Board Bits MAY 2016 BOARD MEETING • Drone Policy Resolution - The Board reviewed and approved the Drone Policy Resolution provided by management. JUNE 2016 BOARD MEETING • Adoption of the Code of Conduct Modifications - The Board reviewed and approved the Code of Conduct as presented with the inclusion of SRCA employees based on review and consent of the Association’s HR attorney. • Establishing Two Criteria for Board Candidates and Committee Members – The Board reviewed and adopted a policy requiring all committee members to sign the newly adopted Code of Conduct and for potential Board candidates to submit to a felony background check at Association cost. • ElectraCraft Boat Purchase – Executive Director, Kathe Barnes, presented information and cost from ElectraCraft for an electric powered boat. After review and discussion, the Board approved the purchase of the ElectraCraft 180cs 2016 model.

How the Finance Committee Works The SRCA Finance Committee is comprised of members of our community association, which enables residents to have a say in how their money is spent. How does the finance committee work and who serves on it? The Treasurer’s and Accountant’s Roles It makes sense for the board treasurer to chair the finance committee. As chair, it’s the treasurer’s job to keep everyone on track during the budget process. The treasurer oversees the process of budget approval by the board and committee members. The association accountant can offer consulting, but our accountant really has no significant role in the process of devising the budget. Their main role is the annual audit of the financials as presented by the association. Who Should Be on the Committee? The owners who serve on the finance committee represent a crosssection of our community. We have financial advisors, CPAs, corporate managers, retirees and more. Our current committee is comprised of ten members and the Executive Director. What the Committee Does The SRCA Treasurer and the Executive Director will make sure that all committee members understand the three basic components of the budget: 1. Funds needed for daily operation of the community, such as common electricity and water, grounds maintenance, management, insurance, and general maintenance. These expenses are either contractual or can be reasonably estimated based on exact need or experience. An important consideration when looking at items in the operating budget is the expectations of the community—for example, do members want a landscaper who is a “blow, mow, and go” type, or do they want a landscaper who provides a higher level of service? 2. Funds needed to maintain our reserves at sufficient levels. Reserve funds provide money for the repair and replacement of the community’s assets—such as the lake equipment, roofs, walls, etc. 3. Funds for additions or enhancements to the existing property. This is a function of what members of the community want and are willing to pay for. The SRCA philosophy has always been that “curb appeal” matters; therefore, another key component to our budget is to ensure that there are funds for future capital improvements and enhancements throughout the community. Our committee would welcome input from the community for this component. Armed with this knowledge, the SRCA Finance Committee and I will estimate total expenses for the coming year and compare that sum to the association’s potential revenue (assessments, interest on investments, other income, and so on). If expenses are greater than revenue, the committee will first look for ways to lower expenses without compromising service. If that doesn’t balance the budget, the committee may have to make a tough decision—whether to increase assessments or not. Our annual assessment‘s last increase was in 2009. As always, we will work diligently to keep the assessment level down but Scottsdale Ranch looking pristine. Notification of the 2017 assessment and budget will be in the Dec/ Jan magazine and will be sent to all homeowners along with the 2017 assessment invoice.

A seven member Board of Directors governs Scottsdale Ranch Community Association (SRCA). The Board establishes the basic policies of the Association and oversees the operation of the professional staff. The Board of Directors meets the fourth Tuesday of every month at the Community Center. These meetings are open to the membership. By Matt Metz SRCA Board President It’s summertime again here in the Valley, and I suspect many of you are enjoying cooler weather in other parts of the country. But the heat doesn’t stop all our activities and progress here at the Scottsdale Ranch Community Association. This spring, we held our election of board members. We bid a fond farewell and hearty “thanks!” to Lea Diamond who ended her term. She left a legacy of activism and engagement with families that we appreciate and will attempt to continue. Board members Mike Breslin and Brian Munson were re-elected to the board, and we also welcomed Mike Nelson, our newest member. Mike brings tremendous financial background and experience with him to the board, and he immediately volunteered to chair the Finance Committee. Per our rules, one of the first acts of the board is to select officers for the next year. I was honored to have been elected President again. Mike Breslin was also re-elected to his role as Vice President. Barbara Sarwar was selected to serve as Secretary, and Mike Nelson – our newest member – jumped immediately into the role of Treasurer, replacing Brian Munson who is starting his second term on the board (this time around). Aarash Darroodi and Ray Texeira start the second year of their first two-year terms. Our members also passed six important changes to our controlling documents. • To keep current and eliminate unnecessary restrictions on our members, we removed from our CC&Rs the prohibition of food preparation facilities (kitchens) in guest houses. The old language was intended to help prevent renting out portions of lots, but other language in our documents already did that. The newer language allows homeowners to install kitchens in their guest

