REBUTTAL TO MARCH 1, 2018 GAZETTE ARTICLE “PECATONICA TOWNSHIP LOOKING TO MAKE CHANGES” written and paid for by Rogene Hamilton because the Gazette gave me only the option of a 400 word letter to the editor instead of a chance to rebut

Pecatonica Township Supervisor Joe Musso’s description of me as the “Assessor’s Wife” is sexist, chauvinistic and sounds like a Victorian romance novel. While I am proud to be Scott Hamilton’s wife, I do not expected to be defined by his profession. Is the eviction of the multi-township assessor being pursued because of the Assessor’s Wife?

According to the Gazette, and quoting a report released by Musso, the problem started when (three people) “berated our Township Attorney” • A Former Trustee (FT) and I addressed the board • The township attorney was not a board member thus not responsible for hiring an outside • Our comments were not about or directed at the township attorney attorney • The FT and I addressed the board about the appointment without board approval, the high • The Former Supervisor (FS) did not even speak cost, and to please consider more carefully in the future when spending that kind of money There is a long paragraph in the March 1, 2018 Gazette article about the 2017 candidacy petition challenge • I believe that was included to imply that I was involved in that issue • I do not even know the challenger • I was not involved in the candidacy petition challenge • The case was finished on Jan. 3, 2017 - long before I spoke in February 2017 The next paragraph states “The citizen-taxpayer requested that reference to the comments be removed from the minutes.”

• I am the citizen-taxpayer mentioned • There were no references to the candidacy petition challenge that I made or that I asked to be removed And next, “Trustees, by a majority vote, did not take action on removing the citizen’s name or reference. The minutes from the meeting in question were subsequently approved and placed on file.” This is an example of misleading information • The trustee majority vote was in April to approve March minutes • The March minutes were not read at the April meeting but were approved • The trustee majority vote was not to address the request I made in May • In April I was informed of the defamatory statement in the March minutes • I addressed the board in February 2017 and didn’t attend March or April • In May 2017, I requested my name and the false accusation be removed • In March 2017 the FS asked if (the township attorney) had quit • The May 2017 minutes state: “Supervisor Musso assured Rogene that he did • FS was told that because of attacks by 2 members of the public and a trustee he quit not mention any names and her name would be removed from the March • However, March minutes say: “…. answered in the affirmative. (he) had been the minutes.”

• The board took no action on the issue so I returned in June legal consultant free of charge for the board but decided after the attacks by FT • In June I started video-recording every Pecatonica Township meeting and Rogene Hamilton, he no longer desired to offer his services.”

As far as any correction or vote on my request made in May: • It was on the agenda in July but tabled until August per attorney advice • It did not get on the August agenda and has never been brought for a discussion and vote It doesn’t really matter because at practically every meeting now, a township official brings up that FS, FT and Rogene Hamilton are the reason the township lost their “free” attorney, or that FS’s “group” is responsible. It continues despite one trustee who has said, “I don’t remember it that way” and who has also said in disgust, “Yeah, you tell us that at every meeting.” This is all on video of the meetings.

The only references in the Gazette article to the previous township attorney are that he was “berated” and that “the last attorney left” • There is no official mention of his resignation in any minutes • To this day we do not know why he left • There has not been a letter of resignation to the township board • The only mention that he quit was a response from a township official to a question • He has not addressed the board to tender his resignation from the audience When I addressed the board in June 2017 I said, “I hope I won’t need to file a complaint…… (and) I need assurance tonight that this board is serious about compliance with the OMA (Open Meeting Act).…” This is all on video. Despite fair warning, they made no effort to assure me that they wanted to be in compliance with the OMA. At that June 2017 meeting a township official again violated the OMA in the time he allowed me for public comment saying “I can give 5, I can give 3. I give 3.” in spite of a 5 minute rule on the books from October 2012. Disgusted, I went home and filed my first OMA Request for Review with the Attorney General (AG).

In Chris Johnson’s article Musso talks about problems “costing the taxpayers a lot of money”, the expense being “unavoidable” and the need to “accommodate the current situation”. He implies it is because the free township attorney quit. No Freedom of Information Act (FOIA) requests for review or Open Meeting Act (OMA) requests for review were filed with the AG until after the new attorney was appointed (by a 3-2 vote). I dispute that most of these attorney fees are “unavoidable”. Let’s review some of those fees.

