SUPERCHARGE YOUR ESTATE PLANNING – MAKING THE BEST OF A DOWN MARKET By: Scott G. Beattie, JD, LL.M (Tax) Certain life events cause people to focus on their estate planning: the death of a friend, a trip out of country, surgeries, births, marriages and deaths in the family being among them. For wealthy individuals one of the best times to focus on estate planning is in a bad economy or down market. The combination of low real estate values and low interest rates are very favorable conditions for wealth transfer planning.

Most people aren’t attuned to this fact. They are focused on cash flow and bottom line business issues. But there are a number of wealth transfer strategies which provide supercharged planning benefits when values and interest rates are low. Frequently these strategies can also be used to produce immediate returns in the form of property tax and income tax savings given a well thought out plan.

So how can you take advantage of low values and interest rates? Among the strategies which are more powerful in a down market are: (1) Leveraged gifts using Family Limited Partnerships and LLCs; (2) Intra-Family Installment Sales; (3) gifts using Grantor Retained Annuity Trusts (GRATs); (4) intra family sales using Private Annuities or Self-Cancelling Installment Notes; and (5) combination charitable and family gifts using Charitable Lead Annuity Trusts (CLATs) which pass an income interest to charity and remainder to family.

These techniques can be powerful devices for mitigating estate taxes and can be used in combination with income shifting strategies (to shift income to younger generation family members in lower income tax brackets, producing an overall tax savings for a family) and in combination with plans which lock in long term property tax savings. Done right, your estate plan can enhance your cash flow and improve your bottom line.

For purposes of estate planning, the interest rates in question are the “Applicable Federal Rates” of interest (AFRs) and the adjusted midterm rates under IRC §7520 (the “7520 Rates”). The 7520 Rates used for estate and gift tax planning purposes have trended from highs back in the mid 80s in excess of 10% down to the current all-time lows of 1.2% in October 2012. If you own an asset with a return greater than the 1.2% assumed 7520 Rate, you can create positive leverage in a wealth transfer.

There are many nuances to the design of estate and business planning transactions depending on whether the senior generation wants to retain cash flow or shift it to the younger generation, whether they want to recognize or defer income tax on the transaction and whether long term property tax savings are part of the mix.

The good news is now is the perfect time to work these things out while the Estate and Gift Tax applicable exclusion is high (currently at $5.12 Million per donor/decedent). The exemption may drop back to 2001 levels of $1.0 Million per donor/decedent when the current law expires at year end. Hopefully Congress will act to retain the present exemption amounts at $5.12 Million.

As with most tax and legal subjects, there are many complexities in the law relating to techniques mentioned in this article. IRS Circular 230 requires that I advise you that you can’t use the information in this article as grounds to avoid potential tax penalties. You should not make changes to your current estate planning without consulting experienced professional advisers so you can consider a number of variables and issues (e.g., how to handle outstanding loans) which are outside the scope of this article.

Giving Back With all the attention food and football get on Thanksgiving, it’s easy to forget the “giving” part. A couple years back, my son really wanted to find a way to help people during the holidays, but in San Joaquin County, sometimes it’s hard to figure out where to start. There are so many people and organizations in need this time of year and so many people ready and willing to help, but not everyone knows where to turn. My son and I ended up going to McDonald’s and picking up a couple hundred dollars worth of gift cards so we could pass them out at a nearby

Keep it fresh for the holidays

After the corn has been shucked and all the pumpkins pureed, Dell’Osso’s famous family corn maze is transformed into a snowy winter wonderland. For the past three years the Dell’Osso family has helped define winter in San Joaquin with its spectacular light show, snow tubing, and ice skating.

Between November 23 and January 5, Holidays on the Farm returns with impressive additions. You’re sure to find great stocking stuffers and seasonal treats in the general store onsite, and kids and adults alike will find fun visiting the petting zoo or picking out fresh Christmas trees before taking a tour of the light show at night. For a more classic feel let the train, horse-drawn carriages, or open air hay ride ferry you through the farm.

With almost one million dollars donated to date, the Dell’Osso farm has been sharing proceeds from their events with non-profit organizations for four generations. With a good cause benefiting from your good fun, there’s no reason not to get out to the farm before the season slips away.

FRENCH AT HEART

Everyone has that one friend or family member that’s impossible to shop for—the person who goes out and buys all the latest gadget or toy for themselves before anyone can pick it up for them. One of Lodi’s newest shops, French at Heart, may have the answer to your toughest gift buying conundrums.

“Our concept was to blend new with old, to be where the past meets the present effortlessly,” says Kay Claxon, owner of French at Heart. This isn’t Kay’s first retail venture - she owned Ocean Avenue and Bambini’s in Lincoln Center, and spent several years working in hospital gift shops and she is drawing on her wealth of experience and support of her family to help French at Heart carve out its niche in downtown Lodi.

