The Environmental Defenders of McHenry County announced that three outstanding McHenry County high school seniors have been awarded $1,000 scholarships each.

The graduating seniors plan to pursue a major or minor course of studies related to the environment.

The applicants were judged by a panel from The Environmental Defenders’ Education Action Team and to be eligible needed to reside and attend high school in McHenry County, have a respectable GPA,

two letters of recommendation, plan to attend an accredited college or university, and complete an essay and full application, including volunteer service over their high school years related to the environment.

The scholarship winners this year are: Tyler Butler, Woodstock High School; Haley Wegener, Prairie Ridge High School; and Jasmine Villavicencio, Woodstock High School.

Tyler will attend Drake Univer-

sity with a double major in Environmental Sustainability and Resilience/Management and possible minor in Zoo and Conservation Science. He was active in his school’s Green Club and Blue Planet Club and was fortunate his school offered an Environmental Science class.

Haley is planning to pursue an education toward becoming an environmental lawyer one day and will begin her studies at Iowa State and plans to major in political science with a secondary major in

environmental science. Haley excelled in her school’s AP Environmental Science Class.

Jasmine will be studying environmental science at the University of Tampa, and like her fellow scholarship awardees, took an environmental science class in high school.

She has a passion for travel and wildlife conservation and is the first recipient of The Environmental Defenders’ new Latino Environmental Scholarship.

mine was made possible through the Gerry & Bill Cowlin Foundation for which The Environmental Defenders is extremely grateful. The grant will also be used, in part, to help fund The Environmental Defenders’ general Latino Outreach Program of which the scholarship is a part.

The Environmental Defenders of McHenry County is a non-profit organization celebrating its 50th year of environmental stewardship through advocacy, preservation, protection and education.

Nonprofits receive Pick an All-America Landmark Illinois grants winner for your garden McHenry County Historical Society & Museum a recipient

The McHenry County Historical Society & Museum in Union was among 13 nonprofits receiving a combined $26,000 from Landmarks Illinois, a statewide historic preservation advocacy organization based in Chicago.

“Landmarks Illinois aims to be a collaborative partner delivering innovative and needed solutions to help people save places for people throughout our state,” said Bonnie McDonald, Landmarks Illinois president and chief executive officer. “We are proud to provide financial relief to our partner nonprofits, which enables them to continue to care for our historic places and serve their communities.”

Through the Landmarks Illinois COVID-19 Organization Relief Grant Program, each nonprofit will receive a one-time $2,000 grant to use toward essential, organizational expenditures including employee payroll and rent and/or improvements to the organization’s digital platforms such as their websites that help to promote their mission and continue their programming.

Landmarks Illinois created its COVID-19 Organization Relief Grant Program this spring to help community development, preservation and other partner nonprofits throughout the state during the coronavirus health crisis.

Thunderstorms, snow and ice, oh my! To beat the winter blues, one may turn to the 2020 seed and plant catalogs for spring inspiration and warmth.

“Planning your garden is essential to make sure you have plants that can tolerate our cold temperatures and still have blossoms all year long,” says Bruce J. Black, University of Illinois horticulture educator. “After mapping out your existing perennials, think about what new plants could be added to your landscape. A great starting place is the All-America Selections.”

All-America Selections, AAS, is a non-profit organization that releases several trialed plants each year as AAS Winners. AAS tests new varieties every year at their 80 private and public trial sites located around the United States and Canada.

Currently, there are five trial locations in Illinois: three northern, one central and one southern. Independent judges, who are professional horticulturists in geographically diverse areas, evaluate trial entries against comparison plants.

The results and observations are compiled and winners are chosen. For the best plants suited to the area, Illinois residents should look for Great Lakes winners or national winners on the AAS Winners lists.

Fourteen 2020 AAS Winners have been announced. Six were mentioned in the previous article. The five additional are discussed below which include four vegetables and one flower. They include: • Pumpkin, Blue Prince F1 (Cucurbita maxima var. Blue Prince F1): Blue flattened 7-9 pound pumpkins with orange flesh. Noted for its savory sweetness and scoring high in: early maturing, fruit size, uniformity, color, etc. 90 days to harvest from transplant. National Vegetable Winner.

