CORYDON — After spending a majority of Monday selecting the jury, the first witness took the stand and answered the plaintiff attorney’s questions to end the first day of the civil lawsuit of Steve Green vs. City of Creston, Water Works Board of Trustees. Jury selection started at 10:15 a.m. Monday. The 10 jurors – two will be named alternates before deliberation – were finalized just after 3 p.m. Opening statements started at 3:22 p.m. with one of Green’s at-

torneys, Michael J. Carroll, addressing jurors first. Green is also represented by Richard Owen McConville. Patrick D. Green Smith, representing the Creston Water Works Board, followed with his opening statement. Green’s attorneys called Cheryl Eblen, former office manager for Creston Water Works, as the first witness. Court dismissed for the day at 4:31 p.m. and reconvened this

morning around 9:30 a.m. Plaintiff statements Carroll described the case as a “disagreement between my client and his former employer” to the jury to start his opening statement. “This lawsuit is about a breach of contract,” Carroll said. “My client had a contract with this employer … that contract was in writing, it had terms, there were two parties to the agreement – my client and his employer, the water works board of trustees – and this case is about why was that contract violated, how was that contract violated.” He showed the jury the 12th paragraph of Green’s contract,

where it highlights Green could receive a payout for his sick and vacation time if he was terminated or retired as Creston Water Works General Manager. Carroll said Green was in regular contact with the board and some things had to be done between the meetings. He added it was not unusual for Green to interact with former Creston Water Works Chairman Dennis Bailey or other members of the board. “A lot of times how they did things there, like how they do things in a lot of small communities, is sometimes with a handshake, where your word is your bond, where if you tell somebody I

am going to do something for you, then you expect it to be done,” Carroll said. “That is how Steve Green did his business for 32 years with the city of Creston Water Works.” At the end of his opening statement, Carroll referred the jury back to Green’s contract. “There is no dispute about one thing,” Carroll said. “There is no dispute about what paragraph 12 says.” Defense statements Smith’s opening statement to jurors started with employees sick Please see TRIAL, Page 2

Pudenz is currently a deputy in the Union County auditor’s office where she’s in charge of IT and real estate transactions. She’s held that position for seven years. Pudenz, 44, has a business administration degree from Iowa State University. “This was an opportunity to advance my career with the county,” Pudenz said. “There is certainly a lot I have to learn, but I will commit the time and dedication necessary for a smooth transition. I want to thank the conference board for giving me the opportunity and am excited to get started with the duties of assessor.”

reston Future Business Leaders of America and Creston middle and high school student governments will host a purple out Thursday during a Creston/Orient-Macksburg wrestling meet. The purple out, headlined as “Pinning for Preemies,” was organized to raise money for March of Dimes, a national organization dedicated to research and prevention of premature births, birth defects and pregnancy difficulties. “Last year, we did a wrestling meet for the March of Dimes, and this year we wanted to add to it and raise a little bit more money,” said Creston High School senior and FBLA member Raegen Smith. The students’ goal is to raise $4,000.

in more people besides just wrestling families, and we thought that would be a good way.” The carnival will start at 4:30 p.m. in the commons area at Creston High School, and tickets are five for $1. The wrestling meet against Clarinda and Atlantic is scheduled to start at 5:30 p.m. in the high school gymnasium. “We have bingo, and a cupcake walk, and find a pacifier in a haystack,” Abell said. “All the games are kind of baby themed. They all tie back to the March of Dimes’ baby cause.” T-shirts were sold before the wrestling meet, but will also be for sale for $10 on a first come, first serve basis Thursday night. Those who attend may also pledge money per each Creston/O-M pin against the rival teams. Audience members are encouraged to wear purple in support of the event, and Creston/O-M wrestlers

Students at Creston elementary, middle and high schools, Early Childhood Center, St. Malachy School, Mayflower School and Orient-Macksburg School are all participating, and all money raised during the war and other events will go to March of Dimes.
