Sheriffs Office garners excellence award for speed awareness day The McHenry County Sheriff’s Office has been accorded the Excellence Award from the Illinois Association of Chiefs of Police Association (ILACP) for its contribution on Speed Awareness Day 2018.

The second annual Illinois Speed Awareness Day, July 25, was a coordinated effort among the ILACP; Families Against Chronic and Excessive Speeding; Illinois Department of Transportation; Illinois Sheriff’s Association; Illinois State Police; Illinois Tollway Authority; local law enforcement agencies; school districts; and numerous other private and public agencies throughout Illinois. The goal was to save lives and prevent injuries by getting motorists to simply slow down, obey the posted speed limits, and more importantly, to not excessively speed.

The 2018 statewide campaign totals were over 1,000 hours spent on education, 1,049 citations and 1,215 warnings were issued. The McHenry County Sheriff’s Office issued 67 citations, 23 warnings, and had one arrest on that day.

“Motorists know that speed kills, and partnerships like Speed Awareness Day help give anyone a reminder of that fact,” said Sheriff Bill Prim. “I am pleased that our staff’s extra effort has brought us this recognition.”

Senator Syverson’s week in review: New laws taking effect in the New Year When the clock strikes midnight on Jan. 1, 2019, 253 new laws will take effect in the state of Illinois. New laws run the gamut from fighting the opioid crisis and promoting car-seat safety to allowing blaze pink hunting gear.

Controversial gun-control measures take effect Several controversial gun-control measures will take effect as the New Year begins. Senate Bill 3256/PA 1000606 creates a 72-hour waiting period on all firearm purchases, not just on handguns. Family members and law enforcement officials who suspect that someone poses a significant danger of causing harm to themselves or others will be able to petition the court for a firearms restraining order under House Bill 2354/PA 100-0607.

Fighting back against human trafficking A number of new laws for the 2019 take aim at human trafficking. House Bill 4340/PA 100-0671 expands the list of locations at which information about hotline numbers to call for help or to report unlawful activity must be posted for the public and victims of human trafficking.

Human trafficking survivors will be allowed to bring a civil suit against traffickers under Senate Bill 3108/ PA 100-0939, the Trafficking Victims Protection Act. Recognizing the trauma inflicted on trafficking victims, and the barriers that trauma may create to seeking justice, the law also allows others, like family members and victims’ advocates, to bring an action on behalf of a victim.

House Bill 2063/PA 100-1037

changes the Crime Victims Compensation Act to make it easier for victims of human trafficking to meet requirements for compensation. Among the changes is a provision that allows for a longer time frame for reporting.

Get your kicks on the Route 66 Centennial Commission Route 66, one of the original highways within the National Highway System, will mark its centennial in 2026. House Bill 66/PA 100-0649 creates the 20-member Route 66 Centennial Commission to plan and coordinate commemorative events throughout Illinois to celebrate 100 years on Route 66, and to highlight the history of how local communities grew and changed thanks to the construction of this historic highway.

New laws support, protect military personnel New laws to support and protect our military personnel and veterans are among those that will be implemented in 2019. Military personnel believed to have a physical or mental condition related to their service will now be included in the state’s definition of “high-risk missing person,” providing additional resources to help locate and safeguard these heroes under Senate Bill 2278/PA 100-0835.

Homeless veterans will be provided a free copy of medical records by health-care facilities and practitioners to help support claims for veterans’ disability benefits under House Bill 4848/PA 100-0814.

Greater dual credit access for high school students In the New Year, high school students will have greater access to dual

credit coursework thanks to two new state laws. Senate Bill 2527/PA 1000792, allows qualified students to enroll in an unlimited amount of dual credit courses and earn an unlimited amount of academic credits from dual credit courses taught by a qualified instructor. Another measure, Senate Bill 2838/PA 100-1049, improves access by requiring community colleges to enter into a dual credit agreement if a high school district within their boundaries requests it.

River Edge Development Zone Program revamp With a focus on redevelopment and economic growth, the River Edge Redevelopment Zone Program gets a facelift in the New Year. This important program helps revive and redevelop environmentally-challenged properties adjacent to rivers in Illinois. Senate Bill 3527/PA 100-0629, in addition to a few other changes, also creates the Historic Preservation Tax Credit Act to help protect and rehabilitate historic structures.

Golden Parachutes A new law targeting overly generous severance packages, also known as “golden parachutes,” is set to take effect on Jan. 1. Golden parachutes have made headlines

in recent years when the College of DuPage president was awarded $762,000 at taxpayers’ expense.

