; the work can be painstakingly lengthy and the people dealt with on a day-to-day basis can be brutal.

At eight years old, the system went something like this: I took people’s orders at the concession booths, organized lines, gave and received change for admission. The year I turned twelve, it was my time to shine. Before I started high school I was trained in the actual mechanics of the financing and accounting that occurs in the back room of the business.

The motto is fast, fresh, and friendly. No matter how bad your body may ache and how far your patience may run out, you must compensate with your friendliness to achieve the costumers’ satisfaction. From the beginning I was told working hard is the only way to get where I want to be in life. In the Fair lifestyle I was brought up in, I was taught to grin and bare it. No matter how I felt, I had to agree with the angst-filled customer, and to get the tickets out the window in a timely manner.

This kind of hard-hitting labor has taught me the exemplification of a good work ethic, and how to treat all walks of life with respect. I have encountered the most generous and delightful people, but also I have combatted with customers who undermined my role in the business, considering me to be a naive child. I try to make my experiences with vulgar people as an example of how not to act. The life lessons I have been confronted with are invaluable; a person cannot receive these kinds of quality lessons without the involvement of firsthand interactions with diverse individuals. At the fair these occurrences are unavoidable; the diversity surrounding each city, state, and country are unique to one another. My eyes have been exposed to a new light of open-mindedness towards

actions or words that may be difficult or foreign to me. The lesson to be learned is that the rude costumer may be having a bad day, or maybe the stealing customer did not have the money to take in the full experience of the fair, and the assortment of customers must all be served.

Behind the scenes of the carnival lifestyle, incredible things have occurred. The ever-growing family of fair friends I have accumulated across the globe from Australia and back here in Minnesota are immeasurable. In fact, I had my first ride down the Giant Slide in Sydney, Australia when I was two weeks old.

These experiences have influenced me to this very day. People from different cultures have shared their homes and customs as I have shared my home experience with them. With each person is a new story, adventure or experience. I think of life like the Giant Slide; it has dips and thrills, but hopefully we come down with a smile – ready to get up at the bottom and tackle life again. All I know now as a senior in high school is that it is going to be an extraordinary ride. H

OABA Contribution Fund Program

THE OABA’S CONTRIBUTION FUND offers three different plans to meet your show’s contribution to the OABA and in turn rewards the show and concessionaires for these donations.

WHY SHOULD I PARTICIPATE? You will be given the opportunity to receive cash prizes for your contributions to this program and help the OABA protect the carnival industry.

WHAT IS IT? Fund-raising for the OABA has always been based on the generosity of its members and depends on members to pay their fair share, the theory being that the organization belongs to the members who raise relevant issues and in the belief that they will also underwrite activities. Support and participation of enough members will provide the revenue necessary to continue and improve on membership services.

HOW IS IT HANDLED? This OABA program advises member carnivals to collect funds from all office-owned and independent concessions and rides, side shows and arcades. When the show owner collects the money, they need to give or complete a receipt. The show or concessionaires then send the receipts to the OABA office, which will be eligible for monthly and annual incentive prizes.

Please note that it is important to include your phone number on your receipt, as we want to be able to contact you when you win!

WHAT IS THE MONEY USED FOR? The funds collected for this program are earmarked for legal, legislative and lobbying issues. Also, funds are used to continually upgrade member services.

CAN’T I JUST CONTRIBUTE? Sure, but then you lose out on the opportunity to participate in winning cash incentives.

SEND IT ALL IN! Funds are solicited and contributed in the name of the OABA. Once money is collected, please send it monthly to the OABA office in form of a check or money order. You may check ShowTime magazine where the contributions and monthly winners in each plan will be published monthly. H

DOT Regulatory News Congress Passes Threeweek Extension of Highway Program Facing a deadline for expiration of the highway, bridge and transit program, Congress passed a further extension this week through November 20, 2015 while it works on a longer-term reauthorization bill. The President signed the short-term extension into law on October 29, 2015.

