Two men charged in two separate incidents in Addison Bond denied for suspects accused of armed carjacking, robbery

It is alleged that after Kimbrough attempted to make three phone calls, he pointed a gun at the victim and ordered him out of the car. After the victim complied, Kimbrough entered the car and drove off at a high rate of speed. The victim then ran inside his residence and contacted the police.

An investigation into the matter led authorities to a gas station on Archer Avenue in Summit. It is alleged that as the Darien Police Department and the Illinois State Police attempted a felony stop on the vehicle, the driver of the car, later identified as Pierre-Louis, allegedly attempted to flee the scene as Kimbrough was attempting to enter the vehicle. It is further alleged that at this time the vehicle was disabled using OnStar® and that Pierre-Louis exited the vehicle and fled on foot while Kimbrough got into the driver’s seat of the vehicle. Kimbrough was taken into custody at this time. Officers recovered a firearm from the vehicle. Pierre-Louis was taken into custody the following day from a hotel in Addison.

DuPage County State’s Attorney Robert Berlin and Addison Director of Police Bill Hayden announced on Wednesday, May 13, that bond has been denied for one of two men accused of hijacking at gunpoint a Chevy Camaro from a man late Monday night, May 11, and robbing an Addison gas station at gunpoint on March 29, 2020.

James T. Kimbrough, 22, of Dolton, appeared in Bond Court on Wednesday, where Judge Jeffrey MacKay denied bond.

Big G’s delivers 150 pizzas to Elmhurst Hospital Thanks to the generosity of Kellogg’s Away From Home

Big G’s has delivered 1,242 pizzas to date to 38 Chicagoland hospitals and clinics made possible by 330 donations, since March 21.

The donation from Kellogg’s Away from Home (KAFH) division is the largest to date. Big G’s owner Jaime Gamez made the first donation and took to social media making a plea for support not only for his workers so that he could stay afloat, but also for those caring for people being treated for COVID-19 at area hospitals.

“I just want to say thank you to all of the health care workers for all that they are doing and to the communities for donating,” said Gamez. “It is through these donations that we can show our appreciation to health care workers on the frontline while helping us keep our nose above water so

that we can get through this together.”

Gamez asked for additional donations via social media which would not only feed the many people who are working tirelessly at area hospitals but also allow his employees to remain on the payroll. Historically, approximately 70 percent of Big G’s sales are on the weekend when the bars are open. The restaurant also heavily relies on foot traffic from the Chicago Cubs season, which remains uncertain.

Illinois hospitals have begun receiving $75 million in new stability payments to help fight COVID-19, the Illinois Department of Healthcare and Family Services (HFS) announced last week. The funds will help hospitals continue to provide essential COVID-19 services to their communities in the coming weeks and months.

“We recognize that hospitals on the front lines against COVID-19 need support and they need it now,” said Theresa Eagleson, HFS director. “We’re incredibly thankful to the medical professionals who are serving Illinoisans during this public health crisis, and we are committed to doing all we can to help them.”

Stability payments are being issued in installments until July 1, 2020 through the state’s Medicaid Managed Care Organization (MCO) partners. Hospitals began receiving the first installments in late April.

The COVID-19 pandemic has brought unprecedented challenges to the healthcare industry. While some providers have experienced an onslaught of suspected or infected patients, others have a looming shortfall of revenue due to delayed elective procedures or patients with chronic conditions seeking care in different ways that reduce risk of exposure to the virus.

To offer further support, a bipartisan working group created last year to extend the Hospital Assessment Program (HAP) has agreed to a proposal that would bring nearly $250 million more dollars annually to hospitals throughout the state. This will maximize federal participation in Medicaid and move to a more

Addison School District 4 music teachers had to use their creative skills to take full advantage of Young People’s Music Initiative (YPMI) grant funds received from the JCS Arts, Health, and Music Fund of the DuPage Foundation for the 2019-20 school year. The YPMI program provides support to schools to help foster love and appreciation for music in young students.

This is the third year of a seven-year grant cycle and the DuPage Foundation had awarded $6000 for providing interactive assemblies at each of ASD4’s elementary schools, as well as purchasing extra drums for the general music classrooms. The drums were purchased and have been used throughout the school year, but the all-school assemblies, which were scheduled to take place in May, had to be cancelled due to the COVID-19 Coronavirus school closings.

Stone School music teacher Kris Brokos met remotely with the Chamber Music on the Fox performers and they came up with an idea to offer their planned music assemblies in a modified virtual format.

Kelly Langenberg (French horn) and Sara Sitzer (cello) recorded videos introducing themselves, the instruments they play, and one of their

favorite pieces of music. Additional videos focus on emotions in music and how those emotions can be expressed through music and movement.

Dr. Kelly Stokes, from the Salt Creek Ballet, recorded a virtual field trip to the Creek Ballet’s studio and Dancing Drums also has provided virtual drum workshop videos.

These video workshops are being rolled out to ASD4 students throughout the month of May. The first two videos, featuring Sara Sitzer and the cello, were well-received by students.

The Dancing Drum videos, which encouraged students to find household ‘instruments’ and practice drumming in rhythm with the video, were made available the week of May 11.

French horn and ballet videos will be made available to students the week of May 18. The final week of the school year will feature listening and movement pieces from The Carnival of the Animals by Camille Saint-Saens as well as answers to questions that students submit to the performers.

Addison School District 4 is grateful for the musical opportunities that are being made available to students thanks to funding from the DuPage Foundation and the inventive adaptations of Chamber Music on the Fox, Salt Creek Ballet, and Dancing Drums.

COVID-19 cases ‘trending down’ at Lexington

Throughout the COVID-19 pandemic, the elderly—particularly those residing in long-term care facilities—has been the segment of the population hardest hit.

According to the Illinois Department of Public Health (IDPH), as of mid-May, there were over 6,300 confirmed cases of COVID-19 reported in Cook County long-term care facilities with over 860 deaths.

