DuPage County rejects fair tax amendment Mazzochi retains seat; Casten beats Ives; Lewis wins over Pappas

At 11 p.m. on Wednesday, Nov. 4, with 100% of precincts reporting, the Presidential race had already been declared for Joe Biden in the state of Illinois by many national media outlets. Still the final tally across the nation was not complete at that time.

While DuPage County has typically leaned toward Republican candidates, Democrat Biden received 276,902 votes to President Donald Trump’s 191,618. At press time, the Republican president was still planning to contest the results.

Illinois’ national representatives In Federal races, U.S. Senator Richard Durbin held his seat, earning 54.67% of the vote in DuPage over his Republican opponent Mark C. Curran, Jr. In Congressional races, Democrat Mike Quigley was winning another term over Tommy Hanson in the 5th District, but the numbers only showed DuPage County, but he represents a portion of Cook County,

The same applies to 8th District, where DuPage delivered more than 69,600 votes to Congressman Raja Krishnamoorthi, who is a Democrat.

Even with their Cook County portions, Quigley and Krishnamoorthi both retained their seats.

Voters also had their eyes on the race in the 6th Congressional District, where Democrat Sean Casten garnered 55% of the vote over Jeanne Ives, winning 112,015 votes to 89,656.

In the state In the race for State Representative in Illinois’ 45th District, Republican Seth Lewis beat Diane Pappas by almost 4,000 votes, which was almost 54% of the total ballots cast.

The race in the 47th District was equally decisive as State Rep. Deanne Mazzochi held her seat over Democrat Jennifer Zordani by more than 4,500 votes representing nearly 54% of the total.

Republican Peter Breen lost in the 48th District, attempting to take the seat he had held previously. But incumbent Terra Costa Howard received in excess of 53% of the total, winning by more than 4,500 votes.

Mayor calls on Gov. Pritzker to reconsider strict business closures restrictions.

I understand your primary mission is keeping Illinoisans safe during this time. I share this mission in providing for the safety and welfare of the residents of Elmhurst. As public leaders, we are tasked with making decisions on behalf of our constituents and have committed to make these decisions based on data and understanding of calculated risks.

I am asking you to reconsider your recent restrictions on local businesses. You mentioned in your October 20th COVID update that the top 3 places outbreaks occur statewide are in the workplace, schools, bars and restaurants. To date we have not been provided with data showing that restaurants are the cause of the rise in

positivity rates. In DuPage County, the total number of tracked outbreak cases directly linked to indoor dining is less than 1% according to DuPage County Health Department data.

While this number cannot account for all COVID-19 cases or outbreaks, it is an indication that the recent rise in positivity is not strongly linked to our restaurants which have had indoor dining since June. The progress made in COVID-19 treatments and recovery rates should also be taken into consideration. I have spoken directly to medical professionals who have stated that they are having greater success in treating individuals who have contracted COVID-19.

The livelihood of these businesses, their owners and their employees

rely on your ability to modify this order. Elmhurst businesses have spent hundreds of thousands of dollars to create a safe environment for their customers. Eliminating indoor dining during our cold weather season will be FATAL to many restaurants in my hometown of Elmhurst and to many across our great state. I hope you are open to compromise. Let’s work together to give small business owners a fighting chance.

Again, I am urging you to modify these restrictions on small businesses and create a path to allow indoor dining. If not, the damage inflicted on our community will be permanent.

I would like to invite you to visit our community to further discuss this matter. I am confident that together we can create a plan that is safe, acceptable and reasonable, all while providing a chance for our small businesses to survive this pandemic.

Montini Catholic High School is announcing an opportunity for incoming freshmen to earn up to $10,000 toward their high school education.

The Lasallian college preparatory high school offers academic scholarships to incoming freshmen taking their placement exam, scheduled for Dec. 5. Scholarships (ranging from $1,000 to $2,500) are based on a student’s national ranking of the placement exam and are renewable for four years.

Make it four big ones in a row for runners from the York varsity girls cross country team.

Those runners, using the team name Kroy (York spelled backwards), won the Class 3A title at the recent 2020 XC Championships sponsored

by ShaZam Racing at Three Sisters Park downstate in Chillicothe.

The meet brought together the top high school teams and runners in Illinois, thus acting as an unofficial/ unsanctioned state meet. The Illinois High School Association did not hold sanctioned high school state cross country championships in Peoria this season due to the COVID-19 pandemic. The IHSA-sanctioned portion of the season ended at the sectional level.

York won West Suburban Conference Silver Division, regional and sectional titles, capping a tremendous high school showing.

Those York runners then took things to the next level this past weekend by winning the Chillicothe race.

Kroy finished with 58 points, 13 better than runners from 2019 IHSA Class 3A state-champion Naperville North. Runners from Yorkville were a distant second with 159 points.

Sophomore Brooke Berger finished fifth to lead Kroy. She covered the 5,000 meters in 18:12.28. Freshman teammate Michaela Quinn was sixth with a time of 18:17.11. Sophomore Bria Bennis was 17th with a time of 18:49.39. Junior Katelyn Winton was 20th with a time of 18:58.11, while freshman Katherine Klimek was 24th with a time of 19:01.33. The five underclassmen had a 49-second split.

Naperville North’s 1-5 split was 1:27.

Freshman Maggie Owens also ran in the race. She took 55th with a time of 19:45. Junior Erin Powers was 99th with a time of 20:34.92.

Quinn was third and Berger sixth to lead York to its first sectional title since 2009. Quinn was third and Berger was fourth in York’s regional win.

Kroy Boys Runners from the York boys varsity cross country team, also sporting Kroy uniforms, had an equally impressive showing in Chillicothe, finishing third in the Class 3A race.

Kroy had 172 points, three better than runners from New Trier and eight better than runners from Barrington. Runners from St. Charles East, a familiar postseason foe to York this fall, won the race with 121 points.

Runners from Naperville North were second with 156 points.

Kroy was paced by senior Mickey Vreeland, who took 12th with a time of 15:58.76. Junior Ethan Summer took 20th with a time of 16:05.48.

Junior Jackson Geiger was 41st with a time of 16:22.95. Senior Colin Hill took 46th with a time of 16:27.41. Junior Garrett Schwan was 72nd with a time of 16:49.64. Senior Sam Ayers was 77th with a time of 16:53.25, while senior David Rosario was 132nd with a time of 17:37.44.

COVID-19 updates for DuPage County As of 8 a.m. on Monday, Nov. 9, there were 29,032 total cases among DuPage County residents, including 639 deaths. Since Sunday, there were 802 new cases and three deaths related to COVID-19, a female in her 70s, a female in her 80s and a female in her 90s.

The DuPage Health Department announced that there were delays with the Illinois Department of Public Health and therefore, today’s data may be incomplete.

Elmhurst Hospital reports that 69 inpatients with confirmed cases of COVID-19 were discharged last week. Since March 24, a total of 741 patients have been discharged.

“Getting third in the state is pretty exciting,” Vreeland told the Independent. “We did really well. These past couple years have been awesome and this was nice to have a fun ending like this. Even though it’s not considered a state meet, it was still the best teams and the best individuals. It’s as close to a state meet as you can get it.”

Vreeland noted the Kroy runners still broke out the tuxedos post-race to celebrate the third-place showing, as is the longtime tradition dating back to legendary coach Joe Newton.

“It’s nice to get another trophy for the program,” he said.

Vreeland also pointed out only one Kroy runner had competed in a state-level meet previously. He added the fact the runners from York finished on such a high note is even more rewarding, given the adversity the York team faced this fall , including multiple COVID-19 quarantine situations (see related story on the York boys cross country postseason

perseverance in Sports).

