City Hall still fighting Embassy court decision

CITY HALL Santa Monica officials are challenging an appellate court decision issued last month that could mean the loss of 19 rent-controlled apartment units at the Embassy Hotel Apartments, a residential building in the Wilmont neighborhood near Downtown.

A state appellate court on June 14 said the property owner, Embassy LLC, is allowed to take the units off the rental market, despite

having signed a settlement agreement in 2000 that required 19 of the building’s 38 units to be operated as rent-controlled dwellings. The other 19 units were permitted to be rented out as hotel rooms under the settlement, which resolved a prior land use and tax dispute with City Hall.

City Hall lawyers on June 28 filed a motion asking the court to reconsider the case, arguing the decision by a three-judge panel from the Second District, Division Five Court of Appeals was “erroneous” because it was based on the “omission of issues and

facts and mistakes of law and fact.”

The court is expected to rule on the motion within two weeks. If it rejects the motion, the last remaining option for City Hall would be to ask the California Supreme Court to rule on the case.

At issue in the case is whether the 2000 settlement is enforceable under the state law known as the Ellis Act, which forbids cities from compelling land owners to stay in the rental housing business. Embassy sued City Hall in 2008 after its application to remove the 19 units from the rental market was rejected.

In determining the settlement violated the Ellis Act, the appellate court reversed a trial court’s earlier finding in City Hall’s favor.

In its motion for rehearing, lawyers for City Hall argue Embassy is trying to wriggle out of a binding settlement it had willingly entered into to resolve the prior litigation.

The appellate court, City Hall attorneys argue, failed to recognize that the settlement should be exempt from Ellis Act requirements under state law.

Talks resume but progress slow in port strike THE ASSOCIATED PRESS LOS ANGELES There has been “little progress” despite hours of late-night and weekend talks between striking clerical workers and shipping companies at the nation’s busiest port, negotiators said Saturday.

Stephen Berry, lead negotiator for the Harbor Employees Association, which represents the shippers, said talks for much of the strike’s third day at the ports of Los Angeles and Long Beach stalled over union demands he said would “force employers to hire temporary and permanent workers even when there is no work for them to perform.”

Berry said in a statement that the provisions sought were “unacceptable, and run counter to the employers’ efforts to reach

fair and reasonable contracts.”

Several calls Saturday to John Fageaux Jr., president of the International Longshore Warehouse Union local that represents about 900 clerical workers, were not returned.

He has said workers’ primary worry is that their jobs may be outsourced as shippers seek to use new computer programs allowing customers to access booking information.

The striking workers handle critical paperwork for shipment at the nation’s busiest port complex. Their work is usually completed several days before a ship arrives, so it could take as long as a week before the strike causes serious disruptions in shipping.

The clerks have been picketing outside several terminals operated by the 14 shipping companies since their contract expired on Thursday.

focused on the nail-biting intensity of World Cup soccer matches, 82 year-old Melanie Downing is gearing up for another competition; The Veteran’s Wheelchair Games.

Now, one may wonder, how can she possibly compete in a sports competition at her age?

Well, Melanie Downing is no ordinary 82-yearold. This Santa Monica resident is an extremely proud U.S. Navy Veteran, who served during the Korean War. When asked about her reason for going into the Navy, she replied, “Is there really any other branch? My dad was in the Navy, my brother was in the Navy, and I really didn’t have a desire to go anywhere else.”

Although Downing now suffers with severe arthritis, she has found a new way to get a work-out. She has been competing in the Veterans Wheelchair Games since 2006, when she traveled all the way to Anchorage, Alaska. Since then, she has traveled to various cities and states across the country, including Milwaukee, Wisc. and Omaha, Neb. This year the games are in Denver, Colo.

“When I first got into a chair, I was looking for some kind of outlet,” said Downing.

“I ran across [my coach] and we got to talking, and he suggested I try out for the games.

“I love them.”

