Village, School District 2 partner to beautify utility boxes Students create art pieces around town

The Village of Bensenville collaborated with Bensenville School District 2 and their talented students to transform seven local utility boxes into beautiful art pieces.

These displays are made of vinyl wrap that is expected to last for years.

Designs range from historical Bensenville monuments, assorted gears, and several others that highlight the community.

“Through our partnership with The Village of Bensenville and the Bensenville Community Foundation, District 2 students were offered a summer program that allowed them to design vinyl pieces of art,” said director of community schools and birth-to-three coordinator Christy Poli.

“Students had fun working together to create art that represented their community while also learning about collaboration and how to reflect their perspectives in creative work. These types of partnerships help strengthen and develop the community-school approach to learning, and allow stakeholders to collaborate with the goal of improving outcomes for students.”

“In the last few years, we have made an effort to bring public art to Bensenville,” said Village President Frank DeSimone. “This project provided a great opportunity to spread art throughout our community while also shining a light on Bensenville’s talented students.”

The newly-decorated boxes are located along Irving Park Road, Church Road, and several other high-traffic areas throughout Bensenville.

Board approves 100% paper ballots for DuPage County New voting system on the way for 2022 primary election

On Tuesday, Oct. 26, the DuPage County Board unanimously approved funding for DuPage County Clerk Jean Kaczmarek’s request for a new voting system which features 100 percent paper ballots. The Clerk’s office selected the Hart InterCivic Verity paper voting solution scheduled to be in place for the 2022 Primary election.

“I have been waiting to say these words for 16 years,” Kaczmarek said.

“DuPage County will have 100 percent paper ballots.

“DuPage is very proud to be the first county in Illinois to use complete on-demand ballot printing for both Early Voting and Election Day voting. Not only are we upgrading to the most secure, transparent, and user-friendly voting system on the market, but we are also saving the County money by printing only the ballots needed by voters so there is no waste. Finally, and most importantly, our County’s new system will ensure all voters have the same voting experience; there is no different

size or shape of ballot for voters with disabilities.

“Voters can use a fully accessible ballot marking device and that device produces a ballot that looks like all others. Everyone will be treated equally.”

The County agreed to a four-year contract for $7,264,965, including initial equipment purchase costs, with options for two additional fouryear renewals. The Hart system will replace the County’s optical scanners purchased 20 years ago and touchscreen machines purchased 16 years ago. The Clerk’s office was notified that the current voting equipment would no longer be supported after this year.

to the internet, making it impossible to hack. The Verity Scan allows reliable audits of voter intent with digital captures of all scanned ballots. The system offers automatic counting for write-in votes, ranked choice voting capability, faster and reliable recounts and multiple language options.

Every aspect of operations is anticipated to become more efficient with the new system, including quicker lines in polling places and easier start-up and shut-down for election judges. Hart will integrate well with the KNOWiNK poll pads for checking in voters.

Chicago man charged with attempting to carjack a woman at gunpoint DuPage County State’s Attorney Robert Berlin and Downers Grove Chief of Police Shanon Gillette announced that bond was set for a Chicago man accused of attempting to carjack a woman’s car from a Downers Grove gas station and stealing her cell phone.

Demario Butler, 30, appeared in Bond Court where Judge James McCluskey set bond at $500,000 with 10 percent to apply. Butler has been charged with one count of attempt aggravated vehicular hijacking with a firearm (Class 1 felony) and one count of armed robbery with a firearm (Class X felony).

On Sept. 30 at approximately 1:19 p.m., officers with the Downers Grove Police Department were dispatched to the BP gas station located in the 4000 block of Main Street, Downers Grove, for a call of an armed robbery and attempted vehicular hijacking that had just occurred.

Upon their arrival, officers spoke to the victim and several other witnesses at the gas station.

It is alleged that the victim was at the gas station when two people approached her, Butler on the driver’s side of the vehicle and the second individual on the passenger side of the vehicle. It is alleged that Butler was

holding a black handgun next to his face with the barrel pointed upward and demanded the victim’s car keys and cell phone.