“We were able to get past the quarantines and the injuries,” he said. “We were able to finish in third place in this meet and did well as individuals.

It made it all that much more sweeter.”

Vreeland ran in the COVID-19-mandated flight that included the top runners from the top high school teams in the state, as well as top individuals invited to run in this state-level meet.

“There were a lot of great athletes there,” he said. “My teammate ran in the flight with the second and third runners and still finished 20th overall in the race.”

Vreeland said he used some advice York coach Charlie Kern gave him.

Kern was not able to coach the Kroy team in Chillicothe due to IHSA regulations.

“Coach Kern told me to run smart,” he explained. “The first 1 1/2 miles there are super hilly. I played it safe.

The last 1,000 meters is when I made my move and I got four or five guys and that’s how I got into the top 15.

I was super happy I made that last move at the end.”

Chamber’s GAC announces more COVID-19 restrictions The Governmental Affairs Committee of the Elmhurst Chamber of Commerce forwarded the following information from the City of Elmhurst regarding Illinois Governor JB Pritzker’s expected announcement of additional Restore Illinois restrictions for Region 8, which includes Elmhurst and all other communities in the County of DuPage: Due to the rise in Coronavirus (COVID-19) cases around Illinois and throughout DuPage County, Gov. Pritzker is

expected to move Region 8 back to into the Tier 2 Mitigation Action Plan of Restore Illinois--meaning all current restrictions remain in place, while additional restrictions are added onto business operations in different segments. For example, for restaurants and bars--which had indoor dining shut down on Gov. Pritzker’s Executive Order on Friday, Oct 23--the increased restrictions reduce the maximum number of diners at any one table from 10 to six.

Police beat

sued a citation for possession of open alcohol by a passenger in a vehicle subsequent to a traffic stop near N. Route 83 and W. Lake at around 11:48 p.m.

The Elmhurst Police Department recently reported the following arrests and citations.

Persons charged with domestic battery are not named in order to protect the privacy of victims.

Readers are reminded that an arrest does not constitute a conviction, and that subjects are considered innocent unless proven guilty in a court of law. Juveniles age 17-or-younger are not named.

Oct. 29 Andre McEwen, 38, of Chicago, was charged with DUI-drugs, unlawful possession of a controlled substance, aggravated driving while license revoked, driving the wrong way down a divided highway, disobeying a traffic control signal, failure to signal and no insurance subsequent to a traffic stop near W. Lake and Route 83 at around 11:45 p.m.

Battery Oct. 31 Kaneel D. Walker, 26, of Chicago, was charged with two counts of battery in the 100 block of Evergreen at around 9:21 p.m. Police said Walker was found to have punched the victim in the face, causing her lip to swell and bleed.

Oct. 28 Mario Milazzo, 40, of West Chicago, was charged with battery in the 200 block of W. Lake at around 11:52 a.m. According to police, a victim told police that Milazzo pushed him to the ground and struck him several times. The victim complained of pain, but sustained no other visible injuries, police said.

Medics arrived on scene and transported the victim to Elmhurst Hospital for treatment. The reporting officer met with Milazzo, who stated he grabbed the victim by the jacket and threw him to the ground, according to police.

Oct. 27 A reporting officer met with the victim in the 200 block of E. South who told police he was battered by a coworker while completing a job at the above location. The victim sustained injuries to his face, left hand, and chest. The victim did not have the suspect’s full name but provided the reporting officer with a phone number. This case is pending investigation.

Criminal damage Nov. 2 Police said officers responded to Pioneer Park for the report of a damaged porta potty.

Officers observed the door to the porta potty had been removed from its hinges and stickers had. been placed on the shelter covering the porta potty. The suspects were observed in the park, but denied damaging the property.

The Elmhurst Park District was notified of the damage.

Domestic battery, domestic incident, disorderly conduct, damage to property, disturbance Nov. 2 A complainant in the 500 block of W. St. Charles told police at around 4:03 p.m. that he observed an unknown suspect, described as an Hispanic male, around 25 years old, 6-foot and wearing a dark coat, a white shirt and black pants, hit a female Hispanic and push her into the bushes in the parking lot of a bank. The male and the female subject left the area in a black Chevy Suburban with tinted windows, large tires, a large front grill or bumper, and possibly a lifted frame. Officers checked the area for the vehicle and subjects with no results.

Nov. 1 A 52-year-old Elmhurst man was charged with domestic battery in the 400 block of S. Parkside at around 12:11 a.m. Police said of-

Oct. 30 Police said officers responded to the 600 block of S. Bryan at around 8:28 a.m. for the report of a domestic battery. The reporting officer met with the complainant who stated her son battered her following a verbal argument. The suspect denied having physical contact with the complainant and stated the complainant slapped an object out of his hand.

No arrests were made due to conflicting statements and no signs of injury.

DUI, DUI-drugs, possession of alcohol in public, possession or consumption of alcohol by a minor Oct. 31 Vanessa Berrum, 19, of Addison, was charged with DUI-drugs, unlawful possession of adult use cannabis, possession of drug paraphernalia and improper lane usage subsequent to a traffic stop near Route 83 and St. Charles at around 10:45 p.m.

Francisco Cazares-Ramos, 38, of Chicago, was charged with aggravated DUI, driving while license revoked and improper lane usage subsequent to a traffic stop near Addison and North at around 8:42 p.m.

Fernando Roman-Mendez, 33, of Chicago, was charged with DUI, illegal transportation of open alcohol, no valid driver’s license, disobeying a traffic control device, improper lane usage and no insurance subsequent to a traffic stop near North and Wilson at around 1:23 a.m.

Melissier Shields, 40, of Chicago, was charged with DUI, resisting a police officer, illegal transportation of open alcohol improper lane usage and disobeying a traffic control device subsequent to a traffic stop near North and York at around 2:14 a.m.

Issac Tavizon, 29, of Chicago, was charged with DUI-drugs, unlawful possession of a controlled substance, possession of drug paraphernalia and improper parking on the roadway subsequent to a report of a driver passed out behind the wheel near North and York at around 2:50 p.m.

Oct. 30 Lauren Cappelletti, 29, of Elmhurst, was charged with DUI and disobeying a stop sign subsequent to a traffic stop near W. Second and N. Addison at around 10:19 p.m.

Nallely Silva-Hernandez, 26, of Elmhurst, was charged with DUI and improper lane usage subsequent to a traffic stop near E. St. Charles and S. Kenmore at around 12:17 a.m.

Fleeing, eluding Oct. 24 Courtnie Blakeley, 24, of Chicago, was charged with fleeing and eluding, driving while license suspended and failure to signal near York and Lake at around 1 a.m. Police said a reporting officer attempted to conduct a traffic stop on a vehicle for failure to signal at the above intersection. The suspect allegedly fled from the reporting officer in the vehicle and was last seen heading eastbound on I-290.

An ISPERN message was broadcast. Subsequent to investigation, the reporting officer located the vehicle on Oct. 28 and conducted a traffic stop, according to police.

Fugitive from justice Nov. 3 Police said that subsequent to a traffic stop near St. Charles and Poplar at around 10:42 a.m., Joshua J. King, 22, of Villa Park, was found to have a valid warrant from Ingham County (Mich.) Sheriff’s Office for violating his probation. King was charged with fugitive from justice and speeding.

