State and IHSA release landscape-altering guidelines for youth sports

High school football moves to Feb. start date; tournament play scuttled starting Aug. 15

The Illinois Department of Public Health, the Illinois State Board of Education and the Illinois High School Association last week released revised COVID-19 reopening guidelines that will greatly alter the youth sports landscape into 2021.

After Governor JB Pritzker released revised youth sports safety guidelines in conjunction with IDPH/ ISBE slated to take effect Aug. 15, the IHSA released its revised 20202021 athletic calendar that contained numerous bombshells, including the shifting of high school football, girls volleyball and boys soccer to the 2021 spring season with those sports now officially starting practice in mid-February.

The IHSA noted its plan has been sent to the Illinois Department of Public Health for final approval.

“This plan, like nearly every aspect of our current lives, remains fluid,” IHSA Executive Director Craig Anderson said in a press release.

“Changes may come, and if they do, we will be agile while putting safety and students first. It was important that we provide a framework today for our student-athletes, coaches, administrators and officials to begin preparing for the 2020-2021 school year.”

Making the tough decisions The IHSA board proposed scheduling changes that include playing all sports over the course of truncated fall, winter, spring and summer seasons. As a result, several team sports will shift to a new season, including the aforementioned football, boys soccer and girls volleyball heading to the spring with practice beginning in February. Those sports are currently classified as either higher risk

(football) or medium risk (soccer and volleyball) under the IDPH/ISBE revised guidelines, which means football, as of now, could only train and conduct no-contact practices, while volleyball and soccer could only conduct intra-team scrimmages with parental consent for minors and no

competitive play allowed in current form.

Boys and girls golf, girls tennis and cross country, and girls swimming and diving, however, will remain as fall high school sports and can proceed to start on Aug. 10 as scheduled. Per Governor Pritzker’s

announcement (of the IDPH/ISBE revised guidelines), fall sports will begin with competition limited to conference opponents and other schools in the same general geographical area (for Addison-based schools that means only competitions against teams from DuPage and

Kane counties and any conference contests against opponents from outside DuPage and Kane).

The fall IHSA season will run Aug. 10 to Oct. 24. The winter season goes Nov. 16 to Feb. 13, while the spring

Signs of the times

For two alumni, Elmhurst University’s new Gates of Knowledge was labor of love

Nowhere is the new Elmhurst University name more symbolically significant than at the institution’s official entrance, the Gates of Knowledge at 190 Prospect Ave. Fittingly, two generations of Elmhurst graduates played key roles in revitalizing the arch, which will welcome students to campus for years to come.

Edward Bartholomew, MBA ’10, runs the Sign Artist company in Bensenville, where daughter Erin is a designer. Working on the arch was an amazingly creative experience, said Erin Bartholomew ’18, who earned a bachelor’s degree in fine arts from Elmhurst.

“It’s such an iconic part of the University and an important part of my family’s history,” she said. “[The project] was the perfect match for us.”

To rejuvenate the wrought-iron Victorian-style arch, with its colorful Elmhurst shield cartouche at the pinnacle, the arch was carefully dismantled, sandblasted clean and restored. As designer, Erin Bartholomew was responsible for ensuring that the new arch adhered to official University signage stan-

dards. She assisted in the sizing and coloring of the cast-metal letters, the layout of the words on the arch and the physical placement of the letters.

Edward Bartholomew, whose family has lived in Elmhurst for 18 years, called it an honor to remake the arch to reflect the Elmhurst University name.

“The Gates of Knowledge signify both the history and commitment to excellence that characterizes the University,” he said.

Michael Emerson, executive director of facilities management, worked closely with the Bartholomews on not only the Gates of Knowledge but also the 100 other signs across campus that required the new name.

“Erin and Ed understood the significance of this effort,” Emerson said. “They made it their top priority to not just change the lettering on the arch, but to holistically redesign it as an enduring icon that will symbolize Elmhurst University moving forward.”

District 88 announces plans for the 2020-21 school year Helton: ‘Safety, health, well-being of students, staff is top priority’

In his regular column in the School District 88 weekly newsletter, Superintendent Scott Helton offered the following updates regarding the upcoming 2020-21 school year: “As we continue to face the challenges of the coronavirus disease 2019 (COVID-19) pandemic, I would like to thank our stakeholders for your adaptability and support as we come together to overcome the adversity of this unprecedented situation.

