Council agrees to drop taxi rates to LAX

CITY HALL Alert: Beginning Friday, if you pay more than $35 for a taxi ride from anywhere in Santa Monica to LAX, you’ve paid

too much.

The City Council voted Tuesday to drop the rates from locations south and north of Interstate 10 respectively as part of a package of motions revisiting different aspects of the citywide taxi franchise system.

Rates will now be a maximum of $35 if you’re hopping in north of the 10 Freeway, and $30 if you get in on the southern side.

The drop in price from what was recommended by a study commissioned in 2008 from the Nelson/Nygaard firm is just sim-

ple math.

“It’s really just an average rate of a bill,” said Don Patterson, business and revenue operations manager for City Hall.

Assemblywoman Brownley reaches agreement with charter schools Assemblywoman Julia Brownley (DSanta Monica) announced Thursday that she and State Sen. Joe Simitian (D- Palo Alto) reached an agreement on a package of bills with the California Charter Schools Association that will establish uniform standards for public charter schools.

“Many months of collaboration with the California Charter Schools Association (CCSA) have produced an exceptional package of bills that will enhance charter schools’ ability to offer a superb, innovative educational experience to a wider group of California students,” Brownley said. “Our agreement contains important protections for students and the public while preserving charter schools’ autonomy as an alternative to traditional public schools.”

AB 360 by Brownley would require charter school governing boards to comply with open meeting and public records laws and add protections against financial conflicts of interest. It includes two new exemptions which allow governing board members and school employees to make loans to the school during fiscal emergencies and to lease or cosign a real property lease for the school.

AB 440 by Brownley requires charter schools to meet rigorous academic accountability standards prior to the renewal process. It requires charter schools to hire the same high quality financial auditors as school districts, allows a charter petitioner’s previous history operating charter schools to be considered by the authorizer, and requires a charter school’s track record in serving students who reflect the community’s demographics to also be considered in renewal.

SB 645 by Simitian expands the eligibility for charter schools to receive grants for facilities serving low-income students and contains the same academic accountability standards as AB 440.

The CCSA and Brownley believe this package of bills will strengthen charter schools’ commitment to high quality education while also providing flexibility charter schools need to ensure innovative alternative learning environments.

AB 360 is scheduled to be heard in the State Senate Committee on Judiciary on July 5. AB 440 and SB 645 are scheduled to be heard in the State Senate and Assembly committees on education on July 6, according to Brownley’s staff.

Disgusting trend Editor:

I have to thank Bill Bauer for detailing the incident in which a child was harassed and racially bullied at Samohi (“New SMMUSD motto: ‘mum’s the word,’” My Write, June 27, page 3). Mr. Bauer has exposed a crime — and detailed the trend that SMMUSD has for covering up crimes that expose children to known dangers.

Again, SMMUSD officials and administrators chose to ignore and completely hide child endangerment.

Someone needs to call children’s services, file a real police report, and arrest these mobsters. Notifications need to be sent to all district parents, telling them that this incident happened, and that it was and is condoned

by SMMUSD. The notification should also clearly state, that should something like this happen again, SMMUSD can be expected to break the law, and do whatever is necessary to cover up illegal activities.

The employees and administrators at SMMUSD that directly participated in the cover up need to lose their jobs, and personally pay Victoria Gray, the mother of the victim, a hefty sum for endangering her child. The police and children’s services need to open an investigation to find out why school officials find it necessary to break the law, cover it up, and endanger the children they are overpaid to protect.

It’s impossible to understand or see any kind of need for more school funding when SMMUSD is pulling these kinds of, as Bill Bauer puts it, “shenanigans.”

SMMUSD’s actions label them as nothing short of corrupt criminals who conspired to hide the injury of a child from their parent(s). Absolutely disgusting.

Do something Editor:

Maybe now that a celebrity hit a cyclist the city will actually start to do something about bike safety as well as traffic safety (“Donald Sutherland, bicyclist collide,” page 3, June 25-26). The fact that neither party was cited (sorry, Donald) is ridiculous. The cyclist should have been cited at the very least for riding on the sidewalk, but if Mr. Sutherland failed to come to a complete stop before exiting the alley and crossing the sidewalk, he should have been cited as well.