Senate Bill 3604/PA 100-0895 sets severance pay conditions for government employees to prevent situations like this from happening in the future.

Battling opioids As the opioid crisis continues to impact lives throughout the nation, two new laws in Illinois that could have an impact are set to go into effect. Licensed prescribers of controlled substances will be required to complete three hours of continuing education on safe opioidprescribing practices before renewing their prescription license under Senate Bill 2777/PA 100-1106.

Senate Bill 682/PA 100-1023 will provide greater access to emergency opioid and addiction treatment by specifying that insurance companies cannot require prior notification for inpatient and outpatient substance-use-disorder treatment.

House Bill 4795/PA 100-0759 provides a firm foundation to enhance and support efforts to combat the opioid epidemic and other substance use disorders. By clarifying and streamlining current state law, managed care organizations and primary care providers are given

clear guidance that will help ensure a standardized approach to intervention and treatment of substance abuse.

Transportation safety As of Jan. 1, children younger than two must be secured in a rearfacing child-restraint system unless they weigh more than 40 pounds, or are 40 inches or taller, under House Bill 4377/PA 100-0672.

And check your backup lights!

Senate Bill 2511/PA 100-0707 states that a backup lamp on a motor vehicle must emit either a white or amber light without glare.

Pink is the new orange Hunters take note! Among the hunting, fishing and trapping laws taking effect in the New Year, House Bill 4231/PA 100-0949 will allow hunters to wear blaze pink, instead of the traditional blaze orange. Proponents of the change claim that blaze pink could be brighter to the human eye than orange, and also less visible to deer.

Two new laws supported by Secretary of State Jesse White that take effect Jan. 1 include child passenger and bike safety initiatives.

The first law will require parents and caregivers to secure children in rear-facing safety seats until they are 2-years-old or weigh 40 pounds or more or measure 40 or more inches tall.

“Children are five times safer riding in a rear-facing seat because their head, neck and spine are better protected in a crash,” White said. “Let’s make sure we keep our children safe by putting them in an appropriate car seat that is properly installed.”

Car crashes are a leading cause of death for children ages 1-13, according to the National Highway Traffic Safety Administration (NHTSA).

The Illinois Child Passenger Protection Act states that children under age 8 must be secured in an appropriate child restraint system, including booster seats.

Car seats have been shown to reduce fatal injury by 71 percent for infants and 54 percent for toddlers, according to NHTSA. The Secretary of State’s office, through its Keep Me in a Safe Seat program, provides child safety seat inspections by certified child safety seat technicians at 10 Driver Services facilities throughout the state. The Huntley 158 Board of Education on Dec. 20 approved agreements with the Lake in the Hills and Algonquin Police Departments to create campus resource officer positions at the District’s Reed Road and Square Barn Road Campuses, respectively.

The new positions are modeled on the school resource officer position that has been successfully housed at Huntley High School in partnership with the Huntley Police Department for nearly 20 years.

One police officer will be housed at each of the District’s two middle schools, Marlowe and Heineman, but will be focused on serving the safety, security, educational, legal, and relationship-building needs of

the entire campus, including elementary schools.

“We’ve seen nothing but positive benefits to having a full-time school resource officer at our Harmony Road Campus in the past two decades,” said Superintendent Scott Rowe. “Adding officers who will be assigned full-time to our other two campuses will help improve the overall safety, security, and well-being of students and staff there as well.”

Campus resource officers provide both proactive and reactive safety and security roles, leading safety assessments, acting as liaison between the law enforcement system and schools, and serving as a first responder in emergency situ-

ations. In addition, the officers will collaborate with schools to lead student and family education programming.

“We have long benefited from the close and positive relationships with the police departments that serve our schools,” Rowe said.

“This is another step in keeping safety and security as our top priority.”

The Reed Road Campus includes Marlowe Middle School, the D158 Early Childhood Center, Chesak Elementary School, and Martin Elementary School. The Square Barn Road Campus includes Heineman Middle School, Mackeben Elementary School, and Conley Elementary School.

Rockford man sentenced to more than 9 years in federal prison for armed robbery A Rockford man was sentenced last week by U.S. District Judge Philip G. Reinhard to a total of 114 months in federal prison for the robbery of the U.S. Cellular store, 6430 E. State St., in Rockford, on June 1, 2016, and for using a firearm during a violent crime.

