DEMOCRATIC RIGHTS, INDEPENDENT JUDICIARY, FREE PRESS Many Australians take for granted hard won democratic and human rights. These rights include secret ballot, voting rights for all adult men and women whether they own property or not, an independent judicial system making available trial by a jury composed of peers, 8 hour days of labour, various work place safety conditions and prompt payment, some accountability of people’s behaviour in public office including police, magistrates, bureaucrats and governors. Australians have come to expect exclusion of brutality, autocrats, tyrants and dictators abusing powers and privileged positions, freedom from slavery, child labour, oppression of minority frightened people. ‘The people’ must not be lulled into complacency that these processes of fairness and equity remain in place and maintain a vigilance that hard won democratic rights are kept even in nations like Australia coming from one of the most brutal beginnings to one of the world leaders in social and democratic reform. The ‘mongrel gene’ however persists in society only suppressed from full expression by processes put in place such as democratic elections, free press and independent judiciary. Manipulators use unscrupulous people or wild animals to do their bidding. This may be a story for another time.

Where in British society did the infusion of the mongrel gene come from? Certain people in society require constant supervision to ensure they act to accepted standards including those in public office. Taking advantage of attention directed elsewhere, will be described as out of step having a mongrel gene. So where could this have come from.

Roman or other conquests where up to 10,000 conquered people were fed to wild animals each festival as public entertainment at the colosseum with seating provision for 45,000 or more? Football seems a reasonable substitute and advancement. People who thought of and undertook feeding routinely 10, 000 people to lions, tigers etc as public entertainment must have been brutal. Those in todays society capable of such brutality, but not given the opportunity because of the checks and balances put in place in government (democracy, free press & independent judiciary), can be described as having the latent mongrel gene serviced in more subtle ways than feeding people to the lions literally.

For sections of British society using wild animals or thugs to deliver power and control in a cowardly anonymous manner, may persist. The lion symbol of regal confidence can have some other interpretations over history. Does the lion symbol have its origins in Roman times? A not so gentle reminder to constituents.

BRIEF HISTORY OF DEVELOPING AUSTRALIAN SOCIAL ETHICS To recount the story of Vinegar Hill (Castle Hill uprising 1804 ) and Eureka Stockade just 50 years later in 1854 are historically timeless reminders of what most people consider demands by ‘the people’ for standards of decency and respect for fellow humans. The three ringed circus between democratic government, judiciary and free press are review checks and balanced standards demanding good behaviour of those assuming the responsibility of leadership roles. Each has important responsibilities to ‘the people’ and ‘the people’ have responsibility to review processes work independently, uncompromised and fearlessly.

Just a recap on Vinegar Hill, is a convict uprising many school children are saved from learning about in official Australian history. 17881868 Australia was a dumping ground for Britain’s excess convicts. About 162 000 were transported for 7 year, 14years or life. This is the only known drawing of the Battle of Vinegar Hill. It is intended to be read clockwise from the center. Up the top at the center Father Dixon is asking the rebels to surrender. On the far right a rebel is saying, "Death or Liberty Major". Major George Johnston replies, "You scoundrel. I'll liberate you!". The next captions are Trooper Azlenark and William Johnston. To the left is Quartermaster Laycock slicing Phillip Cunningham with a sword. Many were displaced Irish excess to British aristocracies requirements, 84% were convicted of petty theft mostly food, clothing, women commonly of ‘horse theft’ galloping away from cruel employment, masters and their unwanted advances or what is referred to today as work place harassment. The irony was convict women were then declared the depths of social and moral depravity for not coming across, perhaps a sexual fancy of contemporary historians and record keepers of the time, the literate few. First fleet convict women for example were aged between 13 and 82, hardly fitting a stereotype of buxom wenches causing riots of seduction when disembarking on the 6th of February 1788 Australia day for women, finally taken off their oppressive prison hulks after 10 months of seasickness and stale inadequate rations. This was 10 days after the male convicts disembarked on 26th January. Survival of squalor was something to celebrate.

