The effects of adverse possession on oil and gas rights By: Sara Fanning, attorney at Roetzel & Andress (sfanning@ralaw.com) This year, the Seventh District Court of Appeals issued a significant decision in Tomechko v. Garrett concerning adverse possession of oil and gas. The Ohio Supreme Court declined to review the Seventh District’s decision, making it the law of the land within its jurisdiction of Belmont, Carrol, Columbiana, Harrison, Jefferson, Mahoning, Monroe, and Noble Counties, which make up most of the oil and gas producing counties in Ohio.

In plain terms, adverse possession is a legal doctrine whereby a person can acquire the property of another by using that property for at least 21 years. To establish ownership by adverse possession, a person must prove that he or she exclusively and continuously used and possessed another’s property in an “open and notorious” manner, i.e. not concealed or secret, for 21 years. In the case of oil and gas, one must actually produce the oil and gas for 21 years; simply possessing the surface is not enough.

In the Tomechko case, an oil and gas lease was entered into by the owners of half the oil and gas estate, and an adverse owner (not the true record owner) of the other half of the estate ratified the lease. Two shallow wells were then drilled on the property in 1991,

and the wells produced for over 21 years. The royalties were split evenly between the record owner who signed the lease and the adverse owner who signed the ratification, and no royalties were paid to the record owners for over 21 years.

The trial court held that the plaintiffs (surface owners) adversely possessed the shallow formations into which the wells were drilled, but they did not adversely possess the deeper formations. Plaintiffs appealed the trial court’s decision, and the appellate court reversed, stating “[a]dverse possession of the deep rights should follow the shallow rights due to the alteration of the surface and subsurface from drilling and removing the oil and gas. Merely because drilling had not yet affected the deep rights should not yield a finding that there is no adverse possession of the deep rights.” In other words, the production of oil and gas from the shallow formations is adverse possession of all the underlying oil and gas layers, including the deep formations.

This decision will greatly impact Ohio surface owners’ ability to regain ownership of the oil and gas rights under their properties.

COVID-19 in Harrison County: a 2021 year-end retrospective

BY REBECCA BRATTEN WEISS Harrison News-Herald Reporting Journalist Dec. 28, 2021, marked the one-year anniversary of the first administration of vaccine doses in Harrison County. On that day, a dozen EMTs received their first shots as part of the very first phase of the vaccine rollout.

About 700 cumulative cases of COVID-19 had been reported in Harrison County at that time. A year later, COVID-19 has been officially present in Harrison County for 20 months, since the virus was first reported in April 2020. As of Dec. 28, 2021, the county has had 2,374 total reported cases.

2021 saw a number of significant milestones as the pandemic continued in Harrison County. The vaccine became more plentiful and available in January 2021, so the county health department began working to organize mass vaccination distribution sites. The first of these was held at Sally Buffalo Park on Jan. 22, 2021, for residents aged 80 or over. On that day, about 300 vaccines were administered.

County health administrator Garen Rhome shared with the News-Herald that a lot of work went into making the first distribution clinics possible. “That was a big undertaking,” he said.

“We had to put out a survey, create a waitlist.”

The mass vaccination clinics continued into early May with the vaccine becoming available to more and more age groups. “Nearly every Friday, we were out there doing between 250-500 doses,” Rhome said. “And at some

point, we were giving not only first but also second doses. By then, we were both Pfizer and Moderna. That was a huge effort for the entire staff. It was an all-hands, all-team, allstaff operation for quite a few weeks and even months.”

June 2, 2021 was another notable day in Harrison County and for the whole state of Ohio. On that day, Governor DeWine lifted the state’s public health restrictions and lawful orders requiring mask-wearing, social distancing, and gathering size limit.

This lifting of restrictions was in response to a piece of legislation passed through the Ohio legislature, which would have potentially lifted restrictions whether the governor opted to or not. Initially, DeWine’s office had stated that they would lift those restrictions when the state met a certain threshold, dropping to 50 cases per 100,000 (which would technically be considered moderate spread). However, the state had not met that threshold when the restrictions were lifted. The state continued to recommend such public safety measures as monitoring symptoms, being cautious about one’s surroundings, and masking in indoor places.

The lifting of restrictions in Ohio happened to coincide with the delta variant becoming a matter of national concern. And in July 2021, Harrison County had its first case of delta.