Ricky Woods, 23, was sentenced to 30 months’ imprisonment for the robbery, and was ordered to serve a consecutive term of 84 months’ imprisonment for using a firearm during a crime of violence. After serving his sentence in federal prison, Woods will be placed on three years of supervised release. Woods pleaded guilty to the charges on Sept. 27, 2018.

Also charged was Mckinley HOARDE III, 23, of Rockford, who on July 9, 2018, pleaded guilty to the robbery and the gun charge. Hoarde

was sentenced on Oct. 19, 2018, to 66 months’ imprisonment for the robbery, and was ordered to serve a consecutive term of 84 months’ imprisonment for using a firearm during a crime of violence. After serving his sentence in federal prison, Hoarde will be placed on five years of supervised release.

Both men admitted that after arriving at the U.S. Cellular store they pulled out and pointed their guns at the only employee at the store. One of them grabbed the employee by the shirt collar and pulled the employee to the back room of the store, where they ordered the employee to the ground.

Hoarde and Woods then took cellular phones from the store and removed electrical equipment from the wall in an attempt to disable the se-

curity system, before running out of the store.

The sentencing was announced by John R. Lausch, Jr., United States Attorney for the Northern District of Illinois; Celinez Nunez, Special Agentin-Charge of the Chicago Field Division of the U.S. Bureau of Alcohol, Tobacco, Firearms & Explosives; and Jeffrey Sallet, Special Agent-inCharge of the Chicago office of the Federal Bureau of Investigation. The federal investigation was conducted

by ATF and the FBI-led Rockford Area Violent Gang Task Force, which includes law enforcement officers and agents from the FBI, Rockford Police Department, Loves Park Police Department and Freeport Police Department. The government was represented by Assistant U.S. Attorney Margaret J. Schneider.

Federal Judge issues order against IL Dept. of Corrections 10 years after filing, ‘immediate action must be taken’ to ‘address the dangerous situation’

A federal court has ordered the state of Illinois to address its “failure to…meet the constitutional requirements with respect to the mental health needs of” its approximately 12,000 prisoners with mental illness.

This case reached a settlement agreement in 2016, but the Illinois Department of Corrections (IDOC) failed to live up to the agreement, and constitutional violations continued, according to the plaintiffs’ lead counsel, Harold Hirshman, senior counsel for Dentons. In October 2018, the court issued a 50-page decision finding that IDOC has been deliberately indifferent to prisoners’ mental health, in violation of the Eighth Amendment.

The court has entered an order directing IDOC to take specific steps to immediately address its mental health care crisis, saying “the record here demonstrates a long history of the Defendants’ non-compliance

with various terms they had agreed upon.”

The court specifically criticized the Department’s reliance on Wexford (a private company), saying, “Defendants cannot shirk their constitutional obligations by delegating them to another.” The court also found that crisis watch, where suicidal prisoners are held in solitary confinement, naked, in a bare room with absolutely no property except a so-called “suicide smock,” is “being used in a manner that is detrimental” to prisoners.

Judge Michael Mihm said the defendants have failed “to adequately staff their facilities,” and ordered, among other things, that IDOC “meet the staffing requirements of their 2014 Remedial Staffing Plan within 90 days.”

“The court’s order requires the state to fill long-vacant mental health staff positions and provide treatment that is needed to stop harming prison-

ers throughout out state,” said Amanda Antholt, senior attorney at Equip for Equality and one of the attorneys representing the plaintiffs. “We’re thrilled to see the court recognize this as an emergency situation. IDOC has failed to provide constitutionally adequate mental health care for far too long. The judge’s order to hire additional staff within 90 days should bring some much-needed relief to prisoners who have been suffering,” said Alan Mills, executive director of Uptown People’s Law Center and one of the attorneys representing the plaintiffs.

“Time will tell whether this powerful order is sufficient to cause the defendants to provide the care they promised in the settlement agreement; care required by the Constitution,” said Harold Hirshman, senior counsel at Dentons and the lead counsel of the attorneys representing the plaintiffs.

Three Chicago-area men plead guilty to robberies of Rockford-area cell phone stores Three Chicago-area men have pleaded guilty to the robberies of Rockford-area cell phone stores.

Narcellus J. Taylor Jr., also known as “J.T.,” 23, of Chicago, Herman L. Doss Jr., 27, of Dolton, and Mario J. Anderson, 25, of Riverdale, admitted to conspiring with each other to steal cellular telephones and computers from stores in Illinois, Wisconsin and Indiana.