In DuPage County, there have been over 1,300 cases with just over 200 deaths.

Lexington Health Network— with assisted living and independent living facilities in Lombard and Elmhurst—reports that since mid-March, 16 residents at Lombard have tested positive for the virus while 13 staff members are recovering at home. At Elmhurst, nine residents have tested positive while eight staff members are recovering at home, also since midMarch.

There have been 10 COVID-19 related fatalities at the Elmhurst facility and seven at Lombard since mid-March.

“Our residents, because they are with us—generally for an extended period—become like family to the staff,” said Fred Benjamin, Chief Operating Officer of Lexington Health Network, which is among the 19 percent of U.S. skilled nursing facilities that have been recognized as “Best Nursing Homes for 2019-20” by U.S. News & World Report. “Consequently, when one of our residents passes, the staff takes it very hard. Some of the residents don’t have family, or if they do, they may live far away, so the staff truly does become their family.

“These deaths are devastating, yet our valiant staff leave their own families every day to come to work, care for and love their residents. They do this despite the late support (with regard to personal protective equipment, or PPE, and testing) from the state and federal governments. We have reached out to sources all over the world and purchased over $1 million of PPE, paying many times what we paid for similar items only weeks ago.”

Benjamin said Lexington is doing everything possible to prevent further spread of COVID-19. He said Lexington is continuing to work closely with the IDPH, the Centers for Disease Control and local health officials.

“COVID-19 is especially dangerous and potentially lethal for the elderly and infirm,” he said. “We take this responsibility very seriously and care deeply about our residents and staff. We have been fortunate that through much hard work and

“We have purchased additional iPads and similar devices to assist,” he said. “We also provide information to family members in writing weekly or more frequently if new cases are identified or if there are any changes in a resident’s condition.”

However, family members are allowed to interact with residents through a window.

“In so far as ‘window visits’ are concerned, our staff has accommodated visits of this type,” Benjamin said. “We also had a ‘drive-by caravan,’ where cars filled with family members and well-wishers drive by the building, and residents and staff can look out to see them and hear them as they honk their horns to send greetings and to thank staff.”

Control measures Benjamin said the following control measures have been implemented at both facilities to prevent further spread of COVID-19. These measures include: • Increased respiratory surveillance with a full set of vitals every eight hours throughout the facility; • Control measures for any patient with signs/symptoms of a respiratory viral infection that include: increased monitoring to every four hours, and initiation of isolation precautions; • Every effort is made for staff caring for positive or symptomatic

patients to not care for negative or asymptomatic patients; • A determination to send residents to the hospital is based on the same criteria used for other severe change in condition; • The screening tool used for entrance to the facility has been updated to reflect recent changes in clinical guidelines; • Strict visitor and non-essential provider restrictions continue. “We are facilitating physician visits and rounding through our telemedicine platform,” Benjamin said.

• Continue suspended group activities and provide alternatives (i.e., in-room dining and one-to-one activities); • Disinfecting frequently touched surfaces every two hours or as frequently as possible; • All staff members wearing a mask upon entry into the building and throughout their shift; • Residents are now encouraged to wear a mask whenever they are out of their rooms and with direct care from staff; • Working with IDPH, local health departments and Lexington’s laboratory partners to procure needed testing.

“Although testing kits, supplies and PPE have been limited, we are experiencing increasing access and prioritizing available tests at this time,” Benjamin said. “Where universal COVID-19 testing and resources are available to our facilities, LHN (Lexington Health

Network) will proactively test all staff and residents. This may lead to higher case counts, but it will allow our teams to identify asymptomatic residents and staff members and work to prevent the spread of COVID-19.”

Benjamin noted that resident-to-resident, in-person contact is limited at this time on units with COVID-19 positive or suspected positive individuals. Social interaction with residents on non-COVID-19 units, he said, is monitored with appropriate social distancing and PPE for residents and staff.

“Residents are not asked to remain in their rooms, except if they are COVID-19 positive or suspected of being positive,” Benjamin said. “We do try to minimize contact if at all possible.”

Meals are served inside residents’ rooms, he said.

“We are making significant efforts to do special things for residents at meal times,” Benjamin said. “We had very nice special meals for the residents on Mother’s Day. Our social service staff provides many activities for residents, such as video bingo and other similar activities to keep them entertained and mentally stimulated.”

If the weather is nice and temperatures are warm, Benjamin said residents who are not in isolation and who can maintain social distancing from others are allowed to go outside and get some fresh air.

“Our staff do interact normally (with residents), within the confines of their personal protective equipment,” he added. “Staff wear PPE when providing care to residents identified as COVID-19 positive or who are being monitored for COVID-19-like symptoms. Residents are now encouraged to wear a mask whenever they are out of their rooms and with direct care from staff. These are the guidelines provided by the CDC and Illinois Department of Public Health.”

Benjamin pointed out that Lexington proactively put restrictions in place in mid-March to protect the health and safety of residents, families and employees at the Elmhurst and Lombard facilities as news of the pandemic became front-andcenter throughout the area and the nation. These restrictions have continued, he said.

“Visitation remains restricted to essential health care staff, government officials or other healthcare professionals,” he said.

As of May 11, Elmhurst Hospital is currently treating 63 inpatients with confirmed cases of COVID-19. Elmhurst Hospital has had 41 deaths of inpatients with confirmed cases of COVID-19.

Since March 24, 228 patients have been discharged from Elmhurst Hospital following treatment for confirmed cases of COVID-19. That’s up from 181 last week. That’s the number we like to see increase.

How to protect a vulnerable person in your house from coronavirus

The coronavirus pandemic has forced people to pay more attention to what they’re touching and do a better job of cleaning their hands and houses.

For people who live with a loved one who could be more susceptible to complications from COVID-19, this is an important lifestyle change.

