CBFC(Central Board of Film Certification) Film certification is handled by CBFC in INDIA● CBFC is a statutory body which comes under the ministry of information and broadcasting to regulate the public exhibition of films under the provisions of Cinematograph Act 1952. ● People of India can watch films only after getting approval from CBFC.

When CBF certificate started● In 1920, the Cinematography act had been passed in India which created censor boards only in a few cities, all were autonomous. ● After the abolition of the regional board’s autonomy when India became independent and then they came under the inspection of the Bombay Board Of Film Censors. ● Later this was reconstituted as Central Board Of Film Censors and Central Board of Film certification in 1952 and 1983 respectively.

Why is this necessary to get CBFC(Central Board Of Film Certification): In the earliest judgement of Apex Court which came into the public in 1989 was that, “Film research is the necessity for the public welfare because through filmmaker’s projects people can influence in their personal lifestyle so that it is necessary to skip or cut all the disturbing ideas from their projects so that our sovereignty, integrity, peace and public health can be maintained.”

Certification process for CBFCIn Current, films are classified under four categories such as● Unrestricted Public Exhibition for the term- ‘U’ ● Unrestricted Public Exhibition but under some conditions as parental circumspection required for children who are below the age of 12 years stands for the term- ‘U/A’ ● Restricted to adult which is stands for the term- ‘A’ ● Restricted to any special class of person which is stands for term- ‘S’

Provision for censorship: ● Government can take our freedom by law on the basis of reasonable restrictions of Article 19(2) upon the freedom of speech and expression in the interest of the sovereignty and integrity of India, the security of state, friendly relations with foreign states, public order, decency or morality or in relation to contempt of court, defamation or incitement to an offence. ● And similar provision is also provided in the Cinematograph Act, 1952 as stated in article 19(2).

Complete certification Process-

The cinematograph (certification) Regulations, 1983 set out the procedure for the producer to go through to make his film validated, clearly stating the process and fees and charges. Everything the process is summarized as follows:

● One should have to submit all the material whatever is required for this process to the regional officer of the concerned regional center. ● To inspect the project, the regional office will form an examining committee. The structure of this committee will be as follows, ○ There will be an officer of the CBFC and one will be from the advisory committee either of whom shall be women, when this is related to short films.

○ And if this is related to quite lengthy duration of film or feature film, then there will be four advisory members two of which will be women; those all will be an officer of the CBFC. ● Then there will be written recommendations from all of the members about what should be deleted and what should be modified and all kinds of recommendations would be considered so that there will be no violation of law. ● After the above procedure, for the next initiation process the chairperson will ask the regional officer. ● In some cases there is a chance to preview projects again then there will be a committee again. But in the second formed committee there will be no one who attended before. ● And there will be no change in film in the second round. ● Every person should have to record their verdict before leaving the theatre. ● And there is also a chance to review the movie again, it is not necessary that there will be only two meetings or one meeting for reviewing the movie. ● After the applicant has been notified of the board’s decision, it will remove any parts (if directed) and submit them to the regional officer, together with one certified copy of the film. ● Before any order affecting a film applicant is approved by the board, he or she is given an opportunity to express his or her views on the matter before the EC/RC. ● If the matter is referred to section 5C of the 1952 Act to the Film.

Certification Appellate tribunal headed by a retired judge as chairman and

not more than four members FCAT may hear both the applicant and the CBFC before coming to court.