Though he could have had a dispute case against the city and still may since they do not even have solid lines with STOP painted before them at most of the alley exits. This would be a good start and increase pedestrian safety as well. Kill two birds, right (and without the risk of injuring people)? I am almost hit constantly by people who fail to stop before the sidewalk, and while they should know, is the city not the least bit liable for not posting stop signs, or at least painting where drivers should stop before proceeding along to see if there are pedestrians? I understand visibility is generally blocked, but come on! Use your heads, people! You’re coming up on a sidewalk and should stop, stop, stop, instead of risking the lives of those walking their kids, dogs, or just on their own.

And bikers should stop riding on the sidewalks and running stop signs! Since my last letter, I have not seen one thing done about this around my neighborhood and even had an officer scold me and tell me not to tell him how to do his job when I pointed out a family of four, yes with two small kids, running a fourway stop without even the slightest hesitation at the stop signs. I really hope the day doesn’t come when people get seriously injured. Write the City Council today and every day until we see something being done about this!

Are mobsters abusing rent control?

AMONG THE REASONS SANTA MONICA

is famous worldwide may be due to the many celebrities who live here. Or, at least who get arrested here.

Back in the 1920s, our fair city was at the center of the mysterious disappearance of famed radio evangelist Aimee Semple McPherson (AKA “Sister Aimee”). On May 18, 1926, McPherson went to Ocean Park to swim in the ocean. (I wonder if the bathrooms were open then because ours won’t until late July!)

After frolicking in the water, suddenly McPherson disappeared. It was thought she had drowned. Her mother preached in the sermon that day that “Sister is with Jesus.”

Actually “Sister” had snuck away with “Mister,” her boyfriend, Kenneth Ormiston.

Suspiciously, Aimee surfaced two months later across the border in Mexico. She claimed that she had been kidnapped, drugged, tortured, and held for ransom in a desert shack and yet she looked remarkably rested. (Then again, maybe being kidnapped just agrees with some people?)

Santa Monica was the favorite haunt of Fatty Arbuckle, Hollywood’s first movie star to pull in $1 million a year. Arbuckle’s fame plummeted, however, after standing trial three times and finally being found not guilty in the homicide of a 26-year-old aspiring actress who died at a party he arranged. When Fatty passed away on June 29, 1933, his ashes were scattered in Santa Monica Bay. One of my favorite actors ever, Oscarand Emmy-winner William Holden (“Sunset Boulevard,” “Bridge on the River Kwai” and “The Wild Bunch”) also had his ashes scattered in Santa Monica Bay. (I’m surprised the city doesn’t charge for permits.) Holden was living on Ocean Avenue at the time of his accidental death on Nov. 12, 1981. He was only 63.

Stan Laurel (of Laurel and Hardy fame), also spent his last years here. He lived at the old Georgian Hotel on Ocean Avenue which, during prohibition, was home to one of Los Angeles’ first speakeasies. As a teenager, I remember seeing Laurel sitting serenely on the large Georgian porch with a blanket across his lap. He died in 1965 at the age of 74. He wrote his own epitaph, “If anyone at my funeral has a long face, I’ll never speak to him again.”

I mention all of this because just eight days ago Santa Monica was once again thrust into the headlines with the arrest here of one of the FBI’s 10 most wanted, James Joseph “Whitey” Bulger, 81. The former Boston mob boss is wanted on 19 counts of murder, racketeering, extortion, money laundering, conspiracy and narcotics distribution. (To quote from Lenny Bruce’s Father Flotsky routine, “That doesn’t make the boy all bad.”)

Curiously, Bulger also served as an FBI informant in a controversial arrangement that allowed his continued criminal activity.

But, in 1994, after being tipped off to a pending indictment, Bulger fled Boston.

Apparently, for the last 16 years, Whitey has

seemingly been just a typical Santa Monica senior living less than a mile from the beach in a rent-controlled apartment on Third Street near Wilshire Boulevard. (That is, if it’s typical to pay rent in cash, have $800,000 stuffed in the wall and 30 guns in the apartment.)

The oddest aspect of the Bulger arrest is that the woman who alerted the FBI lives in Iceland. (I couldn’t make this stuff up, folks.)

She was watching CNN, which ran a public service announcement that featured Bulger and his longtime girlfriend, Catherine Greig, 60. (What the FBI was doing advertising in Iceland is beyond me.)