“As we plan for the 2020-21 school year, the safety, health and well-being of students and staff is our No. 1 priority, and we will continue to follow federal, state and local guidance to ensure the safest environment possible at our buildings. We will cooperate with Centers for Disease Control, Illinois Gov. JB Pritzker, the Illinois and DuPage County health departments, the Illinois State Board of Education and the DuPage Regional Office of Education regarding social distancing, health and cleaning protocols.”

During a Special Board of Education meeting on July 27, the Board approved a resolution authorizing the administrative team to open and operate the district’s schools and programs for the 2020-21 school year, as outlined in the Return to School Plan. The resolution was approved through Oct. 5, at which time the Board and administration will reevaluate the status of the COVID-19 pandemic and the Return to School Plan, Helton said.

Upcoming parent meetings • On Aug. 6, we will host a meeting for parents/guardians in Spanish to discuss the 2020-21 school year.

2020-21 school year with Remote Learning through Oct. 5, at which time the Board and administration will reevaluate the status of the COVID-19 pandemic and the Return to School Plan. During this stage, all instruction and resource support will be remote (with exceptions for special student populations).

• Students will follow a block schedule on Monday, Tuesday, Thursday and Friday. The schedule will consist of 80-minute periods and a resource.

• On Wednesdays, students will follow a traditional schedule with eight periods (see below). Each period will be 35 minutes. This will allow for deep cleaning/sanitation of the facilities and for weekly breakfast and lunch distribution for District 88 students and families.

Amendments to the 2020-21 school calendar During the Special Board of Education meeting on July 27, the Board approved the recommended changes below to the 2020-21 school calendar.

• Add three Remote Learning Planning Days on Aug. 18, 19 and 20 to provide support for staff as they prepare to engage students in robust synchronous learning in a virtual environment.

• Move the first day of school for students to Aug. 24 (instead of Aug. 19).

• Move Open House to Sept. 2 (instead of Sept. 3) to minimize disruption to academic learning. Open House will be virtual this year.

• Move Parent-Teacher Conferences to Oct. 7 (instead of Oct. 8) to minimize disruption to academic learning.

Registration and residency verification • Registration for the 2020-21 school year is open. District 88 is providing a full online registration process for its families.

• District 88 will continue to implement residency verification to be sure to maximize our resources for families, who reside within District 88 boundaries. Residency verification must be completed for all incoming freshmen, new students and transfer students before registering for the 2020-21 school year. To see the residency verification

canoeing, kayaking, sideline spirit, skateboarding, softball, swimming and diving, tennis, track and field and weight lifting. Many of the lower risk sports have additional safety measures attached to them.

Higher risk sports, based on the new guidelines, can play at Level 1 currently, which means no-contact practices and trainings only. Medium-risk sports can play at levels 1 and 2. Level 2 involves intra-team scrimmages with parental consent for minors and no competitive play.

Low-risk sports can play at levels 1, 2 and 3. At Level 3, intra-conference or intra-EMS (COVID-19) region or intra-league play/meets only are allowed. State or league championship games/meets are allowed for low-risk sports only.

At Level 4, which no Illinois sports are classified at as of now, tournaments, out-of-conference play and out-of-state play are allowed, and championship games are allowed.

As an example of the low-risk sports and their attached mitigations, baseball and softball can play at a low-risk level if players are at least six feet apart in the dugout areas or players are seated six feet apart in the bleachers behind the dugout, otherwise those sports are considered medium risk and would be demoted to playing only intra-team scrimmages with parental consent.

More about travel sports, leagues, tournament play In terms of how these new state guidelines affect youth sports such as club/travel sports, the IDPH/ISBE guidance pertains to all youth and adult recreational sports, including, but not limited to, school-based sports (IHSA and Illinois Elementary School Association), travel clubs, private leagues and clubs, recreational leagues and centers, and park district sports programs. The guidelines do not pertain to professional sports leagues or college division-level sports, and also do not apply to adult sport activities subject to existing DCECO guidance, specifically golf and tennis.

Of particular note is the Level 3 allowance of playing intra-conference or intra-EMS region or intra-league play/meets only. EMS refers to the 11 regions the IDPH uses for the Restore Illinois boundaries.

As noted above, Addison falls into the EMS region of DuPage and Kane counties, meaning youth travel teams, starting Aug. 15, can only play teams from these two counties. Tournament play also is not allowed as of Aug. 15 at Level 3. Tournament play can resume at Level 4 status. As an example, one local travel organization saw a tournament scheduled to run through the Aug. 15 weekend suddenly compressed into a two-day event Aug. 13-14 in order to finish prior to the Aug. 15 new-rules implementation date.

