Each year as I sit down to write this article I always think back and reflect on everything that occurred during the year. Sometimes things change so quickly and dramatically that the significant events get blurry. Each year has its opportunities and challenges, but looking back over this past year, 2023 was a year like no other.

Looking forward on this same short list of significant events, let’s consider what 2024 might bring.

Consider this brief summary of just some of the significant events that impacted all of us.

• Although there is no more talk about future bank failures, those that occurred last year have empowered the regulators to initiate sweeping and dramatic changes we will need to work through in 2024.

• The Federal Reserve continued its rate increases at a historical level, both in speed and magnitude. Fed Funds went from .25% to 5.25% in a little over a year. • This rapid and significant rise in rates was a contributing factor, among several others, in three of the largest bank failures in US history. • Although these banks had an idiosyncratic business model, the news media and many other “talking heads” predicted the downfall of the community banking system. • Our country avoided a much-anticipated debt ceiling crisis in the eleventh hour with a short-term “kick the can down the road” solution. • Inflation continued to be a challenge this year for every American. After peaking at a 40 year high in June 2022, we started a slow march down throughout 2023. • Bank stocks, at no surprise, fell out of favor this year with national indexes falling 20-25% around mid-year. • In addition to the various Speaker elections, we ended 2023 with our past President in court and our current President in an impeachment inquiry. The list could go on and on, but it is a good reminder of how quickly things can change and how resilient the banking industry is at maneuvering through significant challenges. Just as it is important to look back, it is even more important to look forward.

• The Federal Reserve signaled a pause in increases and expectations for three rate reductions this year.

• The 11th hour legislation on the debt ceiling suspended the nation’s borrowing limit only to January 1, 2025. Significant work needs to occur throughout 2024 to avoid another potential crisis. • Inflation will continue its downward slow march throughout 2024 and is expected to drop to around 2.4% at year-end. • The stock market has rebounded nicely, up 15% in the last two months of the year. Expectations for 2024 are higher, and the recession fears for next year are waning. • Politics will occupy the national news through the year with this next election year choosing a President and control of the House and Senate. It is way too early to even predict the outcomes. I used to say that I look forward to a more normal year as we turn the calendar on January 1. However, I now think that the rate of change and the opportunities and challenges that come with it might be the new normal. However 2024 turns out, our industry has proven we are up for any challenge because of the hard working, smart, innovative, dedicated men and women who call themselves BANKERS. I will close by thanking you all for your support, encouragement, and friendship throughout this past year. More importantly, let me wish you all a VERY HAPPY 2024. AGAINST A RISING TIDE of

REGULATION,

Banks Must Row Together Whenever a new election cycle comes along, it’s not uncommon to hear pundits make mention of “red waves” or “blue waves,” denoting potential power swings in Congress. But as bankers contemplate the future of our country and the policy environment that will shape the future of our industry, there’s another wave that we need to talk about: a tsunami of complex regulation that’s hitting the banking sector as we speak. To be sure, the tide turned quickly: last year’s turbulent spring ignited a rulemaking frenzy at the banking agencies. Suddenly, new proposals sprang up to increase bank capital levels, impose a new long-term debt requirement and make the resolution planning process more complex. Simultaneously, the CFPB imposed long-awaited small business reporting requirements under Section 1071 of the Dodd-Frank Act—which went far above and beyond what was outlined in the statute. The Federal Reserve issued a proposal to cap interchange fees under Regulation II, and the FDIC is now pursuing significant changes to its corporate governance guidelines. Against all that, the agencies finalized a long-awaited update to the Community Reinvestment Act framework—a staggeringly complex, 1,500-page final rule that creates significant new requirements that have the potential to fundamentally alter banks’ business strategies.

Meanwhile, in Congress, banks are facing the resurgent threat of the so-called “Credit Card Competition Act,” which would apply Durbin Amendment-like provisions to credit cards—the equivalent of lawmakers taking money from banks and putting it into the cash registers of mega retailers. Taken together, these policies place a tremendous cost and compliance burden on banks of all sizes—at a time when they are already facing a tough operating environment due to a protracted period of high interest rates and ongoing geopolitical tensions. These policies will also have devastating effects for consumers. Banking is, after all, a business—and in order for banks to offer the full range of financial products and ser vices to meet the needs of communities, they need to be profitable, and have an operating environment that supports growth. The current regulatory landscape will do the opposite. Banks that are already considered well-capitalized by regulators’ own admission will be forced to hold even more capital in reserve—which means less capital will be available to lend to the local small business looking to expand, or to the young family looking to buy their first home. Simultaneously, changes to the fee income streams upon which banks have long depended could spell the end of free or low-cost checking products, and popular rewards programs that consumers value.

W h a t ’s p e r h a p s m o s t c on c e r n i n g, however, is the fact that regulators don’t seem to understand the full impact of their actions. As we observed with the Reg II rulemaking and the so-called “Basel III endgame” proposal, regulators are failing to adequately assess the potential costs of the individual regulations on banks and consumers—let alone contemplate what the cumulative impact of all these rules would be. ABA is sounding the alarm. We need to make sure policymakers in Washington— from members of the administration to lawmakers in Congress to the regulators holding the rule-writing pens— understand that regulatory burden has a real-world cost, not just for banks, but for consumers, small businesses and the American economy. The sobering reality for banks right now is that rougher seas are likely ahead— but our best hope is to row together.

