Did you attend the Silent Auction and the Mayors Club preevent? If not, you missed a great event. We experienced energy, camaraderie and fun in a great atmosphere. We netted an impressive $19,600 - the best Silent Auction result since 2008!

Would you like to help with a cash donation to tip the scale over $20K? Start thinking about the Spring elections, and consider contributing to your Conduit account right now. The inaugural Mayors Club was a success! Over 80 of our members stepped up and joined the Mayors Club by donating a cash contribution or item valued at or above $100. Fourteen of our pro-growth elected officials joined them for the private reception prior to the Auction. Plans are also underway for additional Mayors Club gatherings throughout next year. I want to say a special thank you to Pete Stebbins for his dedication to this cause. He secures so many of our donations every year. Thanks to Andy Inman for hosting us at Bishops Bay. The space and the atmosphere were perfect for our event. To top it off, Don Tierney and Tyler Wilkinson added some zip to the live auction by serving as our “celebrity” auctioneers! Thank you to everyone else who was involved, especially those who helped recruit auction items, but also to everyone who attended and made a purchase. We’ve been picking a variety of locations for the Spike Dinner over the last few years, and this year it was held at the unique venue of Olbrich Gardens, where we celebrated our MABA Membership Recruiters and the addition of 23 new members during the October membership drive. Congratulations to you all, and great work this year! Last but not least..... step aside Home Products Show, and make room for the Dream Home Showcase! MABA and the HPS committee decided to rebrand this year, as the Dream Home Showcase. See more information in this newsletter, and get a look at the new logo online. It brings a new flair and refinement to the event. We expect it will help you, our members, to draw a crowd of qualified buyers and bring new exhibitors and energy to this event as well. Governor Celebrates New Fire Safety House with MABA On October 17th, MABA, along with the Dane County Fire Chiefs Association and Governor Walker unveiled a mobile fire safety house built by the labor and material donations from members of MABA with an official ribbon cutting. The small-scale home will be available for each Dane County Fire Department to use for fire prevention education. The newly constructed house replaces the aging existing fire safety house which has seen more than 10,000 visitors tour it annually. The new house will feature modern amenities found in contemporary homes in order to provide a venue for the Fire Chiefs and their staff to teach lifesaving lessons in a realistic setting. Good Things Happening in Fitchburg By Fitchburg Mayor Shawn Pfaff

We still have a way to go to get our economy back to where it was prior to the recession of 2008, there are definitely indications locally that we are starting to see our economy recover. One of those local indicators are the good things that are happening in Fitchburg. Fitchburg has seen significant economic investment occur over the past two and half years specifically culminating with Promega Corporation opening up its new $110 million corporate facility last month. Over the past several years, Fitchburg has made smart and timely public sector investments and articulated a vision of economic growth and collaboration with private sector stakeholders to position itself perfectly to take advantage of the expected upswing of the economy. Much of the credit for Fitchburg economic advantage has to do with its incredible location – just minutes from downtown Madison and to Epic – Dane County’s largest employer, its diversity of population and open space to grow but also to its elected leadership over the past three years. In 2011, Fitchburg elected a new Mayor Shawn Pfaff and several members of the City Council that believed (and have demonstrated) that Fitchburg can be a place where you can promote economic growth and protect the environment and provide amenities that improve residents’ quality of life. Since 2011, Fitchburg opened its first-ever library and splash pad water park, broke ground and opened an interchange off of Highway 14 that opens up eastern Fitchburg to modern development just minutes from the Beltline and has begun reinvesting in key parts of the City along the North Fish Hatchery Road corridor and by the Verona Road interchange in northwest Fitchburg. Efforts that are going on in Fitchburg makes me hopeful that 2014 can be a successful year for home building and business growth in our region.

Auction was a Tremendous Success The theme from this year’s event was clear – The Auction is Back! Over 120 members and their guests descended on Bishops Bay Country Club for MABA’s annual political fundraiser. After two years of partnering with the Realtors Association of South Central Wisconsin (RASCW) the auction had returned to an exclusively MABA event and the result could not have been more positive. We were able to secure an incredible facility courtesy of Andy Inman and the 120 members and guests that attended represented a 70% increase over last year’s attendance figure. It was also immediately apparent that the value and number of items for bidding had also increased from last year. Pete Stebbins and the Government Affairs Committee spearheaded the solicitation of items and they were met with an outpouring of generous support from MABA members. Overall, the event raised nearly $20,000 in political funds that are so critically needed to ensure that the voice of our industry is heard by lawmakers.

