Court news Man in drug court found with pot, cocaine A preliminary hearing was scheduled for Jan. 16 for an Elkhorn man allegedly found with marijuana and cocaine while under bond conditions. Jacob A. Gust, 21, was charged Jan. 6 in Racine County Circuit Court with four counts of felony bail jumping; possession with intent to deliver marijuana; possession of cocaine; and operating a motor vehicle while under the influence, second offense. According to the criminal complaint, Gust was pulled over in Burlington on Jan. 5 after a taxi driver shouted, “That guy’s f---ed up,” and pointed out the car he was driving to an officer. Gust’s speech was slurred, his eyes were glassy and an odor of marijuana was emanating from the car. Gust denied smoking marijuana because he was participating in drug court and said no drugs were in the car. However, 45.6 grams of marijuana was found in the car, and, at the hospital, Gust produced a bag that contained 3 grams of cocaine, which he said he’d “crotched” during the traffic stop, according to the complaint. Gust admitted taking Xanax and said he and friends bought the marijuana together because they get it cheaper that way. Gust was under bond conditions at the time on a Walworth County charge of possession with intent to deliver marijuana and carrying a concealed weapon and was ordered not to possess

McCabe, 31, of Elkhorn; operating a motor vehicle while under the influence, fourth offense; violating a court order restricting operating privileges without an ignition interlock device; and operating a motor vehicle with a revoked license, second offense. McCabe was apprehended for drunken driving after she was involved in an accident at Highway NN and Weaver Road in the Town of Geneva at about 8:40 p.m. Dec. 1, according to the criminal complaint. McCabe told police she had come from the Como Inn, she did not have an ignition interlock device and her license was revoked, the complaint states.

Fleeing • James Edward Kalenian, 57, of Beaver Dam; attempting to flee or elude an officer; operating a motor vehicle while under the influence, third offense; and operating with a prohibited alcohol concentration, third offense. Kalenian allegedly fled from police on Highway B in Fontana on Oct. 5, according to the complaint. The officer terminated the pursuit after 1.7 miles when Kalenian continued to pull away from the officer, who was traveling 50 mph in a 25-mph zone, the complaint states. Kalenian was later found near his crashed vehicle with injuries consistent with the crash, the complaint states.

He told police he gave the dogs to a woman named Dee but, when video surveillance refuted that claim, admitted he fabricated that story, the complaint states. Unclassified Battery • Thomas C. Fry, 35, of Genoa City; misdemeanor battery and disorderly conduct, both with domestic abuse assessments and as a domestic abuse repeater; and criminal damage to property. The domestic abuse repeater status changes the misdemeanors to felony offenses. Fry allegedly hit his live-in girlfriend of seven months at their Town of Bloomfield home on Dec. 21 and damaged items in the home including a television and a kitchen window, according to the criminal complaint.
