Businesses to be held liable for allowing patrons to smoke BY KEVIN HERRERA I Daily Press Staff Writer CITY HALL Promising to invest in a marketing and education campaign that emphasizes the positives of being smoke-free, the City Council on Tuesday directed attorneys to draft a law that would make business owners and their employees liable for knowingly or intentionally allowing customers to smoke in outdoor dining areas. smoking ban was in response to complaints from residents and non-smoking advocates that some restaurants and bars were allowing customers to light up nearly a year after the ban went into effect, some going so far as to set out ashtrays. Smoking is currently prohibited at all beaches and parks; the Santa Monica Pier, except in designated areas; within 20 feet of the entrance or window to an open business; the Third Street Promenade; all Farmers’ Markets and all outdoor dining areas and waiting areas like bus stops and ATM lines. “The important thing here is that this is to protect the people,” Councilman Kevin McKeown said. “This is not a new direction. This is an ordinance we’ve already passed and that was to make it safe for people to eat at a restaurant.” The council will have the option of setting the fine for

non-compliance. It was suggested by staff to make the fine $250 — the same charged to smokers who are cited for smoking in areas covered by the ban. However, some councilmembers learned that a $250 fine could grow to nearly $900 because of penalties assessed by the courts, and suggested a lower amount for the first offense. “I think the fines should be more commensurate,” Councilman Ken Genser said. “The fine struck me as fairly high for the offense.” Several representatives from the business community said they are in favor of protecting the public from the SEE SMOKING PAGE 10
