As recreational cannabis sales again hit record, Illinois AG calls for federal rescheduling CAPITOL NEWS ILLINOIS

As Illinois’ recreational cannabis industry once again reported record sales for 2023, the state’s attorney general is calling on the federal government to reclassify the substance.

The U.S. Drug Enforcement Agency classifies cannabis as a Schedule 1 drug, meaning the federal government believes it has “no currently accepted medical use and a high potential for abuse.”

But Attorney General Kwame Raoul and his counterparts in 11 other states are calling on a reclassification to Schedule 3, meaning it has “a moderate to low potential for physical and psychological dependence.”

Raoul and the other attorneys general said the reclassification would allow states to continue to “set the standard” for legal products, would allow businesses to take ordinary tax deductions, and would increase the ability to research the substance to fully determine its effects.

“Illinois is one of several states that have established robust regulatory frameworks for legal cannabis sales,” Raoul said in a news release.

“State-regulated cannabis industries protect consumers from the dangers of unregulated products and the illicit market. Rescheduling cannabis will remove obstacles for legitimate businesses and allow them to better collaborate with

law enforcement and regulators.”

Last year, Illinois recreational cannabis dispensaries sold a record $1.6 billion of product, accompanied by a record number of sales to Illinois residents.

Sales to out-of-state residents, however, fell by $71 million from 2022’s total, marking the first drop in that category since cannabis was legalized on a recreational basis in January 2020.

The growth in 2023 marked a 5 percent increase from the year prior, meaning the pace of the industry’s growth is slowing. From its first year of legalization to its second, sales grew by 106 percent, while in 2022, growth was marked at 12

percent from the year prior.

Lawmakers introduce bill to create state prescription drug price oversight board A new bill in the Illinois General Assembly would create a board of health care experts that would have the authority to set price limits on prescription medications.

House Bill 4472 was introduced Jan.17 by Rep. Nabeela Syed, D-Palatine, and Sen. David Koehler, D-Peoria.

Using a variety of information related to the medication’s market, including the number of people taking the medication and its out-ofpocket cost, the board would assess its price. If the board finds it to be unreasonable,

Lawmakers clear path for assault weapon registration rules

Some members record symbolic objection, saying rules are too vague and complicated

New permanent rules will soon go into effect spelling out how people who own assault weapons and related items that are now heavily regulated in Illinois can register them with the Illinois State Police.

The legislature’s Joint Committee on Administrative Rules voted along party lines Jan. 16 to let the rules go into effect, ending months of negotiations and debate between supporters of the law and gun rights advocates.

“Obviously, this is an issue where there is a difference of opinion on a partisan basis, and I think you saw that play out today,” Sen. Bill Cunningham, D-Chicago, a co-chair of the committee, told reporters after the meeting.

The rules are the result of an assault weapons ban that state lawmakers passed last year in the wake of a deadly mass shooting at an Independence Day parade in Highland Park in 2022.

That law, known as the Protect Illinois Communities Act, bans the sale, purchase, manufacture, or possession of a long list of firearms that are defined as “assault weapons,” as well as several types

of attachments, large-capacity magazines and certain kinds of high-power ammunition.

Under that law, people who already owned such items before the ban took effect are allowed to keep them. But to do so legally, they were supposed to register those items with the Illinois State Police before Jan. 1.

Last fall, ISP published temporary “emergency” rules that went into effect Oct. 1, enabling people to begin filing online registrations ahead of the Jan. 1 deadline. But many gun owners, gun rights advocates, and state lawmakers pushed back against the rules, complaining that they were too vague in some areas, too complicated in others, and generally impossible to comply with.

In response, ISP held additional public hearings in October and November as it worked to craft permanent rules.

One of the concerns raised during the discussions focused on how ISP planned to collect and store information about the items people registered, and what the agency would do with that information if the law is eventually overturned as unconstitutional.

So far, the law has survived

legal challenges in both state and federal courts, but the National Association for Gun Rights, which is the major plaintiff in one of the federal lawsuits, has said it plans to file an appeal with the U.S. Supreme Court within the next several weeks.