• Tomato, Apple Yellow F1 (Solanum lycopersicum var. Apple Yellow F1): Apple-shaped tomato with a firm and meaty texture. Sweet citrus taste with good eating quality. Indeterminate vines with up to 1,000 fruits per plant. 110 days to harvest from transplants. National Vegetable Winner.

• Tomato, Chef’s Choice Bicolor F1 (Solanum lycopersicum var. Chef’s Choice Bicolor F1): Pink and yellow beefsteak, early maturing and uniformed variety. Producing up to 30+ fruits per plant. 75 days to harvest from transplants. Four disease tolerances noted. Regional (Heartland) Vegetable Winner.

• Tomato, Galahad F1 (Solanum lycopersicum var. Galahad F1): High-yielding sturdy planted tomato with Late Blight resistance. Sweet and meaty flavored 12-ounce fruits. Compact and determinate. 75 days to harvest from transplants.

New ASA in McHenry County Patrick D. Kenneally, McHenry County State’s Attorney, has announced that Hunter P. Jones joined the office as an assistant state’s attorney on May 26.

Jones earned his Juris Doctor from the University of Kentucky College

of Law in May 2019, after completing his B.A. in Politics, Philosophy and Economics from Transylvania University in Lexington, Kentucky, in May 2016.

He was previously employed at McAlister Law Ltd. in Lake Forest.

Update on 4-H shows and exhibitions

The following is a 4-H update from Michele Aavang, Program Coordinator, 4-H and Youth Development.

I would like to thank our 4-H members, their families, and our club leaders and volunteers for their patience as we have gathered information about summer 4-H shows and exhibitions. I know that this is an important event for many in our community and we appreciate your passion and commitment to 4-H during this time.

University of Illinois Extension has evaluated the available information to provide guidance about events sponsored by Illinois Extension for the month of July. Because we can only make decisions based on conditions as they exist today and not based on projected conditions at a certain point in the future, we have decided to continue our focus on virtual events into July.

• This means that all events slated for July, including McHenry County 4-H general project shows, will be moved to a virtual format.

• The format (in-person or virtual) of the McHenry County 4-H Livestock Shows will not be determined until July 1.

• As the McHenry County 4-H General Project Show (July) and the Livestock Shows (August) fall under two separate decision dates, Fair Entry dates will be different for General Project submission and Livestock project submission. More

information to come.

Our focus continues to be on managing the safety of event participants and the communities where these events take place. Our updated event policy follows guidance from the Illinois Department of Public Health and the University of Illinois.

Below, I am resharing some information that Illinois 4-H has gathered about how 4-H shows and exhibitions will be impacted by this plan.

• 4-H members will have an opportunity to exhibit their project work and finish their 4-H year.

The state 4-H office has invested in an online system that will allow members to submit documentation, such as photos of their project, and provide an explanation about their work. This will serve as their exhibit. It works through the 4-H FairEntry program we’re already using.

• Information on exhibit requirements for the new online judging format, along with instructions for entering can be found on the local Extension website beginning June 5: extension.illinois.edu/lm/4-hmchenry-county.

• Although this system doesn’t allow for in-person, real-time discussion, judges will provide vital learning feedback for exhibitors.

• We will continue our same award and recognition system, including selection of state fair delegates. Should the state fair be can-

celed, the exhibits nominated will again be judged through the online system used for the virtual county exhibitions.

• After consultation with the national 4-H program, extension of 4-H membership eligibility will not be offered to members currently in their final year of eligibility. We encourage all our completion members to take advantage of the online system.

• Because of the planning time and resources involved in each of our 4-H events, we are not able to postpone and stack all events for a later time in the summer. It is also uncertain at this time when large group gatherings will be allowed and considered safe according to public health guidelines.

Shopping at a farmers market allows people to buy the freshest products, know exactly where their products are coming from and who grew/ made them. That is why farmers markets are considered an essential business during the pandemic and that is why the Huntley Farmers Market is being held outside on Coral Street, Church Street and the Town Square.