Young Bankers Division Annual Scholarship Golf Tournament In a remarkable display of support for education and the development of future leaders, the Young Bankers Division Annual Scholarship Golf Tournament achieved unprecedented success at the Columbia Country Club on October 2, 2023. With a sold-out tournament of 132 golfers and a waiting list, the event showcased the outstanding commitment of the banking community towards fostering educational opportunities in South Carolina. With a sunny, war m atmosphere filled with camaraderie, the tour nament provided an exceptional platform for participants to not only showcase their golfing skills but also network with industry professionals. Bankers, associate members, and friends alike reveled in the fantastic weather, creating great memories together. Beyond the enjoyment experienced on the greens, the event held a much deeper significance. The record number of sponsorships secured for the tournament demonstrated the unwavering dedication of our members to supporting scholarships and nurturing the next generation of leaders.

Avoid Losses from HELOC Fraud Scams Home Equity Line of Credit (HELOC) scams continue to be a costly and challenging issue for financial institutions. Wire transfer fraud can easily reach millions of dollars, and with advancements in technology, such as online databases for county clerk records, online banking and online title searching, data commonly used by financial institutions to verify customer identity for wire transactions is routinely and easily compromised. Several financial institutions have fallen victim to losses arising out of wire transfer and check forgery schemes targeting HELOC accounts and have taken action to mitigate the risk of future loss experience. Institutions that place a high value on their customer service and customer confidence in the institution’s security against wire transfer fraud have implemented risk mitigation upgrades to their operations to help solidify customer confidence. According to Travelers, the following steps are initiatives that can help to avoid, or at least significantly reduce, losses arising out of HELOC fraud scams: • Place greater emphasis on getting full account numbers from callers; • Phrase verification questions so that the caller is providing the information, rather than simply confirming what the financial institution has on file; • Remove items from the list of authentication options (such as mother’s maiden name and date of birth) that have become “public information” through social media websites and venues; • Train employees who field calls to verify authentication items in a specific order and not skip to other items if the caller cannot verify the requested information; • Train personnel with an updated full fraud-awareness module to help employees identify warning signs of fraud; • Encourage customers to set up PIN numbers if the automated phone system allows it; • Update customer account files with driver’s license numbers, if not copies of the entire driver’s license (or other government-issued ID if there is no driver’s license); • Utilize a mandatory callback procedure for all customer-not-present wire transfer requests; • Use a password to authenticate customers rather than commonly compromised information and only allow in-person modification of passwords and key account information; • Consider requiring full balance transfers (or transfers up to a certain percentage of the available funds) to be made in person while placing a reasonable monetary limit (or percentage limit) on customer-not-present wire transfer requests; • Establish a reporting procedure which refers all suspicious wire transfer requests to a higher level of authority for confirmation/processing; • Require a dual telephone confirmation procedure where the financial institution calls the home phone of the customer as well as an alternate number, such as a mobile phone or work phone; • Establish an automatic two-day holding pattern anytime a request is made to initiate a wire transfer from a HELOC account to a foreign bank account within which time the financial institution ensures accurate verification and deters fraudsters seeking immediate processing; • Verify change of address or phone number requests with a call to the customer’s phone number on file; • Customize specific and unique verification questions and procedures with an account holder/customer that can only be modified in-person. • Consider performing a verification call back when a purported customer calls the bank to set up on-line banking for the first time. Technology has made it easier than ever for bad actors to obtain data that is commonly used by financial institutions to verify the identity of their customers. That’s why financial institutions must utilize robust authentication procedures to protect their customers – and themselves – from wire transfer fraud. This includes greater awareness, updated and vigilant policies, procedures and training, and implementing imaginative and unique verification procedures to help reduce the risk of loss arising out of wire transfer fraud targeting HELOC accounts. Young Bankers Division BankPAC Sporting Clays Tournament Government relations play a vital role in the South Carolina Bankers Association’s mission, and the Young Bankers Division has stepped up to actively engage in grassroots initiatives. Since 2019, the Young Bankers Division Board of Directors has taken decisive action by meeting with elected officials across the state, visiting the State House, and organizing a highly successful Sporting Clays Tournament. These efforts not only fostered relationships within the political sphere but also raised funds for the State BankPAC, enabling ongoing advocacy efforts for the banking industry in South Carolina. Recognizing the importance of building relationships with elected officials, the Young Bankers Division embarked on a mission to meet with key figures throughout the state. Each board member embraced the challenge, engaging in insightful discussions and fostering an environment of mutual understanding and collaboration. By establishing personal connections, the Young Bankers positioned themselves as trusted advocates for the banking industry’s interests, ensuring a firm grasp on the evolving legislative landscape. On November 15, 2023, with over 100 Shooters, the annual Sporting Clays Tournament took center stage at the Palmetto Shooting Complex in Edgefield, South Carolina. The event captured the spirit of friendly competition, camaraderie, and a shared commitment to supporting the banking industry. Teams from across the state NOV

participated, ensuring a diverse representation of South Carolina’s banking community. The tournament served as a significant fundraiser for the State BankPAC, a crucial resource for advocating for the banking industry’s goals and supporting legislators who champion pro-business policies. The generous contributions from participants and sponsors during the Sporting Clays Tournament amounted to an impressive sum of nearly $30,000, empowering the State BankPAC to make meaningful contributions to legislators who prioritize the banking industry’s interests. Supporting candidates that support banking also provides the SCBA staff and bankers with the invaluable opportunity for direct contact with legislators. This faceto-face interaction facilitates open dialogue, ensuring our industry’s concerns and priorities are effectively communicated and understood by key decision-makers. By maintaining direct lines of communication, the banking community continues to shape policies and regulations that promote a conducive environment for growth and innovation. This donation will assist with general expenses related to food deliveries to low-income residents throughout Williamsburg and Florence counties. CMD’s Pantry is a non-profit organization established in 2019 and is run by the Driffin family.