It is further alleged that the victim handed over her cell phone to Butler and then ran toward the store. It is alleged that Butler then entered the driver’s side of the victim’s vehicle.

It is further alleged that Butler and the other individual were unable to start the car and exited the vehicle.

It is alleged that after exiting the vehicle, Butler initially began walking toward the victim but then changed course and ran toward Ogden Avenue.

DuPage County Board approves new district maps The DuPage County Board voted Tuesday, Oct. 26 to approve new County Board district boundaries for the next decade.

The County Board is required by state law to complete the reapportionment process every 10 years following the U.S. Census to ensure each County Board district represents a substantially equal number of people.

By law, the districts must be substantially equal in population, contiguous, and as compact as practical. Jim Zay, chairman of the Redistricting Committee, said the committee set a goal to keep villages and cities in the same district to the extent possible.

“From the beginning, our goal has been to create a fair map that keeps

communities intact,” said Zay. “I’m proud of the County Board for putting politics aside to create a fair, transparent, bipartisan map.”

The County’s Redistricting Committee was established in January 2021 and held 11 meetings and four open house forums to discuss the maps. In addition to an online portal, allowing for residents to provide feedback.

“A booster dose of the Moderna or Pfizer vaccine, given six months after the primary series, elicits a much stronger immune response with antibody levels several fold higher against the delta variant,” says Dr. Jonathan Pinsky, medical director, Infection Control & Prevention, Edward Hospital.

“This results in better protection against infection across all ages and a much lower chance of needing hospitalization for older age groups.”

In the U.S., two doses of the Janssen (J&J) vaccine, given more than two months apart, had an efficacy of 94 percent in preventing symptomatic infection, compared to one-dose that was 70 percent effective.

Medical experts are learning more about COVID-19 and how the vaccines work in real time. With more time and study, they will better understand what is necessary to maintain immunity.

Other vaccines, such as polio, HPV, MMR (measles/mumps/rubella) and Tdap (diphtheria/tetanus/pertussis– adults should get a booster dose of Tdap every 10 years) require multiple doses to be effective.

Who’s eligible for a booster shot?

Over the last year, health experts have been studying the effectiveness of the COVID-19 vaccines.

Real-world evidence showed the vaccines offered outstanding protection against COVID-19.

Vaccine effectiveness does wane with time, however, and is not as strong against the delta variant. While breakthrough infections became more frequent in some vaccinated people, the vaccine still provides strong protection against severe infection requiring hospitalization. For those over age 65, there is a slight decrease in protection against severe infection.

Health experts found the slightly waning immunity combined with the emergency of the highly contagious delta variant provided less protection against infection or mild illness.

Does the booster availability mean the vaccines don’t work?

No. In fact, the boosters are intended to better protect those with weakened immune systems (from disease, treatment or age), and decrease the likelihood of infection or mild illness in healthy people that could result from increased exposure to the contagious delta variant. Even without the boost, all the COVID-19 vaccines provide strong protection against hospitalization and death.

On Oct. 21, the Centers for Disease Control and Prevention (CDC) authorized booster shots of Pfizer, Moderna and Janssen (J&J), and approved mixing vaccine boosters—for instance, someone who received a shot of J&J could get a booster shot of Moderna.

“They have worked very hard preparing their audition material for the last seven weeks by meeting for weekly preparation sessions, and submitting mock auditions,” said Superintendent James Ongtengco. “They will represent Fenton and attend the festival on Nov. 20 at Elmhurst University. These students may be invited to participate in the annual All-State Music Conference.”

Playing the flute, Anna represented the United States of America in the up-to-18-years age group and earned a score of 86.09.

She was among just 27 others throughout the world who earned scores qualifying for a first, second or third prize.

“I would like to thank my parents,” Anna said, turning to look at them during the School Board meeting.