The House of Representatives is expected to vote on a six-year, $325 billion highway reauthorization bill later this week. But like the Senate bill passed earlier this year, the House bill contains only three years of funding at the authorized program levels. Neither the House nor Senate has proposed any additional taxes or other sources of revenue to meet these additional infrastructure needs.

House Committee Approves Six-year Highway Bill The Transportation and Infrastructure committee of the U.S. House of Transportation has approved a bill to reauthorize the federal-aid highway, bridge and transit programs for another six years. The bill will now go to the full House of Representatives for a vote.

The Senate passed its version of a six-year reauthorization bill last summer.

Because the current authorization program expires on October 29, 2015, it is likely that the Congress will pass another short-term extension, perhaps for one or more months, to allow time for the

two chambers to agree on a longer-term bill.

As expected, the House legislation does not contain any provisions to increase funding to meet infrastructure funding needs. Highway taxes must be authorized from the House Ways and Means Committee.

The Motor Carrier Safety Title of the bill contains a number of provisions of interest to NPTC members, including a number of CSA and other regulatory reform provisions.

H The bill authorizes funds to create a grant program to train individuals to operate commercial motor vehicles, with priorities for training given to veterans of the armed forces.

H Whenever the Federal Motor Carrier Safety Administration considers a proposed or final rule, the agency’s regulatory impact analysis must consider the effect of the rule on different segments of the motor carrier industry, including small and large carriers.

H If a proposed rule would result in a major rule (more than $100 million in effect on regulated entities), the FMCSA must first issue an advance notice of proposed rulemaking or conduct a negotiated rulemaking with the affected parties.

H Every five years the FMCSA must issue an inventory of all of its regulations and assess whether the rules are consistent and clear, current with the operational realities of the motor carrier industry, and uniformly enforced; and also conduct

an assessment of whether the regulations continue to be necessary.

H The FMCSA must review all of its guidance documents to ensure they are current, are readily accessible to the public, and meet the standards specified in the bill.

H The FMCSA must commission the National Research Council to study the CSA Program and its Safety Measurement System to determine how the BASICs identify high risk carriers; and predict or are correlated with future crash risk, crash severity, and the methodology used to calculate BASIC percentiles and identify carriers for enforcement, including the weights assigned to particular violations and the tie between crash risk and specific regulatory violations. The study must also address the accuracy of safety data, including the use of crash data from crashes in which a motor carrier was free from fault.

H The FMCSA must also incorporate into the CSA program a methodology to allow recognition and an improved SMS score for the installation of advanced safety equipment, the use of enhanced driver fitness measures, and the adoption of fleet safety management tools, technologies, and programs.

H The bill prohibits making available to the public any analysis of violations, non-fault crashes, alerts, or the relative percentile for

each BASIC developed under the CSA program until the FMCSA files various reports with Congress and certifies various remedial changes to the CSA program. Also, the FMCSA may not use the BASICs data for safety fitness determinations until the DOT Inspector General certifies that the required program reforms are completed.

H An entity hiring a motor carrier may not be held liable for negligent selection or negligent retention of the carrier if the entity verifies with 35 days of pickup of the shipment that the carrier has FMCSA authority, the required amount of liability insurance, and a satisfactory safety rating.

H The FMCSA must explain to Congress why deadlines for the following rulemakings have not been met, and to establish new deadlines for their completion: national clearinghouse for drug and alcohol testing results; electronic logging devices; and entry-level driver training standards.

H The FMCSA must amend 49 CFR §393.60(e) to permanently allow the voluntary mounting on the inside of a vehicle’s windshield, within the area swept by windshield wipers, of vehicle safety technology, including lane departure warning systems, collision avoidance systems, on-board video event recording devices, and any other technology determined appropriate by the agency.