Phillip even commented “ex-convicts shrink during their time such they do not make suitable farmers after release.” Disease, poverty and famine were never far away, which slowed the progress in building a settlement, stores, water supplies, farms, fencing, etc. In practice most convicts were transported for life, no return passage was offered for those doing their time, British, budget banishment. Most would only have returned to repression, poverty and famine worse than available in Australia where repression and displacement was offered to Celtic people, the landless and Aboriginal people. Bureaucrats with the top end of town clustered around their creature comforts in urban centres leaving a lot of Australia, for the not so “well bred” and well fed, to retreat out of bureaucrats reach and glare. “Vinegar Hill” was the password for the mostly Irish convict uprising in 1804 where “death or liberty” was the adopted catch cry for a mass breakout and a boat back to civilisation. The Vinegar Hill was reference to the unfinished business of Vinegar Hill in Ireland in 1798 where the British massacred basically unarmed Irish farmers yet again over matters of exorbitant rentals for farm land. The protest that sparked the Castle Hill uprising and riot was the liberal way in which brutal floggings were being issued and carried out by certain red coats in the Sydney penal colony of 1804. Corruption was rife in the military, where rum was currency of the time. Substance abuse and all the associated behavioural changes romped through the ranks of policing and magistrate system more feral than that in Britain of the time. Convicts had no rights of humane treatment. Petitions to British government signed by almost the entire Sydney colony for social rights were ignored, Magistrates, drunken at their work, were accountable to no one sentencing prisoners to be hanged. Hanging to 1822 was more of a slow strangulation and asphyxiation by rope, a most inhumane and agonising dispatch for those wretched victims of hunger, deprivation, social injustice, illiterate, born of lower social classes, denied advancement on merit. Death viewed by many as a kind exit, from a cruel world. Irish convicts took control of their Castle Hill compound, pursued floggers and red coat vermin overcome to declare an independent republic in Australia for several days until Sam Marsden, “the flogging parson” rode into the night to raise the alarm for reinforcements to shoot poorly armed convicts and hang the ring leaders without trial for daring to challenge the issuing and interpretation of floggings which were often lethal from shock, blood loss, infection and debilitation.

Women convicts were spared public floggings and instead offered marriage to partners outside their own choosing. In some cases a lifetime of tyranny, violence and risks of the day associated with childbirth considered sufficient punishment. The same “Flogging Parson”, riding for military intervention at Vinegar Hill, was known to urge on the floggers to “excise the devil” in the victim, his interpretation of Christian teachings. Hand picked parson for a penal colony engendering social reform leading by example, he was also known for his “1 hour arrangements for marriages” where the British government was relieved of responsibility to find keep for convict women in the women’s factory and the married woman then became the responsibility of the husband for keep. Marriage considered the only entry path to “decency in society” for women then raised a new labour force (currency lads and lassies), being convict women’s only considered worth. Women were not allowed to acquire or own property unless through marriage. And so it was Vinegar Hill uprising was quashed, ring leaders hanged, flogged and the 600 Irish convict patriots and social reformers dispersed to the hell of Norfolk island or Tasmania winding up brutality and oppression more notches on the thumbscrews. Sydney used as destination suitably for mostly clumsy London pick pockets. (Some things never change.) Port Arthur and Sarah Island in Tasmania were reputed to be so bad even soldiers were reluctant to serve there. Vast cemeteries testify to some of the carnage. Norfolk island also a hell hole in paradise. Before Port Arthur was finally closed down it was occupied mostly by mental health basket cases born or manufactured by brutality. EUREKA GOLD - TURNING POINT IN SELF GOVERNMENT Eureka stockade on the Victorian Ballarat diggings was perhaps the first emergence of modern Australia to come under international scrutiny about what was going on here socially. Sydney was the original settlement of New South Wales, then Tasmania seeking some level of local government autonomy from NSW and direct orders from Britain. Victoria 1848 decided to separate from NSW and the Sydney centric government by the Governor and the local Sydney landed gentry as the Governors advisors. Like the issues bringing on the American war of Independence, taxes paid and decided in Sydney rarely returned to Port Phillip settlement, later known as Melbourne. What attitude has changed since, for the rest of NSW pouring assets into the Sydney basin black hole? Warragamba dam today has not overflowed in decades due to massive water extraction! Wild rivers with environmental flows are demanded elsewhere to manipulate water access to others. Gold in 1851 was discovered around California in America attracting people from all over the world, including Australian free settlers, labourers, emancipated convicts, currency children, all looking to free themselves of bondage and servitude from a fairly static high society making the rules to maintain their finances and status. In haste, gold was officially discovered in Australia near Bathurst, then near Melbourne, coincidently mainly by government men wanting to stem the losses of the colony labour. Legislation was quickly passed through the formative stages of Australian state governments declaring some independence from Britain in 1852, except where any gold found was ruled to “belong to the crown” and shipped back to London.

