Colorado offers up a Constitutional fourteener Trump just can’t climb

W

hat now seems like a very long time ago, like most Americans, I relished the phrase, “anyone can become president.”

That was then, when the race to the White House included aspiring leaders like Mitt Romney, whose biggest oddity was that he was Mormon and whose public shame was making his dog ride in a carrier on top of the family car.

Compare that to the current favored GOP nominee, who had to pay millions to a woman he was accused of sexually assaulting in a dressing room and can’t be on the Colorado ballot because of his deep involvement in the Jan. 6 failed insurrection.

Trump, and his zealots, argue that it’s “undemocratic” for the Colorado Supreme Court and the Maine secretary of state to hold Trump to the same law that everyone else must abide by.

It’s true, once you reach 35, anyone born in the United States can become president, with one exception: Donald Trump.

Trump isn’t ruled out as a presidential candidate because of his incredible passion for lying, so much so that for the first time I can remember, everyone in the media freely calls out Trump for his voracious appetite for lies and disinformation.

Nobody is arguing that he can’t run for president because of his vast deceits, or that he paid hush money to an adult film actress from his campaign funds. In fact, there really wasn’t a question about whether Trump could run for president again after stealing and harboring hundreds of highly sensitive classified documents in his Florida home. That was after a strong majority of voters pushed him out of the White House, after his failed insurrection failed to undo that.

There’s nothing in the Constitution that explicitly says you can’t run for president if you keep the nation’s blueprints for nuclear war in a box next to your Mar-A-Lago poo poo or in a coat closet.

There’s nothing in the Constitution that says you can’t run for President, like Nikki Haley is, if you tell people that the Civil War broke out in the United States because of something to do with “the freedoms that people could and couldn’t do.” When a man who was listening to her bizarre response at a rally pushed back and said he was shocked she didn’t even mention that slavery thing, she said, “What do you want me to say about slavery?”

Nothing else, Ms. Halley. You’ve said it all.

She’s a dream candidate for democracy, however, compared to Florida Gov. Ron DeSantis. DeSantis can also run for president even though he just can’t say enough bad about

gays, transgender citizens, their parents, Disney, vaccines, Muslim, books and people who think women should make their own healthcare decisions. DeSantis paints a picture of himself so vile that only 60% of Florida could tolerate him, and no one else.

Even Robert F. Kennedy Jr. king of the kray kray konspiracies, can’t be kept off the ballot. Even though he thinks Wi-Fi makes your brain leak and AIDS is caused by something besides HIV and vaccines are poison and Ashkenazi Jews and Chinese can’t get COVID and mass shootings come from prescription drugs, Kennedy speaks for himself.

Congressperson Pat Schroeder could have run for president, even after she cried in public. Arizona Sen. John McCain could have run for president even after handcuffing his campaign to Alaska Gov. Sarah Palin.

Only Donald Trump’s presidential campaign has been derailed by Colorado’s newest fourteener, the third clause of the 14th Amendment.

After the Civil War — which had everything to do with slavery — the U.S. ratified the 14th Amendment to guarantee rights to former slaves and more.

“It also included a two-sentence clause called Section 3, designed to keep former Confederates from regaining government power after the war,” according to an Associated press story last week by Nicholas Riccardi.

“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

Until Jan. 6, anyone, even Trump could become president.

But clearly understanding that allowing undemocratic racists to run the country would undermine what everyone else is trying to do here, post-Civil War congress changed the rules. The unequivocal rules are, Trump and the few thousands of his minions who also participated in the Jan. 6 insurrection can’t run for president, or anything else.

So let’s spend our time for the next 10 months arguing about candidates who can legally take the oath of office next year.

Put the pedals to the mettle and make commuting bike friendly

T

here is the wheel-life solution to the metro-area’s pervasive traffic solution: When it comes to getting people on bikes where it’s safe to ride, build it and they will come.

With the state Legislature poised to convene, new city council members in place, and potentially new county commissioners this fall, transportation plans and challenges will be moving to the forefront.

It’s far past time to put bikes on a metro path to a better future for everyone.

While metroplex and state lawmakers have made great strides in improving acces to the region and safety for recreational bikers, bicycle commuting badly lags.

It’s not nearly what’s needed to change suburban bicycling from something you can stressfully do if have to instead of something you want to do because you easily can.

With not just the advent of electric-assist bikes, but the proliferation of these vehicles, creating a safe and dependable way to integrate bikes into the metro transit mix is overdue.

It’s a complex problem that demands complex solutions. Like all other metro suburbs, Aurora and the metroplex was created around the automobile. Our streets were designed to accommodate a river of large, fast-moving cars and, at best, tolerate pedestrians.

Bikes were toys. For the past 50 years, Aurora streets have been absent almost any accommodation to bikers. There are routes in the city that don’t even have sidewalks, even though they border densely populated neighborhoods, sometimes where children walk to school.

During the 1970s and 1980s, the city catered to developers and have created a maze of problems for anyone who isn’t traversing in Aurora in a car. The city is plagued with RTD bus stops that are difficult to get to for bikers and pedestrians.

It’s simply not enough to accommodate people who are willing and often anxious to improve their health and commute by either walking, biking, riding public transportation or all of those at the same time.

The more people get anywhere without a car, the better it is for everyone in the metro area. Rather than making it difficult for these commuters, Aurora, and every flavor of government, should be encouraging and rewarding bike and pedestrian commuters. We don’t have to look any further than numerous European cities to see how best to successfully mix cars and bikes in the same space.

For decades, the Netherlands has created urban and suburban street systems and safely get people on bikes and inside cars where they want to go safely and efficiently.

Aurora and the region must focus on three things that other cities have already learned and implemented.

First, the city must dedicate physical space in the way of clearly marked bike lanes along almost every major Aurora route. This means dedicated, and preferably, segregated bike lanes, even at the expense of car lanes along routes such as Colfax, Havana, Peoria, Chambers and Buckley Roads.

Second, and most important, intersections must be changed to accommodate bike and pedestrian traffic. Holland cities such as Amsterdam and others have long used simple and inexpensive designs that allow heavy bike and car traffic to move through the same space safely and efficiently. Currently, numerous American cities are experimenting with ways to tweak those intersection designs and make them work even better in U.S. suburbs.