Athletics On July 29, the Illinois High School Association (IHSA) released a modified schedule for the 2020-21 school year. See story on pg. 1 of this issue of the Addison Independent.

Mazzochi files resolution insisting Madigan resign ‘Illinois has suffered with corruption for decades’

On Friday, July 17, the U.S. Attorney’s office outlined a bribery scheme between Commonwealth Edison and “Public Official A”, understood to be the Speaker of the Illinois House Michael Madigan, that Mazzochi called “breathtaking in its audacity to corrupt a publiclytraded company.”

According to the Statement of Facts submitted to the Court, ComEd admits to a variety of schemes to bolster Madigan’s patronage network.

One involved putting one of Madigan’s “important” top “precinct captains,” a Madigan political ally, and several others on a ComEd lobbyist’s payroll despite them

not doing any work for ComEd. Another involved using false invoices that were “intended for ultimate payment to Public Official A’s associates, who in fact did little to no work for ComEd.” ComEd admitted that “indirect payments made to Public Official A’s associates—who performed little or no work for ComEd—totaled approximately $1,324,500.” ComEd also structured “these payment arrangements in part to conceal the size of payments made to Public Official A’s associates.”

Another series of schemes the court filings outline involved ComEd hiring. ComEd set up an internship program for students from Madigan’s ward “with the intent to influence and reward” Madigan. ComEd let Madigan name individuals to be ComEd employees, such as meter readers, as part of an “old-fashioned patronage system,” to have a “chip” ComEd could use with Madigan. ComEd admitted that “Individual A,” organizing these schemes on Madigan’s behalf (believed to be long-time Madigan ally Mike McClain), warned, “don’t put anything in writing,” and that ComEd executives should not tamper with the arrangement because “your money comes from Springfield.”

The filing also highlights that Madigan sought to have a ComEd board member appointed, with McClain telling ComEd’s CEO, “You take good care of me and so does our friend [Madigan] and I will do the best that I can to, to take care of you.”

ComEd also admitted it retained a law firm because McClain told the CEO, “I am sure you know how valuable [the lawyer] is to our ‘Friend,’” threatening, “I know the drill and so do you,” and emphasizing that if the law firm hiring on stated terms did not occur, “our friend [Madigan] will call me, and then I will call you. Is this a drill we need to go through?”

Mazzochi described the findings as “machine politics at its worst.”

“And this is just one company engaged in indiscretions and outright illegal actions due to the Speaker and those working on his behalf,” she said. “We know that subpoenas have also gone out to AT&T, Walgreens, and Rush University Hospital. How many more both in and out of government have been forced into pay-to-play politics with this man?”

While some House Democrats have asked the Speaker to step down from this leadership role, Mazzochi insisted that “Madigan needs to be out of the Illinois House entirely.”

“We don’t need him putting a figurehead in the Speaker’s role while he stays to pull the puppet strings,” Mazzochi said. “He remains arrogantly defiant; and refuses to accept responsibility for the corruption culture he has created.”

Mazzochi also pointed out the

power Madigan has over legislators through the political committees he chairs and controls—including the Democratic Party of Illinois; Friends of Michael J. Madigan; 13th Ward Organization, and the Democratic House Majority.

“As long as he holds the Democrat party coffers on the legislative side and controls

legislators with campaign dollars, Illinois will continue to suffer,” Mazzochi said. “I call on Gov. Pritzker to call legislators back into session. I have sponsored House Resolution 885 to call for a no confidence vote in Speaker Madigan to remove him from his position of power in the Illinois House of Representatives.”

Mazzochi continued: “We need a government that works honestly and is responsive to the people we represent. The Governor is running a one-man show that is rendering our state dysfunctional, while the Speaker treats the people’s House as his own personal playground.

Madigan must resign for the good of Illinois.”

Lawsuit seeking compensation for store closures should be tossed, state says

Business owners say COVID-19 shutdowns were ‘seizure of private property’

Illinois’ attorney general asked a federal judge July 27 to dismiss a lawsuit alleging Gov. JB Pritzker’s executive orders closing non-essential businesses and workplaces are unconstitutional.

A group of Chicagoland business owners argued the governor’s COVID-19 restrictions amount to the confiscation of private property without monetary compensation. Such an action would violate the U.S. and Illinois constitutions, they say.

Those orders “caused the seizure of private property, business interests and livelihoods of individuals across the state, forcing indefinite closures and the layoff of hundreds of thousands of people,” according to the group’s complaint, an amended version of which was filed in June.