The Centers for Disease Control (CDC) reports that older adults and people with underlying medical conditions — hypertension, lung disease, moderate-to-severe asthma, diabetes, severe obesity, and chronic heart conditions, among others — are at a higher risk for severe illness from COVID-19.

To protect a vulnerable person in a household, people need to take some extra preventive steps at home.

Beyond the advice to wash hands frequently with soap and water for 20 seconds, cover coughs and sneezes, and regularly clean and disinfect surfaces and frequently touched items, they should add these steps to their routine: • Maintain social distance, even in the house. The virus spreads mainly between people who are within 6 feet of each other, through droplets that spray when an infected person coughs or sneezes. If someone has a

• Designate a “safe” part of the house for high-risk family members.

If a family member is 60 or older, or immunocompromised, let them have their own space in the house where they mostly reside.

• Keep track of any medical supplies your relative needs (oxygen, incontinence, dialysis, wound care) and create a back-up plan.

• Don’t share personal items.

Don’t share utensils, toothbrushes,

toothpaste or other personal items with family members.

• Designate one person to run errands and minimize the number of times that person needs to leave the house. Stock up on non-perishable food to have on hand in your home.

When the designated errand-runner leaves the house, make sure they wear a mask, avoid touching things like door handles and elevator buttons with their hands, and maintain social distancing. Consider options for grocery delivery, curbside pickup and take-out.

• When returning home, wash hands immediately and disinfect any

surfaces touched before handwashing (such as a door or faucet handle).

• Isolate sick individuals. If a family member becomes sick, they should self-isolate in a single room and bathroom, according to their doctor’s advice. Have family members self-monitor for COVID-19 symptoms.

• Keep a distance from delivery workers. If items are delivered, stay 6 feet away from workers. Wash hands after picking up mail and after handling packages or other items from outside the home. Pay for everything (including tips) online, if possible.

• Don’t have guests over to the

house right now. If a family member or friend must come over, maintain a 6-foot distance and keep them out of shared living areas.

• Healthcare workers should clean up before they interact. Before they enter their home, workers should take off shoes and work clothes and put them in a plastic bag until they can be washed. Head straight for the shower (use separate soap and towels from the household) and change into clean clothes before interacting with family members.

How COVID-19 affects your lungs COVID-19 is a respiratory illness that targets the lungs.

For many, the virus will present with mild to moderate symptoms and will not require hospitalization. But for others, the disease can be more serious and lead to hospitalization, critical care, and in some cases it can be fatal.

COVID-19 starts with droplets from an infected person’s cough, sneeze or breath.

Those droplets can be in the air or on surfaces that you touch, which you can then transfer when you touch your eyes, nose or mouth.

Once the virus enters the body, it looks for a home in the mucous membranes in the nose or throat. It can be 14 days before someone realizes they have been infected and experiences early symptoms such as a fever, sore throat or dry cough.

The virus can continue to move down the respiratory tract eventually landing in the lungs, where it can cause inflammation and infection, making it more difficult to breathe.

The most serious cases of COVID-19 involve lung infections where the virus can cause acute respiratory distress syndrome, which can be potentially fatal as it closes off air sacs and causes inflammation of the lungs, making breathing difficult.

Although most COVID-19 cases resolve with mild to moderate symptoms, it is important to keep the lungs healthy during this time. For many patients, deep breathing exercises can be helpful.

Here’s how deep breathing works: • Take a slow, deep breath in.

• Hold it for five seconds, then slowly exhale.

• Repeat five times, ending the fifth repetition with a cough to expel any mucous.

Sick people can do this exercise every couple of hours.

Patients who have had surgery in the past are probably familiar with this exercise.

Oftentimes, the exercise is done with a spirometer and patients breathe in through a tube and move a piston up the device to measure their breaths.

Taking in a slow, deep breath and then coughing helps open the lower part of the lungs, where infection can set in, and dislodge any mucous that may have collected there.

In more serious COVID-19 cases, physicians also position patients in the hospital on their stomachs (called prone positioning). Lying on your back can put pressure on some sections of the lung, but the prone position opens the lungs, helping oxygen flow.

“You’re able to get more oxygen to where you need it,” said Joan Cecich, system director of respiratory care at Edward-Elmhurst Health.

Cecich said hospital staff are using these techniques with hospitalized patients as well as with those patients who have been discharged from the hospital and are recovering at home.

She noted that patients with COVID-19 who come to the Emergency Department but are discharged to recover at home, are sent home with a couple of tools to aid in their recovery from the virus.

Each patient receives a spirometer to use for deep breathing exercises at home and a pulse oximeter to monitor their blood oxygen levels, with instructions on what to do if those levels dip.

Patients who have been hospitalized for COVID-19 and are discharged to go home also are sent home with a spirometer to continue their breathing exercises.

Follow-up care also includes patients reporting their pulse oximeter readings through text to a case manager from the Emergency Department.

Better Business Bureau briefings released, warn that market volatility, scammers leave businesses, consumers vulnerable COVID-19 has put more stress on consumers and business than ever before, and scammers are still using every ruse they can to swindle people.

There are multiple factors, including stay-at-home orders, quarantines, COVID-19, and scams, that are could lead to as much as a third of the economy being shut down.

Data from the University of California at Berkley shows that unemployment may rise to as much as 25 percent, and tens of thousands of small businesses are barely holding on. The Better Business Bureau conducted a pulse survey over 1,300 accredited businesses and recently published “A Comprehensive Report on the Impact of COVID-19 on Business.” Findings from the survey included: • More than 70 percent said that the coronavirus would have a significant negative impact on their business.

• Over 50 percent of businesses do not have enough cash or credit

to survive more than 60 days in the face of an unexpected calamity, and 60 percent of businesses are searching for funding support options.

• 36 percent of businesses say they will have to reduce staff, and 30 percent say they will have to change their business model. However, Hubspot found that, weekover-week, businesses that were able to pivot into a new business model were able to drive sales up by as much as 8 percent.