Downtown Denver is experimenting with lane segregation on popular and busy streets, such as 14th Avenue from Speer Boulevard to and beyond the State Capitol. This experiment should be reviewed regularly by local transportation officials.

Third, Aurora, and the entire region, must created a prolific and high-profile campaign to teach the public to be aware of bikers and pedestrians, give them deference and ensure their safety.

Colorado and the metro area are perfect places to move people out of their cars and onto bike seats because the area is relatively flat and the weather is unusually temperate year-round. People often quickly find that biking is easier, faster and far more efficient than they anticipate. It’s certainly an important part of a healthy lifestyle.

And it makes getting around easier not only for those who step up to the pedals but those who chose not to. Without serious and sustained change and street design, however, it’s never going to happen.

Biden gets a GOP political lifeline

F

or three years, the Biden administration has engaged in denial, blame shifting and halftruths before conceding the southern border is in crisis.

The change in attitude burst into the open earlier this month, when the president said “significant compromises on the border” would be considered by the White House to stem the unprecedented flood of illegal immigration into the United States.

The president’s remarks changed the dynamics of the debate but infuriated the party’s progressive left wing, who accused the administration of caving in to Republican demands and returning to Trump era restrictive policies – denial of asylum claims, arrests and deportations – the president himself repealed.

The American people would be encouraged if they believed the change represented an epiphany, an awakening in the administration that its refusal to act exacerbated the financial and humanitarian crisis that has befallen communities along the southwestern border and a number of major American cities.

It didn’t.

The administration’s hand was forced by a major dose of power politics, an “I’ll-give-you-what-youwant-if-you-give-me-what-I-want” accommodation usually referred to in more polite terms as bipartisan compromise.

The deal would grant the administration request for $100 billion in aid to Ukraine to continue its war against Russia and to Israel in its war with Hamas in return for significant changes in immigration policy.

Republican demands that border security measures be included in the aid package placed the issue in the hands of a bipartisan group of senators to develop a consensus that could win approval in Congress and the White House.

The administration desperately needs the legislative victory represented by aid for Ukraine and Israel and, while willing to accept more stringent border security measures, has recognized it must shed the perception that it is responsible for an open border and the record influx of migrants into the country.

Mayors of New York, Los Angeles, Chicago, Boston, Washington, San Francisco and Denver have taken their grievances public, demanding millions in federal aid to deal with the rising migrant population.

They face cutting their education and police budgets, for instance, to provide funding for services to migrants. These mayors have come under severe

criticism from residents and taxpayers who claim their needs are being ignored in favor of individuals here illegally.

The administration has bungled the issue since the outset. Its insistence that the border was secure was undermined by news accounts and images of border crossings in record numbers and migrants put up in hotels, police stations and airports.

Secretary of Homeland Security Alejadro Mayorkas and White House press secretary Karine Jean Pierre clung stubbornly to an everything is under control narrative. Despite mountains of evidence, Jean Pierre attempted to shift the blame to former president Trump and congressional Republicans. She has consistently been on the defensive, scrambling for explanations and excuses while her credibility crumbled.

Republican demands for including border security measures in the aid package smacks of legislative hostage taking, but also offers the administration a path toward recovering some level of credibility to its avoidable immigration position.

The administration would have been much better off had it recognized and responded to the warning signs at the border, rather than allowing ideological pressures and a desire to draw sharp contrast with Trump to dictate policy. Choosing to allow the issue to fester and produce an election-jeopardizing political headache was a badly misguided and amateurish decision.

As distasteful as it may be to the administration, accepting the recommendations of the bipartisan Congressional committee offers an opportunity to demonstrate they really do understand the severity of the problem.

How far the progressive left is prepared to go to tank the effort remains to be seen. Dealing with them will require direct involvement of the president.

Not only is addressing immigration at risk, but the potential for failing to aid Ukraine and Israel would seriously weaken a politically vulnerable president as he heads into his re-election bid.

The blame, though, lies squarely with the administration. It continued to paint itself into a corner on immigration and, rather than attempt to extricate itself undamaged, chose to send out for more paint.

urora’s month-long celebration of the legacy of Martin Luther King Jr. will ramp up Jan. 5, bringing an presentation of music, dance and film to the city in honor of the civil rights icon.

Themed “Capturing the Dream,” the series of events will reflect on the life of the Georgia-born Baptist minister and activist, who emerged as one of the most prominent voices for Black civil rights in the 1950s and ’60s before he was assassinated in 1968.

“We feel a profound sense of privilege in orchestrating this event series, a heartfelt homage to the enduring spirit and influence of Dr. King,” Aurora’s Diversity, Equity and Inclusion Officer Sara Valencich said in a news release. “The realization of these impactful events is a testament to the shared vision and unwavering dedication of our invaluable community partners.”

Families across UCHealth Colorado system rang in the new year with a new baby The first baby born this year among Aurora-based UChealth hospitals was Finnegan David Bartels, born at 12:46 a.m. at Medical Center of the Rockies in Loveland. His parents are Kaitlin and Adam Bartels of Severance. Finnegan made his entrance into the world weighing 7 pounds, 14.5 ounces, and he is the couple’s first child.

Just three minutes later, August “Auggie” Theodore Coleman was born at 12:49 a.m. in Colorado Springs. He was born weighing 6 pounds, 5 ounces. His parents are Chelsea and Michael Coleman.

The other babies born Jan. 1 in UChealth hospitals are: Vicente Hinojos Ortiz was born at 1:39 AM. He is the son of Luz Ortiz and Bryan Hinojos. He was born in UCHealth University of Colorado Hospital in Aurora.

Azeyla River Rose Ortega was born at 1:48 AM. She is the daughter of Marissa Amaro and Rio Otega.

He was born in UCHealth Parkview Medical Center in Pueblo.

Julianna Parson was born at 4:11 AM. She is the daughter of Wayne and Socorro Parson. She was born in UCHealth Memorial North in Colorado Springs.

