A city remembers the fallen Woodlawn Cemetery hosts tribute to deceased soldiers

PICO NEIGHBORHOOD More than 7,000 miles from where U.S. troops are fighting the War on Terror, the residents of Santa Monica on Monday honored the current and past soldiers who have put their lives at risk to defend American ideals.

In a sign of solidarity amongst Santa Monicans, who frequently debate the war in the Middle East with passion and vigor, approximately 100 people came out in support of the troops during the city’s 69th annual Memorial Day observance ceremony at Woodlawn

Cemetery, paying their respects to the servicemen and women who have died in America’s wars.

The Memorial Day observance is staged each year by a consortium of Santa Monica service organizations, including the Santa Monica Emblem Club, the local American Legion and the Benevolent and Protective Order of the Elks.

It was just one of many Memorial Day services held throughout the country on Monday, with one of the largest just a few miles away in the L.A. National Cemetery near UCLA. The program was filled with musical performances by the John Adams and Lincoln middle schools choirs, as well as several renditions of famous patriotic songs by Jeanie Talbot, past president of the Culver City Emblem Club #154.

Landlords catch a break Legal changes put tenants on the hook for property damage

Under changes to the laws governing tenant relocation benefits, those found responsible for damaging their apartment, such as causing a fire because of smoking, will not receive money to relocate while the unit is being repaired.

Tenants will have to foot the bill.

Landlords would also be exempt from paying benefits in the event of an earthquake or other natural disaster.

For tenants, the changes will impose a deadline for payment of benefits and create a built-in escalator to match inflation.

Previously, relocation benefits were adjusted “periodically” by the City Council, leaving fees unadjusted for years at a time.

“It seems like we are doing a very good thing,” said Councilman Kevin McKeown, a staunch supporter of renters rights, about the annual, automatic adjustment.

Changes also establish per diem limits for food and other expenses, clarify the duties of city building officials, landlords and tenants, and set up an appeals process.

Tenants would still have to pay rent to

their landlord while repairs are being completed.

Current relocation fees that must be adjusted are: Bachelor or single, $3,000; one bedroom, $3,750; two bedrooms, $4,250; three bedrooms, $5,250; four or more bedrooms, $5,500, according to a city staff report. Fees are expected to be raised by 20 percent.

If the rental housing unit from which the tenant is being evicted is furnished, $250 shall be deducted from that amount.

If one or more of the displaced tenants is a senior citizen or disabled person, or is a tenant with a child under the age of 18, and the displaced tenant has occupied the SEE RELOCATION PAGE 10

CITY HALL A firm that provides wireless Internet service to several cities is planning a pilot project for Santa Monica later this year, as city officials look to enhance the delivery of government services and offer residents an inexpensive option for surfing the Web. Azulstar, a provider out of New Haven, Michigan, was picked from a short list of companies to design, install and maintain a Wi-Fi network that would blanket the entire city, according to Phil Tong, a senior administrative analyst for City Hall.

As part of the selection process, Azulstar is required to design and install a pilot project at no cost to City Hall. Once operational, staff with the Information Services Division and the Wi-Fi Selection Committee will evaluate. The committee is comprised of staff members from ISD, police, fire, economic development, environmental and public works, and the city manager’s office.

If it all checks out, City Council would then have the option of entering into a contract with the company for citywide broadband service. Rates would be addressed at that time.

Azulstar currently offers clients several options for service, including a limited, one hour-per-day plan that is free. For those looking to surf longer, there are unlimited plans starting at $14.95 per month. The company also offers day passes, starting at $5.95.

City Hall has been committed to ensuring residents have access to the information superhighway. To date, 14 “Wi-Fi Hot Zones” have been created throughout town: The Third Street Promenade; the Santa Monica Pier; the Civic Auditorium; City Hall and its courtyard; the Ken Edwards Center; Santa Monica Airport; Reed, Clover, Euclid and Virginia Avenue parks and all libraries.

This year, new locations will be added, most at local parks like Memorial, Douglas, Palisades and Marine.

City Hall has also worked to put more of its services online, allowing people to apply for permits, pay traffic tickets, watch Council meetings or monitor their utility usage. City Hall is also in the middle of redesigning its Web site.

To access the Wi-Fi network, one only needs a computer with wireless capabilities.

There’s no ignoring the war Editor:

I must take issue with the two op-eds (the Daily Press) printed on Memorial Day. In the first (“Arlington West exploits the dead” by Bill Bauer), the writer complained about the Arlington West memorial being too close to people attempting to have fun at the beach.