“Working with nurses helped give me a feel for the things people want to shop for,” she says.

Each desk or chair or apothecary bottle you may find fits the rustic French theme, and pieces match so well that it’s difficult to tell merchandise from store decor.

There are also a variety of plants and terrariums for sale, from orchids and succulents to low maintenance air plants and books to help keep your garden green.

Kay, whose maiden name is Veuve, comes from a French family and was inspired by her heritage when setting up shop. “My dad would probably be really happy,” Kay says.

Kay is enthusiastic about antiques and has brought pieces back from Berkeley, Calistoga, Napa, Las Vegas, and around Lodi

to fill the store. Her 9-year-old son, Charlie, often goes with Kay on picking trips and has learned a thing or two about antiquing. “He’s a negotiator. He’ll go to an antique store and work a deal,” says Kay. Charlie is happy to show customers around the store and point out his favorite glass bottles and flower frogs. French at Heart is an entirely family run business, with Kay’s husband David doing the heavy lifting and Kay’s daughter Amanda helping run the store and handling Internet sales. The Claxons built a nursery upstairs so Amanda can bring her infant daughter, Hannah, with her to work.

Kay is careful to keep her costs, and thus her prices, low by taking advantage of technology. Shoppers can use their PayPal accounts when checking out or swipe their credit cards on the store’s iPod, which also accompanies Kay and Charlie while they’re looking for new merchandise. “The good thing about it is we can take it wherever we pick so we can take pictures of stuff,” says Charlie. New finds are posted regularly on French at Heart’s Facebook account so you can preview this charming store’s merchandise online.

The best rule of thumb is to be mindful and courteous. “While tweeting may be second nature to you, it isn’t always the way to go,” Crowley says. “If the host is working with an abbreviated guest list, check with her before tweeting.

I would rather guests spend their time at the party socializing rather than updating their status, so keep pre-approved posts to a minimum and always positive.” If partying at the office, remember your boss is there, too. “You’re among fellow professionals,” Crowley cautions, “so tweeting about how bored you are won’t help during your next review.”

“As hostess, I prefer my guests turn off their phones or set them on silent upon arrival,” says Crowley, who also appreciates a head’s up when guests may need to be MIA to take a call or text (an especially appreciated nod when occasions call for timed sitdowns like dinner). When in doubt, use common sense. Take and make calls out of the earshot of other guests, and only if need be. If using your cell isn’t crucial, power down for the duration. Taking photos is OK, but post them at another time.

PARTY CIRCUITS Technology is a great numbertwo man, so put it to use! Use detail-tracking apps (Crowley likes myGuestList.com and MyPartyPlanner.com); set up a dock for smartphones so guests can pipe in individual playlists from their digital libraries and arrange for private photo sharing! Smartphone apps like PhotoCircle encourage party guests to upload their photos to a private online album.

For pretty evites on the cheap, Crowley favors PaperlessPost.com. “I tend to shy away from sending invites for social events via Facebook and Twitter because they can feel impersonal, people don’t always check their accounts, and how special does an invite sent to you and 800 of your closest friends or followers feel?” she explains. But, if determined to distribute invitations through Facebook, do so privately so that only invitees are privy to the details.

C H A R I T Y S P O T L I G H T Through the hard work of volunteers and future residents, Habitat for Humanity takes aim at homelessness and strives to make sure everyone has a roof over their head.

As the wind howls and the rain sets in, we put a fire in our step as we scurry through our front door to escape the cold. But in an economy where housing is as fragile as a fault line, there is an ever-growing population of people and families who find themselves homeless. As in all desperate times, desperate measures are being taken by Stockton’s local affiliation with Habitat for Humanity that serves as a means to put people back into homes.

More than 500,000 affordable houses have been built by HFH volunteers around the world. Habitat for Humanity of San Joaquin County, Inc. is entirely run by a board of volunteers and has been building low income, affordable housing since 1993, with homes in Stockton, Lodi, Tracy, Manteca, and Woodbridge. Homeowners helped by Habitat for Humanity invest hundreds what

is considered a ‘sweat equity;’ hundreds of hours of their own labor into building their own Habitat home as well as assisting other partnering families. In agreeing to help themselves they also agree to help others, and it is in this that we find the core mentality of Habitat for Humanity’s goal in not just building homes, but also communities and friendships that are stronger than the framework for any house. “Habitat is not a hand out but rather a hand up,” says president John Shores.

Aside from building homes, Habitat for Humanity also utilizes donated materials in their Restore project, a shop on Stockton’s Fremont Street where new and gently used home improvement items are sold to the public. It is a DIY treasure hunt, with wares varying from bathtubs, trim, flooring, doors, lighting, sinks, and vanities to name a few.