“Thank you so much for always being there for me, literally since Day One. You support me no matter how crazy my dreams seem. I feel very, very blessed for all of your unconditional love and support. I wouldn’t be the woman I am today without you.”

Anna also thanked Fenton Band Director Garett George, saying she “couldn’t have made it without him.”

Last year Anna qualified for the Illinois Music Education Association (ILMEA) All State Band and is part way to repeating this year. She was recently named to the 2021 ILMEA District 1 Band and to the Orchestra for her auditions on both the flute and the piccolo. District 1 of ILMEA includes all Chicago area high schools and is considered extremely competitive.

Anna and Mr. George should know by early 2022 if Anna will repeat as a state qualifier. Her same audition from September will be reviewed by the state committee.

Gia Mia to receive B2B state grant To recognize the efforts of small businesses, state Sen. Suzy Glowiak Hilton (D-Western Springs) is highlighting recipients of Back to Business grants and encouraging residents to shop local as the holiday season approaches.

“To receive operating assistance from the state, nine locally-owned businesses were able to demonstrate financial loss from the pandemic,” Glowiak Hilton said. “By offering support to small businesses, Illinois is

working to strengthen our communities.”

Awarded a combined $550,000, there were nine B2B grant recipients in the 24th Senate District in our area, including Gia Mia in Elmhurst and Subway in Lombard.

The B2B program allocated $250 million in American Rescue Plan dollars for small businesses hurt financially by the pandemic. Grants ranged from $5,000 to $150,000 and could be used to cover a wide range of

operations, such as staff and overhead costs.

“Shopping local can make a difference in our communities this holiday season,” Glowiak Hilton said. “Buying gift cards, recommending a local service or simply interacting on social media can offer support to our small business community.”

Chicago historian debunks myths, mysteries of Great Chicago Fire at EHM Of all the catastrophic events that have taken place in Chicago’s history, none is more infamous than the Great Chicago Fire of 1871. This October, the City of Chicago takes a look back at the fire after 150 years to consider its impact on the growing city and its long-lasting legacy.

If there’s one thing for sure, it is that 150 years later, no one really knows for certain what happened on that warm October night, when a

blaze of epic proportions erupted in Catherine O’Leary’s barn on Chicago’s near southside. Within two days, one-third of the city was decimated by the raging flames leaving more than 17,400 buildings destroyed, 300 people dead, and 100,000 residents homeless.

As Chicago marks the 150th anniversary, many questions still surround the inferno. Was Mrs. O’Leary’s cow, Daisy, the real cul-

prit? Did the nefarious beer deliveryman known as Daniel “Peg Leg” Sullivan play a role? To shed some light on these long-standing myths and rumors, the Elmhurst History Museum welcomes Chicago historian and tour guide, Mr. Al Walovich, with his presentation “Daisy Didn’t Do It: The Truth Behind the Great Chicago Fire.”

The program will take place on Sunday, Nov. 14, at 2 p.m. at Elmhurst City Hall’s Council Chambers,

located on the second floor at 209 N. York Street.

The program is free to members of the Elmhurst Heritage Foundation and $5 for non-members. Advance registration is required and can be made at www.elmhursthistory.org in the programs section. Free on-site parking is available.

Walovich will delve into the history, facts and lies that surround the Great Chicago Fire, and share some of the sites linked to the fire and

His popular tours have included Chicago cemetery tours, the Great Chicago Fire, and the World’s Columbian Exposition and he is a seasoned guide on Chicago River tours.

Symphony to present ‘Brass Blowout’ Dedicated to the late Fred Hodge, concert will feature Stanger winner

The Elmhurst Symphony Orchestra, under the baton of Music Director and Conductor Stephen Alltop, continues its “Music Alive” season of spectacular music-making with “Brass Blowout” on Saturday, Nov. 13 at 7 p.m. at Elmhurst Christian Reformed Church.

