CBA Update
The long overdue updated CBA between Local 104 and Bay Area SMACNA has been completed and will be published soon. If you are dispatched to an employer or on the Out-of-Work List in the CBA area, you should be receiving a hard copy within the next few months.
In 2024 we will be focused on updating the following CBAs: Silicon Valley Contractors Association Building Trades, Monterey Bay Area
Contractors Association Building Trades, Bay Area SMACNA Residential, Silicon Valley Contractors Association Residential, Sacramento SMACNA Building Trades, Northern San Joaquin SMACNA Building Trades for Stockton/Modesto Building Trades, Central Valley SMACNA Building Trades, Tri-Counties SMACNA Building Trades, and Dependable Sheet Metal Residential.
For decades in the 14 northern counties of District 1 (excluding San Francisco) under the Building Trades Agreements, many members have enjoyed the alternating 40/32 swing Friday workweek. Of course I understand there are reasons why some members may volunteer to work their swing Friday for straight time. Still, there are many members who enjoy taking their swing Friday. If you volunteer to work your swing Friday and work the following day (Saturday), Saturday shall be paid at the double time rate of pay. You should be following a swing Friday schedule to make certain you are being compensated appropriately. Recently someone mentioned they were told that you need to work two consecutive Saturdays in order to be paid at the double time rate. That statement is inaccurate.
On the next page is a 2024 swing Friday schedule. Your employer or their designee should assign your swing Friday. However, if they do not, ask. Should you be told that your employer does not take swing Fridays on a job or in the shop within the above noted counties, whoever
is telling you this is in violation of the CBA and is placing the employer at risk of a grievance, and all members involved of being brought up on charges for violating the terms of the CBA. Therefore, if someone has told you that your employer does not take swing Fridays, it is your responsibility to let a Local 104 Business Representative know. If necessary, you can do so confidentially. Also, should your employer not follow a swing Friday schedule, please let a Local 104 Business Representative know so the issue can be addressed immediately. Should your employer request you move from Group A to Group B, or from Group B to Group A swing Friday, you will be paid overtime for two Fridays in a row if you work both, or one if you work one of the two Fridays and take the second Friday off. There may be a chance that you are working on a project that falls under the Light Commercial Agreement as defined in Addendum Two of the CBA and being compensated at the Building Trades rate. If that is the case, the swing Friday schedule is not applicable. However, if you are bouncing between commercial
and light commercial projects, contact a Local 104 Business Representative to ensure you are being compensated correctly. Please remember it is your choice to: a) take the swing Friday off; b) volunteer to work the swing Friday for straight time; or c) only work a swing Friday if your employer is willing to pay you overtime to work that day. As a reminder, anyone who discriminates or retaliates against a member over this issue is subject to a grievance and charges under our Constitution for violating the following language. It should be noted that when working in San Francisco on Building Trades projects, the workweek is 7 hours per day, 35 hours per week in the field. Upon approval, there is also an alternative to follow the 40/32 workweek in the shop.
ITEM 7. WORKWEEK - HOURS AND OVERTIME
SECTION A. The workweek shall be scheduled in two (2)-week increments consisting of a forty (40)-hour week (eight [8] hours per day between 7:00 a.m. and 3:30 p.m., Monday through Friday) and a thirty-two (32)-hour week (eight [8] hours per day between 7:00 a.m. and 3:30 p.m., Monday through Thursday) and shall continue to alternate in such 40/32 manner. No employee shall work more than seventy-two (72) hours in any scheduled two-week increment for any one Employer except at the overtime rate or as otherwise provided herein. The Employer may use, but must pre-schedule, alternate crews.
Where an Employer, who is signatory to this Agreement, can provide the work, any member of the Union may voluntarily work forty (40) hours per week at the straight time rate (eight [8] hours per day between 7:00 a.m. and 3:30 p.m., Monday through Friday) should such a member desire. Where possible, said member shall notify his/her Employer two (2) working days in advance of his/her desire to work Friday, for a total of forty (40) hours that week. There shall be no discrimination or retaliation by an Employer against a Union member who elects to work a 40/32 swing Friday workweek. Such action shall be a violation of this Agreement. The purpose of the voluntary forty (40)-hour workweek proviso is to assure, whenever possible, the filling of job requests, while protecting the right of the individual employee to elect not to work said voluntary forty (40)-hour workweek. Any Employ-
er found in violation of the above provision shall be subject to the revocation of the right to continue the voluntary forty (40)-hour workweek. The LJAB is hereby instructed to give credence and special weight to apparent patterns and practices and/or circumstantial evidence involving alleged violations. In addition to the foregoing, the minimum penalty for each such violation shall be five hundred dollars ($500.00), payable to the SMW Local 104 and Bay Area Industry Training Fund. The voluntary forty (40)-hour workweek provision may be voted on each year by the members of the Union to discontinue its practice. In addition, where serious adverse employment conditions exist, the Union may discontinue the voluntary forty (40)-hour workweek.
SECTION B: Time and one half (1½) shall be paid for the first eight (8) hours on a swing Friday to a member who has not volunteered to work for straight time or a Saturday during normal work hours. However, if the Saturday to be worked follows a worked swing Friday, where a member has volunteered to work for straight time rate of pay on Friday, Saturday overtime shall then be paid at the double time (2) rate.

