Linda Brown, Whose Landmark Lawsuit Zell Miller Passes Led to School Desegregation, Dead at 76 Former Georgia Governor and U.S. Senator

Linda Brown Smith stands in front of the Sumner School in Topeka, Kan., on May 8, 1964. The refusal of the public school to admit Brown in 1951, then 9 years old, because she is black led to the Brown v. Board of Education of Topeka, Kansas case. In 1954 the U.S. Supreme Court overruled the “separate but equal” clause and mandated that schools nationwide be desegregated. Photo: AP Images By The Root

Linda Brown was a third-grader who was barred from attending an all-white school in her neighborhood. Her father, Oliver, filed a lawsuit that would become the basis of the landmark Brown v. Board of Education Supreme Court case, which led to the desegregation of schools. Brown died in Topeka, Kan., on Sunday. She was 76. Brown’s sister, Cheryl Brown-Henderson, confirmed her death to the

Topeka Capital-Journal. Brown-Henderson said that the family would not be commenting on Brown’s death. In 1951, Oliver Brown attempted to enroll his daughter in the all-white Sumner Elementary School near their home in Topeka. He was denied and told to send his daughter to the all-black Monroe School, which was about 2 miles from the family’s home. At the time, Topeka had 18 schools for white

children and just four for black children. Oliver Brown took that denial and joined other plaintiffs involved in an NAACP legal challenge of school segregation in Kansas. Eventually that case, and cases from four other states and the District of Columbia, were consolidated into the case now known as Brown v. Board of Education. In 1954 the U.S. Supreme Court ruled that “separate but equal” schools violated the equal protection clause of the 14th Amendment, thus legally ending school segregation. In 1979 Linda Brown— who was now a mother with her own children in Topeka schools—became a plaintiff in a resurrected version of the Brown v. Board case that sued Topeka schools for not following through with desegregation. According to the Capital-Journal, the federal judge in that case sided with the school district in 1987, but an appeals court reversed his decision in 1989, and the Supreme Court chose not to review

There were a total of 20 contestants competing in the areas of barbering, cosmetology and nail care. Five schools participated, three of the schools were post-secondary, and needless to say the Bluejacket contestants were very concerned because they were competing against adults and only one other high school contestant from Beaufort-Jasper Academy for Career Excellence, just a short trip across the bridge into South Carolina. On Monday, Kansas state officials spoke of Brown and the lasting impact she made on the country. Kansas Gov. Jeff Colyer said: “Sixty-four years ago a young girl from Topeka brought a case that ended segregation in public schools in America. Linda Brown’s life reminds us that sometimes the most unlikely people can have an incredible impact, and that by serving our community, we can truly change the world.” Kansas Deputy Education Commissioner Dale Dennis told the Capital-Journal: “Her legacy is not only here but nationwide. The effect she had on our society would be unbelievable and insurmountable.” Brown was born in Topeka on Feb. 20, 1942. The cause of her death has not been disclosed publicly at this time.

Former Georgia Gov. and U.S. Sen. Zell Miller died Friday morning after battling Parkinson's disease. Georgia House Speaker David Ralston, R-Blue Ridge announced the death of Miller, 86, to House members at the start of Friday's session, calling Miller one of the state's greatest governors of the 20th century. Ralston cited Miller's contribution as father of Georgia's HOPE Scholarship program, which he steered through the General Assembly in 1992. "Throughout his career, Zell Miller was a strong advocate for the value of a public education," added Sen. David Perdue, R-Ga. "Because of his work on the HOPE Scholarship program, over 1.8 million Georgians have been able to attend a public college or university in Georgia who may not have been able to otherwise. His legacy will live on through them." Miller hailed from Young Harris, a small city in the North Georgia mountains. A Democrat, he served four terms as lieutenant governor before being elected governor in 1990. Former Governor Roy Barnes appointed Miller to the U.S. Senate in 2000 following the sudden death of Sen. Paul Coverdell. Miller decided not to run for re-election in 2004 after a public falling out with the Democratic Party, which he blasted with his book "A National Party No More." Miller served as a keynote speaker at both parties' national conventions, the Democratic Convention in 1992 and the Republican Convention in 2004. The Georgia House and Senate passed resolutions Friday afternoon honoring Miller's life and service to the state. Jimmy Carter, Bill Clinton and George W. Bush drew laughter, applause and an occasional “amen” at Peachtree Road United Methodist Church as they recalled the remarkable and sometimes paradoxical public life of a man who rose from Appalachia to become a Georgia icon.

Attorney and Alderman Robbie Robinson Killer Set to be Executed The Alabama Supreme Court has set an execution date for Walter Lee Moody, the man convicted in the 1989 pipe bombing that killed a federal appeals judge in Mountain Brook, and the other from an inmate who asked the court to expedite his own death. The court set April 19 for Walter Lee Moody’s execution for the death of U.S. 11th Circuit Court of Appeals Judge Robert S. Vance. Prosecutors claimed Moody killed out of frustration over being unable to overturn a 1972 conviction

for possessing a pipe bomb. But Moody contends he was framed by federal agents and was denied counsel at his death penalty trial. He filed papers minutes before sentencing that claim a bombing expert retained to help in his defense is actually an FBI informant. Prosecutors contended that in addition to killing Vance, who is white, and black civil rights lawyer Robert Robinson of Savannah, Ga., Moody threatened to kill 17 judges in letters declaring war on the judiSee Robinson - Page 4A

She recalled a time during her teenage years when she dismissed her mother’s insistence to follow the guidance offered by the Bible. She and her siblings would be playing, and “Mama said children the Bible says,” she told the crowd. Now she is one encouraging her younger relatives to read the Bible and to serve God. She taught school for 36 years in Georgia and Jacksonville. “I never had a student that I couldn’t teach. All kids can learn,” she often said. At Simpson Memorial United Methodist Church in Jacksonville, Mrs. Robison sang in the choir, taught Sunday School and was Conference President of the Woman Society of Christian Service (now the United Methodist Women). For pleasure, Mrs. Robinson collected about 200 dolls for more than 50 years. Surrounded by friends and family for her birthday, Mrs. Robinson said she is grateful for the people in her life and that she wants for nothing. While she never had children of her own, she said, “I feel like the old woman who lives in the shoe. I have so many young’uns I don’t know what to do.”

Georgia Lottery Issues Statement on the Death of Sen. Zell Miller

We are deeply saddened to learn of the passing of former Georgia Governor and U.S. Senator Zell Miller. Our thoughts and prayers are with the Miller family during this difficult time. Gov. Miller’s vision to establish a lottery in Georgia with profits earmarked for specific educational programs has made an indelible mark on our state. “On behalf of the Georgia Lottery Corporation board, employees, and most

importantly, Georgia’s students, we are grateful for Governor Miller’s foresight and leadership. Thanks to him more than 3 million students have benefitted from HOPE and Pre-K,” stated Georgia Lottery President and CEO Gretchen Corbin. Since the Georgia Lottery’s inception in 1993, $19.3 billion has been raised for education in Georgia, including Georgia’s HOPE Scholarship Program and Georgia’s

Pre-K Program. More than 1.8 million students have benefited from lottery-funded HOPE scholarships and grants, and more than 1.6 million 4-year-olds have attended lottery-funded Pre-K. The legacy of Gov. Miller will live on in the millions of students and their families who have been positively impacted by Georgia Lottery-funded HOPE and Pre-K.