McHenry County Treasurer’s Office 2100 N. Seminary Ave., Woodstock Service is limited to drivethrough only, from 7:15 a.m. to 5:15 p.m. on weekdays. People who are paying their property-tax bills are strongly encouraged to pay by check, cashier’s check or money order rather than cash. Taxpayers also can pay online through the Treasurer’s website at www.mchenrytreasurer.org.

The Treasurer’s Office is not accepting passport applications until further notice. If you have an emergency situation, contact the Federal Passport Office at 877-487-2778.

McHenry County Animal Control 100 N. Virginia St., Crystal Lake Animal Control is open for animal redemptions, animal registration and other administrative functions. The public should also anticipate having their temperature taken, and questions about their health related to COVID-19 symptoms.

Anyone exhibiting said symptoms, or who have a temperature greater than 100.4 degrees will be asked to handle necessary services from their vehicle or over the phone. Animal adoptions will resume at a later date.

Other county buildings Guidelines are still being developed for other county facilities, such as the Division of Transportation and the Workforce Network.

Valley Hi Nursing Home is developing a plan to gradually reopen the building, in phases, to medical professions and adult visitors.

Face coverings and practicing social distancing are required at county facilities. County facilities are equipped with no-touch hand sanitizer dispensers, floor markings and reduced capacity in waiting rooms, no-touch bathroom faucets, and social distancing signage. Plastic shields are in place at customer service counters.

The county asks for your continued patience as it reopens under the limitations set under Phase 3 of the Restore Illinois plan.

• Arrive no earlier than 15 minutes prior to your scheduled court time, and promptly leave the building when finished.

• Leave your family and friends at home—only people necessary to the proceedings should come to court.

• Bring only your keys, photo ID, cash or credit card and court papers into the building. No bags, purses or backpacks will be allowed. Only cell phones for court-related purposes are permitted in the Judicial Center.

Move comes amid lawsuits and possible U.S. Supreme Court review

People in Illinois will be allowed to attend worship services without fear of prosecution as the state enters Phase 3 of Gov. JB Pritzker’s “Restore Illinois” reopening plan.

Pritzker made the announcement during his daily COVID-19 briefing May 28 in Chicago, the same day a new lawsuit was filed in Lake County Circuit Court challenging the ban on public gatherings of more than 10 people as it applied to worship services.

It also came on the same day the U.S. Supreme Court was preparing to decide whether it would hear the appeal of another case involving two churches in Chicago that were challenging the ban.

“Having received many plans and ideas from responsible faith leaders, (the Illinois Department of Public Health) has reviewed many detailed proposals and has provided guidance—not mandatory restrictions—for all faith leaders to use in their efforts to ensure the health and safety of their congregants,” Pritzker said. “This includes suggestions on capacity limits, new cleaning protocols, indoor gatherings of 10 persons or less, a reduction of activities like sharing food and the safe conduct of outdoor congregating.”

“The safest options remain remote and drive-in services,” he added. “But for those that want to conduct in-person activities, IDPH is offering best practices.”

Earlier in the day May 28, the Thomas More Society, a conservative public-interest law firm based in Chicago, filed suit in Lake County on behalf of five local churches and their pastors who said they intended to hold worship services anyway May 31, which is the Christian holy day of Pentecost.

“This is a total and complete victory for people of faith,” Peter Breen, vice president and senior counsel of the Thomas More Society, said in a statement. “Illinois’ governor and his administration abused the COVID-19 pandemic to stomp on the religious liberty of the people of Illinois. By issuing guidelines only and not the previously announced mandatory restrictions, he has handed a complete victory to the churches in Illinois.”

The Thomas More Society also rep-

resented the Beloved Church, in Lena, when it challenged Pritzker’s order in federal court in late April. And it represented the Jesus House Restoration Ministries in Urbana, which caters mainly to people struggling with homelessness and substance abuse, in another federal lawsuit filed May 12.

Another legal advocacy group, the Florida-based Liberty Counsel, filed suit on behalf of two Chicago churches.