Update Your Beneficiaries
When was the last time you updated your beneficiary designations? For the past five years as a Trustee on the Supplemental Pension plan, I am continually surprised to learn that members have outdated beneficiary designations. It is so important that after marriages, divorces, births, deaths, and other major life events, members check and, if necessary, update beneficiary cards. One good recommendation I received recently is to set a calendar reminder every 5th birthday to review your beneficiary designations no matter if there are changes or not.
To make changes to your beneficiary designations: District 1 and 2 members can contact BeneSys at 925-208-9999; and District 3 members can contact Sheet Metal Workers’ Trust Funds of Southern California, Arizona, and Nevada at 800-947-4338.

MAKING YOUR DUES PAYMENT:
Reminder that the JAMS autopay has been set up, which is a “set it and forget it” approach to paying your monthly membership fees. In your JAMS portal or mobile app, you can set up a payment card, or now use your bank account. Either option you select, will be charged once a month for membership fees owed, or you can make a one-time payment. Autopay through JAMS saves you money and time.

2024 Scholarship Applications
The 2024 Robert G. Mammini SMW Local Union No. 104 Scholarship Trust Fund applications will be available in January 2024. To date, your Union has awarded over 1,200 scholarships to Local Union No. 104 members and their legal dependents totaling more than $7.8 million. To be eligible, a member must have been employed under an agreement which contains the provision for the contribution to the scholarship fund.
There are currently three (3) Robert G. Mammini SMW Local Union No. 104 Scholarship Trust Fund applications available. The Merit Scholarship awarding $7,500, the Mechanical Engineering Scholarship awarding $25,000 (offered to one applicant per year), and the new Graduate/ Advanced Degree Scholarship awarding $50,000 (offered to one applicant per year). BONESO BRINGING THE ARCTIC COLD TO THE TRI-COUNTIES

Boneso Plumbing and Mechanical stands as a force in SMW 104’s District 3, with an expertise that made them the right contractor for the Arctic Cold Ag Freezer Facility Project. Nestled in Santa Maria, California, this venture has provided the Boneso team with a stage to showcase their expertise and resourcefulness.
Their journey with the Arctic Cold project commenced in December 2022, coordinating the ductwork materials needed for the job. The subsequent months of May and June in 2023 were marked by a dedicated team, tirelessly installing hangers and seismic supports, gearing up for the complexities that lay ahead.
The true litmus test arrived between July and October
2023, where Boneso’s laborious efforts shone through, culminating in an astonishing 1,803 hours clocked in August alone. The challenges were multifaceted, including intricacies within the ductwork and structural elements.
As of now, the crew is deeply engrossed in adding the finishing touches and managing change orders, a commitment that will extend into January 2024. The Arctic Cold project has proved to be a source of immense pride and achievement for Boneso Plumbing and Mechanical and its proud Local 104 team.
A standout feature of this project is the unwavering commitment to meticulous specifications. Notably, all duct hanger rods demanded secure fasten-
ing to trusses or supplementary steel structures, a requirement encompassing a substantial 75% of the project. The project’s complexity is further amplified by the need for rod stiffeners on hanger rods exceeding 24 inches in length, underscoring the dedication of Boneso’s proficient sheet metal workers. The challenges, however, stretch beyond aesthetics, as the sheer size and elevated placement of the ductwork present formidable logistical hurdles.
Most strikingly, the majority of the ductwork hovers at a lofty 30-foot elevation, necessitating creative installation techniques involving 20-foot lengths and the use of scissor lifts or boom lifts for efficiency. Early on, the project grappled with challenges from the wind

and dust due to its proximity to strawberry fields. Yet, as the construction advanced and the building became increasingly enclosed, these issues were effectively resolved, leading to a more favorable working environment.
The Arctic Cold project serves as a striking testament to Boneso Plumbing and Mechanical’s unwavering pursuit of excellence. From meticulous coordination to rigorous installation, their work underpins their reputation as a preeminent plumbing and mechanical contractor in District 3. Our members’ ability to adapt and innovate when faced with unique challenges solidifies their position as skilled and trained industry leaders, paving the way for continued success and recognition.