In this year-long celebration of the 60 seasons the ESO has been bringing exceptional orchestral performances to the western suburbs and beyond, “Brass Blowout” will delight you with selections by familiar and well-loved composers: Falla’s Suites Nos. 1 and 2 from The Three-Cornered Hat; Ravel’s Boléro; The Pines of Rome by Respighi, and Tchaikovsky’s Piano Concerto No. 1 in B-flat minor, Mvt. 3, featuring guest artist pianist Shivshankar Prasad, the 2020 Stanger Audition winner.

The Illinois House late on Oct. 27 gave final passage to a bill that repeals the state’s Parental Notice of Abortion Act, clearing the way for Gov. JB Pritzker to sign it into law.

The bill narrowly passed out of the Senate Oct. 26 on a 32-22 vote, with three Democrats voting no and six Democrats not voting.

It passed the House after 11 p.m.

Oct. 27, 62-51. Because it did not receive a three-fifths majority, or 71 votes, it cannot take effect until June 1, 2022.

The parental notice law in its current form was passed in 1995 but did not take effect until 2013 due to litigation. It requires abortion providers to notify a parent or adult family member at least 48 hours in advance of performing the procedure on a patient under the age of 18.

The current law contains exceptions if the minor was a victim of physical or sexual abuse or neglect by an adult family member, if the minor is married or emancipated, or if the provider determines there is

a medical emergency, or if an adult family member waives the notice in writing. A judge can also waive the requirement and has done so approximately 575 times since the law took effect, according to committee testimony.

Supporters of repealing the notice requirement said it deters many pregnant minors from seeking abortion services and could put them in danger if the parent who would be notified is their abuser.

They also argued that the judicial bypass provision is both intimidating and overly burdensome, especially since the onset of the pandemic, which forced many courts to stop holding in-person hearings.

Susan Fox Gillis, a retired Cook County circuit judge, told the House Executive Committee on Oct. 27 that since the law was enacted, she and her colleagues in the court had heard “hundreds” of cases from minors seeking a judicial bypass.

“That law, in my experience as a judge tasked with deciding these waivers, is unnecessary, overly punitive, and it places burdens on young women seeking health care. It should

be repealed,” she said. “Each of the young women who came before me had good reasons for not sharing her decision with a parent.”

Opponents of the bill, however, argued that the issue is not about a pregnant minor’s right to seek an abortion but rather the right of parents to be involved in their child’s health care decisions.

In floor debate, Rep. Avery Bourne, R-Morrisonville, argued that the current law allows abuse victims to bypass parental notice even without going through the court process.

The minor can certify in writing that they are an abuse victim, and the attending physician would put that written certification on file.

“So for those who are experiencing the horrible, horrible situation that they have been abused, neglected, the whole list,” Bourne said, “they don’t have to go through the judicial bypass and they don’t have to notify their parents.”

Bourne emphasized that the notification is done by the clinic, not the minor.

Congressional probe into the NFL and the Washington Football Team’s hostile workplace

Raja Krishnamoorthi As chairman of the Oversight Subcommittee on Economic and Consumer Policy, I recently sent a letter with Oversight Committee Chairwoman Carolyn Maloney to National Football League Commissioner Roger Goodell requesting documents on the League’s investigation into the Washington Football Team’s culture of sexual harassment and discrimination.

The NFL’s investigation led to a $10 million fine for the Washington Football Team, with no release of a report or reform recommendations.

Recently, leaked emails between Washington Football Team official Bruce Allen and former NFL coach

Jon Gruden exposed the scale of the underlying issues while raising serious questions about the NFL’s lack of transparency around the investigation.

The NFL is one of the nation’s most visible employers, and its decisions can have national implications. I’m investigating the Washington Football Team’s workplace conduct issues and the League’s response to help inform legislative efforts to address other toxic work environments. As I said on ESPN’s SportsCenter, we need full transparency from the NFL to resolve their workplace issues and possible violations.

Addison Trail freshman earns Honorable Mention in statewide translation competition

Addison Trail freshman Gabriela Carpenter recently participated in the Illinois High School Translation Competition and earned an Honorable Mention.

