DuPage County state’s attorney Berlin finds officer justified in Villa Park officer-involved shooting “Come over here.”

As Bailey approached Sergeant Pagan with the gun in his hand, Sergeant Pagan again yelled, “drop the gun, drop the gun, drop the gun.”

Haven Bailey chose to ignore those lawful commands and instead began to raise his arm with gun in hand at Sergeant Pagan. Sergeant Pagan fired his gun four times at Bailey at this point.

Paramedics from the Villa Park Fire Department responded to the scene and transported Haven Bailey to Good Samaritan Hospital where, despite the efforts of emergency room personnel, Haven Bailey was pronounced dead at 4:29 a.m.

When processing the scene, authorities recovered a black CO2 pellet-style gun with “SigSauer 1911” written upon it. Additionally, a DNA sample taken from the CO2 pellet-style gun matched the DNA profile of Haven Bailey.

The above facts have been evaluated in the context of Illinois law governing the justifiable use of deadly force. In accordance with Illinois law, my staff and I have reviewed the facts and circumstances of the case with special consideration given to the perspective of the officer on the scene. It is important to remember that police officers are often forced to make split-second decisions about the appropriate amount of force necessary to bring a tense, uncertain and rapidly evolving situation under control.

An investigation into the shooting conducted by the DuPage Metropolitan Emergency Response and Investigation Team (MERIT) found that

Bailey was walking straight toward Sergeant Pagan, armed with a gun and closing distance on him.

At this time Sergeant Pagan thought Bailey was going to shoot him. Sergeant Pagan stated, “The man was coming straight for me.

I thought he was going to kill me.”

Sergeant Pagan decided to fire his gun when Bailey got too close to him, stating, “if I had not fired my weapon at that point, I thought I was going to get shot.”

After shooting the person, Ser-

geant Pagan saw Bailey fall and saw the gun fall to Bailey’s side. The investigation also found that as Sergeant Pagan attended to Bailey, he asked Bailey why he did not drop the

Editor’s note: On Monday, DuPage County State’s Attorney Robert Berlin issued the following statements regarding the fatal shooting in May of Haven A. Bailey in Villa Park that involved a Villa Park police officer.

Every case involving the use of deadly force by a police officer must be carefully and thoroughly investigated. Such scrutiny is required to ensure the protection of the civil rights of those involved and to maintain the public’s confidence in law enforcement.

After a thorough and extensive investigation surrounding the shooting of Haven Bailey by a Villa Park police officer, it is my determination that the officer, Sgt. Jose Pagan, who discharged his weapon four times, striking Haven Bailey four times, once in the right chest and three times in the abdomen, was legally justified in his actions and that no criminal charges will be filed against Sergeant Pagan.

In reaching this conclusion, my staff and I carefully reviewed the applicable law and thoroughly examined all the evidence, including but not limited to: • Police reports • Statements from those involved • Witness accounts • Physical evidence • Photographs • In-car squad videos • 9-1-1 calls • Cellular phone data On May 24, at approximately 2:06 a.m., a person, later determined to be Haven Bailey called 911 and reported “261 Kenilworth, somebody walking around with a gun.”

The DuComm operator asked Bailey to describe the person with a gun, and Bailey stated, “White, they’re in a suit and tie, pretty much looks like it.” The DuComm operator asked Bailey to describe the gun and Bailey responded, “Looks like a pistol, I’m not sure.” Bailey then stated, “They already drew it, they pulled it out of their pants, I already saw it.” It appeared that Bailey then left the conversation but did not hang up.

Multiple Villa Park units, including Sergeant Pagan responded to the call.

Sergeant Pagan and another officer were the first officers to arrive on the scene. As the other officer started to walk toward the house, he heard what he believed was a fence or door swing open near the front of the residence and observed a person, later determined to be Haven Bailey, standing to the east side of the front of the residence.

Both Sergeant Pagan and the other officer observed a black handgun, later determined to be a CO2 pellet-style gun, in Bailey’s right hand.

Both Sergeant Pagan and the other officer gave loud and clear commands to Bailey to put the gun down including “drop the gun,” “please put the gun down, please put the gun down,” and “drop the gun please.”