Their lawsuit asks a U.S. district court judge to compel the state to pay all “similarly situated persons, companies and entities ... just compensation.”

But the state in a response filed on July 27 contends that would be “en-

tirely unreasonable” because the relevant executive orders have expired, allowing all businesses in Illinois to reopen. In its response to the lawsuit, it points out all the businesses listed in the lawsuit have resumed operations.

And any request that might affect future restrictions is “speculative,” the state says in the document.

Also, the attorney general’s office said, because a federal court is constitutionally barred from forcing a state to pay damages as the businesses are asking, the suit should be dismissed.

Alan Bruggeman, a Mokena-based attorney representing the group, wrote in a court filing that by classifying some businesses as essential and others as non-essential, Pritzker’s executive orders were “applied in a completely arbitrary and capricious manner.”

The governor’s actions, he added, “simply picked winners and losers without regard to” Illinoisans’ right to petition the government to reconsider its COVID-19-related rules.

“Never in the history of this nation and certainly in the history of the State of Illinois has a state government issued such sweeping executive orders that so extensively and so completely usurped the private property rights of individual business owners for a public person,” the business owners argued in a court docu-

In its response, the attorney general’s office argued mitigating the novel coronavirus’ spread for the benefit of state residents does not violate either the U.S. or Illinois constitution.

Pritzker, they wrote, used his “police powers,” not eminent domain, which would have required monetary compensation.

They added that all owners of private property in the U.S. are under an

“implied obligation” to not use it in a way that would harm their community. “Necessary restrictions” on Illinois businesses during the pandemic were designed to “protect the health and lives” of all residents.

“The state is sensitive to the economic impact that COVID-19 has had on its residents and has continually adapted its response to COVID-19 to allow for more businesses to open with proper regulations in place,” the attorney general’s office wrote. “However, the temporary closure of certain businesses is not unduly oppressive, as required to negate the police power.”

If a judge were to agree with the business owners, the state argued, “even orders temporarily closing businesses violating health codes, fire-damaged buildings, or crime

scenes would require compensation.” Companies do not have a fundamental right to conduct business without regulation.

They should, Bruggeman wrote, have a right to advocate for themselves in court.

Business owners named in the lawsuit include Samantha Palya, owner of Palos Hills-based Absolutely Pawfect Pet Styling Inc.; Amanda Hamerman, owner of Color Envy Inc. in Bolingbrook; James Van Dam, owner of Mokena-based Van Dam Auto and Truck Repair; Jeff Carpenter, owner of Caveo Learning in Schaumburg; and John Brown, owner of Chipper’s Grill in Streator.

The group has until Aug. 31 to respond to the state’s request that the lawsuit be dismissed.

The downstate attorney challenging aspects of Illinois Gov. JB Pritzker’s COVID-19 response said July 29 he would halt the progress of his “dozen or so” lawsuits if legislators return to Springfield.

At the heart of Thomas DeVore’s many cases in several Illinois counties is the question of whether an Illinois governor is constitutionally and legally authorized to exercise unilateral control over the management of a disaster, such as the public health emergency posed by the novel coronavirus.

He also represents “hundreds” of citizens and business owners as well, he said DeVore said in a phone interview July 29 that while lawmakers are barred by the U.S. constitution from delegating their powers to another branch of government indefinitely, the legislative body’s lack of action suggests an intention to flout those requirements.

As the head of the executive branch, Pritzker “should not have to” consult with Illinoisans about how best to prevent the spread of COVID-19—that is the Legislature’s job, he added.

In an open letter DeVore sent to the General Assembly’s four legislative leaders July 29, the attorney wrote he is “imploring” lawmakers to determine rules for schools and businesses so both can safely resume operations without harming public health.

“The legislature is the voice of the people, and I am afraid of what is to come in the weeks ahead without your involvement in crafting wise solutions,” DeVore wrote.

A spokesperson for Senate President Don Harmon (D-Oak Park) wrote in an email that “the Senate has no plans at this time to reconvene before the scheduled veto session in November.”

“Far too much ink has been spilled over the last several months in courtrooms across this state” through lawsuits such as his own, DeVore wrote in the letter.

“None of this litigation has served the best interests of the good people of our state, as litigation is never the answer to matters such as these, and should only be a solution when no other viable options exist,” he added.

Xenia Republican Rep. Darren Bailey—whose Clay County lawsuit alleging Pritzker overstepped his authority in managing the novel coronavirus pandemic is perhaps the best known of DeVore’s cases—said “none of these lawsuits may have existed” if lawmakers convened in Springfield to “confirm the details of how things should work.”

