THE DIGGING THE NEW YEAR ISSUE

Nativity scenes case appealed Plaintiffs rely on ‘heckler’s veto’ argument to continue fight BY ASHLEY ARCHIBALD Daily Press Staff Writer

DOWNTOWN The law firm defending Santa Monica’s nativity scenes has taken the case to the Ninth Circuit Court of Appeals after

a defeat in early December that left Palisades Park bereft of its traditional December decorations for the first time in almost 60 years. Federal Judge Audrey Collins dismissed the case on Dec. 7, siding with city attor-

neys who argued that the City Council was well within its right to ban the displays. That’s not the issue that William Becker, an attorney representing the Santa Monica

Sebastian LaRue has changed course and removed himself from USC’s 2013 football recruiting class. The Santa Monica High School senior verbally committed in the fall, but has since kept his options open, culminating in the decision to reopen the CLARK AND LaRUE recruiting process. “I just want to make the best decision for myself moving forward,” LaRue told the Daily Press Wednesday. “It was nothing [USC] said, I have just been thinking about this for a little bit of time now.” LaRue has trips to Texas A&M and Notre Dame in the near future. He has made official visits to Ohio State and Washington State and hinted that other schools have entered the discussion, most notably UCLA. He said that he doesn’t have a favorite. “I just want to make sure that the school I pick is also there for me as much as I’m there for them,” he added. Recruited as an athlete by USC, LaRue wants to play wide receiver in college or at least have an opportunity to play the position. LaRue, considered the 13th-ranked wide receiver in the nation by ESPN, made the announcement via Twitter on Wednesday while in Florida preparing for the Under Armour All-America Football Game, which takes place Thursday at Tropicana Field in St. Petersburg, Fla. LaRue is among at least four recruits who have withdrawn their commitments to USC in recent weeks. Despite changing his status, LaRue said that he hasn’t ruled out USC as his final choice. daniela@smdp.com