Employing 100,000 workers building a transport network across a continent of the same size as America or Europe but by 1911 had a population of 4.4M people Europeans and about 60,000 Aboriginal that were not accounted for in census. Changing trains because of all the different rail gauge lines were inconvenient for passengers and livestock, costly for goods and time of war reflecting engineering lacked vision. State governments were fiercely competitive and jealously parochial. Their railways went to their ports and no one was thinking one network national servicing only isolated sheep or telegraph stations, trafficking in white elephants and paying massive interest bills to London money lenders for decades. Exchanging entire wool clips for value adding British textile industries and Australian export produce acquired on interest rates. Independence of Government a nominal affair in reality. Migrant British bureaucrats and academics parachuted into strategic positions remained loyal to the home country paid by the Australian people, also funding frequent trade missions back to see the family. Restive trade union people sent out to sabotage local manufacturing competitiveness. GOLD RUSH GOVERNMENT QUICK TO CLAIM CROWNS GOLD By comparison of gold ownership being legislated for in a matter of an urgent reconvened meeting of the Legislative Council, Australian government of today is not so fast off the mark with ownership of minerals and fossil fuels found under farmland or in backyards, nothing to do with the establishment. Eureka had a good business deal happening were troopers, brutalised and graduating from the penal colony of Tasmania were recruited to the gold fields of Victoria to oversee issuing and policing of diggers licences to look for the crowns gold. The local magistrate issued the licences and oversaw any fines arising from people found on the diggings without licences. A very lucrative funding stream was made difficult to account for back to government by diligent troopers and magistrates slicing the cash cake, perhaps keeping several account ledgers. Licences were issued on flimsy paper which had to be carried by diggers at all times up and down ladders while working in mud and water. Troopers could ride onto the diggings at any time and demand to see current licences. There were no other records but the flimsy paper carried in the pockets of diggers as to whether they were currently licensed monthly, yearly, weekly to work their claim. The local publican was friends with the troopers and magistrate who issued diggers licences for those hopefuls looking to strike it rich through self employment and enterprise, he also imposed the fines for failing to produce a license. Gold passed across the hotel bar may lead to hearing vital information plied with alcohol of the quality to suit transient diggers rushing to new fields. As luck would have it the newly independent Victorian government had a massive debt to retrieve through incompetence and squander of its upper echelons if not chronic isolation from the Sydney based government 1835-1848. The Victorian Government was looking to exorbitant diggers licences to retrieve their debt. All to familiar scenario not unknown in current times. Official theft or incompetence or both left unaccountable. Farmers lost their employees to the diggings, sailors jumped ship, telegraph workers walked out. Soldiers from Europe’s wars and revolutions headed for Australia or California or both to try their luck for easy gold and relief from servitude. American black slaves, Irish blacksmiths, Irish engineers, decorated Prussian soldiers, Italian aristocrats on a world adventure all became diggers and equals on the diggings. Unified by their occupation and dislike of the trooper’s obstructions, interventions, impositions assuming freemen were criminals if they could not produce a license. Diggers found without current licences were treated like criminals put in chains left in the sun while others were gathered and collected, marched off to the lock up for in depth interview and fines issued and be heard by the magistrate licence issuer. No attempts at even veiled independent assessment and declaration of a conflict of interest. An invalid and Irish priest were arrested for being on the diggings as visitors when they could not produce a licence to work a claim when asked by bully brutal troopers. A digger going to the pub for a few too many drinks with a long lost friend had been murdered by what witnesses believed to be the publican, triggered the burning down of the pub when the publican was acquitted of the murder charges by his friend the magistrate on grounds of “insufficient evidence.” Testimony corroborated across several witnesses was dismissed by the magistrate. While this sort of behaviour was routine for early colonial days, the influx of freemen and international visitors with cosmopolitan backgrounds were less tolerant of the inequity, brutality and abuses issued by privileged people in positions of power and authority.