The briefing also touched on ways consumers can help support small businesses: • Reschedule, and commit to future business. Wherever possible financially, support local businesses who may have had to close due to stay-at-home orders by rescheduling appointments, or setting new ones.

• Visit www.bbb.org/smallbusiness for more resources for small business owners during these troubled times.

A second briefing showed that scammers are capitalizing on the

fact that many consumers were forced to stay inside in April. These scammers are setting up fraudulent online shops and phishy social media ads for everything from fake coronavirus cures or prevention to high-demand items like toilet paper and facemasks.

• While only 14 percent of scams reported to the BBB in March were COVID-19 related, 58 percent of people reporting those scams lost money to them. This makes COVID-19/coronavirus scams on of the riskiest on the BBB Scam Risk Index.

• 35-54 year-olds are both most likely to encounter a scam and most likely to lose money, which shows that social isolation from family and friends contributes to the risk of falling victim to a scam.

How can consumers avoid coronavirus scams?

• Educate yourself from official sources. Currently, there is no cure or prevention for COVID-19.

Avoid any business claiming to of-

fer a product for that purpose.

• Ask someone else if the offer or situation seems like a scam.

Often, simply taking the time to ask for another opinion breaks the sense of urgency and fear the scammer seeks to create and allows you to evaluate their claims.

Additionally, if the above scams weren’t enough, the Federal Trade Commission is warning consumers about another new scam to pop up: fake coronavirus testing sites.

While these fake sites seem to have official signs and tents, their testing is anything but real. They may not follow CDC procedure, risking exposure to the virus.

They may take consumers’ financial information, risking identity theft or unauthorized charges on your credit card bill. Worst of all, they are not able to provide consumers with the help that they need.

Report a fake testing site to your local police, the Federal Trade Commission at www.ftc.gov/complaint, and the BBB at www.bbb. org/scamtracker.

Since Saturday, there were 99 new cases and five deaths reported: • One male in his 60s; • One female in her 70s; • Two females in their 80s; • One female in her 90s.

The upside of COVID

I’m as stir-crazy as anyone over this Corona situation. There are lots of moments and days when I find it hard to look on the bright side. The dark side is just so ominous and tempting.

There are the uncertainties. The unknowns. Glass. Half. Empty.

Still, there are certain upsides to the stay-at-home directive that COVID-19 has brought about. They are the bright specks in an otherwise dim situation.

Many people can’t go into work.

Some are working from home in makeshift home offices hastily set up in a corner of the living room or atop the dining room table. People are learning new ways to get their work done in a different environment and perhaps with a cat or baby on their lap. This fosters creativity and ingenuity. Instead of saying “I can’t,” we’ve learned how to figure it out – in a good way.

We are stuck inside with our families. That should be a positive thing. We’ve had time to talk and listen and share ideas. Hopefully we are all being kind to the families we live with, because we all need kindness right now.

We aren’t hungry. Far from it.

Even though grocery shelves may be lacking in some areas, after the quarantine is over many of us will have to start exercise plans to lose our own COVID-19.

We may not be able to get together in person but we aren’t completely cut off. There is email, texting, social media and I’ve heard that good, oldfashioned phone conversations may actually be making a comeback.

on our hands. Pre-pandemic that would have been a gift. It still is. My junk drawers have never been more organized.

While we may dodge face-to-face interaction in the grocery aisle, our community togetherness has never been stronger. We are reaching out.

Helping one another. We are making masks and donating them.

We are making meals for those in need. We are providing support for those vulnerable to the disease. We are doing what we can for graduating 2020 seniors. We have been reminded of the value of one another. Reaching out to help lightens the load and feeds the spirit. Priceless.

Social media photos of fancy restaurant meals have been replaced by home-cooked ones. People are staying put, eating together and getting back to the basics. I’ve baked more bread in the last two months than in the last two years. People are not only sharing photos; they are sharing recipes. Sharing is a great thing – unless you are talking about COVID-19.

People everywhere are decluttering. Ridding ourselves of the extraneous things we never really needed is liberating – both physically and mentally. I’ve unloaded a whole bunch of stuff – from a six-foot safe

distance, of course.

We are saving money. When you are stuck at home you don’t drive anywhere and therefore save on gas.

We’ve even gotten refunds on car insurance because of this. We can’t go out – to restaurants, movie theaters or shopping. While saving money is a plus, I can’t wait to start spending at the venues referenced above. When we open up again, they will need our support.

We are eating more take-out than ever before, and it’s actually a treat.

Who would’ve thought a fast food burger would feel like a splurge? But it does.

For non-essential workers, alarm clocks have become a thing of the past. Sleeping in later than usual may be the new norm, but it still feels like an indulgence.

Finally, I believe we’ve gained a perspective that none of us would have ever thought possible preCOVID. I think we’ve all learned how good we had it – and still have it. We have food in the cupboards and gas in our vehicles. The electricity works and the water flowing from our faucets is safe to drink. We are directed to stay at home, but we aren’t ordered to do so. We can take a walk outside and appreciate the sunshine and warmth it brings.

We’ve learned to not to take normal for granted – not ever again. This appreciation is truly a gift. Glass.

DuPage County Stormwater Management announced on Friday, May 15, that following precipitation throughout the area beginning Thursday through early Friday morning, it was operating the Elmhurst Quarry Flood Control, Wood Dale-Itasca Reservoir in Wood Dale, Spring Creek Reservoir in Bloomingdale on Salt Creek, Fawell Dam in Naperville and the Armstrong Park Reservoirs in Carol Stream along the West Branch DuPage River.

Portions of DuPage County received between 2.8 and 4.1 inches of rainfall from early Thursday morning through early Friday morning.

Intense rainfall overnight triggered the operation of the county’s major flood control facilities. In addition, all County’s gravity-operated facilities were in operation.