Anderson and Doss pleaded guilty last week before U.S. District Judge Philip G. Reinhard, while Taylor pleaded guilty on Sept. 21, 2018. Taylor and Doss each pleaded guilty to one count of conspiracy to commit robbery, three counts of robbery by threatened force, and one count of using a firearm during a crime of violence, while Anderson pleaded

guilty to one count of conspiracy to commit robbery, two counts of robbery by threatened force, and one count of using a firearm during a crime of violence.

According to written plea agreements, between Aug. 5, 2016, and Jan. 6, 2016, Taylor conspired with Anderson, Doss and others to rob certain cellular telephone and electronics stores.

Taylor identified the stores and paid others, including Anderson and Doss, to commit the robberies at his direction. The men conducted surveillance and communicated with other individuals during the robberies.

After the robberies were completed, Taylor took the stolen items to Chicago where he sold them. Taylor then determined the amount each defendant re-

ceived from the proceeds based upon their roles in the robberies.

Taylor admitted to conspiring to commit eight robberies, five of which Doss participated in, and four of which Anderson participated in. Taylor admitted that the local robberies included one on Dec. 2, 2016, of a Best Buy in DeKalb, and two with Doss and Anderson at the Simply Mac store in Cherry Valley, on Dec. 16, 2016, and Jan. 6, 2017. The three defendants admitted to using firearms during the Jan. 6, 2017, robbery.

Each count of robbery carries a maximum sentence of 20 years’ imprisonment, a term of supervised release of up to three years following imprisonment, and a fine of up to $250,000.

Using a firearm during a crime of violence carries a maximum sen-

tence of life imprisonment, with a mandatory minimum sentence of 7 years and a term of supervised release of up to five years, which is required to be consecutive to any other sentence imposed, as well as a fine of up to $250,000. The actual sentence for each defendant will be determined by the United States District Court, guided by the Sentencing Guidelines.

Sentencing for Anderson is scheduled for May 13, 2019, at 9 a.m. Sentencing for Doss is scheduled for May 13, 2019, at 10:30 a.m.

The guilty pleas were announced

by John R. Lausch, Jr., United States Attorney for the Northern District of Illinois; and Jeffrey S. Sallet, Special Agent-in-Charge of the Chicago office of the Federal

Bureau of Investigation.

The federal investigation was conducted by the FBI-led Rockford Area Violent Gang Task Force, which includes law enforcement officers and agents from the FBI, Rockford Police Department, Loves Park Police Department and Freeport Police Department.

The Illinois State Police, Cherry Valley Police Department, Rockford Police Department, DeKalb Police Department, Burbank Police Department, Crestwood Police Department, Kenosha (Wisc.)

Police Department, and Valparaiso (Ind.) Police Department also assisted in the investigation.

Sheriffs office investigating a triple fatal crash A 20-year-old Woodstock man and two male passengers in his vehicle were killed in a one-vehicle crash in the early morning hours Sunday, Dec. 23 in the 3100 block of Lily Pond Road of unincorporated Woodstock, while a fourth victim remained hospitalized in serious condition.

Sunday at 3:32 a.m., the McHenry County Sheriff’s Office, Woodstock Police Department and the Woodstock Fire Protection District responded to the crash involving a1994 Jeep Cherokee.

Preliminary investigation indicates that the Jeep, driven by the 20-year-old man, was traveling northbound on Lily Pond Road. The Jeep left the roadway

south of McConnell Road to the west of the road and struck a tree.

The victims were pronounced dead at the scene.

The fourth occupant was transported to Northwestern Hospital in Huntley and later transported by ambulance to Advocate Lutheran General Hospital in Park Ridge in serious condition.

The Jeep was not equipped with airbags and it is believed none of the occupants were wearing seatbelts at the time of crash. The investigation is currently ongoing by the McHenry County Sheriff’s Office Major Crash Investigations Unit and the McHenry County Coroners’ Office.

A Mexican citizen pleaded guilty last week in federal court before U.S. District Judge Philip G. Reinhard to bank fraud.

Javier Santos Suarez, also known as Roberto Rios, Simon Estrada, Jorge Viveros, Francisco Alvarado, and Fernando Razo, 40, admitted to scheming with co-defendants from January 2003 through August 2003 to defraud and obtain money using counterfeit checks - payable to fictitious names - that the defendants cashed in Northern Illinois and other states.

According to a written plea agreement, Suarez and his co-defendants used counterfeit checks that they cashed at banks near the businesses on which they were purportedly drawn.

