Governor makes call to close bars, restaurants

“Our staff is working to quickly identify, interview and learn the risk for people who may have been in close contact with the first COVID-19 case in DuPage County,” said Karen Ayala, executive director, DuPage County Health Department.

“Our highest priority is the health and safety of all who live, work and play in DuPage County, and we will continue to use every available resource to prepare our communities for additional cases of COVID-19.”

News updates about the COVID-19 Coronavirus have been changing almost hourly, making your weekly newspaper behind the times before the presses even stop rolling.

What started as a mild threat heard on the news has now escalated to what could well be an illness that threatens the entire globe. Amid conspiracy theories of many levels to assertions that “it’s not that bad” to full-blown lockdowns of school districts, college and universities, government agencies and, by order of Illinois Governor J. B. Pritzker, all bars and restaurants.

make an intentional effort not to let our anxiety get the better of us.”

Dr. Weiner offers the following suggestions (below is a partial list, the full list can be found at theindependentnewspapers.com): • Limit the amount of time you spend reading about coronavirus news. It’s very easy to look online repeatedly, hitting refresh to see if the case count of infected individuals has risen in the last day, or last hour. While it is important to stay informed, remember that every time you expose yourself to disturbing news, you are stoking the fires of your own anxiety. “Choose one time per day to read about coronavirus news, and once you are updated, wait until tomorrow to check again,” said Dr. Weiner. “If you find that coronavirus news is all over your social media, consider reducing your exposure there as well.”

• Focus on what you can control to keep healthy. Let go of what you can’t. You can significantly reduce the risk to yourself and your family by following recommended guidelines from our healthcare institutions.

Then rest easy, knowing you’ve done your part to keep your family safe.

• Take precautions, but don’t go overboard. The CDC reports that preventative masks are most useful right now for containing germs if you’re sick, but not for keeping germs out when you’re in public. Also, people tend to touch their face more often when wearing a mask, which is associated with increased risk of contracting the virus.

• Don’t assume it’s a catastrophe: remember that, in all likelihood, you are going to be okay. “Remember: most people who contract COVID-19 will be just fine. That includes you and your family,” said Dr. Weiner.

• Engage in mindfulness meditation to reduce your anxiety. “We can’t always control [what] we’re exposed to in our life, but we can decide how we react to them,” he said.

“One of the best methods … is mindfulness meditation.”

Dr. Weiner recommends at least 10 minutes per day. If you’re unfamiliar with meditation, try a smartphone app that uses research-supported techniques and offers you training.

Park District announces closures Based on the rapidly evolving situation with COVID-19 and recommendations from public health officials to limit public gatherings, the Elmhurst Park District is canceling all programs and rentals as well as closing all facilities beginning Saturday, March 14, through Sunday, April 5. All permitted uses of athletic fields will also be cancelled. This includes the cancellation of the Bridal Swap at Wilder Mansion on April 2 and the new Adult Egg Hunt on Saturday, April 4 at Sugar Creek Golf Course.

While the Park District has no confirmed COVID-19 cases, it is exercising an abundance of caution and have based decisions on recommendations from public health officials to minimize exposure to participants and staff and limit the spread of the virus while reducing strain on the healthcare system.

While facilities will be closed to the public, the

District will continue to operate and staff will be available via phone and email during normal business hours Monday through Friday from 9 a.m. to 5 p.m.

Facility closures include, but are not limited to, Wagner Community Center, Courts Plus, Sugar Creek Golf Course, The Abbey, The Wilder Mansion, Wilder Park Conservatory, and The Hub. The only exception at this time is to the Park Board meeting on Monday, March 30.

“We have a responsibility for the health and wellbeing of our community and staff and we’re playing our small part in slowing the spread of this virus,” said Executive Director Jim Rogers.

Participants will be refunded or credited for any cancelled programs, rentals, and events.

“We will evaluate memberships and based on the length of closure determine a manner in which to compensate members,” Rogers said.

In a proactive response to COVID-19, Mayor Steve Morley along with three aldermen have called a special meeting to discuss potential civil emergency declaration plans.

Although the regular City Council meeting was cancelled, a special meeting was held on Monday, March 16, at which City officials were to discuss an ordinance that grants the Mayor temporary emergency executive powers to amend the City’s code to call for a civil emergency declaration.

Current State statutory law has specific requirements, which restrict most remote or electronic attendance for Alderman at city council meetings. A temporary change in code will allow for emergency action in the event that city council does not have the ability to meet to approve emergency operating procedures.

The ordinance defines the nec-

essary and appropriate established standards in determining if a state of emergency exists and allows the Mayor to temporarily exercise limited power and executive order during the possible state of emergency. If necessary, the declaration will be used to ensure that the effects of COVID-19 are mitigated and minimized and that residents and visitors in the City remain safe and secure.

Examples of these limited orders or regulations that could be declared in a civil emergency include temporary suspension or relocation of all City Council, Commission and Board Meetings, the ability to make provisions for temporary emergency housing, approval for applying for local, state or federal assistance, approval to transfer functions of City departments and agencies during the event that disaster services are needed, and the ability to close public facilities, along with any other action deemed reasonable and necessary to

address the civil emergency.

If approved, the ordinance establishing temporary executive power will expire at the next regular City Council meeting unless extended for due cause by the City Council.

City Council Members will vote to expire or extend the ordinance at

the subsequent regular City Council meeting.

Illinois Tollway to implement all-electronic tolling as precaution against spread of Coronavirus In an effort to mitigate the spread of the coronavirus, the Illinois Tollway will be temporarily converting to all-electronic tolling. By issuing a disaster proclamation, the County officially activated its Emergency Operations Plan and will continue to work with local, state, and federal partners to respond to the COVID-19 outbreak. Governor J.B. Pritzker issued a disaster proclamation on March 9 that would allow Illinois to receive federal funds to assist with the statewide response to coronavirus. Chairman Cronin made the proclamation after consultation from the DuPage County Health Department and the DuPage County Office of Homeland Security and Emergency Management.

“By proclaiming a state of emergency in DuPage County, we are simply continuing the next phase of our response to the coronavirus,” Cronin said. “This proclamation provides an avenue to access additional funding for planning and response efforts. We want to assure residents we are in daily contact with the DuPage County Health Department and the DuPage County Office of Homeland Security and Emergency Management, as well as other local, state and federal agencies to minimize the impact of COVID-19 on our community. It is vitally important that we

take this situation seriously, that we rely on data and best public health practices as we provide guidance to our residents.”