DuPage County Stormwater Management staff pledged to continue to operate the flood control facilities and monitor stream elevations throughout the day Friday.

At that time, little to no rain was forecasted until late Saturday.

Of the 17 flood control facilities DuPage County operates, five larger facilities had mechanical equipment that allowed staff to control them according to a predetermined operating plan.

Rainfall continues all day Sunday On Sunday, May 17, DuPage County Stormwater Management continued to operate all its flood control facilities in response to rainfall accumulated since Thursday, as well as rainfall throughout the day Sunday.

Since Thursday, DuPage County has received 4 to 5.5 inches of rainfall countywide, including an inch of rainfall overnight after a respite Friday afternoon through late Saturday. The National Weather Service forecasted an additional approximately 2.5 inches of rainfall throughout the day Sunday. DuPage County Stormwater Management staff continued to operate all major flood control facilities and monitor stream elevations throughout the rainfall event.

DuPage County Stormwater Management staff will continue to provide updates as they become available.

Amended Bailey argument cites 2001 state attorney general memo as proof Pritzker overstepped DeVore’s other four cases regarding stay-at-home orders moved to federal court

A document included in a downstate representative’s revised lawsuit against Gov. JB Pritzker suggests the governor does not have the authority to issue successive disaster proclamations.

On April 23, Republican Rep. Darren Bailey, from Xenia, first alleged the governor overstepped his power by declaring more than one state of emergency to address the COVID-19 pandemic.

Now, in amended arguments, Bailey cites a memo from the office of Republican Attorney General Jim Ryan in 2001 that says the Illinois Emergency Management Agency Act allows a governor to wield expanded authority only “for up to 30 days.”

Pritzker first issued a disaster proclamation on March 9. Since then, he has extended that proclamation twice, most recently through May 30.

In the 19-year-old memo, senior assistant attorney general Michael Luke wrote that expanding those emergency powers to last more than 30 days “would render the limitation clause meaningless.” Taking into account the rest of the law, he added, a governor would need permission from the General Assembly for any extension.

“This Attorney General opinion lays bare the overreach of the executive branch being perpetrated by this gamesmanship,” Thomas DeVore, Bailey’s attorney, wrote in the re-

vised lawsuit filed May 13.

While that document is not legally binding, DeVore said the “optics” of its existence “will be horrific for the governor’s office,” especially because the attorney general’s office did not disclose the memo to a judge sooner.

Pritkzer, during his daily COVID-19 update May 13, said current Democratic Attorney General Kwame Raoul “has not issued that (memo) to us,” and pointed out that the office is representing Pritzker in this case.

The disaster financing section of the act further supports that argument, Bailey alleges in the lawsuit.

A governor is allowed to spend a certain pot of state money on a disaster, and, if the General Assembly is not in session, to transfer funds from other accounts as needed only “until such a time” as the Legislature “can convene in regular or extraordinary session.”

Raoul’s office previously argued that if Pritzker’s disaster proclamation was allowed to lapse on April 8, or 30 days after the first one was issued, it “would lead to absurd, unjust, and profoundly harmful results to a degree rarely, if ever, contemplated by an Illinois court.”

The law does not specify a governor cannot declare more than one disaster, the office argued in a court filing.

In each of Pritzker’s proclamations, he cites COVID-19 as a continuing public health disaster.

According to the IEMA Act, a

disaster is a wide breadth of circumstances “requiring emergency action to avert danger or damage, epidemic … (or) public health emergencies. …”

DeVore, in an interview, said that is key. He does not contest Pritzker was legally permitted to issue the first proclamation, but said the following two were not allowed. A disaster exists, he said, only if there is a threat that requires emergency action to avoid.

“How are you going to avert something—a public health emergency—that’s already here? That is why Governor Pritzker cannot issue a second or third proclamation. He’s admitted he’s not trying to avert anything, he’s trying to manage its effects,” DeVore said.

And he argued the governor’s legal team is practicing legal gymnastics by building a 30-day deadline into each proclamation.

“I assure you he’s putting that in there to cause that proclamation to expire so he can then issue another one and recharge his emergency powers,” DeVore said.

The Legislature, when it convenes this week for the first time since March 5, should not pass a law allowing Pritzker to continue using emergency powers to combat COVID-19, he added. That would be an unconstitutional, “excessive” delegation of the General Assembly’s powers.

Bailey is asking a judge to declare the governor’s second and third disaster proclamations unlawful and

prevent him from issuing any further ones.

He is also asking a judge to agree the Department of Public Health, not the governor, has “supreme authority” to place a resident under quarantine and shutter a business due to public health concerns.

Four other lawsuits move to federal courts A second Republican state representative who also filed a lawsuit challenging Pritzker’s emergency powers asked a judge May 12 to halt enforcement of the stay-at-home order until a court rules in his case.

Machesney Park Rep. John Cabello asked the Winnebago County Circuit Court for a temporary restraining order because, he said in a statement, the governor’s plan to reopen Illinois’ economy is “wholly inadequate.”

“I have filed my temporary restraining order to put the governor on notice that we are not going to let him dictate to local communities,” Cabello said. “I trust our local officials and our citizens more than I trust politicians from Springfield or Chicago.”

The outcome of Cabello’s case could affect all state residents. If a judge agrees Pritzker cannot legally issue successive 30-day disaster proclamations, it could release residents and businesses from the governor’s restrictions.

DeVore, who is also Cabello’s attorney, said shortly after this request was filed May 12, the attorney gener-

al’s office asked the case be moved to a federal court. And earlier last week, lawyers also asked three other cases be moved to a federal court—one filed on behalf of a hair salon owner and two for a restauranteur with two establishments. All are represented

by DeVore.

The attorney general’s office, which represents Pritzker, did not comment on its motivation for a change in venue.

In an interview, DeVore said while his clients did not file their challenges in federal court, they do not oppose the shift.