God forbid that people be reminded that, not only are we at war, but that we are still losing more than three soldiers every day in that war. The writer obviously prefers that people ignore those facts.

The second writer (“It’s time to respect Memorial Day”

by Paul Morin) decries the attempt by (John) Edwards to stop creating more people that will be memorialized in the future. I can think of no better way to honor our fallen soldiers than by trying to keep more from joining them.

It’s time for the citizens of this country to take a long, hard and honest look at what is going on in Iraq.

Acting as if it isn’t happening is about the least patriotic thing that we can do.

First of all, I am a vet, like my fathers before me. I never saw war (1980-86). I did grow up in a military family, and I clearly understand — up close and personal — the sacrifice that intelligent, industrious, hard working and brave Americans make in service.

We now, shamefully, live in a time when we no longer honor our dead, but rather fly them in C-147s under the cover of darkness, away from the press as if to hide our fallen in shame. No band, no clergy, just a dark runway that welcomes them back to America.

I also am troubled by the Arlington West message (“Arlington West exploits the dead,” May 28). I told them so. They talked to me. I discovered that these volunteers set this display up only to let us see and honor our dead, so that we might remember them.

Because I live across the street, it’s hard to miss them every Sunday. Arlington West volunteers are a collection of mostly women; American women who, as men, we know pay the highest price when thier child, husband, father dies, and is forgotten by a nation more concerned with Lindsey Lohan or Paris Hilton.

I am so very proud of this city, of these people who live here, who roll up their sleeves and “do” something, seemingly for every social issue, while it seems every other city in America just talks. Arlington West is nothing more than the best volunteers of our citizens honoring the best volunteers of our solders. They both make me very proud to live in Santa Monica.

Surely, this is a victimless crime CONGRESS IS BEGINNING WORK AGAIN on immigration law. Amid all the

fanfare, the underlying problem with U.S. immigration policy will not be changed.

Our current system promotes the migration of family members, particularly elderly relatives, and those new people rapidly qualify for financial aid from taxpayers.

Meanwhile, young workers who would pay taxes are denied visas.

Much of the heated debate on this subject is rhetorical spin. Frank Luntz, the Republican strategist credited with the 1994 congressional victory of Newt Gingrich, writes this advice for conservatives in his book, “Words That Work:” “Never say ‘undocumented workers.’

Instead say ‘illegal immigrants.’ This linguistic distinction may prove to be the political battle of the decade. The label used to describe those that enter America illegally determines the attitudes people have toward them.”

Describing the issue with that word, “illegal,” brings support to opponents of immigration they would not otherwise earn. To escape the mind-clouding effect of this rhetoric, look at the original law these immigrants have violated. Surely, this is a victimless crime.

In 1921, under growing racial hatred fostered by the Ku Klux Klan and other nativist groups, the United States adopted for the first time a national quota system for immigration.

That quota system favored northern Europeans, while Catholics, southern Europeans, Asians, Africans, and Latinos were virtually locked out for 45 years. This quota system still exists today. This is what makes it “illegal” for many young workers to accept jobs from eager employers who want to hire them.

The quota system transforms the question about “who is valuable” and “who should come to America” into a collective, national issue. It is actually an issue that ought to be decided at the local, individual level by families and by employers.

In 1965, the quota system was modified to reduce its racist taint. The top priority became bringing parents, siblings and children from the old country to live in the United States. This was expanded in 1980, 1986, and 1990. But the overall national quota system was not changed.

The result has been to tilt the age demographic of those receiving legal visas, and those on the waiting list for years to come, toward more and more elderly immigrants. More than two-thirds of all visas today are given to family members.

The bottom line is, why should the rest of us care? Why not eliminate the national quota system? Families want to bring their close relatives to America for a better life.

Employers want young, willing workers.

Perhaps the only reason we should care is that the rest of us are the ones who pay for generous, compassionate welfare programs: poverty medical care and aid to the elderly.

The quota system favors older people.

America’s welfare system mostly gives money to older people. Immigration law contains a provision against new immigrants immediately going on welfare, but

it is still a systematic problem. After a waiting period of only a few years, large numbers of these elderly family members qualify for public aid, Supplemental Security Income, free medical care and other forms of assistance.

It is clear that America’s immigration quota system is badly broken. The national quota system favors nonworkers. America needs and wants more young workers for its growing economy, but instead we are encouraging immigration by elderly people who will soon be living on the generosity of a compassionate government — and the taxpayers. Those who are “illegally” working are actually contributing taxes to support everyone else’s elderly relatives.

Moreover, most illegal immigrants do not even come across the Mexican border.