Every purchase made goes to help HFH build quality housing in San Joaquin County.

Additionally, the Solar Habitat project is currently in full swing, installing solar panels on homes that are being built to promote energy efficiency and drastically decrease electricity bills.

Ever-promoting community growth, Habitat proudly partners with California Human Development Agency as well as Lincoln High School Construction Department faculty to provide hands-on raining for their respective students. This unique opportunity for students to gain real-life experience and training has opened opportunities for graduates to be offered employment down the road.

Tracy and the Spanish Flu

As early as January 1918 the world, still waging World War I, faced an unknown enemy that silently slipped through every corner of the populated earth. The Spanish Flu Pandemic lasted until 1920, eventually claiming between 50-130 million of the Earth’s population. In California, the flu first appeared in San Francisco in September of 1918, eventually spreading to the nearby communities and making its way to Tracy.

In Tracy, Dr. A.R. Powers gave a speech at a city meeting about the dangers of the flu and measures the city should take to keep the impact low. After speaking, he was appointed

City Physician and Health Officer. From the start, Dr. Powers had conflicts with the Board of Trustees and their leader Nelson Dwelly.

Dwelly’s priorities lie with the local business, particularly the saloons.

When the first death in Tracy occurred because of exposure from the local Army Camp, Powers argued to close all public places, with two exceptions; the schools would remain open as it was determined it would be safer than giving the children the opportunity to be outside and running around, and the saloons, kept open against Dr. Powers advice but thanks to the power of Dwelly. Nevertheless, the schools closed soon after due to low attendance rate of students and teachers. The city Health Board’s attention turned to the saloons.

On October 24, the Board called a special meeting, the sole purpose of which was to close the saloons. The conflict emerged over whether or not the Board could supersede the Board of Trustees and close a business. The decision was finally made by the California State Board of Health, siding against Dwelly and the Board of Trustees and the saloons were closed.

But the decision came too late and the flu spread rapidly through Tracy. The local Methodist Church was converted to a hospital

with local citizens donating what they could.

The city passed legislature requiring citizens to wear masks and outlawed spitting. The precautions seemed to be working and many of the bans slowly began to be lifted, including those on the saloons. Dwelly took on the power to lift bans himself and removed many without the permission of the Board of Health. The Health Board became enraged at his audacity and many members resigned, including Dr. Powers.

The Spanish Flu returned swiftly, resulting in a special meeting Dwelly could not attend due to an unnamed illness. The meeting requested Dr. Powers return to his previous position; upon being reinstated he resumed all the previous bans without any objection from the Board of Trustees. The second wave was fairly light thanks in large part to the immediate bans resumed without interference.

Due to Dr. Powers and his resolve to limit the spread of the flu as much as possible, Tracy was not hit as hard by the Spanish Flu as some places. However, many more victims died worldwide than needed because the World War I war efforts took precedence over quarantines or other precautions on the home front.

ITALIA Art, music, fashion: Italy has it all. When we look at Italian culture we associate it with the positive things in life—spirited living, being amongst friends, and enjoying family. As the Italians are aware, nothing helps us celebrate these things more than great cuisine. Food isn’t just a body’s energy source in that boot-shaped country across the Atlantic; it’s a way to bring people together and reminisce about a day gone well because a full belly leads to a full heart. Like all great things, Italian food is meant to be enjoyed and we know just the places to show you how it’s done.

PIETRO’S OF LODI: BEL PAESE PIZZA

A local take on an Italian classic, the Bel Paese pizza dished up at Pietro’s of Lodi will steal your heart. Pietro Murdocca, whom the restaurant is named after, first served up the original crust recipe fifty-six years ago. His son continues the legacy and uses the same recipe as the foundation for this flavorful pizza. Smothered with Californiamade Corto olive oil rather than a more traditional marinara sauce, creamy Bel Paese cheese is then spread atop the pie, followed by San Daniele prosciutto. Imported from Italy, San Daniele prosciutto is sweeter than the more traditional prosciutto di Parma and brings the richness to this meal. Local asparagus and fresh basil are added before the pizza is baked in a brick oven to guarantee that flavorful, crispy texture. For those who shy away from the meat-based meals, Pietro’s offers a variety of vegetarian friendly dishes, such as the pesto vegetarian pizza or the handmade raviolis (just be sure to ask for a meatless sauce). Boasting great portions, reasonable prices, and authenticity that can’t be beat, Pietro’s menu has something for everyone. Plus, the cozy atmosphere of the restaurant is sure to draw you in.