Governor shuts down bars, restaurants On Sunday, March 15, Gov. JB Pritzker ordered all Illinois bars and dine-in restaurants to close in light of the threat of the COVID-19 Coronavirus. The temporary closure begins at the end of the business day Monday, March 16 and continues through Monday, March 30. Yes, that includes St. Patrick’s Day, to the distress of the owners of many establishments.

Delivery, drive-thru and curbside pick-up service will still be allowed.

Pritzker made the announcement during his daily update on COVID-19 in the state. He went on to say there are now 93 cases of COVID-19 confirmed in the state.

That is 29 new cases since Saturday’s announcement. Those cases include the two announced in Sangamon County Saturday night. New counties impacted are Champaign, Clinton, Sangamon, Whiteside, and Winnebago counties. Other locations with cases include Chicago and Cook, Cumberland, DuPage, Kane, Lake, McHenry, St. Clair, and Woodford counties.

Michelle “Chelle” T. O’Connell, 72 Michelle “Chelle” T. O’Connell, of Addison, formerly of Elmhurst, died peacefully on Tuesday, March 10, at Asbury Nursing Home in Aurora, at the age of 72. She was born in Buffalo, New York. She is survived by her daughter Gillian, son Joseph, and her brother Hogarth. She received a Bachelor of Arts degree at Hollins College and a Masters in Library Science with an emphasis on Information Storage and Retrieval at the University at Buffalo. She also earned her real estate license in New York State. She was part of the inaugural women’s class at the Buffalo Rotary Club and is a Rotary Paul Harris Fellow. She served as Marketing Director at the Elmhurst YMCA and, after a term as Executive Director of the Park Ridge Chamber of Commerce, incorporated two business and two LLC’s. She was on the Board of Directors for Elmhurst Chamber of Commerce, on the Patient Family Advisory Council for Elmhurst Memorial Hospital, and was co-President for the Women’s Club of Addison. She embraced technology and always wanted to help others achieve their dreams and live a better life. She was a member of Calvary Episcopal Church of Lombard. Visitation will be held at Humes Funeral Home in Addison on Saturday, March 21, from 1 to 3 p.m.,

Dorothy M. Fuller, 91 Dorothy M. Fuller, long-time resident of Elmhurst and former resident of Glen Ellyn, passed away March 9, at the age of 91. She was the beloved wife of the late Frederick Fuller for 61 years, until he passed away in 2012.

They spent most of their married life in Elmhurst, where they raised two daughters, Cynthia Fuller and Pamela (Andy) Spencer.

She was a loving and involved grandmother of five: Laura Perout (Ryan) Sandahl, David (Elizabeth) Perout, Dan (Jessica) Perout, Kayla Spencer, and Nolan Spencer. She had six great-grandchildren. Dorothy believed strongly in the value of education. She was valedictorian of her graduating class from Glenbard West, and she was one of five women graduates from the Northwestern School of Commerce in 1950. She participated for more than 30 years in P.E.O., an international philanthropic educational organization for women.

She loved music and taught piano to her daughters, grandchildren, and others for many years. She also

played the organ and sang in church choirs and other groups most of her life. She had wonderful long-time friendships, some going back to her childhood. She loved to travel, enjoyed bridge, rarely missed a day of swimming, was a skilled seamstress, and spent countless hours attending her grandchildren’s many activities. She leaves a legacy of an appreciation for the beauty of nature, the love of music, the importance of helping others, the value of hard work, and dedication to family and friends. The memorial service will take place at a future date due to current precautionary measures. In lieu of flowers, donations would be appreciated to P.E.O. Kathleen Frett, 78 Services Saturday Kathleen Frett, age 78, passed away on Friday March 6. She was born October 10, 1941 in Iowa to Robert and Margaret Dugan. She was raised in Chicago during her younger years, and in Elmhurst throughout her teens. In her adult years, she worked as a payroll clerk. She met her husband of over 40 years at Elmhurst College in the fall of 1976, and achieved her goal of earning her college degree in 2001. She was a loving wife and mother, who enjoyed socializing with her friends, and in her later years, traveling to places on her bucket list. She is survived by her

husband, Bernie, her daughter, Kate, her brother, Michael (Nancy), and many nieces and nephews. Memorial visitation at Visitation Catholic Church, 779 S. York Rd., Elmhurst from 10 a.m. until time of Funeral

The Elmhurst Police Department recently reported the following arrests and citations.

Persons charged with domestic battery are not named in order to protect the privacy of victims. Readers are reminded that an arrest does not constitute a conviction, and that subjects are considered innocent unless proven guilty in a court of law. Juveniles age 17-or-younger are not named.

Assault, battery March 7 Joseph Orrico, 18, of Oak Brook, was charged with battery, resisting a police officer, consumption of alcohol by a minor and attempted possession of fictitious identification in the 600 block of S. Saylor at around 11:48 a.m. Police said that subsequent to a check on well-being of an intoxicated subject, Orrico ran from officers and attempted to strike another person. According to police, Orrico initially resisted the officer while attempting to take Orrico into custody.

March 5 A victim at a store in the 600 block of N. York told police at around 7:06 a.m. that an unknown suspect described as a white male threw yogurt at him and punched him in the face. The unknown suspect left the scene in a black Jeep Cherokee. Officers searched the area with no results; the victim declined to investigate the matter and did not wish to pursue charges.

Criminal trespass, criminal damage March 10 A victim in the 100 block of N. York told police at around 3:24 p.m. that an unknown suspect(s) keyed the driver’s side door of her 2017 Toyota Rav4 while it was parked at the above location.

A complainant at a funeral home in the 1300 block of S. York told police at around 7:08 p.m. that an unknown suspect(s) damaged a stone pillar located in the parking lot of the funeral home. The pillar appeared to be knocked off of its base and several stones in the pillar were knocked loose.

March 7 While assisting another with an unrelated traffic stop near Parkside and Vallette at around 8:05 p.m., police said an officer observed Michael Lestina, 25, of Addison, pull on the rear car door handle of a fully marked squad car. Lestina, police said, was found to be intoxicated and was subsequently arrested for attempted criminal trespass to a vehicle.

Domestic battery, domestic incident, disorderly conduct, disturbance March 11 A 24-year-old Elmhurst man was charged with two counts of domestic battery in the 600 block of Crockett at around 2:33 a.m. Police said officers responded to a report of an intoxicated suspect who was yelling and slamming doors in the home. The victim told police that the suspect poked her in the forehead. Officers observed a red abrasion on the victim’s forehead.