This competition aims to promote the study of less commonly taught languages and to provide high school students with an opportunity to get hands-on experience in translation.

Participants translate a 450-700word text (which ranges from literature to news articles) from Greek, Hebrew, Italian, Polish or Swedish into English.

The Illinois High School Translation Competition is organized by the European Union Center at University of Illinois at Urbana-Champaign and is judged by university faculty and instructors who have native or near-native knowledge of the target languages and who have experience with translation. One winning entry is chosen for each of the five target languages.

Carpenter participated in the Polish-English division, and she and the other winners/Honorable Mention recipients will be recognized on Nov. 4 during an award ceremony hosted by the Consulate General of Italy and Italian Cultural Center in Chicago.

EEHealth: An aspirin a day may not be best way to avoid heart disease and stroke For years, physicians have recommended some adults take an aspirin a day in late middle age to reduce their risk of a heart attack or stroke.

Aspirin, a blood Dr. John Cahill thinner, can help prevent heart attack and stroke (also known as cardiovascular disease) by preventing blood clots from forming in blood vessels that carry blood to the heart and brain.

In 2016, the U.S. Preventive Services Task Force (USPSTF) recommended a daily aspirin to reduce the

risk of a first heart attack or stroke.

But new evidence shows a daily aspirin may do more harm than good, especially in people age 60 and older.

The task force recently reversed its recommendation for certain individuals to take a daily aspirin to help prevent cardiovascular disease.

“The most serious potential harm a daily aspirin can cause is bleeding in the stomach, intestines and brain,” the group said in its statement. “The chance of bleeding increases with age and can be life-threatening.”

The task force does not recommend that people age 60 and older begin taking aspirin to prevent heart attack or stroke, and says people age 40 to 59 should talk with their doctor be-

fore starting a daily aspirin regimen to assess whether the benefit outweighs the risk.

“The group of patients this applies to are people who don’t have a history of heart attack or stroke,” said John Cahill, M.D., an interventional cardiologist with Midwest Cardiovascular Institute and on the medical staff at Elmhurst Hospital. “People who have already had overt heart disease such as a bypass, heart attack or implantation of a coronary stent clearly benefit from taking an aspirin, and the benefit far outweighs the risk.”

This task force recommendation applies only to those who are at a higher risk for cardiovascular disease, have not had a heart attack or stroke

and are not already taking daily aspirin.

“People in that category who are already taking an aspirin a day should not stop taking it but should consult with their doctor in light of this new recommendation,” said Dr. Cahill.

There is a growing number of people who have some plaque blockage that may show up on a heart scan, but it’s not severe enough to warrant a stent or cause a heart attack. Would aspirin help them?

“The guidelines don’t really address this group of patients. Would those people, who we know have early plaque, benefit from aspirin? I would recommend it, but it’s something they should discuss with their

doctor,” says Dr. Cahill.

Fortunately, there are ways to lower your risk of heart attack and stroke that don’t involve a daily aspirin, said Dr. Cahill.

“Being aware of your blood pressure and working with a doctor to get it under control if necessary is important,” he said.

“Other illnesses that can increase your risk, such as diabetes or high cholesterol, are treatable and should be treated aggressively to lower the risk of heart attack.

“For everyone, eating a healthy diet and regular exercise are the bedrock of preventive care.”

Congressional redistricting plan clears General Assembly CAPITOL NEWS ILLINOIS

Illinois lawmakers gave final approval in the early hours of Oct. 29 to a new congressional redistricting plan that divides the state into 17 districts, one fewer than it currently has due to its loss of population since the 2010 U.S. Census.

It was the fourth draft plan that legislative Democrats had proposed over the previous two weeks, and it was introduced to the public after 7 p.m. Oct. 29.

Like earlier versions, it collapses two southern Illinois districts into a single district while carving up much of downstate Illinois into a number of oddly shaped districts that put cities as far apart as East St. Louis and Champaign into one district, with Bloomington and Rockford linked in another.