“My clients could’ve went to a federal court. They didn’t. This is an issue of disagreement between the good people of the state of Illinois and the executive branch,” he said. “For some reason, the attorney general was not particularly excited about that.”

The three lawsuits filed by Sonja Harrison, owner of the Clay County-based Visible Changes Hair Salon, and Kevin Promenschenkel, owner of Poopy’s Pub & Grub in Carroll County and Dookie’s Pub & Grub in Clinton County, are nearly identical.

They are asking judges in three counties—now, federal courts—to agree their businesses were shuttered without an avenue to appeal, that the Emergency Management Agency Act cannot afford Pritzker the power to close businesses, and that the steps outlined in the Illinois Department of Public Health statute must be followed.

Pritzker: Most regions on track to enter Phase 3 in late May

Gov. JB Pritzker said early last week that three of the state’s four regions are on pace to enter the next phase of reopening the state’s economy by the end of May, but he pushed back against suggestions that the state should begin to reopen earlier.

“If we were to lift all of our mitigations entirely at the end of the month, modeling shows that there would be a new surge of COVID-19 and a higher R-naught in each of the four regions, even in the least hard-hit regions of our state,” Pritzker said during a daily COVID-19 briefing in Chicago.

The R-naught is a scientific expression that refers to the rate of spread from one infected person to another who was not previously infected. An R-naught of 2 means one infected individual will, on average, spread the disease to two other people. An R-naught of 1 means the disease is continuing to spread, but that it is relatively controlled.

Public health officials said Illinois has an R-naught value of 1, and that the goal is to get it below 1 over a sustained period of time.

The briefing was unusual in that Pritzker and Illinois Department of Public Health Director Dr. Ngozi Ezike appeared separately in a video conference from their homes, a new self-isolation measure being taken after a member of Pritzker’s senior staff tested positive for the disease last week.

On May 5, Pritzker outlined a five-

phase plan for reopening the state on a region-by-region basis if those regions achieve certain benchmarks.

All regions of the state are in the second phase, which allows retail stores to open for online and telephone orders for pickup and delivery, but it continues to prohibit public gatherings and require people to wear face coverings when they are in public and cannot maintain a six-foot distance from others.

Golf courses and some state parks may open under IDPH guidelines, and hospitals can resume performing elective surgeries.

In the next phase, known as the “Recovery,” face coverings and social distancing will still be required but manufacturing, offices, retail, barbershops and salons may reopen to the public, provided they comply with capacity limits and other safety precautions mandated by IDPH. People will also be allowed to gather in public in groups of 10 or fewer.

One of those benchmarks is to lower the percentage of tests that come back positive to below 20 percent and to keep it there for 14 days. Pritzker three of the state’s four regions are currently below that mark. And while the northeast region, which includes Chicago and the surrounding suburbs, was at 22.3 percent as of May 8, he said there still is time for that region to meet the benchmark

by May 29.

The governor said the rate of tests that return as positive was 9.1 percent in the

north-central region; 6.0 percent in the central region; and 10.5 percent in the southern region.

A second benchmark is that a region should have no overall increase in hospitalizations for COVID-like illnesses over a 28-day period. So far in May, he said, all regions have reported substantial decreases in hospitalization rates: an 18.6 percent decrease in the northeast region; a 35.8 percent decrease in the north-central region; a 44.4 percent decrease in the central region; and a 54.3 percent decrease in the southern region.

The third requirement is that a region have a “surge capacity” of at least 14 percent of its surgical beds, intensive care unit beds and ventilators. Pritzker said all four regions of the state were meeting that benchmark as of midnight Friday, May 8.

Despite those numbers, Pritzker said Illinois still has not hit its “peak” in the spread of COVID-19, which was originally estimated to happen in mid-May. He said that because the state has been successful in slowing the spread of the disease, it has also pushed back the time when the peak will occur, which is now expected to happen in mid-June.

“A pushing out of our peak is a natural consequence of flattening the curve,” Pritzker said. “Remember that no one can truly stop this virus without a vaccine. But what we’ve been aiming to do since early March is slow down the exponential rate of transmission. When we do that, it leads to a slow-

er rate of infections over a longer period of time, giving our health care system the ability to treat those who have complications and giving our pharmaceutical researchers time to develop effective treatments and potentially a vaccine.”

State receives first shipment of COVID-19 treatment Remdesivir Meanwhile, Illinois’ top health official on Monday said the state has received its first shipment of Remdesivir, an antiviral drug that has proven early success as a treatment for COVID-19 patients.

Dr. Ngozi Ezike, director of the IDPH, said the federal government shipped 140 cases of Remdesivir vials to Illinois on Saturday. She said each case of the drug, which is injected intravenously, provides treatment to about five patients.

“The National Institute of Allergy and Infectious Diseases recently conducted a clinical trial and found that patients who received Remdesivir had a statistically significant shorter time to recovery, compared to those receiving a post placebo,” Ezike said during state leaders’ daily briefing on COVID-19.

Ezike said IDPH sent cases of Remdesivir to 14 hospitals around the state by considering hospitalization and intensive care data, as well as hospitals that are treating the most critically ill patients and patients of color.

“We do expect to receive more Remdesivir in the future,” she said.

County Coroner notes surge in overdose deaths DuPage County Coroner Richard Jorgensen MD has advised the citizens of DuPage County that there has been a unusual spike in the number of overdose deaths and non-fatal overdoses in the past three weeks.

“We have noticed an marked increase of deaths. In recent weeks there have been multiple deaths in the same day.” Statistics from last year (2019) show that we had 96 opioid overdoses. In the past three weeks we have had 20 overdose deaths, mainly due to opioids.

We do not know if this is due to a change in the makeup of the drugs, drug usage on the streets or due to current COVID-19 related changes in society. After review of the social aspects of the recent deaths many of those who died were living alone, having personal or marital difficulty, depression and recent drug rehab or treatment.