March 9 Eliot M. Pontius, 57, of Berwyn, was issued a citation for disorderly conduct in the 500 block of Howard at around 11:36 a.m. Accord-

CALL 800-222-TIPS ing to police, a complainant related that Pontius made a delivery at the residence, walked to the side of the home, and urinated next to the garbage cans. Police said Pontius denied urinating; however, the officer stated there was an odor of urine next to the garbage cans.

DUI, DUI-drugs, illegal transportation of alcohol, open alcohol in public, consumption of alcohol by a minor, public intoxication March 9 Daniel P. Lynch, 37, of Joliet, was charged with DUI and speeding subsequent to a traffic stop near Lake and Willow at around 3:44 p.m.

March 7 Brittany Acovelli, 25, of Lombard, was charged with DUI in the 100 block of E. First at around 2:13 a.m. Police said that subsequent to a driver sleeping behind the wheel, Acovelli was found to be driving while under the influence of alcohol.

Jerri Hall-Gortowski, 63, of Elmhurst, was charged with DUI, resisting a police officer, driving on the wrong side of the road, improper lane usage and no insurance subsequent to a traffic stop near Mitchell and Vallette at around 8:18 p.m.

Susan Krueger, 64, of West Chicago, was charged with DUI and failure to signal when required subsequent to a traffic stop near St. Charles and Route 83 at around 2:15 a.m.

Lolita Phillips, 46, of Villa Park, was charged with DUI-drugs, no valid driver’s license and improper lane usage subsequent to a traffic stop near Riverside and Route 83 at around 6:01 a.m.

Cydney Robinson, 28, of Bellwood, was charged with DUI, improper lane usage and no insurance subsequent to a traffic stop near St. Charles and Kenmore at around 1:49 a.m.

Fleeing, eluding March 9 Police said that subsequent to an investigation of a suspicious vehicle near Riverside and Route 83 at around 8:41 p.m., the vehicle was reported stolen out of Hammond, Ind. An officer attempted to conduct a traffic stop and the vehicle accelerated at a high rate of speed.

The officer ceased following the vehicle and returned to patrol.

March 5 Doreea Haden, 20, of Mundelein, was charged with leaving the scene of a property damage accident, failure to reduce speed to avoid an accident and no insurance near North and Route 83 at around 10:41 a.m. Police said a reporting officer located Haden and another suspect who fled the scene of a vehicle crash.

March 6 Police said officers responded to a business in the 200 block of N. Route 83 at around 7:40 p.m. for the report of a disturbance. Officers met with the complainant who stated she witnessed both parties involved in a verbal argument. No injuries were reported and both parties were released from the scene. Upon further investigation it was determined the suspect had given false information. An inquiry was conducted on the suspect’s name and was found to have an active warrant out of Lake County. The case is pending investigation.

Identity theft was reported at a business in the 400 block of W. Fullerton at around 2:36 p.m. A complainant told police that a check was mailed to the business, but it was never received. The complainant learned that the suspect(s) opened a fraudulent bank account using the victim company’s name. An investigation is pending.

Theft/burglary/attempted theft or burglary/identity theft/fraud/forgery/ deceptive practice/ obstruction/robbery March 11 Theft was reported in the 700 block of Larch at around 6:44 p.m. A victim told police that while he was a work, an unknown suspect(s) removed his wallet from his unsecured locker.

The victim’s driver’s license and Illinois state ID card were entered into LEADS. March 3-March 10 Residential theft was reported in the 200 block of E. Fremont. A victim told police that upon returning home from an out of town trip, she found her PlayStation 4, one console controller, and a silver/green ring were missing from her apartment. An investigation is pending.

March 10 Burglary to a vehicle was reported in the 200 block of W. First at around 8:44 p.m. A victim told police that an unknown suspect(s) shattered the rear passenger window of her secured gold Honda Accord, while it was parked in the parking lot and removed her tote bag.

The victim’s cell phone was located in the area of I-290 and I-294 and was returned to her. The victim’s driver’s license was entered into LEADS. Burglary to a vehicle was reported in the 100 block of S. West at around 9:07 p.m. A victim told police that an unknown suspect(s) smashed the front driver’s side window of her secured Hyundai Tucson while it was parked in the parking lot. The suspect removed a small backpack.

Identity theft was reported in the 300 block of S. Kenilworth at around 9:36 a.m. A victim told police that she received an email from American Express notifying her of a new line of credit. The victim contacted American Express and informed them that she never applied for a credit card. No charges were made to the account. She closed the account and contacted the credit bureaus.

March 8 Theft was reported at a business in the 100 block of N. Addison at around 4:37 p.m. A reporting officer met with a victim who reported her black key fob and sunglasses were stolen from a cubby at the above location. The case is pending investigation.

March 6 Identity theft was reported in the 100 block of W. Brush Hill at around 12:21 p.m. A victim told police that he was notified by All Tax Solutions Services Inc. that his 2019 taxes were refused to be e-filed, due to his Social Security number had already been used to file taxes. The victim contacted the IRS and filled

March 4-March 5 Identity theft was reported at a business in the 500 block of W. North. A complainant reported an unknown suspect made two counterfeit checks using the company’s name and bank information. The counterfeit checks were cashed at unknown locations sometime between the above dates. The case is pending investigation.

March 3 Identity theft was reported in the 400 block of E. Huntington at around 2:30 p.m. A victim told police that she received a collection notice for dental services from Aspen Dental.

The victim contacted Aspen to report the error and learned the bill was for services provided to the suspect in Goodyear, Ariz.

Feb. 28 Identity theft was reported in the 100 block of Lawndale at around 9:53 a.m. A victim told police that an unknown suspect(s) used his personal information to open several credit cards, a checking account, and personal loan.

A reporting officer provided the victim with information on how to protect himself against identity theft.

Identity theft was reported in the 300 block of N. York at around 11:05 a.m. A victim told police that an unknown suspect(s) used her business information and forged her signature on several fictitious prescriptions and were submitted to two separate Walgreens stores in Wheaton. The reporting officer will follow up with Walgreens for possible suspect information.

Jan. 9-Jan. 10 Forgery was reported in the 300 block of W. Lake. Police said that subsequent to an investigation into checks, which were stolen out of the mail sometime between the above dates, it was learned that the victim had a check stolen. The suspect attempted to cash the check through a mobile deposit. An investigation is pending.

Dec. 12, 2019-Jan. 30 Identity theft was reported in the 200 block of Forest. A victim came into the police station to report an unknown suspect(s) made several unauthorized transactions with his credit card between the above dates. There were 46 unauthorized transactions. The reporting officer provided the victim with information on how to protect himself against identity theft.