Adena re-ups with Kimble

Adena, in recent months, put out the trash collection services to bid, but as it was revealed in the meeting, only one bid was received: Kimble’s. “We had Kimble put out for bid for the contract for the garbage,” mayor Brenda Roski stated. “It was the only bid we received,” she confirmed. “We’ve had the contract for many, many years,” Kimble explained as he took the floor. Then he revealed the new proposed rates at $15.98 a month. The bills would still get paid every three months, but the overall increase figured to about 70 cents per month. However, the rate doesn’t include a Kimble “cart” (trash bin), but the 96-gallon units can be tacked on to the bill at an additional $3.60 a month.

Kimble also addressed a request for a tire dumpster. “We can deliver it for $175,” he revealed when asked. According to Kimble, the 40-yard open-top dumpster could be brought in specifically for the tires’ disposal. Once full, the dumpster would be pulled and delivered to

Liberty Tire in Minerva.

Kimble added that the dumpster rental is $8 per day and $500 per pull. While nothing was set in stone, Roski was glad for a method to finally start addressing the tire buildup around Adena: “At least we have a possibility on this.”

The tire abundance has been a devaluing eyesore, and many council members have wanted to spearhead their disposal. While nothing was concretely confirmed, Roski and council member RJ Konkoleski both expressed gratitude for the option. “We got an issue with tires. We all know it,” Roski declared. “But at least we got an option,” Konkoleski chimed in.

Before Kimble departed, the council brought up moving Main Street pickup locations back into the alley behind the houses.

They’re currently being placed on the curb in front of the houses, and some village residents and council members would prefer not to see trash cans lining the main thoroughfare every trash day. The back-behind alley isn’t ideal for some of Kimble’s trucks, but it would allow for the streamlined trash collection of two streets worth of houses in one fell swoop if all the carts were taken out back. The council members were going to look into the issue further.

New Rumley celebrates Custer’s 182nd birthday

By ESTHER MCCOY Correspondent NEW RUMLEY—General George Amstrong Custer’s birthday is still being celebrated in the village where he was born 182 years ago. At the New Rumley village, under the direction of the Custer Memorial Association, a birthday dinner is held each December, and a knowledgeable speaker is brought in. There’s also an auction of Custer memorabilia, a display of how the village was laid out, his log cabin home, and a kiosk showing pictures of the general from his babyhood throughout his lifetime.

He lost the lives of his entire group, who were scalped, and also his own life in the Battle of the Little Big Horn. But history tells that his flowing yellow hair was not taken from his head, as was the soldiers in his troop who were scalped.

Vince A. Heier, a lifelong student of the Battle of the Little Bighorn, was the guest speaker and the one given the honor to help cut the first piece of the gigantic birthday cake with a saber.

Heier became interested in the general and his times and his impact on popular culture.

He’s also a member of the Custer Battlefield Historical and Museum Association and Custer Memorial Association. He has published a book

on “Little Bighorn in the Postcard History” series and is the reviewer and author of papers given at the Custer Battlefield Historical and Museum Association.

Rick Williams of near Columbus, who has appeared at many winter and summer events, was unable to attend because of illness. He usually comes with yellow, flowing hair and buckskin clothing, and he makes a convincing representative. Officers for the group are Dave Rose, president; Kevin Haney, vice president; Leroy Van Horne, a collector of Custer literature and old-time artifacts; and Ed Chapdelaine, treasurer.

Van Horne has served in other offices during his years with the group and is a collector of Custer and other generals. He resides in New Rumley.

Santa visits Senior Center over Christmas season

Guests at the Harrison County Senior Center on Main Street Cadiz got into the spirit of Christmas with some seasonal festivities last week. As well as their regularly scheduled covered dish lunch get-together, the guests participated in a gift exchange, a 50-50 raffle, door prizes, and even a visit from Santa. Andy Atkins of Hopedale got into both costume and character to portray Santa Claus for the clients who had gathered for lunch in the dining area, and Misty Mae Darios assisted him as his special elf as they greeted guests and handed out gifts.

The holiday event last Tuesday is just one of the many activities and social opportunities that the Senior Center helps facilitate for older Harrison County residents. They routinely host covered dish gatherings for their guests April through December and often organize bingo nights (typically about four per month).