Nov. 2 Police said an officer observed a vehicle in the 500 block of W. Grand at around 10:17 p.m. which had been reported stolen and conducted a traffic stop. The vehicle was confirmed as stolen, according to police. Police said the driver, James E. Kalenian, 58, of Villa Park, was found to have two valid warrants from the DuPage County Sheriff’s Office, one valid warrant from the Wisconsin Department of Corrections, one valid warrant from the Walworth County Wis. Sheriff’s Office, a revoked driver’s license and was in possession of open alcohol. Kalenian was charged with two counts of fugitive from justice, criminal trespass to a vehicle, transportation of open alcohol and driving while license revoked.

Harassment, threats Nov. 3 A complainant in the 100 block of E. Lake told police at around 5:21 p.m. that while returning to his friend’s house, a suspect exited his vehicle and accused the complainant of harassing his daughter. The suspect left the scene when the complainant dialed 911. The suspect was located and said he had asked the complainant why he attempted to speak to his daughter. The complainant did not wish to sign complaints.

Oct. 26-28 Police said a reporting officer met with the complainant in the 100 block of W. Diversey who stated a suspect called her employer requesting information on her schedule sometime between the above dates. The complainant did not wish to have any further communication with the suspect. The suspect was advised to cease all contact with the complainant.

Nov. 5 Fidel Romero, 20, of Berwyn, was issued citations for unlawful possession of cannabis by a driver, improper lane usage and no insurance subsequent to a traffic crash near York and Butterfield at around 1:50 a.m.

Nov. 4 Isaiah Del Toro, 18, of Bellwood, was issued citations for unlawful possession of cannabis by a driver, operating a vehicle while using an electronic communications device, no valid driver’s license and no insurance subsequent to a traffic stop in the 700 block of W. St. Charles at around 11:32 a.m.

John A. Keys, 21, of Romeoville, was issued a citation for possession of adult use cannabis in a vehicle subsequent to a traffic stop near St. Charles and Monterey at around 11:17 a.m.

Nov. 3 Jillian B. Costabile, 36, of Melrose Park, was charged with possession of a controlled substance and possession of drug paraphernalia at a hotel in the 300 block of N. Route 83 at around 1:40 p.m. Police said an officer responded to a report of a suspect who entered the hotel and appeared to be disoriented. According to police, Costabile admitted to ingesting a bag of heroin and was found to be in possession of numerous bags of heroin and drug paraphernalia.

Alexandria Champ, 30, of Chicago, was issued a citation for unlawful possession of cannabis by a driver near Roosevelt and York at around 2:09 p.m.

Jose Mendez, 19, of Melrose Park, was issue citations for possession of cannabis in a vehicle, possession of drug paraphernalia by a person under 21 and tinted windows near W. North and N. Glade at around 8:53 p.m.

Navaid Siddiqui, 42, of Glen Ellyn, was charged with unlawful possession of a controlled substance, improper registration and failure to signal subsequent to a traffic stop near W. Grand and W. Lake at around 7:36 p.m.

Nov. 2 While on patrol, an officer observed a suspicious vehicle near Elm and Grantley at around 2:10 a.m. Subsequent to a traffic stop a suspect was found to be driving a vehicle with different VIN numbers. Oct. 28 A reporting officer met with the complainant at a senior center in the 100 block of W. Diversey who stated the suspect was incredibly upset and began swearing at the complainant over the phone. The complainant became concerned after the suspect made statements about going to the facility. The reporting officer spoke with the suspect who stated he was not happy with the care his mother was receiving at the facility but did not threaten harm against anyone.

The suspect threatened to forward the video to his social media followers unless he sent $200 via Western Union. The victim did not send any money and blocked the suspect from his accounts.

The key fobs for both vehicles are accounted for at the dealership. Broken glass was found at the scene. Both vehicles were entered into LEADS/ NCIC.

FAST TRACK CATARACT

While there are “nuclear” cataracts that affect the center of the eye lens and “cortical” cataracts that affect the edges of the lens, there are also “posterior subcapsular” cataracts that affect the back of the lens. Congressman Raja appreciates re-election to represent 6th District I am humbled and honored that my constituents have elected me to represent them in Congress for another term, and I will continue to bring the same commitment to serving our community over the next two years that I have since taking office.

In the remainder of this year and the beginning of next, Congress will continue to combat the COVID-19 pandemic while addressing the economic challenges it has created. I’m committed to fighting for additional coronavirus relief that puts our families and small businesses first, but this election and the negotiations of the last few months have only made it more clear that we will only be able to pass legislation with strong bipartisan support.

For that reason, and so many others, as we learn the results of the presidential election, we must come together as a country to begin the work ahead.

I know that the 2020 election and its results have been long awaited, but we may need to wait a few more days to get the official results. Regardless

of the outcome, I’m encouraged and proud to see that 2020 turnout is on pace to break century-old records. In many ways this is an unprecedented election, but it is also an election in which our democratic institutions are working normally and exactly as they are meant to work. Many states take a few days to finalize their vote tallies, and since the pandemic led to an increase in mail-in-voting, counting ballots will take longer in many cases.

So, what does that mean for us? It means we must be patient, be mindful of misinformation campaigns, and trust our states’ electoral institutions. Every vote must be counted: early votes, election-day votes, and absentee votes. Democracy can be a slow process, so please continue to wait patiently for the final election results.

Reader says D205 Board not approving Moyer’s actions, hence little accountability

At a meeting on July 14, the D205 Board of Education passed a resolution to approve its Open D205 plan to open our schools with necessary safety protocols in place. However, that resolution also included a provision delegating authority to the Superintendent to makes changes to that plan from time to time, provided such changes were (1) done in consultation with the Board President; and (2) promptly reported to the full Board after which the full Board “may affirm, modify or disapprove of the changes.”

The Superintendent has since used this delegation to unilaterally delay in-person learning for six-plus weeks, radically change and reduce the delivery of curriculum, and recently. return to all remote learning, all while the large majority of other districts in Illinois have maintained

full or hybrid in-person learning and a full schedule of classes every day.

To date, there has been no evidence presented by the Board that these changes have been made in consultation with the Board President, and the Board has never voted on the record to approve, modify or disapprove any of these changes, as required by the July 14 resolution.

As a result, the Board has removed itself from all decision-making and accountability in regard to in-person learning and the delivery of curriculum to the students of D205.

The education of D205 students, or lack thereof, is now solely at the discretion of the Superintendent, without oversight or review by the Board or, in turn, accountability to the community. As a parent of three D205 students, and as a taxpayer, I find this completely unacceptable.

Stop the mask debate

I wear a mask when out in public because that is what I (and we) are asked to do. The experts tell us that masks help stop the spread of COVID and I usually follow the advice of experts; they often know more than I do.

I have my opinions on masks, but I’ll try not to share them here. I am not anti-mask, or non-anti-mask. I am opposed to polarized opinions about masks.

Let’s be straight. We all believe what we believe. We have opinions.

That’s okay.

I read the online posts about masks, and quite frankly, I think both sides have good arguments.

For the mask wearers: You care about others. You want to protect the vulnerable. You listen to th experts and believe what they say.

You do what you have to because it is what is asked of you. You want to stop COVID, so you wear a mask.

For those who chose a non-mask appearance: You don’t always believe the information you receive from the media. You feel you live in an area where you can social distance safely without affecting others. You don’t want anyone to get sick, but you feel you can keep yourself and others safe without a mask.

Everyone believes they have their own valid points. Please read that sentence a second time to let it sink in. Everyone is imbedded in their own belief system.