Dec. 6-Dec. 31, 2019 Theft was reported in the 200 block of Oneida. A complainant told police that she is prescribed Hydrocodone. Towards the end of December, the complainant noticed about 17-20 pills were missing from the bottle. There have been construction workers and various other people in her home and she does not know who may have taken the pills.

The Illinois Gaming Board has ordered all 10 casinos in the state to suspend operations for 14 days starting Monday, citing public health concerns over the outbreak

Suspicious circumstances reported at bank The complainants, employees at a bank in the 400 block of W. Lake, told police that on Jan. 31, a suspect entered the bank and inquired about how much it would be to open a savings account. The subject got upset when he was told it would be $200. He looked around the bank for a short time and left on foot towards a hotel.

On March 9, two suspects entered the bank; one suspect asked about bank accounts while the other was scanning the area. They both left a short time later on foot towards the hotel. The suspects matched the description of the armed robbery suspects in a Northlake incident.

One of the suspects was described as a black male, around five feet seven, with an average build, a medium complexion, wearing a black beanie hat, a black jacket and baggie blue jeans. The other suspect was described as a black male, around six feet, with a thin build, a dark complexion, wearing a black beanie hat, a black jacket and baggie pants.

Women observed allegedly stealing on surveillance video, police say Janice M. Prensy, 55, of Bensenville, was charged with retail theft at a store in the 300 block of S. Route 83 on March 11 at around 12:21 p.m.

Police said a loss prevention employee observed Prensy on video surveillance concealing earrings, a necklace, and several items of clothing before she exited the store without paying for the merchandise. According to police, Prensy admitted to stealing the items.

Two friends, attempting to gain balance, fall through store window On March 7, police officers responded to a store in the 400 block of S. Spring at around 9:28 p.m. for the report of ambulance assist. A reporting officer met with one of the parties who stated he lost balance while walking, grabbed his friend in attempt to regain balance. Both subjects then fell through the store’s front window shattering it and causing injury.

Both parties were transported to Elmhurst Hospital for treatment of their injuries. A key holder of the business was contacted and the front window was boarded.

Last year the Elmhurst Eagles had three football teams advance to the Super Bowl and two teams won the Super Bowl. There were three cheer teams, which advanced to the State Finals with Varsity taking home a 1st place win. The 5th grade team took 2nd and the 4th graders took 3rd. Overall, the Elmhurst Eagles cheer teams brought home 15 first place wins throughout our competition season. “The public health of patrons, casino employees, IGB staff, and others is of paramount importance,” the board said in a statement March 13. “The board is continuously monitoring developments and will update licensees and the public as frequently as possible.”

Gaming Board Administrator Marcus Fruchter said in a letter sent to the casinos that before the end of the 14-day period he would review the public health situation and decide whether the suspension of operations should be extended.

The action was just the latest in a series closures and event cancellations that have occurred in the past week as the number of people in Illinois diagnosed with the virus has grown to more than 40.

Earlier on March 13, Gov. JB Pritzker ordered public schools to close. That started on Tuesday, and schools will remain closed through March 30. He has also ordered the cancellation of public events that draw more than 1,000 people.

Additoinally, the Illinois General Assembly has said it will not reconvene until at least March 24.

Take coronavirus seriously … and patronize our local businesses The coronavirus (COVID-19) has, of course, been front and center in the news for the past several weeks. Every day, there’s a new story about how the coronavirus has spread and who has tested positive (actor Tom Hanks and his wife being the most well-known); how the stock market has nosedived; and how daily life is being altered or disrupted.

Events that draw large crowds have been cancelled in an effort to curb the spread of coronavirus— such as St. Patrick’s Day parades in Chicago and the suburbs, and various conventions in the city itself (an example being the annual World Congress of Cardiology convention which was expected to bring 18,000 people to McCormick Place).

The travel industry, as we know, also is taking a huge hit. Perhaps you have already postponed or cancelled a planned vacation or trip overseas, or cancelled a cruise.

Nationally, many colleges and universities have closed (or are in the process of closing) campus classrooms and dorms, and moving classes online. Locally, it was announced last Friday that all public and private schools have been closed until the end of March.

All of March Madness—i.e., the NCAA men’s and women’s basketball tournaments—has been cancelled. The remainder of the NBA and NHL regular seasons have been suspended indefinitely.

Major League Baseball announced it has suspended spring training and will delay the start of the regular season. Popular TV shows, as well as late-night talk shows, now have no studio audiences.

And on Sunday, the surprising announcement was made by Gov. JB Pritzker that all bars and dinein restaurants will be closed until March 30—with the exception being restaurants that have delivery, curbside and drive-up options.

It can all make your head spin. It probably already has.

What can you do to reduce the chances of contracting the coronavirus? A notice posted

outside of an area municipal building succinctly sums up steps you can take: • Wash your hands often with soap and water for at least 20 seconds. If soap and water are not available, use an alcohol-based hand sanitizer.

• Avoid touching your eyes, nose and mouth with unwashed hands.

• Cover your cough or sneeze with a tissue; then throw the tissue in the trash. (We will add here that if you don’t have a tissue handy, cough or sneeze into your elbow.

This can effectively prevent fluids from spreading.)

• Avoid close contact with people who are sick.

• Clean and disinfect frequently touched objects and surfaces.

• Stay home when you are sick.

Please take the above hygiene recommendations seriously. The health and safety of you and your loved ones is, and has to be, your top priority.

However, if you are healthy, we urge you not to give in to outright fear and panic. Try to go about your normal routine as much as possible. If you do go out, the Centers for Disease Control and Prevention urges social distancing—keeping a distance of six feet from other people.

And remember to support our local businesses! It goes without saying that they are the lifeblood of our community.

That local business owner and their employees—many of whom are your neighbors and friends— depend on your patronage.

With regard to our restaurants, we strongly urge you to place orders often with those restaurants that have drive-up, curbside and delivery options.

And when they do re-open, get back out to your favorite restaurant or bar!

Not making that phone call to place an order—or not doing business with local companies, shops and retailers—will hurt their business and hurt the local economy, in general. We think you’ll agree we don’t want to see that scenario play out.

Senator passes plan to curb food waste

State Senator Suzy Glowiak Hilton (D-Western Springs) advanced a bill from the Senate Judiciary Committee that would allow state agencies that purchase food through a contract to donate leftovers.

“Millions of Americans struggle with hunger while billions of pounds of food are wasted,” she said. “The state needs to lead by example and

do all it can to curb food waste and ensure that the most vulnerable of us are fed.”

