Nine Myths Regarding Member Discipline

One unpleasant but necessary aspect of board service is the imposing of discipline in response to unneighborly behavior by members. Here are nine myths regarding HOA discipline.

Myth #1: HOAs can impose any fine amount that seems appropriate to punish the violating homeowner. Truth: Civil Code Section 5850(c) limits monetary penalties (aka “fines”) to those as stated in the HOA’s written list of penalties in effect at the time of the violation. No list of fines? Then no fine can be imposed.

Myth #2: A committee can impose discipline. Truth: Under Civil Code 5855 discipline is imposed by the board. Some HOAs have enforcement agents or disciplinary committees sending out notices of fines, but those may be subject to challenge as violating Section 5855.

Myth #3: A fine can be imposed without a hearing so long as there is a “right to appeal” the notice. Truth: The disciplinary process under Civil Code 5855 is clear — before ANY discipline is considered or imposed, the homeowner must be given written notice of the hearing at least ten calendar days before that meeting.Section 5855 Subpart (d) says: “A disciplinary action … shall not be effective … unless the board fulfills the requirements of this section.”

Myth #4: Homeowners have the right to an attorney or representative present at their discipline hearing. Truth: No, the law does not give this right. HOA hearings are not court proceedings but are meetings of neighbors to address unneighborly behavior. Nothing in the law requireshearings to be conducted like criminal proceedings, with counsel, 5th amendment protections, and a jury of peers. I occasionally see governing documents allowing homeowners to bring counsel to hearings, but, generally, theseshould be meetings between homeowners.

Myth #5: Homeowners have the right to be present, so if they don’t attend the hearing it cannot proceed. Truth: The statute requires the homeowner to be given notice of the date, time, and place of the hearing (and the governing document provision violated), but it does not say that the board cannot proceed without the homeowner present. Boards should use their fair and reasonable judgment in determining whether to reschedule hearings, but rescheduling is not legally required.

Myth #6: HOAs can suspend voting rights and board eligibility in response to violations. Truth: HOAs cannot suspend homeowner voting rights, because of the prohibition of Civil Code 5105(g), and unresolved rule violations is not a board eligibility standard allowed by Sections5103(d)(2) and 5105(b),(c)(d).

Myth #7: The HOA cannot control tenant violations. Truth: The HOA has no direct control over tenants as nonmembers, but it can hold landlords responsible for the actions of their tenants or guests.

Myth #8: The HOA should keep imposing fines indefinitely until the problem is resolved. Truth: Fines are intended to deter, but when they don’t work, court action may be necessary. A cautionary tale is recited in the Ritter v. Churchill case from 2008, where the HOA fined the homeowner $200 per day until the balance reached $77,000… and the court ultimately found no violation, costing the HOA hundreds of thousands of dollars in attorney fees.

Myth #9: Boards must punish all violations. Truth: Boards may decide not to pursue minor violations if circumstances warrant and if owners are treated equally. Also, sometimes warnings are sufficient.

A Positive Outlook on Short-Term Rentals

Short Term rentals and the city of Santa Barbara have a love-hate relationship. Lately, the city has been looking at “cracking down” on those that are operating “illegally”. There are many sides to this story, and I can understand and am aware of the arguments by those on both sides. Those that want them to stay and those that don’t want them or only in particular areas. I think a clear, common sense city ordinance with some easy-to-follow rules, locations, perhaps a particular number of them available to be permitted, and a straightforward way for those to apply for them, makes a lot of sense. We are missing this now with a lot of confusion around them. This article explores some of the pros of short-term rentals, those properties rented for under 30 days.

To state the obvious first but sometimes overlooked point in this conversation, Santa Barbara is a tourist town and a highly sought-after vacation destination known for its beautiful beaches, scenic coastline, and mild climate. In recent years, shortterm Airbnb rentals have become increasingly popular around the world and in Santa Barbara. Just like many cities throughout the world, there is currently a mix of hotels, motels, bed, and breakfasts, and short-term rentals that co-exist to allow visitors to choose how they would like to stay while visiting this amazing area.

Short-term or “Airbnb” rentals, as they are referred to sometimes, offer visitors more affordable and often larger accommodation options compared to traditional hotels. Santa Barbara is known for its luxury hotels and resorts, which can be quite expensive, especially during peak tourist season, and are incredible experiences. On the other hand, Airbnb rentals provide a range of options to fit different budgets. Visitors can find everything from cozy apartments to spacious beachfront homes, depending on their needs and preferences. Also, Airbnb rentals often offer more amenities than traditional hotels, such as full kitchens, laundry facilities, and outdoor spaces, especially when traveling with larger groups, saving visitors money on dining and entertainment. A hotel simply just does not provide this option.

Short-term rentals can help support the local economy in Santa Barbara. Many Airbnb hosts are local residents who rely on

income from short-term rentals to supplement their income or by choosing to stay in an Airbnb rental, visitors are directly supporting these local hosts and contributing to the local economy. Short-term rental owners “should be” paying the 12% TOT (Transient Occupancy Tax) to the city. This would be gladly paid for with clear ordinances by those wanting to run a shortterm rental. Now, many of the “illegal” short-term rentals do not pay because they do not want to be known by the city. This additional income with clear guidelines would greatly help our city address bigger issues of homelessness, our downtown corridor, roads, and drainage, or others facing the city. Plus, visitors who stay in Airbnb rentals are more likely to spend money at local restaurants, shops, and attractions, further boosting the local economy.