Recently they even held a country musicthemed dinner. And the Senior Center is also looking forward to adding a new opportunity to their roster with a chair exercise fitness program that they plan to initiate in 2022.

Additionally, Angie Myers of the Senior Center gave the News-Herald a quick rundown of some of the other practical services the organization offers: transportation for seniors who lack access to it on their own, home visits, basic homemaking tasks such as cleaning and assisting with meals, and running errands for seniors. In addition, once a month, they distribute “commodity boxes” containing basic food items like canned goods, milk, and cheese.

The center organizes a farmers’ market for area seniors, too, during the summer months. “The whole community supports this,” Myers said.

Visits from Santa have been a Christmas tradition at the Senior Center for five or six years, but last year, during Christmas 2020, they had to give it a pass because of the pandemic. Being able to gather again for the holiday season, share meals, and participate in decorating the center for Christmas is a wonderful opportunity for local seniors to connect and celebrate together.

Myers also explained that the Christmas tree in the center has a special meaning for the Senior Center clients: most of its ornaments were provided by seniors who brought in one of their own that held special significance or memories.

Lady Huskie basketball falls in St. Clairsville

ST. CLAIRSVILLE—An evening visit to St. Clairsville on Tuesday by the Lady Husky basketball team ended in a 34-44 loss.

Harrison Central now drops to 5-6 with that loss. Unfortunately, the outcome also finds the Huskies in the middle of a three-game slide.

The 34-point total for Harrison indicates the scoring ability of the first five on the squad.

McKayla Dunkle had 13 points to lead the Husky scoring during Tuesday’s road trip.

Emma Fischer scored 4 points on the night, Kaily Banal scored 2 points, Maddy Butler

got 7, Angie Ferri added 2, and MacKenzie Harbold scored 6.

For St. Clairsville (4-4), Shae Brookover and Denise Tuttle led the Lady Red Devils with 11 points each. And Lexis Thoburn and Megan Malin each had 8 points on the night. Sydney Miller also contributed 6 points to the win.

St. Clairsville was credited for dropping in 3 three-balls in the scoring. Brookover had 1, Tuttle had 1 of her own, and Miller scored the other 2.

Jr. high girls’ basketball goes 1-1 over Christmas break

BY SHARON DALTON Harrison News-Herald Sports Writer The Harrison Central Junior High Lady Huskies hosted the Conotton Valley Rockets on Dec. 22. After a closely contested first quarter, the Rockets led 4-3. Then the Rockets scored the first 10 points of the second quarter to take a 14-5 halftime lead. And the Rockets continued their hot shooting to lead 21-7 going into the fourth quarter. However, the Husky offense heated up in the fourth quarter to outscore the Rockets 8-7 for a final score of 28-15. The leading scorer for the Huskies was Randee Hennis with 10 points.

After the Christmas break, the Lady Huskies returned to the hardwood to entertain the Shadyside Tigers. The seventh-grade squad started strong, leading by halftime 14-4. The young Huskies continued their strong offensive game going into the fourth quarter 22-8. The Tigers only scored 1 point in the fourth quarter resulting in the final score of 29-9. Leading the Huskies in scoring was Mikayla Pelegreen with 8 points.

OBITUARIES Leonard Stewart Leonard J. “Lenny” Stewart, 79, of Jewett, passed away peacefully on Tuesday, Dec. 21, 2021 at his home surrounded by his family. He was born July 18, 1942 in Ames, New York, a son of the late James and Evalyn Kail Stewart.Lenny was a self-employed farmer and a member of the Harrison Hills Church in Jewett, the UMWA, and Hopedale American Legion.

In addition to his parents, he was preceded in death by his wife, Bonnie Dunlap Stewart; a son, David Stewart; and a brother, James Stewart.Surviving are his son, Carl (Jessica) Stewart of Jewett; two daughters, Renee (William) Ralston of Rayland and Melissa (Robert) Hursey of Jewett; many grandchildren and great-grandchildren; a brother, Richard Stewart of Mishawaka, Indiana; and two sisters, Donna McGray of Jewett, Ohio and Janet Wells of Bellview, Ohio.A celebration of life memorial dinner will be held at the Hopedale American Legion on Saturday, Jan. 15, 2022 at 1 p.m. The family is being assisted

Ronald Ferri Ronald L. Ferri, 68, of Georgetown passed away on Thursday, Dec. 23, 2021 at his home after a long battle with cancer. He was born April 30, 1953 in Wheeling, West Virginia, a son of the late Dominic and Martha (Blake) Ferri.