Rep. Ryan Spain, R-Peoria, who also co-chairs the committee, said he was frustrated by the short timeframe used to adopt the new rules and by the way some issues were handled. He then offered a motion to prohibit ISP from adopting the rules, arguing that the rules do not meet a requirement in state statute that they be “simple and clear” so that people and groups affected by them can understand them.

That motion failed because it needed eight votes on the 12-member committee but only received six.

Spain then made a motion to “object” to the rules on the same grounds that they were not “simple and clear.” An objection has little practical effect on the rule, except that it requires the agency to respond to the objection in writing within 90 days before the rule can take effect.

That motion, which only

requires a simple majority of members taking part, passed on a 6-5 vote.

That vote allows ISP to move forward by adopting the permanent rules and enforcing them into the future. But it remains unclear how many assault weapon owners will comply with the law by registering those firearms.

According to data maintained by ISP, just under 30,000 individuals had filed registration forms ahead of the Jan. 1 deadline. Those registrations covered roughly 69,000 firearms that fall under the ban as well as nearly 43,000 accessories.

It is not known what percentage that represents of the total number of assault weapons and banned accessories in circulation in Illinois, but many people have suggested that a large number of gun owners will refuse to comply with the registration requirement.

Cunningham, however, said he was not concerned about speculation of widespread noncompliance with the law.

“I would just repeat what I said earlier, which is the law is in place, and I would encourage people to follow the law,” he said.

it could limit the amount wholesalers, pharmacies and hospitals can bill insurers and consumers for the drug.

The bill’s sponsors said it was an effort to limit health care costs across the board.

Dr. Anthony Douglas, general surgery resident at University of Chicago, said he sees patients every day who struggle to afford their medication—some of whom cut their pills or skip doses to make their prescriptions last longer.

“I cannot effectively care for patients if they cannot afford the therapies necessary to keep them well,” Douglas said at a Statehouse news conference to introduce the bill.

The five-person board

would be appointed by the governor and work with a bipartisan 15-member council of legislators and relevant experts to address the price of medications.

The board would be tasked with assessing high-cost drugs, like ones used to treat cancer, auto-immune disease, and diabetes, as well as other drugs that might impact the state health care system. The board members may receive compensation from a special fund created through an annual tax on prescription drug manufacturers.

The bill had not yet been assigned to committee as of Jan. 17, although House Speaker Emanuel “Chris” Welch signed on as a cosponsor.

Lake County to receive portion of grant to expand outdoor recreation

Eight Illinois communities will share nearly $2.4 million in grants to expand access to outdoor recreation, Gov. JB Pritzker and the Illinois Department of Natural Resources (IDNR) announced.

The grants come from the National Park Service’s Land and Water Conservation Fund (LWCF) and will be administered by IDNR. The LWCF program can provide up to one-half of a project’s funds, and when combined with the investment of local matching funds will support more than $5.4 million in local park land acquisitions statewide.

“IDNR is excited to play a small role in helping these exciting outdoors projects become reality,” said IDNR Director Natalie Phelps Finnie. “Conserving and protecting our land, water, and recreational opportunities is critical ensuring future generations have access to nature and the outdoors.”

The Land and Water Conservation Fund Act of 1965 was enacted to help preserve, develop, and ensure access to outdoor recreation facilities to strengthen the health of U.S. citizens. The law created the Land and Water Conservation Fund in the U.S. Treasury as a funding source to implement its outdoor recreation goals. The LWCF program receives its revenue from federal oil and gas leases on the Outer Continental Shelf.

Grant recipients include: • Wauconda Park District – $750,000 (Lake County) Acquisition of 4.4 acres along Bangs Lake that had been a privately owned marina and the only access point on the lake that can accommodate daily boat launches. Bangs Lake is a 306-acre natural glacier lake in the Fox River watershed that is a regional destination for boaters and anglers. Acquiring the property will enable the park district to preserve public access to the lake for future generations.

The district intends to continue marina operations, including boat slips, daily launches, and rentals for boats, kayaks, and paddleboards. Site improvements will address disabled accessibility, parking, boat slips, and appearance of the site.