Lastly, short-term rentals in the city of Santa Barbara offer our very own locals, in a time of crisis or evacuations, which has been more prevalent in the past number of years, a place go. As a REALTOR® with clients in the area, in evacuated areas, I helped find these local’s homes to stay in with hotels booked solid by putting them in shortterm rentals many times over the past few years. I was also proud to assist with housing for 12 out-of-the-area police officers through a client who has a house they rent short-term. These 12 police officers were up to assist our local officers during one of the heavy rain events a couple of months ago, and talking to the police officer that reached out to me, said they would have nowhere else to stay and would be sleeping on the floor at the station. Instead, each stayed in a bed for 3 days, and the owner did not charge them anything.

Short-term Airbnb rentals offer numerous benefits to locals, visitors, and to the City of Santa Barbara, including affordability, size, authenticity, local support, flexibility, convenience, and community connection. Whether traveling to Santa Barbara for a weekend getaway or an extended stay, Airbnb rentals provide a unique and personalized way to experience all the city has to offer. I hope the city can not just eliminate and “crackdown” on short-term rentals in the city. But instead, adopt a common sense, smart city ordinance to still make these an option in the city of Santa Barbara.

What’s the best way to mow my lawn?

You’ll get the best results with your lawn by tuning up your mower at the beginning of spring.

Lawn mowing is one of those tasks you probably do on autopilot. Get out the mower, make the circuit of the yard, maybe trim the edges, and call it a day, right? But a few basic techniques can make lawn mowing a vital part of maintenance that not only keeps your grass short but in the best condition as well.

Here are some tips to level up your lawn mowing game this spring:

Tune Up Your Mower

You’ll get the best results by tuning up your mower at the beginning of spring. You can pay a pro to do this or handle it yourself, as it’s a reasonably simple task. Review your owner’s manual for specific things that must be done, but several basics apply to most mowers.

First, disconnect the spark plug to avoid accidentally starting your mower. Then, give the exterior a good clean with paper towels or a rag, along with grease-cutting soap in water.

Replace the old air filter. New filters only cost around $10 at home improvement stores, and your owner’s manual should tell you the correct size.

Remove any remaining gasoline from the mower, then unscrew the motor oil cap. Tilt the mower on its side so you can drain the oil into a bucket or pan. Then add new oil, checking the dipstick occasionally until the mower is full.

Have the blade professionally sharpened, or replace it if it’s too old. A dull blade rips the grass, creating an uneven look, damaging your lawn, and leaving it exposed to diseases and parasites. Finally, put in a new spark plug, and you’re ready to mow!

Mowing Technique Tips

• Change directions every time: Alternate your mowing pattern each time you cut the grass. This will prevent ruts from forming, and it will encourage the grass to grow tall and straight.

• Mow dry grass: Cutting wet grass can clog your mower’s intake and leave deep tire tracks in your yard.

• Overlap your pattern: It’s tempting to get the most out of every pass and minimize the amount of overlap, but it’s not the best technique. Overlapping every pass by three inches or more will result in a smooth and even lawn.

• Don’t set your blade height too low: As grass grows taller, its roots go deeper, resulting in a healthier lawn that requires less watering. The grass will also fill in nicely, providing a great safety net against weeds. Cutting the grass too short causes stress on your lawn. Over time, repeatedly cutting it short will result in turf that has bare spots and is highly susceptible to cold, extreme heat, pests, and diseases.

• Follow the one-third rule: To keep your grass healthy, never cut the grass by more than a third of its height at any one time. How to maximize the power of mix and match in furniture pairings

Gone are the days of placing matching big-box furniture in a room and calling it good. And while it’s easy to fall into the trap of following a specific trend, often I find that the spaces with the most impact are the ones that effortlessly combine elements from multiple periods, styles and places. The trick is to ensure that everything ties together. The whole point of mixing styles is to create a space that truly defines you, and can’t be re-created somewhere else. It’s all about finding the right balance of color, texture, style and proportion to create a unified and visually appealing look.

Let’s explore some tips and tricks to help you mix and match furniture like a pro, no matter for what style you’re aiming.

For tight spaces

Finding the right pairings for a tight space can be challenging, but with some thoughtful planning, you can make the most of it. The first step is to measure your room and determine the size and shape of your furniture pieces. When selecting furniture, it might be a good idea to choose items that can serve multiple purposes, like an ottoman that can serve as extra seating in a pinch. This will help you save space and maximize functionality.

Two apartment sofas facing each other is a beautiful way to fill a space and maximize seating, especially in a room without a television. It’s the setup I have in my own living room and is fantastic for entertaining. But what I’d consider the most tried-and-true way to provide maximum flexibility of seating for guests (and lounging when no one else is around) is to use a sectional-style sofa and compact, small-framed chairs. The sectional gives space to spread out if you need it, and the chairs add some pleasing visual contrast to the design without adding too much bulk to the space.

