INDUSTRIAL RELATIONS

SDA WINS PAY RISE WITHOUT DELAY! The Fair Work Commission handed down their Annual Wage Review decision on 15 June 2022 resulting in a pay rise for workers across the country. The Decision means a $40 per week increase to modern awards for workers earning up to $869.60 per week and a 4.6% increase to rates above that. This equates to a 4.71% increase or $1.05 per hour for a Level 1 retail employee covered by the General Retail Industry Award. This increase will come into effect on 1 July this year for workers covered by a modern award. The SDA will provide members with specific information about how and when this increase will apply to SDAnegotiated Agreements. This pay rise was won by SDA members and the union movement as we put forward strong arguments to the Annual Wage Review. When employer groups argued for little or no increases as well as postponing any increase, we campaigned out in stores and in the community for a fair increase without delay. Cost of living pressures are here now so the increase shouldn’t be delayed for retail and fast food workers - the SDA won this argument. Almost 10,000 SDA members responded to our survey which helped inform our submission to the Fair Work Commission ahead of this decision and a further 4,000 signed up to support the campaign. Thank you to SDA members who supported the campaign – you

have helped to make a real difference. See the following pages for how much effort our members put into our campaign. We couldn’t have done it without you! In addition to the SDA and the Australian Council of Trade Unions making submissions to the Annual Wage Review, the new Albanese Government also made a submission. The submission called out the need for wages to keep up with the rising cost of living and helped highlight why pay rises are critical for workers and the economy.

u

Working to lift wages for low-paid workers;

u

Prioritising job security through set rosters, regular hours, better carers leave, higher minimum part-time hours, easier pathways to permanent work;

u

Ensuring safe workplaces,including an environment that is free from abuse, violence, bullying and sexual harassment;

The Union looks forward to engaging the new Federal Government on a number of important issues that impact retail, warehousing and fast food workers.

u

Improving access to affordable childcare and early learning, including making it accessible for workers outside of 9am-5pm jobs;

A change in government provides a new opportunity to improve the lives of SDA members and their rights at work.

u

Making housing more affordable across the country, including for young people and those in regional areas.

The SDA has always sought to engage governments on key areas of concerns for members.

A government that supports essential workers and their right to a safe workplace, a secure job and a decent pay rise will be vitally important over the coming years.

The SDA welcomed the Federal Government’s show of support to hard-working Australians. This is a much needed increase for millions of workers who have worked tirelessly throughout the pandemic. The SDA will continue our work for fair and decent pay rises.

HEALTH & SAFETY

CLICK AND COLLECT & CAR PARK SAFETY BY ZAK HOLGATE, INDUSTRIAL OFFICER

The COVID-19 pandemic has shifted customer behaviours towards shopping. The past 18-24 months has seen many more retailers adopt a similar approach to that already in place in supermarkets, offering greater convenience by allowing customers to do their shopping when and where it suits. Companies have been quick to adopt this approach to shopping to reduce potential exposure to covid for both customers and their staff. During lockdowns, companies were able to continue conducting their operations through these means. However, although some tasks have changed to meet shifting customer demand, some work systems put in place by employers seem to have deficiencies, putting our members at risk.

Around mid-2021, numerous members contacted the SDA regarding concerns with clickand-collect or direct-to-boot operations. Although online shopping reduces the time that customers are required to spend in store, as well as providing greater convenience, these online options are being put in centres that were not traditionally designed to operate such facilities, nor have adequate accommodations to perform these operations safely. The Newcastle Branch identified pick-up/delivery options as an area on which attention should be focused for ‘Safety Demands Action’ 2021. In doing so, an opportunity presented itself to provide members with information on the risks and hazards involved in undertaking the role, as well as placing pressure on employers to ensure that safe systems are in place and maintained.

and Delegates and Organisers conducted audits of stores with online departments. Generally, we found that although there are a range of safety measures in place in these areas, they aren't enough and improvements are required. Prevalent issues are CCTV in directto-boot areas, working in isolation, customer abuse and violence, PPE and sheltering, traffic management and workload. We will be discussing the safety issues raised by the feedback in coming months, but we strongly encourage all members to raise safety issues with their store manager and through their safety committee. Contact the SDA immediately if your issues are not resolved in a timely manner.

Big W, Woolworths and Coles members were asked about their safety if they worked in this area,

RETIREMENT SAVINGS

SUPER – FOR OUR RETIREMENTS AND OUR ECONOMY BY GERARD DWYER NATIONAL SECRETARY

The Albanese Labor Government was elected on a platform that said “Labor’s vision for superannuation is for the vast majority of the workforce to be able to maintain their working life standard of living in retirement”. The new Government will deliver on increasing super to 12% by July 2025. During the last term of parliament, some members of parliament suggested another freeze like those imposed by the Abbott and Turnbull Governments. But politicians know that 10% in superannuation payments is not enough. Labor protected the increase when in opposition, so we can anticipate a smooth introduction of the rise to 10.5% on 1 July 2022. But Labor’s promise is twofold. Firstly, it’s about our retirement. They said that “Labor will ensure that all workers, regardless of how they are engaged, can accumulate superannuation on every dollar earned.” Secondly, it’s about using our savings for the Australian economy. Labor said that “Superannuation funds are also a source of economic stability in the Australian economy, creating a pool of capital that supports investment in Australian businesses and social and physical infrastructure.”

18 ’CAUSE JULY 2022

We must now focus on Labor delivering on these promises. We must work with the Government to get super paid on every dollar earned and repair the damage of the attacks on super over the last ten years. Our super can contribute to building national prosperity as we emerge from the COVID-19 pandemic.