APPARENTLY, FOR THE LAST 16 YEARS, WHITEY HAS SEEMINGLY BEEN JUST A TYPICAL SANTA MONICA SENIOR LIVING LESS THAN A MILE FROM THE BEACH IN A RENTCONTROLLED APARTMENT ON THIRD STREET NEAR WILSHIRE BOULEVARD. The tipster, who wishes to remain anonymous (wouldn’t you?) had visited Santa Monica years ago and remembered seeing Bulger and Greig, which seems a bit strange.

(What was so eventful about the pair that she would remember?) That said, she now stands to collect $2.1 million if and when Bulger is convicted.

Ironically, it wasn’t Bulger whom she recognized, (Whitey had aged a great deal from his photos) but rather Greig, who is very cosmetic conscious. Reportedly she made frequent visits to beauty salons and plastic surgeons. But how did the police and FBI find them? GPS in her Botox injections?

Inside the apartment the police also found a dog (breed unidentified) in a building which doesn’t allow pets. My guess is if the dog had tags, they were fake. If so, while Whitey may beat the murder and racketeering raps, I know from personal experience, Animal Control can be relentless. (If the poor pooch is put up for adoption, I wonder if the kennel will have to disclose its previous owner.)

To be serious for a moment, I doubt that ex-mobsters are ruining rent control.

(Vacancy de-control pretty much did that years ago.) But all the same, considering a possible $2.1 million reward, I may be a little more curious when passing a senior citizen center.

Rep. Waxman can stop a big fish and a bigger problem SANTA MONICA’S CITY COUNCIL SENT A

clear message to its congressional representative, Henry Waxman, this week: keep “Frankenfish” in the lab and off our dinner plates.

Rep. Waxman has a key role to play in stopping the U.S. Food and Drug Administration (FDA) from approving the first genetically engineered (GE) animal allowed for human consumption. It’s an Atlantic salmon crossed with the genes of two other fish in an attempt to make it grow twice as quickly as a normal salmon, developed by the Massachusetts firm AquaBounty. If the FDA approves the fish — which could happen at any time — the agency may not even require it to be labeled as genetically engineered. Consumers would have no way of knowing whether they are eating a natural salmon or a transgenic farmed fish whose impact on human health and the environment is still largely unknown.

Although he is the ranking member of the House Energy and Commerce Committee, which oversees the FDA’s budget, Congressman Waxman has not yet publicly questioned the FDA’s flawed process in reviewing this fish or its failure to respond to public comments — now numbering in the hundreds of thousands — against it. In a late-night vote Tuesday, Santa Monica’s City Council urged the congressman to voice disapproval to the FDA and President Obama.

They also asked him to co-sponsor a federal bill that would ban the production of GE fish even if the FDA let it slip through, H.R. 521.

Consumers who wisely choose wildcaught Pacific salmon at the store or restaurant have reason to be very concerned if GE farmed salmon is approved.

In a letter sent to FDA Commissioner Margaret Hamburg last fall, 14 California state legislators registered deep concern that "approval [of GE salmon] will lead to numerous other applications to grow this and other genetically modified fish ... .

California's wild salmon runs are at historical lows and are not capable of withstanding an additional assault that could come from escaped genetically-modified farmed salmon in the future."

Pacific Coast fisheries have been in a state of crisis for several years now; the number of salmon in the Sacramento River fell from 800,000 in 2002 to under 40,000 in 2009.

In their letter to the FDA, state legislators also pointed out that California law prohibits the rearing of GE salmon or any transgenic fish in our ocean waters. FDA approval could preempt California from enforcing this law.

Experts, including scientists at the federal Fish and Wildlife Service, believe that insufficient research has been done on the risks of raising or eating GE salmon. Too few studies have been conducted on the dangers to human health or the environment, and those that have been were conducted by AquaBounty or its contractors, not independent scientists. In an e-mail on GE salmon sent last fall, one expert at Fish and Wildlife commented to a colleague that “Maybe they [the FDA] should watch Jurassic Park.”

It would be a mistake for Congressman Waxman to allow the approval of GE salmon on his watch, particularly at a time when efforts to restore our wild salmon fisheries are in full force. The rapid approval of GE salmon would open the floodgates for other transgenic food animals to be approved under the same flawed process. With their resolution, Santa Monica’s City Council is asking the congressman to lead on this issue — and he can, by co-sponsoring H.R. 521 and voicing his disapproval with the FDA and the president.