• The second modification to our CC&Rs clarifies what portion of the lot is used to measure setback requirements – basically stating that setbacks for side and back yards are measured from fences (if there is a fence), not property lines. This helps remove some confusion and ambiguity from our documents. • The third change to our CC&Rs limits commercial vehicle parking on streets within Scottsdale Ranch. Most homeowners don’t want commercial vehicles parked on their streets more than is absolutely necessary; this new rules basically states these vehicles can be parked only while in the process of delivering products or services. This is an important rule for protecting our quality of life in SRCA • Fourth, our residents approved a change to our bylaws reducing the severe term limits we had on board membership. As a result of the change, board members may serve at most three consecutive two-year terms; at that point, the member must step off the board for at least one year. The prior restriction (limiting board service to at most four years out of any ten) was unnecessarily restrictive, and often pushed board members off the board right when they were starting to “get the hang of it.” • Fifth, we modernized our bylaws by allowing for electronic (internet) voting. This helps move us into the 21st century, preparing us to save time, money, and effort for future voting. • Finally, we changed our bylaws to ensure the method we use in the future to modify the bylaws is consistent with Arizona statute – requiring 2/3 of the votes cast, rather than a majority of a quorum. It takes a LOT to keep Scottsdale Ranch current and to ensure our community association is able to protect our property values and quality of life. Among those are: keeping our documents current; electing competent people to our board; the hard work of the scores of folks who serve on committees and volunteer to help at events; and, of course, our Executive Director Kathe Barnes and the terrific staff. By the way, if you haven’t dropped by the Community Center recently to meet our newest staff members, please make an effort to stop by and say “hi!” to Sonja Perez, Anna Marie Gonzalez and Linda Quesal! Declaration empower the Board to adopt rules and regulations on a variety of matters to be known as the Scottsdale Ranch Rules;

Not only has Scottsdale Ranch Community Association adopted a new Drone Policy, the City of Scottsdale and the FAA have put forth policies and enforcements regarding drones as well. It is advised that anyone who flies a drone in Scottsdale familiarize themselves with all of the current HOA, city, state and federal drone polices and guidelines.

Drone Resolution and Policy

WHEREAS, Article IV, Section 2(z) of the Declaration further empowers the Board to restrict and regulate activities that are deemed a nuisance or affect the health, safety, and welfare of Owners and Residents; WHEREAS, Article IV, Section 2(e) of the Declaration prohibits nuisances on Lots and Parcels; and WHEREAS, the Board is concerned with the impact on safety and privacy presented by the use of drones in the community, as well as the potential for drones to create a nuisance for residents of the community.

WHEREAS, the Scottsdale Ranch Community Association (“Association”) is governed by the Fourth Amended and Restated Declaration of Covenants, Conditions, Restrictions, Assessments, Charges, Servitudes, Liens, Reservations and Easements (Scottsdale Ranch Community Association) (the “Declaration”), recorded at Recording No. 2016-0334975 in the office of the Maricopa County Recorder;

NOW, THEREFORE, the Association hereby adopts this Drone Resolution and Policy and makes it part of the Scottsdale Ranch Rules in order to regulate the use of drones in the community.