It is easy to get a tourist or student visa to come into the United States. Most illegal immigrants simply do not return home when their visas expire. There is no system for tracking people with expired visas.

The national quota system not only shifts the proper focus on “who is valuable, who should come,” from individual Americans — employers and families — it also threatens the civil liberties of every other American. There already is a federal requirement for employers to check whether job applicants are legal residents, but it is hard to enforce. The new proposal in Congress would mandate a full computerized data bank, maintained in Washington, to prevent anyone from getting a job if his or her papers are not in order. Watch out for computer errors in the future that will frustrate many legal Americans from starting a new job. Big Brother will be watching.

Walls have never solved anything trying to get over or under it. Korea’s DMZ has substantially held the North Korean nation captive. It’s the North Korean government that tunnels under the DMZ trying to subvert the South Korean republic.

As a nation that built its reputation on open doors and open arms, the United States is now engaged in debate as to how welcoming it wants to be. This is only partly a question of national and personal security. It’s also about economic security.

That’s a two-way street. Are immigrants — legal or illegal — taking jobs from Americans or doing jobs that would otherwise be hard to fill? Send back 12 million immigrants and see who shows up for work tomorrow morning. That goes well beyond the stereotypical notion that immigrants are all gardeners, dishwashers and hotel maids.

What the U.S. is wrestling with is hardly new or unique to our shores. When I lived in Yugoslavia decades ago, the street cleaners and garbage collectors were all ethnic Albanians. Serbs tended to look down on them. When I moved to Austria, the street cleaners and garbage collectors were more likely to be Yugoslavs. Austrians tended to look down on them. When I moved to Germany ... you get the picture.

I took my teenage son to Ellis Island in New York recently. It was one of those Dad provides a field trip experiences to supplement son’s American history studies. The museum on Ellis Island documents the flow of Germans, Irish, Italians, Russians, Jews and others to the U.S. in the late 19th and early 20th centuries.

Those populations, too, faced struggles of assimilation and discrimination. We’ve done this before and in numbers that probably seemed equally daunting. We did not, though, have to face immigration with the fears and insecurities of terrorism.

As the immigration debate continues there is much for our politicians and our society to think about. It’s not a time for building walls around our imagination and creativity.

fall in Washington, it will have on exhibit what may be the largest section of the infamous Berlin wall remaining anywhere and the East German guard tower that I used to pass crossing through the wall at Checkpoint Charlie. The Newseum is the Freedom Forum’s living tribute to the First Amendment freedoms of speech and press inscribed in the U.S. Constitution and engraved on the Newseum’s wall facing Pennsylvania Avenue here in this nation’s capital.

Our Media & Politics class put on hard hats for a look at the work under way. The Newseum sits midway on the avenue that links — or divides — the Capitol and the White House, a metaphor for the role of the press as the Fourth Estate in America’s artfully crafted, yet sometimes precarious balance of powers.

It’s been a warm, sunny week in Washington during which the division over funding the war in Iraq cooled-slightly. The simmering summer debate over changing the nation’s immigration laws, though, continues. It bubbled up in the recent Republican presidential debate in Columbia. There’s a wall between Senator John McCain — worker visas — and former Governor Mitt Romney — no amnesty.

South Carolina’s senators — Lindsey Graham and Jim DeMint — are similarly divided. The “A” word is causing much of the buzz, though the issue is too complex to be characterized by any single aspect.

There are real, virtual and rhetorical walls in this debate. Rep. Henry Brown told the students that past immigration reform has not worked, so the U.S. “has got to defend its borders first.” Rep. Jim Clyburn suggested that for every “15-foot fence” there is a “16-foot ladder.”

Last year’s Secure Fence Act calls for some 700 miles of fencing between the U.S. and Mexico. History suggests walls don’t always guarantee security. China’s Great Wall was, in effect, more a centuries-long jobs program and is now a tourist attraction.

The walls of Jericho came tumbling down, and Israel’s contemporary walls have not kept terrorism out.

The Berlin Wall was an onerous scab.

Mobile but Muffled

Dear Mobile, When you’re the parent of more than one child, one of the most difficult things to do is to avoid comparisons between your children. Each child progresses in his unique way and your job is to support that individuality. Most parents I know have two very different children and they are constantly amazed by the genetic variations. Rarely will a family have incredibly similar siblings — it’s just nature’s way of keeping us parents on our toes!

That said, there are many things you can do to encourage language development.

Start with factual repetition of things that your son does or one-word phrases that he

says. For example, if he says “ba” to mean the word ball, respond with something like, “Yes, that is the ball. Would you like to play with it?” By doing this, you are elaborating on his thought and exposing him to additional relevant vocabulary.