Teenage boy injured New Year’s Eve in northwest Aurora shooting An unidentified teenage boy was shot and injured while outside a home in northwest Aurora New Year’s Eve, police reported.

At about 5 p.m., police said that officers were called to the 1500 block of Emporia Street to respond to reports of the shooting.

“The victim, a young teenage boy, has been transported to the hospital with serious bodily injury,” police said in a social media post.

“Suspect information is not available at this time.”

No other details were released.

Police said anyone with information can call Metro Denver Crime Stoppers at 720-913-7867. Tipsters can remain anonymous and still be eligible for a reward of up to $2,000, police said.

Aurora dentist sentenced in Nevada power plant fire tabbed as terror attack An Aurora dentist was sentenced Dec. 27 to prison in Nevada following his arrest last January for setting his car afire at a remote facility in what authorities initially characterized as a terror attack on the electric system serving several Las Vegas Strip casinos.

Mohammed Reza Mesmarian, 35, was sentenced to two to 10 years following his plea in November to guilty but mentally ill on charges of felony arson and property destruction in the incident at a remote desert solar array about 25 miles northeast of downtown Las Vegas.

“This was not so much an act of terrorism as a person going through personal issues during COVID, the loss of a marriage and his business,” Mesmarian’s attorney, Jeffrey Nicholson, told The Associated Press after sentencing. Nicholson said he sought probation, but he called Clark County District Court Judge Ronald Israel’s sentence “a good and fair decision.”

Mesmarian received credit for nearly a year already served in custody and could be paroled in early 2024.

Mesmarian, a dentist, is from Aurora, where state records showed he faced Colorado Dental Board discipline and his license to practice was restricted in July 2022. Records also showed that Mesmarian filed Chapter 7 bankruptcy in October 2022.

Nicholson said Wednesday he didn’t immediately know the status of his client’s dental license.

Mesmarian initially faced charges including terrorism, arson, destruction of property and escape.

He spent months in custody during court proceedings that eventually determined he was competent to stand trial.

The litigation is the latest of several Second Amendment lawsuits aimed at a slew of gun control regulations passed by Colorado’s majority Democratic legislature and signed

by Democratic Gov. Jared Polis last year.

The ban on ghost guns took effect Monday and follows a dramatic rise in their reported use in crimes, jumping by 1,000% between 2017 and 2021, according to the Bureau of Alcohol, Tobacco, Firearms and Explosives.

The law bars anyone in Colorado except licensed firearm manufacturers from creating gun frames and receivers, which house internal components. It also prohibits the transport and possession of frames and receivers that don’t have serial numbers.

The lawsuit filed by the Rocky Mountain Gun Owners and the National Association for Gun Rights alleges that the ban infringes on Americans’ Second Amendment rights.

“This law is an outright assault on the constitutional rights of peaceable Coloradans. It’s not just an overreach; it’s a direct defiance to our Second Amendment freedoms,” said Taylor Rhodes, executive director of the Rocky Mountain Gun Owners, in a statement.

Rhodes said the Supreme Court’s ruling last year, which is considered an expansion of gun rights, reinforces their case in Colorado, pointing to a long history in America of citizens being their own gunsmiths.

“The Supreme Court made it clear that any law infringing on the right to bear arms must align with the historical understanding of the Second Amendment,” said Rhodes, “If homemade – unserialized – guns weren’t legal at the time of our nation’s founding, we would all have a British accent.”

Shelby Wieman, a spokesperson for Polis, declined to comment cit-

ing ongoing litigation. As Colorado’s governor, Polis was named as the defendant in Monday’s lawsuit.

The other gun control laws passed last year facing legal challenges include raising the minimum age to purchase a firearm from 18 to 21 and imposing a three-day waiting period between purchase and receipt of a firearm.

Democratic President Joe Biden has similarly cracked down on ghost guns with the new rules also being challenged in federal court.

Trump is blocked from the GOP primary ballot in Colorado and Maine.

Can he still run for president?

First, Colorado’s Supreme Court ruled that former President Donald Trump wasn’t eligible to run for his old job in that state. Then, Maine’s Democratic secretary of state ruled the same for her state. Who’s next?

Both decisions are historic. The Colorado court was the first court to apply to a presidential candidate a rarely used constitutional ban against those who “engaged in insurrection.” Maine’s secretary of state was the first top election official to unilaterally strike a presidential candidate from the ballot under that provision.

But both decisions are on hold while the legal process plays out.

That means that Trump remains on the ballot in Colorado and Maine and that his political fate is now in the hands of the U.S. Supreme Court. The Maine ruling will likely never take effect on its own. Its central impact is increasing pressure on the nation’s highest court to say clearly: Can Trump still run for president after the Jan. 6, 2021, attack on the U.S. Capitol?

After the Civil War, the U.S. ratified the 14th Amendment to guarantee rights to former slaves and more. It also included a two-sentence clause called Section 3, designed to keep former Confederates from regaining government power after the war.

The measure reads: “No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”

use. But it was rediscovered after Jan. 6.

Trump is already being prosecuted for the attempt to overturn his 2020 loss that culminated with Jan. 6, but Section 3 doesn’t require a criminal conviction to take effect.

Dozens of lawsuits have been filed to disqualify Trump, claiming he engaged in insurrection on Jan. 6 and is no longer qualified to run for office.

All the suits failed until the Colorado ruling. And dozens of secretaries of state have been asked to remove him from the ballot. All said they didn’t have the authority to do so without a court order — until Maine Secretary of State Shenna Bellows’ decision.

The Supreme Court has never ruled on Section 3. It’s likely to do so in considering appeals of the Colorado decision — the state Republican Party has already appealed, and Trump is expected to file his own shortly. Bellows’ ruling cannot be appealed straight to the U.S. Supreme Court — it has to be appealed up the judicial chain first, starting with a trial court in Maine.

The Maine decision does force the high court’s hand, though. It was already highly likely the justices would hear the Colorado case, but Maine removes any doubt.

Trump lost Colorado in 2020, and he doesn’t need to win it again to garner an Electoral College majority next year. But he won one of Maine’s four Electoral College votes in 2020 by winning the state’s 2nd Congressional District, so Bellows’ decision would have a direct impact on his odds next November.