Despite their commands, Bailey did not drop the gun.

At one point in time, Sergeant Pagan attempted to de-escalate the situation by saying to Bailey, “What’s your name Bud, what’s going on with you?” Sergeant Pagan then said,

The Villa Park Fire Department’s newest lieutenant

Frank Reposh, who joined the Villa Park Fire Department nearly 16 years ago, officially attained the rank of lieutenant earlier this month. Surrounded by his family and his colleagues, Reposh was honored with a badge-pinning ceremony at the start of the Villa Park Village Board meeting on Aug. 9. Reposh, who grew up in Oakbrook Terrace, attended Albright Middle School and Willowbrook High School. He joined the Villa Park Fire Department as a firefighter/paramedic in October 2005. As a member of Villa Park’s Fire Investigation Unit and the DuPage County Fire Investigation Task Force, Reposh has participated in numerous fire investigations. He and his wife Caryn have a son—Nate (age 9)—and a daughter—Eleanor (age 8). Reposh is one of six lieutenants with the Villa Park Fire Department. The latest opening at that position became available after Lt. John Rzeszut, who spent 25 years with the department, retired in late July. Reposh is pictured on Saturday, Aug. 14, at Station 82, located at 102 W. Plymouth St.

Also on hand was Bruce Bronge, president of ICI Construction, the firm that built the building.

“It was a fantastic turnout. We had tons of clients come, which was extremely wonderful,” Nerko said after the event. “The whole city came out,

the aldermen and other officials. Honestly, we were so excited to be a part of Oakbrook Terrace. We’ve been waiting a long time for this to happen.”

Nerko said the bank was looking forward to getting involved in the community.

“We’ve joined the local Chamber of Commerce and we belong to MORE [a real estate organization] as well,” she said. “We’re still getting our feet wet, but we’re getting to know the community. We are arranging to meet and greet our business neighbors, introducing ourselves. Lakeside is a work in progress.”

Nerko said commercial real estate is their specialty.

“Our bread and butter is commercial real estate, but we can handle any kind of loan a customer may need,” she said. “We can beat the competition.”

Cullerton calls for National Guard troops to be compensated As chair of the State Senate Veterans’ Affairs Committee, state Sen. Tom Cullerton (D-Villa Park) is calling on the U.S. Congress to repay debt owed to the National Guard for their service providing security to the U.S. Capitol in the wake of the Jan. 6 riots.

“The riots at our nation’s capital were a scary time for many,” Cullerton said. “Hundreds of men and women from Illinois were sent with the National Guard to assist in the aftermath of those riots, putting their safety on the line to protect the Capitol. It is only fair for them to be fully compensated for their duties.”

With expenses from the Washington D.C. mission still outstanding, the National Guard is facing devastating prospects if this funding is not immediately repaid, including a reduction in exercises, weekend training and potential furloughs,

placing a significant financial burden on individual members of the guard, putting their monthly drill checks and insurance payments in jeopardy.

“These soldiers put their lives on hold including jobs, schooling and time with their families to support the needs of our country,” Cullerton said. “I urge Congress to act as quickly as possible to address this debt and prevent any further burdens on our Illinois National Guard.”

Over 25,000 Guard troops answered the call in January to protect the Capitol following the Jan. 6 riots. Thousands remained in Washington, D.C., until the end of May to provide support to local law enforcement and ensure the safety of the nation’s capital city.

UH-1 ‘Huey’ helicopter returns to Cantigny

Vietnam-era chopper on outdoor exhibit through September

The First Division Museum at Cantigny Park plans to exhibit its UH-1 helicopter, an iconic symbol of the Vietnam War, beginning Wednesday, Sept. 1. The prized macro-artifact will be interpreted outdoors at Cantigny for one month.

The Bell UH-1 Iroquois helicopter, or “Huey,” was the workhorse for Army assault units in Vietnam. Its body style and rotor sound made it one of the most recognized aircraft in the world. The UH-1 was the first turbine powered helicopter to enter production for the U.S. military and entered service in 1959.