Let’s take a common example for a slightly older toddler. While sitting in the highchair eating noodles, the toddler says, “busketti.” You would respond with something like, “Yes, you are eating spaghetti. Does it taste good?” The key here is a positive affirmation of any attempt to talk, regardless of the situation.

Sooner or later, your son will start combining words into phrases. Until then, keep narrating. Good luck,

Parents shelling out to accessorize family

NEW YORK Will it be the Earnest Sewn jeans, a Splendid top or a Lucy Sykes dress in a Liberty of London print?

That’s the fashion decision facing many toddlers this morning. Yes, toddlers.

We’ve entered an age of mini-me dressing, with parents — particularly well-todo and fashion-savvy parents — buying their children the labels, or at least the styles, they like to see on themselves.

Lucy Sykes, the jet-setting Manhattan socialite, freelance writer and designer of trendy tot togs, says that her splurges on her own 3 1/2-year-old son include a cashmere gray hoodie, Ferragamo trainers and those Earnest Sewn jeans that cost upward of $100.

“My husband says, `My son has better jeans than me!"’ Sykes recalled with a laugh.

But even the splurges are usually for practical items, she says, like the jeans that he wears several times a week. “I buy things that get worn. They’re so expensive, I want to get use out of it.”

Sykes notes that the four pairs of Tod’s shoes her son had when he was an infant were all gifts. “They’re gorgeous but babies can’t even walk yet,” she observed. “They come from people who aren’t parents.”

Most of the time, though, it’s the mothers who are fueling these purchases, although Deanna Inniss, owner of Freckle Face Boutique in Milwaukee’s historic Third Ward neighborhood, has had pint-size shoppers as young as 2 offer their own opinions.

More often than not, children feel more strongly about what they don’t like, she says.

But it’s not hard for mother and child to agree on something like a Splendid

Littles T-shirt, Inniss reports. It’s made from super-soft modal and pima cotton, which feels good against anyone’s skin, regardless of age. Sure, a T-shirt costs $28 at Freckle Face, but the mother is used to paying double that for the adult version.

The premium segment of the infant, toddler and preschool market is worth $14.5 billion in apparel and another $1.6 billion in shoes, according to consumer strategist Michael Silverstein of The Boston Consulting Group and is growing at least 4 percent a year.

“Children’s clothes are emotional to begin with. I sell a lot of mini versions of what mom and dad wear, but not in the bad way, not the way the junior market skews a little sexy. My clothes are sophisticated and tasteful. I’m basically speaking to the customer,” Freckle Face’s Inniss said.

At her shop, it is the upscale but not ultra-luxe products that sell best. “I have a lot of shoppers who are more conservative and think about what they’re spending.

Tea is a brand that does really great clothes at a great price point, and Splendid — ooh — it’s so soft. ... I have some people who will get the Splendid T in every color and size. They love it, it feels great and it washes well,” Inniss said.

Modern parents see their children as representatives of a lifestyle they’ve worked hard to achieve, adds Pilar Guzman, editorin-chief of Cookie magazine, so it’s no surprise that manufacturers and marketers recognize this link, too.

She points to the varied — and sometimes unexpected — labels that offer children’s clothes: Burberry, Ralph Lauren, DKNY, Diesel and Roberto Cavalli.

“Cavalli’s surprising because it’s a very adult and rock ‘n’ roll brand, but it’s fitting because even rock stars have kids.”

“The reality is, people are getting married later, having kids later. They have established likes and dislikes,” Guzman said.

They also have higher incomes.

Good tidings Lost whales heading back toward the sea

SAN FRANCISCO Two lost whales traveled a significant distance toward the Pacific Sunday, swimming 14 miles down the Sacramento River after lingering for a week near a bridge about 70 miles from the sea, officials coordinating the rescue said.

The mother humpback and her calf passed under the Rio Vista Bridge at around 1:50 p.m. and were spotted near the city of Pittsburg, near a confluence of the Sacramento and San Joaquin Rivers, at about 6:30 p.m., said Greg Hurner, a senior advisor with the California Department of Fish and Game.

A convoy of boats were following the pair as they traveled the farthest downriver since suddenly departing the Port of Sacramento last weekend.

Scientists have no clear idea why the whales began moving again after frustrating biologists’ weeklong efforts to urge them seaward using a variety of tactics, Renick said.

Before the pair headed south, veterinarians used sponges attached to a long pole to swab skin cells from bumps resembling blisters or lesions on the mother and calf.

