reen is the New Black: Delving into the Many Benefits of Green Building

Green building is smart building for many reasons. But what does that really mean? It means energy-efficiency, environmental responsibility, sustainability, and sound, economic growth for many industries. When green initiatives are employed, it also means significant cost-savings. Having a good understanding of green principles means keeping your finger on the pulse of what’s hot, and what’s here to stay, in the real estate market. According to the National Association of Realtors® (NAR), several factors are leading the real estate industry, and the nation, to adopt green practices; and it’s paramount for today’s Realtor® to be mindful of these factors. Homeowners are now demanding real efficiency in their homes. Educated homeowners know that green building meets the highest quality standards for construction. Environmentally sound home insulation, energy-efficient appliances, solar water heaters, energy-efficient windows and doors – the list goes on and on, but it all boils down to significant cost-savings in monthly utility bills and maintaining home value over time. These cost-saving measures, along with an increased commitment to sustainability, are the driving factors behind the integration of new Green technologies in our homes and businesses. The astute Realtor® will recognize the need to fully educate themselves on everything green. NAR now devotes an entire section of the national web site to green, and created a green designation and benefits program tailored for real estate agents. NAR’s Green Designation provides advanced training in green building and sustainable business practices so that Realtors® can understand and market properties with green features. In the green designation course, you can learn green real estate concepts, principles, practices and benefits of being green. NAR’s Green Designation is the only NAR conferred real estate designation designed for agents looking to learn about issues of energy efficiency and sustainability in the various facets of real estate. As consumer demand for knowledge on these issues increases, so will your awareness of green issues. For more information, visit www.greenresourcecouncil.org/. It’s important to keep in mind that NAR’s Green Designation and green building in general is not part of a fad. “While some may have questioned early on whether green building was a fad, that answer is now clearly NO,” said Lee-Hayes Byron, Sarasota County Sustainability Manager. “Some developments, including Lakewood Ranch, require green building certification by all their builders. Homeowners are requesting it of their architects and public entities like Sarasota County are requiring it in their projects. With over 15 years of market impact, green building has proven benefits and is here to stay.” There are a lot of misconceptions today about the time and money it takes to implement green home features and sustainable lifestyle practices. One of the main misconceptions surrounding green building is that going Green will cost more than it’s worth.

But this simply isn’t true. Not only are we saving our resources for the next generation, but saving actual dollars as well. The USGBC informs us that green homes can be built for the same cost as, and in some cases even less than, conventional homes. Sometimes there are upfront costs which on average are 2.4% and can be quickly recouped with the homeowners saving money for the rest of the home’s lifespan. Furthermore, green homes have a higher resale value and are on the market for less time than comparable conventional homes. The Earth Advantage Study in 2011 found that, on average, greencertified new homes sold for 8% more than non-certified green homes. Resales of existing green homes sold for an average of 30% more than conventional homes (source: http://www. usgbc.org/articles/benefits-green-homebuilding). “While green building certifications are most common for newer homes and buildings, the benefits can be applicable in buildings of any age,” added Lee-Hayes Byron. “Considerations of energy and water efficiency, indoor environmental quality, site and landscape sustainability and more can be included in plans for small or large scale retrofits, with benefits to both the current and future owners. Sarasota County also encourages considering design adjustments for accessibility and aging in place.” There are a variety of cost-effective ways to green your home and lifestyle that can actually save you money. “Green improvements do not need to be expensive nor do they need to all be done at once. Sarasota County’s Energy Upgrade program encourages homeowners to plan for their energy and water efficiency upgrades over time, starting with the no and low cost strategies like temperature changes and lighting retrofits and implementing the more expensive strategies like insulation and air conditioning units over time. What is great about these home investments is that they start paying for themselves right away in utility bill savings,” commented Hayes. When it’s time to sell, these energy saving improvements can significantly increase the home’s value. From solar technologies to water efficient landscaping, these green features provide the added value of sustainability in the MLS property listing, ensuring potential buyers can find information on features that are important to them. Sarasota County has made a commitment to green building in its new facilities given the operational savings to taxpayer