Different configurations of the UH-1 were deployed in Vietnam in a variety of roles, including troop transport, air assault, command and control, and evacuation of the wounded. With its flexibility and speed, the ubiquitous Huey transformed modern warfare, allowing commanders to place combat troops at almost any point on the battlefield, engage the enemy and quickly extract soldiers upon mission completion.

On Friday, Sept. 24 at 6 p.m., museum educators will conduct a family program, “Masters of Flight: The Nature of the Huey,” with demonstrations and activities for all ages. The program is free, but registration is required; visit fdmuseum.org or call 630-260-8162.

Also in September, the First Division Museum will exhibit and interpret pieces from its historic military vehicle fleet every Thursday, from 1 to 3 p.m., weather permitting. Exhibit dates are the Thursdays of Sept. 2, 9, 16, 23 and 30.

The First Division Museum is open Tuesday through Sunday, from 10 a.m. to 5 p.m., with extended hours until 8 p.m. on Wednesdays.

The crime wave in Chicago is more of an emergency than COVID-19. *** I’m tired of seeing Allison Arwady, Ngozi Ezike, Lightfoot, Pritzker and the other authoritarians in this state standing in front of TV cameras and issuing their warnings, threats, mandates and executive orders with regard to COVID-19. We’re all in this together? OK, then. Let’s see them wear masks for several hours every school day like they’re forcing the children and teachers to do. Let’s see them put their six-figure salaries where their mouths are and take a pay cut, just like I’ve had to do, and many employees and business owners have had to do over the last 18 months.

Tech-savvy teens and young adults falling for online scams at a higher rate than seniors Victims 20 and younger grew by 156 percent from 2017 to 2020 compared to 112 percent for seniors. The 9,053 young victims in 2017 jumped to 23,186 last year.

Seniors remain by far the most victimized group overall with 105,301 victims losing $966 million in 2020, but the surge of Gen Z victims is unprecedented and speaks to the growing sophistication of scammers.

SocialCatfish.com released a study on the State of Internet Scams 2021 using 2021 data from the FBI, IC3 and FTC. Overall a record $4.2 billion was lost to online scams in 2020 and Illinois was the No. 6 most-scammed state.

Parents and young people should remain vigilant when they shop, date, work, or socialize online.

Here are five common scams targeting teens and young adults in 2021: Job scams: The pandemic made it difficult for young people to find work. Scammers capitalized on this by dangling fake jobs that can be done remotely with high pay. They post on job sites and then request advanced payment for training. They ask for

personal information during the “application process” and use it to drain your bank and commit identity theft.

How to avoid: Be wary of any job that seems too good to be true or asks you for payment prior to beginning.

Never provide information or bank accounts until you’ve investigated the company thoroughly.

Instagram influencer scam: Teens and young adults worship their favorite influencers. Scammers will create fake accounts that look just like the actual influencers account. They host a fake brand-sponsored contest and ask the “winner” to pay a fee or provide their bank account to win the prize.

How to avoid: Never send money or bank information to anyone you do not know.

Romance scams: Also known as catfishing, this is when scammers steal photos of good-looking people and target young, vulnerable people online. They make the victim fall in love and begin asking for money.

How to avoid: Never give money to anyone you meet online. If they will not video chat or meet, they are a scammer.

Sextortion scams: The advent of

smartphones led to sexting, which has now led to sextortion. Scammers pose as an attractive person on OnlyFans or Snapchat, hooks the target and moves the conversation over to text.

They send an explicit image and ask for one in return.

Once received, they reveal themselves to be scammers and threaten to send the photo to all contacts in the person’s phone and post the picture on the Internet.

How to avoid: Avoid sending explicit images online or by phone. If the person you are falling for will not meet or video chat think twice before sending anything.

Online shopping: Fake websites are created that look like an online store selling items at a huge discount.

If you buy, the item never arrives, they pocket the money and steal your credit card and personal information for future online theft.

How to avoid: Make sure the website is not full of typos. If the “customer service” email is “gmail.com” or “yahoo.com” that is a red flag. Research the company.

If you are the victim of a scam or attempted scam report it to the FTC, IC3, FBI, and IdentityTheft.gov.

