“How To” Protect yourself after sustaining an injury in the workplace

Injuries that occur at work are often immediately accompanied by feelings of concern, thoughts about the future, and worries about financial well-being. Those thoughts, on top of the pain you experience after sustaining an injury, can make it impossible to know what to do next. The goal of this article is to help you become knowledgeable about how to handle the situation without the stress of the pain and those emotions weighing you down.

After any injury, it is imperative that you report the injury to someone in a supervisory setting whether it be a manager, safety personnel, or team lead. The requirement in Illinois is that any injury be reported to your employer within 45 days of the injury’s occurrence. The reporting of the injury can either be verbal or in writing, but an individual should ensure there is a written account of the incident which has been turned into their employer to ensure proof of notice. Once given, the employer should turn the claim over to their insurance carrier. You should immediately seek medical treatment, and that claim information should be readily available at the outset of the claim for bill processing purposes. All medical should always go through the workers’ compensation carrier as it should for the entirety of the claim, barring outside independent medical evaluation opinions which may affect the medical

approval of your injury.

You are entitled, among other things, to the payment of all reasonably related medical treatment which arises out of and is related to the injury in question. It is important to note that an employer is entitled to what is known as an Independent Medical Evaluation under Section 12 of the Act wherein the employer pays for you to attend an appointment, and pays for your mile-

age to attend said appointment, with a physician of their choosing. That physician is not YOUR physician, which is an important distinction, because this physician will not personally give you advice or opinions regarding your medical care. These opinions often become a crucial part of your regular and continuing care.

Throughout the course of the claim, your employer or their insurance representative may hire a surveillance team or individual to follow you to confirm your actions and abidance by restrictions or to verify your injury. It is difficult during an injury, especially if you are home and off work feeling as though you are not contributing in the same way to your family as you are generally accustomed to, to not attempt to do tasks which you might otherwise do in an effort to still feel like you’re contributing to your family’s success, even if completing those tasks results in pain which may set you back a few days. It is imperative to follow your restrictions, listen to your doctor, and be honest and consistent about your pain levels, activity abilities, and difficulties with activities of daily living so that your records and reporting are consistent throughout your claim and at hearing.