Sheet Metal shows force in Sacramento for the City-Wide CWTA Renewal
Nearly 40 dedicated members of SMW Local 104 turned out for the Sacramento City Council Meeting to rally behind the renewal of the city-wide Community Workforce Training Agreement (CWTA). They joined forces with counterparts from other Building Trades Unions to vocally endorse the agreement.
The Sacramento City Council sealed the deal with a unanimous 7-0 vote, ensuring the extension of the Sacramento city-wide CWTA, a momentous victory for working families. The revitalized CWTA not only guarantees ongoing job opportunities for union members but also promotes apprenticeship programs and gives precedence to local workers’ employment. This resounding consensus on the renewal highlights the success of the initial CWTA, as City Council members unanimously voiced their support, signifying a remarkable shift from the opposition encountered five years ago.
Sacramento is another shining example of organzing and activating our membership to fight for working families across Local 104.
South Bay Showing up!
The dedicated South Bay Campaign for Jobs team has been putting in great effort. A group of Local 104 members recently paid a visit to Alviso, working diligently to clear the brush around the nesting area of the local Burrowing Owl. When these feathered friends are in need of help, there will be no need for them to wonder “WHO?” because they already recognize that Local 104 stands firmly by their side.

Simultaneously, in San José two teams of volunteers from the Sheet Metal Workers’ Local 104 CFJ crew teamed up over 80 volunteers for District 8 City Councilmember Domingo Candelas’ Autumn Litter Harvest. The teams dedicated their day to enhancing the community by helping volunteers collect 70 large garbage bags with litter, weeds, and other yard waste from local parks around the area.

JATC UPDATES & Announcements
JATC Update - District 1
The training program continually reviews and revises all curriculum in the effort to support the training needs of members and contractors. This includes adding 3rd party certifications throughout all 5 years of the 3 separate programs, Sheet Metal, Service and TAB. From 1/1/2023 to date the program has held:
Over 800 ICB Certification exams covering:
•Fire Smoke Damper Technician
•Smoke Control Systems Technician
•Indoor Air Quality Technician
•Duct Air Leakage Testing Technician
•Building Envelope Installer Technician
•Mechanical Acceptance Test Technician Level 1 & Level 2

Over 100 service based ESCO certification exams covering:

These numbers do not include OSHA 30, First Aid and CPR certifications that all apprentices receive. In 2024 the AWS Brazing certification will be added to the service curriculum.
JATC
Outreach:
The training program’s full time Outreach Coordinator Henry Funcke oversees all outreach events in the Bay Area. Henry has participated in over 200 outreach events to date in 2023. With one point of contact covering all 5 JATC’s, the program is able to participate in more viable outreach events and have a more consistent voice in recruiting.
Dusty Robotics:
The training program has developed a partnership with Dusty Robotics. In working with Dusty a 3 level training program has been developed resulting in a Dusty Robotics certification exam in the final classes.
With this certification, any contractor who has a Local 104 member that has achieved the Dusty Robotics certification, is not required to engage Dusty Robotics staff for training prior to implementation, saving the contractor time and money.
STRATUS Curriculum:
The training program is currently working with STRATUS to develop curriculum for the future training opportunities in the software. STRATUS is an add-on to the REVIT library to create efficiencies in work flow in detailing, shop fabrication, field installation and job completion. The training program feels that the Livermore facility with its technology labs, steel structure and fab shop area will allow members to be trained in all facets of STRATUS. For any questions on STRATUS and its implementation, speak with Nate Vennarrucci.
Partnership Foothill College:
The training program has begun the official submission process with Foothill College to recognize the apprentice curriculum as an associate degree program. The training program has been working with Foothill over the last several years in preparation for this. Once approved all future graduates of the apprenticeship program will have the ability to receive an associate’s degree from Foothill College upon successful completion of the apprenticeship program.
Northern California Valley Sheetmetal Training Center
Service Lab Upgrade:
The training center has purchased a new Enviro-Tec air handler with a chilled water-cooled coil and hot -water preheat coil. This air handler is served by a 20-ton air cooled chiller and a high efficiency boiler. The system delivers air through 3 new Variable Airflow boxes. The entire system is controlled with a new i-Vu DDC system. This also features a refrigeration monitoring system for safety in the event of a leak and provides an opportunity to train the apprentices with this type of control scenario. The system is up and running complete with owner training provided by Air Systems Service and Construction.
A pneumatic trainer is being added to the TABB lab with options for direct acting and reverse acting. The Sacramento area still has numerous buildings that rely on pneumatic controls, this is an an important skill