The U.S. Department of Agriculture estimates that 30-40 percent of the total food supply is wasted each year. Most food waste occurs at the retail and consumer levels.

Senator Glowiak Hilton’s measure requires each state agency that purchases food through a contract to adopt policies that allow for the donation of leftovers. Food can be given to food banks at homeless shelters, food pantries, soup kitchens, and other non-profit organizations.

Senate Bill 3036 passed the Senate Judiciary Committee and awaits consideration before the full Senate.

Conroy bill to better protect families of victims of sexual assault A new measure introduced by state Rep. Deb Conroy, D-Villa Park, will make it easier for the families of victims of sexual assault and violent sexual crimes to file no contact orders against the perpetrator.

“Decades ago, our community experienced an unthinkable tragedy that resulted in the sexual assault and murder of a young Elmhurst woman,” Conroy said. “While the perpetrator was thankfully convicted and sentenced, we learned after his release from prison that there were fewer protections available to the victim’s family members. Families of victims of horrific crimes like this go through enough already.

They shouldn’t also have to live in fear that the

offender can freely contact them.”

House Bill 4790 allows the relatives of sexual assault victims to file a petition for a civil no contact order against the perpetrator, which would essentially ban contact between the perpetrator and the victim’s family members.

“This bill helps give family members the peace of mind they deserve by adding another layer of protection and distance between them and the offender,” Conroy said. “It’s my hope that this will give families another tool to help them recover, grieve, seek justice, and most importantly, begin to rebuild their lives following tragedy.”

The Brian E. Wagner Scholarship Fund (BEWSF) recently hosted their 10th annual Bags for Wags charity event, raising $10,000.

The outing drew residents of Elmhurst and the surrounding area to

celebrate Brian Wagner’s memory.

The tournament sold out for a third consecutive year and a total of 36 teams competed.

About the scholarship The BEWSF continues to stand by its mission to encourage emerging young leaders to make a positive impact in their lives and toward the well being of their communities through volunteer service. The cause commemorated the life of Brain Edwin Wagner who tragically passed away in an auto accident several decades ago, while he was a student at York High School. Although he never had the chance to pursue his dreams in college, Brian’s ambition is remembered through the recipients of this scholarship. Those who receive it proudly carry on his legacy of excellence. The organization has bestowed this honor upon more than 25 college-bound high school students from Fenwick, IC Catholic Prep, Montini Catholic, Timothy Christian and York Community High Schools.

The 2020 awardees will be announced this spring. All will receive money to use towards tuition for college enrollment in the fall.

Students who wish apply for the scholarship award will have the opportunity to tell their personal stories and share experiences of how their leadership endeavors have affected their communities for the better. The ideal candidates will possess Brian’s most admirable qualities: compassion, integrity and resilience.

Hops for Humanity (slogan: Good beer doing good) presented a check for $6,000 to ‘Youth Outlook’ at Bethel United Church on Monday, March 9. The group maintains several safe meeting places for LGBTQ youth in Illinois. Holding the ‘big check’ are Youth Outlook Executive Director Nancy Mullin, Elmhurst resident Stephanie Wargin, who nominated the group for Hops’ consideration, and Site Leader Maddi Wrzectiona.

The Elmhurst Rotary Club is again offering the Service Above Self Scholarship for an outstanding high school senior. The college-bound student will receive $4,000 this year, which is renewable for three successive years and a total of $16,000.

“Judging will be based on the student’s commitment to helping others through volunteering, service projects and community-based initiatives,” said David McKenna, Elmhurst Rotary president. “Service Above Self is Rotary’s motto, so we want to encourage and reward a student that finds real joy in serving others.”

Applicants must be graduating this year from IC Catholic Prep, Timothy Christian or York Commu-

nity high schools. Financial need will be considered.

Elmhurst Rotary has a long-standing commitment of helping deserving students attend college. Since 1955, more than 400 students from IC Catholic Prep, Timothy Christian and York Community high schools have received in excess of $500,000 in scholarships.

The club’s 45 members join fellow Rotarians around the world in support of the Rotary International Foundation’s efforts to promote peace, fight diseases, provide clean water and address education and literacy problems.

Spring sports seasons put on hold due to coronavirus concerns Area high school teams in wait-andsee mode

Area high school spring sports seasons were brought to a halt late last week after Illinois Governor JB Pritzker announced the mandatory closing of all Illinois schools for a two-week period from March 17-29 amid the coronavirus pandemic.

But prior to Pritzker’s announcement, several area high schools already had made plans to curtail extracurricular activities. York High School in Elmhurst was first out of the gates in putting a halt to all sports practices and games per District 205 mandate with all activities suspended until further notice from the superintendent, athletic director Rob Wagner told the Independent.

Addison Trail athletic director Matt Thompson and IC Catholic Prep athletic director Michael Fahey also told the Independent of activity hiatus plans ahead of Pritzker’s announcement last Friday. Timothy Christian, whose boys basketball team was in Peoria preparing to play in its first state semifinal in 40 years when the IHSA cancelled the tournament last week amid coronavirus concerns, also had laid out the school’s overall plan of attack ahead of Pritzker’s announcement.

“I’m heartbroken for our boys basketball team,” Timothy Christian Schools superintendent Matt Davidson told the Independent. “Wow. These are extraordinary times, but God is faithful—always. He never fails—never.”

Fenton athletic director Todd Becker told the Independent late last Friday that as of now, all of the Bensenville school’s activities, practices and games are cancelled until April 6.

IC Catholic Prep’s Fahey noted the school cancelled both the baseball and softball teams’ spring break trips to Florida the day before Pritzker’s announcement. “Before we made our announcement we already had games the week of March 16 (this week) cancelled because of other teams making cancellations,” he said. “Overall, we didn’t have too much going on during spring break.”

IC Catholic Prep teams practiced last Friday before the Archdiocese of Joliet and then Pritzker made their announcements.

“We have to wait and see how this all unfolds,” Fahey said. “It’s the most logical, smartest and safest thing to do right now. Hopefully we can get back into the swing of things after spring break. Some schools have announced up they are going

to cancel all athletic events up until mid-April. We do have early to midApril games affected and cancelled.

We haven’t made a decision on any games past March 30. Hopefully it doesn’t go any further into April, but you don’t know when this will slow down. We have to play it by ear, but we won’t take any chances. The kids will do e-learning and will continue to be taught while they are home.”