The humpbacks’ long exposure to fresh water has led to serious skin damage, biologists

said, making them vulnerable to germs they would not face in their native saltwater habitat.

“We really need to try to get them back into a more appropriate environment so they can start healing,” said Trevor Spradlin, a marine mammal biologist with the National Oceanic and Atmospheric Administration.

The bumps could be the result of an infection from bacteria, a virus or fungus, but scientists wouldn’t know for sure until they examine the skin cells under a microscope, Spradlin said.

Deep gashes in both whales — likely suffered from a run-in with a boat’s keel — have also worsened rather than healed outside their ocean home. But veterinarians believe antibiotics injected into both whales Saturday could slow the damage.

Scientists won’t know for several days whether the medicine is having a positive effect, Spradlin said.

While they continued to monitor the whales’ health, rescuers had otherwise halted rescue operations over the Memorial Day weekend to let the whales rest.

Coast Guard officials said several “independent researchers” had announced their intention to broadcast whale sounds underwater on their own to lure the giant mammals downstream.

They warned anyone interfering with the whales would face up to $70,000 in fines under federal wildlife protection laws. As of Sunday afternoon, no actual incidents had taken place, Renick said.

Inmate suicides take dip

FOLSOM, Calif. Every 30 minutes, day and night, guards walk the tiers of the isolation unit at California State Prison, Sacramento, checking inmates to make sure they don’t kill themselves.

The guards have been doing so since October, when the prison system instituted a series of reforms to cut the high rate of inmate suicides. The steps were prompted by a federal judge’s finding that a disproportionate number of suicides occurred in the isolation cells used to segregate inmates for disciplinary or other reasons.

The measures, which include screening inmates for potential suicidal tendencies and training guards how to intervene, appear to be making a difference.

Last year, a record 43 inmates killed themselves in California prisons. California’s rate of 25.5 deaths per 100,000 inmates is nearly double the nationwide prison suicide rate of 14 per 100,000, according to the federal Bureau of Justice Statistics. Nearly half those deaths were in California’s isolation units.

Through Friday, 13 inmates had committed suicide, compared with 19 during the same period a year ago. Three were in the segregation units, down from seven in those cells at the same time last year.

The reduction in suicides so far this year marks a rare hint of success for a prison system beset by multiple crises and one that has seen many of its operations placed under the authority of federal courts.

Three years ago, nearly 70 percent of California’s inmate suicides were in segregation units, triggering intervention by a federal judge and the prevention efforts that began last fall.

Guards have reported preventing more

than 60 suicides in segregation cells so far this year. They represent a disproportionate share of the more than 170 suicides attempted during the past five months in the state’s 33 adult prisons.

“They’ve approached several guys who have nooses around their necks and they’ve intervened. They’ve saved them,” said Correctional Capt. Gene Nies, who oversees the Folsom prison’s segregation unit. “They know these guys. They start to recognize the signs. They know to check on them more frequently.”

Sometimes, the guards are too late.

On April 25, one of Nies’ officers found 30-year-old Alberto Gomez hanging from a noose made of a bed sheet.

Resuscitation efforts failed.

Wildland warriors save day Homeowners living on the edge thankful for firefighters

If money’s burning a hole in your pocket, it’s not a new pair of pants you need.

RIVERSIDE A building boom of homes on the fringes of wilderness has created a new kind of hero: the wildland firefighter who often saves the day — and the homes.

But success has created high public expectations that can have deadly consequences.

The deaths of five federal firefighters who perished last fall in the so-called Esperanza Fire protecting an empty mountain vacation home were blamed in part last week on social and political pressures and decisions to put homes before the safety of firefighters.

Now, as another fire season heats up, some officials are considering whether saving homes should always be a high priority — particularly as suburbs increasingly brush up against dense forests and chaparral-covered hillsides.

The U.S. Forest Service plans to issue a plan addressing flaws in the response to the Esperanza Fire as early as this week and is conducting a longer-term review of overall firefighter safety, said Chief Forester Gail Kimbell.

While Kimbell and other officials would not say whether the service is considering a change in policy on defending homes in certain fire conditions, she cited the decision to protect homes in remote Twin Pines as a key factor that led to the five deaths.

Others, however, say while firefighters will continue to protect homes, a shift in strategy is inevitable as firefighters increasingly risk their lives defending communities that have been built in prime fire territory.

“We are not going to die for property,” said Tom Harbour, national director of fire and aviation management for the Forest Service. “It’s time for homeowners to take responsibility for the protection of their homes.”