STOCKTON JOE’S: STEAK A LA VARNI The steak a la Varni at Stockton Joe’s new location on Lincoln Center’s brickwalk is the go-to dish for those wanting to indulge in a perfectly prepared cut of beef. Stockton Joe’s uses the best flat iron steaks, cut from the shoulder of the cow, for its ideal tender texture. The restaurant’s most popular dish for over thirty-six years, this certified Angus steak will be charbroiled to perfection and dished up with your choice of side.

The smell of rosemary and garlic is unmistakable as you cut into it, and it’s sure to make your mouth water for more. Named for the family who opened Stockton Joe’s doors in 1976 and still runs it to date, the steak a la Varni cannot be missed. If steak isn’t your favorite then don’t worry!

BUENO ITALLIANO CAFE: EGGPLANT PARMASEAN When it comes to eggplant, no one does it better than the Italians. Lodi’s Bueno Italiano Café knows this well and prides themselves on an eggplant parmesan so good that it sells faster than they can make it. If you’re wary of the purple squash then let us assure you that this fare is molto benne. Made in a 1930s style, the Lodi-grown vegetable is sliced into hearty steaks that are breaded and cooked in olive oil. Jack cheese and a tangy ragu marinara made from masala tomatoes will accompany the squash to make it one of our favorite Italian classics. Found upstairs in Lodi’s Bella Terra Plaza, the terrace seating at Bueno Italliano will remind you of a warm spring day (or a chilly winter afternoon) in Rome with its water fountain, cheery umbrellas, and flowers abounding. Decorated with photographs of the family’s Italian hometown of Caraglio, Bueno Italiano understands the relaxed appeal of Italy and recreates it for us in amiable detail.

ANGELINA’S: SPAGHETTI Angelina’s Spaghetti House is just what it claims: the place to be if spaghetti is your dinner du jour. Eleven different types of spaghetti await you at Angelina’s, with something available for everyone. As you try and decide between the ever popular meat sauce or the untraditional jalapeño-infused hot and spicy, keep in mind that these original sauce recipes have been used and inspired by the gravy first served when the doors opened in 1976. Dress up your spaghetti dinner with meat balls, or try out their spaghetti with calamari if you’re a sea lubbing eater. Their sizeable portions are available at half order upon request.

DE VEGA BROTHERS: CIOPPINO While cioppino is technically an Italian-American dish originating across the way in San Francisco, DeVegas Brother’s has made this hearty fish stew is a winter staple for any Italian foodie. The fish of the day is chopped and stirred into a pot of saucy tomato stew with the freshest clams, scallops, mussels, shrimp, and crab legs still in the shell. By the time the soup is served, the seafood is so tender it will melt in your mouth. Freshly made cappelini, or angel hair pasta, is served on the side to keep the noodles from becoming soggy, and each customer can decide for themselves how much pasta they want in their soup. If you’re like us, you’ll save a bit of the saucy broth and enjoy it with your noodles after indulging in the fish and veggies that have taken on the seasoned flavor of the tomato sauce. The aromatic fresh garlic bread that comes with your dinner will help soak up every last bit of this wonderful stew. Take advantage of the patio seats before they all fill up, and peruse the extensive wine list that features many local appellations. With a made-from-scratch minestrone and clam chowder that gives San Francisco a run for its money on the menu, De Vega Brother’s is the place to be for the soup lover in all of us.

FABIOS: LASGANA It’s impossible to think of Italian cuisine without lasagna. It’s even harder to think about lasagna without Fabio’s. While their menu hosts a variety of traditional Italian meals guaranteed to please, the single serving lasagnas dished up here are out of this world. Prepared every morning before the restaurant opens its cast iron doors for dinner hours, these delicious dishes are a haute commodity. Only twenty or so are made every day so it’s first come, first serve where Fabio’s lasagna is concerned. The iconic square noodles are layered in meat sauce, fresh ricotta cheese, mozzarella, and parmesana reggiano, then baked to perfection. It can’t be denied that the lasagna is fantastic, but the highlight for patrons is enjoying the top layer of dark brown cheese that has been baked to heavenly hue. It is not uncommon for the top to be pulled off and saved for last, because we all know that’s where the best deserves to be as far as our food is concerned. Be sure to save room for dessert, as all sugary treats at Fabio’s are hand made by the owner and her daughters. The romantic interior at Fabio’s pulls in a large number of first dates, owner Roe Bridges comments, and for very good reason. Whether it’s your first date or your fiftieth, Fabio’s will serenade you with its charming atmosphere and family-owned vibe.