IC Catholic Prep’s baseball team was slated to play at Disney’s Wide World of Sports. “Once Disney World was shut down, that made it obvious,” Fahey said. “The teams had fundraised for those trips and there are some families that are still planning on going for vacation. We know the seniors are disappointed about the trips, but in hindsight when you look back at it, it’s probably smart that we made these moves now.”

coach Mike Kennedy had some tough conversations with his players. “It’s unfortunate to have those types of conversations with the kids,” he said. “I feel bad for our seniors. We don’t play a lot of games during this time, but that’s not how you want to start your senior year.

That being said, you 100 percent have to go on the side of caution.

It’s nice that we are being proactive instead of reactive. The best-case scenario is nobody gets the virus and everything works out well. We have to be safe under these kind of circumstances.”

Kennedy said his team will miss at least eight games using April 4 (a Saturday) as a possible return barometer.

Kennedy said his staff had a feeling last Thursday that an announcement such as this was coming. That greatly altered that day’s practice plan.

A great start for the Dukes

“We had one last practice Thursday,” he said. “I walked out to the field. I knew it was coming. I took out three new pearls and threw them out there and told the kids to go play and pick teams. I sat back and watched them play and have fun.

We weren’t going to do drill work.

Let them go play. It could be weeks before they have a chance to do it again. The tough part was getting them off the field. It was very reminiscent of a sandlot game. It was fun and it was fun to watch. There was no coaching going on. I was a spectator and watched. It’s what I get to hold onto for three weeks, seeing those guys enjoying baseball in its purest form.”

Kennedy noted Addison Trail had been outdoors five times for practice prior to the suspension notice. “It was great and awesome,” he said.

“Our field was ready to go by the third day of practice. We had been

talking to Glenbard East about moving up our season opener to whatever day looked the best (this week).

That’s not going to happen.”

Kennedy said the key will be what happens when school and activities are given the high sign to resume.

“When we get out of hiatus, how are we going to respond to this?” he asked. “That’s the question every team in the state has to answer. Do we come back and hit the ground running? Some pitchers will not have done any organized baseball in two or three weeks and then have to jump right into games. How are you going to adapt and how will things progress? You have to be prepared and you have to be ready. The teams that are the most prepared and disciplined will be the most successful.

We have a good handle on that stuff.

You always shoot to improve and be better than before, and that, of course, is our goal.”

York boys water polo team has necessary firepower Dukes looking to improve on last year’s 23-win mark

York boys water polo coach Brian Drumm reeled off a stat he’s hoping will be changed to his team’s favor this year.

Drumm noted Lyons Township has beaten York in the West Suburban Conference final every year since 2016.

“They are strong again this year,” he said. “Oak Park-River Forest is always at the top of the conference standings as well, so we know they will be strong. We have an exciting group this year, too, so it will certain-

ly be a battle.”

The Dukes went 23-9 last year and 4-1 in WSC play to finish second in the league.

And the good news for York is a hearty amount of talent returns from that team in the form of seniors Carson Hicks, Jay Jensen, Will Yasdick and Michael McKenna, along with juniors Andrew Hausoul and Jacob Dunlap. Yasdick and Dunlap also were starters last year, while McKenna started in 2018.

Hicks scored 88 goals last year for the Dukes, while Jensen had 64 goals and 54 assists. Hausoul had 31 goals and 32 steals.

Hicks was a third-team all-state pick last year, and also made the firstteam all-sectional and all-conference lists. Jensen was second-team all-sec-

tional and first-team all-WSC, while Hausoul was second-team all-sectional and second-team all-WSC. Yasdick was third-team all-sectional.

This returning group also features plenty of future college athletes.

Hicks will play water polo at Salem University, while Jensen is headed to Wisconsin-Milwaukee for swimming. Yasdick will run cross country at Loras, while Liam Enright will play football at Wisconsin-Eau Claire.

Key newcomers to the team include juniors Josh Allen and Colin McNamara, along with sophomore goalie Jack Schroeder.

“We return a veteran lineup that has played a lot of varsity water polo together,” said Drumm. “We have an entire lineup of players that has started multiple games at the varsi-

ty level. This opens up what we can do at practice. In our first two weeks of practice, we were able to work on things that we normally don’t get to until April.”

Drumm feels his group will find the back of the net. “Offensively, we have a lot of firepower,” he said.

“Every player on our team can score, so we are stressing patience and decision-making so we have the best opportunity to do so every possession.”

York turns to sophomore Schroeder between the pipes. “This is the first time in my coaching career that I have started a sophomore in goal,” Drumm noted. “We have a player in Jack Schroeder who can handle the task. Jack is one of the most committed players on the team. He rarely, if ever, missed all summer and all fall,

and every time there is an opportunity for a camp or a clinic in the area, he is there. Jack also is 6-4 and incredibly intelligent, so we feel we are in good hands. It also helps, though, to have such an experienced lineup in front of him. We are fully expecting our field players to be in the right place all the time on defense this season, which will help our young goalie tremendously.”

Drumm said one major key to where this team ultimately ends up rests in the communication department. “We need our veterans to step up and lead our team,” he said. “If the players on our team talk in the water, lead each other and take initiative consistently, we will be in a good place to accomplish our outcome goals this season.”

Timothy Christian boys basketball season ends in bizarre fashion Trojans in Peoria were preparing for state finals when tournament cancelled amid coronavirus concerns

The Timothy Christian boys basketball team will always be left with the question: “Could they have won the Class 2A state title?”

That question will never be answered after the Class 2A state finals in Peoria at the Peoria Civic Center’s Carver Arena, which Timothy Christian was to be a participant in, were cancelled last week by the IHSA amid concerns about the coronavirus pandemic.

Timothy Christian coach Scott Plaisier noted his team was in Peoria last Thursday readying to play in the Class 2A state semifinals against

Springfield Sacred Heart-Griffin when during an evening meeting with the IHSA it was determined the entire tournament would be called off.

Previously, it was announced the tournament would still be played but with only an extremely limited number of fans in attendance.

“That is exactly a great way to put it: A bizarre season,” Plaisier said.

“I would have never thought a season would finish this way. The kids were pretty devastated and pretty emotional. It’s like you run through some quick stages of grief, that’s how I feel. You are unbelievably angry at first and then your emotions come out, and you are devastated and heartbroken for what you feel was ripped away from you. You don’t have an opportunity to finish what you had worked up to that point to be able to do.

“But after some time and reflection you are super-appreciative of

the time we were able to spend together. The IHSA tried to hold on to hope I feel like as long as they could. It got to the point where they felt as though they were probably going against what everybody else’s decisions were and the scrutiny they would have been under. They brought us down to Peoria with all intentions to play and to make things as safe as possible. The only possible thing was maybe we could have gotten in a round of games Thursday. We had found out early that morning (Thursday) that they were going to limit the crowd to 60 tickets per team per game, so 120 fans per game.”