“This will be the most gerrymandered map in the country,” Sen. Don DeWitte, R-St. Charles, said during floor debate. “And this process will be used as the poster child for why politicians should never be allowed to draw their own maps.”

But Senate President Don Harmon, D-Oak Park, who carried the bill on the floor of the Senate, defended the maps, saying, “I’m here to stand behind the work we’ve done.”

“We’ve shown our maps to the public. We have presented them in hearing after hearing after hearing. We have refined them based on the input that we’ve gotten. And I’m proud of this map,” he said.

Most of the legislative wrangling over the past two weeks, however, centered on Chicago and the collar counties, and pressure from within the Democratic caucus to create a second largely-Latino district because of the rapid population growth within that community over the past 10 years.

Illinois’ congressional delegation is currently divided 13-5 in favor of Democrats. Independent analysts, including the nonpartisan Princeton Gerrymandering Project, have estimated that earlier iterations of the plan would give Democrats as many as 14 seats, and Republicans as few as three.

If that holds true, it could have national implications because Democratic congressional leaders are looking to states like Illinois and New York to help offset losses they expect to take in states where Republicans control the redistricting process.

The redistricting plan passed the Senate on a straight party line vote, 41-18. It passed the House nearly on a party line vote, 71-43, losing

two Democratic votes.

Rep. Kelly Cassidy, D-Chicago, did not vote on the remap proposal. The lone Democratic “no” vote came from Rep. Angelica Guerrero-Cuellar, who was appointed to the 22nd state legislative district in Chicago to replace former House Speaker Michael Madigan, who resigned earlier this year.

Guerrero-Cuellar said on the floor that she remained upset about how the 22nd District was reshaped during the legislative redistricting process in August.

“And there was something done to that district intentionally to exclude Latinos and that representation,” she said. “So, when someone tells me, ‘Hey, we’re here to represent the Latinos on the southwest side,’ I’m gonna say, hold on. That was not the case.”

The maps passed after a long day of legislative action during which it appeared rifts in the supermajority Democratic caucus might derail the proposal.

Just before 5 p.m. Oct. 28, House Redistricting Committee Chair Lisa Hernandez, D-Cicero, declined an interview request with Capitol News Illinois, noting she was working with fellow lawmakers.

“I don’t know yet,” she responded when asked if she thought the maps would have the votes to pass Oct. 28.

The maps needed three-fifths majorities to pass due to a clause in the Illinois Constitution that states any bill passed after May 31 cannot take effect until June 1 of the following year if it does not reach that threshold.

Democrats account for more than the 71 votes needed in the 118-member House, and 36 needed in the 59-member Senate, but bringing them all together proved an elusive task for much of the day.

The draft of the maps that eventually passed Oct. 28 was largely similar to previous versions, except that it moved 3rd District incumbent Rep. Marie Newman, D-La Grange, into a district with Rep. Jesus “Chuy” Garcia, D-Chicago, into a reshaped 4th District.

Garcia’s current district has been described as the “ear muffs” district, or a C-shaped district, because it stretches from southwest Chicago westward to Westchester and Hillside, then northward along a narrow strip to the Northlake area, then back east along Chicago’s north side.

That district is being reshaped in a way that lops off part of the northern strip and forms a new 3rd District, which would be Illinois’ second Latino influence district. It stretches from the north side of Chicago westward to an area

that includes portions of West Chicago and Elgin.

In southern Illinois, which saw the most dramatic population declines since the 2010 census, Republican Reps. Mike Bost, of Murphysboro, and Mary Miller, of Oakland, would be paired together in a new 12th District.

In central Illinois, Republican Reps. Darin LaHood, of Peoria, and Adam Kinzinger, of Channahon, would face each other in a 16th District primary.

Unlike the Oct. 27 map, the latest version left Democratic Rep Sean Casten, of Downers

Grove, uncontested in the 6th District primary. Newman was drawn into that district in the Oct. 27 version, but was moved into Garcia’s district in Oct. 28’s map.

