An overview of Private Label Networks for Live and On-Demand Broadcast of Musical Ensemble Performances for Schools, Colleges, Universities and Performing Arts Organizations.

SBN private label broadcasting networks are individual customized video broadcasting networks that handle both on-demand and live broadcasting of performing arts presentations for schools, school districts, colleges, universities, community and professional arts organizations and music education associations, while solving the conundrum and cost of obtaining synchronization licensing. The networks are fully copyright and COPPA compliant and licensed for the broadcast of music ensemble presentations. Because the networks operate on a revenue sharing basis with the music owners (publishers, songwriters, and composers) and the organization that is supplying content to the networks, there is no requirement to purchase synchronization licensing up-front for on-demand streaming of pre-recorded musical performances. This represents a tremendous cost savings for all schools, school districts, colleges, universities, symphonies, music education associations and performing arts organizations.

There is no charge for setting up or operating a separate custom, private-label SBN Broadcasting Network, nor are there monthly maintenance fees.

A Detailed Review of the SBN Networks

1) Every school, school district, college, university, performing arts organization or music association may operate their own custom SBN for live and on-demand broadcasts. Networks are collections of channels customized with the graphics, logos, and trade dress of the “owner” of the network and the network can be set up with as many channels for as many different events, ensembles, or archival collections of content as you would require. The networks are both COPPA and Copyright Compliant.

2) The network can be used to broadcast multiple live performances simultaneously on multiple channels. In other words, an SBN network can be live streaming multiple different performances from their network, and those broadcasts could be coming from multiple ensembles, live or on-demand, without interference from other broadcasts. This also holds true for archival or prerecorded performances that are viewed on demand.

3) The Networks are subscription driven, and the organization who is operating the Network sets the yearly subscription fee as they see fit, however, the yearly fee must be at least $39.99 per user ($3.33 per month). A user is defined as a “family” with everyone living under one roof, and each user is identified by their email address, which serves at their username. There are also monthly subscriptions and subscriptions that can be delineated in number of days, as in: a two day all access pass, etc.

4) There is a unique code functionality that would allow a network operator to provide free annual passes to donors, patrons, low-income families, students, or to whomever the network operator wanted to give them to. The code is entered at the time of purchase and is good for one year’s access, and the operator would be billed for these codes. However, because the revenue sharing for these free memberships operates the same way as all other subscription revenue, at a minimum, 32.5% of the cost of the free membership will be returned to the network operator. There is a detailed description of the revenue sharing directly after paragraph number 8 in of this letter.

5) The SBN custom networks can handle the live and on-demand transmission of performances of the following performing arts ensembles:

a. A Capella ensembles

b. Band (Concert Band)

c. Cheerleading (if using a major label master recording, live broadcast only. However, SBN has just acquired a recording library with 75,000 covers, and the use of these recordings is licensed for SBN)

d. Choir and Show Choir

e. Color Guard (if using a major label master recording, live broadcast only. However, SBN has just acquired a recording library with 75,000 covers, and the use of these recordings is licensed for SBN)

f. Dance Events (if using a major label master recording, live broadcast only. However, SBN has just acquired a recording library with 75,000 covers, and the use of these recordings is licensed for SBN)

g. Marching Band and all school instrumental ensembles

h. Symphony Orchestra, Chamber Orchestra, all instrumental ensembles

i. Talent shows featuring student performances

j. Winter Guard (if using a major label master recording, live broadcast only. However, SBN has just acquired a recording library with 75,000 covers, and the use of these recordings is licensed for SBN)

k. Percussion ensembles.

6) The Networks are hosted on redundant SBN servers, but videos are delivered directly from Amazon’s cloud services. The custom networks can utilize a subdomain of the host organization so that subscribers do not have to leave the network operators own website, or the organization could assign it any domain name of their choosing and SBN will obtain the domain name on behalf of the network operator.

7) Content uploaded to the network belongs to the uploader/operator of the network. However, the content is only licensed for display on your SBN private label network. Display of the same content on other services, like Youtube for example, would require additional separate synchronization licenses for an on-demand video. Content could be licensed for YouTube separately and be used on your private label network as that would be the choice of the network operator.

8) Copyright clearance for videos happens during the uploading process, which is very fast. All music uploaded will be automatically pre-cleared. Although it is rare, if it is determined that the music does not fall under our agreements with music publishers, the uploaded video will eventually be set to private for viewing by the instructor/channel administrator. There are no copyright clearance issues for live broadcasts.

Revenue Sharing

SBN operates on the principle of revenue sharing. That means that the revenue generated by subscription purchases is divided up between SBN, the music publishers, and the Performing Arts Organization that “operates” the network

SBN receives 35% of all subscriber revenue for each network.

The music publisher receives 32.5% of all subscriber revenue that can be attributed to the watching of on-demand videos.

The Performing Arts Organization would receive 32.5% of all revenue from subscriptions.

Network Configuration and Flexibility

At the risk of being redundant, SBN White Label Networks can be configured to be a collection of channels, (i.e. these descriptions will not really apply to barbershop, but you will get the idea when we say that a school or organization could have one channel for orchestra, one channel for marching band, one channel for choir, one channel for show choir etc., channels for archives or educational material and/or channels for individual events) and there are infinite possibilities for this. The architecture of the platform was designed so that the SBN(s) could be utilized by school districts, schools, colleges, universities, performing arts organizations and even specific performing arts programs within a school or college and the revenue generated can be apportioned and tracked to the individual channels or ensembles participating within the college or university. The reporting capabilities of the networks are transparent and provide tremendous insights into subscriber habits and content popularity.

There is no long-term commitment required for these networks. While we hope that they will be a great solution for every performing arts organization, that might not be the case. Nevertheless, we want people to use this solution because it is smart, saves their educational

institution or performing arts organizations a ton of money while actually making them money. We think it helps with outreach, teaching, programming and that it relieves stress on administrators who are tasked with obtaining licensing, which is also very positive.