MEZZO: GNOCCHI If you’re craving pasta but want to break away from the traditional, the gnocchi at Mezzo’s is the dish for you. Russet potatoes, eggs, and flour make up this portly pasta ball, and Mezzo’s has it down to an art. There is no recipe for their well-known menu item; the fresh dough is kneeded by hand until the consistency and texture are just right. Fresh peas and applewood smoked bacon are tossed in a light alfredo sauce with the pasta, and pecorino romano is grated on top to complete this dish in the most flavorful of ways. If you are of the carnivorous persuasion, grass-fed beef or organic chicken can be easily added to your meal upon request. Only the freshest of ingredients are used at this Stockton hot spot, with everything made in house and local produce used when available. With heated patio seating, a full bar, charming interior, and family friendly environment, there is more than enough room for you and your appetite at Mezzo’s. This winter keep an eye out for sweet potato or butternut squash gnocchi variation that will add a cozy flavor to the pasta.

Local food banks spend much of their busy holiday season fielding calls from holiday help seeking seasonal volunteer opportunities. But different food banks have different needs.

About ten thousand people will benefit from food bank boxes and hot meals from the Valley’s three largest distributors, according to their representatives. Food banks need help right now with packing boxes; they also need drivers and a host of other volunteers.

Second Harvest volunteers work Monday mornings and Tuesday and Thursday afternoons sorting food. The food bank partners with local food pantries to serve about 350,00 hungry people a year. There are an average of about twenty to thirty volunteers a shift, but that number varies. Second Harvest is also seeking drivers to pick up donation barrels. Drivers must have a good record and will drive the food bank’s trucks. You must be over 18 to volunteer for the food bank.

St. Mary’s needs volunteers starting the Monday before Thanksgiving, when the kitchen starts preparing as many as a thousand hot turkey dinners. Some 300 volunteers will show up on Thanksgiving Day, but the food bank’s most pressing needs aren’t then, says St. Mary’s CEO Edward Figueroa. “Everybody likes to come on Thanksgiving,” he says.

“The real need for assistance is the days leading up to Thanksgiving.”

St Mary’s needs twenty-five volunteers every day of the year to feed its 700-plus families. Children younger than 14 can work in the kitchen with an adult, and those as young as five can accompany a parent in serving meals. Sometimes the kitchen is short of volunteers and the needy step in to help. Figueroa encourages volunteers to consider helping out at times other than the holidays, adding there are other options for volunteering. Clothing drives are ongoing at the food bank, for example. Gardeners can help keep the landscape tidy, too. “It’s a continuing need that’s 365 days a year,” Figueroa says.

Micke Grove Zoo is another example of year-round opportunity.

The zoo needs about twenty volunteers nightly to help with activities at the annual holiday Zoo Lights. Then in January, Kelly Morris and others at the zoo start trainings for a new crop of volunteers. About thirty volunteers from ages 12 to adult work at the zoo now, doing everything from preparing animal food to educating school groups.

Volunteers are asked to make a six-month commitment to the Zoo Keeper Aid, Zoo Ambassador and Zoo Education Docent programs, Morris says. “Most people are excited to find out they can volunteer here,” Morris says. “We need them.”

The holiday canned food drive can be just the beginning of a new tradition in year-round giving. There are dozens of other opportunities for holiday and year-round volunteering in the Valley. “There are all kinds of ways to make things better,” Derby says.

There are other ways to share the holiday spirit. Local animal shelters, convalescent centers, veterans groups, and even the zoo are happy to get a little holiday help. Like the food banks, their need for volunteers is year round. “Every food bank always needs volunteers,” says Andy

GIVING BACK THROUGHOUT THE YEAR Nonprofit groups suggest families make a holiday commitment to spread their volunteer cheer throughout the year, but it can be difficult to find a charity that fits. There’s a database for that.

Stockton’s Volunteers in Services to Aid Stockton (VISTAS) offers links to more than 100 local nonprofit groups looking for help. The database features listing for specific, immediate volunteer needs as well as links to group websites. In 2009, the Stockton city council set up the web page to offer one-stop shopping for volunteers looking to help the cash strapped city with civic projects like

VISTAS is managed by a volunteer executive director and does not draw from the city’s coiffeurs.

“We get so many different versions of volunteers,” says Yvonne Derby of San Joaquin’s largest emergency food provider. “We do tend to have extra volunteers at this time. It’s extremely busy.” Derby coordinates volunteers for the warehouse that feeds up to 6,000 families a year. Food box giveaways the week before Thanksgiving and Christmas draw seventy or so volunteers to help sort, pack and distribute full dinners to about 2,000 families. It’s a huge undertaking, and Derby tries to give every new volunteer group a tour so they can get a real appreciation for the scope of the operation. “They’re always very surprised at how much work it entails.

Their heads spin when they see everything,” Derby says.

This year, the food bank is hoping to find a few drivers to pick up food barrels in their own vehicles. Volunteers need a valid driver’s license and insurance to do pickups. Darby is looking for someone to wear the turkey costume for the Thanksgiving giveaway. She’s looking for a few artistic types in 2013 to provide paintings and create a mural at the warehouse. But do please check with the food bank before showing up.