Until the high court rules, any state could adopt its own standard on whether Trump, or anyone else, can be on the ballot. That’s the sort of legal chaos the court is supposed to prevent.

Trump’s lawyers have several arguments against the push to disqualify him. First, it’s not clear Section 3 applies to the president — an early draft mentioned the office, but it was taken out, and the language “an officer of the United States” elsewhere in the Constitution doesn’t mean the president, they contend.

Second, even if it does apply to the presidency, they say, this is a “political” question best decided by voters, not unelected judges. Third, if judges do want to get involved, the lawyers assert, they’re violating Trump’s rights to a fair legal procedure by flatly ruling he’s ineligible without some sort of fact-finding process like a lengthy criminal trial.

Fourth, they argue, Jan. 6 wasn’t an insurrection under the meaning of Section 3 — it was more like a riot.

Finally, even if it was an insurrection, they say, Trump wasn’t involved in it — he was merely using his free speech rights.

Of course, the lawyers who want to disqualify Trump have arguments, too. The main one is that the case is actually very simple: Jan. 6 was an insurrection, Trump incited it, and he’s disqualified.

The attack was three years ago, but the challenges weren’t “ripe,”

to use the legal term, until Trump petitioned to get onto state ballots this fall.

But the length of time also gets at another issue — no one has really wanted to rule on the merits of the case. Most judges have dismissed the lawsuits because of technical issues, including that courts don’t have the authority to tell parties whom to put on their primary ballots. Secretaries of state have dodged, too, usually telling those who ask them to ban Trump that they don’t have the authority to do so unless ordered by a court.

No one can dodge anymore.

Legal experts have cautioned that, if the Supreme Court doesn’t clearly resolve the issue, it could lead to chaos in November — or in January 2025, if Trump wins the election.

Imagine, they say, if the high court ducks the issue or says it’s not a decision for the courts to make, and Democrats win a narrow majority in Congress. Would they seat Trump or declare he’s ineligible under Section 3?

Maine has an unusual process in which a secretary of state is required to hold a public hearing on challenges to politicians’ spots on the ballot and then issue a ruling.

Multiple groups of Maine voters, including a bipartisan clutch of former state lawmakers, filed such a challenge, triggering Bellows’ decision.

Bellows is a Democrat, the former head of the Maine chapter of the American Civil Liberties Union, and has a long trail of criticism of Trump on social media. Trump’s attorneys asked her to recuse herself from the case, citing posts calling Jan. 6 an “insurrection” and bemoaning Trump’s acquittal in his impeachment trial over the attack.

She refused, saying she wasn’t ruling based on personal opinions.

But the precedent she sets is notable, critics say. In theory, election officials in every state could decide a candidate is ineligible based on a novel legal theory about Section 3 and end their candidacies.

Conservatives argue that Section 3 could apply to Vice President Kamala Harris, for example — it was used to block from office even those who donated small sums to individual Confederates. Couldn’t it be used against Harris, they say, because she raised money for those arrested in the unrest after the murder of George Floyd by Minneapolis police in 2020?

Is this partisan? Well, of course it is. Bellows is a Democrat, and all the justices on the Colorado Supreme Court were appointed by Democrats. Six of the 9 U.S. Supreme Court justices were appointed by Republicans, three by Trump himself.

But courts don’t always split on predictable partisan lines. The Colorado ruling was 4-3 — so three Democratic appointees disagreed with barring Trump. Several prominent legal conservatives have championed the use of Section 3 against the former president.

Now we’ll see how the high court handles it.

Curd appeal

I

f you travel along the Havana corridor, you’ve undoubtedly seen a Seoul Hospitality business or two.

J.W. Lee has made a point of establishing a cadre of signature establishments along Havana Street, which some have dubbed a top-ten cultural fare destination across the country.

From Coffee Story to Thanksool Pocha, a Korean Nightlife spot with premium cocktails, and all the in-between, J.W. has brought Korean cuisine to the forefront in Aurora.

He began with acquiring Seoul Korean BBQ and Sushi 10 years ago and built his local empire of 10 establishments within the city, now owning 20 restaurants across the country.

Tofu Story, his newest restaurant, makes organic tofu in house the old fashioned way, producing the soybean product several times a day. There is one other Tofu Story owned and operated by Seoul Hospitality, located in Queens, New York.

The menu offers much more than just tofu dishes, including a bevy of hot pot options and other traditional Korean fare, most of which can incorporate its staple ingredient.

J.W., an immigrant from Korea, has lived in the US for 25 years and in Aurora for 11 years. He noticed that there were few makers of traditional organic tofu so he researched where he could get homegrown organic soybeans, and he ships them from Minnesota. He also bought a tofu machine from Korea to make the product in the Tofu Lab inside of Tofu Story.

“We go through about 300 pounds of soybeans a day,” J.W. said.

T

he calendar has moved along to 2024 and that means the winter prep sports season is set to heat up.

It was a fast-paced start for Aurora teams in boys and girls basketball, boys and girls wrestling, girls swimming and ice hockey, but the resumption of the season allows for a settling in of rhythm with the advent of league play and building WINTER SPORTS towards the postseason.

Eaglecrest got off to a 7-0 start to the season, then dropped its last three before break. Coach Jarris Krapcha’s Raptors — ranked eighth in MaxPreps’ Class 6A Colorado standings — lost in the championship game of the Curtis Winter Classic in Washington, then fell to a pair of 6A top-six teams before break. Junior LaDavian King leads three players who average in double figures for the Raptors with an average of 19.4 points per game.

Overland is off to a promising 6-3 start, as coach Danny Fisher’s team went through a rigorous opening schedule against Colorado teams and then a 3-1 performance at the Dwan Hurt Holiday Classic in California. The Trailblazers’ win total includes significant wins against defending 6A state champion Denver East as well as Rock Canyon, while all four of their losses came by single digits. Juniors Siraaj Ali (18.7 points per game) and Isreal Littleton (11.0 ppg) have set the tone for Overland.