Ron retired from Columbus Equipment Company in 2019 after 35 years of service. He was an avid sports fan, especially Cleveland. He also loved watching and helping his grandkids with sports. He never missed an event.

In addition to his parents, he is preceded in death by his father- and mother-in-law, George and Catherine (Kate) Bomboris and two sisters-in-law, Constance (Mike) Slaga and Sue (Jack) Moore.

Surviving is his wife of 42 years, Teresa (Bomboris) Ferri; their children, Ryan (Tiffany Johnson) Ferri and Becky (Joe) Thomas, both of Cadiz; special niece, Katelyn Bomboris; grandchildren, Kamryn and Chase Campbell and Connor Ferri; stepgrandchildren, Lucas, Landen, and Lillian Thomas and Logan and Madalyn Johnson. Also surviving are his brothers, Rick (Sherrie) Ferri and Dave (Gina) Ferri, all of Cadiz; brothers-in-law, George Bomboris of Adena and Tony (Brenda) Bomboris of Colliers, West Virginia; and several nieces, nephews, great-nieces, and greatnephews.

Calling hours will be held on Monday, Dec. 27, from 3-8 p.m. at the Clark-KirklandBarr Funeral Home in Cadiz, where funeral services will be held on Tuesday at 1 p.m. with Reverend Pete Tuchek officiating. Burial will follow at Holly Memorial Gardens in Pleasant Grove, Ohio.

Carol Cyrus Carol Lee Kinsey Cyrus, age 75, of 26220 Westchester Road, Tippecanoe, died at 9:35 p.m.

Tuesday, Dec. 28, 2021 at the OhioHealth Riverside Methodist Hospital in Columbus, surrounded by her family.

She was born January 27, 1946 in Springfield Township, Akron, Ohio, a daughter of the late Marvin S. Kinsey and Loretta Uetz Kinsey.

Carol was a 1964 graduate of Springfield High School. She worked at Mohawk Tire Company in Akron and for the Freeport Press bindery and office for several years.

She loved crossword puzzles, crocheting, flower gardening, going to auctions, talking on the phone, chocolate ice cream and hot fudge sundaes, packing eggs, antagonizing her sons, and spending time with her grandkids.

Her husband, Charles Ray Cyrus, Sr. died Sept. 7, 2021. They were married on Aug. 30, 1968 and lived in the Akron area until 1978, when they moved to their present home, where they raised their three boys.

She is survived by their three sons, Charles Jr. (Lori) Cyrus, Mark (Kim) Cyrus, and Gary Cyrus; grandchildren: Markie Cyrus, Koty (Paxton) Cyrus, Conner Cyrus, Shania (Cash) Cyrus, Stetson Cyrus, and Daisy Cyrus, Cheyenne (Tanner) Bailey, Shaunee (Kyle) Swihart, Mia McIntire, and Max McIntire; great-grandchildren: Stryker, Bryler, Hayden, and Ashtyn; a twin sister, Karen (Ken) Dunbar of Dayton and a brother, Harold (Donna) Kinsey of Cuyahoga Falls; and several nieces and nephews.

She was preceded in death by a brother, Lester Kinsey, and a sister, Charlotte Roads.

Visitation will be held from 1-4 p.m. Saturday, Jan. 1, 2022 at the Koch Funeral Home (216 S. High Street in Freeport) and also on Sunday, Jan. 2, 2022 from noon to 1 p.m. A service will be held at 1 p.m. Sunday, also in the funeral home, and burial will follow in Greenmont Union Cemetery. How Do You Do 2022?

us. Time management is not just for upscale professionals; it’s for all of us — from students to retirees. We all get 24 hours a day. It’s up to us how we spend them.