With graduated tax failure, ‘there will be cuts, and they will be painful,’ governor says ‘Everything is on the table’ in addressing fiscal challenges

Backers of a graduated income tax constitutional amendment conceded defeat for Gov. JB Pritzker’s marquee policy proposal which was projected to bring in more than $3 billion annually to state coffers.

With 98 percent of precincts reporting, voters had rejected the amendment by a 55 percent to 45 percent margin. The Associated Press called the race for the “No” camp, as a large number of outstanding mail ballots were almost certainly not enough to make up for the deficit of approximately 500,000 votes.

In his daily COVID-19 briefing in Chicago Nov. 4, an agitated Pritzker lashed out against the Republican Party, warned of cuts to public safety and human services and said several other options were on the table for addressing state budget deficits that have been ongoing for decades.

Kenneth Karnstedt, 81 On October 30, 2020 Kenneth Dean Karnstedt passed away peacefully at the age of 81 from complications related to COVID-19. “Ken” was born at Elmhurst Community Hospital on August 15, 1939. He was a lifetime resident of Elmhurst and spent his childhood years living on Larch Street, raised his family on Washington Street and later moved into Park Place Retirement Community.

A proud member of York Community High School’s class of 1957, Ken went on to complete his undergraduate degree from Elmhurst College. After graduation, Ken married his college sweetheart, Jean Thon in October 1962, and was blessed with two children, Lynda Jean in 1963 and David Kenneth in 1966.

Ken was a marketing executive with Sears Roebuck & Company and Navistar. He continued to advance his education by obtaining a CPA and a Home Inspector License.

Outside of work, Ken found great enjoyment spending time with family. He was an active participant in his childhood church, Immanuel Lutheran, where he ushered weekly and served on the board for a number of years. Ken loved everything about cars, especially the NASCAR Driving Experience and golfing with his brother and buddies at Old Wayne Golf Club, fishing and the Cubs. He was also a member of Alcoholics

The failure of the amendment marks the end of a fight led by Pritzker which began legislatively in April 2019 and even before that politically when Pritzker was running for governor in 2017 and 2018.

Pritzker spent $58 million of his own personal fortune to promote the amendment, while billionaire Republican donor Ken Griffin, the state’s wealthiest person and founder of the hedge fund Citadel, dropped more than $53 million into an effort to defeat the tax change.

being a 20 percent increase to the state’s flat tax or 15 percent acrossthe-board cuts to state spending.

But he has also frequently warned that discretionary spending has already been reduced drastically in several areas in recent years due to a two-year state budget impasse in which the state racked up a $16 billion backlog of unpaid bills. As of Nov. 4, the Illinois Comptroller’s office estimated that backlog at $8.3 billion.

“My predecessor, Gov. Rauner, tried to drag the state underwater with painful and draconian cuts that in the end were blocked by both Republicans and Democrats,” Pritzker said. “His approach devastated higher education, child care, human services, and hollowed out state agencies like those that manage public health and unemployment benefits, all while adding billions of dollars of debt on to our bill backlog.”

The impasse occurred beginning in July 2015, lasting 736 days, after lawmakers allowed a temporary income tax hike to expire which decreased the individual income tax rate from 5 percent to 3.75 percent.

That reduced state revenues by about $4.5 billion, but in the absence of a state budget targeting cuts in spending for two years afterward, the state continued to spend at a rate far outpacing revenues. As a result, many agencies, public schools and universities all eventually saw drastic drops in funding as obligated state expenditures took precedence.

“If you set aside federally protected programs, court ordered obligations and our bond and pension debt, we would have to reduce discretionary spending in our state by approximately 15 percent,” the governor said. “That’s 15 percent fewer state troopers. That’s 15 percent fewer students going to college, 15 percent fewer working parents receiving child care assistance and 15 percent less money for your local public schools, which likely means that your property taxes will increase.

“You could call this the republican approach option to raise revenue

within our current regressive flat tax system and impose a higher flat tax which falls disproportionately on the working poor and the middle class.”

Complicating matters is a global pandemic that has ripped a hole in state finances. Even before COVID-19 redefined the state’s revenue picture, Pritzker had pegged the state’s structural, year-after-year budget deficit at about $3.2 billion.

Considering lost revenues due to COVID-19 and associated economic restrictions, that deficit could exceed $7 billion with the graduated tax’s failure, Pritzker predicted in April.

In September, Pritzker directed state agency directors to prepare for cuts of up to 5 percent for the current fiscal year and 10 percent next fiscal year, which begins July 1.

On Sept. 24, Lt. Gov. Juliana Stratton said lawmakers “will be forced to consider raising income taxes on all Illinois residents by at least 20 percent, regardless of their level of income” if the graduated income tax fails. That would push the current tax rate to about 6 percent, and would require a simple majority vote in a Legislature dominated by Democrats as well as a signature from the governor.

The state’s path forward could include some combination of cuts and tax increases, as well as borrowing from the federal government’s Municipal Liquidity Facility program which was authorized in the state’s budget for fiscal year 2021.

“Everything is on the table,” Pritzker said.

Pritzker has also frequently urged the federal government to pass a COVID-19 stimulus package providing aid to states but talks had stalled between Democrats in the House and Republicans in the Senate and White House prior to the election.

Some who lobbied against the amendment, including libertarian-leaning think tank Illinois Policy Institute, which was once closely tied to Republican former Gov. Bruce Rauner, have suggested the results demonstrate a need for structural pension reform.

Annually, payments to the state’s pension liabilities—which exceed $137 billion— account for 20 percent or more of the state’s operating budget. That’s more than $8 billion total general revenue fund spending that will go to the state’s five pension funds this fiscal year.

But reforms to the pension system passed by lawmakers in 2013 were unanimously struck down by the state Supreme Court in 2015, and any major changes would also require an amendment to the Illinois Constitution, which currently protects existing pension benefits from being diminished.

Legislative Democrats have thus far not shown an appetite for such reforms, however, and three-fifths majorities in each chamber of the General Assembly would need to vote on the measure before it could be put to voters.

The opposition campaign also centered on the trustworthiness of state politicians and the possibility that the amendment would make it politically easier to raise a retirement tax on portions of the electorate, even though that was never proposed and the amendment would not have changed the vote threshold needed to tax retirement income.

“It is clear that Illinoisans do not trust this legislature and this administration to spend more of their precious tax dollars without restraint,” Illinois Chamber of Commerce President and CEO Todd Maisch said in a statement. “We believe we’re on our way to hearing from the electorate that Illinois needs a lot more than tax increases to fix our economy. Park District to receive funds to offset financial impact of pandemic

Two recent decisions by the Board of Park Commissioners will assist in dealing with the impact of COVID-19 related expenses on the District.

At the Sept. 14 meeting, the Park Board approved entering into an Intergovernmental Agreement (IGA) with DuPage County to have the opportunity to receive reimbursement for COVID-19 related expenses.

DuPage County received more than $161 million in federal funding to help pay for its response to the COVID-19 pandemic. Coronavirus Aid, Relief and Economic Security Act (CARES Act) funds can be

used for necessary or unanticipated expenses incurred due to the public health emergency. One million dollars of the county’s federal CARES Act funding has been made available to all 38 park districts in DuPage County.

The District is eligible to be reimbursed (based on per capita) up to $57,126 for COVID-19 related expenses through Dec. 31.

More recently, at the Oct. 26 meeting, the Park Board also approved an Intergovernmental and Subrecipient Agreement with Cook County for reimbursement of COVID-19 related expenses up to $5,000, such as per-

sonal protective equipment (PPE), sanitation, and Plexiglas.