We need federal and state investment in protecting and restoring our wild fisheries. We don’t need a science experiment that uses our plates — and our environment — as a Petri dish. The City Council has done Santa Monica residents an important service by passing this resolution; Congressman Waxman should follow the council’s lead.

SATURDAY, JUNE 25, AT 9:41 A.M., Santa Monica police officers located a suspect in the 1400 block of the Third Street Promenade who was wanted in connection with an assault with a deadly weapon. Police said the suspect tried to stab a fellow homeless man in the stomach on May 8. The two were involved in an argument over who was allowed to panhandle in a certain area. The suspect allegedly had issues with the victim asking for money at the same location he was. Officers placed the suspect under arrest for assault with a deadly weapon. He was identified as Kurt Edward Johnson, 50, of Los Angeles. His bail was set at $20,000.

SATURDAY, JUNE 25, AT 9:38 P.M., Officers were on routine patrol in the area of Pico Boulevard and 20th Street when they saw a gray GMC Safari van in the intersection that had failed to proceed through multiple green lights in violation of the vehicle code. Officers conducted a traffic stop. Upon contacting the driver, the officers said they could smell marijuana. Officers removed four men from the van and brought in a drug-sniffing dog to search the van. Officers said they recovered pot, some Oxycodone and various drug paraphernalia. All four suspects were interviewed and two were determined to be under the influence of a controlled substance. Both were also found to be in possession of narcotics and were arrested. The other two men were released. The suspects booked for possession and being under the influence were identified as Ari Levin, 24, and Max Rosenblum, 21; both from Santa Monica. Levin’s bail was set at $10,000 while Rosenblum’s was set at $2,500.

SUNDAY, JUNE 26, AT 6:56 P.M., Officers responded to the 1600 block of Ocean Front Walk regarding a report of a robbery that just occurred in the 300 block of Ocean Front Walk. When officers arrived, they made contact with the victim who told them that he was approached by the suspect as he was walking and counting money. The suspect asked him if he wanted to buy some weed and when the victim said no, the suspect allegedly grabbed the money from his hands. The suspect allegedly told the victim that he was armed with a gun and would shot him if he made any moves. The suspect then walked away northbound on Ocean Front Walk toward the Santa Monica Pier. Armed with a description of the suspect, officers detained a man in the 1500 block of Palisades Park. He was positively identified by the victim and placed under arrest for robbery. The victim’s money was recovered, police said. The suspect was identified as Mack Hemingway, 60, of Hawthorne. His bail was set at $50,000. No weapon was found.

SATURDAY, JUNE 25, AT 7:30 A.M., Officers patrolling Parking Structure 8, located on the 1500 block of Second Street, saw two people who appeared to be loitering on the rooftop. Officers approached the suspects and determined they were under the influence of a controlled substance. Both were detained and officers searched a backpack and found several tabs of Ecstasy. Both suspects were booked for possession of a controlled substance and being under the influence. They were identified as Nicholas Greco, 19, and Deidra Wellman, 20; both from West Leona Valley, Calif. Bail was set at $10,000.

SATURDAY, JUNE 25, AT 8:32 P.M., Officers were on routine patrol on the 1200 block of Lincoln Boulevard when they saw a man riding his bike without a light at night. Officers stopped the suspect and recognized him from a prior drug bust. Officers searched the suspect, who was on probation, and said they found a hypodermic needle containing a cloudy fluid. A drug identification test revealed the substance to be an opiate. Officers also said they found burglary tools. The suspect was placed under arrest for possession of a controlled substance and burglary tools, for riding a bike without a light and for violating the terms of his probation. The suspect was identified as Balbinder Sihota, 52, a transient. No bail was set.

WEDNESDAY, JUNE 22, AT 10:02 P.M., Officers responded to the 700 block of Broadway — Vons — regarding a shoplifter in custody. When officers arrived, they made contact with store security who said the suspect entered the store and grabbed a bottle of Bacardi rum and tried to conceal it inside a reusable bag he was carrying. The suspect allegedly walked out of the store, failing to pay for the booze. He was confronted outside the store by security and detained until police arrived. Officers took the suspect into custody and he was booked for burglary and a probation violation. He was identified as Quayshaun Beauford, 19, of Kittanning, Pa. His bail was set at $20,000.