dollars and reductions in natural resource use that result. Since making the commitment in 2005, Sarasota County has received LEED Certification on 10 facilities, including the most recent LEED Silver Certifications for Gulf Gate Library and Fire Station Number 16. The County has prioritized energy conservation measures in particular, with a goal to achieve significant operational savings over the life of the buildings. Not only is Sarasota County committed to green building for its own facilities, but it has also established a fast track permitting incentive program for new construction of green buildings and developments in the private sector. The goal is to encourage builders and developers to implement green building strategies in the design phases to ensure savings for the future owners of those buildings. Likewise, Manatee County understands the values and needs for creating a sustainable community through proper energy efficient practices and innovative conservation methodologies. “Manatee County’s mission statement addresses our commitment to being an efficient government and always being mindful of our natural environment,” said Diana Linville, Manatee County Energy Manager. “Property Management’s sustainability goals include educating employees and citizens to take responsibility and alter behaviors that will help protect our beautiful coastal and agricultural community.” Through the implementations of cleaner technologies, efficient

land management practices, improved water conservation techniques, and utilizing economically and energy efficient building services and materials, Manatee County is cultivating an ambitious and sustainable organization and implementing a greener footprint. Manatee County has also adopted the LEED Silver Standards as the official minimum criteria for all new buildings and renovations. These specifications include: Sustainable Site Features, Materials and Resources (recycled content and regional sources), Water and Energy Efficiency, and Indoor Environment day lighting, views, and Indoor Air Quality. The County is an EPA Energy Star Partner. Through the partnership, the County measures and tracks the energy performance of facilities by using the Energy Star Portfolio Manager tool. In accordance with the Energy Star Energy Management Guidelines, the County has developed and implemented policies to achieve energy savings and educated employees on the importance of energy efficiency. It’s safe to say that green initiatives are here to stay. They aren’t simply a vogue trend: they are the future of real estate. eep it Legal - Real Estate Referral Rules Update

The ever changing regulatory climate continues to evolve concurrently with the changing and demanding real estate market which places a greater emphasis on operations and compliance for Real Estate Agents, Title Insurance Agents and Mortgage Brokers and related businesses. The Federal Regulations: The Dodd-Frank Wall Street Reform Act established the Consumer Financial Protection Bureau (CFPB). The CFPB is charged with rule making and enforcement of Real Estate Settlement Procedures Act (RESPA) violations. The CFPB with its enforcement powers has begun to target real estate agencies, companies, settlement providers and individual agents with enforcement actions. Real Estate Agents need to be particularly aware of RESPA section 8(a) and (b) which basically prohibits a person or entity from accepting a fee, kickback, thing of value for the referral of settlement business. Any person who gives or accepts any portion, split, or percentage of a charge for real estate settlement services, other than for services actually performed, is in violation of Section 8(b) of RESPA. Real Estate Agents need to be extremely wary of payments for the referral of business. Exceptions to RESPA Violations: Under RESPA Section 8(c), there is also an affiliated business arrangement (AFBA) exemption. This section requires a specific disclosure to the consumer which must state the arrangement existence, and it must be clear to the consumer that he or she is not required to use that company. QUESTION: A real estate broker and a settlement company agree to jointly place a full-page advertisement in a local newspaper. Each company gets exactly one-half of the page to advertise its services. Each company pays one-half of the cost of the advertisement. Is this a violation of Section 8 of RESPA? ANSWER: No, so long as the advertising costs paid by each party are reasonably related to the value of the goods or services received in return, no violation exists. If one party is paying less than a pro rata share for the brochure or advertisement, there is a RESPA violation. Real Estate Agents may want to review and have an independent audit of any affiliated business arrangement agreements to ensure compliance. Title 12, Appendix B, to Regulation X provides examples and commentary of factual situations that would and would not violate RESPA and can be found at https://goo.gl/Eiy4wZ