Regis Jesuit enters the new year looking to build on a 6-3 start that has come against quality competition. Coach Ken Shaw’s Raiders won their first five games in impressive fashion, then dropped three of their last four, including an overtime defeat at Grandview in the final game before break. Sophomore Eric Fiedler has been a force in the early going, as he has averaged an Aurora-best 20.4 points per game, while senior Damarius Taylor has poured in 18.4 per contest and junior Alec Roumph 11.9.

Cherokee Trail has made significant progress in the second season under Brandon Brown. The Cougars were 1-5 at winter break last season, but went into the hiatus this season at 4-3 with two of three losses coming by eight or fewer points. Senior guard Braylen Thomas has been a catalyst.

Gateway is 4-6 at the break, just one game off the pace it was at last season in a 14-win campaign.

The Olys — the first season under Nicholas Dixon — have been bolstered by a double-digit scoring duo

of Hayden Von Boeckman (18 ppg) and Oriel Bailey (14.1 ppg), while last season’s leading scorer, Maximus Matthews, returned the lineup two games before break after missing time due to injury.

Aurora Central is 3-4 after seven games — a twogame improvement in the win column at the break from last season — with balance as the hallmark.

Coach Marcus Shelton’s team has five players that average 9.3 points or better so far.

Grandview entered break at 3-8, but coach Michael Rogers’ team went out on a high note with an overtime home victory over Regis Jesuit. Junior Breven Anderson has been the Wolves’ most effective offensive player with an average of 10.3 points.

Rangeview opened 2-2 before it dropped five straight going into winter break. Coach Shawn Palmer’s Raiders dropped three games at the Cherry Creek Christmas Classic by six points or less and then lost to two teams in MaxPreps’ 6A top six in Ralston Valley and Rock Canyon. Impact freshman Archie Weatherspoon V has averaged 11.5 points per game.

Hinkley remains in the search for its first win of the season after an 0-6 start.

GIRLS BASKETBALL Cherokee Trail holds the No. 1 spot in MaxPreps’ Class 6A rankings after the opening portion of the season, which coach Tammi Traylor-Statewright’s team open 8-2. The Cougars (who were 9-1 at the same point last season during a 19-win campaign) opened with a win at Highlands Ranch, won the Castle View/ThunderRidge tournament and started 2-0 at the Nike Tournament of Champions in Phoenix before two losses going into the break to finish fourth in the Joe Smith Division. Junior Delainey Miller (13.4 points per game), senior Damara Allen (10.9) and sophomore Karson Chaney (9.7) lead the way.

Eaglecrest holds a share of the city’s best marks through the break at 8-2, which includes four straight wins prior to winter break. Coach Robby Gabrielli’s Raptors (No. 9 in MaxPreps’ 6A rankings) have retooled after several longtime standouts graduated with depth. Senior Shyann Farbes holds the scoring lead at 12.6 points per game, followed by junior Amaia Jones at 10.5.

Overland won 12 games all of last season, but has seven already during a 7-2 start under new head coach Wondame Davis. The Trailblazers’ losses came to Rock Canyon (No. 6 in MaxPreps’ 6A rankings) and then to Standley Lake (No. 3 in 5A) in the cham-

pionship game of the Northglenn Shootout. The senior tandem of Seilani Relford (14.4 ppg) and Destiny Moore (11.9 ppg) leads the way, with junior Ilaisaane Davis right behind at 9.6 points per contest.

Regis Jesuit owns a 6-3 mark with all three losses coming out of state at the She Got Game Classic in the Washington, D.C., area. Coach Jordan Kasemodel’s Raiders sit No. 10 in MaxPreps’ 6A rankings with Colorado wins over two teams (No. 4 Valor Christian and No. 7 Mullen) ranked ahead of them. Senior Hana Belibi — who surpassed the 1,000 career points scored milestone — leads in scoring at 19.2 points per game, followed by senior Coryn Watts at 16.3.

A 3-1 performance at the Tarkanian Classic in Las Vegas brought Vista PEAK Prep into break at 6-4.

Coach Howard Payne’s Bison won five of six before the hiatus to rise to No. 11 in MaxPreps’ 5A rankings.

Juniors Eianna Jackson (8.6 ppg), Amirah Pena (8.4 ppg) and sophomore Knakai Starks (8.3 ppg) lead a balanced lineup Aurora Central entered break at 4-4, the identical mark it had last season at the same point. Coach Joseph Hill’s Trojans have had nearly a double-double every game from sophomore Jamaea Johnson Gonzalez (9.7 points, 11.9 rebounds), while junior Alayna McClain has averaged 10.6 points per contest.

Two-time defending state champion Grandview checks into the new year at 3-6 with decisive wins in its only two games in Colorado sandwiched between an o-3 trip to the She Got Game Classic in Dallas and 1-4 mark at the Nike Tournament of Champions in Phoenix. Three of the six losses for coach Josh Ulitzky’s team — which has worked through injury and absence of some regulars — have come by six points or fewer. Defending Colorado Gatorade Player of the Year Sienna Betts is off to a massive start as she has averaged 24.8 points, 16.7 rebounds, 4.8 assists and 3.2 blocked shots per game.

In the first season under Tony Speights as head coach, Rangeview sits at 3-6 after the opening portion of the season, a contrast from its 6-2 start last season.

The Raiders finished sixth at the Best In the Nest Tournament to open the season, then won two of their last five. Gateway sports a 1-4 mark at the break, with the majority of its schedule yet to come. Coach BJ Wilson’s first win with the Olys came against Hinkley in a local matchup. Coach Rick Harris’ Smoky Hill team snapped a 21-game losing streak with a win against Hinkley and enters break at 1-9, while coach Dawn Quintero’s Hinkley team dropped its first five contests of the season. ›› See WINTER, 11

Seven of coach Ryan Budd’s Wolves appear in the 5A rankings, topped by junior Charlie Herting, who is No. 2 at 165 pounds. Grandview has won every dual match it has competed in this season and pitched shutouts in two of them. The Wolves competed in the Reno Tournament of Champions prior to winter break and finished 14th in a loaded field of teams from a multitude of states.