Officers responded to the area of 20th Street and Pico Boulevard regarding a report of an assault that just occurred. When officers arrived, they found a man lying face down near a bus stop. The man was unconscious and bleeding profusely from the head and face. Several witnesses told officers that a man struck the victim, who was panhandling in the area, in the head and then rode off on a beach cruiser north on 20th Street.

Officers searched the area and located a possible suspect in Virginia Avenue Park. He was positively identified by witnesses and placed under arrest for battery with serious bodily injury and a parole violation. No bail was set. The suspect was identified as Albert J. Duran, 39, of Santa Monica. The victim was transported to a local hospital in extremely critical condition. news@smdp.com

RATES FROM PAGE 1 The new charges help City Hall’s goal of creating a fair, equitable taxi service while still giving the driver’s a chance to make a reasonable living, Patterson said.

City Hall has control over cabbies because of a franchise system instituted in 2010, which put strong restrictions on which cab companies could operate in city limits (five total), and capped the maximum number of cabs at 300.

Representatives of several of those taxi services stayed past midnight to comment on the matter, which was one of the last items on the packed agenda.

They seemed supportive of the two-rate system, which they hoped would bring in additional customers.

They also spoke out strongly in support of very particular language in the resolution, which would allow cab companies to offer coupons and discounted rates to passengers, and for the elimination of running the meter as an option.

“Do not open the door to a driver being able to run the meter,” said Michael Calin of Bell Cab. “What a dishonest driver will do is ask an innocent passenger who has no idea what’s what if you want a flat rate or the

meter.”

Oftentimes, he continued, the passenger will get overcharged, Calin said.

Councilmembers deviated from the staff recommendation of a single, maximum rate of $35, which would cut down on confusion and complaints from hotels and the Convention & Visitor’s Bureau, which declared the dual-rate system too confusing.

It wasn’t without some discussion, however.

“It’s not as if we didn’t try the two different rates, we tried them and it wasn’t working,” said Mayor Pro Tempore Gleam Davis, regarding the staff report.

The bureau and hotels received complaints about the different rates, according to the staff report.

Council member Bob Holbrook didn’t see a problem with letting people figure out the intricacies of I-10 geography.

“I think that word of mouth and people reading the Daily Press … will soon learn what the flat rate is,” he said. “It’ll be just fine that way.”

Charging the southerly customers more for a shorter ride would be a difficult sell, said Mayor Richard Bloom.

“Frankly, I don’t know how I would respond to our constituents,” Bloom said. ashley@smdp.com

BULGER FROM PAGE 1 dated by callers wanting to know when the Bulger apartment would be available and how much it would cost. So many people called, he sent a memo to employees telling them not to promise it to anyone.

“It’s a total curiosity,”Verge said.“People say they want to rent it. But as the owner, you want the best tenant, not someone who is fanatical about living in a monster’s apartment.”

Verge’s agency has no formal agreement with the 28-unit Princess Eugenia complex where Bulger lived, but has previously advertised several other vacant apartments from the building.

There’s not much to distinguish Bulger’s former home from any other in the 1970s complex. The corner unit faces away from the sea, is next to an elevator and has two bedroom and two bathrooms.

And it’s not available -- at least for now.

Bulger, always punctual with his rent, which he only ever gave in cash, had paid through the end of June. FBI agents will remain at his former home for at least two more weeks as they search for anything he could have stuffed into the walls or floors of the two-bedroom unit.

After his June 22 arrest, agents found about $800,000 in cash, more than 30 firearms, multiple knives and several pieces of false identification in the apartment.

The FBI recently allowed a property manager a brief visit inside. Several square and rectangular holes, measuring about 10 inches wide and 18 inches tall, had been cut neatly into the drywall by the front door and in one of the bedrooms.

Agents told the manager that Bulger had kept these hidey holes covered over with pictures and mirrors.

The manager spoke only on condition of anonymity to avoid additional attention from the media.

Josh Bond, the building supervisor, went into the apartment soon after Bulger’s arrest and said it seemed like any other. He too had been fielding calls from people wanting to know about renting it.

"We’ve been getting a lot of calls,” Bond

said. “People from Boston, people that saw it on the news and want to rent it out. The phone was off the hook there for a few days.”

Bulger, now 81, fled Boston in 1995 after a retired FBI agent who had recruited him as an informant warned him he was about to be indicted on racketeering charges.