Downing doesn’t just compete in the games, she wins. Since 2006, she has won a total of 12 medals (six gold, three silver and three bronze), which she proudly displays around her neck.

She has placed in such events as bowling, power chair relay and motorized rally.

From all of her accomplishments, one would gather that she was extremely intent on going out and winning. However, although she’s proud, it was less important to her that she won gold — when displaying her medals, she exclaimed “I like the bronze ones more, don’t you? I just think they’re the prettiest. I should win more of those!."

She believes it's more important that she gains the experience of competing, and meeting all the great people she comes across. Winning comes in second.

“It feels good to win medals, but let me tell you something about the wheelchair games; you meet the most amazing people.

There are young people and old people with all these horrible disabilities participating, and they just go out there and continue to compete. It’s awe-inspiring.”

She also says that, while she doesn’t have much, she is always trying to do her part to help her community. Since she moved to Santa Monica, about 20 years ago, she has been extremely saddened by the amount of home-

less people living on the streets. Although she expressed that she doesn’t have much to give, she does what she can to help their situation.

“I like to buy Bibles, and then give them away. Usually I go near the ocean. There are so many homeless people down there; it’s absolutely heartbreaking. I can’t really afford

to give them money, so I give them Bibles.

They really need them.”

She also takes trips to the Veterans Administration Hospital in West L.A., where she spends time with the patients, some suffering from conditions similar to hers.

“I go over to the VA about three times a week and work with some of the patients down there. I play dominoes, talk with them, and always try to go in there with a smile on my face. I see so many of these people with frowns, and I don’t want to be that way. I promised myself that when I got into a chair I was never going to be like that.”

What about the facts?

VA shortchanges homeless vet center

It seems like whenever someone challenges an opinion piece on its “facts,” the challenger comes up with inaccuracies that somehow manage to outdo the targeted piece.

Chris Harding’s op-ed (“Just stick to the facts, guys,” July 1), certainly fits the pattern: for all his protests, he couldn’t resist sending out at least one whopper of his own into the world before he was done.

But there was one mis-statement that was particularly significant. Harding’s claim that the recent school parcel tax election “garnered a two-thirds positive vote on Measure A by Santa Monica voters” is ridiculous on its face: if the measure garnered a two-thirds approval (plus one vote, of course) as Harding states, it would be law. And while it’s tempting to find such twisting of reality laughable, there is too much behind the statement, and far too much at stake, to be amused.

Make no mistake — this was no mistake. The “business interests” that Harding represents have been hard at work making people think that the ill-conceived, regressive tax measure that voters soundly rejected was somehow barely defeated. Or, in Harding’s case, was miraculously passed.

Why the re-writing of barely month-old history?

Because the same business interests that spent hundreds of thousands of dollars in a failed effort to pass Prop. A want to come right back in November and try it again.

Instead of what we actually need, a school tax based on square footage of development, one that would supply millions more in needed funding to our schools, and, yes, expect the “business interests” to contribute their fair share, Harding and his ilk want to continue the virtual free ride they have managed for decades.

We can’t allow it. If we want to guarantee a future of quality education for the children of this city, we have to follow the lead of other progressive school districts throughout California and develop a school funding measure that doesn’t provide a favored status to special interests at the expense of our students.

Or doesn’t the “fair shake” that Harding asks for apply to our kids?

Administration funds to convert a single, unused building at its West Los Angeles campus into housing for chronically homeless veterans shouldn’t be a big deal.

But it is.

Securing housing for homeless veterans has been a personal cause of Santa Monica Mayor Bobby Shriver, who has been trying to expand housing and related services at the VA campus in Brentwood for years. I even wrote about his efforts a few weeks ago.

Shriver identified three empty buildings at the VA that could be used to house mentally disabled and chronically homeless veterans and vets with substance abuse problems years ago. In fact, the buildings were constructed in the 1950s specifically for mentally ill veterans. Rehabbing the buildings to serve a new generation of vets had stalled because of the lack of political will to make it happen.

