County Board approves three referendum questions for November ballot The DuPage County Board voted Tuesday to put three referendum questions on the November 2020 General Election ballot.

Two questions seek the voters’ opinion on law enforcement issues: The first asks about funding for law enforcement while the second asks about law enforcement training methods. The third

question asks voters about whether the County should stockpile personal protective equipment to protect against a further outbreak of COVID-19.

“Residents have expressed a great deal of interest in these topics in recent months. Voters will share their opinions about public safety, weighing in on questions of public safety and

Pritzker announced the new enforcement measure Aug. 7 as 13 counties were put on warning that they may have to reimpose some social and economic restrictions to control the spread of the novel coronavirus.

The order requires businesses, schools and day care facilities to make “reasonable efforts” to ensure that patrons and employees wear face coverings when they cannot maintain a six-foot distance from others.

Reasonable efforts can include such things as posting signage that state face coverings are required, giving verbal warnings to customers to wear face coverings, offering a mask to patrons and asking customers to leave if they refuse.

Under the new rules, businesses found to be out of compliance will first be given a written warning. A second offense can result in having some or all of their patrons leave the premises as needed to comply with health guidelines. If businesses refuse to comply after that, they can re-

ceive a class A misdemeanor notice and be subject to a fine ranging from $75 to $2,500.

“I have always put the health and safety of Illinoisans first, and I’m gratified that local governments now have an additional way to keep their communities safe,” Pritzker said in a statement after the JCAR vote Aug. 11.

But the outcome of that vote was not a foregone conclusion. The Illinois Department of Public Health issued similar emergency rules in May, but withdrew them after lawmakers returned for their special session.

Pritzker said at the time he expected lawmakers to address the enforcement issue legislatively, although it also appeared evident that there were not enough votes on JCAR to sustain the rules and it never came up for a vote before the full General Assembly.

County Coroner warns of two new street drugs The Independent brings you the following Public Service Announcement: Dr. Richard Jorgensen, DuPage County Coroner, wishes to inform the public of the occurrence of two new street drugs in the area. These drugs are Flualprazolam® and Isotonitazene®. The DuPage Coroner’s Office has investigated 11 deaths involving Flualprazolam and four involving Isotonitazene. These are new and dangerous drugs, Jorgensen said.

Information about these drugs are: Flualprazolam is a benzodiazepine derivative and has sedative and anxiolytic effects. It was first synthesized in 1976 but not presented to the FDA for approval and was never marketed. It has subsequently been sold as a designer drug.

Isotonitazene has no current approved clinical use and has a high rate of addiction. The drug is an offwhite or white powder and is often pressed into counterfeit opioid pills that may have a M or an 8 stamped one side and to look like Oxycodone or 8mg Dilaudid (hydromorphone) tablet. The symptoms of use are similar to opioids in general. Isotonitazene is considered one of the most persistent and prevalent new opioids.

Narcan can be used, but multiple doses may need to be administered.

The potency of isotonitazene may require more than a usual dose of naloxone to reverse the opioid overdose.

But Sen. Bill Cunningham, D-Chicago, a cochair of JCAR, said the graduated nature of the enforcement rules means businesses that are genuinely trying to comply should have nothing to fear.

“And I think it’s really important to understand what that points to is this rule is going to be enforced against rogue operators,” Cunningham said. “This is not something that is going to be easily applied even by the most zealous law enforcement agency or public health department against someone—a business that slips up once or twice. There’s just not an ability to do that based on the framework of this rule.”

Speaking to reporters after the meeting, Rob Karr, president and CEO of the Illinois Retail Merchants Association, said the rule is unlikely to have much impact on the rising spread of COVID-19 in Illinois.

“I would also remind everyone that most of the governor’s comments, most of (IDPH Director) Dr. (Ngozi) Ezike’s comments, most of the comments of other local officials have not been about rogue bars and restaurants that are tied to outbreaks,” Karr said. “They’ve been public gatherings where individuals are not wearing masks.”

Under JCAR’s rules, it takes a two-thirds majority, or eight votes on the 12-member panel, to block an emergency rule from taking effect.