We do it every year, but very few of us ever stick with it: New Year’s resolutions. And 2022 will be no different. Whether it’s more disciplined spending and saving, dieting and exercise, or a myriad of other things, we always try to make a clean start on Jan. 1. One of the best advertisements I ever saw was a New Year’s Day full-page newspaper ad for a gym with a person on a stationary bike wearing sweaty work-out clothes and only two words printed on the page: “You promised.” The ad for new enrollment at the gym was effective because, for the previous weeks of holiday eating, thousands of people had been saying, “After the holidays, I’m really going to get down to the business of getting in shape.” The ad simply reminded them of their own words.

Commitments to getting our physical life in order are great, but what about our spiritual life? Followers of Jesus have all the more reason to “get in shape” spiritually as we do in health and finances. So, with that in mind, here are just a few things every Christian can take aim at this year.

Whose soul will you pray for this year?

If we truly believe what the scriptures say about unbelievers being eternally separated from God, we should be relentlessly knocking on heaven’s door with prayers for those we know are indifferent to the gospel message.

(And now that we have removed the timewasters from our life, we’ll have more time to bring those people before the throne.)

What could you do to strengthen and enjoy your walk with God? The answer is not difficult; we can all spend more time alone with him and reading his word. And that ties directly to the next question…

What’s the biggest time-waster in your life?

Here’s the thing: If we’re not good enough at wasting our own time, there’s always someone else willing to come along and help

Is there some form of serving you can do for the Lord this year that will matter in eternity?

Scripture tells us that we all have a skill set, something that can benefit other members in the body of Christ. No one has been left without a talent.

Are you willing to pray bigger and bolder prayers this year?

The letter from James tells us that the effectual fervent prayer of the righteous avails much. Hebrews says to approach the throne of grace boldly. We serve a big God who answers big prayers. An obscure fellow named Jabez prayed a simple but audacious prayer in 1 Chronicles 4, “Jabez cried out to the God of Israel, ‘Oh, that you would bless me and enlarge my territory! Let your hand be with me and keep me from harm so that it might not bring me pain.’ And God granted his request.” This planet needs a lot more Christians who are willing to pray to have their territory enlarged to reach more people for God’s kingdom.

Ann’s Advice

Dear Ann, I bought my child what I felt was a “big” Christmas gift. When they opened it, they were excited but not very appreciative. It was as if they expected to get it and did not realize the effort it took me to get it for them. I was disappointed. How should I approach this topic with them?

Sincerely, Giving Dear Giving, A lack of gratitude is very disheartening. This is usually a sign that they have too much. If it’s a young child and they have too many toys etc., you could try storing half or more and rotating them every 6 months or so. That way they aren’t overwhelmed with so much (and they’ll forget what they had, so it will be like getting new toys all over again). Children don’t need all the things that are advertised. With teens, I always find it is better to set the precedent as a parent. If you start pairing back and include them in the process, it could have a profound impact on how they form their own habits. It is nice to have good things, but it is detrimental for children to expect to get every new toy or piece of technology. You’ll end up with a room full of things when what they really need is your attention. I encourage you to spend time with your children instead of supplying their every want, so you can teach and explain the hard work it takes to get those nice things. Teach them to be thankful for the “little things” (relationships, time together, intangible values) instead of focusing on the (usually unnecessary) big things that distract us from what actually matters. By Susan Adams The Feed Spring Church on the Moravian Trail outside of Deersville will be having a game night on Dec. 31 at 6:30 p.m. at the Feed Spring schoolhouse adjacent to the church — a fun way to close out 2021.

The Deersville General Store will be closed Saturday, Jan. 1.

On Jan. 6, Thursday at 10 a.m., the Women of Mission of the Deersville UM Church will meet at the Holy Grounds Cafe in Dennison. New members are welcome. One does not need to be a member of the church to join the group.

On Jan. 10, Monday at 10 a.m., the WoodyPaul Blanket Mission will meet at the Deersville UM Church fellowship hall. Anyone who can tie a knot is welcome to come. A covered dish lunch will follow.

Also on Jan. 10, Monday will be the monthly business meeting of the Deersville UM Church.

The PPR will meet at 6 p.m. and trustees at 7 p.m., followed by the administrative council.

Everyone on these committees is encouraged to attend. Any of the congregation that wants to sit in on the trustee and administrative council meetings are also welcome to come. Thank you to those who serve to take care of the church’s business so that the church is a good steward of the gifts God has given to them to manage.