In the Esperanza fire, for example, the men who died were trying to save a home that had been flagged as “nondefensible” on a state fire planning map several years before.

Harbour’s comments reflect a growing uneasiness within the Forest Service about defending homes in populous rural areas, said John Maclean, a federally certified firefighter and the author of several books on wildfire disasters.

The agency spends 44 percent of its budget on wildfire suppression annually, he said, and much of that work means protecting homes where suburbs collide with wilderness.

Maclean said the Forest Service could scale back structural protection without too much political fallout, but that would not be easy for the California Department of Forestry and Fire Protection, which answers to the governor.

More than 6 million homes in the Golden State stand in wildfire “red zones” and that number is expected to grow by 20 percent in the next decade.

“There is an expectation on the part of a lot of people that somebody better get in there and do or die for their house,” Maclean said. “If you stop doing that and you stop taking reasonable risk to protect structures, you’d have a new governor in about five minutes.”

David Kassel, who rebuilt his San Diego home after it burned in 2003, said he would be shocked if firefighters started backing off structural protection.

“What is the purpose of the fire department? Are they just going to stand around and watch?” Kassel said. “If the structures are being left to the local departments to take care of, isn’t that simply shifting the risk from one department to another? I wouldn’t want to be the fireman who would say, ‘I’m going to leave this to you because we can’t handle something risky."’

On the ground, however, public expectations can sometimes lead to bravado and a cavalier attitude.

The nearly two hour-long service drew Santa Monicans of all generations. The older silver-haired crowd — some donning red, white and blue apparel — mostly sat up front, sniffing and wiping away their tears, perhaps remembering a loved one who had fallen in combat. Some youngsters, still not old enough to understand war, waved miniature flags throughout the ceremony.

“We gather here today to honor those in the past and pray for those in the future,” said R.A. Pickett, the exalted ruler of the Santa Monica Elks Post 906.

Memorial Day is about remembering, Pickett said, asking the audience to “remember the Alamo, remember Pearl (Harbor) and remember 9/11.”

Honored in this year’s ceremony was the family of former Santa Monica Police Officer Ricardo A. Crocker, who died in action during his second tour of duty in Iraq on May 26, 2005. Crocker was serving as a major in the Marines at the time of his death.

State Assemblywoman Julia Brownley presented a framed letter to Crocker’s mother, Jeanette, and sister, Maria, signed on behalf of the state of California and the 41st District.

“Our hearts and our arms will embrace Rick today and forever,” Brownley said.

Crocker served in the Santa Monica Police Department for 10 years. The news of his death was painful, but the police department has finally moved on from Crocker’s passing, said Capt. Mark Smiley as he presented flowers to Crocker’s family.

“We lost a great warrior in Iraq,” he said.

The keynote speaker this year was 1st Lt. Colin Browning of the U.S. Marine Corps. The Minnesota native has served in two tours of duty in Iraq as a rifle platoon commander and an Iraqi army training officer.

Browning spoke of the feeling of pride he had in attending his younger brother’s commissioning ceremony at West Point on Saturday.

“I don’t know how I feel about having a brother in the Army,” he said, drawing a laughter from the audience.

Browning’s voice cracked at times as he spoke emotionally about the fellow members of his troop who never made it back home — a platoon sergeant and a lance corporal, among others. He relayed to the audience the importance of remembering that their loss was not in vain. Each one of those soldiers had a family and came to Iraq with a purpose, he said.

“Today is not about remembering the sorrow, but rather the greatness of the individual,” Browning said. melodyh@smdp.com

If a landlord does not pay up, they can be sued in civil court and forced to pay the relocation benefits plus a $500 penalty and attorneys fees. A judge could also award punitive damages.

City officials looked to make changes last year when City Hall’s building officials sought advice from the City Attorney’s Office regarding a lack of clarity in both state and local law. For instance, the obligation to determine fault was vague under state law and that local law left unclear how relocation rights should be determined in specific cases.

A lawsuit was filed shortly after in which a landlord sued the city over the temporary relocation law, calling it unconstitutional and in conflict with state law. The case arose from an unusual situation in which two units in a building were rendered temporarily uninhabitable as a result of fire. The Santa Monica Fire Department determined that the fire was caused by a tenant’s smoking in one of the units.

The owner was ordered to rehabilitate the units and a dispute arose as to which tenants were entitled to relocation benefits.

The landlord claimed that the city’s temporary relocation law effectuates an unconstitutional taking of property because it requires that benefits be paid in “unlimited amounts,” that it violates the due process rights of landlords

by denying them adequate notice or a right of appeal, and that it conflicts with health the safety codes, in that it requires relocation payments even though a tenant is at fault.