Bill to make suicide prevention information available signed into law State Sen. Tom Cullerton (D-Villa Park) championed a measure that would ensure suicide prevention information is readily available to college students, which was signed into law on Friday, Aug. 13.

“College-aged students have some of the highest rates of suicide in the nation,” Cullerton said. “Providing these resources on a readily available card that students will be carrying with them all the time is a simple way to make them aware

that help is out there.”

The measure would require any public institution of higher education that issues student ID cards to publish contact information for the National Suicide Prevention Lifeline and the Crisis Text Line on the back of each card, as well on their website.

Cullerton sponsored similar legislation this year, House Bill 1778, which would require school districts as well as universities to sup-

ply this information on ID cards.

Between 2007 and 2018, suicide rates for people aged 10-24 increased by 57.4 percent, according to the CDC. Additionally, a CDC survey taken in June 2020 found that one in four young people aged 18-24 reported seriously considering suicide over the 30-day period.

The legislation, Senate Bill 2014, was signed by Gov. JB Pritzker and is effective July 1, 2022.

Edgar Fellows: Followers or leaders?

By Jim Nowlan Former Gov. Jim Edgar has created a program that might be the last great hope for struggling Illinois, yet his Edgar Fellows Program has yet to prove its potential.

I propose that the nearly 400 Fellows take on the task, never before tried, of building a strong future for Illinois. The challenge could determine if these young politicos are leaders or followers.

Annually over the past decade, Jim Edgar has gathered 40 of our state’s best and brightest in Urbana for an intensive week of policy seminars with top national figures and experts.

Maybe even more valuable, there is important after-hours social bonding among young men and women across both parties and all regions of the state.

The Fellows, mostly young legislators or wannabes, feel good about themselves for having been selected, and for rubbing shoulders with biggies, but are they really going to become transformational leaders?

After all, most elected officials are, by the nature of the democratic process, followers not leaders. That is, they have to be elected and re-elected—fail to reflect the often-shortsighted wishes of their constituencies, and they might find themselves out of office.

Indeed, four of our greatest Illinois governors never bothered to serve in the Legislature, and they lasted only one term each— leadership has its costs. Thomas Ford (1842-1846) ensured that the state pay off massive debt; John Peter Altgeld (1893-1897) championed higher education and pardoned, hugely unpopular of him, anarchists who had been railroaded toward the gallows; Frank Lowden (1917-1921) modernized state government, and Richard B. Ogilvie (!969-73) enacted an income tax.

So, are today’s up-and-comers

more interested in making careers out of partisan politics, or in making a difference, damn the consequences?

After all, Illinois should be an economic dynamo. As I keep quoting successful friend Jim Schultz of Effingham, in each of the five R’s critical to economic development—rails, roads, runways, rivers and routers— Illinois ranks among the top three American states. And we are located right in the middle of the world’s largest market!

Yet, Illinois is “the sick man” of Midwestern states, the only one losing population. Shame on our “leaders.”

Our problems are fixable: fiscal instability and debt; an unbalanced revenue system too reliant on the property tax; a national perception for being a corrupt state; and a mediocre K-12 education system.

These challenges won’t be solved in a year or two, yet that is exactly how elected officials approach our problems. Each biennium, Illinois lawmakers introduce 6,000 or so bills; this potpourri of policy ideas becomes in effect the sum total of our state’s long-term thinking.

The lawmaker/Fellows can either return to business as usual, that is, to a post-Mike Madigan lawmaking process that appears as polarized, atomized and smallminded as it was before the speaker was dethroned this past year.

Then again, they might create something like an Edgar Fellows Future of Illinois Coalition. The Fellows could hold a plenary gathering each year, break up into task forces, issue nonpartisan action platforms—and provide the leadership to enact them.

Or, the Fellows can be followers, which is much safer politically. The Edgar Fellows need to step up.

The fall of the Afghanistan government and the need to protect U.S. citizens and allies

By U.S. Rep. Raja Krishnamoorthi As Afghanistan falls to the Taliban due to the withdrawal of American troops, we must use every resource at our disposal to safely evacuate every American and all our friends and allies across the country.