That request for a temporary restraining order was rejected in U.S. District Court as well as the 7th U.S. Circuit Court of Appeals. But attorneys in that case appealed to the nation’s high court, and on May 27, Justice Brett Kavanaugh, who oversees the 7th Circuit, gave the Illinois attorney general’s office one day to file a reply brief so the court could decide whether to hear the case.

All of those cases argued, in one form or another, that Pritzker’s stay-athome order as it applied to churches interfered with individuals’ freedom of religion. The federal cases were based on the U.S. Constitution’s guarantee of the free exercise of religion, while the Lake County case focused on the Illinois Constitution and the state Religious Freedom Restoration Act. Governments can and do put restrictions on churches on a regular basis.

Churches are, for example, subject to local building codes and fire safety regulations, and those codes often put limits on the number of people who can be in the building at one time.

During an interview May 28, however, Breen argued those laws apply uniformly to religious and secular facilities alike. Pritzker’s executive orders, he argued, singled out churches while other businesses such as supermarkets, manufacturing facilities and meat processing plants were allowed to operate without capacity restrictions.

“There’s no constitutional right to run a meat-packing plant; there is an express constitutional right to have a church,” he said. “So, this is the problem that we’re pointing out, which is you’ve singled out churches for different treatment.

And there are plenty of other places in society today that are fully open, that are more dangerous than a church.”

In a ruling May 19 denying Liberty Counsel’s request for a temporary restraining order, a three-judge panel of

the 7th Circuit disagreed with that argument.

“The Executive Order’s temporary numerical restrictions on public gatherings apply not only to worship services,” the panel wrote, “but also to the most comparable types of secular gatherings, such as concerts, lectures, theatrical performances, or choir practices, in which groups of people gather together for extended periods, especially where speech and singing feature prominently and raise risks of transmitting the COVID-19 virus. Worship services do not seem comparable to secular activities permitted under the executive order, such as shopping, in which people do not congregate or remain for extended periods.”

Before Pritzker’s announcement May 28, a number of churches around the state had been targeted for enforcement action, including the Jesus House Restoration Ministries which received a cease-and-desist notice from the Champaign-Urbana Public Health District in April.

Although churches now will be able to operate without fear of prosecution, IDPH said it still does not encourage them to hold indoor services with large congregations.

“Indeed, it is strongly recommended that places of worship continue to facilitate remote services, particularly for those who are vulnerable to COVID-19 including older adults and those with co-morbidities,” the agency stated in the new guidelines. “Even with adherence to physical distancing, multiple different households convening in a congregational setting to worship carries a higher risk for widespread transmission of the virus that causes COVID-19, and may result in increased rates of infection, hospitalization, and death, especially among more vulnerable populations.”

The new IDPH guidelines for in-person services are substantially similar to those issued recently by the U.S. Centers for Disease Control and Prevention.

They still encourage limiting attendance and offering multiple small services instead of one large one. They also encourage churches to thoroughly clean and disinfect their facilities, to practice physical distancing, avoid singing and group recitations and to discontinue serving food and beverages.

Mendoza unequivocal: No raises for lawmakers Legislative back-and-forth shows complexity of state lawmaker pay law

The complexities of Illinois’ legislator pay laws were on display again this week as the state’s comptroller insisted in a video message that there will be no raises for lawmakers this year.

Comptroller Susana Mendoza, a Democrat and the state’s chief fiscal officer, emphatically said in a one-minute YouTube video there would be “zero” raises for lawmakers despite claims to the contrary.

“By law, there is a (cost of living adjustment) in the budget every year,” Mendoza said in the video.

“But this year, the General Assembly voted to make the COLA zero, and I’m glad because it’s the right thing to do, especially in the COVID-19 crisis that has really hit our state budget hard.”

Mendoza should know, she said in the video, because she writes the checks in Illinois, and money not appropriated by the General Assembly cannot be spent. Sen. Andy Manar, D-Bunker Hill, said the same on the Senate floor, noting lawmakers intentionally appropriated zero dollars for raises this year.

