McDermott gets green light for expansion Business gets approval for expanded sales lot

The Orfordville Village Board convened on Nov. 27, passing a budget and addressing business with two tenants of the business park across Highway 11. A public hearing regarding the 2018 budget drew no members of the public, and so the board unanimously passed the 2018 general fund budget for $1.2 million. The 2018 local tax levy was set at $565,378. The board issued a conditional use permit to Bright Star Child Care, naming Connie Markee as the sole owner. Next the board discussed whether to issue a conditional use permit to Jack McDermott to expand the south-facing lot from five vehicles to up to 10 vehicles for sale. The board engaged in some debate on the matter, Village Trustee Gary Phillips questioned whether the board was setting a precedent McDermott said state regulations require automobile vendors to either provide or contract with a repair facility, among other regulations regarding hours, signage and others. “The service side and the sales side often go hand-in-hand,” McDermott told the board.

Village counsel Timothy Lindau said the village board has ultimate discretion in awarding conditional use permits, and could impose restrictions if the body felt it necessary. Lindau acknowledged the potential for perceived selective enforcement if permits were to be issued inconsistently. The board took a roll call vote. Trustees Beth Schmidt, Becky Strupp, Russell Rucker, and Board President Dave Olsen voted in favor. Phillips was the lone vote against. Phillips reached out after the meeting to explain his vote.