Expenditures submitted to Cook County for reimbursement will be separate from those submitted in accordance with the DuPage County IGA. According to park officials, this funding will help ease some of the effects of the pandemic on the Park District community as the Board and staff continue to seek out resources and opportunities that will improve the Park District’s financial conditions during this challenging time.

‘AgeGuide’ seeks input on needs assessment survey

In preparation for AgeGuide’s next three-year Area Plan, AgeGuide will be hosting stakeholder listening sessions in each of its eight counties and distributing a needs assessment survey in January. This feedback is to help AgeGuide develop a service design that addresses the needs of older adults and caregivers in our region, especially those underserved populations such as limited English-speaking, LGBTQ+, racial and ethnic populations. This is a large undertaking for AgeGuide and the agency will be seeking the support of its community stakeholders to assist them with this work.

These Listening Sessions will be held remotely, on the Zoom platform (a phone-in option is also available) and the sessions will be discussing the Older Americans Act services that are provided in each of the agency’s counties to determine what is working, where there are barriers to service, and what services are needed but might be

More than 1,800 locally-owned Sport Clips Haircuts franchise locations will recognize Veterans Day, Wednesday, Nov. 11, when the company will donate an additional $1 per haircut service to support “Sport Clips Help A Hero Scholarships” for service members and veterans.

Edward-Elmhurst Health: Be aware of the coronavirus stigma As the COVID-19 pandemic continues in the United States, concern over the virus has manifested itself in a variety of ways.

In some cases, anxiety or fear can result in stigmatizing people with the virus.

Stigma is a mark of disgrace or a form of discrimination against a person or group of people, place or characterization. With a heightened awareness of how COVID-19 spreads and where outbreaks originate, it can be easy to blame someone or someplace for the spread of

the virus.

But, as the Centers for Disease Control and Prevention (CDC) notes, “no single person or group of people are more likely than others to spread COVID-19.” Blaming or shaming groups or individuals can be harmful and could make people targets for misplaced anger or hostility.

Moreover, it could prompt some to hide their symptoms for fear of being ostracized or targeted.

“People don’t want to be isolated,” said Phillip Cozzi, MD, pulmo-

nologist and medical director of the Sleep Center at Elmhurst Hospital.

“They want to continue to work and interact with family and friends.

They don’t want to lose their status in the community simply by contracting a virus.”

It is important to report any virus symptoms and for people to stay home if they are ill. If an individual becomes infected with the virus, they should be sure to let those with whom they have had recent contact (within the three days prior to a positive result) know that they may have been exposed, said Dr. Cozzi.

“Everyone in the community needs to be forthright with their infection,” said Dr. Cozzi.

And while that kind of forthrightness is key in fighting the virus, Dr. Cozzi added that fighting the stigma also is important.

“Welcome people back when they are no longer infected,” he added.

The CDC recommends some ways to help prevent the spread of COVID-19 stigma: • Educate yourself with facts about the virus. Visit the CDC site or your local health department for information about COVID-19.

• Reach out to those who may feel stigmatized by the virus. While people may not be able to physically visit someone who is quarantined by the virus, an encouraging text, phone call or card can help let them know they are not alone.

• Take time to thank and show support for essential workers such as grocery store clerks, healthcare workers, first responders and delivery drivers.

• Speak up about misinformation about the virus.

Visiting the library during a pandemic: What to expect

With additional COVID-19 safety precautions in place, the doors of Elmhurst Public Library remain open to visitors.

Visitors are required to wear masks and remain socially distanced from others for a maximum of a one-hour visit. Walk-ins are welcome, but reservations are required for some spaces like the Makery and Study Rooms.

Computers are available during visits and do not require a separate reservation.

“Our new grab-and-go service model gives patrons access to the Library’s collection while limiting time spent in the facility for the health and safety of all,” said Mary Beth Harper, Director.

The Creative Studio and Meeting Rooms are unavailable until further

Because of the pandemic, the Library has increased its virtual services by offering virtual meeting rooms, virtual chat with the Information Desk, and an increased digital collection with expanded borrowing privileges. In September, the Library checked out nearly 18,000 digital items.

The Library has stayed in step with its vast array of programming, offering all virtual programs primarily over Zoom or YouTube.

Throughout the pandemic, the Library has continuously served the community, and made its collections, services, and staff accessible to the public.

For the first time since Illinois adopted judicial retention elections in 1964, an Illinois Supreme Court justice lost a retention bid to stay on the state’s highest court.

Justice Thomas Kilbride failed to win at least 60 percent of the ‘yes’ vote in his district, earning only 56.4 percent of the vote, according to unofficial results. Kilbride conceded from the race in an email statement issued Nov. 3.

“Though votes continue to be counted, I am disappointed in the apparent outcome. I want to thank the voters of the Third Judicial District for twice placing their faith in me to uphold the sacred principles that guide our judicial system. Serving on the Illinois Supreme Court has been the honor and privilege of my lifetime, and I am proud of the legacy I will leave behind, including a court that is more open, transparent and accessible to all, regardless of economic means,” the statement read.

Kilbride is part of the 4-3 Democratic majority on the seven-person Supreme Court. He represents the 3rd Judicial District, which includes 21 counties across north-central Illinois.

Democratic justices have maintained a majority on the Illinois Supreme Court since 1969.

Kilbride’s retention was opposed

by Citizens for Judicial Fairness, a campaign committee that raised millions backing his removal, with hopes of electing a Republican to the 3rd District seat in 2022.

Jim Nowlan, chairman of the Judicial Fairness committee, in a statement, said the outcome “sends an unmistakable message that Illinoisans want an independent judiciary with no ties to [Democratic Illinois House Speaker] Mike Madigan.”

“We call on the Supreme Court to listen to the people as they consider a potential interim replacement to serve until 2022,” Nowlan said in the statement.

York boys cross country team perseveres through challenging COVID-19 season Coach Kern provides inside view of all the sectional runner-up Dukes had to overcome this fall

York boys cross country coach Charlie Kern tabbed the recently concluded season as “a struggle, to say the least.”

But even times of struggle, a York boys cross country team overcomes.

“We are better for it and we were able to race as we believed we could.”

York, whose season was greatly impacted by the COVID-19 virus, finished the season with a sec-

ond-place finish at the Class 3A Lyons Township sectional, trailing champion and nationally ranked St. Charles East by only five points.

York also took second at the Class 3A Proviso West regional.

Mickey Vreeland took fourth with a sectional time of 15:02 and defeated the regional champion and regional runner-up at the sectional. Colin Hill was fifth in 15:04 (he was ninth at the regional meet). Sam Ayers took 15th in 15:34 (he was 16th at the West Suburban Conference Silver Division meet). Ethan Summer took 19th at 15:43. Garrett Schwan was 20th in 15:44. Jackson Geiger took 22nd in 15:45 (Jackson took 18th in the regional meet) and David

Rosario finished 28th with a time of 15:52 (Rosario was 41st at the WSC Silver meet).

Kern noted in his usual report to alumni that the Lyons Township sectional was the first time during the season where the team’s best seven runners were competing. A key for York, Kern noted, was the return of Ayers. “With Sam back in the lineup we knew we could beat LT and sought to expose St. Charles’ weakness, runners No. 4 and 5. We thought it possible to put six before their fourth. The biggest problem to overcome was a very likely 1-2-3 finish for their top three.”

The first flight of the race at LT saw the No. 6 and No. 7 runners com-

pete. “Once again, the boys were not permitted to take the lead until after the 2.25-mile mark,” Kern explained.