Coach Javier Quintana’s Raptors have five ranked wrestlers (all in the top 10 of their respective weights) and four of them sit in the top five (2022-23 finalist Adonias Cantu is No. 3 at 120 pounds, Thayne Lundy and Dalton Leivian are No. 4 at 175 and 190, respectively, and Ethan Diaz is No. 5 at 126 pounds). Eaglecrest and Grandview meet in a big Centennial League dual Jan. 11.

Coach Jeff Buck has one of two wrestlers from Aurora programs with current No. 1 rankings from On The Mat, as freshman Cooper Matthews holds that spot in the 106-pound weight class. Matthews has four losses, but all have come in close decisions and his brother, Chance, is ranked No. 2 at 138 pounds. In all, Cherokee Trail has six ranked wrestlers.

Regis Jesuit’s Garrett Reece, a returning state finalist, is the other Aurora-area wrestler to hold a No. 1 ranking, which he has at 150 pounds. Reece won the championship of the Northern Colorado Christmas Tournament prior to break and he’s won every match he’s had this season, including half at 157 pounds.

Three other wrestlers for coach Dan Wrona’s Regis Jesuit team hold spots in the rankings.

Vista PEAK Prep has 4A ranked wrestlers in Ian Bacon (No. 11 at 120 pounds) and Joseph Maes (No. 11 at 285), Smoky Hill has Dashawn Jenkins, who is No. 6 in 5A at 113 pounds, while Overland has the No. 15-ranked wrestler at 157 pounds in James Rada Scales.

GIRLS WRESTLING Eaglecrest has ascended to the No. 4 spot in On The Mat’s Week 4 girls team rankings and is the only Aurora program to have a team ranking.

Coach Horacio Vialpando’s Raptors have a ranked wrestler in eight of the 14 weight classes, with the highest rating going to senior Chasey Karabell, who currently sits No. 2 at 100 pounds. Karabell

has won all 17 of the matches she has wrestled and also received two wins by forfeit.

Ranked No. 3 at 170 pounds is senior Gianna Falise, who is 14-3 with two of her losses coming in out-of-state tournaments and the other to Matilda Hruby of Brighton, who is ranked No. 1 in the weight class.

Sophomore Emma Roberts also holds the No. 3 spot (at 235 pounds) and has yet to be defeated.

Individually, Aurora programs have one top-ranked wrestler and that is Vista PEAK Prep sophomore Amelia Bacon at 125 pounds. Bacon won championships at two tournaments thus far, including the Northern Colorado Christmas tournament before break. Her only loss came in the championship match of the Eaglecrest Invitational to Regis Jesuit senior Alexis Segura, who is in search of her third career trip to a state championship match.

Vista PEAK Prep also has the second-ranked 190-pounder in senior Taryn Holloway.

GIRLS SWIMMING The top swimmers from the city got a good measuring stick just before winter break at The REX Coaches Invitational, which saw four Aurora area programs finish in the top 14 standings of the large school programs.

Regis Jesuit earned the victory in impressive fashion, bolstered by event champions in senior Maya Kriz (1-meter diving) and senior Charlotte Burnham (100 yard breaststroke) plus an assortment of other strong performances. Coach Nick Frasersmith’s team appears to have the depth to make a run at unseating rival Cherry Creek when the state championship meet arrives in February.

Cherokee Trail has gotten off to an unbeaten start in dual meets and coach Kevin Chatham’s team grabbed the No. 5 spot in the final standings the REX meet. The Cougars topped rival Grandview for the first time in a dual meet earlier and finished one spot in front of them at the Coaches Invitational in a battle within a meet that is likely to continue at the Centennial “A” League Championships and state meet.

Strong relays, senior standouts in Ella Drakulich and Sarah Woren and the addition of Ava Zadigan (a transfer who had to sit out last season) give Cherokee Trail a powerful mix, while coach James Boone’s Grandview team features a number of quality senior swimmers — including Amelia Brown, Keira Vail (a Hoyt Brauner Award nominee) and Kaitlyn Hafer — plus a standout diver in Addison Campbell.

Sophomores Cameryn Walkup and Mya Noffsinger lead the way for Smoky Hill, which finished 14th at the Coaches Invitational. Ran-

geview got on the scoreboard via a diving place by Hailey McDonald and will look to extend its dominance over the Aurora Public Schools Championship meet later in January.

ICE HOCKEY The two local programs that feature players from Aurora — the Cherry Creek co-op and Regis Jesuit — skated to a 2-2 overtime tie in their first of two meetings.

Coach Terry Ott’s Regis Jesuit team, which got a late start to its regular season schedule, entered the break at 3-1-1 and No. 2 in MaxPreps’ Class 5A rankings. Besides the tie with the Bruins, the Raiders’ only loss came to MaxPreps’ No. 1, the Poudre School District co-op team. Ian Beck, Parker Brinner and Vincent Cieslak pace Regis Jesuit with six points apiece, while freshman Easton Sparks has started all five games and tied for the most minutes of any goalie in 5A. He has a 2.20 Goals Against Average.

Coach Jeff Mielnicki’s Cherry Creek team —which melds athletes from a variety of district schools — sits No. 5 in MaxPreps’ 5A rankings with a 4-1-2 mark. The Bruins also suffered their only loss against the Poudre School District team. Eric Burggraf (Grandview) collected nine points on five goals and four assists for the Bruins.

The two local programs meet again Feb. 2.

o g i s t i c s fo r t h e state’s universal preschool program are up in the air as several school districts, including Cherry Creek, and two Colorado families continue a legal battle against the state over the program’s many complications.

The civil complaint centers around the equity and funding of the universal preschool program. Complaints also focus on the functions of BridgeCare, the statewide online system through which parents apply for the universal preschool program. Colorado began offering at least four hours of free preschool to all children, part of a $322 million program approved by voters.

Cherry Creek is one of seven school districts battling Gov. Jared Polis in court over the universal preschool program. Two Colorado families as well as the Colorado Association of School Executives and the Consortium of Directors of Special Education are named as plaintiffs in the lawsuit. Aurora Public Schools has not joined the lawsuit.