“I need a heads up if they’re coming,” says Darby, adding that children as young as ten (accompanied by a parent) can help at the food bank.

Through the summer months, the tourist scene in Santa Cruz is dominated by the rollercoasters and midway atmosphere of the Beach Boardwalk. California’s oldest surviving theme park is a large part of the city’s identity, but far from its only facet. Santa Cruz is a city with a wealth of natural beauty and an unmatched spirit of uniqueness. From September to March, when the rides have gone silent, there are still many things to experience in this central coast city.

WHERE TO GO Natural Bridges State Beach Named for its massive bridge-like rock formations, this park is teeming with unique sights and affords visitors the chance to catch a glimpse of a stunningly

diverse marine ecosystem. On a good day, a lucky park-goer can spot migrating whales, seals, or playful otters just offshore. Not far from the beach area, low tides reveal myriad forms of ocean life. Tide pools are often filled with colorful starfish, anemones, and temporarily trapped fishes. These sights alone set Natural Bridges apart from other parks, but it is home to another unique phenomenon.

For about half the year, October through early March, this state beach becomes a sanctuary to nearly 100,000 monarch butterflies. The monarchs are attracted to the area’s temperate climate, eucalyptus groves, and plentiful supply of food. The park is home to large amounts of milkweed, the only plant monarch caterpillars can eat. The Monarch Grove is California’s only state monarch preserve.

Docent-led tours of the butterfly habitat, tidepools, and various nature trails are available, and they also maintain a milkweed garden where visitors can view monarch eggs, caterpillars and chrysalides up close.

The Mystery Spot Tucked deep in the redwoods up a mountainous road lies the quirky attraction The Mystery Spot. Claiming to be a “gravitational anomaly,” the centerpiece of The Mystery Spot is the badly lopsided cabin located atop a steep hill. Once there, patrons are greeted by a slew reality defying spectacles. Tour guides demonstrate balls rolling uphill, a broom standing on end, and even a few illusions where participants appear to switch their heights.

The guides keep the tours light and entertaining and pepper each group with ad-libbed comedy and quick puns, making sure each visit is a unique experience.

Audience participation is encouraged and can lead to some great photo opportunities. At the end of every tour, everyone is rewarded with The Mystery Spot’s distinctive yellow bumper stickers.

WHERE TO EAT

Chardonnay II The Chardonnay II allows passengers to experience the beauty of the Monterey Bay from the water. This seventy foot sailing yacht is designed to provide a wide range of experiences, from wine and beer tasting excursions to culinary events featuring local chefs and restaurants, and even afternoon pizza lunches. All of these charters are offered while the boat takes a tour of the stunning coastline. Options are available for all times of day and every day a week except Mondays.

Saturn Cafe True to its name, the Saturn Cafe seeks to offer an “out of this world” dining experience, says manager Humberto Olivera.

The design of this restaurant is evocative of kitschy sixties sci-fi. Images of robots and rocket ships complete its extraterrestrial decor. All of the offerings are 100 percent vegetarian here, but that doesn’t mean it’s in the realm of flavorless tofu and rice cakes. Saturn Cafe boasts a broad menu filled with tasty offerings, including decadent deserts like the Chocolate Nova shake and hearty entrees like their crunchy potato taco plate.

Burger The simply named Burger offers a great snapshot of the unique character of Santa Cruz. Diners are greeted immediately by a large menu filled with colorfully named dishes. Most of their offerings bear the names of pop-culture icons like the spicy Chuck Norris jalapeno burger or the bacon wrapped Notorious B.I.G. The interior is sleek, hip-looking, and sports an expansive bar. In a fun bit of Santa Cruz weirdness, the tables are not numbered. Instead, customers are instead given placards featuring celebrity mugshots when they order for their waiter to identify their table.

Burger is not only concerned with coolness and prides itself on its high quality ingredients. All of their beef is grass fed, and they use local produce and products wherever possible.

Like Burger, Saturn Cafe does not sacrifice substance for style. They are a certified green business and have been heavily involved with the community since they opened thirty-five years ago.

The Cliff Crest Inn is a convert-

ed Victorian mansion that was built in 1887. The inn was purchased in 2001 by current owners and operators Constantin Gehriger and Adriana Gehriger Gil. The pair pride themselves on hospitality and Adriana’s own artwork decorates many of the walls. The highlight of this bed and breakfast is the solarium, which was originally designed by John McLaren, the architect of Golden Gate Park in San Francisco.

Local Lodi

The rarest Lodi wine of all

Many Lodi wine lovers know and appreciate grapes that visitors to other wine regions are not so familiar with.