1. Two bills submitted show a total of $630 for letters, phone calls, conferences, review and research regarding FOIA requests, FOIA and OMA complaints filed with the AG. These requests began in July 2017 and the first official offer of documents was February 19, 2018. I prevailed on all FOIA requests for review and the township was admonished by the AG to give me the records. I now have most but not all the information. This money was spent to keep me from seeing the records which begs the question- why?

2. A bill for $75 for a letter to me regarding a FOIA request which stated “Your request is denied. Pecatonica Township has no checkbook, checkbook registers.” Of course they have checkbooks and registers and eventually I got the information. Why such deceit, effort and expense to prevent release of information that any one of us is entitled to see?

3. A bill for $105 for another letter to me which said they weren’t going to fix the false statement in the August minutes. The board needed an attorney to say that??

Because of repeated inaccuracies in board minutes, I had suggested that the township get a tape recorder. This letter also stated that my actions “are an example of reasons that the smaller townships do not record their meetings.” Huh..really? Seems it would be just the opposite!

4. There was a bill to prepare a resolution for the mandated Sexual Harassment Policy for $75. That resolution is available for free on the Township of Illinois (TOI) website.

5. There was a bill for preparation of ordinances and resolutions for the December 2017 meeting for $375. For one thing, the board should insist on precise itemization and not accept that blanket notation. One, the ordinance for reimbursement of travel, meal and lodging expenses is available for free on the (TOI) website. The resolution to dissolve the veteran flag program from the township should have been created by the supervisor and clerk instead of paying the attorney to do it. And finally, the resolution to ban me from speaking for 3 months. This was not at the direction of the board, so who authorized or directed the attorney to do this? It was defeated 3 - 2 so it was a waste of money anyway.

6. There are two bills, $75 each to prepare two monthly agendas. The township may say there was no sitting township clerk at that time. How about the secretary? She has sent letters to me on the township’s behalf. What about the board? If no trustee can use a typewriter or computer how about this….handwrite it! It is an outline of the business to be conducted. How hard is that?

7. A bill for $120 to research the requirement of recording equipment at meetings. Those rules are in the township code and the FS recently brought each of the board members a new handbook. There is also a more detailed rulebook in the office. Look it up!

8. There is a bill for $125 for a substitute attorney to sit at the February 2018 meeting. The ordinance to hire the current attorney says “2. Attorney John M. Nelson shall be compensated as follows: a. A flat fee of $125.00 for attendance at any Pecatonica Township Board of Trustees meeting.” It doesn’t mention paying for a substitute.

9. And finally, a bill for $112.50 to research issues involving evicting the multi-township assessor. Do our peer townships - those with similar demographics such as Seward, Burritt, Durand, Laona, Winnebago, Owen, Shirland, Harrison - have an attorney at every meeting? The Gazette article goes on to say that after “more than a decade of letting the joint Township Assessor pay $100 per month for utilities, It’s Seward Township’s turn to step up to the plate.” This was deceitfully worded to provoke your indignation and to drive a wedge between Seward and Pecatonica citizens. The multi-township assessor does not pay that $100. The Pecatonica and Seward township taxpayers pay that $100. Seward isn’t putting one over on Pecatonica - we are all in it together. Citizens are urged to “bring their concerns to Trustees and the Supervisor’s attention at any time, including during open meetings during the Community Voices segment at the start of each meeting.” He didn’t say that if you plan to come and speak, the new resolution requires you to sign up no later than 15 minutes before the meeting. If you try to sign up at 6:45:01 you won’t be allowed to speak. Some of the issues that I have raised so far but have been ignored are: • for minutes to be read aloud before being approved • to reconfigure seating so the public can hear and not address the board to their backs • for trustees to get bills and information a couple of days before the meetings so they can thoroughly review • for the board to record their meetings • for authorized bills to be included in the minutes what they are authorizing I have not filed an OMA request for review for some time despite continued discrimination against me. In October, (a woman) spoke for 13 minutes and 19 seconds.

She was not interrupted. In November I was escorted out by the police after only 9 minutes. The township supervisor’s justification was that he wanted to hear what (the woman) had to say.

The following are verbatim comments made at the October Pecatonica Township meeting (all on video), showing behavior that is now typical at township board meetings: • I can’t seem to trust a few people who come into the office • I won’t say we didn’t do it properly but somebody • they still griped • because somebody wrote down to the attorney general higher up said we didn’t do it properly • some people are griping and said there was something wrong • we lost a lawyer because some people were very rude • certain people they griped • certain people griped • somebody wrote a letter to the attorney general • somebody griped • somebody downstate says there is another technicality • certain people are griping And this is from only one meeting.