For 20 years, these brave men and women have helped us work to pursue the dream of a free and democratic Afghanistan through supporting our military as translators and local advisors, serving in the Afghan army and government, and helping us to root out forces of extremism and terror in their country.

Their efforts and sacrifice over the last two decades ensured the safe return home of countless more American service members than would have otherwise been possible.

Now, it is our turn to protect them and their families. To do anything less would be a betrayal of their sacrifices, of the members of our military they helped, and of who we are as a nation.

As a member of the House Intelligence Committee, I am committed to uncovering the truth of how our withdrawal from Afghanistan went so wrong and how our country failed to anticipate the Taliban’s rapid takeover of the country. At this moment, my foremost priority is ensuring that all of our citizens and our allies currently in Afghanistan are safely evacuated and have the support they need.

The Inclusion of provisions based on my SAFE TO DRIVE Act in bipartisan infrastructure bill Recently, the Senate passed the bipartisan Infrastructure Investment and Jobs Act, which included

provisions based on my SAFE TO DRIVE Act to combat the dangers of distracted driving by providing grants for states to enact driver education programs while encouraging a clearer and stricter definition of texting in distracted driving laws.

Distracted driving—driving while also trying to text, call, clean, eat, or any other activity that detracts from driver focus—killed more than 3,000 people in 2019.

As we modernize and improve our infrastructure, we need to do so in a sustainable and safe way.

We know all too well that the small moment of checking a text while driving could cause a tragedy.

With state laws on distracted driving based on my SAFE TO DRIVE Act, we can make our roads safer.

On Wednesday, Sept. 15 at 4 p.m. in the Founders Lounge of the Frick Center, Paul Chavez will present “Lessons Learned From My Father,” this year’s Cesar Chavez Intercultural Lecture at Elmhurst University.

This year marks the 25th anniversary

of the annual lecture series, which was created in 1996 as part of Hispanic Heritage Month activities at Elmhurst.

Paul Chavez has spent his entire life with the farm worker movement as a union organizer, negotiator and assistant to his father. Since 1991 he also has led the Cesar Chavez Foundation, which works to improve the lives of farm workers and other poor working families throughout the Southwest.

Under Paul Chavez’s leadership, the Cesar Chavez Foundation built

and operates an affordable housing portfolio with nearly 5,000 units in four states. Chavez also expanded the Foundation’s Communications Fund with a Spanish- and English-language educational radio network that has 1.5 million daily listeners and followers.

gun to which Bailey responded, “I wanna die.”

The shooting and Bailey’s statement to Sergeant Pagan were all captured on squad car video. The investigation also uncovered text messages sent by Bailey three minutes before the 911 call showing Bailey wearing a dark colored shirt and tie and a message that read in part, “I’m sorry in advance…” The investigation also revealed that approximately one month prior, Bailey had conversations with a trusted family member in which Bailey talked about “suicide by cop.”

In determining whether the shooting of Haven Bailey was justified, the fundamental question to be answered is whether Sergeant Pagan reasonably believed that Bailey posed an imminent threat of death or great bodily harm to the officer or others. Bailey clearly knew that the officers were police officers.

The “reasonableness” of a particular use of force must be judged from the perspective of a reasonable officer on the scene, rather than with the 20/20 vision of hindsight. Graham v.

Connor, 490 U.S. 389 at 396 (1989). “[H]owever, the ‘reasonableness’ inquiry in an excessive-force case is an objective one: the question is whether the officers’ actions are ‘objectively reasonable’ in light of the facts and circumstances confronting them, without regard to their underlying intent or motivation.” Graham, 490 U.S. at 397.

When Haven Bailey refused to drop the gun, continued walking toward the police officers and then began to raise the gun at the officers, Sergeant Pagan reasonably believed that Bailey was trying to shoot him or the other officers on scene, and that deadly force was necessary to prevent imminent death or great bodily harm to himself and the other officers. The law of the State of Illinois as it applies to the use of force in this matter (720 ILCS 5/7-

1 Use of Force in Defense of Person) states that “A person is justified in the use of force against another when and to the extent that he reasonably believes that such conduct is necessary to defend himself or another against such other’s imminent use of unlawful force. However, he is justified in the use of force which is intended or likely to cause death or great bodily harm only if he reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or another, or the commission of a forcible felony.

