McHenry police arrest subject after neighborhood dispute while possessing a firearm
John Birk, Chief of Police of the McHenry Police Department, announced last week the arrest of a male subject in connection with an assault with a firearm stemming from a neighborhood dispute. Theodore J. Siebeck, 41, of 612 S. Broadway St., McHenry, Ill., was arrested by the McHenry Police Department on July 29. On Sunday, July 29, at approximately 8:50 p.m., the McHenry Police Department responded to the 600 block of S. Broadway St. in McHenry for a report of a reckless driver in the area. Neighbors in the area reported seeing Siebeck driving his gray Chevrolet Sedan recklessly. Neighbors confronted Siebeck about his driving and Siebeck returned to his residence after a brief argument with neighbors. Police were called to speak with Siebeck regarding the driving complaint, but he could not be contacted. At approximately 9:27 p.m., a second call to the McHenry Police Department was made from neighbors reporting Siebeck returned and was causing a second disturbance. During this time, Siebeck displayed a handgun to several individuals. Siebeck eventually returned to his home where McHenry Police Officers tried to make contact with him. McHenry Police Officers observed Siebeck in his home, but he refused to cooperate with officer’s commands. After approximately one hour, Siebeck attempted to flee through his back door where he was taken into custody by officers. Probable cause was established and a subsequent search warrant was issued to search Siebeck’s residence. During this search a loaded 9mm handgun and ammunition was recovered from the residence along a felony amount of cannabis and several other items of drug paraphernalia. Theodore J. Siebeck was charged with the following: - Aggravated Unlawful Use Of Weapon, 720 Ilcs 5/24-1.6(A)(1)(3) (A-5) Class 4 Felony - Reckless Conduct, 720 Ilcs 5/12-5(A)(1) Class A Misdemeanor - Criminal Trespass To Real Property, 720 Ilcs 5/21-3(A)(2) Class B Misdemeanor - Disorderly Conduct, 720 Ilcs 5/26-1(A)(1) Class C Misdemeanor - Resisting Or Obstructing A Peace Officer, 720 Ilcs 5/31-1(A) Class A Misdemeanor 2 - Possession Of Cannabis With Intent To Deliver, 720 Ilcs 550/5(D) Class 3 Felony - Unlawful Possession Of Cannabis, 720 Ilcs 550/4(D) Class 4 Felony - Unlawful Possession Of Drug Paraphernalia, 720 Ilcs 600/3.5(A) Class A Misdemeanor - Aggravated Assault, 720 Ilcs 5/12-2(C)(1) Class A Misdemeanor Siebeck was processed and transported to the McHenry County Adult Correctional Facility to await a bond hearing. This was an isolated incident with no injuries occurring.