Some of the demands for relief include: reimbursing school districts and families for financial losses; the Colorado Department of Early Childhood giving school districts immediate access to accurate and real-time information; the department of early childhood funding 30 hours of preschool for students with one qualifying factor.

“We know that lawmakers are aware of the ongoing concerns

and problems,” Cherry Creek spokesperson Lauren Snell said.

State legislative officials said they’d been assessing the process and feedback and would have comment later in the week.

Snell said there was a post-session legislative hearing Sept. 20, and the Colorado Department of Early Childhood had a briefing before the Joint Budget Committee. The school district is not aware of any current pending hearings.

State officials said that, despite problems starting the program, they’re determined to move forward, and they pointed to initial successes.

“The governor is committed to strongly defending free preschool, which is saving over 38,000 families hundreds of dollars each month, against all lawsuits,” said Polis Press Secretary Shelby Wieman. “The Polis administration is working hard to make preschool even more amazing, in part thanks to Prop II, for next school year.”

The 75-page civil complaint, which was amended Nov. 24, makes a bevy of allegations.

Cherry Creek claims that BridgeCare prevents families from applying for the program due to language barriers. Bridgecare is only available in English, Spanish and Arabic while over 150 languages are spoken in the Aurora region, “meaning many families may not know or have the technical and language skills to access the BridgeCare system.”

Also, accessing the application in Spanish and Arabic requires “some technical savvy,” according to the complaint.

Another complication that families have allegedly faced in Cherry Creek, is that when BridgeCare matches families to a school district preschool, families mistakenly think that it also means that the child is then enrolled in the school.

The complaint states that Cherry Creek “has had to turn away several families on the first day of school at each preschool site who thought they were enrolled because of BridgeCare.”

The civil complaint also states that neither BridgeCare nor the department of early childhood education gave Cherry Creek, or other school districts, the families’ contact information, so there was no way for the district to reach out to families who have not completed enrollment.

There are also funding inconsistencies, according to the civil complaint.

There was a discrepancy in the number of preschool students enrolled in district schools and the number of students who enrolled through BridgeCare. This caused the school district to look through their own enrollment lists, compare it with the information from the state and then contact families who did not enroll through BridgeCare.

Hundreds of students were unaccounted for and the school district did not receive funding for the unaccounted students.

In one instance, a family with two special education children initially enrolled in a private preschool through BridgeCare. They then later enrolled in a Cherry Creek district preschool “to receive special education.” However,

the district was not compensated for those two children. Instead, payment was sent to the private school.

The students attended Cherry Creek for months while the district worked to resolve the funding issue. Despite confirming that funding should have gone to Cherry Creek, and later resolving the funding issue, the district will not be reimbursed for the time the students were in the district school prior to the resolution, according to court documents.

The district also claims there are more incidents of students attending a Cherry Creek preschool, but funding from the state goes to a private school.

Other districts go to court, too The other school districts who are embroiled in the legal battle alongside Cherry Creek are: Brighton School District, Centennial Board of Cooperative Educational Services, Harrison School District, Mapleton Public Schools, Platte Valley School District and Westminster School District.

Like Cherry Creek, these school districts allege they faced confusion and misinformation from the state and technology issues with BridgeCare.

Platte Valley School District and Harrison School School District stated in the civil complaint that they were not informed which students qualified to receive additional hours of preschool.

The program allows for qualified 4-year-olds to get at least 15 hours of free preschool per week,

according to the state website.

Children from low-income families would qualify for additional hours.

“A significant percentage of [Harrison School District] students” who initially applied for the universal preschool program through BridgeCare qualified to receive 30 hours of preschool.

But, “at the eleventh hour”, the Colorado Department of Early Childhood informed parents and the school district that most families would not qualify to receive the full 30 hours and would not say which students did not qualify.

Many of the school districts also stated in the civil complaint that BridgeCare also did not match students with the preferred preschool within the district. This meant that students were not attending the same school as their siblings, or students with special needs were not receiving special education.

“The Cherry Creek School District, along with the other plaintiffs, continue to work with the [Colorado Department of Early Childhood] to address many of the outstanding challenges such as funding issues, planning for Year Two, and access to the enrollment system,” Snell said. “We hope to find resolution to these challenges as quickly as possible to ensure children across the state can access a high-quality preschool education.”

ith its new universal preschool program, Colorado joins a small but growing group of states that offer tuition-free preschool to all 4-year-olds.

So far, the program is popular with families, but there have been lots of bumps in the road, including three lawsuits against the state and the threat of a fourth. Some of the hiccups and headaches are usual new-program fare while others stem from the program’s rushed rollout by a new state agency.

Despite the problems, the $322 million program is a big deal.

Funded partly with a nicotine tax that Colorado voters passed easily, it’s cutting preschool tuition costs for thousands of families and helping more Colorado children get ready for kindergarten. Nearly 50,000 preschoolers are enrolled this year, more than double the number served in the state’s previous smaller preschool program.

Universal preschool has long been one of Gov. Jared Polis’ signature initiatives and its launch last August represents the second and harder half of the governor’s ambitious early childhood agenda.

Free full-day kindergarten, which kicked off in 2019, was the other major component.

Here’s a closer look at four key issues that have cropped up during the preschool program’s first six months.

A surge in demand led to tough decisions — and could again More than 38,000 4-year-olds — 60% of that age group in the state — are enrolled in universal preschool this year. That’s about 8,000 more 4-year-olds than the state expected. In addition, the program includes more than 10,000 3-year-olds with risk factors.

The surge in demand meant state officials had to spread the money more thinly than planned.

Last summer, just weeks before preschool was set to start, they told thousands of families that their children wouldn’t get free full-day preschool, only half-day, because there wasn’t enough funding. Some of the students who lost out — low-income students and English language learners — are those who stand to benefit the most from extra preschool.

The state has already taken steps to remedy this problem for about 3,000 children next year, specifically those living in poverty. A proposed rule would prioritize those 4-year-olds for full-day classes. At the same time, the state expects even more 4-year-olds — as much as 64% of that group — to enroll in universal preschool next year. With next year’s state budget not yet set, the possibility of another surge in demand, and a slew of new rules under consideration, it’s unclear how far the money will go.