The lawsuit was eventually dismissed once the plaintiff learned of the council’s attempt to change the laws dealing with relocation.

Some landlords called for a cap on benefits paid, citing examples of rent controlled tenants who would be paid benefits that are double, perhaps triple, what they are paying in rent.

City Attorney Marsha Moutrie said some cities do have caps, however, one was not included in the changes to Santa Monica’s law because the council said in a previous discussion that creating a cap would not create an incentive for landlords to repair units as quickly as possible.

Bonds’ Hall pass Slugger is keeping souvenirs to himself as he chases record

NEW YORK As Barry Bonds nears his record 756th home run, he’s stockpiling quite a collection of souvenirs -- bats, balls, helmets and spikes, pieces of baseball history perfectly suited for the Hall of Fame.

Whether he’ll donate any of them to Cooperstown, however, is in doubt.

“I’m not worried about the Hall,” the San Francisco slugger said during a recent homer drought. “I take care of me.”

No wonder those at the museum are getting concerned, especially with Bonds only 10 homers shy of breaking Hank Aaron’s career mark.

“There’s uncertainty,” Hall vice president Jeff Idelson acknowledged.

Around 35,000 artifacts are shown and stored at the shrine, and about a dozen pertain to Bonds.

There is a bat from his rookie year and cleats from him becoming the first player in the 400-homer/400-steal club. Unsolicited, he sent the bat and ball from his 2,000th hit.

A batting practice bat from the 2002 World Series was the last thing Bonds provided.

“Doesn’t everybody have the right to decide to do it or not do it?” he said last week.

The most prized items, the ones that fans would really want to see, are missing.

Nothing directly from Bonds to highlight his 500th home run. Ditto for homers 714 and 715, when he tied and passed Babe Ruth.

Same for anything tied to him topping Mark McGwire’s single-season total of 70.

Hall president Dale Petroskey went to visit Bonds at spring training last year, and instead walked smack into his reality show.

The Giants talked to Bonds this year, and hope he’ll be in a giving mood as the big moment comes and goes.

So far, Bonds has not indicated he intends

to share any Aaron-related memorabilia.

A Hall representative plans to follow Bonds once he gets within a few home runs of Aaron’s 755. Idelson has collected treasures for Cooperstown for more than a dozen years.

“Barry is very cognizant of his place in baseball history and we’ll try to work closely with him to assure him that how this milestone is represented meets his expectations and ours,” Idelson said.

“You need artifacts from the player to do that,” he said. “A cap, bat or jersey, anything can tie a visitor to a specific event.”

Aaron, who has said he will not attend the record-breaker, is well-documented at the Hall. There are 40 assorted items from his career; Ruth is remembered with more than 30.

The Hall does have the home plate from Bonds’ 714th homer and first base and the lineup card from No. 715 -- those came from ballparks, not him.

Bonds has been generous with teammates and opponents. He recently signed a guitar that Giants pitcher Barry Zito gave to charity and autographed a bat for Houston’s Craig Biggio. He’s also given some of his own things to charity.

Bonds is careful with personal items related to his home run pursuit. He makes certain that hats, jerseys and other things he wears are authenticated, and he keeps them in a warehouse.

He marks them, he said, “so people don’t steal my stuff.” By his count, he’s already able to take care of his next three-plus generations.

Whether that memorabilia shows up on his personal Web site or in Cooperstown remains to be seen. He opted out of Major League Baseball’s licensing agreement before the 2004 season, and some of his gear is auctioned off on MLB’s Web site -- on Monday, bidding topped $10,000 for a Bonds-signed Giants jersey.

Also to be determined is whether Bonds himself is inducted into the Hall. If he does make it, that could be his first trip to the redbricked building on Main Street. Bonds becomes eligible for election five years after his final game, and there’s no telling how steroid allegations will affect his vote total.

Coast Guard searching for New England’s Hill

NEW ORLEANS U.S. Coast Guard rescue crews continued searching Lake Pontchartrain on Monday for New England Patriots defensive end Marquise Hill, who was reported missing following a jetski accident.

“We searched throughout the night,” said Petty Officer Tom Atkeson.

Hill’s agent, Albert Elias, said he had been told Hill and a young woman were jetskiing Sunday in the lake when both of them went into the water, which had a strong current.

Elias said the woman was able to make it to a pylon and hang on until she was rescued, while Hill was last scene floating away from the scene.

“I’m an optimistic guy,” Elias told WWL Radio in New Orleans. “He’s a strong kid and a fighter.”