Koda Devore ended the 2021 race season on Dec. 11 by picking up his ninth and final win of the season. This included three national events and two big EROC rounds. The last race brought his career total to 121 wins. He is now in Georgia for winter conditioning. The first green flags for 2022 will wave in February.

Congratulations, Koda, and best wishes as you move on in 2022 with the EROC Eastern Racing Offroad Championship races. Koda is the son of Travis and Nikki Devore of rural Uhrichsville and the grandson of Shelley (late Chuck) Devore of rural Deersville.

Old 22 Service Center new to Cadiz Ryan Coffman and Ben Dodds have recently expanded their over-the-road trucking company, Old 22, to include an auto service center. Coffman, Dodd’s former wrestling coach, turned into a friend and business partner when the two began their small trucking outfit together nearly three years ago. The trucking side of the business has kept busy hauling crude oil for local operations.

In mid-October, Old 22 opened to the public, and they boast a DOT certified mechanic, convenient pick-up and delivery of vehicles, and low prices on undercoating ($150 for cars, $175 for SUVs). In addition to a typical oil change and tire rotation, the service center can take care of any heavy-duty truck that needs a yearly inspection, install snow removal and construction equipment, and service ATVs

and UTVs. “What sets us apart from other shops in the area is our open schedule because we are fairly new to this and our availability to pick up and drop off vehicles if customers are at work or can’t find the time to wait at the shop,” said Dodds. “We are glad to take a look at any job, big or small, and give a free estimate at the least.”

Driving east out of Cadiz toward Hopedale, Old 22 Service Center is located three and a half miles outside of town past the red light.

They are open during normal business hours Monday through Friday. New customers are welcome at the service center, and qualified drivers are encouraged to apply at the trucking company.

Thank you to all who came for the Dec. 24 Christmas Eve candlelight service at the Holloway UM Church. There was a baptism of Cooper Michaels, two special songs by Bob Tomer, and a wonderful message by Pastor Jon Little. Karen Hinkle did a fantastic job as organist. With the support of her grandmother Ruth Robertson, Gracie Hans did an awesome job as acolyte. It was an inspiring evening with readings, message, scripture, and music. The church looked beautiful. Anyone who left a poinsettia can contact Ruth Robertson to pick it up or come to Sunday service and pick it up then. Each poinsettia has a name on it.

SMITHFIELD

By Esther McCoy We are into a new year and hopefully successful in conquering the diseases that have been roaming around our country and overseas. We had two nice holiday events, even with taking care of everyone this year. The McCoys from Delaware, Ohio, Plain City, and Bolivar all congregated for lots of eating and playing card games that I always dream up on Sunday.

We saw a video of Maggie, our 14-year-old athlete extraordinaire, practicing her catching abilities. She is not a big girl but isn’t afraid to protect the plate when a runner comes barreling in at full speed. Jackson, 17, is more interested in the musical side. He taught himself to play the tuba and French horn over the summer two years ago so he could play in the Johnathan Alder High School band and go along to the games. He is now saving for a guitar and taking lessons on that instrument. The McCoys from the other side of town are all graduated and situated in the employment of their liking. Time does pass by quickly. I remember holding them in my arms before they were even a day old.

There was sadness in the loss of our brother-inlaw, Andy Toth, who died unexpectedly on Oct.

5. We live next door to each other, and each time I would go over, he would get the coffee maker in gear so we could enjoy a coffee session together. He also ran across the yard to help me if I was stuck with the computer on writing my column or a story. He was a real wiz at the computer.

The Smithfield Fire Department has been maneuvering the big, bright fire truck out of the station house and throughout the streets of Smithfield, the outskirts, and on Rayland Ridge several days before Christmas. I always watched for the brightly lit truck coming down the road with sirens blazing and popcorn balls being thrown out to the awaiting children. I somehow missed it; this is my first year since 1962. It was just like Santa got stuck in a snowdrift (which didn’t happen) and did not make it. Thank you, firemen. It isn’t comfortable riding on top of the engine with the wind and sometimes snow blowing while tossing out the confections.

Everyone appreciates your effort, though.

I really hope the little dog that was found surrounded by water in a cornfield and taken to the Harrison County Dog Pound was reunited with its owner. And thanks to the dog pound workers for accepting and cleaning up the furry friend.