CFPB Enforcement Examples: In March of 2014, the CFPB brought legal action against RealtySouth, an Alabama Real Estate Agency, and its affiliate, TitleSouth, LLC. The CFPB brought forth violations of RESPA Section 8(a) and 8(c)(4). Specifically, the CFPB alleged that RealtySouth strongly encouraged, and in some cases required, its agents to use TitleSouth without proper disclosure of the affiliate arrangement. Ultimately, a settlement was reached, and RealtySouth agreed to pay $500,000 without admitting wrongdoing. A copy of the consent can be found at: http://goo.gl/sTVe6n State Regulations: The Florida Department of Financial Services, Division of Agent & Agency Services, provided notice of Final Adoption of Rule Chapter 69B-186.010, of the Florida Administrative Code, relating to Unlawful Inducements Related to Title Insurance Transactions effective February 9, 2016. The rule provides lists which are intended to be examples of prohibited conduct such as: • Facilitating any discount, reduction, credit, or paying any fee or portion of the cost of an inspection, inspection report, appraisal, or survey, including wind inspection, to a purchaser or prospective purchaser of title insurance. • Providing or offering stocks, bonds, securities, property, or any dividend or profit accruing or to accrue thereon to a referrer of settlement service business. However, the use of lawful affiliated business arrangements that are permitted under the Federal Real Estate Settlement Procedure Act would not violate this subparagraph and would be allowable under subsection (2) of this rule. • Providing or paying for the printing of bulletins, flyers, post cards, labels, etc. that promote the business of a referrer of settlement service business. • Furnishing or paying for the furnishing of office equipment (fax machines, telephones, copy machines, etc.) to a referrer of settlement service business. • Providing or paying for cellular telephone contracts for a referrer of settlement service business. • Providing simulated panoramic home and property tours to real estate brokers or real estate sales associates that they utilize to promote their listings. • Sponsoring and hosting, or paying for the sponsoring and hosting, of open houses for real estate brokers or real estate sales associates to promote their listings. • Paying advertising costs to advertise and promote the listings of real estate brokers or real estate sales associates via publications, signs, emails, websites, web pages, banners, or other forms of media. https://goo.gl/1rJeSS

Elizabeth Reynolds Elizabeth Reynolds, Marketing Director at Innovative Agent Services, has been one of a handful of founding members of YPN and a driving force behind some of our most successful events. Last year she was co-chair of YPN’s biggest event to date, the Realtor® Bowling Day. Her leadership in this event helped us raise over $10,000 dollars for local charities. Elizabeth keeps pushing to become a better leader year after year and this year is no exception. She was recently accepted into the RASM 2016 Leadership Academy with only 13 other inductees. The program is designed to teach leaders to make a difference, maximize their leadership skills and prepare them for future leadership roles for RASM and Florida Realtors®. reen is a Commercial Real Estate Practitioner’s Favorite Color

The theme for this month’s Realtor® magazine is green. This is a commercial real estate practitioner’s favorite subject, as green is the color of money! After all, that is why we all do what we do! The point of any business is to provide an income to live, pay your bills, support your family, and support your favorite charity. CRE agents work with businesses and investors every day to help them build and grow Tony Veldkamp their business or their income through 2016 CID President investment. Our business is to help their business. We focus on “going green” every day. In order to help others, you have to help yourself first. We have all seen the safety video on an airplane that says; “please put the oxygen mask on yourself first before helping others.” So what are you doing to help yourself build and grow your CRE business? What are you doing to build your business before you go out and help others with their business? We all spend time working IN our CRE business, but what are you going to do in 2016 to work ON your business? I had young agent in my office the other day looking to join my brokerage. In telling her how to be successful in Commercial Real Estate I started listing the things that she could begin working on to build her business. I realized that there are three main categories that a CRE professional needs to master to be successful. Sort of like the 3 legs on a stool. Even experienced professionals, who have been at this for many years, can look at these three areas, or legs, and figure out what they are weak in and to try to focus improvement on. The first area or leg is the market. This seems simple enough and most agents will spend most of their time on this leg of their stool. But are you really focusing your time and effort to learn everything you can about the market you work in, the product you are trying to sell or lease, and the players in that product type? Even though we are in a tertiary market and many of us sell or lease many different product types, because you have to in a tertiary market to make a living, what are you the expert in? Are you an I-75 office corridor expert? An east Manatee land expert? A Venice industrial expert? It is okay to do a little bit of everything in commercial real estate, but you need to have one focus that others will come to know you as the expert on, that you learn everything you can about. If you are going to be the downtown Sarasota leasing expert, then you need to know and understand every building in the