Analysis of the 2019 data revealed that the age of those who were dying has trended to older age ranges. This average age of those who have died is 36. This is older than the average in 2019. Further, there have been no definitive geographic or demographic trends, these deaths are found in all areas of the county.

State’s Attorney Bob Berlin was asked what his thoughts are about this surge in deaths.

“While we find ourselves in the midst of the deadly COVID-19 health crisis, it is important to remember that we are still facing a severe opioid epidemic that has claimed too many lives and must not be forgotten,” he said. “Because of this, we must be vigilant in ensuring that resources allocated to fight COVID-19 are not taken from the resources previously intended to fight the opioid epidemic.”

fering from addiction. Brad Gerke is co-founder of 516 Light Foundation, director of operations at the Banyan Treatment Center, and is a member of the DuPage County HOPE Task Force. In light of the recent trend, Dr. Jorgensen reached out to Brad Gerke to inquire what he was seeing on the street level. Brad responded that he had been seeing “a marked increase in all issues related to addiction.”

“I have gotten an increasing number of phone calls from those with concerns and fresh relapses,” he said.

“I monitor social media and have seen a spike in fatal and non-fatal overdoses in the range of three to six per day. I think this is due to a lack of in-person communication and lack of ability to be with people. This void of connection takes away the primary treatment methods, which are critical aspect of rehabilitation and recovery.

“This COVID-19 environment leads to depression, anxiety, fear and worry about job security. This is all extremely difficult for addicts and those in recovery.”

“If you know of people who are at high risk: known drug users, those living alone, having personal or marital difficulty, depression and recent drug rehab or treatment, please reach out and see if they need support or help,” Coroner Jorgensen said. “These are difficult times made worse when an individual has drug and/or mental health issues.

“We are all in this together and need to reach out to all of those who are vulnerable in this difficult time.”

Returning to Willowbrook

Members of Willowbrook’s Class of 2020 stopped by their school on Friday, May 15, and Saturday, May 16, for a drive-through celebration. Teachers and administrators greeted the Willowbrook seniors, who remained in their vehicles as they received their graduation caps and gowns, diplomas, yearbooks and senior awards. Warriors’ badminton season winds up ending as it was about to begin Shutdown arrived just before the season-opening meet STAFF REPORT

Willowbrook’s badminton team was just about to begin the 2020 season when the COVID-19 shutdown began at the end of regular classes on Friday, March 13.

The Warriors were supposed to open their competitive season with a March 16 match against Wheaton Warrenville South. The opening week of the season was also supposed to include a quad meet with three other teams at Downers Grove North on March 18.

The Warriors held their first practice of the season on March 2. The team held its last practice on March 12.

“I feel terrible for my team, as many had worked really hard in the off-season leading up to this spring,” said Willowbrook coach Eastman Tiu. “It’s just a shame that an entire season was canceled, but we all understand it had to be done. I feel terrible for our seniors for not having the closure of a final season, and also for our freshmen who had just made the team and were excited for their first competition.”

Willowbrook’s 2020 team included six senior athletes—Chloe Harr (captain), Makenzie Bay, Maddie Brown, Pearl Hosman, Lizzie Romero and Jessica Whiting—along with senior managers Sophia Rizzo and Marie Sabio.

“From a program standpoint, everyone loses a year of development, so this will have lasting effects on our program, but that’s also true across the entire state and country,” said Tiu, who added that all of the program’s underclass players are already looking forward to the 2021 season.

Mariners’ swim season canceled STAFF REPORT

DuPage Swim and Dive Conference won’t conduct its 2020 season

The Villa Park Mariners won’t be swimming in 2020.

The Mariners, who compete in the DuPage Swim and Dive Conference (DSDC), recently learned that the 2020 season has been canceled because of the COVID-19 pandemic.

The conference sent a recent letter to its members announcing the cancellation. The conference made the announcement after a meeting that included its members’ park district executive directors and village recreation directors.

“Collectively, our top concerns are the safety of our patrons and staff, and how to provide aquatic enjoyment this summer without compromising this safety,” the letter stated.

The DSDC letter noted that neither the Illinois Department of Public Health (IDPH) nor Gov. JB Pritzker had given direction on how pools will be impacted this summer. The IDPH and Pritzker have also not provided a timeline as to when to expect the lifting of current pool restrictions.

Last week, the Village of Villa Park announced that Jefferson Pool, the Mariners’ home pool, would not open for the 2020 season because of the pandemic.

“Unfortunately, as we all know, there is nothing socially distant at the swimming pool on a sunny, 80-degree summer day; nor at a swim meet with over 300 swimmers, plus spec-

tators, volunteers and staff,” stated the conference’s letter.

The letter noted that the summer swim season is one of the top highlights for DSDC swimmers, especially those who are celebrating their “senior” seasons—their final seasons in the conference. Many of those senior swimmers—18-year-olds— have been involved with their programs for over a decade.

“After much discussion and deliberation, our agencies are in sad agreement to not host the 2020 DSDC season,” stated the conference’s letter.

“This decision does not come lightly, and we hope the DSDC Board will understand our decision to not host the 2020 season.”

The Mariners were scheduled to open the 2020 season with a home meet against Bartlett on June 6. The Mariners’ regular season was supposed to include 10 regular-season meets, followed by a pair of post-season conference meets on July 18 and July 25.

Villa Park would have been a member of the conference’s fourteam Blue Division in 2020.

Pritzker warns of ‘consequences’ for businesses, counties opening early

On May 13, Gov. JB Pritzker warned business owners and local governments of consequences they will face if they defy his stay-at-home order.

Pritzker said there are no “easy decisions” in a pandemic and said he sympathizes with local elected leaders struggling with difficult choices.

“But what I don’t have sympathy for is those so intent on disregarding science and logic, so afraid to tell their constituents what they may not want to hear—that they put more people’s lives at risk,” the governor said during a virtual news conference from his home in Chicago.