“At the 2-mile mark there were six runners together. With just over 800 to go, Jackson (Geiger) moved into the lead and pushed all alone from there. David (Rosario) was in a group of three and numerous times was pushed or ridden to the side of the course. One final push occurred in the last 150 and David, not known for his kick, showed it and followed Jackson across the line. A 1-2 start was a great way to begin the meet.”

In the second flight (No. 5 and No. 4 runners), Ayers and Schwan were in a group of five leaders at the 2-mile mark. Ayers and a LT runner

were side-by-side in the last 200, but the LT runner inched ahead with 100 to go. With 20 meters left, Ayers rallied and came away victorious and Schwan finished third.

In the third flight (No. 3 and No. 2 runners), Hill stayed with is group and then moved in the last 300 and crossed the line in third place, “outkicking those with more leg speed, but not more heart,” Kern said. “Colin is back!” Hill crossed in third, while Summer was seventh.

The final flight included all teams’ No. 1 runners, plus the individual regional qualifiers. St. Charles East’s Luke Schildmeyer pulled away and

Local high schools remain in limbo regarding status of fast-approaching basketball season Movement throughout the state to cancel/postpone

As of press time, high schools in the Independent’s coverage area remained in a holding pattern on the topic of whether or not to pull the trigger and start the boys and girls basketball seasons on time.

Practices for boys and girls basketball, according to the Illinois High School Association’s COVID-19-adjusted calendar, are scheduled to start this coming Monday (Nov. 16).

However, schools throughout the state have been left to decide whether or not to proceed with the season with the Illinois Department of Public Health and the IHSA at loggerheads on whether or not to play basketball at this current stage of the pandemic.

IDPH recently elevated basketball to its high-risk sport category, meaning only non-contact practices and trainings can occur (with parental permission) and no contests can be staged. The IHSA followed with its ruling that, based on guidance from its Sports Medicine Advisory Committee, the season is OK to start on time, but with the caveat that each school is responsible for making the call on whether or not to proceed.

York High School athletic director Rob Wagner provided the Independent with Elmhurst Community Unit School District 205’s position on the

topic, which included reference to further communication being disseminated earlier this week.

“Concerning athletics, District 205 has received guidance from its insurer to follow the governor’s and Illinois Department of Health’s direction categorizing basketball as a high-risk sport and prohibiting basketball competition this winter,” the statement read. “The Illinois High School Association has decided to move ahead with basketball as a winter sport, in conflict with the Governor’s and IDPH’s direction. The district is awaiting guidance from its attorneys and information on this issue.”

York Principal Dr. Shahe Bagdasarian confirmed to the Independent that York anticipates having a decision on winter athletics, including basketball, this week. Girls bowling, boys swimming, cheerleading, dance and girls gymnastics also are slated to kick off practices Monday, Nov. 16 as low-risk sports (ending on Feb. 13). Wrestling, also categorized as a high-risk sport by IDPH, has been shifted back to a summer sport (starting April 19, 2021).

No status change was reported at either IC Catholic Prep or Timothy Christian. IC Catholic Prep athletic director Michael Fahey told the Independent the school continues to wait on a ruling from the Joliet Dio-

cese on whether or not basketball can proceed.

Of note as it relates to IC Catholic Prep, the Rockford Diocese, which encompasses Elgin St. Edward, Woodstock Marian Central Catholic, Rockford Boylan, Freeport Aquin, Sterling Newman Catholic and Aurora Central Catholic, said last week the boys and girls basketball seasons for those schools have been voided for the proposed winter season.

“The recent decision by the Illinois High School Association to move forward with the 2020-21 high school girls and boys basketball seasons beginning Nov. 16 without the support and endorsement of the Illinois Department of Public Health and the Illinois State Board of Education, and which would be in violation of the governor’s order prohibiting basketball practice and games, leaves our Diocesan high schools in a difficult and vulnerable position,” Rockford Diocese Superintendent of Schools Michael M. Kagan wrote in a letter to the schools. “Therefore, we are informing you today our six central Catholic high schools will not be participating in the IHSA season 2020-21.”

Fahey told the Independent he anticipated a hearing from the Joliet Diocese either late last week or early this week. Joliet includes IC Catholic Prep, Montini (Lombard), Joliet

Catholic, Providence Catholic (New Lenox), Benet Academy (Lisle), St. Francis (Wheaton) and Bishop McNamara (Kankakee).

Timothy Christian athletic director Jack LeGrand also said nothing has changed since the differing IDPH-IHSA rulings, but said the school plans to make a decision on whether or not to proceed with basketball this week.

Addison Trail athletic director Matt Thompson told the Independent late last week he had no update on a decision from DuPage High School District 88, which also includes Willowbrook. Messages late last week to multiple administrators at Willowbrook and Fenton in Bensenville (the Independent’s other two coverage school) seeking an update on those schools’ positions were not returned.

Schools from around the state have started making their positions known. Up north, Community School District 128, which includes Libertyville and Vernon Hills high schools, made the same decision to follow the state/governor rulings and not the IHSA’s, instead choosing to conduct basketball when the state gives the OK. Chicago Public Schools previously announced their schools will not play basketball either this winter.

A sampling of other schools siding with the state and not the IHSA

include Rockton Hononegah in the Rockford metro area, Ottawa from out west and the Maine Township high schools of Maine East, Maine South and Maine West, plus Huntley from McHenry County.

Schools such as Peoria Christian (familiar to Timothy Christian on the boys soccer front) and Parkview Christian in Yorkville plan to start the season on Nov. 16, while Kankakee High School said it will start practice Nov. 16 but put any competitions on hold. Sherrard High School, south of Davenport, Iowa, also voted to start its season Nov. 16, as did Lewiston (east of Macomb in western Illinois) and Lena-Winslow (west of Rockford).

The Chicago Sun-Times reported late last week that more than 150 schools in the state have opted out of starting next Monday. The newspaper added the IHSA recently sent out a survey to schools that included a question if they would be in favor of moving back the season.

This continued back-and-forth rages on as the state further regresses in its COVID-19 recovery. Several days last week positive test results throughout the state registered in five figures with positivity rates skyrocketing into double figures multiple times during the same timeframe —inching the state closer to further COVID-19 restrictions.

Fall superstars: York’s Gianna Nikoleit

Senior girls tennis player finishes career as one of the Dukes’ all-time best players

Statistically, the COVID-19 pandemic prevented York senior girls tennis player Gianna Nikoleit from leaving the school as its all-time wins leader.

Nikoleit finished her career tied for fourth on the school’s all-time girls tennis wins list with 102— three shy of third place (Blaire Porter, 105), five shy of second place (Gabby Riek, 107) and 15 shy of alltime leader Kelly Barry’s 117.

Odds are if York was able to play a full packed slate that York coach Tres Heimann is famous for, Nikoleit would have had a legitimate shot at breaking the record.

But regardless of what the numbers say, one thing is for certain: Nikoleit walks away as one of the program’s all-time greats.

“This year was pretty different from last year with the whole corona thing,” she said. “We couldn’t get as close to the team as we did in past years. It was very different. We were not able to gather and cheer for each other when we were on the court.

Playing-wise, it was pretty similar to past years. We had some really good players who had good seasons. I was happy with the end result.”

Nikoleit said one difference this year was with her mental approach. “I gained a lot of confidence throughout the season,” she said.

“After the high school season, I felt I was playing at my best because we were able to play multiple matches during the week and I got the experience, which helped my confidence.”