Grapes like Primitivo, a clonal variation of Zinfandel; Tempranillo and Albariño, the finest wine grapes of Spain, transplanted in Lodi’s Mediterranean terroir with smashing success; or Verdelho, which originated in Portugal, and makes deliciously light, lemon/lime scented dry whites.

But very, very few students of a vine have heard of Marzemino, a member of the European family of grapes (Vitis vinifera) that is rare even in its native Northern Italy (primarily the Alpine region of Lombardia).

Marzemino is so rare and obscure that Barbara Huecksteadt, the owner/ winegrower of Lodi’s Hux Vineyards, has to bottle her Marzemino as Dave’s Aria, without the name of the grape on the label because the agency (the ATF) which regulates the language on the label of each and every bottle of wine made and sold in the U.S., has never heard of Marzemino either!

As such, the 2008 Hux Lodi Dave’s Aria ($25) may be not only be the rarest bottle of wine produced in Lodi, it is also a spectacularly rich and wildly flavorful red wine—deeply bluish-violet in color, with soaring aromas of crushed black cherry and blackberry tinged with sweet licorice veering towards caraway; thick, velvety, viscous on the palate. Deliciously, achingly memorable.

The Marzemino vine itself yields such black colored, gargantuan clusters, it is practically the last to ripen in the Delta.

Last year, in mid-October 2012, we watched as Ms. Hueckstead hand picked the final two rows of grapes left unpicked in the region – all by herself, as she customarily does each year, snipping and lovingly placing each hefty bunch into her trays while talking about the vintage – pretty much summarizing the story of 2011 for just about every winegrower in Lodi.

“Since we knew 2011 would be an unusually cool year like 2010,” Huecksteadt told us, “I pulled leaves aggressively and dropped twice as much fruit as I did the year before in order to get the grapes to sugar up – otherwise the grapes wouldn’t ripen at all. One year I picked the Marzemino in November, closer to Thanksgiving – nearly a month after everyone’s Cabernet Sauvignon came in. In 2010 we barely got it to ripen past 22° Brix (i.e. sugar reading), and we ended up with less than half a ton.”

A half-ton of grapes produces only about 30 cases of wine, or 360 bottles, give or take—barely enough to get an Italian family through a year (at least in the old days).

“2011,” says Huecksteadt, “was another small crop, but at least I got a full ton. The Brix was about 23.5° — not as much as I wanted, but still producing an intense wine, and you could see how beautiful the clusters were… almost no rot, despite the rains earlier in October.”

Hux Vineyards was originally planted in the late nineties by the late Dave Huecksteadt, and the 2008 bottling of Dave’s Aria is Barbara Huecksteadt’s tribute to Dave’s visionary winegrowing. When she isn’t engaged in her fulltime day job as Project Manager of San Joaquin County’s Oriental Fruit Fly Project (currently a huge concern to Lodi’s cherry industry), you can find her in her tiny vineyard in the center of Lodi’s Mokelumne River area, meticulously tending to her amazingly diverse selection of grapes: a planting that includes Grenache Blanc, Rousanne, Graciano, Tempranillo, Souzão, Teroldego, Mourvèdre, Petit Verdot, Petite Sirah, Zinfandel, and of course, those big, black bunches of Marzemino. Oh, the passion of Lodi!

Whisky Barrel Saloon

Lodi is a hot spot for people who want to make a weekend wine tasting trip to sample some local vino, but wine isn’t the only option for those who want to try some spirited sips.

If whisky is your poison of choice, then the Whisky Barrel Saloon is ready for you. Owner Jerry Wolfe and the bartenders take this all-American alcohol seriously, and are happy to share their vast knowledge with regulars and newcomers alike. “The bartenders are highly trained and

know whiskys very well,” says Wolfe.

With sixty-six types of whisky and counting behind the bar, his staff sure has their work cut out for them - but since each tender has been around since the Whisky Barrel opened last November, they’ve had a whole year to figure out their favorites and perfect the house specialties like their Huckleberry Martini (made with whisky, of course).

If you’re not a big fan of the whisky, bourbon, and rye family, fear not, for the Whisky Barrel has a full bar stocked with all the flavored vodkas

you could ask for, and they make a delicious, no-frills margarita out of 100 percent agave tequila, agave nectar, and crushed limes. In keeping with their 1970s Montana saloon motif, Wolfe also stocks old school beers that are almost impossible to find elsewhere, like Coors Banquet (Coors Light’s heartier big brother) on draught, and Olympia (cousin of hipster favorite PBR) in classic gold horseshoe adorned cans. However, if you don’t like whisky, it’s probably just because you’ve never been to the Whisky Barrel – let the bartenders whip up one of their signature drinks and you just might change your mind.

The Whisky Barrel hosts live music with no pesky cover charge on Fridays and Saturdays. Friday nights are all country all the time, and anyone is invited to take free line dancing lessons from 7-9 p.m.