SUPERANNUATION TO BE PAID ON EVERY DOLLAR EARNED The truth is, the so-called ‘Superannuation Guarantee’ is only a guarantee for some. It’s not guaranteed for those who don’t work a traditional five-day working week from 9am to 5pm with an employment contract. With a workforce changing as much as it has, the old model of superannuation needs to change so that it’s extended from being world-class in the public sector, managerial and multi-national roles to being first-class for everyone. As I write, super isn’t paid to all under 18s, nor on paid parental leave and a range of other payments. The parts of the law that need to be abolished are section 28 of the Superannuation Guarantee Act, called Salary or Wages: excluded earnings of young persons and section 6 which contains the provision that defines part-time. Together, those two sections allow employers to not pay super for those who are under 18 and working less than 30 hours. The Act also includes Regulation 12: Certain salary or wages excluded which allows employers to not pay super on parental leave and other payments.

Just like we won the battle to get superannuation paid on earnings under $450 per month, so too we can win super for under 18s and for those on parental leave – both the employer and government paid parental leave schemes. But it will require campaigning for change. The superannuation system is currently ranked 6th out of 43 in the world6, but if everyone got paid super it could be No. 1.

SUPERANNUATION TO CONTRIBUTE TO THE ECONOMY Our superannuation system means that Australian households have $500 billion in savings that they otherwise would not have. This has helped make Australian households among the world’s wealthiest, and wealth inequality in Australia among the lowest in the world. But inequality is rising in this country as profits go to company owners and managers, and are not being shared through commensurate wage rises. We need to get the economy back on track to rectify this. There is a clear link between retirement savings and lower pressure on the public purse. As the compulsory system of superannuation matures, the proportion of retirees eligible for either a full or part Age Pension is expected to decline – in effect, fewer people will be eligible for the full Age Pension. This will counter the pressure of an ageing population on future Age Pension expenditure by government.

RETIREMENT SAVINGS

This means that, in terms of payments to the aged, Australia is better placed than most other advanced economies. Investments made with our super help the economy too, with our investments providing a local, stable, long-term source of capital for listed Australian companies. Funds like Rest Industry Super, which is the super fund for retail workers, also invests over $8 billion in Australian infrastructure. This means our savings support the Australian community with, for example, the provision of local airports, reliable gas pipelines, renewable power (such as that which comes from wind farms) and secure food sources through agriculture. Retail workers’ savings are being used to build motorways in Queensland and construct schools in WA, as well as developing property such as office buildings, shopping centres and student accommodation. This is especially important for regional economies where so much of the retail industry is located. The commitment in the “Statement on Labor’s Economic Plan and Budget Strategy” was that they will establish an all-of-government framework to facilitate partnerships between super funds and projects of national importance – like largescale and regional infrastructure projects, affordable housing, and seed investment in farm and manufacturing technologies. To deliver on this will require the Government to change some of the policy settings put in place by the outgoing Liberal-National Coalition.

SUPERANNUATION AND HOUSING A key election issue was the link between superannuation and housing. A home and retirement should not be an either/or choice. The truth is, a key determinant for Australians’ retirement outcomes is housing affordability. Housing affordability is likewise a key determinant for Australia’s economic prosperity.

But some believe that Australians should raid our retirement to pay for our homes. This is not on – as I have said before, you should be able to have both a home and a decent retirement. Good sense has prevailed as the electorate resoundingly rejected the notion, just days after economists from all directions described it as a terrible idea for retirement and terrible for the economy. The Labor Government will now need to look at solutions that deal with supply of housing including in partnership with superannuation funds. I look forward to seeing Labor deliver on the promised ten billion dollar offbudget Housing Australia Future Fund to build social and affordable housing now and into the future. Labor also needs to solve employment issues. Too many people don’t have the kind of job that enables them to have a place to call home – a job that is secure, pays good wages, and delivers enough hours of work. In short, ‘decent work’. Labor’s platform aims for full employment, and that includes those who are underemployed. If you want work, you should be able to get it. Especially in what is being described as a tight labour market. Having and keeping work in jobs that will help pay for the costs of living and an affordable home will need to be an early priority for Labor. Whether its owned or rented, your home should be a place of comfort and safety that you can afford because you earn decent wages, and the cost of houses are reasonable. In retirement, whether it’s funded by the pension or superannuation, you should have a decent standard of living – about the same as during your working life or indeed a better one through a minimum standard that provides dignity and economic security.

YOUR QUESTIONS ANSWERED

Q: I am a permanent employee. What happens if I test positive to COVID-19?

A: If a full-time or part-time employee tests positive to COVID-19, they are entitled to access their accrued personal leave entitlement for the period of their isolation and recovery. Under some Enterprise Agreements and Modern Awards, for extended periods of personal leave, you are required to provide proof of your absence by way of a doctor’s certificate or a statutory declaration, so check if this is a requirement in your workplace. If an employee does not have access to accrued personal leave, some workplace COVID-19 policies specify you may have a conversation with your store manager to discuss the possibility of accessing other accrued leave entitlements such as Annual Leave or Long Service Leave. If you do not have any leave entitlements available, you may be eligible for the Pandemic Leave Disaster Payment from Services Australia. To check your eligibility, please contact Centrelink or Services Australia. In NSW, you are required to tell your manager that you have tested positive for COVID-19 as well as the date of your test, the date you began to feel sick or symptomatic, and any days you were at work while potentially infectious.