State leaders promised high-quality preschool.

It will take years.

One of the casualties in the race to stand up the new preschool pro-

gram were rules governing program quality. State officials ran out of time to craft those rules, so they told participating preschools last spring to “keep doing what you’re doing.”

That means preschools are required to meet only basic health and safety standards this year, not other benchmarks of quality, such as small class sizes, highly trained teachers, and strong curriculum.

Some participating preschools already embrace high-quality practices, but not all do. That leaves the current universal preschool landscape a mish-mash of superior programs, mediocre programs, and everything in between.

Experts say quality standards matter because when preschool is done well, it can have short- and long-term benefits for children — boosting academic skills, increasing the likelihood of graduating from high school, and even improving adult job and health outcomes.

Colorado officials are planning to adopt some quality rules for the 2024-25 school year and a separate set of rules on preschool staff credentials for the 2025-26 school year. But with some likely to be phased in over time, four or more classes of universal preschoolers may graduate from the program before a binding set of quality requirements take hold.

Colorado faces lawsuits as churchstate legal landscape changes Although faith-based preschools make up a tiny fraction of Colorado’s universal preschool providers, they’ve played an outsize role in recent legal challenges

over the program’s policies.

Two of three lawsuits the state is facing over universal preschool revolve around a non-discrimination agreement state officials asked participating preschools to sign. The agreement bans discrimination based on various factors, including religion, sexual orientation, and gender identity, but a Christian preschool in Chaffee County and two Catholic preschools in metro Denver sued over the provision last summer.

In October, a federal judge blocked Colorado from withholding universal preschool funds or disciplining the Chaffee County preschool even though its policies on employee hiring and bathroom and pronoun use appear to violate the non-discrimination clause.

The lawsuit by the Catholic preschools, which is set to go to trial in early January, is broader.

Like the Chaffee County case, it takes issue with the possibility of hiring staff who don’t reflect the schools’ religious tenets, but it also challenges the state’s mandate to accept all children and families regardless of religion, sexual orientation, and gender identity.

The schools argue that enrolling all children conflicts with their religious beliefs and mission to provide a Catholic education.

There’s likely another battle over religion on the horizon.

That’s because of a proposal to ban religious instruction during universal preschool classes starting next fall. The state intended to put that ban into place from the outset, but didn’t follow through — allowing participating faith-based preschools to incorporate religion however they see fit this year. That omission, set Colorado up for a conspicuous mid-stream flip-flop.

Colorado has already threatened to sue if the state goes through with the proposed ban, citing a recent U.S. Supreme Court decision allowing public funding for religious education.

Class size debate is another symptom of funding challenges This year, universal preschool classes can have up to 24 4-yearolds. That’s higher than most early childhood experts recommend, so the state has proposed capping the number at 20 starting next fall.

A related rule would require one staff member for every 10 children, down from one per 12 this year.

But some participating preschools literally banked on having 24 students per class and 12 students per staff member. (The state pays about $6,000 per child for half-day preschool.) If the proposed changes are adopted, these providers stand to lose tens of thousands of dollars next year and some have said they would pull out of the program altogether.

The class size dilemma, especially in a field known for razor-thin margins and low pay, is another example of the tension between Colorado’s promise of high-quality preschool-for-all and the reality of limited funding. Although universal preschool’s $322 million price tag sounds like a hefty sum, preschool providers, school districts, and lawmakers have questioned whether it’s enough to support the program Colorado leaders envisioned.

t was an annual end-of-year exercise in futility for many. But a clean slate on Jan. 1 brought a new round of resolutions.

As the closing chorus of “Auld Lang Syne” rang out, so did hope 2024 could be the year for finally achieving long-elusive goals, fulfilling aspirations and being resolute on all those New Year resolutions.

“As humans, we are creatures that aspire,” said Omid Fotuhi, a social psychologist who is a motivation and performance researcher.

“The fact that we have goals, the fact that we want to set goals is just a manifestation of that internal and almost universal desire to want to stretch, to want to reach, to want to expand and grow,” said Fotuhi, the director of learning innovation at Western Governors University Labs and a research associate at the University of Pittsburgh.

“New Year’s resolutions are one of those ways in which we do that,” he said. “There’s something very liberating about a fresh start.

Imagine starting on a blank canvas. Anything is possible.”

thon, vanquish (or make peace with) old foes such as the bathroom scale and a thickening waist? Maybe learn Mandarin or register to vote, and actually vote? So many questions, and so much time to delay.

Tim Williams used to issue himself a panoply of resolutions: lose weight, drink less, exercise more and yada yada.

Now, he doesn’t bother.

“In the past, I would make them, and I would fail or give up on them or whatever,” said Williams, a part-time resident of Fort Lauderdale, Florida.

Carla Valeria Silva de Santos, a Florida transplant from Brazil, wants to learn to play the guitar. A native Portuguese speaker, she wants to learn Spanish and improve her English.

With any resolution, she said, the ultimate goal is “to improve your life and be in peace with yourself.”

Josh Moore, another Fort Lauderdale resident, sees things in line with the natural philosopher Sir Isaac Newton and physics. For every action, there must be an equal reaction.

“If you do something like eat a bunch of candy or a bunch of desserts at a holiday party, go

run,” he said while interrupting a jog with his dog. “Maybe you went out drinking too much and you might have a hangover. But then next day when you’re feeling better, go to the gym.”

Too many people are too soft on themselves, he posited. “You’ve got to actually hold yourself accountable.”

Resolutions don’t have to be big, grandiose or overly ambitious, Fotuhi said.

Even it they are, he said value should not exclusively be derived from the achievement but also be measured by what you become by trying to better yourself.

“Goals are only there to serve a function to get you started,” Fotuhi said. “If they don’t do that, then maybe that’s not the appropriate goal for you.”

In other words, it is a time to recalibrate goals and expectations, he said, adding that some people hang on to outdated goals for way too long.

“If you set a goal that’s overly ambitious, that doesn’t have the effect of getting you excited and making you believe that it’s possible, then maybe you should think about a goal that’s a little bit more within your reach — starting with a 5K for instance, then moving up to 10K,” Fotuhi said.