• Wheaton Park District – $60,000 (DuPage County) Acquisition of a 0.78-acre parcel on the south side of Lincoln Marsh. The parcel is approximately 30 feet wide by 1,000 feet long and is currently improved with two sections of path that connect to the Lincoln Marsh.

•City of Calumet City – $375,000 (Cook County) Plans are to acquire 9.27 acres of land to expand Blues Water Run, which is currently a seven-acre park that includes a dog park, an entertainment venue, restroom facilities, a canoe/kayak launch, and general park activities.

• Campton Township – $750,000 (Kane County) Acquisition of a 130-acre site known as the Goldenstein Farm, which was identified more than 20 years ago by Campton Township as a priority for acquisition for public open space because of its old-growth woods, potential for prairie and wetland restoration, and wildlife habitat, and trail connections between multiple sites to expand public

Join the fight to help end homelessness by participating in the Lake County 2024 Point In Time (PIT) Count. Volunteers are needed the night of Wednesday, Jan. 31 to search across Lake County to interview, count, and offer assistance to unsheltered homeless people.

Currently, eight states and Washington, D.C., operate elections almost entirely by mail. William Cavecche, an election administrator in King County, Washington, which includes the city of Seattle, said that state passed a similar law in 2005 and immediately, two-thirds of the counties in the state shifted to vote-bymail systems.

“Speaking to someone who has run both polling-place elections and vote-by-mail elections, I can tell you from experience that vote by mail elections are significantly easier to administer,” he said.

Among other benefits, Cavecche said, in a voteby-mail election, there is no need to worry about problems that commonly occur at in-person polling places such as running out of ballots, voting machines breaking down or poll workers failing to show up.

He also said vote-by-mail elections are more secure because all ballots can be counted in a centralized location.

He said ballot counting can also be livestreamed on the internet to provide more public transparency.

The meeting was a subject matter hearing, meaning the committee only heard testimony and did not take action on the bill. But Rep. Maurice West, D-Rockford, who chairs the panel, said he intends to hold additional hearings during the legislative session, which began Jan. 16, and it’s possible lawmakers could vote on the measure in time to take effect for the 2024 general election in November.

Farewell to a hero

As the 2024 election season draws near, voters in Illinois will once again choose whether they want to cast their ballots in person or by mail.

But one lawmaker is proposing a bill in the Illinois House that could make that decision a lot easier, making voting by mail the default option for people in counties and cities that choose to go that route.

State Rep. Carol Ammons, D-Urbana, said voting by mail has been shown to be a more convenient and efficient way of running elections.

“Vote-by-mail has been proven by way of court order, as well as people’s utilization of vote-by-mail—I vote by mail—that it has been safe,” she said during an interview.

“There have been no problems. I have not missed a single election. And people who use it increase their voter participation.”

Voting by mail, often referred to as absentee voting, was originally intended for people who planned to be away from home on Election Day, particularly military personnel, as well as college students and people whose jobs required them to travel.

That often required voters to ask their state or local election official for an absentee ballot and, in some cases, explain why they wanted to vote by mail.

In more recent years, Illinois and other states have made voting by mail an option for anyone by adopting “no-excuse” absentee voting laws, meaning anyone could request a mail ballot without

giving a reason.

Illinois also gives voters the option of asking to be placed on a permanent voteby-mail list so they can automatically receive a mail-in ballot without having to fill out a new request for one each election cycle.

And in 2020, amid the COVID-19 pandemic, the General Assembly passed a law requiring local election officials automatically send vote-by-mail applications to every voter in their jurisdiction, instead of requiring voters to ask for one.

During a special meeting of the House Ethics and Elections Committee held recently in her hometown of Urbana, Ammons said voting by mail has become increasingly popular. But she said the multistep process of voting by mail is still inefficient because it requires voters to fill out and send in a vote-by-mail application to receive a ballot.

“But when we went back to look at the utilization of the ballots, the number that came back, and the cost associated with mailing a ballot, we realized as we talked to other jurisdictions that you would actually save the money if you simply mailed them the ballot,” she said.