New this year was the Mayors Club Reception which was held immediately prior to the Auction. Members who donated an item or cash valued at over $100 were invited. Several of Dane County’s pro-growth elected officials joined the Mayors Club members for cocktails and conversation in an intimate setting. The event demonstrated to the elected officials that MABA members are united, organized and influential! The auction supports MABA’s Political Action Committee “PAC” fund and the Builders Direct Fund Conduit. The conduit program allows any member to make a contribution to any candidate of their choice but is routed through the conduit in order to make it clear that the donor is a Builders Association member. Members can contribute to the PAC and Conduit funds outside of the auction as well.

Dan Duren was the big winner of the evening outbidding his fellow Parade builders for a brand new well - the auction’s highest valued item.

Positive Changes to DATCP 110 Are on the Way! DATCP Rule 110 regulates home improvement sales practices in the State of Wisconsin. While new home construction falls outside the scope of “home improvement,” the Rule does affect more than just traditional remodelers as it applies to anyone who does work on an existing home like trade contractors, landscapers, painters, or companies who do service work. New home builders will be subject to the rule if they go back and work on a house that they initially built. Currently, this rule contains a litany of so-called “consumer protections” addressing warranties, contract terms, delays and disclosure requirements. The result is overly burdensome red tape to comply with that is unseen in other industries. Reform of this rule will make everyone’s life easier! Over the past year, members of the Wisconsin Builders Association (WBA) have been working with officials at the Department of Agriculture, Trade and Consumer Protection (DATCP) on improvements to the Rule. DATCP is now considering many very positive changes to DATCP 110 that WBA supports. Because this is an administrative rule, state legislation is not required and the rule can be amended through the unilateral action of DATCP which has been working collaboratively with our industry on improvements over the past year.

Rule Subjects Builders to More Red Tape

When the final revisions to the Rule are finalized and released in the coming months, WBA anticipates the Rule will be substantively changed bringing fairness to home improvement contractors. Stay tuned to celebrate yet another advocacy victory for the Wisconsin Builders Association!

Government Affairs Report All Eyes are on Washington DC for upcoming housing finance changes New guidelines for lenders will be announced in January In October, the Realtors Association of South Central Wisconsin (RASCW), the Wisconsin Mortgage Bankers (WMBA) – Madison Chapter and MABA collaborated to put on an industry wide seminar addressing the significant changes in mortgage lending regulations that will begin this January. We know that our industry is interconnected with many others, evidenced by NAHB’s finding that 3 fulltime jobs are created for every new single family residential home that is built. Clearly, the flow of credit that mortgage lenders provide to creditworthy borrowers is essential to the health and vitality of the homebuilding industry. On the horizon, there are several key new rules that will be coming out of Washington DC regulating the lending industry and thereby affecting homebuilders. Ability to Repay (APR) Definitions In the wake of subprime mortgage crisis, congress enacted legislation known as ‘Dodd-Frank’ that heavily regulated residential mortgages and added new requirements when lenders verify borrower’s “ability to repay.” The intent of this rule is to protect consumers from taking out loans that they do not have the financial means to repay. Although this has always been a prudent action taken by lenders, now it is required by law. This rule addresses what sort of documentation is required to obtain in the income verification process. For example, if a $5,000 cash deposit appears in your checking account for a loan repaid from a relative, I hope you forced your sibling to sign a promissory note because lenders will have to substantiate that $5,000 deposit with “sufficient documentation.” Lenders that do not comply face huge penalties in the way of fines and potential legal liability to borrowers. Accordingly, borrowers can expect increased scrutiny of their finances in the mortgage application process. Qualified Residential Mortgage (QRM) Rules In a nutshell, the QRM rules set forth by the Federal Housing Authority (FHA) establish what lenders have to abide by in order to protect them from liability. The criteria sets parameters for such things like the borrower’s income needed and loan-to-value ratios. When these guidelines are adhered to, the mortgage will be classified as a “qualified mortgage” and will insulate the lender from any liability stemming from a lawsuit where a consumer can allege that a loan was made to them when it was known that they would be unable to repay it. This is a common affirmative defense used by consumers who are going through foreclosure. New QRM standards will be released by the feds on January 10, 2014 so it is likely that mortgage underwriting will strictly conform to the new QRM standards promulgated at that time. A loan that complies with new QRM standards will be presumed to comply with the ATR rule. Future of Government Sponsored Enterprises (GSE’s) The federally funded and quasi-public agencies - Fannie Mae and Freddie Mac insure or own half of the nation’s $12 trillion dollar residential mortgage market. Fannie and Freddie were created to enhance the supply of credit and reduce borrowing costs to homebuyers. However, recently Fannie and Freddie have run large deficits as loans have failed and foreclosures have mounted and as a result a whirlwind of bills are swirling in the nation’s capital on how to wind-down Fannie and Freddie and remove them from receiving such a large government subsidy. While it is currently uncertain what action will ultimately be taken, one thing is for sure: Fannie and Freddie’s days are numbered. Andrew Disch J.D.