Nikoleit added that going over the 100-win mark for her career brought with it a big sense of accomplishment. “It is a big deal,” she said. “I felt very accomplished when I got that 100th win. I had a chance to beat the record, but with the shortened season I was not able to. I still am in a really happy place. I was happy to reach that 100 goal.”

decade ago and started on the competitive front at the age of 10. In recent years she has been attending the Evert Tennis Academy in Boca Raton, Florida.

“My first year was the summer going into sophomore year,” she said. “Last year, I went down there second semester and spent the whole semester there. I was there for five months. I had changed to online school before all the corona stuff, which was very different with no teacher. I had to figure things out myself. I did that to focus more on tennis. I had a really good time. At first, I was a little homesick, but I was used to being there from the summers. I got over it and really enjoyed it there. I got close with the new people and coaches I met. It’s really helped me.”

Nikoleit noted she did get to meet Chris Evert, the legendary women’s tennis player (winner of 18 Grand Slam titles). “She gave me a croissant at breakfast one morning,” she said with a laugh. “She is really nice. She was helping me with my volleys one morning.”

Nikoleit said she plans returning to the academy in the near future. “I am planning on going after I figure out all my college stuff,” she said.

“I’ll probably go back down and spend more time there and spend most of the summer playing. It really helps me get ready for college.

I’m down there by myself living in a dorm room. The tennis is great. You are learning from coaches from all over the world.”

Nikoleit’s goal is to indeed play college tennis. “Right now, I am looking at a few schools,” she said.

“My goal is to play Division I, and I want to go into nursing. There are a lot of options you can take with nursing.”

Looking back on her run at York, Nikoleit admitted there will be some sadness when she leaves. “I am going to miss York, but I will carry the pride of the Dukes forever,” she said.

“It will forever be with me. I was a Duke and I am very happy with that.

The coaches at York have been very helpful. Coach Heimann gave me a lot of good advice throughout the seasons.”

Restaurants push back as all 11 regions placed under mitigations Pritzker: ‘All I can say is that I am going to fight this virus’

Illinois restaurant owners are asking Gov. JB Pritzker to rethink the state’s efforts to control the spread of COVID-19 as yet another medical region was placed under enhanced mitigation measures on Oct. 30.

“We want to collaborate with the state of Illinois on a different path, one that addresses the alarming surges we are seeing while protecting the livelihood of industry workers and restaurant owners-operators across Illinois,” Sam Toia, president and CEO of the Illinois Restaurant Association, said during a news conference in Chicago.

Toia said he and other industry officials hope to meet with Pritzker this week to discuss alternative mitigation measures. In the meantime, he said, the restaurant association is teaming up with the National Restaurant Law Center in Washington, D.C., to file amicus briefs in several pending lawsuits challenging the administration’s executive orders.

“These are prudent actions we can take now to support favorable rulings in lawsuits that are under way,” Toia said. “There will be more. It is important for the courts to hear about our rights and how we’ve been harmed as an industry.”

Pritzker, however, gave no indication that he was willing to back away

from his mitigation strategy.

“Every day, we now see these numbers going through the roof,” he said during his daily COVID-19 briefing in Chicago. “And so, the idea that we’re going to make the locations that are amplifying the number of cases and the spread, the transmission of this virus, that we’re going to open those even more at this point makes no sense.”

The news conference came on the same day the Illinois Department of Public Health announced that Region 6 in east-central Illinois would be placed under enhanced mitigation measures, including the closing of bars and restaurants to indoor service. That took effect on Monday.

That left Region 2 in west-central Illinois, including Peoria and several surrounding counties, as the only one of the state’s 11 regions not currently under enhanced mitigations.

Those measures are triggered whenever a region crosses one of the state’s benchmarks that measure a dangerous surge in COVID-19 cases.

The most common reason has been recording three consecutive days of an average test positivity rate above 8 percent.

But even Region 2 fell into that category early last week. As of Oct. 28, the most recent data available, its positivity rate stood at 8.5 percent and had been rising for six of the previous 10

days.

Restaurant owners across the state have been leveling objections to the mitigation orders for weeks, arguing that there is scant evidence that the recent surge in outbreaks can be traced back to their establishments. They argue that theirs is one of the most heavily regulated industries in the U.S., undergoing frequent health and safety inspections, and that most restaurants have been diligent about cleaning, sanitizing and requiring patrons to wear face coverings.

“We all agree that private uncontrolled gatherings are a leading cause of the rise in cases,” Toia said. “Closing restaurants for indoor service will cause the exact opposite of the intended impact of slowing the spread as it drives people further into uncontrolled, unmonitored private gatherings where few safety precautions are in place. By closing our restaurants, people are going to have house parties and it’s just going to drive COVID-19 up.”

Pritzker has pointed to contact tracing data which shows bars and restaurant as the second-most identified location that people had visited 14 days prior to their COVID-19 diagnosis in 69 counties. The most identified location was “other,” which includes weddings, private gatherings, parties and others.

Bars and restaurants went through several weeks of mandatory closure during the state’s initial stay-at-home order in the early phase of the pandemic. They were allowed to reopen for outdoor service on May 29 when the state entered Phase 3 of the reopening plan, and later were allowed to open for limited indoor service starting June 26 when the state entered Phase 4.

At that time, based on the number of daily new cases and the rate of viral spread, it appeared that the COVID-19 pandemic was tapering off in Illinois.

But since late August, cases have begun surging again and regions across the state have been placed back under resurgence mitigation measures.

By Nov. 1 when those mitigations were to have taken effect in Region 3, which includes the Springfield and Quincy areas and several other counties in west-central Illinois—Toia said 90 percent of the state’s bars and restaurants will be closed to indoor service. And that percentage was expected to grow on Monday when restrictions take effect in Region 6.

“Fifty-five percent of Illinois operators say it’s unlikely their restaurants will be open if the current conditions are still in place in the next six months,” Toia said. “The most conservative estimates say that a minimum of 20 percent of our restaurants will close down here in the state of Illinois.

That means we will lose over 120,000 jobs.”

Pritzker, meanwhile, said he sympathizes with the restaurant industry, but he insisted the measures he is taking are the best way to control the spread of the disease.

“All I can say is that I am going to fight this virus,” he said. “We have got to get these numbers down, and do you know why? So we can reopen the bars and restaurants.”

Legislators discuss statewide police reforms

In the wake of a recent police shooting that left one teenager dead and a woman injured in Waukegan, lawmakers met in a joint hearing of the Senate Criminal Law Committee and Senate Special Committee on Public Safety Oct. 27 to discuss statewide reforms for law enforcement.

Lawmakers and witnesses discussed body cameras, mandatory data collection, increased transparency around police shootings, residency requirements for officers and changes to how allegations of police misconduct are handled. Public defenders, state’s attorneys, municipal officials and law enforcement all gave testimony.

“We must address the procedures and policies that perpetuate the inequality and injustice that Black communities face,” state Rep. Justin Slaughter, D-Chicago, a guest speaker at the committee hearing, said.

“Holding law enforcement officers to a higher standard and examining ways to increase transparency and accountability will undoubtedly help protect our families and pave the way for a more just future.”

Cook County Board President Toni Preckwinkle testified that change at the state level is required to enact lasting police reform, citing barriers of authority to municipal governments that have tried to implement changes regarding law enforcement.

“At the local level, police reforms have been limited at best,” Preckwinkle said. “The Chicago Police Department, for example, has either delayed implementation, or just refused implementation of the reforms.”

“We believe that the authority to mandate implementation should not

be dependent on the will of the police department, but rather, certain reforms should be codified at the state with funding tied to police departments’ compliance,” she added.