He added the Legislature’s lack of action since May, ongoing federal investigations into Illinois officials and decreased state revenues as a result of the virus are “a wakeup call to the citizens of this state.”

His attorney in that case, DeVore,

wrote in his letter that “an ever-increasing number” of residents “are growing weary” of actions taken solely by the executive branch to close businesses, implement social gathering restrictions and change school rules.

“This has nothing to do with the efficacy of these executive and administrative actions but everything to do with the lack of checks and balances which the legislative branch of government is intended to provide,” he wrote.

Rep. John Cabello, a Republican from Machesney Park and another of DeVore’s clients who filed a similar lawsuit against Pritzker, said he thinks members of the General Assembly should tackle corruption, unemployment and the budget shortfall. But, he said, he does not “believe whatsoever” a session will be scheduled before the fall veto session.

He dropped his case challenging the governor’s use of emergency powers on July 22. “(Michael Madigan) obviously controls the agenda, so we’ll have to wait and see what comes about, but I’m not holding my breath that we do anything really good,” Cabello said of the Speaker recently embroiled in a federal corruption investigation. “Any time legislators are in Springfield, something bad happens to the taxpayers of this state.”

Health Department partners with Olympian to prevent drownings According to media reports, five Illinois children, ages 1 to 12, fatally drowned between June 1 and July 17, 2020 in pools or open water. Three of the children were age 5 and younger. In comparison, a total of 11 pool or open water drownings occurred among children 12 years and younger in all of 2019, (Illinois Department of Child and Family Services, 2020).

In May, the Consumer Product Safety Commission (CPSC) reported 18 children each day are treated in hospital emergency departments across the nation for non-fatal drowning submersion injuries.

To encourage adult caregivers to reverse these trends and remain vigilant about water safety, the DuPage County Health Department (DCHD) has partnered with two-time Olympic Swimmer Cammile Adams to inspire children and adults to practice simple water safety steps.

Top executives of utility giant Commonwealth Edison faced tough questions from state regulators July 29 as they publicly apologized for the lobbying scandal that is forcing the company to pay a $200 million criminal fine.

“That’s the first words I wanted you to hear out of my mouth,” ComEd CEO Joseph Dominguez told members of the Illinois Commerce Commission. “But the last words I want to leave you with is that I’ve observed the character of this company. I know what our job is and leading it and I know the reforms that we have to put in place.”

On July 17, ComEd entered what’s called a deferred prosecution agreement with the U.S. Attorney’s office in Chicago and admitted to handing out lobbying jobs and subcontracts to close associates of Illinois House Speaker Michael Madigan—including some who reportedly did little or no work—in an effort to gain Madigan’s support for legislation benefitting the company.

Madigan, who also serves as chairman of the Illinois Democratic Party, so far has not been charged with any crime and he has denied any wrongdoing.

ComEd is the state’s largest electric utility and serves roughly four million customers in northern Illinois.

As part of the deal to defer prosecution of

bribery charges against the company, ComEd and its parent company Exelon agreed to pay the fine, to cooperate with a continuing federal investigation, to adopt internal policies and controls regarding their dealings with public officials to prevent similar crimes from occurring again and to file reports with the U.S. Attorney’s office at least once every 12 months detailing how it is complying with the terms of the agreement.

“They create, among other things, a detailed tracking system to capture information about our interactions with public officials,” said David Glocker, Exelon’s executive vice president for compliance and audit. “Going forward, beginning when these policies went into effect on July 6, any request, recommendation or referral from a public official has to be reported, has to be tracked, and it can only be acted on with the concurrence of a series of people within the organization, including, importantly, the compliance function.”

The Illinois Commerce Commission is a five-member body whose members are appointed by the governor to five-year terms. Its main function is to set rates and charges for services provided by public utilities.

But with regard to electric utility rates, that function was greatly curtailed in 2011 with the passage of a bill that has been a focus of the federal investigation, the Energy Infrastructure Modernization Act.

COVID-19 has changed so many things for so any of us. I haven’t been able to see my dad (in a nursing home) for four months.

My daughter is quarantining for two weeks before the birth of her baby so we can’t see her family.

My son lost his job.

We are in a state of uncertains and unknowns about our youngest son starting college in less than a month.

These are unprecedented times – for all of us. We all have similar stories to tell, many more serious and hardship-laden than mine.