Thirty Minute Rule

O

ne item I would like to re-visit from a previous column from last year is the 30 minute rule. This is an hours of service rule which became effective in July 2013. Since many OABA drivers are not full-time truck drivers, there are still drivers and members out there who are not complying with this rule. The rule generates tickets, fines, and just as many CSA points as violating the 11 or 14 hour rule. So what is this rule, again?

A driver must take a 30 minute break on either Line 1 (off-duty), or Line 2 (sleeper berth) for every eight hours of duty. For example, I start my pre-trip inspection at 4 AM. At noon, I can no longer drive and must show at least 30 minutes in either the sleeper or off-duty. If I drive beyond noon without taking that 30 minute break, I am in violation. Local drivers not required to complete logbooks are not required to take the 30 minute breaks.

Some common errors I have seen regarding the 30 minute rule: 1) T aking the break on Line 4 (on-duty, not driving). You cannot take the break when you are loading, unloading, fueling the truck, or otherwise on-duty. Furthermore, if you are eating lunch or actually off-duty, make sure your break is logged on

Line 1: OFF-DUTY. If you log it improperly, DOT will not let you fix your mistake. While this may seem unfair, DOT is not concerned with fairness.

2) S plitting the 30 minutes. I have seen drivers take 15 minutes off-duty, then take another 15 minutes later in the day, and claim that is their break. Nice try, but the DOT does not accept splitting of the 30 minutes.

3) C ounting only driving time in calculating when the 30 minute break must be taken. For example, I start my shift by doing a 30 minute pre-trip inspection at 4 AM. I then drive eight consecutive hours until 12:30 PM. I am in violation. I should have stopped and taken my 30 minute break at noon, not 12:30.

4) N ot taking enough 30 minutes breaks. If you take your break early in the day, you may need another one before the end of your shift. For example, a driver does his pre-trip at 4 AM and drives for an hour, arriving at the receiver at 5 AM. He then is in the sleeper for two hours while at the receiver, exiting the sleeper at 7 AM. He then works and drives for the rest of his shift. By 3 PM he needs another 30 minute break.

Even though this driver already took a break from 5 AM – 7 AM, eight hours of duty has elapsed since the conclusion of his last break (7 AM – 3 PM). If he drives beyond 3 PM without another 30 minute break he is in violation.

The reason the 30 minute break rule is important is because DOT treats it just as importantly as the 11, 14, and 70 hour violations. If 30 minute violations are discovered, they create the same amount of CSA points as the other rules. Once the rule is understood, though, it is relatively easy to comply. The breaks must be taken as I described. More importantly, the breaks must be logged correctly on the logs. As long as the breaks show up in the proper places on the logs, no further questions will be asked.

CSA The rumor I have been hearing is that the CSA system will likely be removed from the internet in the near future. CSA is roundly hated by the industry as unfair and not related to safety.

The industry is close to getting enough votes in Congress to have CSA removed from the public view. Undoubtedly, DOT will still use the CSA methodology internally to determine who gets audited. Nothing is certain at this point. A Legislative Fix to Boost Seasonal Labor

E

very year, thousands of seasonal employers struggle to find an adequate workforce to meet their employment demands during peak periods. As a result, many employers turn to foreign workers to fill these temporary positions.

Under current immigration law, the H-2B visa program is specifically designed to assist these employers by providing temporary visas for foreign workers who assist with seasonal workloads. By all accounts, this program works fairly well, and is popular with both employers and seasonal foreign workers.

In fact, it might be a little too popular. As currently administered, the program’s annual cap of 66,000 H-2B visas is inadequate and often reached in the first few months of the year, leaving many employers out in the cold and scrambling to find workers during peak periods.

The demand is rooted in the sheer number of industries that rely on seasonal help. Seasonal industries range from hospitality and the mobile amusement industry to forestry and landscaping to horse training and swimming pool maintenance, just to name a few.

The more the economy, and these industries in particular, grow, the more seasonal employees are needed to keep pace.