WHEREAS, Article V, Section 3 and Article XIV, Section 5 of the

1. The use of any Model Aircraft, as that term is defined in the

FAA Modernization and Reform Act of 2012, or any small unmanned aircraft system (UAS) that is governed by Federal Aviation Administration (FAA) rules now or hereafter in effect (collectively, “Drones”) within the Association shall be governed by this Drone Resolution and Policy. 2. Anyone operating a Drone within the Association is solely responsible for ensuring their own compliance with all local, state, and federal laws, regulations, and rules. The operator of a Drone shall be solely responsible for any injury or damage arising out of the Drone’s operation in the community. 3. Any Drone that is operated so as to be offensive or detrimental to any other property in the vicinity thereof or to its occupants, as determined in the sole discretion of the Board, shall be deemed to be a nuisance and in violation of the Declaration. 4. Upon the written request of any Member or Resident, the Board shall conclusively determine, in its sole and absolute discretion, whether a particular Drone is being operated so as to be a nuisance. The Member or Resident submitting the request for determination of whether the Drone is a nuisance shall keep a log and documentation of proof of the nuisance for a minimum of two (2) weeks or such other time period as is prescribed by the Board. The Member or Resident must also provide information to the Association documenting in what Lot or Unit within Scottsdale Ranch the user of the Drone resides. In addition, Members or Residents submitting a request for determination of any of the above shall provide any other documentation required by the Association. Any decision rendered by the Board shall be final and enforceable in the same manner as other restrictions of the Declaration. 5. The Association is not required to take enforcement against all Drones operated in Scottsdale Ranch. However, should the Association bring any legal or administrative action to enforce this Drone Resolution and Policy and/or the Declaration with respect to a Drone, the Member or Resident submitting a complaint would be required to testify and provide documentation relevant to the complaint. The Association does not prejudice or waive its right to enforce this Drone Resolution and Policy and/or the Declaration should the Association not enforce this Drone Resolution and Policy and/or the Declaration as to any particular Drone’s operation in Scottsdale Ranch. 6. The Board of Directors shall have the authority to enforce the provisions of this Drone Resolution and Policy in any manner provided by the Association’s governing documents and applicable law.

Making Changes?

As we are in the midst of the hottest time of the year and we start looking towards the fall to plan upcoming projects, here are some things to keep in mind-ANY change to the exterior of the home or yard will likely require some sort of approval from Scottsdale Ranch. Many changes can be approved on a staff level and should only take a matter of a few days for approval, while others require disclosure to neighboring properties as well as Architectural Committee review and approval. In addition to things like guest houses and additions, there are many types of projects that you may not know require approval. Some of the Types of Exterior Changes that Require Approval • Window and door replacement, even when the openings are not changing. • Basketball hoops, trampolines, play structures, sports netting and flagpoles • Front yard landscape changes, including removal of grass, change in decomposed granite color, addition of plants and boulders • Awnings, shade screens, security screens • Exterior art in the front yard, including statues, fountains and pots, dependent upon size, number and color. • Coatings on walkways, added walkways and pavers • Gate replacements • Rain gutters • Roof tile replacements • Mailboxes • Garage Door replacements • Changes in exterior lighting, including landscape lighting • Repainting • Any change in the rear yard that is at wall height or above, including rear yard fireplaces Don’t forget-your sub-association will require final review and approval of all projects. First, I would like to introduce myself as the new Homeowner Liaison for Scottsdale Ranch Community Association. I am delighted to be here and grateful to have the opportunity to work on such a beautiful property. As Homeowner Liaison, part of my role is community Before compliance. Yes, I am the person who drives around and sends notices to residents regarding issues on their property. It’s not a glamorous position and, sometimes I unintentionally upset people. But compliance inspections are an important part of an association as they help maintain the standard set by the rules of the community. These rules are established to ensure the collective rights and interests of all owners, protect and enhance property values and provide and protect the services and amenities promised. With all that said, I would like to talk about a compliance issue that will be prevalent on upcoming inspections.

When Caring for Palms DO • Remove only dead fronds to a 180 degree angle, 9:00/3:00 o’clock positions as you look at the tree. • Use a sharp linoleum knife to remove dead fronds. • Remove fruit clusters to avoid pavement staining. • Remove seedling branches DO NOT • Remove fronds higher than a 45 degree angle. • Use dull tools. • Trim fronds before entering cool/wet season to avoid creating an environment for fungal development. • Remove more than 25% of foliage at any time • Prune before the danger of frost. If you have not trimmed your trees, now is a crucial time to schedule with a landscaper or certified arborist as the palms have seeded/fruited and we are receiving numerous complaint calls regarding palm debris clogging pool filters. Notices are being sent to owners who have not trimmed their palm trees. Get to know your neighbors…