The former leader of Boston’s notorious Winter Hill Gang has also been linked to 19 murders, including the strangling of an associate’s girlfriend who knew he was a snitch and the murder of a man shot so many times his leg was almost severed from his body.

Soon after the ex-agent, John Connolly, tipped Bulger off, it was discovered that the Boston FBI had a corrupt relationship with its underworld informants and had protected crime leaders as long as they were feeding their handlers useful information.

Bulger was arrested along with his longtime girlfriend Catherine Grieg after publicity about the case led to the FBI getting a tip.

The couple, who went by the aliases Charles and Carol Gasko, was known to neighbors as a generally friendly if somewhat aloof pair.

It’s not clear exactly when Bulger moved in to the Santa Monica apartment, as its owners had no rental agreement on file.

When he first arrived in the early- to mid1990s, the units were mainly used as extended-stay vacation homes, the property manager said. They were turned into regular apartments in the late ‘90s and no one saw a need to collect references or a tenancy agreement from Bulger, who had been a good tenant.

Because the apartment was rent-controlled, which meant rates could only go up a small amount each year, Bulger was getting a relative bargain rate on his rent. According to property records, he was paying $1,145 a month, while some of his neighbors pay more than twice that amount.

The property manager said the ideal new tenant would be a reliable person with good credit.

FBI spokeswoman Laura Eimiller said it was not known how much longer agents would remain at the apartment. The unit’s owners could file a claim with the government for any rent due or damage done to the home during the course of the investigation, she said.

Fireworks illegal in SM As people get ready to celebrate America’s birthday on Monday, the Santa Monica Fire Department is reminding the public that all types of fireworks are illegal in the city by the sea.

That includes so-called “safe and sane” fireworks, which may not be used in Santa Monica, even if they are legal in the city they were purchased, fire officials said Thursday.

Each year fireworks cause permanent scarring, loss of vision, and even dismemberment. Keeping the public safe from firework-related injuries and death is the fire department’s top priority, said Suzanne Post, fire safety coordinator for the SMFD. Public fireworks displays by trained professionals are the smartest and safest alternative for everyone to celebrate and enjoy the July 4 celebration, Post said.

The suit also asserts that Vitale is perpetrating what amounts to a sham on the public and wants him to stop all uses of the logo, name and other trappings of the original restaurant, Pozzuoli’s lawyer Maria Savio said.

“This is the best suit I’ve ever litigated,” said Savio, who works with Gottlieb, Rackman & Reisman, an intellectual property law firm in New York. “Hands down, this is the strongest case I’ve ever had.”

Pozzuoli was granted an injunction against Vitale earlier this year in a ruling that stopped him from using the name, references to Bleecker Street, the logo and any claim that the two eateries are the same company. They say that it amounts to false advertising, robbing the New York location of a reputation that took years to build.

Vitale’s lawyer, Santa Monica-based William Hochberg, feeling the injunction went a bit too far, was able to win an order in May that allowed the Santa Monica location, and sister restaurants in West Hollywood and Hollywood, to continue to use the name, but the judge maintained that the Bleecker Street reference should be dropped as well as any picture or advertisement that purports that Vitale is connected to the New York location. Vitale has complied, removing pictures of the New York location from the walls of his Broadway storefront. He also removed part of the building’s awning that included the Bleecker Street reference.

“It’s what I describe as a family squabble and a trade dispute wrapped up in a big ball of pizza dough,” Hochberg said. “Blood is thicker than water and mozzarella is thicker than both.”

Hochberg acknowledges that Vitale isn’t a partner or co-founder of the New York Joe’s, but said that Joe’s Pizza is a common name, which the judge ruled during the most recent court hearing. He added that the New York location closed its Bleecker Street location years ago, abandoning the reference. He said that opened the door for Vitale to assume the name and set up shop on the West Coast.

Vitale does have a solid link to the original Joe’s. He worked there for over 20 years, but Savio said that he wasn’t even a manager, let alone part owner.

Savio believes that Vitale seized on the name to further his business interests once parting ways with his ex-father-inlaw.

“They claim I’m using their name,” Vitale said. “But, my name is Joe.” He said that it’s just a coincidence that the two share a name.

“This thing has been blown out of pro-

While Vitale can carry on his business under the Joe’s Pizza name, there is still litigation to be done.