But let’s get to the most serious of subjects hitting us all in the face right now: masks. I never would have predicted I’d spend so much time contemplating masks and their comfort, efficacy and ability to make a fashion statement, but these are the days we are living.

Like just about everything in 2020, masks have proven to be polarizing.

No matter what side of this particular polar vortex you reside on, you know, without a doubt, that the other side is 100 percent wrong. Am I right?

But I’m not going to get into that. I try to avoid angry topics whenever I can. After four months of shut down and quarantine, I don’t have it in me to argue about masks. (At least not two months before Halloween.)

And, whether you are pro or anti-mask there is one thing we can all agree. They are mandated in many, most and nearly all public places – depending on where you live.

I am a do-it-yourselfer so I initially addressed the mask issue with my sewing machine. My daughter was required to wear one during doctor’s visits. Essential workers needed them on the job.

We weren’t yet at the requiredmask stage, still I was sewing.

My first masks were, in a word, failures.

I made them too small, or too big. I finally got the pattern right and made enough for my family.

At this point I found myself completely out of elastic. And with the current and well-documented elastic shortage of 2020 I was stymied.

I paused in my mask-making adventures – for the moment.

Also (full-disclosure here) I attempt to be prepared for anything – pandemics included.

So I already had a small stash of the home-improvement masks available previously at the dollar store. (I’m guessing they’ve been sold out since April.)

Fast-forward a couple of months. Masks started out on our outer radar but they are currently front and center. We are required to wear masks; therefore we are required to acquire masks. And as alluded to earlier, I like to be prepared.

box stores, my husband and I purchased a few bandanas – just in case of a pinch. Why have just one mask when you can have a dozen?

Besides, isn’t it important that a mask match or at least coordinate with your clothing?

Since I wasn’t totally satisfied with my first sewn masks, I went back to the drawing board.

We took a trip to the dollar store, and I kept my mask options open.

I found a long scarf and thought maybe I could fashion some sort of a mask from that. I also bought socks; I’d seen a couple of online tutorials showing how to make masks from socks – no sewing required.

Still, I had my no-elastic dilemma.

Then I hit on the obvious: rubber

bands and ponytail holders. They are stretchy and elastic, similar to the real thing.

I restarted my mask tasking. I can make three nice ones from a scarf at the dollar store with only one straight and easy seam on the sewing machine. (It could also be hand-sewn.) I’m not as sold on the sock masks. They don’t require sewing, but they will fray in the wash. Rubber bands and ponytail holders work just as good as elastic – a happy discovery in these unhappy times.

Six months ago I never would

have predicted I’d be mandated to wear a mask to the grocery store. I never thought I’d be color-coordinating masks with my outfits, but we are living in a new reality. And no matter what side of the mask debate you reside on, we can all agree on one thing: we might as well look good wearing them.

Conroy supports vote-by-mail program In response to the unique public health situation we continue to face as a result of the novel coronavirus, legislation sponsored by state Rep. Deb Conroy, D-Villa Park, to promote the state’s vote-by-mail program and enact other measures to protect voter safety and health was signed into law last week.

“The public health crisis we are experiencing has forced most of us to confront daily challenges head on and required us to learn and become more adaptable in our everyday lives,” Conroy said. “As elected officials, we have been faced with tough decisions in trying to balance public health while simultaneously maintaining the fundamental operations and functions of state government. This bill recognizes the challenges we continue to endure, allowing state government to continue conducting vital business while taking measures to protect public health.”

Senate Bill 1863 was negotiated by the leadership of the Illinois House Democratic Women’s Cau-

cus, of which Conroy serves as the chair. Among other measures, the legislation requires the automatic mailing of vote by mail applications to recent active voters, expands early voting hours to allow for greater social distancing, and allows election authorities to implement curbside voting to reduce person-to-person contact for vulnerable populations.

“It is clear that the unprecedented situation we are navigating related to the pandemic warranted a commonsense update to our election law for the upcoming election by making a vote by mail option more accessible to all Illinoisans and enhancing safety measures to promote social distancing,” said Conroy. “This change will help mitigate any future resurgence of COVID-19 cases which could arise down the road and is exclusive only to the 2020 General Election.”

Vote by Mail applications being sent to all voters The DuPage County Clerk’s office is sending Vote by Mail applications to all voters for the Nov. 3 general election, in compliance with recent emergency legislation to provide a safe choice of voting during COVID-19.

Voters selecting Vote by Mail are requested to securely apply online or to complete the mailed application with their signature and phone number, then drop it the mail as soon as possible. No postage required.