Some may not be aware, but located right within Scottsdale Ranch’s own boundaries, located over at the Scottsdale Ranch Park on the corner of Via Linda and Lakeview Drive is our very own Desert Garden Park. This beautiful park was designed to enhance the understanding of the Sonoran Desert, of botanical processes, and of the geology and soil materials indigenous to the nearby McDowell Mountains. The Garden Park features three zones: a hummingbird nest for the low desert area, a saguaro and bat sanctuary for the high desert area, and a butterfly garden for the riparian community area. The park is free and open to the public. The Desert Garden Park first opened in 2003. Scottsdale Ranch played an intricate role in the development of this amenity. Back in 1979, the developer of Scottsdale Ranch donated 64 acres of land to the City of Scottsdale for a General Public Use area in the heart of its master-planned community. The City of Scottsdale actively pursued various parties to build a public use facility on a five acre parcel on the corner of Via Linda and Lakeview Drive. The SRCA Board of Directors, staff and a special volunteer Park Committee, comprised of SRCA residents, spearheaded fundraising efforts and proactively participated in the development of this site. The garden has since been a treasured amenity for Scottsdale residents. If you haven’t already, be sure to take a few moments to go and experience this great area. 12

In the Community…

Scottsdale Family Advocacy Center The Scottsdale Family Advocacy Center is located just behind the Mercado, right here in Scottsdale Ranch. The center was designed to increase the effectiveness and efficiency of the Scottsdale Police Department’s Crimes Against Persons investigations section, while also reducing stress and trauma to victims. The center provides office space to a number of investigative units and outreach organizations, all under one roof, working together. The SFAC is not a shelter. It is an office space that provides resources for victims of domestic abuse, sexual assault, and a myriad of other person to person crimes. The center puts victims together with special investigators, forensic nurses, crisis intervention specialists, and the Department of Child Safety, as well as officers from an array of agencies, which can provide both short and long term assistance. An example of the services provided and the donations needed, can be found in the story below. Sarah and her two children have been displaced from their home due to domestic violence. A caring co-worker has contacted the Scottsdale Family Advocacy Center about Sarah and her children. Upon arriving at the center the family was greeted and made comfortable in the safe, professional environment. The children were given access to the play room as Sarah was interviewed by investigators and attentive personal from multiple agencies. The center also provided a quiet room where the youngest child took his nap. After speaking with the investigator and the crisis interventionist, Sarah decided that it was best for the family to relocate to Sarah’s mother’s home in Santa Fe as soon as possible. Due to safety, security and other sensitive issues, the crisis interventionist cautioned Sarah against using her personal bank card or involving any other family and/or friends at that time. Bus tickets were purchased for the family to depart for Santa Fe the next morning. Unfortunately, the crisis interventionist was not able to secure overnight housing at a local shelter or safe house, therefore the SFAC provided the family with a one night stay at a local motel. The family was driven to the overnight accommodation by a SFAC staff member, provided with a gift certificate for a nearby eatery and prepared for the morning’s journey. The Scottsdale Family Advocacy Center has been able to provide assistance to Sarah and her children during this trying time through the use of donated gift cards to the various businesses utilized. By 9:00 am the next day, Sarah and her children were on a bus and on their way to a safer and more secure living situation. Through the SFAC, detectives, crisis interventionists and agencies had the opportunity to gather the information required to fully investigate the family’s situation as well as provide the family with the emergency assistance they needed in that moment. In order to aid victims, the center utilizes gift certificates to all kinds of businesses such as; grocery, dining, clothing, personal care, home goods, toy stores, gas, transportation services and accommodations. The center also accepts donations of old cell phones for emergency use and recycling. Summer brings warm weather and a time for families to have fun. When the bikes come out of the garage, here are few tips to limit the chances of those bikes being stolen. 1 Register your bicycle for free with the Scottsdale Police Department • Go to the City’s Service page http://www.scottsdaleaz.gov/ services • Scroll down to Bicycle Registration or call (480) 312-3134. • Select Bicycle Registration Application. • Create an account by inputting your email and a password. • Provide the make, model and serial number of the bike. • You will receive in the mail a strong adhesive sticker to apply to your bicycle. 2. Use a quality bike lock. • Cable locks are easy to cut. • Use a quality U-lock designed for bicycles with a key, not a combination. • Take a picture of the bicycle for your records with the make, model and serial number in the event of theft. • Don’t leave items on the bike that can be taken like the light, bag, water bottle, quick release seat or helmet. 3. Know WHERE to lock your bike. • Don’t leave the bike outside overnight. • Lock your bike to a solid metal object securely fixed to the ground and in plain view of other pedestrians, bike riders or residents. • If you are able to store your bike in a bike room of your multifamily property like a condominium, STILL use a U-lock to secure it. 4. Know HOW to lock your bike. • If you have quick release rims, remove them and place alongside bike using two U-locks to secure the rims to the frame and the frame to a stationary object. 5.