The panel is evenly split between Republicans and Democrats and between House and Senate members.

Rep. Steven Reick, R-Woodstock, offered a motion to block the rule, but it received only six votes—all from Republicans.

“Our neighborhoods welcome technological advances,” Mazzochi said. “But those same neighborhoods also need the right to decide at the local level whether certain aesthetic or safety costs are worth it.”

Several neighborhoods in Mazzochi’s district have served as pilot communities for various categories of 5G wireless small cell units, and the early rollout results were not considered good. After hundreds of residents of Western Springs and Hinsdale called for expanded local control over 5G sites, Mazzochi filed House Bill 5818, the “Protect Me from 5G Act.” Mazzochi hopes the bill will be considered in the General Assembly’s Fall Veto session in November.

When the original Small Cell Wireless bill was debated in 2018, communities and legislators were told most new 5G installations would be on existing poles. Since then, local villages have been inundated with permit applications for new towers in front of houses, in parkways, on neighborhood street corners and at playgrounds.

Having took office after the Small Cell Wireless bill was passed, Mazzochi reiterated that “our local municipalities and residents were not informed of the real-world implementation plans under the prior legislation.”

With wireless companies converging on neighborhoods to build new installations over the objections of homeowners, Mazzochi explained that, “the time to reexamine this legislation is now.”

“We must give more authorities to communities and homeowners at the local level with the ‘Protect Me From 5G Act,’” she said.

The “Protect Me from 5G Act” contains the following key elements: Radio frequency monitoring Requiring a monitoring plan and tracking and recording daily levels of radio frequency emissions produced by 5G equipment.

Noise monitoring Requiring a written report that analyzes acoustic noise levels for small wireless facilities and all associated equipment.

Derecho storm brings 13 tornadoes to northern Illinois NWS says tornado tore through Lombard, Villa Park; trees, homes, roofs damaged

Following the derecho storm that blew through the northern part of the state including DuPage County on Monday, Aug. 10, the National Weather Service (NWS) issued a report that 15 tornadoes touched down in the northern Illinois and northern Indiana areas.

The NWS defined a derecho as a line of intense, widespread, and fast-moving windstorms and sometimes thunderstorms. The events of Aug. 10 were ranked EF-1, which is considered “moderate,” according to the NWS. The most powerful storm is rated EF-5, which can produce winds of more than 200 mph.

The NWS issued the following list of locations where tornadoes had been confirmed: • Southwest Rockford • Rockford to Caledonia • Ottawa • Southeast Marengo

• Elburn • Yorkville/ South Plainfield • Wheaton • Lombard/Villa Park • Spring Grove • Oak Forest/Midlothian • Park Forest • Rogers Park in Chicago • Grant Park in Chicago Other tornadoes were confirmed in northern Indiana and near Lake Geneva, Wis. The closest tornado to the Independent’s readership area was in the Lombard/Villa Park area. The storm, which moved in from Wheaton, produced tornado damage immediately east of I-355, just west of Lilacia Park in Lombard, the NWS said. The tornado continued in a northeasterly direction, uprooting trees—some snapped at the trunk—as well as some damage to homes, including a few with substantial roof damage.

According to the Village of Lombard, the “impact zone” consisted largely of the Great Western Trail to the north, Madison Street to the south, Westmore-Meyers Road to the east and Finley Road to the west.

The tornado lifted just northeast of the Jefferson Middle School.

Edward-Elmhurst postpartum complications program educates new moms More mothers die from pregnancy-related complications in the United States than in any other developed country. An average of 73 women die each year in Illinois due to pregnancy-related complications.

A new Edward-Elmhurst Health (EEH) Postpartum Complications program combines Edward-Elmhurst’s Obstetrics and Emergency Departments, and local EMS providers to increase awareness among new moms and healthcare providers of the postpartum complications that new moms can experience.

Between birth and six weeks postpartum, specific complications can occur in new moms that many people are unaware of, such as: • Severe hypertension/preeclampsia (severe high blood pressure that may lead to a stroke) • Late postpartum hemorrhage (severe vaginal bleeding) • Untreated infections leading to sepsis (blood infection) which can

cause multiple organ damage • Thrombolytic embolism (reduction in blood flow due to a blood clot) • Postpartum depression • Complications related to a substance use disorder, particularly opioid poisoning If left untreated, these complications can lead to death.