Stockadists were also currently negotiating with government figures, diggers rights for return of value for their licences of better facilities than un-serviced tent cities, no roads, no protection, easy gold was running out and the families suffering trying to buy food and supplies shadowed by the exorbitant unrealistic licence fees demanded by indolent fat controllers. A stockade was built around part of the diggings in order to exclude troopers from turning up unannounced as frequently as they wished haul diggers up ladders and interrupt their work on a whim and harassment. Simple pit props assembled to form a rough compound and raise a Prussian Blue flag with the Southern Cross bearing witness to calls for matters of principle, decency and consideration.

Among the diggers were people from Britain calling themselves chartists having submitted various requests for equality in democracy, voting rights for the working classes, 8 hour working days, 6 day week, timely and fair pay, access to property, political and legal representation. These calls were well received among the Australian population whose families were enduring torrid treatment emerging from the dark ages of convict settlement. Virtual lawlessness of authorities and humanitarians were a rare minority, Governors Phillip and Macquarie were exceptional among a variable run of ship captains made governors of the colony to finish off their careers. Convict labour appeared to be a cheap labour force legal loophole in lieu of slavery banned in Britain in 1807 and lingering on in America until 1865 civil war between the north and south. Southern plantations of tobacco, cotton, sugar had not yet mechanised and industrialised. Britain sent convicts to Western Australia delaying granting of self government to 1868 where convicts to the eastern states were sent until the late 1840s. The people becoming enslaved instead to bankers and money lenders for inflated land prices, consumerist gadgets and housing standards set beyond the capacity of family incomes. Convicts moved through their sentences before the granting in 1852 by an Act of British Parliament a constitutional self government to South Australia, Tasmania, NSW and Victoria at the demands of emancipist, statesman, journalist, humanitarian, explorer, farmer, barrister and son of a convict mother and a controversial ships surgeon father looking like a notorious highwayman of the time, colourful character none other than William Charles Wentworth the first. Wentworth was not afraid to stand the part of convicts rights, demand freedom of the press, demand the governor treat all his constituents with respect, holding a farewell party for Governor Darling and not inviting him, over a matter of putting a soldier in chains such he died an inhumane death “to be made an example of” after a prank went astray among other issues of controversy and bad character. Wentworth was fearless and dogged in his demands for civilised and lawful behaviour among what he referred to as the “exclusives” self service, attitude “the public serve us.” The military and free settlers gave themselves privileges, land grants, and contracts insider trading when daring to judge ex-convicts as not being allowed to better themselves after release, and/or on ticket of leave. Ticket of leave a cunning way convicts could enjoy early release to work off the rest of their sentence at no cost to the British government for keep and control assigned to a master to clear his sheep station to produce wool for the British textile industry, etc. Kindle the status of good breeding. William also married a convict girl and raised a dynasty of fair minded educated gentry with political clout and respect earned across all classes. He lived his convictions and principles that many convicts were more decent people than those that administered their suffering. Vinegar Hill, Eureka Stockadists, Wentworth statesman, journalist, barrister, emancipist one who stuck out for a dual house of parliament, constitutional government elected by the people, trial by jury, freedom of the press has set the extraordinary social framework for Australia. Something not to be forgotten or taken for granted, allowed to be watered down, the battlers who came from behind and down under.

