by Mike Andrew SGN Staff Writer A Transgender high school student in Kenosha, Wisc., has a right to use the restroom that corresponds to his gender identity, a federal appeals court ruled on May 30. A three-judge panel of the 7th Circuit Court concluded that Ash Whitaker was protected under Title IX of the 1974 Education Amendments, barring discrimination on the basis of sex in federally funded
schools, and the equal protection clause of the 14th Amendment. The 7th Circuit upheld a decision by a lower court ordering the Kenosha School District to allow Whitaker to use the boys’ restrooms at school. “[A] policy that requires an individual to use a bathroom that does not conform with his or her gender identity punishes that individual for his or her gender nonconformance, which in turn violates Title IX,” the 7th Circuit panel said in a unanimous decision. The school district “has not demonstrated that it will suffer any harm” from complying with the lower court’s order, the court ruled. On the other hand, Whitaker suffered daily humiliation by being singled out by school staff. “The harms identified by the School District are all speculative and based upon conjecture, whereas the harms to Ash are well-documented and supported by the record,” Judge Ann Claire Williams wrote for the panel.