“The Postpartum Complications program is designed to raise awareness among new moms,” said Pat Bradley, system director, Women’s Services, Edward-Elmhurst Health.

“As part of the discharge instructions, new moms are educated about the risk of postpartum complications that may occur between birth and six weeks and are encouraged to become more self-aware of the changes going on in their bodies during this time.”

New moms are also given a teal bracelet to wear until their six-week postpartum doctor’s appointment.

The color teal represents female strength. If a new mom develops

physical or emotional issues during that timeframe, the bracelet can help alert Emergency Medical Services (EMS) paramedics and emergency department staff that she has recently given birth.

“The bracelets will help providers more easily identify these issues at the time of care, resulting in timely and appropriate treatments and improved outcomes,” says Dr. Tom Scaletta, Medical Director, Emergency Services.

Local EMS paramedics and Edward-Elmhurst Health emergency room doctors and clinical staff have been trained to look for the teal bracelet and to ask if a woman has recently given birth as part of her medical history – and coordinate with the Edward-Elmhurst Obstetrics departments as needed.

Aid for struggling small businesses to start flowing $636 million in ‘Business Interruption Grants’ to help small firms hit by COVID-19

Financial aid is about to start flowing for Illinois businesses that have been affected by the COVID-19 pandemic.

The Department of Commerce and Economic Opportunity published emergency rules this week to implement the Business Interruption Grant program, or BIG. Those rules took effect July 21 when they were submitted to the secretary of state’s office.

State lawmakers authorized the program in the budget they approved during their special session in May. It will make $636 million in federal CARES Act money available to small businesses that have been forced to close or that have seen a substantial loss of customer activity due to COVID-19.

“The Business Interruption Grant program, otherwise known as BIG, is a key component of Governor Pritzker’s comprehensive response to COVID-19 and the economic distress it’s caused for Illinois businesses and communities,” DCEO spokeswoman Lauren Huffman said in an email.

“This historic $636 million program will provide immediate relief for small businesses which have experienced significant revenue losses as a result of the ongoing pandemic and focuses on businesses and communities hit hardest by the crisis.”

The bill also provides that at least 30 percent of the money must go to businesses located in “disproportionately impacted areas,” or DIAs, which are ZIP codes where there are high concentrations of low-income households and high rates of COVID-19.

Huffman also said that at least $159 million in grants will go to entities located outside Chicago and the

surrounding collar counties.

Although the application window for the first round of grants totaling $60 million has already closed, the new rules enable the agency to begin processing those applications and awarding grants.

During the first round, priority is being given to small businesses located in DIAs. Specifically, $20 million will be distributed to small businesses located in DIAs where there was property damage during recent civil unrest. Another $20 million is set aside for bars and restaurants; $10 million for barbershops and salons; and $10 million for gyms and fitness centers.

Those businesses must have met certain income requirements during 2019. They also must have been in business for at least three months prior to March 2020 and have incurred at least $10,000 in qualifying expenditures since March 21.

The BIG program also sets aside $270 million for licensed day care centers. An initial round of those grants is to be awarded by Sept. 30.

Those grants are being administered by the Department of Human Services and will be awarded to facilities that receive at least 25 percent of their revenue through the Child Care Assistance Program and whose operating capacity has been reduced due to group size restrictions imposed by the Department of Children and Family Services to combat the spread of the novel coronavirus.

If funds allow, another round of grants will be awarded for the period Oct. 1 through Nov. 30, according to DCEO. Grant awards may be used to cover operational costs such as staff wages and benefits, occupancy costs, materials, supplies and professional services that are eligible for federal

Coronavirus Relief Fund reimbursements and are not otherwise covered by another grant or loan program such as the Payroll Protection Program or other disaster relief programs.