Shriver and others had grown frustrated as securing funding had become a long, drawn-out process along with what appeared to be a lack of enthusiasm for the project by most political leaders. Not one federal political leader pushed for this facility. And, only one of three buildings so desperately needed has been funded.

During a June 16 meeting in U.S. Sen. Dianne Feinstein’s Senate office in Washington, DC, Secretary of Veterans Affairs Eric Shinseki committed $20 million (a fraction of the VA’s 2010 discretionary budget of $55.9 billion) to renovate and rehabilitate one structure: Building 209.

A total of $10 million is earmarked for seismic upgrades while the other $10 million will go for living quarters, activity rooms and facilities for services, treatment and physical and mental rehabilitation.

Building 209 will see its first client in 2012.

Despite sitting on the Senate Appropriations Committee and being a former chair and ranking member of the Senate Appropriations Committee on Military Construction and Veterans’ Affairs, surprisingly Feinstein has never championed funding for this project nor has superpowerful U.S. Representative Henry A. Waxman (D-Beverly Hills).

Los Angeles County Supervisor Zev Yaroslavsky credited Shriver with suggesting as far back as 2004 that the three buildings be recycled and renovated to serve the county’s huge homeless veteran population — a growing problem because of the large numbers of compromised veterans returning from Iraq and Afghanistan and the appalling lack of mental health services available to them Estimates are that over 15,000 homeless veterans now sleep on Los Angeles County streets each night. Many vets suffer from Post-Traumatic Stress Disorder, various mental illnesses. depression and/or have alcohol and drug abuse problems. Some 15

percent of homeless veterans are woman — many are victims of military-related sexual trauma. Some even live in vehicles or dumpsters with their children.

Shriver told me he was pleased that real money had finally been committed but was disappointed that the two other buildings weren’t included. He also was hopeful that the VA would quickly issue a Request For Proposal (RFP) for an experienced homeless/veterans service provider to assist with the new facility’s design and operation.

“It’s vital that a key service provider be brought in early during the planning process," he said.

A number of providers already furnish services at the Brentwood VA including New Directions, which has been providing a comprehensive array of services to homeless vets since 1992 and the Salvation Army.

I talked to Bob Pratt, president of Volunteers of America whose Los Angeles operation is interested in being involved with the new facility. VOA already provides a wide range of services to veterans including sheltering, transitional and permanent housing, outreach and support services around the county. Pratt, who lives in Santa Monica, said, “This is a terrific opportunity” and praised Shriver because he “single handily made it happen." The VA’s partner would assist in assuring a comfortable and beneficial environment for mentally disabled vets.

Shinseki has also promised “to work” with Feinstein and Waxman to identify and secure an additional $20 to $30 million to renovate Buildings 205 and 208 — the other two structures identified and designated for homeless veteran housing and services.

Pratt told me he hoped that one of the three buildings would be set aside for female veterans with and without children. He noted, “Women often have more and more severe adjustment problems than male veterans because of negative sexual experiences on top of the PTSD.” Let’s pray it doesn’t take another six years to just get the money. Vets are dying out there in the meantime.

Giant oil skimmer offers hope in Gulf TOM BREEN Associated Press Writer

NEW ORLEANS The latest hopes are riding on a massive new skimmer to clean oil from near the spewing well in the Gulf of Mexico, while a local Louisiana parish’s plan to block the slick has been rejected by federal officials.

A 48-hour test of the Taiwanese vessel dubbed “A Whale” began Saturday.

TMT Shipping created what is billed as the world’s largest oil skimmer by converting an oil tanker after the April 20 explosion sent millions of gallons of crude spilling into the Gulf.

The vessel was expected to cruise a 25square-mile test site just north of the Macondo Deepwater well site, company officials said.