Ammons is the sponsor of House Bill 4198, which would allow county clerks and other local election authorities to make voting by mail the default option in their jurisdiction. It would give them the option of mailing ballots to all registered voters in their jurisdiction, without requiring voters to ask for one. But it would still require local election authorities to offer in-person voting as well for

Lake County Sheriff’s canine unit records successful 2023

Lake County Sheriff John D. Idleburg is proud to announce an extremely successful year for the Lake County Sheriff’s Office Canine Unit.

In 2023, Lake County Sheriff’s Canines Teams were deployed 497 times to respond to various calls for canine assistance. 64% of those incidents originated from sheriff’s office calls for service and 36% of the incidents were assists to local municipal police departments.

During 2023, sheriff’s canine

teams located 72 people who were either missing and endangered, or individuals fleeing a violent crime. They located eight firearms during article searches, as well as significant amounts of fentanyl, heroin, methamphetamine, LSD, cocaine, and illegally possessed cannabis. Our electronics detection canine located 33 concealed electronic devices, resulting in the arrest of six individuals for sexually based offenses.

Community engagement is a key component for our canine

team, and last year our canines participated in 48 community canine demonstrations throughout Lake County.

On January 16, the Lake County Board read a ‘Special Recognition’ honoring the Lake County Sheriff’s Office Canine Unit.

Sheriff John D. Idleburg said, “We are grateful for the recognition and praise received by our county leaders at yesterday’s Lake County Board meeting. I could not be more proud of our ten canines and their partners. The

results produced by our canine unit shows what an incredible resource they are to the Lake County community. We are happy to assist our municipal neighbors, as proven with over 170 calls to provide canine assistance to are municipalities.”

Radon is an odorless and colorless gas that naturally occurs in rock and soil. It typically moves through the ground to the air above and into your home through cracks and other holes in your foundation. Your home traps radon inside, where it can build up.

Lake County unveils state-of-the-art vote-by-mail processing center

The Lake County Clerk’s Office proudly inaugurated its cutting-edge Vote-By-Mail Processing Center on Jan. 4, a significant milestone in the county’s commitment to accessible, secure, and efficient election administration.

The ribbon-cutting ceremony marked the official opening of this innovative facility. Funded by federal dollars, this groundbreaking project is a testament to the County Board’s dedication to advancing voting accessibility for all residents.

Speakers for the event included: Sandy Hart, Lake County Board Chair, Valentino Guyett, BlueCrest Director of Mail Operations, and Anthony Vega, Lake County Clerk.

The Vote-By-Mail Processing Center boasts impressive capabilities, with the ability to compile an outstanding 1,200 ballots per hour, setting new standards in processing efficiency. Moreover, the Processing Center’s infrastructure enables the swift handling and processing of each ballot on the same day that it is returned to the Clerk’s Office.

The following are tips on how to avoid being the victim of road rage: • If you are in the left lane and someone wants to pass, move to your right and allow them to pass • When merging, make sure you have plenty of room and use your turn signal • If someone cuts you off, slow down and give them room to merge into your lane • If a speeding driver is tailgating you, safely change lanes when able • Making gestures might anger the other driver; create distance and avoid confrontation • If another driver is acting angry, don’t make eye contact If you are the victim of road rage or believe a driver is following or harassing you, call 911 and/or go to the nearest police department to report it. Sheriff Idleburg partners with Illinois Sheriffs’ Association to award student scholarships The Illinois Sheriffs’ Association announces that it will be awarding over $58,000 in college scholarships throughout the State of Illinois to students wishing to pursue higher education during the 2024-2025 academic year. The scholarships are to be applied to tuition, books, and fees only.

The student must be enrolled full-time at a certified institution of higher learning within the State of Illinois, full-time. Online learning is acceptable.

Lake County Sheriff John D. Idleburg will be awarding two (2) scholarships in the amount of $500 for each recipient.

There will be no restriction on any applicant by reason of race, age, creed, color, sex or national origin.