Amy Campanelli, who serves as the public defender of Cook County, testified that despite body cameras already being mandated by the Chicago Police Department, her office has dealt with several recent cases where officers “blatantly violate their body worn camera policy.”

Campanelli called for the General Assembly to pass House Bill 2111 which would make it a felony for a member of law enforcement to turn off, or fail to turn on, their body camera. Preckwinkle and the ACLU also supported the bill in written testimony.

According to Campanelli, cases that involve body camera footage move through the legal system quicker thanks to an objective third-party view being available to prosecutors, judges and defense attorneys.

“Body cameras and, more specifically, policies that require their constant use and that allow officers to be punished for violating them is the easiest and most effective way to ensure a greater sense of police accountability,” state Sen. Robert Peters, D-Chicago, said. “The era of ‘their word versus mine’ must come to an end. There must be a publicly available, unbiased record of any incidents that occur so that justice can be delivered and so that safety can be prioritized above all else.”

Illinois Association of Chiefs of Police Director Ed Wojcicki and Elgin Police Chief Ana Lalley supported the claim that body cameras help law enforcement and the justice system solve cases swiftly and accurately.

Children and school staff will likely be wearing masks. Students will be sitting farther apart in the classroom and won’t be able interact closely with each other like they did before.

Reassure children that this is temporary and find supportive resources to help them cope with stress.

4. Transitioning home. Maintain a daily routine before and after school. When children return home, make sure they wash their hands immediately.

Edward-Elmhurst Health offers selfcare techniques to optimize e-learning The changes people face from COVID-19 continue to create unanticipated challenges.

The introduction of e-learning in many schools has been one of those.

Parents, guardians, children and school staff are figuring out how to adapt to this new form of schooling that COVID-19 has created.

Parents must balance work (and in many cases, working from home) with overseeing their children’s schoolwork at home. Teachers must figure out how to navigate this new form of online teaching and ensure that the quality of learning isn’t diminished.

While everyone does what they can to manage these changes, anxiety can still creep up. How can people most effectively manage e-learning?

First, make time for self-care. The term “self-care” is relatively new in pop culture. The definition is simple: self-care means taking care of yourself. However, it is not uncommon to be stuck on what exactly that means.

Self-care starts with the basics of making sure physical needs are met: eating regularly, sleeping well and taking care of daily needs (e.g., showering, brushing teeth, exercise). This is a good starting point when someone is struggling with managing the daily to-dos or the new challenges that COVID-19 may have thrown into the day.

So, when someone is having a particularly rough day with either getting the kids focused on their schoolwork or juggling your own work, they should take five minutes and check in with those small things. Ask: • “Did I eat lunch?”

• “How has my sleep been?”

• “When can I take a shower next?”

Asking and answering these simple questions can help someone ground themselves for a moment to make sure they’ve met those basic needs.

The next step in self-care moves to emotional needs. Someone can do all the basic self-care items and still struggle to manage their anxiety over how to tackle the day. This is when people need to take time for themselves and do even small things that will help recharge their emotional batteries.

Taking time for self-care can be daunting, but it’s not impossible.

Think of things that can make the day a little easier and see if it’s possible to make time for even one of those things each day.

When anxiety over e-learning feels overwhelming, try these emotional self-care techniques: • Create an organized space for learning/working separate from where the “living/relaxing” occurs in the rest of the house.

• Take time to communicate with others about any support you need.

• Have an open conversation with your family about everyone’s frustrations with e-learning and brainstorm ideas for how to support one another.

• Start a text message chain with fellow parents or teachers with something you are grateful for once a day.

• End a discussion with small or big “wins” that you all feel have been accomplished or achieved for the day.

• Find kind words to post around the house or workspace that you find comforting, empowering or funny.

• Give yourself a reward for completing a day of e-learning that was especially challenging, such as ordering your favorite take-out meal or watching a movie you have been meaning to watch.

People can easily forget to do things for themselves, especially now. When someone engages in self-care, they are more attuned to not only what their body needs (basics of self-care) but also what they mentally need (emotional self-care).

State legislators are considering eliminating or limiting aspects of qualified immunity for law enforcement.

Qualified immunity isn’t an explicit federal statute or law but a legal doctrine established in its current form by the U.S. Supreme Court in the 1982 case Harlow v. Fitzgerald which grants government officials immunity from civil suits in the course of their duties. It is most often used in cases of alleged police misconduct or brutality.

At a joint hearing of the Senate Criminal Law and Public Safety committees on Nov. 6, lawmakers heard testimony from legal experts, law enforcement and municipal officials on the impact of qualified immunity and its potential removal.

The committee also discussed officer liability and amendments to the Uniform Peace Officers’ Disciplinary Act. State Sen. Robert Peters, D-Chicago, co-chaired the hearing.

“Qualified immunity is often used as justification for excessive force and other forms of police misconduct,” Peters said in a release after the hearing. “If officers had to worry about facing consequences from their actions, maybe they would think twice before brutalizing our communities. We cannot and will not win real safety and justice until police officers are able to be held accountable for their actions.”

In order to lose qualified immunity, officers must violate “clearly established statutory or constitutional rights of which a reasonable person would have known.”

Supreme Court scholar Carolyn Shapiro, who has argued cases in the state and federal supreme courts, testified to lawmakers that this standard has meant that unless a nearly identical case of police misconduct has previously appeared before a court, officers could not have reasonably known their misconduct was violating the rights of the plaintiffs.

“Increasingly courts require more and more precise identity between the allegations that the plaintiffs are making and the pre-existing cases,” Shapiro said.

Shapiro offered two examples to the joint committee of when the lack of precedent has led to officers being shielded from civil liability for their misconduct.

The first was a case in the 9th U.S. Circuit Court of Appeals in which officers serving a search warrant in

2013 removed more than $200,000 of the homeowner’s possessions and underreported what was seized, allegedly keeping the difference for themselves. In subsequent litigation, the officers were granted qualified immunity on the grounds that there was no previous case or lawsuit that indicated the action would violate the homeowner’s constitutional rights, Shapiro said.

The second example was a case in the 11th U.S. Circuit Court of Appeals in which a Georgia sheriff’s deputy, while apprehending a criminal suspect during a chase that spilled onto private property where children were playing, held children at gunpoint. The deputy fired two errant shots at a dog belonging to one of the children, striking the 10-yearold owner of the dog once in the leg while he and the other kids laid face down on the deputy’s orders.

The appellate court granted the deputy qualified immunity from civil suit from the boy’s family on the grounds “that it was not clearly established it would be a constitutional violation to fire into a group of children,” Shapiro said.

According to Shapiro, there are exceptions to the rules on qualified immunity in cases where “the facts are so egregious that they say any reasonable officer would recognize the constitutional violation.”

The U.S. Supreme Court ruled on one such case Nov. 2, Taylor vs.

Riojas, denying qualified immunity to corrections officers who left an inmate in a cell covered in feces for days before leaving him naked for several more days in a different cell kept at frigid temperatures.

The high court overturned a decision by the 5th U.S. Circuit Court of Appeals, which originally had granted the correctional officers qualified immunity on the grounds they didn’t have “‘fair warning’ that their specific acts were unconstitutional.”

Brad Cole, executive director of the Illinois Municipal League, testified before the joint committee Nov. 5 that ending qualified immunity was not the answer to curtailing police brutality and enacting police reform.

“We are aware of a growing movement to abolish or limit qualified immunity, in part a reaction to widely publicized instances of police misconduct,” Cole said. “While we’re interested in exploring and possibly supporting aspects of policing reforms, the weakening or elimination of qualified immunity is something the Illinois Municipal League does not support.”