The U.S. Coast Guard and BP are waiting to see if the vessel, which is 10 stories high and as long as 3? football fields, can live up to its makers’ promise of being able to process up to 21 million gallons of oil-fouled water a day.

The ship works by taking in water through 12 vents, separating the oil and pumping the cleaned seawater back into the Gulf.

"In many ways, the ship collects water like an actual whale and pumps internally like a human heart,” TMT spokesman Bob Grantham said in an e-mail.

A Whale is being tested close to the wellhead because officials believe it will be most effective where the oil is thickest rather than closer to shore.

The ship arrived in the Gulf on Wednesday, but officials have wanted to test its capability as well as have the federal Environmental Protection Agency sign off on the water it will pump back into the Gulf, which will contain trace amounts of crude.

The wait has frustrated some local officials, who say the mammoth skimmer would be a game-changer in keeping oil from reaching vulnerable coastlines.

During a Thursday tour of the inlet to Barataria Bay, Louisiana Gov. Bobby Jindal said it was exasperating to have A Whale anchored offshore instead of being put to immediate use.

“They’ve used the war rhetoric,” Jindal said aboard a boat floating in oil-slicked waters near Grand Isle. “If this is really a war, they need to be using every resource that makes sense to fight this oil before it comes to our coast.”

The governor, who has been outspoken in his criticism of the relief effort, also criti-

cized a decision by the U.S. Army Corps of Engineers to reject a proposal by Jefferson Parish to build a series of rock dikes to protect the ecologically important Barataria Bay. Parish officials were using a fleet of barges — dubbed the “Cajun Navy” — as temporary barriers to block the oil, but some was still seeping in. The Corps found that the dike plan was incomplete, lacking a designated agency to remove the barriers, a restoration plan for environmental damage and data to measure any such damage.

“The Corps took weeks to review the plan only to reject it today — and this denial is another unfortunate example of the federal government’s lack of urgency in this war to protect our coast,” said Kyle Plotkin, Jindal’s press secretary.

Back at the well site, work continued through the weekend to prepare another vessel, the Helix Producer, to hook up to the containment cap at the seafloor and start collecting up to 25,000 barrels a day. The work was delayed by severe weather from Hurricane Alex.

If workers are able to hook up the Helix Producer this week, it could double the amount of oil being collected at the well head and then burned or transferred to other tankers.

Meanwhile, work is a few days ahead of schedule on two relief wells that BP says are the best chance at stopping the leak, BP America spokesman Daren Beaudo said.

But the company is sticking with its earlyto-mid-August timeframe for completing the wells because of the uncertainties of hurricane season and the precision needed as the drills get deeper into the ocean floor.

Elsewhere on the Gulf coast, Environmental Protection Agency administrator Lisa Jackson visited Pensacola Beach on Saturday, her first trip to Florida since the explosion and her sixth trip to the Gulf.

Jackson said that despite the level of contamination on the beaches, it should be up to local officials to decide whether they should be closed. Officials in Escambia County have posted oil warnings at beaches but not closed them.

“From a commonsense perspective there is nothing that I am going to be able to tell you in chemical lab that you can’t learn about the safety of the water from a bathing purpose by looking at it and smelling it,” she said.

Reporters pressed Jackson on whether she would wade into the water Saturday based on what she had seen.

“I would not go into the water today,” she said.

economy” means different things to different people, but in general it refers to encouraging economic development that prioritizes sustainability — that is, working with nature and not against it in the quest to meet peoples’ needs and wants — instead of disregarding environmental concerns in the process of growing the economy. The primary way governments around the world are trying to “green” their own economies today is by increasing investment in — and, by extension, creating jobs in — industries on the cutting edge of non-polluting renewable forms of energy, such as solar and wind power.

President Obama has repeatedly invoked his vision of a green economy as a tool for helping the U.S. lift itself out of recession and position itself as an economic powerhouse in a carbon-constrained future. The American Recovery and Reinvestment Act (ARRA) of 2009, the $787.2 billion stimulus package that Congress signed into law in 2009, was chock full of provisions to boost renewable energy, energy efficiency and environmental restoration initiatives.