Plaisier said his team went through a shoot-around earlier last Thursday in Peoria and had pictures taken.

“We were on the court getting things planned out and getting things going in the shootaround,” he said.

Plaisier said the regularly scheduled meeting with the IHSA at 6 p.m. last Thursday was when he found out the tournament had been cancelled.

Timothy reached the state finals for the first time in 40 years thanks to a 59-43 win over Minonk Fieldcrest in the Class 2A DeKalb supersectional held at Northern Illinois University.

“We came up against a really good Fieldcrest team that had been on a rampage,” Plaisier said. “They had beaten Sterling Newman Catholic, which was really good. They had beaten Taylor Ridge Rockridge, which is really good and Princeton.

They were finding ways to knock off a bunch of really good basketball teams. They had a couple fantastic guards that we knew going in we had to handle. If we handled those two guys that would put us in a decent position to be successful.”

And defend the Trojans did. “The boys defended their hearts out and made it very challenging for them for three quarters,” Plaisier said. “It was hard for them to get openings, open looks and to penetrate gaps like they did in other games. We built a little bit of a lead and then in the fourth they knocked down some shots, but we were able to score enough ourselves to not let them come all the way back.”

Timothy led 10-4 after the first quarter and 20-11 at halftime. The Trojans used a 16-7 third quarter to push the lead to 36-18 before the teams exploded for a combined 48 points in the final stanza.

Josh Harris led the Trojans with 14 points. Ben VanderWaal, a sophomore, had 12 points, while Matt Owens finished with 10 points.

Marquis Johnson had eight points and Zach Orange finished with six points. Timothy made no 3-pointers in the game, but canned 21 of 27 free-throw attempts (78 percent).

Jack Baldridge and Harris each were 4-for-4 from the line, while Owens hit 4 of 5.

VanderWaal had 11 rebounds, while Harris had 10 boards. AJ Vos finished with six rebounds. Owens had four assists, while Harris had three steals.

VanderWaal also blocked two shots and took a charge. Timothy had five blocks in the game.

“Ben played a nice game,” said Plaisier. “Josh had another nice game and I thought Jack Baldridge came off the bench and gave us great minutes, as did Marquis Johnson, who gave us fantastic minutes.”

Timothy finished the year 28-5 and ran through the Metro Suburban Conference Red Division unbeaten at 12-0. It was the program’s fourth state finals appearance. The 1975, 1979 and 1980 teams also made the Class A state finals with the 1975 team finishing second and the 1979 team finishing third. Those three teams were coached by Don Greenfield, who won 445 games in 26 years at the Timothy helm.

In terms of where Timothy ranks in school annals, according to IHSA records only the 2005-2006 team coached by Jeff Powers had more wins in a single season. That team went 29-2 but only made it to the sectional round of the playoffs.

Plaisier’s three Timothy teams have gone 22-6, 20-12 and 28-5 for a 7023 overall mark since he came to the school. His .753 winning percentage is tops all-time among Timothy boys basketball coaches with more than one year at the school.

“This season was spectacular,” Plaisier said. “This is as special a group of young men that you could

be around. From the very first day we talked in the gym to the last, there was not a day that went by that I was not looking forward to getting to practice or working with the boys.

They play with a joyous spirit and full love in their heart for basketball and each other and it shows by the way they play. I feel like they embraced a community where they let themselves and they let the community enjoy them as people. And because of that the community embraced them and they embraced the community. That made things even more special. I loved watching them play. Having those two games (in Peoria) and not being able to watch them, I wish I could watch them a couple more times because they are so fun to watch.”

Owens, Harris, Vos and VanderWaal earned all-MSC Red honors.

Owens was named the MSC Red Division player of the year. Owens also was an Associated Press Class 2A all-state second-team pick, while Harris was an IBCA Class 2A second-team selection and Owens was IBCA special honorable mention.

Timothy graduates seven seniors in the form of Owens, Vos, Johnson, Orange, Baldridge, Troy Hughes and Josh Radoha. “It sure makes it even tougher losing these guys,” said Plaisier. “They are awesome kids and great senior leaders, for sure.”

In terms of what the IHSA will do in terms of place finish for the state finals qualifiers, Plaisier said he has been advocating along with the other Class 2A and 1A coaches who were in Peoria for each team to receive one of the IHSA trademark state finals large trophies. “The teams would receive a Final Four trophy similar to if they would have won any of the places,” Plaisier explained. “The trophies would say Final Four the same on all of them and then would have a spot for the boys to have their names so they can get recognized for the great seasons they had.”

The other Class 2A state semifinal was to have pitted Chicago Orr against Breese Mater Dei. The Class 3A and 4A state finals that were to take place this weekend at Carver Arena also were cancelled.

IC Catholic softball team ready to swing the bats Knights stacked with offensive potential

Scoring runs in high school softball is a good thing.

And IC Catholic Prep coach Frank Reaber thinks his team will be able to just that this spring.

“They can hit,” he said. “I think we are going to be able to score some runs.

We have some power and we’ll probably play small ball at the bottom of the lineup. We have fast kids and a couple of freshmen who are really fast.”

The Knights went 19-13 last year and 2-10 in Metro Suburban Conference Blue Division play. Back for Reaber are seniors Emma Lytton (catcher-third baseman), Alessandra Eccardt (first baseman), Dani Murillo (shortstop/pitcher), Tea Carpanzano (outfielder), Erin Liszka (outfielder) and Brooklyn Campos (infielder), along with juniors Rebecca Cash (pitcher/ shortstop) and Anna Maciejewski (infielder/outfielder).

Lytton, who will play softball at Aurora University, and Cash were allMSC Blue selections last year.

“Rebecca Cash is even stronger as a pitcher,” Reaber said. “We have power in the lineup with Dani, Alessandra, Emma and Cash, and Brooklyn is more of a line-drive hitter, and I think

the rest will do well.”

Key newcomers to the team include sophomores Caterina Calabria (outfielder), Brianna Moreno (outfielder) and Lauren Haubner (infielder/outfielder), along with freshmen Natasha DeRose (catcher/third base), Samantha Serrano (outfielder), Jazlyn Cervantes (infielder) and Bianca Maldanado (outfielder/pitcher).

Reaber noted IC Catholic Prep has 15 on the varsity roster and 16 on the JV. “That’s a good amount of kids,” he said.

Defensively, Reaber added the staff was hard at work evaluating both the infield and outfield alignments right before the state-mandated coronavirus shutdown.

