State, federal lawyers in court to argue Trump travel ban SAN FRANCISCO (AP) — State and federal lawyers will argue before a panel of federal appellate court judges Tuesday in the pitched fight over President Donald Trump’s travel and refugee ban that could reach the Supreme Court. The legal dispute involves two divergent views of the role of the executive branch and the court system. The federal government maintains the president alone has the power to decide who can enter or stay in the United States, while states suing Trump say his

executive order is unconstitutional. Seattle U.S. District Judge James Robart, who on Friday temporarily blocked Trump’s order, has said a judge’s job is to ensure that an action taken by Robart the government “comports with our country’s laws.” The Justice Department filed a new defense of

Trump’s ban on travelers from seven predominantly Muslim nations as a federal appeals court weighs whether to restore the administration’s executive order. The lawyers said Monday the travel ban was a “lawful exercise” of the president’s authority to protect national security and said Robart’s order that put the policy on hold should be overruled. The filing with the San Francisco-based 9th U.S. Circuit Court of Appeals was the latest salvo in a high-stakes legal fight sur-

rounding Trump’s order. Washington state, Minnesota and other states say the appellate court should allow a temporary restraining order blocking the travel ban to stand as their lawsuit moves through the legal system. The judges hearing the arguments — two Democrat-appointed judges and one Republican appointee — are from a randomly assigned panel. The appeals court over the weekend refused to immediately reinstate the ban, and BAN | 2A

Creston Community School District will implement an Instructional Support Levy after the Board of Directors voted 4-1 in favor of participating in the Instructional Support Program during Monday’s public hearing and board meeting. The board received no written comment for or against participation in the Instructional Support Program and the public hearing drew no attendants from the public. Prior to voting, board members discussed concerns about rate and tax increases looming for several other entities. “Obviously, with the ag economy where it’s at today, it’s not the best time to be squeezing everything together,” Board President Dr. Brad James J a m e s said. Creston Community School District was one of

only five districts in the state of Iowa not utilizing an Instructional Support Levy, after another district recently approved one. ISL allows a school district to increase its spending authority by a maximum of 10 percent. Instructional Support is a levy that can be generated from property taxes, income surtax or a combination of both. Currently, a portion of property taxes paid by residents in the school district fall under the cash reserve levy. The cash reserve levy, however, does not provide the school district with any spending authority. “You’ve talked to other superintendents who have an Instructional Support Levy,” Board Member Galen Zumbach said. “ W h a t have they shared with you? Why did they do it and Zumbach why has it benefited their district?” SCHOOLS | 2A

Iowa House OKs K-12 budget amid claims it will hurt schools DES MOINES (AP) — The Iowa House has approved a bill increasing K-12 education spending by 1.1 percent, a move school officials say will result in larger classroom sizes and school district shortfalls. T h e H o u s e Branstad

approved the measure late Monday. The Senate already has passed the bill, which now goes to Gov. Terry Branstad. Before the vote a group that included school board members, parents and students gathered at the Capitol in opposition to the legislation, which adds about $40 million to a roughly $3 billion education budget. Republican lawmakers say the small increase is all the state can afford.
