Police nab suspect BY DAILY PRESS STAFF AIRPORT COURTHOUSE A Santa Monica man arrested last week in connection with the stabbing of a local woman in April was arraigned here Tuesday on attempted murder and burglary charges. Santa Monica Police arrested Michael Thomas Gargiulo, 32, on June 6, believed to be an assailant who attacked a Santa Monica woman in her home on April 28. Gargiulo was charged with attempted

willful, deliberate and premeditated murder and burglary. He is being held in lieu of $1.1 million bail. Investigators believe Gargiulo broke into an apartment complex on the 1200 block of 12th Street, awakening a female victim who was home alone and stabbing her several times during a struggle. The victim was transported to a local hospital where she was treated for injuries. The suspect fled on foot. Gargiulo was identified through DNA

evidence gathered at the crime scene and processed. Detectives believe Gargiulo entered the home through a partially opened window. that the ban on categories C and D jets was not lawful. The order was also issued without a hearing, to which City Hall, as the airport’s proprietor, is legally entitled to in order to protect public safety, the motion states. “It usually comes at the end of the administrative process and we’re at the beginning,” Tachiki said. The FAA disagreed with City Hall’s assessment.

CITY HALL An assessment of more than 200 declining carob trees once slated for removal could come in the coming weeks as city officials prepare to select an independent arborist to head the study. Walt Warriner, the community forester, said on Tuesday that he is speaking with several consulting arborists to receive quotes and expects to make a decision by the end of the week. The selected arborist will be responsible for reviewing each of the 202 carob trees previously identified as having an unacceptable risk failure, determining which of the shady specimens can be saved. The City Council last month approved a $395,000 project that calls for the removal and replacement of approximately 300 carob trees that were deemed in a study by consultant HortScience as being in declining health and posing an imminent risk to the public. The project is split into two phases, starting with the removal of the 98 highest risk trees, followed by the additional 202. The reevaluation was prompted by a

CITY HALL The Federal Aviation Administration acted illegally when it issued an interim cease-and-desist order to stop a jet ban at Santa Monica Airport from taking effect, according to a brief filed by City Hall on Monday. Submitted to the Ninth Circuit Court of Appeals in San Francisco, the brief was written to bolster the city’s request to reverse a preliminary injunction that allows

the continued operation of the fastest jets at SMO. “We reemphasized the fact that we don’t believe the FAA has allowed their own procedure and shouldn’t have been able to grant the interim cease-and-desist order,” Deputy City Attorney Martin Tachiki said. City Hall argues that the interim ceaseand-desist order should’ve been issued following the completion of the agency’s administrative review, not before or during the process. The initial results of the review were released at the end of May, concluding
