RULES AND REGULATIONS REVISION NO. 1 Effective September 1, 2010 THE BALLANTRAE GOVERNING DOCUMENTS (BALLANTRAE AT CREEKSTONE DECLARATION OF CONDOMINIUM, BYLAWS, AND THESE RULES AND REGULATIONS) IDENTIFY REQUIREMENTS AND RESTRICTIONS FOR ALL UNIT OWNERS. CONFORMANCE WITH THESE REQUIREMENTS WILL ENSURE THAT THE COMMUNITY CURB APPEAL IS MAINTAINED AND THAT PROPERTY VALUES ARE PROTECTED FOR ALL RESIDENTS. KEY PROVISIONS OF THE GOVERNING DOCUMENTS ARE IDENTIFIED BELOW AND ARE APPLCABLE TO ALL UNIT OWNERS, THEIR TENANTS, GUESTS AND INVITEES:
I. PROHIBITED CONDITIONS: 1. Overnight vehicular street parking on Ballantrae Circle and the blocking of the street or driveways by parked vehicles at any time is prohibited. 2. The parking of a commercial moving van/trailer is not allowed in driveways of units. 3. Access within gated area of any RV, boat/jet skis, motor home, motorcycle or trailer is limited to four (4) hours. 4. Overnight parking of vehicles with commercial signage is prohibited. 5. The display of security system signage/placards in common or limited common areas is prohibited. (Limited common area is defined as porches, patios and decks.) 6. The display of Unit resale signs and information packet holder placement in the common or limited common areas is prohibited. 7. Statues, statuettes, sundials, ornamental lawn ornaments are prohibited in the common area, but allowed in limited common area provided that they do not exceed 3 ft. in height and shall be of dark bronze/black or concrete material or as approved by the Board. The maximum number of the aforementioned decorative items that may be displayed shall be two (2). 8. The adornment of mailboxes with balloons, seasonal decorations, support post vines/flowers is prohibited.
9. Decorative flags, bunting, exterior wall hangings/plaques (exception: hangings and plaques are permissible within a screened or enclosed veranda), wind chimes, etc. are prohibited. 10. The placement of bird or animal feeders of any type as well as the broadcasting of animal or bird feed on the premises is prohibited from all locations. Exception: feeding of fish in the water features is permitted. 11. Placement of artificial flowers in the common or limited common areas is prohibited.
II. RESTRICTED CONDITIONS: 1.
Residents are limited to two (2) vehicles per Unit (excluding the vehicle(s) of temporary guest(s)- (guest parking is limited to three (3) days unless prior written approval obtained from Board). Parking is prohibited in the driveway turn-around area. Clubhouse parking spaces are reserved for events only, with 12 hr. maximum.

Trash and recycle containers must be removed from curb on day of trash pickup. Place containers curbside on evening prior to pickup (7 p.m. or later).
3.
Hoses stored outside must be in approved containers (Pictures of approved containers attached).
4.
Resale “For Sale� signs (commercial grade only – no hand written) are restricted to window placement.
5.
Outdoor gas/charcoal grills must be shielded from view with solid dark tone colored cover when not in use.
6.
Garage doors must be maintained in fully closed position when not used for vehicle movement or when the garage is occupied. Exception: Doors may be left partial open (up to six (6) inches) during hot weather.
7.
Patio furniture cushions, pillows and umbrellas that are visible from the street must be solid muted tone colors that are complimentary to building color (not stripes, checks, patterns), or as approved by the Board. Umbrellas to be closed when not in use.
8.
Landscape planters allowed in limited common area and must be well maintained in terra cotta, beige or unfinished concrete containers.
9.
Prior written approval is required for all exterior modifications, including but not limited to, stepping stones, additions of any kind, fences, walls, wall hangings, patios, decks, etc. Any repairs/replacement of exterior walls, siding, etc. that may be required due to Owner attaching any item to the exterior of Unit will be paid for by the Unit Owner and not the HOA.
10. Decorative holiday door wreaths are permitted from Thanksgiving to January 7th of the following year. Other holiday lights/decorations are allowed in limited common areas only and within the same time frame. 11. Restrictions on animals/pets are covered in the governing documents. No structure for the care, housing or confinement of any pet shall be constructed or maintained in the common areas. Dogs are to be on a leash at all times, and a fine may be imposed for not picking up after your pet. 12. The American flag may be displayed provided that flag protocol is observed.

The Rules and Regulations have been prepared to highlight key provisions of the governing documents and to provide a ready reference to unit owners. Non-conformance with the governing documents may result in the imposition of monetary fines and loss of community privileges. At the discretion of the Board, a fine of $100 may be imposed for the first offense and $150 for second and subsequent offenses. Parking violation fines may be assessed without the benefit of a remedy period.