As a result, employers in these industries require far more temporary employees than the H-2B program permits.

As Chairman of the House Small Business Committee, I have heard from numerous employers, as well as the OABA, about the burdens they face when dealing with the H-2B program. One of the most significant problems they must overcome is the uncertainty created by the limited availability of visas under the program. Because there is a far greater demand for seasonal workers than there are actual visas available, employers can never be sure that a visa will be renewed from one year to the next. Nor can they know how many slots they might receive in any given year.

This uncertainty can make seasonal preparation nearly impossible and force businesses, at times, to delay growth or expansion.

But that’s not the only problem created by the relatively low cap on H-2B visas. When there are more available jobs than visa slots, entering our borders illegally can become an enticing option for many seasonal workers. This is a problem not only for the government and law enforcement, but for employers as well, particularly as efforts to cheat the system become more complex and sophisticated.

Our laws shouldn’t be written in such a way as to encourage illegal immigration. Instead, we should make it easier for foreign workers to follow our laws by increasing the availability of H-2B visas, particularly for those who have demonstrated their willingness to play by the rules.

I recently introduced legislation in the House to do just

that by adjusting the way seasonal workers are calculated under the H-2B cap. Specifically, my legislation, the Strengthen Employment And Seasonal Opportunities Now (or SEASON) Act, will increase the availability of H-2B visas by not counting a foreign worker receiving an H-2B visa for a given year against that year’s cap if that worker received a visa in any of the three prior years. Rather than just indiscriminately raising the H-2B cap, this approach places the emphasis on encouraging successful participants to return to the program.

These workers have already participated in the program, adhered to its rules and returned to their home countries following the conclusion of their employer’s peak season. And for seasonal employers, they have proven to be reliable and trustworthy employees. Perhaps most importantly, if foreign workers receiving H-2B visas know that abiding by the rules of the program increases their likelihood of receiving a future visa, they are less likely to attempt to circumvent the law by overstaying a visa or entering the country illegally.

The SEASON Act also streamlines the program by removing the Department of Labor from the regulatory process. Instead, the program will be administered solely by the Department of Homeland Security, the agency charged with immigration enforcement. Employers will still need to certify compliance with program rules and regulations, but they will only have to answer to one government agency. As it is now, employers are often bogged down in bureaucratic red-tape, routinely receiving conflicting answers from different agencies.

Ultimately, by increasing the availability of seasonal work visas and streamlining oversight of the H-2B program, these common-sense reforms will make it easier for employers to meet the demands of the growing economy while encouraging seasonal workers to follow our laws and play by the rules. H

H

oliday Season is a season when circus folks spend time with family and friends instead of entertaining the rest of us. However, there are always

exceptions.

Most noticeable are the December performances of the two units of Ringling Bros. and Barnum and Bailey.

Circus Xtreme closes out its first-year tour in Indianapolis (IN) on December 6 before taking its traditional break between seasons. But as noted in last month’s column, Feld Entertainment has postponed its “winter quarters” until next spring, meaning that Legends will continue to play dates during December, including Christmas in Little Rock (AK), before finishing out the month in Huntsville (AL).

As for holiday shows, Cirque Musica’s Holiday Spectacular, produced by TCG Entertainment, undertakes a month-long, coast-to-coast tour presenting its unique circus/ symphonic production in nine cities from Alberta (BC) and Walla Walla (WA) to Raleigh (NC) and Atlanta (GA). Cirque Dreams, a touring holiday show produced by Neil Goldberg, kicks off December in Scranton (PA) and makes 19 one- and/ or two-day appearances across the country (including dates in Iowa and North Dakota) before closing on December 30 back in Pittsburgh (PA). Sarasota’s Sailor Circus presents its annual Holiday Show in its Circus Arena December 26–29.