Examples include $4.5 billion to convert government buildings into high-performance green buildings, $8.4 billion for investments in public transportation, and tens of billions of dollars more for research into new technologies to amplify existing efforts.

ARRA also earmark $11 billion for the implementation of the “smart grid,” a new approach to power distribution that will bring more clean energy sources into the mix and promote energy efficiency.

Infusing such huge amounts of cash into sustainability-oriented projects is one way the Obama administration hopes to “green” the U.S. economy while simultaneously pulling the country out of recession. “To truly transform our economy, protect our security, and save our planet from the ravages of climate change, we need to ultimately make clean, renewable energy the profitable kind of energy,” Obama told Congress a few months ago.

Of course, Americans aren’t the only ones bent on building a green economy. During the 1980s and 1990s, while the American government was largely asleep at the wheel on environmental issues, countries such as Denmark, Germany, Spain and Japan were already busy investing in wind and solar research and implementation. And while these nations’ ongoing efforts are nothing to sneeze at, economists point out that what is most needed is action on the part of the world’s fastest growing economies — China and India.

A recent report by the consulting firm McKinsey & Company found that China — which surpassed the U.S. as the world’s largest generator of greenhouse gases three years ago — has great potential for building a green economy over the coming decades.

According to McKinsey, by 2030 China could reduce its oil and coal imports by up to 40 percent and its greenhouse gas emissions by 50 percent by investing upwards of 1.5 trillion yuan ($220 billion in U.S. dollars) per year in both existing and new green technologies. China has begun to see the light with regard to reducing emissions, increasing energy efficiency and embracing renewable alternative energy, but it has yet to make significant financial commitments, which will be key to both warding off catastrophic climate change and building a truly global green economy.

Ilene Woods, voice of Cinderella, dies at 81

City Hall argued that the published decision would set a precedent that would “lead to unintended consequences to private agreements between tenants and landlords.”

Tony Oliva, who represented Embassy in the case, said most motions for rehearing are rejected.

“We certainly believe the original decision was proper and that there’s no basis for a rehearing,” he said.

Stephen Lewis, a spokesman for Santa Monica’s rent control agency, didn’t rule out the possibility of asking the state Supreme Court to review the case if the motion for rehearing is unsuccessful.

LOS ANGELES Ilene Woods, the voice of Cinderella in Disney’s animated classic, has died. She was 81.

Woods died Thursday of causes related to Alzheimer’s disease at a nursing home in Canoga Park, her husband, Ed Shaughnessy, tells the Los Angeles Times.

Woods was an 18-year-old radio singer in 1948 when she recorded a demo for an upcoming Disney feature. Two days later,

Silent hybrids may be history KEN THOMAS Associated Press Writer

WASHINGTON The age of the silent hybrid may be coming to an end.

Gas-electric hybrids, propelled by electric motors at low speeds, are well-known for their quiet ride and great mileage. But their silence isn’t always golden.

Some researchers and safety groups say that quiet operation — “hybrid creep” — can pose risks for unsuspecting pedestrians and the blind, who use sound cues.

Advocates for the blind have sought the addition of artificial noises in hybrids for several years, concerned that the expected sales growth of hybrids could lead to more pedestrian fatalities and injuries. Hybrids account for about 2 percent of new car sales each year but auto companies are expected to boost production in advance of tougher fuel efficiency standards this decade.

“This is an example of too much of a good thing,” said John Pare, executive director for strategic initiatives with the National Federation of the Blind. “Cars got quieter, that was good. Suddenly they got to be so quiet that it added an element of danger.”

The government’s auto safety agency said in a research report last year that hybrid vehicles are twice as likely to be involved in pedestrian crashes at low speeds compared with cars with conventional engines. The study by the National Highway Traffic Safety Administration examined circumstances in which the vehicles were slowing down or coming to a stop, backing up or entering or departing a parking space.