But the best thing about a small room is that by adding just a few finishing touches, you can make your space feel ultra-stylish in a breeze. Treat yourself to a sculptural side table, a glam new accessory or simply a few faux flowers, and the entire space will feel big-budget.

Two-tone furniture

Two-tone furniture is another fun way to create pairings in your custom pieces. For designer-forward kid-friendly spaces, you can apply performance fabric to the seat of your piece and then any fabric you like on the body where it won’t get as much wear (in theory). Even if practicality isn’t your primary concern, going two-tone injects a little texture and personality into the piece.

The charcoal fabric on these two-tone chairs adds interest to the design and is a great partner to the polka dot.

The value of repetition

Repetition works wonders in design. When curating your look with mixed and matched furniture, try to work in a common element or two to tie the pieces and overall space together. Using a defined color palette, having a couple wood pieces from the same time period, or carrying a motif throughout help to add a touch of polish. To create cohesion in your design, repeat a chosen color, finish, material, shape or pattern two to three times. This also helps to make the space feel curated.

A balancing act

When it comes to mixing and matching furniture pieces to create your style, it might feel like a little bit of a balancing act. Too few details and it feels like something’s missing; too much of the same is uninteresting. Cultivating balance is essential when mixing furniture styles. Do the colors and scale feel evenly dispersed throughout the space? Does anything need to be moved? Don’t be afraid to take a step away and come back with fresh eyes.

Mixing and matching your furniture is the perfect way to achieve the sought-after collected look. Remember, good design is more of an evolution than a destination, and collected spaces take time to build. I hope you enjoy the journey as much as I do!

Here are some top tips to spruce up your shortterm rental without breaking the bank.

1. Keep personal belongings at a minimum. A short-term rental should feel fresh and welcoming.

2. Consider hiring a professional staging Company. Staging companies specialize in the rental of furniture and setting a space. Professionally setting up your space for wide appeal will go a long way.

3. have a welCome booK with a personal note. Not only is it a nice touch, but it helps reinforce the personal aspect and will help serve as a reminder to people to respect your personal home.

4. thinK thoughtfully about presentation. From furniture to artwork and overall decor, these details matter to many potential renters. Often people make an instant impression about a property based on these qualities alone.

5. don’t deCeive or ConCeal. There will be no greater hit to your reviews than false advertising. Renters will expect and demand the property they viewed in your photographs.

6. Consider hiring a property manager. While being your own manager may save money, ask yourself whether it will be worth your time. Many who choose to selfmanage their properties complain about the mountain of emails and need to constantly be on call for inquiries.

Having a property that shows at its very best will lead to better photos, and ultimately more bookings.

8. maKe sure your property is spiC-and-span Clean. These days, renters not only expect a property to be clean, they demand it. Many will also request that the property be cleaned with no one present a minimum of 48 hours prior to their stay.

9. ensure your short-term rental is well stoCKed. From appliances such as coffee makers to can and bottle openers, pots, pans, dishes, towels, linens and a closet full of games, the expectation for renters is a property that is fully and adequately stocked.

10. asK for and always respond to reviews. While a bad review can hurt for months and even years to come, great reviews can help put your short-term rental near the top of the list.

‘Barkitecture’ interior design trend puts pets first

Four out of five U.S. pet owners planning to buy a home consider their pets’ needs just as important as their own, according to a December 2022 study by Realtor.com and HarrisX. With so many pet owners factoring in their pets’ needs when choosing a home or apartment to live in, a new and fascinating interior design trend has sprouted: barkitecture.

“Barkitecture is an evolving term that encompasses innovative ideas to create comfortable and stylish spaces for humans and their four-legged friends,” Caroline Danielson, director of showrooms at Ferguson Bath, Kitchen & Lighting Gallery, told Realtor Magazine. “Originally used to describe the design and construction of dog houses and other structures specifically for dogs, the trend today has grown popular due to its ability to incorporate practical elements of pet ownership into the design of kitchens and bathrooms that both humans and dogs can enjoy.”

The fad reached new heights in 2020 with the airing of “Barkitecture” on The Roku Channel, where contractor Tyler Cameron and interior designer Delia Kenza build custom, designer dog homes for celebrity clientele. According to Danielson, the trend isn’t going anywhere anytime soon.

“Barkitecture is here to stay due to growing demand among pet owners who view their animals as true family members,” he said. “They are willing to invest in ensuring that every part of their home reflects this sentiment.”

That investment, of course, doesn’t require a celebrity-sized budget.

“This trend might mean turning the area where the dog’s bed is usually kept into a more luxury dog bedroom, or incorporating stylish cat-friendly shelves and scratch posts discreetly into the permanent fittings of your home,” Louise Richardson, director of marketing at Pinterest, told Country Living.

In the end, the interior design trend is largely about highlighting a pet’s toys and beds throughout the home, rather than storing them away when guests come to visit. It’s a way to elevate the quality of life for our four-legged friends.