Tiebreaker process for marijuana licenses finalized State adopts permanent rules to award 75 adult-use dispensary licenses

The Illinois Department of Financial and Professional Regulation, or IDFPR, recently adopted permanent rules to break ties in the application process for 75 conditional adult-use marijuana dispensary licenses.

Under the Cannabis Regulation and Tax Act, firms can score up to 250 points on their application to obtain a license. There are a limited number of licenses available in each of the state’s Bureau of Labor Statistics Regions.

An outside company does the scoring for the applications, and the new rules provide for a randomized tiebreaker process that takes effect if two or more applicants in a given region have a tied score.

Per the rules, which were filed in June and approved by a legislative rules committee Tuesday, the first name drawn will have first right to a remaining conditional license, the second name drawn will have second right, and so on.

If licenses are left over due to some or all of the drawn applicants abandoning their claim, the license will go to the application with the

next highest score. If there are more applicants at the next highest score than licenses available, the tie breaker process will repeat.

Applicants receive points for the strength of their planned security measures as well as floor, record-keeping, business and operating plans, among other factors. Applicants can also receive an added 50 points for qualifying as a social equity applicant.

A firm can achieve social equity status if the majority of its ownership has recently lived in communities disproportionately impacted by poverty, gun violence or the war on drugs. A majority of staff must currently live in such an area or meet other criminal justice related criteria.

Social equity applicants are the only ones that can achieve a perfect 250-point score on their application.

The methodology of the point system is in line with other programs which seek to enact social justice policies to benefit low-income communities disproportionately impacted by the war on drugs and historic disinvestment.

“We are pleased that these rules have been adopted, and we remain

unwavering in our commitment to ensuring these licenses are issued in a fair and objective way that implements Illinois’ equity-centric law,” Toi Hutchinson, a senior cannabis advisor to Pritzker, said in a statement.

Of the 75 available licenses, 47 will be given to applicants from the Chicagoland region. The Metro East area near St. Louis has the next highest number with four.

Conditional adult-use dispensary licenses do not allow the holder to buy or sell marijuana. The licenses only allow them 180 days to find a location to house their dispensary, pass inspection and pay a fee to receive a full license that will entitle them to deal in recreational marijuana.

According to a release distributed

by IDFPR, approval in the legislative committee will allow them to issue conditional licenses “in coming weeks.”

The Illinois Department of Agriculture, which is in charge of awarding licenses that allow firms to grow, infuse and transport cannabis, has yet to finalize its scoring process for firms to apply for and win those licenses.

It is further alleged that the victim then threw the car keys to the juvenile and that she and her daughter exited the vehicle. It is alleged that the juvenile then entered the vehicle and drove away. It is alleged that when the juvenile drove away, he was followed by another vehicle, allegedly driven by Washington-Davis.

Nearly two weeks later, on Dec. 13, at approximately 2:06 p.m., the Warrenville Police Department responded to a call on County Ridge Road regarding a carjacking. It is alleged that as the victim drove, he was being followed by a car allegedly occupied by the juvenile, Washington-Davis and Embry. It is alleged that when the victim arrived at his house, he exited his vehicle and began walking towards his house, at which time he was allegedly approached by two masked men, later identified as the juvenile and Embry.

It is alleged that both the juvenile and Embry were armed at the time. It is further alleged that the men then demanded the victim’s car key and his wallet and then drove off in the victim’s vehicle.

Approximately 20 minutes later, at 2:27 p.m., the Downers Grove Police Department responded to a carjacking that had just occurred on Hawkins Street. It is alleged that the victim, a pregnant female, was sitting in her vehicle in her driveway when she was approached by two individuals, later identified as the juvenile and Embry. It is alleged that the juvenile and Embry wore masks and were armed. It is further alleged that the men ordered the woman out of her vehicle and drove off in her car. It is further alleged that Washington-Davis was the driver of the vehicle that brought the men to the Hawkins Street address.

A friend of the victim had observed the alleged carjacking and followed the stolen vehicle. It is alleged that

Glowiak Hilton: New mental health programs available State Senator Suzy Glowiak Hilton (D-Western Springs) urged those who are struggling with mental health issues to see if they qualify for help through three new Illinois Department of Human Services’ designed to provide housing, crisis support and community care resources.