Given the actions of Haven Bailey on the early morning of May 24, Bailey’s refusal to obey repeated police commands to drop the weapon while walking towards Sergeant Pagan with a BB gun that looked exactly like a firearm in hand, it was reasonable for Sergeant Pagan to believe Haven Bailey was trying to shoot him and/ or other officers at the scene, and that deadly force was necessary to prevent imminent death or great bodily harm to himself or others.4 Additionally, considering Bailey’s response to Sergeant Pagan of “I wanna die” when asked why he didn’t drop the gun and Bailey’s conversations about suicide by cop, the evidence is clear that Haven Bailey

Therefore, it is the conclusion of my office that Sergeant Pagan acted lawfully and was justified in using deadly force when he fired his service weapon and shot Haven Bailey.

All of the Villa Park Police officers involved in this incident should be commended for their professionalism during this extremely tense incident. Their concern for the safety and

well-being of not only Haven Bailey, but their fellow officers and the public at large, as well as their efforts to resolve the situation in a peaceful manner is a testament to the excellent training they receive from the Villa Park Police Department.

Unfortunately, Haven Bailey’s failure to obey the officers’ repeated commands and ensuing threatening behavior resulted in Sergeant Pagan fatally discharging his weapon.

It is indeed heartbreaking when a loved one meets an untimely death.

Warriors begin season with a win over Downers Grove South Program’s first win over the Mustangs during coach’s 17-year tenure

The Willowbrook girls golf team opened its 2021 season with a milestone victory. The Warriors defeated Downers Grove South 155-168 in a West Suburban Conference dual meet at Willowbrook’s home venue—Twin Lakes Golf Club in Westmont—on Wednesday, Aug 18.

Willowbrook head coach Jim White, who is beginning his 17th sea-

son as the program’s coach, noted that last week’s victory marked the Warriors’ first conference win over the Mustangs during his tenure.

Senior Emma Rattana of Willowbrook delivered the top individual score in the meet against Downers Grove South. Rattana shot a 9-hole score of 33 on the par-28 course. Senior Franki Giacalone shot a 38 for

the Warriors. Junior Mickey Martens (40) and senior Grace Hayes (44) also contributed to the team score of 155 (33+38+40+44).

Juniors Maddie Aderholt and Judy Roelle rounded out Willowbrook’s varsity lineup by shooting scores of 47 and 52, respectively.

Two Mustangs led their team with individual 9-hole scores of 40.

One day after beating Downers Grove South, the Warriors played a non-conference dual meet against Glenbard East at the Rams’ home course—Glendale Lakes Golf Club in Glendale Heights. Willowbrook defeated the Rams 209-215.

On Aug. 18, the Warriors defeated Downers Grove South in a West Suburban Conference Meet at Willowbrook’s home course—Twin Lakes Golf Club in Westmont. One day later, the Warriors beat Glenbard East in a non-conference meet at Glendale Lakes Golf Club in Glendale Heights. Rattana shot the best individual score in both meets. Saturday’s event is named after Rachel Gibson, a 2011 Willowbrook graduate who played for the school’s girls golf team. She passed away in 2013 after battling leukemia.

Willowbrook’s schedule this week includes West Suburban Conference dual meets against Addison Trail and Hinsdale South. The conference’s Gold and Silver teams join to form one 10-team conference in girls golf.

Four of the conference’s 14 teams do not have girls golf programs.

The Warriors’ 2020 fall season was postponed because of the COVID-19 pandemic.

Willowbrook’s girls volleyball team played an abbreviated spring season earlier this year. The Warriors opened that season with two losses, but won their remaining 10 matches to finish the campaign with a record of 10-2.

Willowbrook went 6-0 in West Suburban Gold Conference matches to win the conference title. The Warriors completed their championship season with an exciting three-game conference victory over Hinsdale South in Villa Park on April 21. There was no IHSA post-season in girls volleyball this spring.