Big Apple Circus is receiving strong media reviews for The Grand Tour. Directed by Mark Lonergan and created

by Joel Jeske, the show is set in the 1920s and features early 20th-century modes of transportation. New York Times critic Alexis Soloskioct called The Grand Tour a “lively and smartly paced” production that is “friendly, beguiling and emphatically humane, from the smallest poodle to the tallest stilt walker.”

Huffington Post’s Regina Weinreich dubbed the show “a trip” with “sensitive animal acts, including horses, ponies, and dogs, led by Jenny Vidbel.” The Grand Tour appears at the Lincoln Center through January 10.

After creating and previewing his “first-ever cabaret show” at the Showfolks Club in Sarasota (FL), Big Apple Circus founder Paul Binder presents “Paul Binder Risks His Life!” at The Metropolitan Room in New York City on December 5. Sharing the stage with singers Lainie Cooke and Bradley Jones and accompanied by Dennis Buck on the piano, the show is a benefit performance for BAC’s youth-oriented programs, including Clown Care, Circus for the Senses and Circus After School.

This quarter’s edition features the 75th birthday celebration of nouveau cirque pioneer Hovey Burgess, staged by New York City’s Bindlestiff Family CirKus. Circus World Museum in Baraboo (WI) made art world news when it unveiled an 1847 oil portrait of P.T. Barnum painted by 19th-century artist Frederick R. Spencer. Known to be one of the earliest portraits of America’s famed “huckster,” the painting was in disrepair when it was donated to the museum in 1987. A lack of funding prevented its restoration for years, but then Chicago-based art conservator Barry Bauman offered to perform the restoration for reimbursement of materials only. Bauman described the painting as “the worstlooking painting” he had ever seen, but admitted that it gave him “the most fun I’ve had in my career.”

In unrelated quasi-museum news, former Ringling Ringmaster Eric Michael Gillett portrayed an art museum curator in a recent episode of NBC-TV’s The Mysteries of Laura starring Debra Messing.

Congratulations to “Queen of the Air” Dolly Jacobs who was honored with a 2015 National Heritage Fellowship Award presented by the National Endowment of the Arts.

Dolly performed her classic aerial routine at the NEA National Heritage Fellowships Concert in the Lisner Auditorium on the campus of George Washington University in Washington, DC. Dolly was also awarded the 2015 Award for Artistic Achievement, presented by the Arts and Cultural Alliance of Sarasota (FL) County, along with the Perfect Pitch Award from Sarasota’s Key Chorale.

With so much negative press we encounter today concerning performing animals in the circus, it is heartening when a mainstream media outlet, such as CNN Money, presents an unbiased and honest presentation of life in the circus for big cats.

Huntsman Cancer Institute, University of Utah School of Medicine and Primary Children’s Hospital (PCH), has been studying the elephants at the Ringling Bros. and Barnum & Bailey Circus’ Center for Elephant Conservation to better understand why elephants appear relatively resistant to cancer, and how those findings may apply to humans. Dr. Schiffman recently published his findings in the Journal of American Medical Association (JAMA). CEC’s Dr. Dennis Schmitt and Dr. Wendy Kiso co-authored the paper. Additionally, Ringling Bros. has pledged $1 million for pediatric cancer research, and will donate $10,000 to a local children’s hospital or treatment center in cities along its itinerary. Ringling Bros. Children’s Fund will also match each $10,000 donation to the PCH’s Foundation.

In an action that surprised both sides in the so-called performing animal debate, California Governor Jerry Brown vetoed Senate Bill 716 that would have banned the use of the ankus as a legitimate elephant management tool throughout the entire state of California. SB 716 was among nine bills vetoed by the governor. His reasoning: the bill (among others) “creates a new crime — usually by finding a novel way to characterize and criminalize conduct that is already proscribed.” In other words, there are already sufficient laws on the books that protect animals in our custody, and no further ones are needed in California. Thanks to Gov. Brown, and kudos to all who worked hard to defeat this reckless bill! H