downtown core and their competition in the surrounding areas. What are the lease rates, pass through expenses, building owners, building features, etc.? Know your product, your market and the players in that field. The second leg of the stool is to know, understand and utilize the tools that your brokerage provides you, RASM provides you, or the ones that you purchase on your own. Are you getting the most out of your tools and utilizing them to get your money’s worth? For marketing commercial properties here at RASM you can select My Florida Commercial Real Estate (MFCRE). This is a Catalyst based system that we use to market our listings to other CRE professionals. If you are only putting a commercial listing in MLS, you are missing most of your audience; other CRE agents. Then there are other paid marketing services like Loopnet, Commercial Search and many others to market to the public. For data research you have the public records websites you can search, but many in our market are also subscribing to a CRE research tool like Xceligent or CoStar. These help you research all CRE properties both on and off the market, who owns them, and sometimes the tenant in the building. These programs make searching for comparable sales much quicker but they can be costly. You have to do a cost-benefit analysis to determine if they are right for you. For keeping track of your clients a client management tool is imperative. After all we are in a relationship business, not just the real estate business. Who are you fostering relationships with? Using Outlook is not a client management tool. There are many on the market like Apto and Clientlook and others that have amazing tools to keep track of who you are reaching out to on a regular basis. There are many other programs for writing contracts, sending out e-blasts, keeping track of documents, etc. But if you are not using them on a regular basis, understanding how they work, and how to apply them to your business, you may need to work on this leg of your stool. The last or third leg of your stool for CRE success is understanding sales, the sales process and sales techniques. There are simple things you can lean and apply to become a better sales person and to represent your client better. Brokers Who Dominate by Rod Santomassimo is a must-read for all CRE professionals and there are many other books out there on learning sales tips and tools. Rod and others also offer webinars, conferences and personal coaching to help you be a better CRE professional. So in working ON your CRE business as they say “there is no time like the present.” Which leg of your stool do you need to work on so that you can “go green” more often and more regularly. Realtors® in Florida need to have an understanding of the impact of the everchanging exchange rate between the US Dollar and other world currencies to better serve their clients and customers. All foreign nationals buying, owning and selling real estate in Sarasota and Manatee Counties will be influenced by the exchange rate between the US Dollar and the currencies of other countries Marie Avery with which they have an association. 2016 Global The combined decisions made by these Business Council Chair foreign nationals will have an effect on the Florida real estate market, both residential and commercial, as a whole. Most residential real estate purchases and sales are made for lifestyle reasons, but all residential real estate purchases and

The return on investment, either positive or negative, for a foreign national will change as the exchange rate changes if their primary financial base is outside the US. If the costs of their vacation or snowbird residence is to be met from ‘income’ from outside the US, any change in the exchange rate will increase or decrease their costs of ownership perhaps to an extent for them to change their lifestyle decisions. Consider the following simplistic example of a foreign national who bought a home in February 2006 for $100,000 with a US Loan of $65,000, interest only.

So the foreign national may decide to sell the home for the same price as paid for it 10 years earlier to take the ‘profit’ on the exchange rate and take the net proceeds back to the homeland. But another foreign national may look at the property at its 2016 Value and Ownership Cost and decide to invest in the home after comparing it with the alternative investments and lifestyle choices in his or her homeland or elsewhere in the world. Therefore, the exchange rate is an important factor for a Realtor® to bear in mind when dealing with real estate in Florida. Evictions: Real World Facts and Best Practices

Living in community associations can be a daunting task. It is the Realtor’s® responsibility to ensure that their clients have read all of the disclosures and governing documents in order that their lives be peaceful and predictable. In this seminar, we will attempt to hit the major items to look for in reviewing community association documents. We shall also cover many of the nuances in selling association controlled property, including the issues of seller disclosure, the use of limited common elements and their maintenance and repair, foreclosure, REO sales and unpaid assessments. The seminar will compare and contrast a sample Declaration of Condominium and Declaration of Covenants and Restrictions in order that the Realtor® might better advise their clients on safely moving forward at contract time. About the speaker: Bob is currently Private Counsel to the Manatee County Value Adjustment Board, working on zoning and land development issues and regularly engaging in the creation and representation of community associations throughout Manatee and Sarasota Counties. Evictions are being contested at a record rate. Residents are hiring attorneys at a record rate. While many residents have no legal basis for contesting the eviction, they are still able to file an answer with the court and too often get a court hearing, which causes significant delays. Most of the time, the resident does not win in court, but the resulting delay causes significant financial harm to the manager. Most of the materials covered are actual cases filed in Broward County, Florida. Your instructor was the plaintiff in each of these cases and will guide you through the process from start to finish. There are three distinctly different evictions, all of which are the types you will encounter if you own or manage rental properties. Myakka City