The outcomes for Eureka stockade massacre were more lasting social advances than achieved by the two Vinegar Hills not without their messages. Trial by jury of stockadists with public opinion saw 13 ring leaders acquitted of treason charges and some subsequently becoming founding members of the Victorian parliament were reform was backed by legislation even if ever so slowly. People of Asian decent were marginalised on and off the diggings. Chinese were coming from as early as the 1400s to Australia regularly for sea slugs and other purposes. The white Australian policy persisted to 1973. Aboriginal people serving in the military could vote in the 1940s others if they were on the electoral role by 1960s. Bob Carr said he would speed up the court system in NSW dispensing with trial by jury for various “routine cases.” Neville Wran QC and Bob Carr his environmental minister made a lifestyle of buying votes with rural communities confiscated well managed leasehold land converted to pristine wilderness and national parks to go to the dogs and incinerate. Victorian labour party followed suit with the successful formula. It is with mixed feelings families with convict origins view the call for convict settlements to be declared world heritage sites when they were symbols of suffering and horror for so many. Injustice, inequality, slavery, displacement, misrepresentation, abuse of the hungry, unemployed, mentally ill, political patriots, social reformers… the list goes on. In many wars and campaigns since, the lowly stock sent to Australia has headed to France, Gallipoli, Sudan, Boer war, India provided self sufficient men and women, their stock horses to fight selflessly to the last for human rights and democratic principles and has been more than once dealt more blows from the mongrel genes using them as naïve colonial canon fodder. While many Australian’s respect the crown, the Commonwealth of Nations, have some allegiances, they struggle with the monarchy’s 352 year old agreement with the Royal Charter for scientists funded by the government for the government’s advice. Hardly independent or peer reviewed when professors are sent to judge students or vice versa across the invisible college as scientists come to the rescue of their funding body on demand, inconvenient science has been starved of funds, isolated, marginalised, disrespectfully personally degraded, attacked by controlled media and stacked committees. The Australian Conservation Society was initiated in 1963-66 by Prince Phillip from all reports with good intent but lacking in astute consultative skills to tailor make environmental salvation for Australia’s climate and vegetation requirement.

Various boffins with little expertise opinionated and influential outside their fields of experience or expertise, in their ACF membership to by pass processes of democracy to set up world heritage areas burnt with unprecedented fuel loads causing mass extinction of cherished Australian biodiversity as if by accident 2002-09. Abuse of parliamentary privilege to deliver unsubstantiated opinions, angle for future research funding streams, wordsmith deception and deliberate omission to maintain convenient controversy dismissive of anecdotal information from sources of “vested interest” in local rural communities predictably concerned for depreciation of national, family, and local assets. Accusations of “vested interest” set to disarm hard working honest law abiding people. Tony Burke, the current Environment Minister in the Australian Federal Parliament, wishes State and Local Governments over ruled on the alps national heritage listed wrapped in plastic and rice straw faining concern for the area locked up to repeatedly cremate as if by accident with maximal fuel in the driest climate and most flammable vegetation in the world. No evidence when evidence is obstructed from collection via “official credentialed channels.” Individual scientists are bullied and isolated by those calling themselves independent environmental lobbyists with public funded positions, tourist operators, water barons, ski enthusiasts but definitely not seeing themselves or allowing the public to see them as “vested interests.” UNESCO being approached to take the cinders of the Australian alps in as a World Heritage Site likely under a continuation of the abuses of the last 67 years or more, confiscated from local communities in 1944 when farmers, stockmen black, white and brindle were away at war fighting selflessly for mother England to the last man, woman, horse, bale of wool and quid and the mongrel gene that has plagued humanity for thousands of generations.

Rural Australia at least finding a truce with their country and Aboriginal people in a healing mode after a rotten beginning wrapping the Celtic cross in the Aboriginal flag embracing dislocated people from across the world to become dedicated Australians by performance not race, religion or background. Australian government has an over supply of the mongrel gene persisting in the ranks proliferating in dark corners where cockroaches hide in stacked orchestrated expert hand picked committees advising Ministers with select portfolios to ensure singleness of purpose and facilitate the passage of strategic legislation to have the Australian people conform and fund treason, signing away sovereign rights to national, public and private assets. Three levels of government to keep in disarray a scattering of people of which 89% live comfortably in debt to the plastic card for their big house and expensive land within 50 kilometres of the beach. Working for bureaucracy is the zenith of employment opportunity which brings compliance to most families enjoying a comfortable life in the bank’s house on public salaries with the dream of one day paying it off with the boat, beach house, lifestyle investment block in the country, hope of a hobby job managing a national park on city wages in the country, some confiscated farm well managed beauty spot with a view and profile. Kudos of world heritage notoriety, international travel servicing the reputation biodiversity still exist, old photos to prove it. Biodiversity saved from local community forestry, farming, fishing activities working different rules doing what government says, not what government does or acknowledges.

Freedom was abundant as the nation flourished, government PROVIDED service to the people, employment was abundant, world leading rural industry of primary producers, a nation of industry now all but gone, you could be proud of your Australia. How did we lose control allowing unaccountable political party gangsters erode our lifestyle determine our destiny?