Republicans, however, issued news releases and spoke on the floor May 23 claiming the budget included the automatic raises.

The state GOP asserted on Twitter that one lawsuit from a “safe, entrenched legislator” could force the payment of the raises which the comptroller has unequivocally denied she will pay.

While Mendoza made clear there will be no raises this year, the exchanges highlighted the fact that an ongoing legal challenge leaves much uncertain in terms of whether legislators can halt their own pay raises legally.

At the crux of the issue is a section in the state Constitution and an Illinois law dating back to 1990 which provides for automatic COLA increases of roughly 2 percent to 3 percent every year unless lawmakers act to stop them.

In fiscal Year 2009 and thereafter, lawmakers routinely did just that by including language in a budget implementation bill prohibiting the COLAs. Lawmakers did not include that language in a budget approved last May, which allowed for a roughly 2.4 percent raise to lawmaker base pay for the first time since 2008, bringing it to $69,464 annually, not including stipends for legislative leaders and committee chairs and spokespersons.

This year, according to Mendoza and Manar, lawmakers went back to denying themselves a raise by specifically appropriating no money to pay for it. That approach is different than in years past, when

lawmakers passed language prohibiting cost of living adjustments.

The new approach was in large part a response to an ongoing lawsuit which deemed the previous method unconstitutional.

“We wanted to say in a very clear voice that we do not want the COLAs funded,” Manar said in a phone call. “There’s multiple places in a state budget where a COLA could be funded. And we took care of all of those things. And the final piece of that was putting a zero next to it, which is, I think, crystal clear what its intention is.”

The lawsuit in question was filed against Mendoza by former Senators James Clayborne and Michael Noland, both Democrats, who claim it was unconstitutional for lawmakers to deny themselves pay in each of those years because the state’s Constitution states “A member shall receive a salary and allowances as provided by law, but changes in the salary of a member shall not take effect during the term for which he has been elected.”

According to a 2019 “Preface to Lawmaking” publication of the state’s Legislative Research Unit, legislator pay was set by law until 1984, when the Compensation Review Act was enacted providing that a Compensation Review Board would make salary recommendations that would take effect automatically unless both houses of the General Assembly disapproved of

them within 30 days.

The Board’s 1990 recommendation provided for salaries to be adjusted for inflation each year thereafter, using the federal government’s Employment Cost Index.

While the Compensation Review Board was abolished in 2009, it was established that the 1990 plan—including automatic COLAs—would continue to be law going forward.

But because the COLA freezes since 2009 took place mid-term for most lawmakers, they violate the Constitution, according to Noland and Clayborne, and the former lawmakers claim they are due back pay for the raises they were denied.

“Contrary to statements that have been made in the press, the comptroller can—and in fact is obligated to—make these payments regardless of whether the General Assembly has specifically appropriated money for this purpose,” Michael Scotti III, the attorney for the former lawmakers, wrote in a letter to the comptroller last year.

A Cook County judge ruled in their favor last year, but the state has appealed the decision and neither lawmaker has received back pay. That case is likely to be appealed and challenged for years to come, according to the comptroller’s office.

“I’m not going to predict what a court says,” Manar said. “… But we’re not going to cede our authority as appropriators to an unnamed

After last year’s raise went through, one first-term Republican senator filed a bill which he believes will abolish automatic COLAs without running afoul of the constitution.

Sen. Craig Wilcox, R-McHenry, said the latest exchange on lawmaker pay cause a rush of bipartisan support for a bill he has had sitting in the Senate’s Assignments Committee since February. His Senate Bill 3607 would end cost of living adjustments starting in 2023—the year after each of the state’s lawmakers is scheduled to stand for reelection.

The date is important, he said, because it will be an action implemented after all lawmakers start a new term. Wilcox said he pursued

the matter rather than taking part in the politicization of the COLA conversation.

“The point is this kind of negates the reason for Dems and Republicans fighting about words,” he said in a phone call. “It fixes the issue constitutionally going forward.”