The clerk’s office is using funds made available this year through the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) for the mailing of applications and ballots.

To date, 26,000 voters have already applied for Vote by Mail ballots in DuPage County for the Nov. 3 election; roughly 55,000 total voters chose Vote by Mail for the 2018 general election. Voters who applied prior to July 4 will not be receiving an additional mailed application.

Ballots will not begin to be mailed out until Sept. 24. It may take four to five business days to receive a ballot after that date.

Voters will continue to have the option of casting ballots during Early Voting or at Election Day polling places.

Due to COVID-19, all 2020 general election voters are encouraged to cast a ballot prior to Election Day, either by mail or during early voting. Voting by mail is an easy option for voters and you can request a vote by mail ballot through email, mail, or in person. An application is available from your local election authority or at https://elections. il.gov/electionoperations/VotingByMail.aspx. To register to vote or check your registration status, visit https://ova.elections.il.gov.

Cullerton urges child care providers to apply for restoration grants To support the reopening of local child care providers after months of financial distress, state Sen. Tom Cullerton (D-Villa Park) is urging providers to apply for Child Care Restoration Grants.

“I know residents like to send their children to facilities that are clean and adhering to safety guidelines during this pandemic,” Cullerton said.

“As workers head back to work they should have the assurance that their children are safe and happy. This grant will allow child care services to reopen while giving them the support to keep children safe.”

The Illinois Department of Human Services is distributing $270 million in available funding to assist child care providers across the state with reopening in the wake of the COVID-19 pandemic.

Licensed child care providers that meet the eligibility criteria may apply for Child Care Restoration Grants.

“Child care facilities serve as an essential support to help parents and caregivers enter and stay in the workforce,” Cullerton said. “It is our duty to ensure

local child care providers will be able to weather the economic hardship of this pandemic so residents can safely go back to work as the state’s economy gets back on track.”

To be eligible for the grant, child care providers must: • Have a current license from the Department of Children and Family Services to care for children.

• Be open and caring for children at the time of application.

Bond set for man accused of criminal sexual assault, illegal videotaping of women On Wednesday, July 29, DuPage County State’s Attorney Robert Berlin and Wheaton Chief of Police Bill Murphy announced that Felony Criminal Sexual Assault and Unauthorized Videotaping charges had been filed against a Wheaton man accused of secretly videotaping the sexual assault of female acquaintances on at least two different occasions.

Matthew Tumbarello, 19, of Wheaton, appeared in Bond Court where Judge Brian Telander set bond at $20,000 with 10% to apply in accordance with a previously issued arrest warrant. In all, Tumbarello has been charged with two counts of Criminal Sexual Assault (Class 1 Felony), two counts of Unauthorized Videotaping (Class 4 Felony), one count of Eavesdropping (Class 4 Felony) and one count of Misdemeanor Unauthorized Videotaping.

barello’s alleged victims, who was in a dating relationship with the defendant, reported to the Wheaton Police Department that she was the victim of an alleged sexual assault and videotaping. Wheaton police immediately began an investigation into the allegations. It is alleged that on several occasions Tumbarello used his cellular telephone to secretly record consensual sex between the two. It is alleged the victim did not know or consent to the recordings.

It is further alleged that the defendant secretly recorded himself having sex with the woman while she was intoxicated and unable to consent. It is further alleged that the investigation also uncovered several videos of Tumbarello having sex with two other women at separate times in which those women were also unable to consent.

On July 23, 2020, Judge Robert Miller issued a $20,000 with 10% to apply arrest warrant for Tum-

barello. On July 28, 2020, Tumbarello was taken into custody following a traffic stop in Chicago. An investigation into the matter continues and anyone with information regarding this defendant is asked to call Lieutenant Cooley with the Wheaton Police Department at (630) 260-2077.

“The allegations that Mr. Tumbarello took advantage of several women who were unable to consent and secretly videotaped the sexual assaults are beyond disturbing and will be met with the full force of the law,” Berlin said. “An individual’s right to privacy does not end simply because they are in a relationship with another person.”

Tumbarello’s next court appearance is scheduled for August 25, 2020, for arraignment in front of Judge Alex McGimpsey.

Members of the public are reminded that this complaint contains only charges and is not proof of the defendant’s guilt.

State senators take steps to assure safety on mass transit Acting in his capacity as chair of the Senate Transportation Committee, state Sen. Ram Villivalam (D-Chicago) sent a letter to all mass transit agencies in Illinois to inquire about the steps being taken to protect both their passengers and employees.