Fort Friendship men planned and assisted in building and having a wall of soldiers from the first war to the present engraved on the surrounding brick wall and held a Wreaths Around the World project on Dec. 18. At the meeting, an election was held where Barbara Baird was named commander. She is a former nurse with the U.S. Army. Barry Bardone was named adjutant, Tony Phillippi was chosen as treasurer, Lamont McCoy was elected chaplain, and Charles Greene and Tom McCain are the trustees. Paul Greene is the picnic chairman.

Members of our Smithfield Christian Church are very happy that the church attendance is moving ahead. The congregation welcomed Reverend Craig Smith to the pulpit. Debbie, his wife, is also active in events in the church. He is a 1972 graduate of Smithfield High School, so we know him from years back.

I read that Coy Sudvary of the Wellsville Junior and Senior High School announced the Dec. 22 basketball game on the radio. Maybe someday, he will be seen or heard on national television.

I’ll say goodbye to the old year and hello to the hopes for a truly wonderful year for everyone.

Freeport’s Clark Memorial Library movin’ and groovin’ with fitness classes

JVS programs getting updates BLOOMINGDALE—Two programs at the Jefferson County Joint Vocational School are getting some relative updates in the coming year following discussions at the year-end board meeting.

The JVS school board held its final session on Dec. 21, where officials noted that the health technologies program will procure a futuristic educational tool while the cosmetology lab will undergo a makeover.

Leaders discussed a grant notice from Pete Chalfant of the Mary Jane Brooks Charitable Trust, a Steubenville-based foundation, which is providing more than $70,000 to the health tech program for a new Anatomage table.

The life-sized table features dual touchscreens that allow students to interact with digital cadavers and explore anatomy and physiology through virtual representations of various body systems. JVS superintendent Dr. Todd Phillipson said instructor Tammy Sismondo had sought the equipment for a long time, and the foundation has made it possible.

“Mr. Chalfant called me during the summer after he saw a report on the program,” he added. “The foundation likes to work with things that are healthcare-related and wanted to do something for the health tech program.

Koch Caramel in Freeport had a booming business in 2021, shipping their traditional homemade candies nationally but also selling locally to area residents who have come to revere the shop’s offerings as part of a seasonal tradition.

A passerby glancing at Bob and Donna Jean Koch’s home, which doubles as their candymaking shop, might have difficulty believing that over 5,000 pounds of caramels were manufactured there in November and December alone. For perspective, that is over two tons of candies in only two months. Over the entirety of 2021, Koch Caramels produced about 6,000 pounds of candies — double what they made the year before.

One reason the Koch Caramel confections are so popular is that their recipe — which dates back at least to 1904 — is so simple. Their signature vanilla caramel is made with just a few basic natural ingredients: sugar, milk, and vanilla — none of which contain any synthetic additives. The recipe was originally used by a candy store that Bob Koch’s father’s family owned in Canton in the early 20th century, and the motto of the store was “you can be sure it’s pure.” There, customers could purchase not only candy but candy-making cookbooks and equipment. But after World War I, it became

harder for the family to acquire the ingredients they needed for candy-making, and the store closed. Still, Koch’s father kept making candy using their signature recipe. Later, after his father had passed away, Bob Koch embarked on the candy-making himself, following the recipes in the old store cookbooks from the early 1900s.

Initially, the Kochs made candy simply to give away to friends, but in the early ‘80s, Donna Jean Koch came up with an idea to sell some of their caramels at an area trade show. Not only did they sell out all the caramels they brought, but people started taking orders for Christmas time as well.

The first order of caramels was packed into brown paper lunch bags and loaded onto a sled with their children accompanying them in snowsuits. “That was our Christmas money that year,” Bob Koch said.

At first, making candy to sell over the holidays was enough, but the business kept growing and expanding over the years. Eventually, Bob Koch said, making and cutting the candy by hand became too difficult and timeconsuming, given the volume of caramels they were producing. Luckily, Bob Koch’s friend and mentor, Harold Vitte, loaned them the funds they needed to purchase a cutting machine, and after this debt was paid off, the See CARAMELS Pg.- 9

MWCD receives grant through BUILDS program

NEW PHILADELPHIA—The Muskingum Watershed Conservancy District (MWCD) has been awarded a $1.55 million grant from the Ohio Department of Development, Ohio BUILDS water infrastructure grant program.