Saturdays bring in a more eclectic mix of classic rock and tribute bands, with an AC/DC act leading off November’s lineup. If you prefer to hop onstage yourself, Tuesday nights are open mic and acoustic band nights, and anyone in the food service industry, hair stylists and barbers, and teachers are invited to enjoy $1 draughts and join in the live entertainment. If live music, Bulleit Old Fashioneds and a big bowl of peanuts sound like your perfect night out, then get ready to make the Whisky Barrel your new favorite spot.

Tucked away in the heart of Lodi’s appellation is the story of a vineyard that happened by accident. Joe Berghold, patriarch of the vineyards ownership, was working in France when a phone call came asking him if he would be interested in purchasing the estate site unseen. Needless to say, he agreed. Upon returning to California, however, he was informed that none of the grapes grown at the vineyard were of the wine-making persuasion, and so from the ground up replanted a vineyard that has been successfully producing grapes since 1986.

In 1999 the first of the Berghold vintage was sold after over a decade of selling grapes to other labels, and business has been booming for our local favorite ever since. Five varietals set this winery apart from the rest: Syrah, Viognier, Cabernet, Merlot, and Zinfandel, all bottled under the direction of son Miles.

The charm is impossible to resist at Berghold Vineyards tasting room.

A short drive through the beautiful property with its open lawns, gardens, statuary, olive trees, and roses will lead you to a tasting room uniquely decorated with an extensive collection - one of the largest in the country - of American Victorian art and antiques.

compliment the collected works found inside, including a Charles Steiff grand piano, thirteen-foot tower clock, a German-styled glockenspiel, and two ornate bars preserved for use in the tasting and barrel rooms. The winery was designed with these pieces in mind, and the result is a striking spot that will feel like stepping out of time and into the past. Pay close attention to the roofline as you walk up to the estates carved cherry doors, once found on an 1800s Philadelphian mansion; the sixty-plus corbels you see along it are the legs of historic grand pianos.

With the success of their wines the winery will soon be expanding their collection with a Sparkling Syrah and Syrah Port. Ever the entrepreneurs, estate-bottled olive oil will soon be sold as well, made from olives grown right on site. Given their distinctive décor and family-centric philosophy, the well-known wedding location is an experience in and of itself.

CAULIFLOWER

What has now become an underappreciated vegetable in our neck of the woods, the misunderstood cauliflower was once king of the crop. Originally brought to North America by Italians in the early 1800s, the cruciferous veggie gained huge popularity from 1920-1944 because it lacked broccoli’s infamous overpowering taste and smell.

However, following the end of World War II, soldiers returning home had acquired a taste for cauliflower’s green counterpart and broccoli boomed in reputation.

Related to cabbage, cauliflower is a bit finicky to grow due to its sensitivity to cold and high heat, making it perfect for our beautiful California climate. Locally it is grown as close as Monterey, Santa Barbara, San Louis Obispo counties and, of course, in the San Joaquin Valley. China and India are also large producers of cauliflower, where it is

an essential ingredient in their cuisine.

Recently the produce industry has seen a growing demand for the non-starchy vegetable due to its incredible health attributes. Low in calories and fat, cauliflower is loaded antioxidant properties that make it a strong cancer-preventative candidate for your menu. With almost as much Vitamin C as a medium orange and four times more potassium per calorie than one banana, cauliflower is just asking to be added to your stir fry and soups.

Take care when cooking, however. Because of the flower buds that crown the top of the stems, cauliflower will become mushy and lose flavor if boiled too long. Popular ways to prepare as a healthy winter side dish are by sautéing, roasting, steaming, or popping them raw as a mid-day snack.

Mashed Cauliflower 2 heads cauliflower, washed and cut into large pieces 2 tablespoons Earth Balance Spread or olive oil ½ teaspoon celtic sea salt Steam the cauliflower pieces until very tender. Puree steamed cauliflower in a food processor, add in buttery spread and salt. Reheat in a casserole dish in the oven at 350° for 20 minutes serve.

Crispy Cauliflower with Hot Parmesan Dip 1 head cauliflower 2 tablespoon olive oil, or olive oil cooking spray Salt & pepper to taste 4 oz cream cheese, softened 1/2 cup plain, greek yogurt 1 tablespoon parsley 1/3 cup parmesan cheese

Preheat oven to 425. Chop cauliflower into small florets and place on baking sheet.

Drizzle oil or spray with cooking spray.

Season with salt and pepper. Roast for 45 minutes, or until golden brown, rotating baking sheet after 20 minutes. For parmesan dip, preheat oven to 375. Combine all remaining ingredients in a bowl and whisk together or mix with an electric mixer. Spoon into a small ramekin and bake for 10-15 minutes, or until top is golden brown and bubbly.