“Public transit is essential to people’s lives and livelihoods,” Villivalam said. “Its continued availability is crucial to reviving our state’s economy, but without proper safety precautions, our buses and trains could also help spread COVID-19.”

Villivalam, along with several of his colleagues, have asked the state’s transit agencies to explain their COVID-19 safety precautions.

Agencies have been asked to detail their requirements and procedures for testing, tracing, temperature checks, sanitation, and employee pay. The agencies are also expected to provide more information to consumers about safety procedures like mask requirements and capacity limits.

Villivalam said he was especially concerned about working class families, which rely on buses and trains for all of their travel needs, including going to work and school.

Number of House Democrats calling for Madigan’s resignation grows

Cracks are beginning to show in Michael Madigan’s hold over the House Democratic caucus that he has led as Speaker for all but two years since 1983.

Three more members of that caucus called for Madigan to resign last week, at least as House Speaker and chair of the state’s Democratic Party. They join another Democratic representative and three senators—all women—and a number of high-profile Republicans in calling for Madigan’s resignation from at least one of his leadership positions.

Later in the evening on July 30, a spokesperson for Madigan released a statement on his behalf after he reportedly spent much of the day calling Democratic caucus members.

“I understand that the last couple of weeks have been difficult for our caucus and party, and I have had many candid conversations with members of

The latest calls for the Speaker’s resignation come nearly two weeks after he was implicated in a bribery scheme relating to utility giant Commonwealth Edison. In a court document, ComEd admitted to handing out benefits such as lobbying jobs and subcontracts to close associates of the Illinois House Speaker in an effort to gain support for legislation benefitting the company.

Madigan has not been charged with any crime and has denied wrongdoing.

Rep. Anne Stava-Murray, a Naperville Democrat, was the only member of the House Democratic caucus who had called for his resignation before last week. She was also the only Democrat who did not vote for Madigan as speaker at the beginning of this session of the General Assembly.

Last week, Reps. Terra Costa Howard, (D-Glen Ellyn, 48th District), and Stephanie Kifowit, (D-Oswego), added their names to the growing list seeking Madigan’s resignation. Others have called for the Speaker to resign if the allegations in the ComEd court document are true.

Howard, in a statement July 29, called for Madigan’s resignation as Speaker and party chair.

“The sworn statements in the U.S. Attorney’s agreement with Commonwealth Edison detail a years-long scheme of payoffs and bribery involving many of Speaker Madigan’s closest allies. Even if he was not directly

involved in this scheme, these accusations clearly demonstrate that the Speaker’s leadership has failed,” she said in the statement. “Speaker Madigan has a duty to recognize that these allegations have cast a deep shadow on the reputation of our House. He must take action now to avoid inflicting further damage on the members of the House and the Democratic Party.”

While she said Madigan has not been charged and is entitled to “the presumption of innocence and due process,” his ties to the investigation “make it impossible for Rep. Madigan to continue in his leadership roles.”

“I hope he will do the honorable thing and step down,” she said.

On July 30, Kifowit tweeted that she “electronically delivered” a letter to the speaker requesting he step down.

“I write this letter as a legislator who voted for you for Speaker in the past,” Kifowit wrote. “The reality is that each time, the vote I made for you was care-

fully considered. I voted with the view that you would respect and honor the leadership position of the Speaker of the House.”

But, in light of the ComEd document, Kifowit said it was clear that Madigan—or at least those he empowered in his inner circle—“did not hold the respect and dignity of the institution of the Illinois State House and the General Assembly as a whole.”

“The actions described in the U.S. Attorney’s deferred prosecution agreement by ComEd show that you have compromised the integrity of the office of Speaker of the House and undermined the public trust,” she said. “… Therefore, I demand you to do the right thing and step down immediately as Speaker of the House. In the event that you do not, and if you choose to seek nomination to this position again, I will vote against said nomination and will not vote for you should your nomination be successful.”

The Villa Park Parks and Recreation Department held last week’s summer volleyball camp for students entering grades 6-8.

Camp directors Jack Weaver and Grace Reckamp, who will soon start their senior year at Willowbrook High School, directed the camp at the Iowa Community Center. Weaver is a member of the school’s boys volleyball team, while Reckamp plays for the Warriors’ girls volleyball team. The participants in last week’s four-day camp, which featured indoor and outdoor play, included Elisabeth Vandenberg (left), Noah Edison (right) and Christina Duszak (bottom right).
