I’ve been told its my job to be completely enthusiastic about the Real Estate market here locally and perhaps it’s a character flaw of mine to continually look for data to support my position BUT, I’ll say it once again... It’s an unbelievable time to be acquiring property right NOW! The year to date snap shot above is raw proof with year over year highlights including an area like the exclusive Rolling Hills with a Price Per Foot increase in value of over 10%, an 18% total increase of the number of homes sold in the Rancho Palos Verdes West section, and 14.7% total increase of homes sold in our market! Double digit gains is overwhelming support that the trajectory of our Real Estate market is not called recovery any longer - it’s now referred to as strong GROWTH. Having said that, there are certainly areas of slight disappointment too however there’s no question the turn around point is in the works when we look at reports within the past few months (see prior South Bay Digs issues). In any case, August is here and it’s very soon we’ll see another seasonal increase of inventory so I’m truly looking forward to end of year 2012 report and another excuse to for me to be EXCITED about our Real Estate market!

Two new railroads competed to build the dominant port for the Los Angeles area. The Sante Fe Railroad constructed a wharf in Redondo Beach, which shipped a considerable amount of lumber from there. On April 13, 1892, the Dominguez heirs sold Rattlesnake Island in San Pedro to a competing railroad, the Los Angeles and Terminal Island Railroad Company. In 1891, a survey had been commissioned as to a recommendation for the location for continued funding and construction of a deep water port for Southern California. This survey had recommended San Pedro as the desired location for the port. Collis P. Huntington, who now headed up the Southern Pacific Railroad, had become annoyed by the competition of the Los Angeles and Terminal Island Railroad, as well as the Sante Fe Railroad in Redondo Beach, so began a vigorous lobbying campaign to designate Santa Monica Bay for harbor development, since the Southern Pacific Railroad completely controlled this option. By 1893, Southern Pacific’s railroad extension and wharf in Santa Monica were in full operation.

White pushed for federal support of the Port of Los Angeles at San Pedro Bay. The matter was settled when San Pedro was endorsed in 1897 by a commission headed by Rear Admiral John C. Walker. Finally in 1898, San Pedro was selected for the port improvements appropriation, and construction began on the new Federal breakwater project in San Pedro. This intense congressional battle was dubbed the “battle for a free port”, because it was feared that with the Southern Pacific’s monopoly of the Santa Monica port, there would be no competition at the new port. Construction of the breakwater began in 1899, with the first section completed in 1912. In 1906 the City of Los Angeles purchased a long narrow strip of land, a half-mile wide from Slauson Avenue, connecting the city to the cities of San Pedro and Wilmington (now known as the “Harbor Gateway” community). And in 1909, the city annexed San Pedro and the adjacent town of Wilmington. The odd shape is still seen in the map of the city. In 1888, the War Department took control of a tract of land next to the bay, and added to it in 1897 and 1910. This became Fort MacArthur in 1914, and was a coastal defense site

for many years, which also included a Nike missile site in the White Point area. In 1978, the Secretary of the Interior transferred ownership of the White Point U.S. naval reservation to the City of Los Angeles to be used for recreational purposes.

N E G OT I AT I O N S : D O T H E Y E V E R E N D ? Whether you are a buyer or a seller, contract negotiations don’t seem to stop when the original offer is accepted. No doubt that sellers hope the negotiations are over; buyers on the other hand are always rethinking their decision. So what should you expect after you completed what sometimes can be a tough battle in the beginning? There are numerous items that still need to be discussed and agreed upon. The most common are inspection findings. The other one that seems to come up a lot lately are the already agreed upon contingency removal dates. California real estate contracts have a standard 17 days pre-written into the contract form for the 3 major contingencies: inspection, loan approval and appraisal. However, the buyer or seller may adjust those dates by mutual agreement. Assuming everyone agreed that 17 days is the allotted time for the buyer to get their loan approval and day 17 has just arrived, what happens next?

Sellers are left with the decision to allow the buyer more time or demand that they remove the contingency. The risk in that is if you ask a buyer to remove their loan contingency prior to them getting approval there is a good chance the buyer will be forced to cancel the contract so they can protect their deposit. If you are a seller that is OK with starting over -- try find another buyer to pay your price, accept the home in the current condition, etc.-- then perhaps you are comfortable taking that risk.

Per the terms of the contract, the buyer is supposed to remove that contingency in writing, it is not automatically removed. If the buyer does not remove the contingency, the seller has the legal right to issue what is called a “Notice to Perform” which basically tells a buyer that he must remove his loan contingency and if he doesn’t, then the seller is given the right to cancel the transaction without recourse. Herein lies the big question: if you are a seller and you arrive on day 17 should you automatically force the buyer to remove their contingency? The answer is: maybe.

Many sellers don’t want to start the process over and deal with more showings and a possible lower price. In addition, the clock starts over again requiring a change in the seller’s own plans. Many sellers today are granting more time to the buyers. It is extremely important however to make sure that the agent representing the buyer is doing what they can to educate the buyer on being timely with their lender in submitting required paperwork. Equally important is verifying with the buyers’ lender that the process is moving along at the normal pace. There are a lot of great lenders, and then there are some that are less than capable that can drag the process for weeks on end. Know which one you are dealing with prior to making these decisions. Be reasonable with your buyers if you are a seller but do insist on timely actions.

The fact is interest rates are at historic lows and just can’t keep up with the pace of loan requests. They are not issuing loan approvals as fast as everyone would like to see. If a buyer doesn’t have loan approval and they are not 100% confident the bank will approve it then they must risk their initial deposit. A buyer who removes their contingency loses their right to cancel the contract and protect

Gidget was based on a real life surfer girl in Malibu, at a time when surfing was considered a “boys only” sport. This didn’t resonate much with Donna D’Amico in 1960, as a young girl in the South Bay who wanted to surf.