Some people who spoke during the Oct. 28 hearing expressed disappointment with the latest draft, including residents of what is currently the 3rd District on Chicago’s southwest side.

Health Care Right of Conscience changes will head to governor

Measure aimed at addressing court exceptions to COVID-19 vaccine, testing mandates

By Jerry Nowicki Capitol News Illinois The Illinois Senate joined the House on Oct.28 in approving a change to the Health Care Right of Conscience Act that was requested by the governor and attorney general, putting it one signature away from becoming law.

The HCRC Act currently prohibits discrimination against anyone for their “conscientious refusal to receive, obtain, accept, perform, assist, counsel, suggest, recommend, refer or participate in any way in any particular form of health care services contrary to his or her conscience.”

The bill passed Oct. 28 would add language stating that it is not a violation of the law for an employer “to take any measures or impose any requirements …intended to prevent contraction or transmission of COVID-19.”

Its supporters believe the measure will clarify the legislature’s intent as a number of court cases continue through the system in which Illinoisans are challenging COVID-19 vaccine or testing requirements by citing protections afforded in the HCRC Act. It’s needed to close a legal loophole allowing people to flout those mandates, they argued.

William Beaulieu and Clare Duggan, both members of a group called Coalition for Change IL3, said that group was formed, in part, to unite the diverse communities and bring about change in the 3rd District.

Members of that coalition have testified at nearly every public hearing about new congressional maps since the hearings began in early August, and Duggan said many of them had submitted their own proposed maps through the Democratic caucuses’ mapmaking web portals.

Despite that, Duggan said, while

the latest draft would keep more of the current 3rd District intact than previous iterations, significant parts of the district would be broken off into other districts.

Under questioning from Republican senators, Harmon said the proposal was based on “the totality” of input that legislative leaders received from the public as well as other sources, including private communications with staff from various congressional offices.

“We are not obviously adopting one person’s map and presenting it as our own,” Harmon said. “We are taking input from all sources and it is reflected in the maps presented to the Senate.”

Critics of the bill, however, argued the language is overly broad and that the Health Care Right of Conscience Act actually was intended to protect an individual’s right to make his or her own health care decisions.

It passed the Senate 31-24 just before 11 p.m. Thursday with no Republican votes. Because the bill did not receive a three-fifths majority in both chambers, its effective date is set for June 1, 2022, per a provision of the state constitution pertaining to bills passed after May 31.

Supporters, including bill sponsors Rep. Robyn Gabel, D-Elgin, and Senate President Don Harmon, D-Oak Park, argued over the past two days that the measure does not mandate vaccination.

“Contrary to rampant misinformation campaigns, this bill is not a vaccine mandate,” Gabel said. “In fact, it does not require anyone to do anything. As the bill itself says, this is simply a declaration of existing law and shall not be construed as a new enactment.”

Harmon argued that the existing law should not be applicable to mitigation measures aimed at slowing a deadly pandemic. Those with health care or religious concerns regarding mandate compliance can still access federal exemptions, he said in floor debate.

“The Health Care Right of Conscience Act was adopted in 1977 and was intended, I think fairly

clearly, to provide protection to doctors, nurses, pharmacists, other health care professionals who, based on their own conscience, did not want to participate in certain reproductive health care services or prescriptions,” he said.

“That law, broadly drafted, is being construed today and litigation is essentially a ’I choose not to follow these rules and as justification for that I will cite the Health Care Right of Conscience Act.’ I don’t believe that is at all consistent with the original intent,” he added.

He likened the effort to use the act not to be tested to trying to avoid detection for drunk driving.

“Let’s imagine that your constituent is pulled over under suspicion of drunken driving,” Harmon said in committee discussion with Sen. Jil Tracy, R-Quincy. “Could that constituent tell the officer they would refuse a breathalyzer test on the Health Care Right of Conscience Act? “My objection is not about vaccinations. I’m vaccinated. ... We go down this path, we don’t know where it ends.”