Pritzker has faced pushback from

local officials across the state who are seeking to reopen sectors of their economy earlier than the May 29 date when regions can begin moving to the third phase of his reopening plan.

But, Pritzker said, those leaders were not elected “to do what’s easy,” they were elected “to do what’s right.”

He also warned of consequences for businesses that try to reopen too quickly.

“For the small minority of businesses that choose to ignore the medical doctors and the data, and to ignore your legal obligations to residents of your community, there will be consequences,” he said.

Those include revocation of licenses for those businesses and professionals licensed by the state.

Carthage student-athletes make CCIW Winter All-Academic list The College Conference of Illinois and Wisconsin (CCIW) released their Winter Academic All-Conference honorees, with Carthage College earning 79 selections. Among them was Villa Park resident Meghan Koterba.

Villa Park native graduates from Iowa State Villa Park resident Jacqueline Bliss will graduate with a bachelor of science degree from the College of Agriculture and Life Sciences (CALS). Majoring in Food Science (AGLS), Bliss will join a network of 46,000 CALS alumni sharing their talents and making a difference around the world. Due to the ongoing COVID-19 crisis, spring commencement has moved to a virtual format.

“Counties that try to reopen in defiance may not be reimbursed by FEMA for damages they cause, because they ignored the law,” he said. “Local law enforcement and the Illinois State Police can and will take action. But there is no consequence the state could impose that is greater than the harm that you will do to your own communities.”

It was announced May 13 that the General Assembly would convene a legislative session this week to focus on pandemic response, a state budget and other matters. Pritzker said he respects Republican calls for bills requiring legislative approval to extend his disaster proclamation, but he said all actions thus far are aimed at public health.

“I think everybody understands that what I’ve been doing is following the science and the data and doing what’s best for our economy, given that the virus is out there,” he said. “I want to remind everybody that when people get sick, and when they die, that too has an economic cost aside from the terrible cost to families and communities. There’s also an economic cost to our state when that’s happening, so take that into account when you’re suggesting that we should follow a different path.”

Those at state-run veterans homes face the same precautions as all longterm care facilities in Illinois, he said.

Since March 5, all visitors and staff have been screened before entry into the home, and by March 10 all vendors were barred from visiting facilities and off-campus activities and on-site construction projects were canceled. Family visits were confined to end-of-life visits as well.

He said the state has provided 30,000 tests to 129 facilities around the state. He said the state has also distributed personal protective equipment to all 102 counties, and local health departments distribute it to long-term care facilities.

“Our state and stockpile always provides a backup for them, and is not the primary supplier for private business, such as nursing homes,” he said.

“Having state government fulfill each individual request would not be efficient, or in any way, manageable.”

Still, he said, the Illinois Emergency Management Agency and IDPH have coordinated an effort to directly deliver PPE to more than 1,200 nursing homes and other long-term care facilities across the state.

Those shipments began on April 30 and have reached more than 85 percent of the facilities.

Pritzker also gave an update to the state’s strategy for dealing with spread at long-term care facilities. He also said a resident of the state-run Manteno Veterans Home who had been in hospice for several months recently tested positive for the virus and died.

That facility had 30 residents of 220 and 19 employees of 307 test positive for the virus between April and May, and all residents have been tested recently. All positive residents and others contacted by them have been isolated.

He said one of 153 residents and none of the 219 staff at the LaSalle Veterans’ Home have tested positive; five of 51 residents and none of the 78 staff members at the Anna Veterans Home tested positive, although some staff tests were still pending; and there were no known positive residents or staff at the Illinois Veterans Home at Quincy, although more than 200 residents and 50 staff were awaiting results.

Pritzker said the state is testing residents even at long-term care facilities that do not have positive cases of the virus, as almost half of the state’s 3,792 COVID-19-related deaths can be tied to such facilities.

“IDPH has prioritized testing at long-term care facilities and to our vulnerable populations where infection is more likely to lead higher severity cas-

Memory Care Made to Order at Clarendale of Addison

Bill Liapis was a restauranteur and chef most of his adult life, so when he entered the memory care neighborhood as a resident at Clarendale of Addison, the senior living community tapped into his passion.

Heartfelt CONNECTIONS – A Memory Care Program® is at the core of the community’s approach to care; and it is founded on the belief that the abilities that remain are far more important than what is lost. The program taps into what’s important and personal to individuals with Alzheimer’s and other forms of dementia.

“We simply put Bill back to work,” says Erin K. Klco, Director of Memory Care at Clarendale with a smile. “We enabled him to do what he loves…and our community is better for it.”

According to Klco, “No matter how old we are, we want to continue a fulfilling life. Bill had a successful career— owning restaurants in the Chicago area, including Washington Square and Billy Boys—cooking and baking daily. So as he enters his golden years, we offered him the chance to do that at Clarendale in the memory care neighborhood kitchen.”

The caregiving team at Clarendale supervises as Bill prepares all his favorite recipes; staff and residents enjoy all the delicious results.

The Liapis family is delighted to see their father has regained a sense of purpose again. They note that the retired restauranteur is even revisiting the process of bookkeeping at Clarendale. He has been given receipts to add and fill out paperwork, much like he did in his own restaurants.

he says, “I will always help you, and when I say it’s right, it’s right. If I say it’s wrong, I’m out!”

“Heartfelt CONNECTIONS is truly about connecting on a personal level with individuals facing memory loss— and bringing out the joy and best in them. And with residents like Bill, we get even more in return,” says Klco.

Klco explains, “I met with our Director of Culinary Services and asked him for an old restaurant invoice. I blew up the font, made copies, and laminated it so Bill can continue to use it. The invoices represent a purposeful bookkeeping, cognitive activity for Bill to help out.”

If you stop by Bill’s temporary work desk, you’ll see an adding machine, “PAID” stamp, ledger, highlighter, and pens at-the-ready for a day’s work.
