I’ve been told its my job to be completely enthusiastic about the Real Estate market here locally and perhaps it’s a character flaw of mine to continually look for data to support my position BUT, I’ll say it once again... It’s an unbelievable time to be acquiring property right NOW! The year to date snap shot above is raw proof with year over year highlights including an area like the exclusive Rolling Hills with a Price Per Foot increase in value of over 10%, an 18% total increase of the number of homes sold in the Rancho Palos Verdes West section, and 14.7% total increase of homes sold in our market! Double digit gains is overwhelming support that the trajectory of our Real Estate market is not called recovery any longer - it’s now referred to as strong GROWTH. Having said that, there are certainly areas of slight disappointment too however there’s no question the turn around point is in the works when we look at reports within the past few months (see prior South Bay Digs issues). In any case, August is here and it’s very soon we’ll see another seasonal increase of inventory so I’m truly looking forward to end of year 2012 report and another excuse to for me to be EXCITED about our Real Estate market!

The Point Vicente lighthouse is located in Rancho Palos Verdes on the outcropping of land with the same name. Capt. George Vancouver, the English explorer, originally named the area Point Vincente in 1790 after the Friar of Mission Buenaventura. The name was changed to Point Vicente in 1933. In 1916, the United States Congress approved the construction of a lighthouse at Point Vicente. Frank Vanderlip, Sr., who had acquired the entire Palos Verdes Peninsula in 1913, fought vigorously against this project, as he had planned to construct an artisan’s village at this location, modeled after an Italian seaside village named Neri. This fight lasted 5 years, and after the government threatened eminent domain action, the Federal government acquired the 8 acre site from Mr. Vanderlip.

the handcrafted five-foot lens. The cylindrical tower is 67 feet tall, and the masonry structure is built on the edge of a 130-foot cliff. This places the center of the lantern 185 feet above the ocean, and because of this elevation, the beam can be seen twenty miles away. For years, there have been rumors that the lighthouse is haunted. After World War II, nearby residents complained about the bright flashes from the lighthouse, and the landward side of the lantern room was painted an opaque, pearly white. The light from the rotating lens seen through the opaque tower room windows created, for some, the illusion of a woman pacing the tower’s walkway and gave rise to Point Vicente’s “Lady of the Light,” yet another lighthouse ghost story. Some said the ghost was the spirit of a woman who leaped into the sea when her lover was lost in a shipwreck off the point. In 1955, a thicker coat of paint ended the spirit’s nightly romp around the tower, and the ghost has not been seen officially since. Anton Trittinger was the lighthouse keeper for 15 years from 1930 to 1945. The U.S. Coast Guard took over operation of the lighthouse from the U.S. Lighthouse Service in 1939. Mr.

Trittinger and his family were responsible for lushly landscaping the grounds. The lighthouse has been automated since 1971. The Point Vicente Lighthouse is open for tours on the second Saturday of each month, except for the month of March when it is opened on the first Saturday in conjunction with the City of Rancho Palos Verdes’ Whale of a Day Festival.

T H E A R T O F N E G OT I AT I O N S In the last edition of DIGS, I examined Part 1 in my series on negotiations in real estate transactions, and as promised I will now examine further the art of negotiation as we explore the “repair request” process of a typical real estate sale. So, let’s say you just wrote a million-dollar offer on your dream home. If you are buying in Southern California, certainly in Manhattan Beach and surrounding cities, you may have just bought a “post war” starter home with design choices from 1972. I am not saying that is bad thing but today’s styles have slightly changed from those of my childhood years. 3” green shag carpet is cool, but can be a challenge to get your spouse to agree to. The first step in a home purchase is doing proper due diligence before removing the “inspection contingency” that is likely written into your real estate purchase contract. This means hiring a professional inspector and/or contractor(s) to determine the condition of the property you are about to buy. Once you are presented with the inspection report, you have to determine what to do about it. This is the turning point; do you still go ahead with the purchase, do you ask the seller to fix the issues reported, do you ask the seller to give you a credit for repairs, or do you buy the home and fix it the way you want? There are a lot of misunderstandings when it comes to negotiating repair items in real estate transactions. Sellers prefer to sell their homes in “as-is” condition, while buyers expect the home to be perfect. Try mixing oil and water and you have a recipe for a complete mess. What should buyers realistically expect and what should sellers be prepared to fix? The fact is the answer changes in every single transaction and it is affected by the economy, the real estate market, as well as the motivation of each party in the transaction. There is not an absolute right answer, however there are contractual rights given to each party to protect their downside risks. In a standard California real estate purchase contract, it states that the seller has no obligation to make any repairs that are not specifically asked for in the purchase contract. At the same time, the buyer has the right to withdraw if they find something adverse with the property and the seller is unwilling or unable to correct it. Whether I am representing a buyer or seller, I offer this advice on deciding what to agree to. If you are seller and a buyer asks you to correct a safety condition or code violation, it would make sense to agree to fix this issue. The reason behind this is if the buyer does not purchase the home and you decide to live there or rent it out, it would be wise to correct the condition for your own safety. If the buyer is asking for a cosmetic condition to be corrected

(for example, stained carpet or paint touch up), most sellers rarely agree to give in to the buyer on those requests. Sellers believe the buyer likely saw these issues prior to making their offer and should have taken these concerns into consideration when they made their offer. How about a roof? What if your inspector says it is in bad shape and should be replaced. There are no signs of it leaking but the roofer says it may not make it through the next rainy season. Who should pay for it? As a buyer who is about to plunk down a million dollars you certainly feel entitled to a decent roof. However, it is highly possible the seller is not feeling the same way. Sellers are not always as enamored with the fact that a buyer is spending a million dollars. Imagine the seller who bought their home in 2006, paid $1,200,000 for it, put 10% down and now is selling for $1,000,000. The fact is that they are writing a check to sell their home. Based on this scenario, the thought of giving the buyer additional money to fix anything is about as likely as giving up the couple’s first born child. Certainly not all sellers are in that position, but most take on a similar attitude when selling. A reasonable and common negotiation in these cases would be for the buyer and seller to split the cost. A seller didn’t price their home as “brand new” and the buyer does expect the roof to have some life expectancy; the split of the cost often can solve the stalemate.

“Mr. Seller fix my roof, I just gave you a Million Dollars!” “Sorry Mr. Buyer, buy somewhere else, I don’t need your Million Dollars.” The bottom line is that every situation is different and is based on buyer and seller motivation, market conditions and how the original negotiations started. Sellers should remember that buyers expect the home to be in safe condition, they are spending their life savings and are a bit nervous about doing so. Buyers should remember that sellers don’t see all of the money you are paying, they are not selling a brand new home and buyers do have to assume some responsibility when buying real estate. When you buy a home, even a brand new home, there will be a list of endless things that could go wrong, break and need maintenance. In all cases, consult with your realtor, a lawyer and or your contractor to determine the best path for you in your negotiation.

While spectators waited for the paddlers to finish the long race, a volleyball tournament was held to keep their attention. This evolved into the Manhattan Open. “The race hasn’t changed much since 1955,” says Kyle Daniels, Catalina Classic Board Member. “The boards have changed a little bit, but it’s a race based largely on tradition. We’re the oldest ongoing paddleboard race in the world, and for a lot of us in the surfing community, it’s kind of a rite of passage.