Governor DeWine created the Ohio BUILDS water infrastructure grant program to reduce or eliminate the local financial burden associated with critical infrastructure needs, such as the construction of new water systems, replacing aging water lines, and the installation of new water mains. Grants are also funding projects to prevent sewer system backups and replace failing household sewage treatment systems with new sewers.

The grant awarded to MWCD will fund the building of a new 8,000-gallon-perday wastewater treatment plant, two new pump stations with force mains, and gravity collection to tie in the existing marina building,

In other good news, supervisor-principal Dan Hartman discussed plans to remodel the cosmetology lab with painting, updated stations, and flooring. Superintendent Dr. Todd Phillipson said the work could get underway once school’s out with students able to utilize the updated space during the fall term.

“It’s getting a makeover, and we hope to do it this summer.

Kochs were able to take out a loan to build an addition on their house to be used as a candymaking room.

“Vitte made this life possible,” Koch shared.

“We could go on making the candy and our business growing.”

While Bob Koch oversees the candy-making, Donna Jean Koch takes care of computerrelated work and manages orders and mailing.

The Kochs also hire young women from the local Amish community to work in their shop, making and wrapping the candy. Bob Koch had the highest praise for the work ethic and abilities of the women, whom he said they regard as family. “We are so blessed to have them,” he said.

The young woman who has worked with them the longest — about 13 years — oversees hiring other workers from the Amish community, sets their schedules, and keeps track of inventory.

“She’s my right arm,” Koch said. “And her sister, who’s been with us for eight years, she’s my left arm.”

Koch also spoke of the importance of living in a supportive community. As Bob Koch also serves as Freeport’s fire chief and is a chairman at his church, it makes a difference knowing he has reliable people who can run things for him during November and December when candymaking becomes a top priority.

Koch Caramel was just recently registered as an LLC in 2020 and has kept on growing. Koch hopes that this trend will continue. “We’re looking to keep this going, have a goal — we’re hoping to enlarge, as we’ve outgrown our candy-making room.” Ultimately, they hope to produce around 15,000 pounds of candy per year. But to do this, they will need more space, especially for storing bulk ingredients. But it doesn’t look as though Koch’s Caramel will be slowing down any time soon. Their traditional homemade sweets continue to be in high demand. Older customers, in particular, have mentioned to the Kochs that their caramels are just “like my grandma used to make.” Some of the Koch Caramel candies are even sold in high-end groceries, where the natural additivefree recipes are especially appreciated. And Bob Koch doesn’t expect to slow down, either. “This is what I love doing. I can keep on doing this into my 80s.”

As delta began to surge, case numbers went up.

In September 2021, Harrison County had the highest number of cases in any given month since the pandemic’s start, with more than 400 cases reported. The previous high had been in December 2020.

Harrison County passed a threshold of 1,500 cumulative cases by mid-September, about 10% of the population. However, this number accounts only for reported cases, not for those detected with home tests but didn’t report their positives — or those infected and never tested at all.

This was when the surge began to affect area hospitals, as delta ran rampant through a predominantly unvaccinated community.

In mid-October, the Health Department began to offer the first booster shots to people 65 and older or those who had qualifying medical conditions. Access to the booster was expanded to nearly everyone by the middle of November. Around the same time, the first pediatric doses were given in Harrison County.

As 2021 closes, about 2,500 folks have been boosted, and about 44% of the age-eligible population has both doses.

It is important to keep in mind that a vaccinated person is generally less likely to get infected; they are also less likely to infect others. “A vaccinated person would require a heavier viral load to actually get sick, and they will shed the virus less,” Rhome explained. “This virus is not airborne in the sense that it still needs a microdroplet of moisture to travel on. It does not float or move across the air on its own.”

A vaccinated person is less likely to cough or sneeze and, therefore, less likely to produce droplets for the virus to travel on.

As of Dec. 29, 2021, there is still no confirmed case of omicron in Harrison County, but as Rhome explained, people can operate on the assumption that it’s probably here.

The guidelines remain the same for the general population: get vaccinated and get the booster.

And while it can’t hurt to move to a mask made of material specifically designed to block moisture droplets, it’s still better to wear a mask than not to wear a mask. “Wear the mask that