Sen. Suzy Glowiak Hilton, D-Western Springs, is a co-sponsor on that measure. She said she was given assurances by budgeteers that there would be no raises in the budget, which is why she supported it. She also said she hoped Wilcox’s measure or something like it would pass when lawmakers return for fall veto session in November or later.

“Our budgeteers were very clear on that,” she said. “And that’s why they didn’t appropriate anything to the raises on the line item.”

What you should know as Illinois readies to enter ‘Recovery’ phase

Illinois now advances to the “Recovery” phase of Gov. JB Pritzker’s plan to incrementally reopen the state’s economy after almost 70 days of residents living under a stay-athome restriction.

It comes as Illinois is one of only two states to meet federal COVID-19 guidelines to reopening, according to a ProPublica analysis. New York is the other.

Retail shops, restaurants, barbershops, salons and fitness clubs are set to resume business, but with restrictions implemented by the Illinois Department of Public Health to combat exposure to the novel coronavirus.

All state parks, wildlife areas and historic sites will be available to visit as well, and social gatherings of no more than 10 people will be allowed.

The changes are permitted because all four Illinois regions—groupings of counties based on IDPH’s emergency medical service districts—achieved

specified benchmarks. Those include a COVID-19 positivity rate below 20 percent for 14 consecutive days and a stable or declining hospitalization rate.

When Pritzker announced his Restore Illinois plan in early May, he said residents should expect COVID-19 to remain a threat until it can be “vanquished.”

“Until we have a vaccine or an effective treatment or enough widespread immunity that new cases fail to materialize, the option of returning to normalcy doesn’t exist,” the governor said.

People will still be expected to wear facial coverings and practice social distancing when in public places.

“Non-essential” businesses and stores, closed for more than two months to in-person customers and workers, reopened Friday with capacity limitations, social distancing observations and other safety guidance measures from IDPH. That same guidance will be imple-

mented for barbershops and salons.

And for those workplaces that can enable remote activities, it is encouraged they do so.

Restaurants will remain closed to indoor dining, but Pritzker amended the Phase 3 plan to allow outdoor, socially distanced dining. Delivery, pickup and drive-thru are still options.

All of the state’s 5,000-plus child care providers not in operation will be advised to reopen. Pritzker said for the first four weeks that they are open, providers will be able to serve up to 10 children per classroom.

“Once they have provided care safely for four weeks and have gotten accustomed to the new health, social distancing and sanitation routines, they will be able to expand to larger group sizes, though not yet at their fully licensed capacity,” he said.

Fitness clubs can also hold outdoor activities, as well as one-on-one training with an instructor so long as public health department guidance is observed.

The General Assembly created a Restore Illinois Collaborative Commission to “participate in and provide input on plans to revive the various sectors of the state’s economy in the wake of the COVID-19 pandemic” when it convened for four days last week.

Because the commission “may request meetings be convened to address revitalization efforts for the various sectors of the state’s economy,” it is unclear what level of input legislators will have on the governor’s reopening plan.

Republicans, who long sought more input in that blueprint, called the newly created body “window dressing.”

The next step after the “recovery”

phase is “revitalization.” Schools and other child care programs can reopen so long as social distancing is observed, restaurants can serve in-house diners and social gatherings will be limited to 50 people or fewer.

Framers of the plan anticipate at least a 28-day period before the state can progress into that phase, meaning no sooner than Friday, June 26.

Among the criteria for entering Phase 4 will be that COVID-19 testing is available to anyone who wants it, regardless of symptoms or risk factors; a contact tracing program must be in place; hospitalization rates must remain stable or decline; and the positivity rate must be below 20 percent for 14 consecutive days.

The COVID-19 pandemic has led to an increase in unemployment and job insecurity across our communities. While businesses slowly begin to reopen and people everywhere adjust to a new way of life, many who have been furloughed or laid off are still dealing with difficulties associated with lost income.

Those impacted may find that now is the perfect time to focus on building and strengthening skillsets needed to advance their careers. One of the best ways to do this is by furthering their education. Many put off earning an undergraduate or graduate degree for one reason or another but, given the current climate, may want to take the leap and work toward that goal – online, from the safety of their homes.