Harmon said in his closing speech that lawmakers are “trying to strike a balance” between liberty and public safety, “You’ve asked where we draw the line,” he said. “The line of my personal liberty ends at the beginning of your nose. …This law was never intended to preclude public health responses to a global pandemic.”

“We don’t force the daughter to call the mom and tell them. We don’t.

This isn’t what was described in committee as cruel,” she said. “We’re not being cruel. We’re allowing parents basic knowledge of a serious medical procedure that their daughter is contemplating and they don’t have to tell their parents. It’s the clinic that does it.”

That sentiment echoed testimony from Mary Hallan FioRito, an attorney with the Catholic Women’s Forum, in the House Executive Committee earlier in the day.

“No abortion clinic should be able to perform irreversible surgery on either of my daughters without telling me,” she said. “At a time when there is so much division in our state, in our country, the Parental Notice of Abortion Act is a popular and broadly supported and reasonable safeguard that allows parents to properly exercise responsibility for the care of their children.”

Rep. Anna Moeller, D-Elgin, said opponents of the bill had engaged in “very emotional and quite frankly, misleading and hyperbolic rhetoric,” and she called her relationship with her daughters, 18 and 16, “the most important relationship in my life.”

“It’s tough to be a parent of teenage daughters,” Moeller said. “But I have worked since the day they were born to develop a relationship with them, where they trust me, where they can come to me and talk to me about what is going on in their life. This bill is not about them. This bill is not about your children. This bill is about the children in our states who live in such

dangerous family situations.”

House floor debate also mirrored that of the Senate, where Republicans pointed out that minors need parental consent to go on a school field trip, get their ears pierced or take a Tylenol at school.

In Senate committee debate Oct. 26, GOP members questioned why a minor must have parental consent to receive a vaccine, but would no longer be subject to parental notification of abortion under the repeal.

Emily Werth, a staff attorney at ACLU of Illinois, responded that in Illinois, a minor who is pregnant no longer has to receive parental consent for any medical care. The pregnant minor could undergo a caesarean section, receive a vaccine or get any other medical care without parental notice or consent.

“And that is because the General Assembly has made the policy decision that when a young person is pregnant, it is in their best interests and all of our best interest that they have access to whatever medical care they need, without delay, without being put in harm’s way,” Werth said. “Abortion is one kind of medical care that they may need when they are pregnant.

And it should be treated the same as any other kind of medical care.”

The bill would create the Youth Health and Safety Advisory Working Group to “identify existing and needed resources for pregnant and parenting youth, and youth seeking reproductive health care.”

The working group would report to the General Assembly and governor

by July 1, 2023.

Motor vehicle crashes are a leading cause of death among children in the United States, and legislation like this has the potential to save lives.

The Booster Seat Safety Act would implement clear standards for booster seat labeling and safety testing. To address the misleading claims made by manufacturers and the risks associated with children under 40 pounds and 4 years of age using booster seats, the bill would mandate clear labeling of these safety recommendations. To address the lax testing currently in place by manufacturers, the legislation requires the National Highway Traffic Safety Administration (NHTSA) to issue standards for the side impact testing of booster seats.

The Booster Seat Safety Act finally allows the federal law to catch up with the safety recommendations of experts. As parents, we expect all booster seats to be safe, but sadly, that is not the case. Our children are our most prized possessions, and I want to help every parent protect their child.

In response, I wrote a letter to the U.S. Department of Agriculture (USDA) demanding answers to this oversight in regulatory enforcement.

This is just one instance of the failure of enforcement of the Animal Welfare Act—proven by the fact that U.S. enforcement action brought against licensed animal facilities fell by 90 percent between 2015 and 2020.

As the sponsor of the Animal Welfare Enforcement Improvement Act, I know that the USDA has tools available to improve their enforcement of this life-saving law.

I expect a response from the USDA explaining how breeders in violation of the Animal Welfare Act can maintain their licenses and what steps are in place to resolve these enforcement gaps. Every violation of the Animal Welfare Act means an animal in pain.