Hill played on LSU’s 2004 national cham-

pionship team and was drafted in the second round by New England.

The Coast Guard was using both boats and a helicopter search the shoreline, Atkeson said. Wildlife and Fisheries was using a recovery line that drags the bottom of the water.

A call came in around 9:30 p.m. Sunday, Atkeson said. The woman, whose identity was not available Monday morning, was rescued and sent to Tulane Medical Center where she told them Hill had tried to keep her calm even as the two were drifting away from each other.

Neither Hill nor the woman wore a life preserver, Atkeson said.

“It’s so important to have a life jacket and a signaling device,” Atkeson said. “One keeps you afloat and the other helps us find you.”

Elias said Hill has spent much of his time since Hurricane Katrina helping family members rebuild their homes.

Barbra bails BARBRA STREISAND canceled her concert in Rome next month — a move that followed protests by Italian consumer groups angered by what they said were excessively high ticket prices.

Concert organizers indicated the decision was not connected to the outcry, saying that production delays had forced them to scrap the June 15 concert in the capital’s Stadio Flaminio, what would have

“We met with unexpected production delays,” said a statement by tour promoter Michael Cohl posted on the Web site of Milano Concerti, the Italian organizer of the event.

“We deeply apologize to the fans in Rome,” Cohl said in the statement, adding that ticket holders would be refunded and

given the opportunity to book a spot for one of Streisand’s other European concerts.

Organizers were not immediately available Monday morning for further comment.

Last week, consumer groups Codacons and Adusbef protested as “absurd and shameful” ticket prices ranging from just under $200 to more than $1,200, calling on

authorities to deny Streisand use of the 24,000-seat stadium.

The stadium “is public property and cannot be used for immoral deals that are shameful to a civilized country,” the groups said in a statement.

Instead of the Rome concert, Streisand’s Web site listed a new date — a June 18 concert in Zurich, Switzerland — as the kickoff for the star’s tour.

Streisand’s 2006 U.S. tour was ranked the second-highest grossing tour in North America last year, generating $92.5 million in gross sales, with the average ticket price at $298.

The Rolling Stones tour ranked first.

After the Zurich event, Streisand’s monthlong European tour has concerts scheduled in Austria, France, Ireland and Britain.

Former Hillbilly rolls the dice MAX BAER JR., who as Jethro in the 1960s sitcom “The Beverly Hillbillies” lived off his uncle Jed’s oil riches, is hoping to strike it rich in the gambling market.

Baer purchased a 2.5acre parcel last week for a planned casino in north Douglas County for $1.2 million. The deal followed his recent sale of the old Wal-Mart building in nearby Carson City for $8.5

million.

“I’m putting my money where my mouth is and buying the property,” Baer told Gardnerville’s RecordCourier newspaper. “This purchase demonstrates a commitment to Douglas County. It shows the people here that the process is moving forward.”

The parcel was the first of two the longtime county resident will need for his

proposed Jethro Bodine’s Beverly Hillbillies Casino & Mansion. He won’t purchase the remaining 20.78 acres until he has received the needed zoning changes and height variances for the casino, he said.

If approved, the casino would be part of the proposed 600,000-squarefoot Riverwood commercial development located along U.S. Highway 395 just

south of Carson City.

A 40,000-square-foot gambling area with 800 slot machines and 16 tables would be flanked by various eateries, including Jethro’s All You Ken Et Buffet. The project also would feature a showroom, cinema complex and a 240-room, five-story hotel.

Baer is the son of former heavyweight boxing champion Max Baer.

Clinton wants justice for all Former President BILL CLINTON told Middlebury College graduates Sunday they must consider everyone when they try to find solutions for the world’s problems.

“The bigotry you have to work hard to avoid is not seeing everyone else,” he said, touching on a campaign theme of his wife and presidential

hopeful, Sen. Hillary Rodham Clinton.

In his 20-minute speech before 600 graduates and more than 7,000 guests and faculty sitting outside on the Middlebury campus, Clinton told the seniors they must build community by focusing on the similarities among humans rather than differences. The key is “the elemental knowledge

that what we have in common is more important than what divides us,” he said.

Clinton received an honorary doctor of humane letters degree for his legacy of commitment to service, Middlebury President Ronald D. Liebowitz said.

Clinton said he first learned about Middlebury from Ron Brown, his late commerce secretary and

1962 Middlebury graduate who also served on the college’s board. Brown died in April 1996 in a military transport plane crash in Croatia.

“A kid who grew up in a hotel in Harlem found a home here because there is a community here in the best sense and that’s really what we have to build in the world,” Clinton said.