More than 4,300 pedestrians were killed in 2008, according to the most recent data available. The government has been researching the safety risks that hybrids and electrics could pose for pedestrians, particularly the blind, along with the elderly and children, for vehicles traveling at 20 mph or less. When a car is going faster, the friction between the tire and the road’s surface makes the vehicle louder.

The quiet hybrid phenomenon already has its place in pop culture. In an episode of NBC’s “The Office,” paper salesman Andy Bernard uses his stealthy blue Toyota Prius to sneak up on Dwight Schrute and pin his bitter rival against a hedge. One concerned co-worker, watching the unfolding drama, says “the Prius is silent if he keeps it under 5 miles per hour.”

Congress is heeding the warnings, adding sound performance requirements for hybrids and electric cars to an auto safety bill being considered after the massive Toyota recalls. Lawmakers could consider the changes this summer and car companies most likely would have to have the sounds ready to go three years after the release of new government rules.

Automakers helped develop the proposal in Congress and are moving forward with new artificial sounds that will be emitted from electric cars and future hybrid models.

Nissan Motor Corp. has produced distinct sounds for the Leaf, the electric car

expected to go on sale this year, when the vehicle accelerates or moves in reverse.

When the Leaf speeds up to 20 mph, it automatically will use a soft whirring sound that changes pitch as the car accelerates. When the Leaf backs up, an intermittent bell will ring to warn those nearby.

The Japanese automaker consulted with acoustic psychologists and Hollywood sound designers to find a tone that addresses drivers, pedestrians and the community.

“It was kind of like peeling back an onion. The more we worked on it, the more issues came up, the more of a balancing act it became,” said Andy Christensen, a manager with Nissan’s North American Technical Center near Detroit. Nissan plans to use the sounds on the Infiniti M35 hybrid to be released in 2012.

General Motors Co. wanted a more subtle chirp on its Chevrolet Volt, so it chose an alert horn that lets the driver warn an unknowing bystander.

“We didn’t want to blast the horn at them and figuratively smack the people in the nose,” said Doug Moore, a vehicle performance engineer for the Volt project. “We just wanted to tap them on the shoulder and say, ‘Hey I’m here.’”

Other automakers are hard at work, too.

Toyota Motor Corp., which makes the top-selling Prius hybrid, is studying artificial sounds for hybrids when the vehicle is propelled by its electric motor at low speeds. Ford Motor Co. is working to bring external sounds to future hybrids and electrics, including its Focus electric car, expected in 2011, and a next-generation hybrid and plug-in hybrid vehicle planned for 2012.

Nancy Gioia, Ford’s director of global electrification, said car companies should consider standardizing tones from future hybrids and electrics to avoid a cacophony of confusion on the streets.

“It can’t be like cell phones where we all select our own sound and we tune out everybody else’s but our own,” Gioia said.

Some green car advocates have questioned the need for the extra tones and noted that the requirement could add more noise to neighborhoods. Paul Scott, vice president of Plug In America, said the sounds could help under certain circumstances, but drivers should have the right to activate the tones.

“After hearing how innocuous the Nissan Leaf sound is, maybe it’ll be a minor irritant for us, but I suspect people will tire of it eventually and seek ways to disable the noise,” Scott said in an e-mail from Japan, where he was test-driving the car.

Les Blomberg, who is the founder of the Noise Pollution Clearinghouse, said reducing noise from the loudest vehicles, such as trucks, buses and motorcycles, would increase the ability of pedestrians to detect sound. Adding sounds to hybrids, however, would simply enhance noise pollution and make it more difficult to hear an individual vehicle in traffic.

■ In the midst of World Cup fever, readers might have missed Germany's win over host Barbados in June for the Woz Challenge Cup, following an eight-team polo tournament with players not on horses but Segways.