“We’re all laboring under heavy mental and emotional burdens right now, so we can’t forget how much harder of a struggle this is for our friends and neighbors who are managing mental health issues,” Glowiak Hilton said. “Those in need should reach out to local service providers to see what options are available to them.”

IDHS’ new programs include the Living Room Program, Transitional Living Centers Program and the Transitional Community Care and Support Program. All three coordinate with community-based mental health centers and non-traditional service providers to increase access to the services they offer, as well as to develop their clinical services.

The Living Room Program is designed to

break the cycle of psychiatric hospitalization by providing a safe, home-like environment for people to go to process mental health crises. Peer run crisis services are used to provide a less traumatic and more empowering alternative for people experiencing a mental health crisis.

The Transitional Living Centers Program provides immediate housing to people living with mental illness while they work to find permanent housing. Priority is given to those being discharged from psychiatric hospitals who are at risk for homelessness.

The Transitional Community Care and Support Program assists uninsured or underinsured patients transitioning out of psychiatric care.

The program includes funding for non-traditional supports, such as cell phones, food, clothing, transportation and other resources that are necessary for individuals to succeed as they transition back into communities.

Think about the environment and situations in which teachers have to work. Visit a school and classroom.

And you will see that this is very different from the police, fire or medical personnel, who themselves have their own challenges.

Man accused of stealing County-owned truck following release from jail

when the stolen vehicle was stopped in traffic, the victim’s friend approached the vehicle at which time the occupants, allegedly the juvenile and Embry, exited the vehicle and fled the scene. It is further alleged that as the victim’s friend moved her vehicle off the roadway, one of the defendant’s entered the victim’s friend’s car and drove away. An investigation conducted by the Downers Grove and Warrenville Police Departments led to Embry, Washington-Davis and the juvenile as suspects in the car-jackings.

Through the course of their investigation, authorities were able to apprehend the juvenile who was taken into custody on Dec. 13. On Dec. 17, authorities took Washington-Davis into custody from his apartment and several hours later, authorities apprehended Embry in Chicago.

“In DuPage County we take violent crimes, such as alleged against these defendants, extremely seriously,” Berlin said. “If found guilty, the juvenile allegedly involved in these crimes is equally culpable as his co-defendants and for justice to be served it is imperative that any penalty he faces reflect the severity of the crime. Simply put, the fact that he was several months shy of his 18th birthday should not shield him for a proper measure of justice.”

Embry has been charged with two counts of Aggravated Vehicular Hijacking (Class X Felony), one count of Armed Robbery with a Firearm (Class X Felony) and one count of Unlawful Possession of a Stolen Motor Vehicle (Class 2 Felony). Washington-Davis has been charged with four counts of Aggravated Vehicular Hijacking (Class X Felony), one count of Armed Robbery with a Firearm (Class X Felony), one count of Armed Violence (Class X Felony), two counts of Unlawful Possession of a Stolen Motor Vehicle (Class 1 and Class 2 Felonies) and two counts of Unlawful Use of a Weapon (Class 4 Felony). At approximately 1:30 a.m. on Friday, Aug. 14, the Wheaton Police Department was dispatched to the DuPage County complex for a report of a stolen County-owned work truck. It is alleged that at approximately 1:14 a.m., Britter entered the truck, which was unlocked and running at the time, and drove off the County complex.

At approximately 5 a.m. the same morning, Darien police officers observed the truck parked on the side of Lemont Road just south of I-355.

Britter was found there, allegedly asleep in the driver’s seat. He was taken into custody at that time with-

out incident.

“It is alleged that shortly after posting bond on disorderly conduct charges, Mr. Britter wasted no time in allegedly committing another crime, this time a felony,” Berlin said.

Britter’s next court appearance is

scheduled for Tuesday, Sept. 8, for arraignment in front of Judge John Kinsella.

County expands small business relief program The DuPage County Board on Tuesday, Aug. 11 voted to remove a restriction from the County’s Reinvest DuPage small business grant relief program.