The defendants used false personal identification documents, such as false Resident Alien Cards, when presented to the banks to cash. Suarez admitted that he kept at least a portion of the cash he received from personally cashing counterfeit checks, and turned the balance of the cash over to other participants. Suarez and his co-defendants cashed counterfeit checks totaling $721,617 at banks and businesses in Poplar Grove, Marengo, and Harvard, as well as in other states.

Suarez was arrested in Wisconsin on the federal charges. He faces a maximum sentence of 30 years’ imprisonment, a term of supervised release of up to five years following imprisonment, and a fine of up to

$1 million or twice the gross gain or gross loss resulting from the offense, whichever is greater.

The actual sentence will be determined by the U.S. District Court, guided by the Sentencing Guidelines. Sentencing for Suarez is set for May 13, 2019, at 10 a.m.

The guilty plea was announced

Also convicted of bank fraud in the case were: Rogelio Ramos, 38, who pleaded guilty on Sept. 15, 2004, and was sentenced on Nov. 19, 2004, to 40 months in prison, to be followed by five years of supervised release.

Ramos was ordered to pay restitution in the amount of $773,336.66.

Leonel Bello Leon, 41, who pleaded guilty on July 15, 2005, and was sentenced on Sept. 26, 2005, to 31 months in prison, to be followed by five years supervised release.

Leon was ordered to pay restitution in the amount of $718,778.56.

Miseal Sangabriel Alarcon, 38, who pleaded guilty on Dec. 16, 2005, and was sentenced on March 24, 2005, to 32 months in prison, to be followed by three years of supervised release. Alarcon was ordered to pay restitution in the amount of $141,738.50.

Last Saturday’s Firefighter Bell Ringing for the Salvation Army was a tremendous success. Crystal Lake Fire Rescue Department Lieutenant Darrell Cook reports, “...One kettle in particular was AMAZING! I had kettle 309 on the hook at the left door of the Crystal Lake Jewel from 3pm until 8pm. The kettle was heavy and full; people were so generous all afternoon and evening. I turned it in to the (The Salvation Army of Crystal Lake and McHenry County, IL) staff and said “I would love to know the total of this one. It’s so heavy!” After arriving home from a long day of bell ringing I got a phone call. That lovely heavy kettle had $927 in cash, a silver bar, and FOUR gold coins... 4 Krugerrands more specifically. I’m blown away by the generosity in this community. Thank you to all the people who donate into a kettle. Thank you for your smiles, Christmas greetings, and blessings. Volunteers pack up the meal packages to be delivered to those in need.

Members of the McHenry County Sheriffs Office, McHenry Police Department, McHenry County Government Countyboard, numerous volunteers from various area churches and businesses have been working hard these past few weeks to coordinate Christmas meals for almost 300 people throughout McHenry County. The meals were picked up at the Crystal Lake Food Pantry and delivered. Thank you to everyone who was involved in helping bring a little bit of joy to our residents this Holiday Season.

Thanks to a team effort, 300 families received food packages.

Christmas tree recycling offered in McHenry County As you “undeck the halls” this year, do something good for the environment and recycle your Christmas tree. From Dec. 26 through Jan. 15 three drop off locations are available that will help keep your holiday tree out of the landfills. Trees are processed into mulch and mulch will be available free of charge at a later date.

HHS Robotics Team earns State Tournament bid after hosting successful competition Huntley High School’s Red Raiders VEX Robotics team captured a number of accolades at the school’s inaugural home tournament Dec. 15, with a showing strong enough to earn a bid to state competition.

Huntley’s Team 158C went undefeated during qualifying and was seeded 1st in the tournament bracket, which included 28 teams from eight schools. Team 158C’s performance earned Huntley’s first-ever bye in the first round of the singleelimination bracket tournament.

In addition to four HHS teams, competitors included teams from Jacobs High School, Lake Park High School, Lyons Township High School, Niles North High School,

Seneca High School, Stevenson High School and Winston Campus Jr. High School in Palatine.

In addition, Huntley’s Team 158B took home the Excellence Award, which is awarded to the top all-around team. That award qualified them a bid for the state tournament. They will join our Team 158H at the state tournament Feb. 23, 2019. Additional HHS teams will have a chance to qualify for state at upcoming competitions Jan. 5 at Glenbrook South and in Evanston on Jan. 19.

“We had an amazing day,” said Red Raider Robotics sponsor Amanda Henk. “Two of our HHS teams made history.”