Savio continues to press the fact that the logo and tie to the original eatery are essential parts of the case that need remedy. In court filings, she claims that NYC Joe’s has been damaged to the tune of $10 million, a figure she said was based on speculation. She isn’t sure what the judge will rule in September, or which part of the original complaint will make it to a jury trial.

“There is very little battleground left,” Hochberg said. “It seems we’ll only have a small trial just about the sign.”

They found out purely by chance that a subcommittee to the Urban Forest Master Plan Task Force had made the recommendation that the Canary Island date palms be replaced by the other two less exotic species just before the final public workshop on the matter.

The trees in question line 18th Street north of Washington Avenue, 21st Street north of Montana Avenue and Marguerita Avenue east of 17th Street.

Neighbors began circulating the petition immediately, and within five days had 290 signatures protesting the change.

People were incensed by the possible change, said Pat Bauer, the resident who began the petition. One woman got out of the shower and answered her door in a towel to sign the petition when she heard what was happening.

That total was up to 302 by Wednesday morning when the matter finally came before the City Council in its public comment period sometime past midnight.

“We did not find a single person who was aware that the city’s draft master plan calls for replacing our historic (almost hundredyear-old) palms with other trees,” Bauer said. “Virtually everyone has been dismayed by the insensitivity of the city’s plan, and apparent lack of transparency of its process.”

If the situation — and the complaints — sounds familiar, it’s because a similar dust-up happened in May over the Canary Island date palms on Georgina and Marguerita avenues.

In that fight, neighbors also came before the City Council to protest the proposed replacement of Canary Island date palms with sycamores.

Their complaints led the council to direct staff to write up an information item detailing how the tree selection process had been completed, and how involved neighbors were.

The report described a process with little public inquiry and a lot of miscommunication.

Residents sat down with members of the tree selection committee and found a compromise palm tree, the Chilean wine palm.

Canary Island date variety — namely a proclivity to share a fungal infection that kills them — but would preserve the look that members of the neighborhood want.

Since, community members have had the opportunity to attend three meetings specifically to share their thoughts on tree selection. The last of these was June 25, where residents living on Marguerita Avenue and 18th and 21st streets first voiced their concerns.

Residents shouldn’t worry, as that won’t be the last opportunity for public input on the process, said Barbara Stinchfield, the director of community and cultural services.

“The tree species plan will be a section of what we’re calling the Urban Forest Master Plan,” Stinchfield said. “It’s going through a public process now that’s involved community meetings and public input at Urban Forest Master Plan Task Force meetings.”

Then, it will go before a variety of commission reviews, including the Planning Commission, before it finally lands in front of the City Council sometime in October or November of this year.

Additionally, a mailer will go out to each household in Santa Monica in July that will direct them to a website where they can find out what tree has been recommended for their street,and how they can comment on the choice.

Funds were allocated for the mailer in the budget passed June 21, Stinchfield said.

“There is still time for dialogue and listening to people and considering what they have to say,” Stinchfield said.

Residents hope they will have an opportunity to be heard, and that like Marguerita and Georgina avenue palms, the character of the treescapes on the more easterly roads will also be preserved.

“These palms have been standing here almost one hundred years. They frame a beautiful view of the Santa Monica mountains. They are majestic, they are like members of our families. We have raised our children in the shade of these trees, and we love them,” Bauer said. “They’re emblematic of the joys of living in our city and we can’t imagine why they would think of doing anything other than preserving, maintaining and renewing them.” ashley@smdp.com

Stocks dipped in June, some consider it a blip DAVID K. RANDALL AP Business Writer

NEW YORK Stocks are headed for a correction. No, stocks are rallying. Wait, stocks are down again. Or up. A lot.

For investors, June was one long seesaw ride that began with a deep plunge on the first day of the month. Six days of declines were followed a week of give and take and then four days of gains. The month ended with strong earnings from a consumer bellwether and signs that a European debt crisis could be averted. That led to a 4-day advance in the three major stock indexes.

The Dow Jones industrial average rose 480 points, or 4 percent, the last four days of the month and the Standard & Poor?s 500 index is on track for its best weekly return for since July 2010.

That strong ending didn?t make June a winner. Stocks were down about 2 percent for the month, the second straight month that the market finished lower. Only the Dow Jones industrial average eked out a gain, of 0.8 percent, for the quarter.