In May, the Board allocated $7 million in monies received under the federal CARES Act for a grant relief program developed in partnership with Choose DuPage for small businesses and independent contractors impacted

by COVID-19. The Board set aside an

additional $10 million in June for use through the same program.

Previously, businesses or independent contractors could not apply for the grant program if they had received assistance from the federal Paycheck Protection Program, the Economic Injury Disaster Loan, any state hospitality grant, or any local loan or grant program. The County Board action on Tuesday removed that restriction from

the application criteria for the Reinvest DuPage program.

The Villa Park Parks and Recreation Department’s men’s 16-inch softball league 2020 season is in full swing.

The start of the season was delayed because of the COVID-19 pandemic, but the league’s teams are back in action on Friday nights at Lions Park.

One of the league’s games on Friday, Aug. 14, featured Belligerent against the Amateurs. Belligerent beat the Amateurs 6-3 in the seven-inning contest, played under the lights on a pleasant summer evening.

Belligerent improved its season record to 3-2. The Amateurs suffered their first loss and fell to 5-1.

“Come on out, Villa Park, like you used to,” said Belligerent head coach Tom Van Petten, a lifelong Villa Park resident who’s been a part of the league for 40 years, after the game. “It’s nice out; you can be socially distant. It’s entertaining.”

In encouraging residents to watch the current action at Lions Park, Van Petten recalled the sport’s glory days in the village.

“Softball was a big thing in this town, and the fields would be surrounded by fans,” said Van Petten, who has lived in Villa Park for 56 years. “There were games here [at Lions Park] just about every night in the summer.”

Van Petten said 16-inch softball—in which players in the field don’t use gloves—had its heyday in Villa Park from about the mid 1970’s until about 1990. Multiple 16-inch leagues with players from the surrounding area played games

“It used to be real, real serious,” said Van Petten of some of the competitive leagues.

While 16-inch softball still has a following, Van Petten admits that youth interest in the sport has waned in the age of computers, streaming entertainment and an array of highly organized athletic programs.

“I think most intramural or town sports have faded,” he said.

“Kids just aren’t out playing like they used to when we were kids.

We would play even if there were just two of us. That was beautiful, growing up like that, and it’s kind of sad that it’s fading.”

Van Petten noted that most of the players on the Belligerent and the Amateurs were in their late 20s or their early to mid 30s. Friday’s fast-paced game featured some excellent defensive plays, including a diving catch in the outfield and a long throw from center field to cut STAFF REPORT down a baserunner at home plate.

Illinois Department of Public Health approves IHSA’s plans for fall sports Most of Willowbrook’s fall sports teams held their first practice of the season on Aug. 17 and boys and girls cross country teams to hold their first practices on Monday, Aug. 17. The Addison Trail/Willowbrook girls swim team’s season will begin when the program can secure a pool that will allow the team to swim in an exclusive environment.

On July 29, the IHSA announced a modified schedule for Illinois high school athletics during the 2020-21 school year. Three sports traditionally held during the fall— football, girls volleyball and boys soccer—have been shifted to the spring during the upcoming school year. Additionally, the IHSA created a new summer season for the 2020-21 school year. Willowbrook’s baseball, softball, girls soccer, boys volleyball, boys tennis and boys and girls track and field teams will compete during the summer season in 2021.

The IHSA’s athletic schedule for the 2020-21 school year will feature truncated fall, winter, spring and summer seasons. The fall sea-

son will continue until Oct. 24. The winter season will run from Nov. 16 until Feb. 13. The spring season will take place from Feb. 15 to May 1, while the summer season will run from May 3 to June 26.

Willowbrook’s traditional spring sports programs weren’t able to compete during the spring of 2020 because of the pandemic.

Willowbrook’s building closed to in-person instruction at the end of classes on March 13. The building remained closed for the rest of the 2019-20 school year. Willowbrook and the state’s other high schools were prohibited from conducting practices and competitions while school buildings were closed during the spring.

Willowbrook will begin the 2020-21 school year, with fully remote instruction, on Monday, Aug. 24. The District 88 Board of Education will reevaluate the status of the COVID-19 pandemic and the district’s instruction model at its meeting on Oct. 5.