By Mary Vavala, Keller Williams of Manatee Photo Credit: Detlev von Kessel Miakka (or old Miakka) was established in the year 1850 by a group of cattlemen and had a school, church, post office, country store and telephone service. The common story behind the spelling of Myakka is that when the city was registered on the federal map for a post office, the hand writing was poor and couldn’t be read so Miakka became Myakka. Myakka is located in Southeast Manatee County, along State Road 70, near Bradenton. This quaint, picturesque piece of Manatee County has a population of approximately 22,834, as of 2007. The average home price, sold within the last 6 months, is $285,000, making Myakka County an affordable option for many looking for quiet, country living. Home styles in Myakka vary depending on the builder and homeowners’ choice. However, many homes styles are one story, with cinder block construction, with home sites starting at 1+ acres. “Cracker-Style” homes are popular as well, featuring a large front porch, often wrapping around the entire home. The open, undeveloped land and large home sites make Myakka the perfect location for raising horses and other farm animals. One look and there is no doubt why residents refer to Myakka as “Country Living at its Finest.” But what exactly does that mean? So I asked the residents of Myakka what they loved about living out here and the overwhelming response was that “it’s so peaceful and quiet… yet still close to restaurants, shopping and parks”. Home owners love the landscape, open fields and wild life that visit in your back yard. On clear nights a constellation of stars so stunning and bright brings back childhood memories. Plenty of room to stretch out and have barns/garages for toys, hobbies and working equipment. Mostly though, the kindness, caring and close knit community some will never know or experience. It’s like taking a step back in time, with modern conveniences such as Myakka Fitness, Myakka Market, Crowley’s Museum and Nature Center, Myakka River State Park to name a few. You’re still close to Lakewood Ranch restaurants, movies, UTC, Sarasota and Bradenton without living with all that traffic and noise. I-75 is minutes away to areas north and south of us. Country living at its Finest, not for everyone but exceeding expectations for those looking for a place to unwind and slow down, if even for a moment and enjoy life as it used to be. www.MyRASM.com

Sarasota Chapter The Women’s Council of Realtors®, Sarasota will be celebrating their yearly District Conference on April 6th, 2016. This luncheon will be held to welcome our 2016 State President, Audrey Lackie to our District. The 13th District consists of the Manatee, Sarasota, Venice, Punta Gorda/Port Charlotte Chapters and as an extra added bonus, Alfredda SmithOdato the Tampa Chapter from District 6 will 2016 WCR be joining us for the occasion this year. President Sarasota Chapter The event will take place at the Polo Fete Grill in Lakewood Ranch from 11:00 a.m. to 2:00 p.m. Please come and help us welcome our State President to this beautiful place that we call home. Speaking of this beautiful place, did you know that Lakewood Ranch is the Largest GREEN Community in America? Every home in LWR meets the Florida Green Building Coalition’s Green Home Standard because all of the builders are using more energy-efficient products and techniques that result in healthier and environmentally responsible homes in every home in the communities. Building Green can be challenging at times and style, convenience and comfort are never sacrificed as they balance the more efficient way of building and protecting the land that surrounds the communities at the same time. According to the LWR website, caring for and preserving the environmental and ecological consequences when land is cleared is of the utmost importance. Unique wildlife habitats are left intact and paths are routed to preserve the integrity of the natural resources that Lakewood Ranch has to offer. The water is reclaimed and recycled, only indigenous plants and trees are planted. Careful planning and vigilance resulting in an environment where man and nature can live in complete harmony. Our area is so lucky to be able to boast of such a wonderful place to live. We are looking forward to presenting District 13 & 6 to our State President when she visits in April.