for apprentices to possess as pneumatic knowledge seems to be dwindling as members retire.
SMUD Shine Grant:
The Sacramento training center has been awarded a grant from SMUD under their “SMUD Shine” program. We received two High Efficiency and two Low Efficiency HVAC split systems and two 5-ton package units. We also received one 3-ton Water Source Heat Pump as well as a chilled water heat exchanger. The heat pump is now installed along with the heat exchanger with the rest of the equipment on track to be fully installed by the end of the year.
New Detailing Instructor hired:
Let’s welcome our new staff member, Marcus Stratton, Lead Detailer at Southland Mechanical. The class focuses on computer programs such as Bluebeam and AutoCAD with emphasis on Revit to focus on current industry trends.
New Laser Welder:
Thanks to an ITI grant, we now have a new IPG Laser Welder. This will expose our apprentices to emerging technologies as well as give our contractors the opportunity to try it firsthand to determine if it is a tool they would like to incorporate into their shops.
CTWI/LOCAL 104 - Open House at the East Bay JATC
Over the Summer, Sheet Metal Workers’ Local 104, in collaboration with CTWI, had the privilege of hosting an event that brought together 42 esteemed elected officials to witness more than 50 talented graduates from MC3 as they explored the Sheet Metal craft. The atmosphere buzzed with energy as these brilliant individuals learned more about the workings of our trade. The event served as a showcase of the unwavering dedication and hard work of our Sheet Metal Workers and the exceptional CTWI staff. It was truly inspiring to observe the strong connection between education and its practical application, particularly for those in underrepresented and disadvantaged communities. We extend our heartfelt gratitude to everyone who contributed to making this event an overwhelming success.

KIANA DIZON
5TH YEAR APPRENTICE DISTRICT 2
Kiana Dizon, a dedicated 5th-year apprentice in District 2, hails from the city of San Leandro but currently calls Tracy, California her home. Her willingness to step up for the Union has gained her recognition amongst her peers and leadership.
From a young age, Kiana harbored a strong desire to avoid trouble, channeling her energies and passions into creative pursuits. Her artistic inclinations led her to the world of music, where she explored various genres, including indie, punk, hardcore, and even the intricate realm of composing 8-bit music.
Beyond just making the music, Kiana immersed herself in the local punk scene, devoting her time to organizing and helping run local punk shows. In doing so, she not only contributed to the vibrant Stockton music scene but also cultivated a profound sense of camaraderie with fellow scene members. This social skill she honed seamlessly translates to her involvement in the Union, where fostering workplace solidarity and maintaining

strong interpersonal relationships are paramount.
In 2019, Kiana was organized into the Union, a significant milestone in her journey. Since becoming a member of Local 104, she has participated in various projects ranging in size, with one notable example being the Great Wolf Lodge in Manteca, California, where her primary focus was installing kitchen equipment. She now finds herself employed at Comfort Air, a company specializing in the meticulous installation of heating, ventilation, and air conditioning systems, with its base of operations in Stockton.
Kiana’s commitment to the Union and the craft made her an obvious choice to represent Local 104 at the 2022 NABTU Tradeswomen Build Nations Conference, the largest gathering of tradeswomen in the world, held in Las Vegas. She keenly understands the vital importance of active participation within the union, as evidenced by her involvement in Campaign for Jobs actions, where she proudly shows her support for labor

standards and Union solidarity at city council meetings and diligently participates in various union-related events.
Kiana’s dedication to her work shines through not just in her actions, but also in her words: “I want to be the best person on the team, I’m proud of my work, I think that’s important.” This resolute commitment is also demonstrated in her preference for working in the shop, stemming from her machining background. Here, she leverages her exceptional precision in measuring and adhering to specifications, underscoring a commitment to accuracy.