All three indexes are still up for the year.

The Dow is up the most, 7.2 percent. The S&P 500 and Nasdaq are up 5 percent and 4.6 percent respectively. The Dow was down 6.3 percent at this time last year.

Concerns about the strength of the U.S. economy and a possible debt default by Greece spooked investors much of the month. One the first day of June investors were greeted with reports that American manufacturing output had expanded at the slowest pace in 20 months, that auto sales had tumbled in May, and that private companies added the fewest number of employees since September. By June 15, the S&P had lost nearly all of its gains for the year, before dividends.

Market declines mean different things to different people. Rather than retreat further, some investors came to believe that stocks were relatively cheap. Stocks began to reverse course.

The upward climb continued this week when Nike Inc.?s earnings came in much higher than analysts had been expecting.

That indicated that higher gas prices haven?t stopped consumers from splurging on things like pricey sneakers and sportswear.

In the last four days of the month, the S&P rose 4.1 percent.

Even so, the S&P 500 lost 1.8 percent for the month, the Dow finished down 1.2 percent for the month. The Nasdaq composite fell 2.2 percent. For the second quarter, the Dow gained 0.7 percent between April and June. The S&P 500 and Nasdaq, however, lost 0.4 percent and 0.3 percent, respectively.

Most economists, analysts and investors agree that, at the very least, the U.S. economy has struggled through a soft patch. The weakness was brought on by gas prices that hit $4 a gallon, problems getting computer chips and auto parts from Japan and severe weather in the South. These factors weighed on consumer spending and confidence and made recession-weary companies reluctant to hire employees or expand domestically.

Whether the late June rally continues into July depends partly on results from upcoming earnings reports and lingering effects of that soft patch.

Most stock analysts think the economy?s

troubles are temporary. Few have lowered their estimates over the last month despite a dip in consumer spending and continued high unemployment. One reason: even if U.S. consumers spend less, American companies continue to make a significant portion of their profits overseas. As of 2010, 40 percent of the profits for U.S. companies in the S&P 500 came from overseas.

Alcoa Inc. is the first major U.S. company to report earnings every quarter. Many investors look to those results for indications of how the results of other major corporations might turn out. The aluminum maker, which tends to do well when the global economy is growing, reports its quarterly results on July 11.

Mark Schultz, portfolio manager for the $240 million MTB Mid-Cap Growth fund, believes that the impact of higher gas prices on U.S. corporate profits will be balanced out by growing revenue coming from sales in countries like China and Brazil, where companies are still expanding.

Some market strategists say the stock market is in for another up and down ride in July as earnings reports come out.

"We?re worried that the earnings season will capture the soft patch in the second quarter,” says Ron Florance, the managing director of investing strategy at Wells Fargo Private Bank. “If analysts haven?t factored that into their estimates then we could be set up for disappointments.”

Earnings season also gives investors a glimpse of what?s to come. When companies report for the quarter, their executives often lay out their expectations for revenue and earnings for the next quarter. Gloomy predictions from key companies like JPMorgan Chase & Co, IBM and Caterpillar could make a second-half stock rally difficult.

On the other hand, if those forecasts are more bullish, that will bolster the belief that effects from the Japanese earthquake and tsunami and high oil prices will be shortlived.

“The misses will probably not be repeatable because they could come from weather and commodity price spikes,” says Phil Orlando, the chief market strategist at Federated Investors. “We all know that the third quarter will be better.”

Of course, there?s one unknown looming: Politics. The federal government will reach its debt limit on Aug. 2. If Republicans and Democrats in Congress can?t reach a deal to prevent that from happening, the U.S. could find itself unable to borrow more money to meet all of its financial obligations.

The government would be forced to choose which payments it won?t make.

Those could include Social Security checks to more than 52 million recipients or military salaries for the 1.4 million currently in the armed forces. Alarming, yes. But skipping bond interest payments could be even worse.

A default would lead to a sharp rise in interest rates and possibly trigger a recession.

As of now, many investors are betting that a deal will be reached. But look for big swings in the market if a deal isn?t reached by midJuly, says Kevin Shacknofsky, co-manager of the $635 million Alpine Dynamic Dividend fund. “If we don?t have signs that there?s a deal by (then), you have to start positioning your portfolio for the worst.”