Reaber has high hopes for the season, once it resumes. “I think we have the ability to be better than last year,” he said.

IC Catholic Prep once again is in the larger-school MSC Blue Division.

“That’s the top bracket,” Reaber said.

“The team to beat in the conference is Riverside-Brookfield. I think they are loaded. I think they have seven seniors who all start and are all really

good. St. Francis is really good. ACC lost a pitcher, but their second pitcher was good. We’ll see how they are. I am hoping to go .500 in the conference.

We let a few games get away last year.

Ridgewood also will be better and they have a coach who does a really good job. Hopefully, we can start back up here in a few weeks. Right now, this is a scary situation.”

A big highlight on IC Catholic Prep’s schedule is its annual tournament it hosts May 15-16 at Plunkett Athletic Complex in Elmhurst. “We have a bunch of new teams this year with Schaumburg and Glenbard East.

St. Francis and ACC will there, so we have some good teams coming out,” Reaber said.

“We will be pretty young, but we have a number of girls who have played at the varsity level,” said Holba. “Gina, Sydney and Lauren played big roles on the team that went to state a couple years ago. It’s nice to have their leadership and having a pitcher like Lauren is definitely a big deal.”

Holba also is looking for big things from Madeline Modica (cather-infielder, junior), Rena Sotos (catcher-first baseman, junior), as well as pitchers Caroline Collins (senior) and Kara Jensen (sophomore).

“We’re looking for big things from Caroline and Kara in the circle, too,” Holba said. “Caroline has pitched before and is a senior. Kara is a sophomore who pitched a little last year when Lauren was hurt. She dominated the JV level and hopefully that translates back onto the varsity. Pitching will be the biggest strength for us. Behind that, we can hit the ball pretty well. As long as the bats sharp, we will be pretty good.

We will see how the three-week layoff goes. We were able to get outside once to practice and were planning on going out (last Friday).”

Defensively, Holba said with the majority of practices being held indoors, outfield work and evaluation has been minimal, but he noted York’s infield defense should be strong. “We will have younger people, sophomores or inexperienced seniors, in the infield,” he said. “From what we have seen, we will be pretty strong.”

Holba noted as with any team, the Dukes ultimate goal is a state title.

“We want to win conference and be one of the top four seeds in the sectional,” he said. “If we can do those two things, it will set us up for a nice road.”

Holba said York is slated to lose four or five games due to the current coronavirus hiatus. He added he’s greatly looking forward to getting back on the field with his team.

“It’s a phenomenal group of girls,” he said. “They have great attitudes and everybody hustles.”

Holba takes over York softball program CORRESPONDENT

First-year York softball coach Brendan Holba might be new to the softball diamond, but he’s far from new to the school.

Holba, who took over for former coach Elizabeth Munn (now coaching in the Jacksonville, Florida area), previously coached in the York baseball program as a varsity assistant and freshman B coach. Prior to York, Holba coached baseball at Plainfield South (varsity hitting and catching coach) and Providence Catholic (sophomore coach).

Holba is a graduate of the University of Louisville where he was the bullpen catcher and student manager for the Cardinals. He was a member of the 2013 Louisville team that played in the NCAA College World Series. Holba teaches in the social studies department at York.

“I have twin girls who are 14 months-old now,” Holba explained.

“Once I found out we were having girls, I started thinking somewhere down the line I would be coaching softball. My uncle has been a head softball coach at Joliet West and Andrew and now coaches at Providence Catholic, so I talked to him. I reached out Elizabeth before she left to take a job in Florida and asked if she needed help on her stuff. And then she left and this job opened up and we went from there. Other than the pitching aspect, other parts of the game are similar to softball.”

Holba has wasted no time in diving deep into the sport. “As soon as I got the job, I started studying,” he said. “ESPN has done a phenomenal job showing college softball games.

With ESPN+ I have been able to watch games on my computer. I talked to my uncle a lot and I have gone to coaching clinics, being a student of the game and getting involved as much as I could. I have taught the hitting side of it with baseball and softball lessons, so that hasn’t been too much of a change.”

Choose DuPage, Cronin present ‘Legalized recreational cannabis and the workplace’ DuPage County business leaders gathered on Wednesday, Feb. 26 at a breakfast hosted by Choose DuPage and DuPage County Board Chairman Dan Cronin to discuss the Illinois Cannabis Regulation & Tax Act, and how it affects the workplace.

The discussion was led by Mark McAndrew and Therese King Nohos of Rathje Woodward LLC. Attendees included a diverse range of leaders with a broad spectrum of interests and concerns including representatives from healthcare, labor, government, higher education, major employers, and more.

After a welcome from Chairman Cronin, McAndrew began the discussion by saying, “We want you to walk out of here with a concept on how to re-balance the workplace given the new reality of recreational marijuana in the State of Illinois.”

Statistics to highlight: • Roughly half the states have legalized or decriminalized marijuana.

• There are 17 adult-use (recreational) cannabis dispensary regions in Illinois. DuPage is part of the Chi-

cago-Naperville-Elgin region, which has the largest number of maximum conditional licenses allowed at 47.

• In January, sales from recreational marijuana were almost $40 million, generating $10 million in tax revenue. Of that, $3.1 million went to the State of Illinois’ General Fund and local governments McAndrew went on to highlight some challenges related to the Illinois Cannabis Regulation & Tax Act: 1. ‘Employer’ was never defined in the bill. For companies with employees in different states, how do you treat your employees with a patchwork of laws? This becomes difficult.

2. ‘Employee’ was never defined in the bill. Does it apply to independent contractors? Trends show that independent contractors are treated as employees in these instances, but it was never defined in the bill.

3. ‘Discipline’ was never defined in the bill. Is it verbal, suspension, termination?

The law focuses on impairment at work, while current drug testing methods focus on use. Until impair-

ment is quantified and can be tested in the field it remains largely subjective. It is recommended that employers have someone trained and designated to determine impairment.

There are also tools available (such as checklists) to help document behavior.

McAndrew explained that the law does permit employers to: enforce drug testing policies in a nondiscriminatory manner, enforce a drug-free “workplace” (including a Zero-Tolerance policy), prohibit employees from using, possessing, or being impaired while working or “on call,” and discipline or terminate employees who violate policies. Additionally, a “workplace” includes not only the building, but the entire property and parking area under control of the employer or area used by an employee while in performance of their job or duties, including vehicles.

The law provides that an employer may discipline and terminate any employee under the following condition: “good faith belief” if “employee manifests specific, articulable symptoms while working that decrease or lessen the employee’s