The Illinois State Police (ISP) is launching an educational, public awareness campaign focused on reducing incidents involving road rage. The new campaign, “Road Rage. Don’t Engage.” is designed to raise awareness about an increase in road rage incidents leading to violence, as well as educate the public on the signs of road rage and tips on how to prevent and handle these situations.

“Although road rage is nothing new, we’re seeing people react more aggressively and dangerously,” said ISP Director Brendan F. Kelly.

“The message is simple – if you see or become part of a road rage situation, don’t engage. That extra car length you gain by cutting someone off, or arriving 10 seconds earlier by tailgating another person, is not worth your life.”

ISP developed a campaign to raise public awareness about road rage and the disturbing trend. The campaign consists of social media, including a social media toolkit, along with billboards and radio ads in strategic markets.

ISP Safety Education Officers across the state will continue to educate the public on the dangers of road rage and how to deal with the dangerous behavior.

According to an AAA Foundation for Traffic Safety study, when drivers explained why they became violent, the reasons were often trivial, such as the other driver wouldn’t let them pass or they kept tailgating. Almost 80% of drivers reported aggressive behaviors while driving, including speeding and following other vehicles too closely.

Sheriff’s reports

Impairment suspected in serious head-on crash Lake County Sheriff’s Traffic Crash Investigators continue investigating a Sunday evening head-on traffic crash.

On January 21, at approximately 8:15 p.m., Lake County Sheriff’s Deputies responded to Route 12 and Russell Avenue, Volo, for a head-on traffic crash. Sheriff’s deputies arrived and located two vehicles with heavy damage.

A preliminary investigation indicates a Ford Mustang, driven by a 24-year-old man from Fox Lake, was traveling northbound in the southbound lanes of Route 12. The driver of the Ford struck a southbound Mitsubishi Outlander, driven by a 36-year-old woman from Deerfield, head-on.

The driver of the Mitsubishi sustained critical injuries, consisting of a fractured spine and brain bleeding. The driver of the Ford sustained serious

injuries. A front-seat passenger in the Ford, a 23-year-old man who was not wearing his seat belt, sustained significant injuries, including not being able to feel his legs.

The two drivers and the passenger were transported to area hospitals via ambulance.

An open container of alcohol was located in the Ford, and impairment does appear to be a factor in the crash.

The crash remains under investigation by the Lake County Sheriff’s Office Technical Crash Investigations Team.

Coroner releases results for July 2023 inmate death

McHenry County Coroner, Dr. Michael Rein, released the final death certificate results for Colton Sabo, 31, who was found unresponsive in his cell at the McHenry County Cor-

rectional Facility on July 28, 2023. He was hospitalized and pronounced deceased the following day.

An autopsy was performed July 31 by Dr. Kristen Escobar, Forensic Pathologist. The final cause of death is undetermined, and manner of death is also undetermined.

Extensive toxicology testing and vitreous electrolytes were noncontributory to Sabo’s death. He was diagnosed at Northwestern McHenry with anoxic brain injury and cerebral edema. This was determined to have no significant cause to his death. Sabo did have a history of seizure disorder and polysubstance abuse.

The McHenry county Coroner was assisted by Northwestern McHenry Hospital, McHenry county Correctional Facility and McHenry county Major Incident Assistance Team for the investigation.

Coroner’s Office launches public data dashboards

On January 19, Lake County Coroner Jennifer Banek announced the release of two data dashboards that will track trends of overdoses and suicides throughout Lake County. These dashboards have been in the development process for the last six months in conjunction with Lake County Geographic Information System (GIS).

Both dashboards incorporate data from 2020 and will be updated on a weekly basis as investigatory information is available. Data on both dashboards can be queried by year and city/town and additionally include a visual mapping feature. “We feel it is important that our residents and partner agencies have data that is accurate, readily available, and in as close to real-time as possible as it relates to death trends throughout our county. This electronic presentation will help better illustrate where in the county we need to concentrate our

efforts regarding preventable deaths,” Coroner Banek said. Parameters have been set within the visual mapping that do not allow users to zoom into specific addresses.

The overdose and suicide dashboards are the first two to be released. Plans are in place to release a third dashboard focusing on homicide data in coming weeks.
